75th Anniversary of the End of World War II Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 500,000 $1 coins, and 750,000 half-dollar coins in commemoration of the 75th anniversary of the end of World War II. The coins shall be emblematic of the sacrifices made by millions of people of the United States 75 years ago in bringing an end to World War II. The design on each coin shall represent the World War II Victory Medal, which was awarded to all 16 million U.S. military personnel who served from December 7, 1941, to December 31, 1946. The bill requires all sales of such coins include specified surcharges, which shall be paid by Treasury to the congressionally designated National WWII Museum to fund its educational mission of telling the story of the U.S. experience in World War II.

Improving Seniors' Timely Access to Care Act of 2019 This bill establishes several prohibitions, requirements, and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, the bill prohibits MA plans from instituting additional prior authorization requirements for surgeries (including related items) that are furnished to a patient during other surgeries for which prior authorization was not required or was already received. Additionally, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

Stop Dangerous Sanctuary Cities Act This bill prohibits a sanctuary jurisdiction from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program. Under the bill, a sanctuary jurisdiction is a state or local government that has in effect a statute, policy, or practice that prohibits or restricts (1) information sharing with another government entity about an individual's immigration status, or (2) compliance with a lawfully issued Department of Homeland Security (DHS) detainer request or notification of release request. When complying with a DHS-issued detainer, a state or local government shall be deemed to be acting as an agent of DHS with all authority available to DHS officers and employees. The bill also limits the legal liability of a state or local government for complying with a detainer.

Criminal Alien Removal Clarification Act of 2019 This bill subjects to deportation an alien who at any time after admission has been convicted of a felony or two misdemeanors under state or federal law. Currently, an alien is subject to deportation for a single conviction for certain felonies (such as an aggravated felony), two or more convictions for crimes involving moral turpitude, or being a drug addict.

Prohibiting Local Airports from Neglecting Enforcement Act or the PLANE Act This bill prohibits the Department of Transportation from issuing grants to airports that impose unreasonable conditions or restrictions on air carriers operating under an agreement with a government agency, including the U.S. Immigration and Customs Enforcement.

Processing Revival and Intrastate Meat Exemption Act or the PRIME Act This bill expands the exemption of custom slaughtering of animals from federal inspection requirements. Under current law, the exemption applies if the meat is slaughtered for personal, household, guest, and employee uses. The bill expands the exemption to include meat that is slaughtered and prepared at a custom slaughter facility in accordance with the laws of the state where the facility is located; and prepared exclusively for distribution to household consumers in the state or restaurants, hotels, boarding houses, grocery stores, or other establishments in the state that either prepare meals served directly to consumers or offer meat and food products for sale directly to consumers in the state. The bill does not preempt any state law concerning (1) the slaughter of animals or the preparation of carcasses, parts thereof, meat and meat food products at a custom slaughter facility; or (2) the sale of meat or meat food products.

Transit Infrastructure Vehicle Security Act This bill prohibits the awarding of a contract to an entity for the procurement of rolling stock for use in public transportation if the manufacturer of the rolling stock is (1) incorporated or has manufacturing facilities in the United States; and (2) is owned or controlled by an entity based in a country that is identified as a nonmarket economy country, was identified by the Office of the U.S. Trade Representative (USTR) as a priority foreign country (e.g., a country that does not protect intellectual property rights), and is subject to monitoring by the USTR. This includes the People's Republic of China. Any recipient of financial assistance for public transportation that operates a rail fixed guideway service must certify that is will not award any contract for the procurement of rail rolling stock for use in public transportation to a manufacturer of rolling stock that is described by this bill. A recipient that operates a rail fixed guideway public transportation system must certify that it has a written plan for identifying and reducing cybersecurity risks.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).

National Strategic and Critical Minerals Production Act This bill addresses the mine permitting process. Under the bill, projects that provide minerals vital to job creation, energy infrastructure, coastal resilience and restoration, American economic competitiveness, and national security must be considered to be infrastructure projects as described in Executive Order 13807, titled Establishing Discipline and Accountability in the Environmental Review and Permitting Process for Infrastructure Projects and dated August 15, 2017. This order directed federal agencies to ensure that the environmental review and permitting process for infrastructure is coordinated, predictable, and transparent. The bill sets forth general requirements for an existing mineral exploration or mine permit application. The Bureau of Land Management (BLM) or the Forest Service shall appoint a project lead for the mine permitting process to coordinate with other agencies to ensure that the agencies minimize delays, set and adhere to timelines for completion of the permitting process, set clear permitting goals, and track progress against goals. The requirements of the National Environmental Policy Act of 1969 are satisfied if the BLM or the Forest Service determines that the agency issuing the permit will address specified factors, such as environmental impact, alternatives to issuance of the permit, or any irreversible and irretrievable commitment of resources that would be involved in the proposed action. Projects on National Forest System land shall be exempt from regulations that prohibit timber tree cutting and road construction in areas without roads.

Fostering Undergraduate Talent by Unlocking Resources for Education Act or the FUTURE Act This bill extends through FY2021 and revises mandatory funding programs for historically black colleges and universities and other minority-serving institutions, including by allocating a portion of the funding for grants to predominantly black institutions for programs in (1) science, technology, engineering, or mathematics; (2) health education; (3) internationalization or globalization; (4) teacher preparation; or (5) improving educational outcomes of African-American males.

This bill modifies the eligibility criteria for certain veterans to qualify for a preference in the federal hiring process. Specifically, an individual who is honorably discharged from active duty service is eligible for a veterans' preference, if the active duty service was performed for more than 180 total days (currently, consecutive days). Additionally, a retired member of the Armed Forces is eligible for a veterans' preference, even if the retiree (1) is not a disabled veteran and (2) retired at or above the rank of major or its equivalent.

Women's Suffrage Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 400,000 $1 silver coins that are emblematic of the women who played a vital role in rallying support for the 19th Amendment to the U.S. Constitution. Such coins may be issued during the period beginning on January 1, 2020, and ending on December 31, 2020. All surcharges received from the sales of such coins shall be paid to the American Women's History Initiative of the Smithsonian Institution.

Muslim Brotherhood Terrorist Designation Act of 2019 This bill requires the Department of State to report to Congress within 60 days indicating (1) whether the Muslim Brotherhood meets the criteria for designation as a foreign terrorist organization; and (2) if not, which criteria have not been met.

Wild Game Donation Act of 2019 This bill modifies the tax treatment of donations of wild game meat to (1) increase the tax deduction for charitable contributions of qualified wild game meat by the processing fees paid with respect to such contributions, and (2) exclude from the gross income of meat processors processing fees paid by a charitable organization for the processing of donated wild game meat. "Qualified wild game meat" is the meat of any animal typically used for human consumption, but only if (1) such animal is killed in the wild by the individual making the charitable contribution and is hunted or taken in accordance with all state and local laws, (2) the meat is processed for human consumption by a licensed processor, and (3) the meat is apparently wholesome as determined by regulations under the Bill Emerson Good Samaritan Food Donation Act.

Promotion and Expansion of Private Employee Ownership Act of 201 9 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Freedom for Families Act This bill modifies requirements for health savings accounts (HSAs) to (1) exclude from gross income HSA distributions paid or distributed during a period of qualified caregiving, (2) allow participation in an HSA without enrollment in a high deductible health plan, and (3) increase the contribution limit for HSAs.

Revitalizing Underdeveloped Rural Areas and Lands Act of 2019 or the RURAL Act of 2019 This bill modifies the definition of income used to determine the tax-exempt status of a mutual or cooperative telephone or electric company to exclude certain government grants, contributions, and assistance. Specifically, the bill excludes from income (1) grants, contributions, and assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act or by local, state, or regional governmental entities for disasters or emergencies; and (2) certain grants or contributions provided by a government entity for electric, communications, broadband, internet, or other utility facilities or services.

Parental Notification and Intervention Act of 2019 This bill prohibits a person or organization from performing, facilitating, or assisting in the performance of an abortion on an unemancipated minor under age 18 without first complying with parental notification requirements, subject to exceptions. It establishes penalties—a fine, up to one year in prison, or both—for each willful violation. A parent who is required to be notified of an abortion of an unemancipated minor may bring an action in federal district court to prohibit the abortion.

Access Technology Affordability Act of 2019 This bill allows a refundable tax credit equal to the amounts paid for qualified access technology for use by a blind individual who is the taxpayer, the taxpayer's spouse, or a dependent of the taxpayer. "Qualified access technology" is hardware, software, or other information technology with the primary function of converting or adapting information that is visually represented into forms or formats useable by blind individuals. The credit is limited to (1) costs that are not compensated by insurance or otherwise, and (2) an aggregate amount of $2,000 per blind individual in any period of three consecutive taxable years. The credit must be adjusted for inflation after 2020 and terminates after five years.

Lymphedema Treatment Act of 2019 This bill includes certain lymphedema compression treatment items as covered durable medical equipment under Medicare. (Lymphedema is a condition of localized fluid retention and tissue swelling that is caused when the lymphatic system is damaged or blocked.)

Future in Logging Careers Act This bill exempts from child labor laws an employee between the ages of 16 and 18 years who is employed in an occupation that the Department of Labor finds to be particularly hazardous for the employment of children between such ages by a person who is a parent, or standing in the place of a parent of such employee, or by a timber harvesting employer or a mechanized timber harvesting employer owned or operated by such person.

Safe Freight Act of 2019 This bill prohibits the operation of a freight train or light locomotive engine used in the movement of freight unless it has a crew of at least two individuals, one of whom is certified by the Federal Railroad Administration as a locomotive operator and the other as a train conductor.

Ending Duplicative Permitting Act This bill prohibits the Department of the Interior from requiring a federal drilling permit for oil and gas exploration and production activities on the nonfederal surface estate if the subsurface mineral estate is less than 50% federally-owned and the operator submits a state permit for such activities.

Accountability Through Electronic Verification Act This bill expands the E-Verify program by requiring all employers to use it, and permanently reauthorizes the program. Currently, E-Verify use is voluntary for most employers, although some states mandate its use. All employers shall use E-Verify to confirm the identity and employment eligibility of all recruited, referred, or hired individuals, including current employees who were never verified under the program. Failure to use E-Verify shall create a rebuttable presumption that the employer is violating immigration law. U.S. Citizenship and Immigration Services (USCIS) shall generate weekly reports about individuals who have received a final non-confirmation of employment eligibility. The Department of Homeland Security (DHS) shall use the report to enforce immigration laws. DHS shall establish a program to help certain small businesses verify employee eligibility. DHS shall also update E-Verify's design to help prevent and detect fraud and identity theft. The bill increases civil and criminal penalties for hiring unauthorized aliens. DHS shall debar repeat offenders and those criminally convicted from holding federal contracts, grants, or cooperative agreements. The Social Security Administration, Internal Revenue Service, Department of the Treasury, and DHS shall jointly establish a program to share information to help identify unauthorized aliens. The bill establishes the Employer Compliance Inspection Center within Homeland Security Investigations of U.S. Immigration and Customs Enforcement (ICE). The center's duties include processing I-9 employment eligibility verification forms and ensuring compliance with employment eligibility laws. DHS shall report to Congress on ways to simplify procedures relating to I-9 forms, and on whether the I-9 process should be eliminated.

Notify ICE Act This bill requires the national instant criminal background check system to report to U.S. Immigration and Customs Enforcement on the individuals determined to be ineligible to receive a firearm due to their illegal or unlawful presence in the United States.

Health Insurance Tax Relief Act of 2019 This bill delays reimposition of the annual fee on health insurers until 2022. Under current law, the annual fee for a health insurer is calculated based on the insurer's share of total premiums from the preceding year. The fee is suspended for 2019 (i.e., there is no fee based on premiums from 2018); reimposition is scheduled for 2020.

Bureau of Reclamation Transparency Act This bill directs the Department of the Interior to publish, and update every two years, an Asset Management Report. The report must describe the Bureau of Reclamation's efforts to (1) maintain in a reliable manner its reserved works (e.g., buildings, structures, facilities, or equipment); and (2) standardize and streamline data reporting and processes across regions and areas for the purpose of maintaining reserved works. The report must include (1) an assessment of major repair and rehabilitation needs for reserved works, and (2) an itemized and prioritized list of major repair and rehabilitation needs of individual facilities. Interior must coordinate with the nonfederal entities responsible for the operation and maintenance of Reclamation facilities, known as transferred works, in developing reporting requirements for their major repair and rehabilitation needs.

Reining in Irresponsible Decorating Expenses Act This bill requires certain federal employees to notify Congress at least 30 days before spending more than $5,000 to furnish or redecorate their offices. The bill applies to individuals who are (1) the head of a federal agency, or (2) occupy a position in the federal government that requires confirmation by the Senate. The notice must include (1) a justification and explanation for the expenditure, and (2) an overview of the current state of agency affairs. Individuals who fail to comply with the notice requirement must repay the Treasury for the expenditures that exceed $5,000.

Phair Pricing Act of 2019 This bill requires that certain negotiated prices for covered drugs under the Medicare prescription drug benefit be disclosed at the point-of-sale. Specifically, negotiated prices offered under a prescription drug plan (PDP) must be disclosed at the point-of-sale; the disclosed price must include specified adjustments, payments, and fees that are negotiated with the pharmacy (e.g., dispensing fees) by the PDP sponsor or pharmacy benefit manager. Additionally, the Centers for Medicare & Medicaid Services must establish certain quality measures for PDP sponsors to use when determining incentive payments and adjustments (e.g., performance payments) to pharmacies.
