Pay Our Correctional Officers Fairly Act This bill provides increased locality pay rates to certain Bureau of Prisons employees whose duty stations are located in the pay locality designated as Rest of U.S. The Rest of U.S. GS (general schedule) locality is the default locality area that applies to GS employees in any city that does not fall within another specified GS locality. Such an employee shall not be subject to this bill if his or her official work site is not located within 100 miles of any pay locality other than Rest of U.S .

JAB Act or the Justice for All Businesses Act This bill restricts the Department of Labor from engaging in rulemaking to require that employers mandate COVID-19 vaccination or testing of employees. Specifically, Labor may not use any funds to draft, promulgate, or enforce such a rule. Additionally, Labor may not assess civil monetary or criminal penalties for violations.

Treatment Restoration for Emergency Antibody Therapeutics Act or the TREAT Act This bill prohibits the Department of Health and Human Services (HHS) from implementing any policy that restricts health care facilities from ordering and receiving COVID-19 monoclonal antibody therapies directly from manufacturers and distributors. In addition, the bill expressly nullifies a policy announced on September 13, 2021, under which HHS allocated supplies of these therapies through state or territorial governments.

Transparency in COVID-19 Expenditures Act This bill requires the Government Accountability Office (GAO) to audit certain funding that was provided to address COVID-19. Specifically, the GAO must audit and report on the use of funding provided by the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020; the Families First Coronavirus Response Act; the Coronavirus Aid, Relief, and Economic Security Act (CARES Act); the Paycheck Protection Program and Health Care Enhancement Act; Divisions M and N of the Consolidated Appropriations Act, 2021; and the American Rescue Plan Act of 2021.

Bring Entrepreneurial Advancements To Consumers Here In North America Act This bill provides tax incentives for relocating manufacturing facilities in the United States. Specifically, it allows accelerated depreciation (20-year recovery period) for nonresidential real property acquired in connection with the relocation of manufacturing facilities in the United States. It also excludes from gross income, for income tax purposes, gain on the sale or exchange of such relocated facilities. Finally, the bill allows permanent 100% expensing of manufacturing property relocated in the United States.

Safeguarding Children's Privacy in Schools Act This bill revises the standards for parental consent with respect to the online collection, use, and disclosure of the personal information of a child. First, it revises the definition of verifiable parental consent to require websites and online services to obtain consent by a parent before collecting a child's personal information. Currently, websites and online services must make a reasonable effort to ensure that a parent authorizes the collection, use, and disclosure of such personal information before collecting it. The bill also prohibits elementary and secondary school employees from acting as the agent of a child enrolled in such school for the purpose of providing verifiable parental consent.

Marginal Well Protection Act This bill prohibits the Environmental Protection Agency from imposing fees for methane emissions from wells that produce less than 15 barrels of oil per day and less than 90 Mcf (90,000 cubic feet) of natural gas per day.

Safeguards Ensuring Criminal and Unvetted Refugees don't Enter America Act or the SECURE America Act This bill imposes restrictions on the admission of aliens, including refugees, and addresses related issues. Specifically, no refugees may be admitted until Congress enacts a joint resolution setting the maximum number of refugees allowed to be admitted in a particular fiscal year. Currently, that number is set each fiscal year by the President. The Department of Homeland Security (DHS) must notify Congress at least 30 days before determining that an alien or class of aliens is eligible for refugee status. Congress may nullify the determination by enacting a joint resolution of disapproval. Further, an alien shall be inadmissible for holding certain beliefs, such as (1) believing that a system of religious law should be implemented in the United States, (2) believing that the alien does not need to learn English if the alien is not already fluent, or (3) any belief that the Department of State determines is incompatible with the principles of the United States. DHS may not parole into the United States an alien who does not have status under immigration law. Currently, DHS may provide parole in certain instances, including for urgent humanitarian reasons. Federal agencies must notify a state at least 30 days before resettling a refugee in that state. The refugee may not be resettled in that state if the state expresses disapproval. An alien who has committed a crime of violence (generally one involving the use or threat of physical violence against person or property) may not be eligible for refugee status and must be removed.

Renew Effective Protection of Americans' Information Rights Act or the REPAIR Act This bill restricts the use of information reasonably linked to an individual (or the individual's internet-connected device) that is collected, processed, or transferred by certain entities subject to unfair competition laws. Individuals must affirmatively and expressly consent to the use of their information and may withdraw their consent. Entities may only use information as reasonably necessary and for the allowable purposes (e.g., completing transactions at an individual's request, complying with legal obligations, and other purposes specified in the bill) to which the individual consented. The Federal Trade Commission (FTC) may allow additional purposes through rulemaking. Entities must also establish data security practices. Additionally, entities must make their privacy policies publicly available, and individuals must consent to a policy change that weakens privacy protections before the change takes effect. Further, entities must (1) notify individuals in real-time when their information is being used; and (2) provide copies of, delete, mask, or correct information at an individual's request. However, these requirements shall not apply to entities that have revenues, staffing levels, and related indicators below specified limits. The FTC must also develop a downloadable program that allows individuals to opt out of unwanted data harvesting and targeted advertising by public-facing websites, applications, and related operators (e.g., social networks and search engines). Operators must comply with requirements related to the program. Along with existing remedies, the bill provides civil penalties for violations of the bill and allows enforcement by the FTC, states, Indian tribes, and territories.

No Taxation Without Congressional Consent Act This bill prohibits assessing a fine, fee, or tax against any person who violates a COVID-19 vaccine mandate issued by the Occupational Safety and Health Administration or other executive agency.

Believe In Delaware Election Nobility Act or the BIDEN Act This bill prohibits states from taking certain actions related to voting in federal elections, particularly with respect to absentee voting. Specifically, the bill prohibits states from (1) using automatic voter registration systems, (2) providing absentee ballots to individuals unless they meet specified application requirements and are unable to vote in person, (3) using drop boxes to collect completed absentee ballots unless the box is located within a building that serves as an office for an election official, (4) accepting completed absentee ballots that are received after the polls close on election day, and (5) allowing individuals to vote at a polling place during an early voting period. Additionally, the bill places certain restrictions on the delivery of completed absentee ballots and requirements for collecting these ballots. In particular, the bill prohibits a completed absentee ballot that is delivered by an individual other than the voter from being counted unless the individual who delivers the ballot is acting within the individual's official duties as authorized by law, such as an employee of the U.S. Postal Service. The bill also requires individuals to provide proof of identification to vote.

Defending Students' Civil Rights Act of 2021 This bill prohibits the use of critical race theory or critical race pedagogy in any federally funded program or activity. Specifically, the bill includes the use of critical race theory or critical race pedagogy as a violation of Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin in federally funded programs or activities. The bill defines critical race pedagogy as the separation of students or teachers, or the assignment of characteristics or assumptions, based on race, color, or national origin. The bill defines critical race theory as a curriculum that establishes specified principles relating to race or sex, including that (1) one race or sex is inherently superior to another, (2) the United States is fundamentally racist or sexist, and (3) an individual bears responsibility for the past actions of others of the same race or sex.

Freedom from Mandates Act This bill nullifies certain executive orders regarding COVID-19 safety and prohibits the Departments of Labor and Health and Human Services (HHS) from taking specified actions with respect to vaccination against COVID-19. Specifically, the bill nullifies Executive Order 14042 (relating to ensuring adequate COVID-19 safety protocols for federal contractors) and Executive Order 14043 (requiring COVID-19 vaccination for federal employees). Labor may not issue any rule requiring employers to mandate vaccination of employees against COVID-19 or requiring testing of employees who are unvaccinated. HHS may not (1) require a health care provider, as a condition of participation in the Medicare or Medicaid program, to mandate vaccination of employees against COVID-19 or require testing of employees who are unvaccinated; or (2) otherwise penalize such a provider for failure to mandate such vaccination or require such testing.

Make the Migrant Protection Protocols Mandatory Act of 2021 This bill requires the Department of Justice (DOJ) to remove certain aliens from the United States while such an alien's application for admission is pending. Specifically, if an alien arrived by land from a foreign country bordering the United States and the alien is not clearly and beyond a doubt entitled to admission into the United States, DOJ must return that alien to that bordering foreign country while the alien's application for admission is pending. (Currently, DOJ may choose to detain such an alien or return the alien to the bordering foreign country while the application for admission is pending.)

Freedom From Union Violence Act of 2021 This bill revises the federal criminal statute commonly known as the Hobbs Act, which prohibits the obstruction of interstate commerce by robbery or extortion (or by attempting or conspiring to commit robbery or extortion). Currently, an extortion offense includes obtaining property of another with consent through the wrongful use of force, violence, or fear. Typically, violations are investigated by the Federal Bureau of Investigation and prosecuted by the U.S. Attorney's Office. First, this bill broadens the scope of prohibited conduct by (1) eliminating the requirement that the means used to obtain property (i.e., the use of force, violence, or fear) must be wrongful, and (2) expanding extortion to include obtaining property of another by wrongful use of fear not involving force or violence. Second, the bill explicitly states that the maximum fine is $100,000. Third, the bill exempts from the federal prohibition conduct that (1) is incidental to peaceful picketing during a labor dispute, (2) consists solely of minor bodily injury or damage to property, and (3) is not part of a pattern of violent conduct or of a coordinated violent activity. A violation involving exempted conduct is subject to prosecution only by state and local authorities.

Teleabortion Prevention Act of 2021 This bill restricts the use of telehealth for chemical abortions (also known as medication abortions). Specifically, it requires a provider who dispenses or prescribes medication for a chemical abortion to physically examine the patient, be physically present at the location of the chemical abortion, and schedule a follow-up visit. The bill provides an exception for a chemical abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, illness, injury, or condition. The bill establishes criminal penalties—a fine, a prison term of up to two years, or both—for a provider who does not comply with the requirements. A patient who undergoes a chemical abortion may not be prosecuted.

This bill sets out informed consent requirements for, and restricts the authority of the federal government to require, vaccinations. Specifically, the bill requires written, informed consent from any individual who receives a vaccine in the United States and imposes a criminal fine for violations of this requirement. In addition, the bill prohibits the federal government from requiring vaccinations of U.S. citizens or federal employees unless the citizen or employee is advised in writing of all known risks of, consults with a physician about, and provides voluntary informed consent for the required vaccine.

Afghanistan Accountability Act This bill requires the President to impose sanctions on certain foreign persons, such as Taliban officials, and requires reports related to Afghanistan. The President must impose asset- and visa-blocking sanctions on any foreign person who (1) is an official, agent, or instrumentality of the Taliban; (2) has acted to undermine democratic institutions or threaten the stability of Afghanistan; (3) has acted to limit or penalize freedom of expression in Afghanistan, particularly the freedom of expression of women; (4) has committed serious human rights abuses in Afghanistan; or (5) operates in the mining sector in Afghanistan. The sanctions also apply to certain immediate relatives of such persons and those who provide material support to such persons. The bill also requires reports to Congress on (1) the intelligence provided to the President and policymakers prior to and concerning the withdrawal of U.S. troops from Afghanistan, (2) whether the Taliban meets the criteria for designation as a foreign terrorist organization, and (3) human rights violations by the Taliban against individuals who supported U.S. efforts in Afghanistan.

Americans not Aliens Act This bill prohibits an alien who has been ordered removed from receiving employment authorization. Currently, an individual who has been ordered removed may receive employment authorization if the Department of Justice finds that the individual's removal is impracticable or contrary to the public interest.

Judicial Understaffing Delays Getting Emergencies Solved Act or the JUDGES Act This bill requires the appointment of additional U.S. district court judges, converts certain temporary district court judgeships into permanent judgeships, and requires the Government Accountability Office to report on vacant or underused federal courthouses. Specifically, the bill requires the appointment of 39 district court judges on or after January 21, 2025, in specified judicial districts in Arizona, California, Colorado, Delaware, Florida, Georgia, Idaho, Indiana, Iowa, New Jersey, New Mexico, New York, and Texas. Further, 38 district court judges must be appointed on or after January 21, 2029, in specified judicial districts in Arizona, California, Colorado, Delaware, Florida, Georgia, Indiana, New Jersey, New York, and Texas. Additionally, the bill converts certain temporary district court judgeships to permanent judgeships in specified judicial districts in Alabama, Arizona, California, Florida, Kansas, Missouri, New Mexico, North Carolina, and Texas.

Federal Insurance Office Elimination Act This bill eliminates the Federal Insurance Office (FIO) within the Department of the Treasury. The bill also removes the FIO director as a nonvoting member of the Financial Stability Oversight Council.
