Prescription Drug Affordability Act - Amends the Federal Food, Drug, and Cosmetic Act to revise provisions concerning the timing of generic drug availability. Requires applicants (pharmaceutical companies) to register their patents with the Food and Drug Administration (FDA) within 30 days of approval (or issuance for subsequently issued patents). Makes failure to timely register a bar to civil actions for patent infringement. Requires applications for new drugs (NDA) or abbreviated new drug applications (ANDA) which rely upon investigations not conducted by or for the applicant and which concern a patent that claims both the drug and a method of use or more than one method of use to include a certification on a claim-by-claim basis that the patent is invalid or will not be infringed (known as a Paragraph IV filing/certification) by the new drug's (generic) manufacture and a statement regarding the method(s) of use claim. Prohibits (for subsequently issued patents) an extension of the 30 month stay of FDA approval for any new drug where an ANDA or NDA contains a Paragraph IV filing/certification and the patent holder indicates an intention to bring a patent infringement suit against the new (generic) drug's manufacturer. Makes failure to timely file a civil action for infringement a bar to later action. Requires the first generic applicant with a Paragraph IV filing to forfeit the 180 day marketing exclusivity period to a subsequent generic applicant if the first generic applicant engages in certain behaviors (forfeiture events) which delay or prevent the marketing of the generic drug. Revises notice requirements for Paragraph IV filings to include and protect certain proposed formulation, composition, or method of use information. Excludes an applicants's ability to pay damages from a court's consideration of whether or not to provide injunctive relief before the expiration of the 30 month stay of approval period.

Expresses serious concern regarding the decision by the American Association for the Advancement of Science and the editors of `Science Express' to publish a blueprint that could conceivably enable terrorists to inexpensively create human pathogens for release on the people of the United States. Calls upon the scientific community, including publishers and editors of scientific publications, to establish ethical standards and exercise restraint to ensure that information that may be used by terrorists is not made widely available Encourages the executive branch to examine all policies relevant to the classification or publication of federally funded research to ensure that information that could be useful in the development of chemical, biological, or nuclear weapons is not made accessible to terrorists or countries of proliferation concern.

National Forest Fire Prevention Act - Authorizes the Secretary to treat additional timber within or outside existing cutting units for National Forest System timber sales and within related analysis areas to reduce insect infestation or fire hazard by: (1) modifying contracts; or (2) offering additional timber sales within such areas. Sets forth treatment priority criteria.

Education Freedom Act - Amends the Internal Revenue Code to permit a tax credit for 50 percent of certain cash contributions by a taxpayer to an education investment organization or to an elementary or secondary school. Sets a maximum credit of $50,000 for corporations and $250 for other taxpayers ($500 for a joint return). Provides other limitations on the amount of the credit in certain specified instances. Excludes from gross income any amount received as a grant for qualified elementary and secondary expenses from an education investment organization. Defines "qualified elementary and secondary expenses" and "education investment organization." Revises definition of "school" for purposes of defining qualified elementary and secondary education expenses.

Drug Importation Act of 2002 - Amends the Federal Food, Drug, and Cosmetic Act to permit an individual who is not in the business of importing prescription drugs to import prescription drugs which appear to be approved, non-narcotic, and produced by a registered producer. Provides for a program where a pharmacist who is not otherwise permitted to import a prescription drug may do so when a drug meets the above standard. Excludes controlled substances and biological products. States that alternative labeling may be required.

Expresses the sense of Congress that the Federal Mediation and Conciliation Service should immediately: (1) offer its services to the Major League Baseball Players Association and the team owners who are members of the National Association of Professional Baseball Leagues to resolve labor contract disputes over entering into a collective bargaining agreement; and (2) use its best efforts to bring the parties to agree to such contract without engaging in a strike, a lockout, or any other coercion that interferes with the playing of scheduled professional baseball games.

Securing America's Freedom through Enforcement Reform Act of 2002 (SAFER Act) - Sets forth provisions, and amends specified Acts, with respect to: (1) prevention and punishment of alien smuggling, and transporting and harboring of aliens; (2) border patrol increases; (3) use of the military along the border; (4) visas, including the visa waiver program, and consular interviews of applicants; (5) alien terrorist removal, deportability, and asylum requests; (6) alien criminal removal; (7) alien human rights violator removal, deportability, and bar to status adjustment, including criminal penalties for reentry and aiding human rights violators to enter the United States; (8) document security (birth certificates, drivers licenses, social security cards); (9) employment eligibility verification; (10) increased Immigration and Naturalization Service (INS) investigative personnel, (11) expedited exclusion; (12) criminal and civil penalties for improper entry of aliens; (13) voluntary departure; (14) detention facilities; (15) removal proceedings; (16) establishment of a Federal election-related Citizenship Verification Program; (17) establishment of an Office of Citizenship; (18) treatment of nationals of state sponsors of terrorism; (19) refugee admissions, and extended family and employment preferences; (20) elimination of diversity immigrant program; (21) temporary protected status; (22) designation of foreign terrorist organizations; (23) foreign students; (24) INS attorneys; (25) alien proof of identity; and (26) information on foreign crimes.

Amends the United States-Israel Free Trade Area Implementation Act of 1985 to designate Israel and Turkey as qualifying industrial zones (granting duty-free treatment to articles imported into the United States from such countries due to similar duty-free treatment provided to articles imported by those countries). Excludes from such duty-free treatment certain import-sensitive articles imported into the United States from such countries, including specified textiles and apparel articles, footwear, handbags, luggage, flat goods, work gloves, and leather wearing apparel.

Partial-Birth Abortion Ban Act of 2002 - Amends the Federal criminal code to prohibit any physician or other individual from knowingly performing a partial-birth abortion, except when necessary to save the life of a mother that is endangered by a physical disorder, illness, or injury. Authorizes the father, if married to the mother at the time of the abortion, and the maternal grandparents of the fetus, if the mother is under 18 years of age, to obtain specified relief in a civil action, unless the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion. Authorizes a defendant accused of an offense under this Act to seek a hearing before the State Medical Board on whether the physician's conduct was necessary to save the life of the mother. Prohibits the prosecution of a woman upon whom a partial-birth abortion is performed for conspiracy to violate this Act or under provisions regarding punishment as a principal or an accessory or for concealment of a felony.

Cancer Survivorship Research and Quality of Life Act of 2002 - Amends the Public Health Service Act to include demonstration, education, and other programs concerning cancer survivorship among the activities of the National Cancer Institute (Institute) within the National Institutes of Health (NIH). Requires the Director of NIH to: (1) expand and coordinate NIH activities related to cancer survivorship; and (2) establish an Office on Survivorship within the Institute. Creates the position of Associate Director for Survivorship. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Protection, to: (1) study the health challenges associated with cancer survivorship and carry out projects and interventions; and (2) make grants for the monitoring and evaluation of cancer care and survivorship.

Amends the Internal Revenue Code to establish a credit to promote the production and usage of biodiesel fuel. Requires a taxpayer to obtain a certification from the producer of the biodiesel which identifies the product produced in order to utilize the credit. Imposes a tax for biodiesel not used as fuel, but for which a credit was granted. Reduces motor fuel excise taxes on biodiesel mixtures. Provides for transfers of funds from the Commodity Credit Corporation to the Highway Trust Fund in amounts equivalent to the reductions that would occur but for this Act.

Standards Development Organization Advancement Act of 2002 - Amends the National Cooperative Research and Production Act of 1993 to provide that, in any action under the antitrust laws, the conduct of a standards development organization (SDO) while engaged in a standards development activity shall be subject to a rule of reason standard. Limits the amount recoverable and attorney's fees with respect to standards development activity engaged in by an SDO. States that an SDO may, not later than 90 days after commencing activity for the purpose of developing or promulgating voluntary consensus standards or 90 days after enactment of the Standards Development Advancement Act of 2002, whichever is later, file simultaneously with the Attorney General and the Commission a written notification disclosing: (1) the name and principal place of business of the SDO; and (2) documents showing the nature and scope of such activity. Allows an SDO to file additional disclosure notifications as appropriate to extend protections under this Act to standards development activities that are not covered by, or that have changed significantly since, the initial filing. Includes standards development activity within notice, disclosure, and withdrawal from notification requirements of the Act.

Amends the Internal Revenue Code to set forth that a plan or other arrangement shall not cease to count as a cafeteria plan solely because qualified benefits under such plan include a health flexible spending arrangement under which not more than $500 of unused health benefits may be carried forward to the next year or paid as compensation. Sets forth rules for determining whether or not such benefits shall be included or excluded from income.

Pension Protection Act of 2002 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to direct the Secretary of Labor to undertake enforcement actions with respect to requirements for pension plan participation, vesting, benefit accrual, and funding, including an appropriate enforcement response in connection with a report on oversight of certain cash balance plan lump sum distributions. Directs the Secretary, with the Secretary of the Treasury, to develop improved guidance for defined benefit plan administrators, with respect to requirements for such plans which express accrued benefits in the form of an account balance, including further assistance relating to all factors involved in determining lump sum distributions of accrued benefits.

Chronic Wasting Disease Research and Response Act of 2002 - Directs the Secretary of the Interior, acting through the Director of the United States Geological Survey, to establish and coordinate a national research program to assess chronic wasting disease (the transmissible animal disease that afflicts deer and elk). Includes among program elements requirements that the Secretary: (1) provide States with technical and financial assistance and timely information to prevent disease expansion; (2) design a national program for disease monitoring and surveillance; (3) conduct research to determine how the disease is transmitted; (4) develop new non-lethal detection and diagnostic methods to identify the disease in free-ranging cervid populations; (5) develop safe methods of disposal of infected carcasses; (6) instruct Federal land managers to determine the presence of the disease, the likelihood of transmission to adjacent non-Federal lands, and management options for infestations; and (7) develop a public outreach and education strategy for the hunting community and the public.

National Science Foundation Authorization Act of 2002 - Authorizes appropriations to the National Science Foundation (NSF) for FY 2003 through 2005, with specific allocations for: (1) Research and Related Activities; (2) Education and Human Resources; (3) Major Research Equipment and Facilities Construction; (4) Salaries and Expenses; and (5) the Office of the Inspector General. Sets a limitation on the obligation of Major Research Equipment and Facilities Construction funds. Requires the Director of NSF to submit to specified congressional committees annual plans for the allocation of funds authorized by this Act, including information on how the allocation for Research and Related Activities will affect research grants, trends in research support, and research opportunities in science, mathematics, and engineering. Requires the Director to: (1) develop, submit to the National Science Board for approval, and report annually to Congress on a list indicating the relative priority for funding under the Major Research Equipment and Facilities Construction account of each project the Board has approved for inclusion in a future budget request; and (2) include in the plan for construction and repair of national research facilities covered in the NSF annual budget request full life-cycle cost information. Prohibits the management of any national research facility project by an NSF temporary appointee. Directs: (1) NSF to assess and report to Congress on the Major Research Instrumentation Program; and (2) NSF and the National Aeronautics and Space Administration (NASA) to establish an Astronomy and Astrophysics Advisory Committee.

Disabled Veterans' Caregiver Compensation Act - Requires the Secretary of Veterans Affairs to pay monthly compensation of $234 to a veteran if and while totally disabled and in need of regular aid and attendance and while unpaid aid and attendance is provided by an adult family member who is dependent upon such veteran for support.

American Dream Downpayment Act - Amends the Cranston-Gonzalez National Affordable Housing Act to: (1) authorize the Secretary of Housing and Urban Development to make grants to participating jurisdictions for downpayment assistance to low-income, first-time home buyers; and (2) make the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 inapplicable to such assistance. Amends the Housing Opportunity Program Extension Act of 1996 to authorize appropriations for the self-help housing provider program. Amends the United States Housing Act of 1937 to authorize appropriations for the public housing agency grant program for project demolition, revitalization, and replacement, and tenant-based assistance. Extends the program sunset date to September 30, 2003.

Vested Worker Protection Act of 2002 - Amends the Internal Revenue Code to mandate that an "applicable pension plan" adopting any amendment that reduces rates of future benefits provide: (1) written notice meeting certain requirements to participants; and (2) that the participants be offered the chance to elect to continue to accrue benefits under the terms in effect immediately before the amendment. Defines "accrued benefit" as an early retirement benefit or retirement-type subsidy meeting certain standards. Defines "applicable pension plan" as a defined benefit plan or an individual account plan with at least 100 active participants meeting certain funding standards and other restrictions. Requires plans to inform participants of the option of staying under the old terms at least 90 days before the effective date of the amendment. Exempts a plan from the above requirements if its sponsor can show the Secretary of the Treasury that each employer contributing to the plan meets certain distress termination conditions under regulations of the Secretary. Imposes an excise tax on plans that adopt amendments decreasing benefits and do not let participants elect to continue to accrue benefits under the old terms. Makes the plan liable for such tax in the case of a multiemployer plan, and the employer liable in any other case.

Constitutional Amendment - Prohibits outlays for a fiscal year (except those for repayment of debt principal) from exceeding total receipts for that fiscal year (except those derived from borrowing) unless Congress, by a three-fifths roll call vote of each House, authorizes a specific excess of outlays over receipts. Requires a three-fifths roll call vote of each House to increase the public debt limit. Directs the President to submit a balanced budget to Congress. Prohibits any bill to increase revenue from becoming law unless approved by a majority of each House. Authorizes waivers of these provisions when a declaration of war is in effect or under other specified circumstances involving military conflict.

Recognizes and supports the people of Iran in their daily struggle for democracy, reform, human rights, economic prosperity, and the rule of law. Urges the President to: (1) support the Iranian people and their legitimate aspiration for freedom and democracy; (2) continue to pursue areas of common interest with the Iranian people while taking an uncompromising stance on terrorism, weapons of mass destruction, and human rights of Iranian citizens; and (3) use all diplomatic means to support the Iranian people's demand for an immediate release of all political prisoners and for removal of the ban on freedom of the press.

Medicare and Medicaid Nursing Facility Quality Improvement Act of 2002 - Amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act (SSA) to revise the Federal survey and certification process of skilled nursing facilities. Revises requirements for nurse aide training and competency evaluation programs and for nurse aide competency evaluation programs to state that the prohibition on approval of a program offered by or in a skilled nursing facility which is operating under a waiver, subject to an extended survey, or has been assessed a civil penalty shall not be continued when the facility involved through on-site verification demonstrates compliance with the applicable standards. Authorizes the Secretary to: (1) waive the skilled nursing survey and certification process in order to test and implement innovative alternatives to the otherwise applicable survey process; and (2) continue payments for up to one year under certain conditions, pending remediation, to a nursing facility that no longer meets the specified requirements. Requires each State to establish an informal and independent dispute resolution process to allow facilities to settle disputes involving compliance with nursing facility requirements. Requires surveyors to defer to the diagnosis and treatment decisions of the resident's attending physician and of the facility's medical director and requires the Secretary to implement programs to monitor and correct instances of failure of surveyors to do so. Declares that nothing shall be construed as precluding members of survey teams from providing information to faculty and staff on best or innovative practices for assuring quality care in nursing facilities. Requires the Secretary to provide incentives for operators with histories of good compliance to acquire facilities with poor compliance histories. Permits nursing facilities to appeal deficiency determinations. Requires the Secretary to establish a program that rewards skilled nursing facilities that provide the highest quality of care.

Consistent Public Land Laws Enforcement Act of 2002 - Amends the Federal Land Policy and Management Act of 1976, the National Park Service Organic Act, and other Federal law to classify as a Class B misdemeanor a violation of any regulation concerning the management, use, and protection of National Park System lands, National Forest lands, and other public lands. Makes a person guilty of a Class A misdemeanor (subject to a higher fine and/or imprisonment) for the knowing and willful violation of any such regulation. Provides authority to adjudge persons who commit such a violation to pay all costs of the proceedings. Allows fines so collected to be used to: (1) cover the costs of improvement, protection, or rehabilitation of the public lands rendered necessary by such violation; and (2) increase public awareness of such regulations and other requirements concerning public land use.

Schoolchildren's Health Protection Act - Amends the General Education Provisions Act to prohibit Federal education funding (from programs for which the Secretary or Department of Education has administrative responsibility) to any State or local educational agency that provides to an unemancipated minor, at an elementary or secondary school, postcoital emergency contraception (e.g. the "morning-after pill") or a prescription for such contraception.

Federal Deposit Insurance Reform Act of 2002 - Mandates the merger of the Bank Insurance Fund and the Savings Association Insurance Fund into the Deposit Insurance Fund. Amends the Federal Deposit Insurance Act (FDIA) and the Federal Credit Union Act to: (1) increase the amount of deposit insurance coverage; (2) couple such increase with an inflation adjustment; and (3) double the amount of deposit insurance for certain retirement accounts. Amends the FDIA to increase the amount of deposit insurance coverage for municipal deposits. Expands the range of authorized investments for the Federal Deposit Insurance Corporation (FDIC) to include Federal agency obligations or comparable obligations authorized by the Secretary of the Treasury. Repeals: (1) independent treatment of each deposit insurance fund with respect to assessments and designated reserve ratio; (2) minimum risk-based assessments for certain at-risk deposit insurance funds; (3) limitations on assessments on deposit insurance funds that fail to meet the designated reserve ratio; and (4) the special rule for recapitalizing undercapitalized funds. Instructs the FDIC Board of Directors to establish annually a designated reserve ratio that falls within a prescribed range. Replaces refund guidelines with rebates to insured depository institutions that are predicated upon DIF balances in excess of specified percentages. Instructs the FDIC to establish a Deposit Insurance Fund Restoration Plan to ensure adequate reserves whenever the actual ratio in the DIF falls below certain criteria. Directs the Comptroller General to study and report to Congress on FDIC administrative structure, expenses, and certain activities, and further possible changes to the deposit insurance system.

Medicare Drug and Service Coverage Act of 2002 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new part D (Outpatient Prescription Drug Benefit Program), a voluntary prescription drug benefit program to provide eligible enrollees covered outpatient prescription drugs, covered medication preparation services, and covered medication therapy management services. Requires such an enrollee to be entitled to hospital insurance benefits under Medicare part A (Hospital Insurance) and enrolled in Medicare part B (Supplementary Medical Insurance). Establishes within the Supplementary Medical Insurance Trust Fund the Prescription Drug Benefit Insurance Account for the payment of benefits under the program. Makes program enrollees responsible for a $250 annual deductible and a co-payment for services for which payment may be made under the program. Establishes a Medicare Prescription Drug Benefit Advisory Commission. Directs the Secretary of Health and Human Services, with the Commission's advice, to: (1) determine and promulgate a coinsurance amount that qualified beneficiaries pay with benefits covered under this program for the next calendar year; and (2) determine and promulgate a monthly premium.

Urges the owners of major league baseball franchises, before November 1, 2002, to give serious consideration to the increased sharing of broadcast revenues on a league-wide basis as an alternative to eliminating franchises by reason of their lack of revenue.

Upper Mississippi River Basin Protection Act of 2001 - Directs the Secretary of the Interior (Secretary), through the United States Geological Survey, to establish a nutrient and sediment monitoring network for the Upper Mississippi River Basin. Directs the Secretary to: (1) establish guidelines for related data collection and storage activities; (2) inventory the sediment and monitoring efforts of governmental and nongovernmental entities for the purpose of creating a baseline understanding of overlap, data gaps, and redundancies; and (3) collaborate with other public and private monitoring efforts in establishing the monitoring program. Directs the National Research Council of the National Academy of Sciences to conduct a water resources assessment of the Basin. Requires the Director of the United States Geological Survey to establish: (1) a computer modeling program of nutrient and sediment sources in the Basin; and (2) an Internet-based system to distribute information about nutrient and sediment loss reduction projects and nutrient and sediment levels in the Upper Mississippi River and its tributaries.

National Rural Development Partnership Act of 2001 - Amends the Consolidated Farm and Rural Development Act to establish the National Rural Development Partnership composed of the National Rural Development Coordinating Committee (established by this Act) and State development councils (authorized by this Act). Includes among Partnership purposes: (1) enhancement of State and local rural development capacities; and (2) engagement of Federal, State, local, tribal, and private and nonprofit sectors in such efforts. Provides for State rural development council matching requirements. Terminates the Partnership five years after enactment of this Act.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956 and the Revised Statutes of the United States to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from making a determination that real estate brokerage activity or real estate management activity is an activity that is either financial in nature or incidental to any financial activity, or is complementary to a financial activity.

Medicare Physician Payment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the conversion factor (update) for payments under the Medicare physician fee schedule for 2002 at 0.9 percent less than the conversion factor for 2001. Declares that this conversion factor and a specified update adjustment factor for a year after 2002 shall be applied as if this Act had not been in effect. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing or modifying the use of the sustainable growth rate as a factor in determining the update for such payments such that the factor used more fully accounts for changes in the unit costs of providing physicians' services.
