Imposes: (1) an additional estate or gift tax with respect to such property if an heir or donee disposes of or uses such property for other than farming or conservation purposes, and (2) a federal tax lien on such property until liability for estate or gift tax with respect to such property has been satisfied or has become unenforceable.

Medicare Audit Improvement Act of 2012

Medicare Audit Improvement Act of 2012 - Directs the Secretary of Health and Human Services (HHS) to establish a process under which the number of additional documentation requests made by a Medicare contractor pursuant to a complex prepayment or postpayment audit with respect to a hospital's Medicare part A (Hospital Insurance) claims in a year may not exceed, across all such contractors with respect to the hospital's claims, the lesser of: (1) 2% of all such claims for such year, or (2) 500 additional documentation requests during any 45-day period. Amends title XVIII (Medicare) of the Social Security Act with respect to the Medicare Integrity Program and use of recovery audit contractors. Requires the Secretary to ensure that recovery audit contracts include certain mandatory terms and conditions pertaining to: (1) penalties for certain compliance failures, (2) penalties for overturned appeals, (3) postpayment and prepayment audits, and (4) guidelines for prepayment review. Directs the Secretary to publish on the Internet website of the Centers for Medicare & Medicaid Services information on recovery audit contractor performance regarding: (1) audit rates, denials, and appeals outcomes; and (2) independent performance evaluations. Prohibits the Secretary, in conducting the Medicare Part A and Part B Rebilling Demonstration, from prohibiting any appeal by a hospital of any finding by a recovery audit contractor that an inpatient admission was not reasonably and medically necessary. Deems to be an original claim for Medicare part B (Supplementary Medical Insurance) payment a resubmitted hospital claim for Medicare part A payment for inpatient hospital services which a recovery audit contractor determines: (1) were not medically necessary and reasonable based on the site of service, but (2) would be medically necessary and reasonable in an outpatient setting of the hospital. Requires payment to be made for such a resubmitted claim for all furnished items and services for which payment may be made under Medicare part B. Deems to be a reopened claim, for purposes of a hospital's ability to resubmit a claim for Medicare payment in timely fashion, any claim that is the subject of an audit by a recovery audit contractor or a Medicare administrative contractor. Requires contracts for a recovery audit contractor to require that a physician review each denial of a claim for medical necessity made by an employee of the contractor who is not a physician.

Medicare DMEPOS Market Pricing Program Act of 2012 - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services (HHS) to establish a market pricing program for durable medical equipment (DME), prosthetics, orthotics, and supplies (DMEPOS) as a replacement for the competitive acquisition program for DMEPOS, which is hereby terminated. Directs the Secretary to: (1) conduct annual market-priced auctions from among entities supplying market priced items and services in an eligible market area selected in the auction design, (2) establish a lead product for each of specified product categories, and (3) award a contract to any entity in an eligible market area in which an auction is conducted whose bid is below a clearing price equal to the highest cost bid that will meet capacity targets in the market area. Requires the Secretary to contract with an auction expert to assist in, and a market monitor to monitor, the design, development, and functioning of the auction. Adjusts the covered DME item update for 2012 through 2014 and each subsequent year.

STEM Jobs Act of 2012 - Amends the Immigration and Nationality Act to make up to 55,000 visas available to qualified immigrants who: (1) have a doctorate degree in a field of science, technology, engineering, or mathematics (STEM degree) from a U.S. university; (2) agree to work for at least five years for the petitioning employer or in the United States in a STEM field upon being lawfully admitted for permanent residence; and (3) have taken all doctoral courses in a STEM field, including all correspondence courses, while physically present in the United States. Makes any such unused visas available to aliens who: (1) hold a master's degree in a STEM field from a U.S. university; (2) agree to work for a total of at least five years for the petitioning employer or in the United States in a STEM field upon being lawfully admitted for permanent residence; (3) have taken all master's degree courses in a STEM field, including all correspondence courses, while physically present in the United States; and (4) hold a baccalaureate degree in a STEM field or in the biological and biomedical sciences. Prohibits the Secretary of Homeland Security (DHS) (Secretary) from approving an employer petition on behalf of either of the above class of aliens unless the Secretary receives a determination by the Secretary of Labor that there are not sufficient American workers available for the job. Requires: (1) employers of foreign STEM graduates to submit a job order for the position with the appropriate state workforce agency, and (2) such agency to post the position on its website for at least 30 days. Requires DHS to make available on its website specified information regarding foreign STEM employers, the number of aliens granted STEM status, and their occupations. Eliminates the diversity immigrant program. States that: (1) the permanent priority date for any employment-based petition shall be the date on which the petition is filed, unless such filing was preceded by the filing of a labor certification with the Secretary of Labor, in which case that date shall constitute the priority date; and (2) an alien who is the beneficiary of an employment-based petition that was approvable when filed shall retain such petition's priority date in the consideration of any subsequently filed employment-based petition. Revises student visa provisions.

Amends the Horse Protection Act (HPA) to direct the Secretary of Agriculture to prescribe regulatory requirements for the Department of Agriculture (USDA) to license, train, assign, and oversee persons who are to be hired by the management of horse shows, exhibitions, sales, or auctions and are qualified to detect and diagnose sore horses or otherwise inspect horses at such events. (The soring of horses refers to the application of blistering agents, burns, lacerations, sharp objects, or other substances or devices to a horse's limb to produce a higher gait by making it painful for the horse to step down.) Replaces the current horse inspector appointment process under which the management of a horse show, exhibition, sale, or auction appoints inspectors with a new process requiring the Secretary to assign USDA-licensed inspectors after receiving notice that management intends to hire such inspectors. Specifies that the term "management" includes sponsoring organizations and event managers. Directs the Secretary to disqualify a horse the Secretary determines is sore for specified minimum time periods that increase after the first, second, and third instance. Prohibits a person from causing or directing a horse to become sore for the purpose of any horse show, exhibition, sale, or auction or allowing any such activity respecting a horse which is sore by the owner of such horse. Expands a list of activities designated as unlawful conduct under such Act to include a prohibition on showing, exhibiting, selling, or auctioning a Tennessee Walking, a Racking, or a Spotted Saddle horse with: (1) an action device; or (2) a weighted shoe, pad, wedge, hoof band, or other device or material if it is constructed to artificially alter the gait of such horses and is not strictly protective or therapeutic. Defines "action device" as any boot, collar, chain, roller, or other device that encircles or is placed upon the lower extremity of the leg of a horse in such a manner that it can: (1) rotate around the leg or slide up and down the leg, so as to cause friction; or (2) strike the hoof, coronet band, fetlock joint, or pastern of the horse. Increases the maximum criminal penalties and maximum civil liability penalties to the United States for certain HPA violations. Expands the categories of activities the Secretary may disqualify a violator of such Act from participating in to include: (1) transporting or arranging for the transportation of a horse to or from a show, exhibition, sale, or auction; (2) personally giving instructions to an exhibitor; (3) being knowingly present in a warm-up area, inspection area, or other area that spectators are not permitted; or (4) financing the participation of other individuals. Permits the Secretary to permanently disqualify a person with at least three violations after notice and an opportunity for a hearing.

Cutting Federal Unnecessary and Expensive Leasing Act of 2012 or the Cutting FUEL Act - Requires the Director of the Office of Management and Budget (OMB) to determine: (1) the number of civilian vehicles purchased and leased by each executive agency in FY2010, (2) the total dollar amounts obligated by each agency to purchase and to lease civilian vehicles in FY2010, and (3) the amount that would be 20% less than those combined totals. Prohibits each agency from obligating more than such amount to purchase and lease civilian vehicles in each of FY2013-FY2017. Exempts the purchase or procurement of any vehicle determined by the President to be essential for reasons of national security. Directs the Administrator of General Services (GSA) to ensure that agencies may share excess or unused vehicles for temporary or long-term use through the Federal Fleet Management System.

STEM Education Opportunity Act - Amends the Internal Revenue Code to allow: (1) individual taxpayers a deduction from gross income for STEM (i.e., science, technology, engineering, and mathematics) higher education expenses; and (2) a business-related tax credit for contributions of STEM property (e.g., computer equipment and software, microscopes, and lab equipment), services, and training made to an elementary or secondary school to promote education in the biological sciences, mathematics, earth and physical sciences, computer and information science, engineering, geosciences, and social and behavioral sciences. Defines "STEM higher education expenses" to include any expenses incurred by an individual attending an institution of higher education who is majoring in science, technology, engineering, or mathematics. Requires the Comptroller General (GAO) to submit to Congress a report detailing: (1) the efficacy of this Act in increasing higher education enrollment in the fields of mathematics, science, engineering, and technology; and (2) any effect this Act has had on the price of higher education tuition in such fields.

Requires all sales of coins minted under this Act to include a surcharge of $35 per gold coin, $10 per silver coin, and $5 per half-dollar clad coin. Requires all of the surcharges received from the sale of such coins to be paid to the National Park Foundation for projects and programs to help preserve and protect resources under the stewardship of the NPS and to promote public enjoyment and appreciation of those resources. Prohibits the surcharges paid to the Foundation from being used for land acquisition.

Authorizes the Secretary to collect and set fee amounts. Authorizes the Secretary of Homeland Security (DHS) to admit into the United States a qualifying Canadian citizen over 50 years old and spouse for a period not to exceed 240 days if the person maintains a Canadian residence and owns a U.S. residence or has rented a U.S. accommodation for the duration of such stay. Directs the Secretary to make publicly available each month data for the previous two years regarding visa appointment availability for each visa processing post to allow applicants to identify periods of low demand. Revises the visa waiver program to: (1) authorize the Secretary of Homeland Security to designate any country as a program country, (2) adjust visa refusal rate criteria, including addition of a 3% maximum overstay rate, and (3) revise probationary and termination provisions. Amends the Intelligence Reform and Terrorism Prevention Act of 2004 to direct the Secretary of Homeland Security to include in the Global Entry Trusted Traveler Network individuals who meet security requirements and are employed and sponsored by an international organization which maintains a strong working relationship with the United States. Prohibits enrollment in the Network of a person who is a citizen of a state sponsor of terror as defined in the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010. Directs the Secretary to require U.S. diplomatic and consular missions to: (1) conduct nonimmigrant visa application interviews expeditiously, consistent with national security requirements and in recognition of resource allocation considerations; (2) set a goal of interviewing 80% of all nonimmigrant visa applicants, worldwide, within three weeks of application receipt; and (3) explore expanding visa processing capacity in China and Brazil with the goal of maintaining interview wait times under 15 work days, recognizing that the first priority of U.S. missions abroad is U.S. citizen protection.

Provides for an inflation adjustment to such increased wage threshold after 2013.

Provides that the use of such guidance as the basis for any rule shall be grounds for vacating such rule.

Student Loan Employment Benefits Act of 2012

Student Loan Employment Benefits Act of 2012 - Amends the Internal Revenue Code to exclude from the gross income of an employee amounts paid by an employer under a student loan payment assistance program. Limits the amount of such exclusion to $5,000 in a taxable year. Requires an employer student loan payment assistance program to be a separate written plan of an employer to provide employees with student loan payment assistance. Defines "student loan payment assistance" as the payment of principal or interest on any indebtedness incurred by an employee solely to pay qualified higher education expenses which are paid or incurred within a reasonable time before or after such indebtedness was incurred and are attributable to education furnished during a period in which such employee was a student eligible for federal financial assistance.

Amends provisions of the federal criminal code governing interstate transportation of firearms or ammunition to require that whenever transported by any means other than a motor vehicle: (1) a firearm shall be in a locked container or secured by a secure gun storage or safety device, and (2) ammunition shall be in a locked container. Excludes from permitted transport of a firearm or ammunition any transportation: (1) with the intent to commit a crime punishable by imprisonment for more than one year that involves the use or threatened use of force against another; or (2) with knowledge or reasonable cause to believe that such a crime is to be committed in the course of, or arising from, the transportation. Prohibits the arrest or detention of a person for a violation of any state or local law or regulation related to the possession, transportation, or carrying of firearms unless there is probable cause to believe that the person is doing so in a manner not provided for under federal law. Provides that when a person asserts this as a defense in a criminal proceeding: (1) the prosecution shall bear the burden of proving, beyond a reasonable doubt, that the person's conduct did not satisfy federal conditions; and (2) the court shall award the prevailing defendant a reasonable attorney's fee. Authorizes a private right of action (and attorney fees) for deprivation of any right, privilege or immunity secured by federal firearms provisions under color of any state or local law or regulation.

End Trafficking in Government Contracting Act of 2012 - Amends the Trafficking Victims Protection Act of 2000 to expand the authority of a federal agency to terminate a grant, contract, or cooperative agreement involving grantees or contractors who engage in severe forms of trafficking in persons to include grantees or contractors who: (1) engage in acts that directly support or advance trafficking in persons, (2) destroy an employee's immigration documents or fail to repatriate such employee upon the end of employment, (3) solicit persons for employment under false pretenses, (4) charge recruited employees exorbitant placement fees, or (5) provide inhumane living conditions. Requires the Interagency Task Force to Monitor and Combat Trafficking to monitor all known cases and activities involving trafficking in persons that are reported to certain officials of the Department of Defense (DOD).   Prohibits the head of an executive agency from entering into a grant, contract, or cooperative agreement valued at $1 million or more if performance will predominantly be conducted overseas unless a representative of the recipient of such grant, contract, or cooperative agreement certifies that the recipient has implemented a plan and procedures to prevent trafficking in persons. Requires a contracting or grant officer of an executive agency who receives credible evidence that a recipient of a grant, contract, or cooperative agreement has engaged in trafficking in persons or other prohibited activities to request the agency's Inspector General to investigate allegations of trafficking and to take remedial actions, including the suspension of payments under the grant, contract, or cooperative agreement. Amends the federal criminal code to impose a fine and/or prison term of up to five years on any individual who knowingly and with intent to defraud recruits, solicits, or hires a person outside the United States, or attempts to do so, to work on on a government contract performed on government facilities outside the United States by means of materially false or fraudulent pretenses, representations, or promises regarding such employment.

Servicemember Family Protection Act - Amends the Servicemembers Civil Relief Act to provide that if a court renders a temporary order for custodial responsibility for a child based solely on a deployment or anticipated deployment of a parent-servicemember, then the court shall require that upon the return of that servicemember from deployment the custody order that was in effect preceding such deployment shall be reinstated, unless the court finds that reinstatement in not in the child's best interest. Prohibits a servicemember's deployment or possible deployment from being considered in the determination of a child's best interest in a motion seeking a permanent order to modify custody. Provides that under a temporary custody order, if a state law provides a higher standard of protection to the deploying parent-servicemember, then the appropriate court shall apply the higher standard.

National Heritage Area Act of 2012

National Heritage Area Act of 2012 - Establishes a system of National Heritage Areas through which the Secretary of the Interior may provide technical and financial assistance to local coordinating entities to support the establishment, development, and continuity of the National Heritage Areas. Provides for such system to be composed of National Heritage Areas designated by Congress before enactment of this Act or under this Act. Prohibits National Heritage Areas from being: (1) considered to be units of the National Park System, or (2) subject to the authorities applicable to such units. Specifies the criteria that the Secretary shall apply to determine the suitability and feasibility of designating proposed National Heritage Areas. States that designation of a National Heritage Area shall be by Act of Congress and contingent on the prior completion of a management plan and an affirmative determination by the Secretary that the area meets such criteria. Sets forth requirements for National Heritage Area management plans.
