Firefighter Cancer Registry Act of 2016 This bill requires the Centers for Disease Control and Prevention (CDC) to develop and maintain a voluntary patient registry to monitor, collect, and make available epidemiological information related to cancer incidence and trends among firefighters. The CDC should seek to include specified information in the registry, including the number and type of fire incidents attended by an individual. To collect information for the registry, the CDC may incorporate questions into existing public health surveys, questionnaires, and other databases. The CDC must: (1) encourage the inclusion in the registry of data on minority, female, and volunteer firefighters; and (2) seek feedback on the registry from nonfederal experts. The CDC must develop an approval process for making registry data available for research without a fee if findings or publications derived from the research are made public or available to stakeholders.

Naismith Memorial Basketball Hall of Fame Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 coins, 400,000 $1 coins, and 750,000 half-dollar coins in recognition and celebration of the Naismith Memorial Basketball Hall of Fame. The coins shall be in the shape of a dome, and the design on the common reverse of the coins shall depict a basketball. Treasury shall hold a competition to determine the design of the common obverse of the coins, which shall be emblematic of the game of basketball. The bill requires all sales of such coins to include specified surcharges, which shall be paid by Treasury to the Hall to fund an endowment for its operations.

The Office must also provide SBA employees BEIT training to assist small businesses in the use of such technologies. The SBA Chief Counsel for Advocacy shall evaluate the impact of broadband speed and price on small businesses. Services provided by a small business development center shall include accessing and using BEIT as an authorized activity of small business development centers.

Lake Berryessa Recreation Enhancement Act of 2016 This bill establishes as the Lake Berryessa Recreation Area specified land administered by the Bureau of Reclamation that is underlying or adjacent to Lake Berryessa in California, including any improvements. The bill transfers the administrative jurisdiction over the area from the Bureau of Reclamation to the Bureau of Land Management (BLM) of the Department of the Interior. Interior shall develop a management plan for the area and may establish guidelines and restrictions on recreational uses to ensure the safety and security of recreational users. Interior may also issue recreation concession permits, including at the area, to allow a third party to provide facilities and services to visitors on lands and waters managed by the BLM in support of outdoor recreational opportunities. Reclamation shall continue to administer and operate the Monticello Dam and any related facility, including any power facility.

Combating BDS Act of 2016

Combating BDS Act of 2016 This bill authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit investment of its assets in: (1) an entity that such government determines, using credible information available to the public, engages in a commerce or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with, such an entity. Such government shall provide written notice to such an entity before applying such a measure. Such a measure by a state or local government is not preempted by any federal law or regulation. The bill applies to measures adopted by a state or local government before, on, or after the date of this Act's enactment. The bill amends the Investment Company Act of 1940 to prohibit any person from bringing any civil, criminal, or administrative action against any registered investment company, or any officer or employee thereof, based solely upon such company divesting from, or avoiding investing in, securities issued by persons that such company determines, using credible information available to the public, engage in commerce or investment-related boycotts, divestments, or sanctions activities targeting Israel.

Make It In America Manufacturing Communities Act This bill establishes a program to improve the competitiveness of U.S. manufacturing by designating consortiums as manufacturing communities and authorizing federal agencies to provide them with financial and technical assistance. The Department of Commerce must designate consortiums as manufacturing communities using a competitive process and specified criteria. An eligible consortium must: represent a region that is large enough to contain critical elements of the key technologies or supply chain prioritized by the consortium and small enough to enable close collaboration among the consortium's members; include at least one institution of higher education, a private sector entity, and a government entity; and have a lead applicant that is a district organization, an Indian tribe, a state or political subdivision of a state, an institution of higher education, or a nonprofit organization or association cooperating with a political subdivision of a state. Specified federal agencies may support the manufacturing communities by awarding them financial or technical assistance, providing preferential consideration when members of the consortium apply for assistance, or providing a federal point of contact to help members access assistance. Recipients of the financial or technical assistance may use the funds to improve the competitiveness of U.S. manufacturing with investments that may include infrastructure, access to capital, promotion of exports and foreign direct investment, equipment upgrades, workforce training, energy or process efficiency, and other specified purposes.

Education for All Act of 2016 This bill expresses the sense of Congress that: (1) it is in the U.S. national security interest to promote universal basic education in developing countries; and (2) an educated citizenry contributes to economic growth, strengthened democratic institutions, the empowerment of women and girls, and decreased extremism. The Foreign Assistance Act of 1961 is amended to state that it is U.S. policy to work with foreign countries and international and civil society organizations to achieve sustainable quality universal basic education by: (1) assisting developing countries and nongovernmental and multilateral organizations to provide all children with a quality basic education, and (2) promoting education as the foundation for community development. The President, through the U.S. Agency for International Development (USAID), shall develop a comprehensive U.S. strategy to promote quality universal basic education. The President shall give assistance priority to foreign countries in which there is the greatest need and opportunity to expand universal access and to improve learning outcomes, and in which the assistance can produce a substantial, measurable impact on children and educational systems. Priority should also be considered in countries where there are chronically underserved and marginalized populations, or populations affected by conflict or crisis. USAID shall designate a Senior Coordinator of United States Government Actions to Provide Basic Education Assistance, who shall have primary responsibility for the oversight and coordination of all U.S. government resources and international activities to promote quality universal basic education.

Truth in Tuition Act of 2016 This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify eligibility requirements for an institution of higher education (IHE) to participate in federal student aid programs. Specifically, the bill requires an IHE to provide to an admitted graduate or undergraduate student: (1) a multi-year tuition and fee schedule; or (2) a single-year tuition and fee schedule, and a nonbinding, multi-year estimate of net costs after financial aid is awarded. An IHE that provides a single-year tuition and fee schedule must include, in its multi-year estimate of net costs, the average difference between previous year estimates and actual net costs.

Water Infrastructure Trust Fund Act of 2016

Water Infrastructure Trust Fund Act of 2016 This bill amends the Internal Revenue Code to establish in the Treasury a Water Infrastructure Investment Trust Fund and appropriates to it amounts equivalent to the fees received in the Treasury before January 1, 2022, under this Act. The bill requires 85% of amounts in the Fund to be available to the Environmental Protection Agency (EPA) for capitalization grants under the Federal Water Pollution Control Act (commonly known as the Clean Water Act or CWA) and 15% to be available for capitalization grants under the Safe Drinking Water Act. Amounts in the Fund may not be made available for a fiscal year unless the amount of funds appropriated to the Clean Water State Revolving Fund through annual capitalization grants is not less than the average of the annual amounts provided in capitalization grants under the CWA for the immediately preceding five-fiscal-year period. The Department of the Treasury shall: (1) implement a program under which it provides a label suitable for placement on products (for a fee of three cents per unit) to inform consumers that the manufacturer, producer, or importer of the product and other stakeholders participate in the Fund and are contributing to America's clean water; and (2) deposit amounts received in the Treasury. The EPA, with participation by the states, shall conduct a study to: (1) assess the affordability gap faced by low-income populations located in urban and rural areas in obtaining services from clean water and drinking water systems; and (2) analyze options for programs to provide incentives for rate adjustments at the local level to achieve full cost or true value pricing for such services, while protecting low-income ratepayers from undue burden.

Aviation Innovation, Reform, and Reauthorization Act of 2016

Aviation Innovation, Reform, and Reauthorization Act of 2016 This bill reauthorizes the Federal Aviation Administration (FAA) through FY2019 and specified FAA programs for FY2016-FY2022. The bill revises requirements for the pilot program for passenger facility charges at nonhub airports and airport improvement program. The bill establishes: the ATC Corporation as a federally-chartered, not-for-profit corporation; and an Advisory Board of the Corporation. The Department of Transportation (DOT) shall transfer to the Corporation: by a certain deadline FAA employees, property, and facilities; and on October 1, 2019, operational control of FAA air traffic services. DOT shall establish a Safety Oversight and Certification Advisory Committee. The FAA shall issue a notice of a proposed rule reorganizing the certification of, and streamlining the approval of safety advancements for, small airplanes. The FAA shall establish: the FAA Task Force on Flight Standards Reform, and a Regional Consistency Communications Board. The FAA shall establish a safety workforce training strategy. DOT shall take appropriate actions to promote U.S. aerospace standards, products, and services abroad. The FAA shall appoint a Designated Agency Safety and Health Officer. DOT shall develop a comprehensive plan to accelerate the integration of civil unmanned aircraft systems (drones) into the national airspace system. The bill establishes in the FAA an Unmanned Aircraft Systems (UAS) Integration Office. DOT shall establish a UAS detection systems pilot program. The bill prescribes certain requirements with respect to improving passenger air service. The bill also reauthorizes for FY2016-FY2022 the essential air service program and the small community air service development program. The FAA shall submit to Congress a strategic cybersecurity plan. DOT shall establish a remote air traffic control tower pilot program for rural or small communities.

Clean Distributed Energy Grid Integration Act

Clean Distributed Energy Grid Integration Act This bill directs the Department of Energy (DOE) to: (1) study the status of integration of clean distributed energy into electric grids, (2) identify issues requiring additional research or regulatory development, and (3) make grants for research proposals that address technical barriers identified in the study. "Clean distributed energy" means energy technologies that are located on the customer site operating on the customer side of the electric meter and are interconnected with the electric grid. DOE shall convene a stakeholder working group to: address regulatory barriers to deployment of intelligent grid integration of clean distributed energy technologies; and provide guidance on how to address the technical, regulatory, and economic factors that limit widespread integration of grid-level clean distributed energy use in order to advance the integration of such energy into electric grids. DOE may make grants to implement integration demonstration projects, based on study findings, to state and local agencies, public institutions, private companies, electric utilities, and equipment manufacturers.

Protecting Our Youth from Dangerous Synthetic Drugs Act of 2015 This bill amends the Controlled Substances Act to include in the definition of a "controlled substance analogue" a substance designated as such by the Controlled Substance Analogue Committee (established by this bill). It directs the Drug Enforcement Administration (DEA) to establish such Committee as an interagency committee headed by the DEA and comprised of scientific experts in the fields of chemistry and pharmacology from the DEA, the National Institute on Drug Abuse, the Centers for Disease Control and Prevention, and any other federal agency determined by the DEA to be appropriate. The Committee may designate, and shall establish and maintain a list of, controlled substance analogues determined to be similar to a schedule I or II controlled substance in either chemical structure or predictive effect on the body in such a manner as to make it likely that the substance will, or can be reasonably expected to, have a potential for abuse. The DEA must publish a description of each designation made by the Committee. The bill amends the Controlled Substances Import and Export Act to prohibit the importation of any controlled substance analogue except pursuant to such notification or declaration as the DEA may prescribe. It directs the U.S. Sentencing Commission to review and, if appropriate, amend the federal sentencing guidelines and policy statements to ensure that they provide adequate penalties for any offense involving the unlawful manufacturing, importing, exporting, or trafficking of controlled substance analogues and similar offenses.

Mechanical Insulation Installation Incentive Act of 2015 This bill amends the Internal Revenue Code to allow an additional tax deduction for the cost of installing mechanical insulation property. The bill: (1) limits the amount of such deduction to the lesser of 30% or the reduction in energy loss from the installed mechanical insulation property compared to property that meets the minimum requirements of American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) standard 90.1-2007; and (2) allows the cost of replacing mechanical insulation property to be treated as a deductible business expense in the current taxable year. The bill defines "mechanical insulation property" as insulation materials, facings, and accessory products: (1) placed in service in connection with a mechanical system which is located in the United States and of a character subject to an allowance for depreciation; and (2) utilized for thermal requirements for mechanical piping and equipment, hot and cold applications, and heating, venting and air conditioning applications which can be used in a variety of facilities. The bill also allows a tax deduction for capital expenditures related to mechanical insulation property.

Educating to Prevent Eating Disorders Act of 2015 This bill amends the Public Health Service Act to permit the Agency for Healthcare Research and Quality to establish a pilot program to provide students with interventions for eating disorders. Under this pilot program, grants must be awarded to schools that serve students in grades 6-8 and need a nurse trained in recognizing and responding to eating disorders. Schools must use these grants to develop best practices for health care providers to assess, recognize, and respond to students with eating disorders and to hire a health care provider to: (1) follow these best practices, (2) provide information and seminars on eating disorders to teachers and parents, and (3) otherwise serve as a full time health care provider for the school.

This bill makes permanent the Land and Water Conservation Fund (LWCF). Of the appropriations from the LWCF: (1) at least 40% shall be used collectively for federal purposes for certain land and water acquisitions (as currently); (2) at least 40% shall be used collectively to provide financial assistance to states for LWCF purposes and for outdoor recreation, for the Forest Legacy Program, for cooperative endangered species grants, and for the American Battlefield Protection Program; and (3) at least 1.5% or $10 million, whichever is greater, shall be used for projects that secure recreational public access to federal public land for hunting, fishing, or other recreational purposes. The Department of the Interior and the Department of Agriculture shall consider the acquisition of conservation easements and other similar interests in land where it is appropriate and feasible, taking specified considerations into account. The bill establishes a National Park Service Critical Maintenance and Revitalization Conservation Fund in the Treasury for the deposit of specified amounts from revenues due and payable to the United States under the Outer Continental Shelf Lands Act. Amounts deposited in the Fund shall: (1) be used only for the high priority deferred maintenance needs of the National Park Service that support critical infrastructure and visitor services, and (2) be available for expenditure only after amounts are appropriated for such purposes. Amounts in the Fund shall not be used for acquiring land.

It defines "covered entity" as any business or organization that provides, or licenses, certifies, or coordinates individuals or organizations to provide care, care placement, supervision, treatment, education, training, instruction, or recreation to vulnerable populations including elderly persons, disabled persons, and children. It defines "covered individual" as an individual who: (1) has, seeks to have, or may have unsupervised access to vulnerable populations served by a covered entity; (2) is employed by or volunteers with, or seeks to be employed by or volunteer with, a covered entity; or (3) owns or operates, or seeks to own or operate, a covered entity.

The VA shall ensure that each external clinical review is completed and the individual is notified in writing of the results within 120 days of the election.

Improving Opportunities for Service-Disabled Veteran-Owned Small Businesses Act of 2015 This bill amends the Small Business Act to expand the definition of "small business concern owned and controlled by service-disabled veterans" for purposes of federal agencies awarding small business contracts pursuant to Small Business Administration (SBA) programs to include: a small business concern not less than 51% of which is owned by one or more veterans with service-connected disabilities that are permanent and total who are unable to manage the daily business operations of such concern; or in the case of a publicly owned business, a small business concern not less than 51% of the stock of which is owned by one or more such veterans. (Currently, such veterans with permanent and total disabilities are provided for in a separate small business program under veterans' benefits laws carried out by the Department of Veterans Affairs [VA].) The VA definition of "small business concern owned and controlled by veterans" is revised to be the same as the SBA definition of such term, thereby making the eligibility requirements for participation in veteran-owned small business contracting programs consistent for both SBA programs and VA programs. The VA, when listing small businesses in the database of small business concerns owned and controlled by veterans and the veteran owners of such business concerns, must use SBA regulations with respect to a concern's small business status and the ownership and control of it. If the VA does not verify a concern for inclusion in its database based on its status as a small business or its ownership or control, the concern may appeal the denial to the SBA Office of Hearings and Appeals, whose decision shall be considered a final agency action. The VA shall reimburse the SBA for fiscal year costs incurred by the Office of Hearings and Appeals for actions taken pursuant to this Act.

Early Childhood Nutrition Improvement Act This bill amends the Richard B. Russell National School Lunch Act to revise several provisions related to the child and adult care food program. Under current law: (1) an institution that provides child or day care under the program may be reimbursed for up to two meals and one supplement per day per child; and (2) a family or group day care home sponsoring organization may receive the same maximum reimbursement, but only with respect to a child maintained in a child care setting for at least eight hours per day. The bill eliminates this distinction between institutions and sponsoring organizations, and increases maximum reimbursement for both to: (1) two meals and one supplement or one meal and two supplements per day per child; or (2) three meals and one supplement or two meals and two supplements per day per child, for each child maintained in a child care setting for at least eight hours per day. A determination of a for-profit day care center's eligibility to participate in the program shall be in effect for six months. The Department of Agriculture (USDA) must issue guidance and, as appropriate, regulations to assist in ensuring a fair and effective process for the identification, review, and correction of serious program deficiencies. USDA shall establish an advisory committee to examine the feasibility of reducing unnecessary or duplicative paperwork for those participating or seeking to participate in the program.

Stolen Identify [ sic ] Refund Fraud Prevention Act of 2015 This bill amends the Internal Revenue Code to: (1) require returns relating to employee wage statements, payment of wages in the form of group-term life insurance, and any payments required to be reported on Form 1099-MISC with respect to non-employee compensation to be filed on or before February 15 of the year following the calendar year to which such returns relate; (2) require the Department of the Treasury to notify a taxpayer of an unauthorized use of the identity of such taxpayer and any criminal charges relating to such unauthorized use; (3) require a taxpayer identifying number on W-2 forms instead of a Social Security number; and (4) impose a criminal penalty on any person who willfully misappropriates another person's taxpayer identity. The Internal Revenue Service (IRS) shall: (1) ensure that taxpayers who have been adversely affected by identity theft have a centralized point of contact at the IRS, (2) implement a program to allow a taxpayer who has filed an identity theft affidavit to elect to prevent the processing of any tax return submitted in an electronic format by the taxpayer or a person purporting to be the taxpayer, and (3) report biannually to congressional tax committees on taxpayer identity theft and tax refund fraud and actions taken to combat it. The bill amends the Social Security Act to allow the IRS access to information in the National Directory of New Hires for the sole purpose of identifying and preventing fraudulent tax return filings and claims for tax refunds.

Earnings Contingent Education Loans Act of 2015 or the ExCEL Act of 2015 This bill amends the Higher Education Act of 1965 to replace several existing federal student loan programs with a single repayment plan that caps annual debt repayments based on the borrower's income. The bill terminates the authority of the Department of Education (ED) to make federal Direct Stafford Loans, Direct Unsubsidized Stafford Loans, and Direct PLUS loans, subject to exceptions for existing student borrowers, PLUS loans made to parents of undergraduates, and Direct Consolidation Loans. To replace the programs, the bill establishes the Income Dependent Education Assistance (IDEA) Loan Program and the IDEA Loan Repayment Program, which limit annual repayments based on the borrower's income and prohibit the accrual of interest on loans for active duty service members. Loans under the program are not eligible for the federal public service loan forgiveness program. The bill amends the Social Security Act (SSAct) to require ED and the Department of Health and Human Services to exchange information necessary to use the National Directory of New Hires to assist in the collection of student loans. The bill amends the Internal Revenue Code to require the Department of the Treasury to disclose to ED tax return information necessary to carry out the IDEA Loan Repayment Program.

Sentencing Reform Act of 2015 This bill permits a court to reduce the mandatory minimum prison term imposed on certain non-violent defendants convicted of a high-level first-time or low-level repeat drug offense (including unlawful import, export, manufacture, or distribution of, or possession with intent to distribute a controlled substance). The legislation expands safety valve eligibility to permit a court to impose a sentence below the mandatory minimum for certain non-violent, cooperative drug defendants with a limited criminal history. It reduces the enhanced mandatory minimum prison term for certain defendants who commit a high-level repeat drug offense, use a firearm in a crime of violence or drug offense after a prior conviction for such offense, or unlawfully possess a firearm after three or more prior convictions. It permits retroactive application of such reductions for defendants without a prior serious violent felony conviction, after a court considers certain factors. It also establishes a consecutive mandatory prison term for a defendant who commits a drug offense involving a detectable amount of heroin or fentanyl. The bill makes the Fair Sentencing Act of 2010 retroactive to permit resentencing of a convicted crack cocaine offender sentenced before August 3, 2010.

Reach Every Mother and Child Act of 2015 This bill directs the President to: establish a five-year strategy to achieve, with target countries and donors, the goal of ending preventable maternal, newborn, and child deaths globally and ensure healthy and productive lives within a generation; and provide assistance to implement the strategy. The President shall designate a current U.S. Agency for International Development (USAID) employee serving in the Senior Executive Service or at the level of a Deputy Assistant Administrator or higher to serve concurrently as the Maternal and Child Survival Coordinator, who shall be responsible for: overseeing such strategy, and all U.S. government funds appropriated or used for international maternal and child health and nutrition programs. The U.S. government, through USAID and other relevant executive branch agencies, should identify and remove financial barriers to strengthen access to delivery systems for vulnerable and marginalized populations by leveraging public and private capital to expand delivery of interventions for maternal, newborn, and child health.
