Securing Our Border States Act This bill requires the Department of the Treasury to provide grants to states for building barriers and related infrastructure along the U.S.-Mexico border. Within 30 days of receiving a certification from a border state that it intends to use such grant funding for constructing a border barrier, Treasury must disburse funds to the state, with the amount based on the number of miles of border in that state that currently does not have a border barrier. The bill provides $22 billion of funding for this grant program and permanently rescinds $22 billion from funds made available for various assistance programs related to COVID-19.

Protecting Life on College Campus Act of 2021 This bill prohibits the award of federal funds to an institution of higher education (IHE) that hosts or is affiliated with a school-based service site that provides abortion drugs or abortions to its students or to employees of the IHE or the site. An IHE that hosts or is affiliated with a site must, in order to remain eligible for federal funds, annually certify that the site does not provide abortion drugs or abortions to students or employees.

Migrant Child Trafficking Prevention and Accountability Act of 2021 This bill imposes sanctions on an alien parent (or guardian) of an unaccompanied alien child who arrives at any U.S. border or port of entry. Under current law, an alien may arrive in the United States (whether or not at a port of entry) and request asylum, subject to certain restrictions. If the parent is not a lawful permanent resident, that parent shall be permanently barred from adjusting immigration status and deemed inadmissible into the United States. In addition, such a parent shall be deemed to have violated certain crimes related to assisting or abetting an alien's attempt to enter into the United States in violation of immigration laws, even if the parent's actions would fall under an exception for a first offense in assisting or abetting certain family members. If the parent is a lawful permanent resident, that parent shall be ineligible for any federal public benefit.

Wildfire Prevention and Drought Mitigation Act of 2021 This bill categorically excludes forest management activities carried out on specified public lands from requirements to conduct environmental assessments and environmental impact statements. In order to be excluded from environmental review, the primary purposes of such activities must be to protect a municipal or tribal water source from damage caused by wildfire; improve watershed or habitat conditions; improve, maintain, or restore water yield or quality; improve, maintain, or restore snowpack; or adapt the forest landscape to an increased threat of drought. The bill limits the categorical exclusion to activities that manage up to 10,000 acres of land. However, activities that manage up to 30,000 acres of land may be categorically excluded from environmental review if the activities are located in areas that (1) are in a severe, extreme, or exceptional drought; or (2) have been in such droughts in the previous five years.

Securing the Homeland from International Entrants with Life-threatening Diseases Act or the SHIELD Act This bill suspends for one year the admission and parole into the United States of certain categories of individuals who are from or were recently in a country that fails to meet certain criteria related to COVID-19. This restriction applies to certain individuals entering the United States from Mexico or Canada through a port of entry or U.S. Border Patrol station and (1) whose country of origin has not been categorized by the Centers for Disease Control and Prevention as a low-risk country for COVID-19, or (2) who was in such a country at any time in the 30 days before arriving in the United States. The bill exempts certain individuals from this restriction, including U.S. citizens and lawful permanent residents, members of the Armed Forces, and persons from a foreign country who arrive at a designated port of entry with valid travel documents. The Department of Homeland Security shall transport barred individuals to a foreign location, such as an individual's country of origin, to the extent practicable.

Reprioritizing Unserved Rural Areas and Locations for Broadband Act of 2021 or the RURAL Broadband Act of 2021 This bill restricts the use of Rural Utilities Service grants or loans to deploy broadband infrastructure that would overbuild or otherwise duplicate existing broadband networks.

Preserving Rules Ordered for The Entities Covered Through 340B Act of 2021 or the PROTECT 340B Act of 2021 This bill prohibits pharmacy benefit managers (PBMs) and health insurance plans from discriminating against health providers participating in the 340B drug pricing program, including pharmacies contracted with such providers to dispense 340B drugs. The 340B program allows certain providers to receive covered outpatient drugs at reduced prices from manufacturers. Specifically, PBMs and insurance plans may not reimburse 340B participants at a lower rate than other entities not participating in the program; impose differing terms (such as fees, charge-backs, or audits) on 340B participants; interfere with an individual's choice to receive drugs from a 340B participant; require 340B participants to identify which drugs fall within the program; or refuse to contract with a 340B participant on the basis that they utilize the program. Violations of this bill are subject to a civil penalty of not more than $5,000 per violation per day. These prohibitions also apply to prescription drug (Part D) sponsors under Medicare. The bill also provides for a process to prevent duplicate 340B drug discounts to states under Medicaid.

Listing Reform Act This bill modifies requirements concerning the review of petitions to add a species to the list of endangered or threatened species or to remove a species from the list. Specifically, the bill allows the Department of the Interior and the Department of Commerce to prioritize the consideration of petitions to list a species as endangered or threatened other than in the order in which the petitions are received. The appropriate department may not give general priority to petitions to add species to the list of endangered or threatened species over petitions to remove a species from the list. The deadline for the appropriate department to decide on whether or not a petition to list or remove a species should be granted is changed from within 12 months to as expeditiously as possible. The appropriate department is given the authority to preclude the listing of a species as threatened due to the likelihood of significant, cumulative economic effects that would result from such listing or from the likely resulting designation of critical habitat of the species. Once a petition is precluded due to those economic effects, the appropriate department may not reconsider that finding unless the department (1) determines there is endangerment of extinction of the species; or (2) receives a new petition to add the species to the list that includes an analyses concluding that alternative actions are possible other than those resulting in significant, cumulative economic effects.

Veterans in Parks (VIP) Act This bill makes the America the Beautiful-National Parks and Federal Recreational Lands Pass available, without charge, to members of the Armed Forces, veterans, and Gold Star Families. The pass covers the entrance fee and standard amenity recreation fee for all federal recreational lands and waters.

Proven Forest Management Act of 2021 This bill directs the Department of Agriculture (USDA), when conducting a forest management activity on National Forest System land, to coordinate with impacted parties to increase efficiency and maximize the compatibility of management practices across such land. USDA shall conduct such an activity on National Forest System land in a manner that attains multiple ecosystem benefits, including reducing forest fuels and maintaining biological diversity. However, a forest management activity shall not be conducted if the costs associated with attaining such benefits are excessive. Additionally, the USDA shall (1) establish any post-program ground condition criteria for a ground disturbance caused by a forest management activity required by the applicable forest plan, and (2) provide for monitoring to ascertain the attainment of relevant post-program conditions. The bill categorically excludes certain forest management activities for reducing forest fuels from certain environmental impact requirements. USDA or the Department of the Interior, as appropriate, in conjunction with land adjustment programs, may enter into contracts and cooperative agreements with a qualified entity to provide for fuel reduction, erosion control, reforestation, Stream Environment Zone restoration, and similar management activities on federal lands and nonfederal lands within such programs.

No Taxpayer Funding for the Central American Minors Program Act This bill prohibits using federal funds to carry out the Central American Minors program, a Department of Homeland Security and Department of State program that reunites qualified children from El Salvador, Guatemala, and Honduras with their parent who is lawfully present in the United States.

Increasing Health Coverage through HRAs Act of 2021 This bill provides statutory authority for the Department of the Treasury, the Department of Labor, and the Department of Health and Human Services rule dated June 20, 2019, which provides for the integration of health reimbursement arrangements and other account-based health plans with individual health insurance coverage or Medicare.

Transparency of Migration Act This bill requires the Department of Homeland Security and the Department of Health and Human Services (HHS) to make publicly available online certain information about individuals unlawfully present in the United States who are (1) apprehended by U.S. Customs and Border Protection and sent to a federal detention center or released into the United States, or (2) processed through an HHS facility. This information must be updated weekly and must include daily numbers, the country of origin of such individuals, and other details.

Cutting Unnecessary Regulatory Burdens Act This bill generally requires agencies to repeal at least two rules before promulgating a major rule (i.e., a rule with a significant economic impact, cost to consumers, or adverse effects on competition). Further, unless required by law, an agency may not issue a rule that exceeds the total cost of the rules to be repealed without approval by the Office of Management and Budget. These requirements do not apply to major rules related to agency procedures, the Armed Forces, national security, or foreign affairs.

Second Amendment is Essential Act of 2021 This bill directs the Department of Homeland Security to designate the business of importing, manufacturing, or dealing firearms, or importing or manufacturing ammunition, as a critical infrastructure sector. Additionally, the bill states that individuals who are employed by those entities are critical infrastructure workers. The term critical infrastructure means systems and assets, physical or virtual, so vital to the United States that the incapacity or destruction of such systems and assets would have a debilitating impact on security, national economic security, national public health and safety, or any combination of those matters.

Vote Outcome Transparency in Elections Act or the VOTE Act This bill establishes certain requirements for counting ballots in federal elections. Specifically, the bill requires the appropriate state or local election official, within one hour after the closure of a polling place on election day, to submit a report to the chief state election official. The report must document (1) the total number of voted ballots in the possession of the state or local official, and (2) the total number of voted ballots that have been tabulated for the election. Within one hour after the closure of polling places on election day, the chief state election official must (1) submit a final report to the chief executive of the state, and (2) make the final report publicly available on a government website. The bill also requires each state and local jurisdiction to ensure that voted ballots delivered by postal mail are postmarked, signed, or otherwise indicated as delivered by the U.S. Postal Service.

Responsible Practical Training Act of 2021 This bill imposes limits on the Optional Practical Training program and addresses related issues. (The program provides an F-1 student visa holder temporary employment authorization before or after completion of the student's studies, or both. Currently, an eligible alien may receive up to 12 months of employment authorization under the program, with a 24-month extension available to certain individuals with degrees in certain fields related to science, technology, engineering, or math.) Specifically, the bill requires the Department of Homeland Security to issue regulations to (1) limit the program to six months and eliminate any extensions; and (2) exclude from the program any alien with a degree or working in a sensitive field, such as military-related fields. The Department of Labor must conduct a wage analysis of the Optional Practical Training program and Curricular Practical Training program. The analysis must include a determination as to whether the aliens in the programs received wages appropriate for the type and location of employment.

Firearm Due Process Protection Act This bill expands the grounds for pursuing judicial remedies related to certain firearm transfers. Additionally, the bill establishes procedural rules applicable to actions for judicial remedies. Current law authorizes judicial remedies for an individual who is erroneously denied a firearm (e.g., an individual is denied a firearm but the individual is eligible to receive or possess a firearm). This bill authorizes remedies for an individual who experiences an extended delay (i.e., a delay of more than 60 days) on a firearm transfer. Additionally, the bill requires an expedited hearing on an action for judicial remedies and places the burden of proof on the respondent to show by clear and convincing evidence that the individual was ineligible to receive or possess a firearm.

Essential Caregivers Act of 2021 This bill requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and nearby inpatient rehabilitation facilities to establish an essential caregivers program during a public health emergency. Under the program, facilities must allow each resident to select up to two essential caregivers to provide daily living assistance, emotional support, or companionship during the emergency. Facilities must afford such caregivers 12 hours of access to residents each day (or unlimited access for end-of-life care), and caregivers must agree to follow facility protocols for staff safety. Facilities may deny access to caregivers who violate protocols, subject to certain notification requirements; the Centers for Medicare & Medicaid Services must establish an appeals process relating to such decisions and may take specified enforcement actions against facilities that violate the bill's requirements.

Children Have Opportunities in Classrooms Everywhere Act This bill allows tax-exempt distributions from qualified tuition programs (known as 529 plans) to be used for additional educational expenses in connection with elementary or secondary school. The bill also allows certain federal funds for elementary and secondary education to follow a student from a low-income household to the public school that the student attends or for tax-exempt educational expenses. Under current law, tax-exempt distributions in connection with elementary or secondary school are limited to tuition for a public, private, or religious school. The bill allows these distributions to be used additionally for curriculum and curricular materials, books or other instructional materials, online educational materials, tutoring or educational classes outside the home, testing fees, fees for dual enrollment in an institution of higher education, and educational therapies for students with disabilities. Distributions may also be used for tuition and the purposes above in connection with a home school (whether treated as a home school or a private school under state law). In addition, the bill directs state educational agencies to allocate grant funds to ensure the funding follows students to their public school or for other tax-exempt educational expenses outlined by the bill. Each state that carries out these allocations must establish a plan that allows the parent or guardian of an eligible child to apply for grant funds.

Lymphedema Treatment Act This bill provides for Medicare coverage of lymphedema compression treatment items. Specifically, the bill provides for coverage of (1) standard and custom fitted gradient compression garments that are prescribed by a physician or other specified health care professional to treat lymphedema, and (2) other devices determined to be effective in the prevention or treatment of lymphedema.

Military Spouse Student Loan Deferment Act This bill allows certain military spouses to defer payment on their federal student loans for 90 days. Specifically, borrowers are eligible to receive this deferment if (1) their spouse is an active duty service member of the Armed Forces, (2) they have lost their employment due to a permanent change in duty station of their spouse, and (3) they provide certain documentation to the Department of Education. Loan interest shall not accrue during the deferment period.

Protect Americans from Foreign Criminals Act of 2021 This bill requires the Department of Homeland Security (DHS) to conduct background checks before releasing from custody an alien who is unlawfully present in the United States. Specifically, before releasing such an individual from detention while removal proceedings are pending, DHS must conduct a background check using criminal history databases covering the United States, the individual's country of origin, and any country that the individual transited through. DHS may not release the individual if the individual is (1) facing charges for (or convicted of) an aggravated felony, (2) a member of a criminal street gang, or (3) subject to mandatory detention on various crime- or security-related grounds. Furthermore, DHS must review and determine whether the criminal history databases of countries around the world meet standards for accessibility, accuracy, and other factors. DHS may not release a detained individual if a background check for that individual is required from a country with databases that fail to meet the relevant standards.

Repaying the Rural Borderlands Act of 2021 This bill requires the Department of Homeland Security (DHS) to reimburse individuals, entities, and state and local governments for damage to property caused by aliens entering the United States along the southern border. DHS must also reimburse local governments for the costs of providing care, such as housing and schooling, to such aliens.

Stop Cancel Culture from Degrading Honor Act This bill prohibits the rescission of a military decoration after 10 years have passed since it was awarded unless the award was based on fraud or other misinformation or the individual awarded the decoration is prohibited from interment memorialization in the National Cemetery Administration of the Department of Veterans Affairs or Arlington National Cemetery.

State Antitrust Enforcement Venue Act of 2021 This bill exempts antitrust actions brought by states from the Judicial Panel on Multidistrict Litigation's processes regarding transfers and consolidations of cases. Under current law, civil actions that are pending in different federal courts, and that involve common questions of fact, may be transferred to a single court district for coordinated or consolidated trial proceedings. Current law exempts antitrust actions from consolidation or transfers only if they are brought by the United States.

Broadband for Rural America Act This bill modifies and consolidates Department of Agriculture (USDA) programs for expanding broadband internet in rural areas. Specifically, the bill modifies a program that provides grants, loans, and loan guarantees to support broadband expansion in rural areas. Modifications include revising the criteria used to prioritize applications and projects and changing the name of the program to the ReConnect Rural Broadband Program. Additionally, the bill terminates on June 30, 2022, a Department of Agriculture (USDA) COVID-19 response program that supports broadband expansion in rural areas for distance learning and telemedicine. Any remaining program funds available after the termination date shall be used for the ReConnect Rural Broadband Program. The bill also expands coordination requirements that apply to the Department of Commerce, USDA, the Federal Communications Commission (FCC), and the National Telecommunications and Information Administration. This includes requiring the use of specified FCC maps when assessing a community's access to broadband.

Gigabit Opportunity Act This bill authorizes the designation of qualified gigabit opportunity zones in low-income communities and provides tax incentives for investments in such zones. Governors may submit nominations for a limited number of qualified gigabit opportunity zones in low-income communities to the Department of the Treasury for certification and designation and must give particular consideration to areas that are facing obstacles to economic development due to a lack of geographic broadband coverage or speed; are the focus of mutually reinforcing state, local, or private economic development initiatives; are poised for economic growth that requires access to high speed broadband for commercial purposes; and represent the areas of a state where such service would result in the highest return on investment. For eligible taxpayers who sell certain broadband services, the bill allows (1) deferrals, reductions, or exemptions from taxes on capital gains invested in certain property used to provide broadband services in a zone; and (2) immediate expensing of the costs of the property. The bill also allows tax-exempt private activity bonds to be used for certain broadband projects in the zones. Within one year of enactment of this bill, the Federal Communications Commission must publish a Uniform Model Broadband Deployment Act containing laws for the state regulation of the deployment of broadband services. Qualified zones must either adopt the Act or laws comparable to the Act.

Pausing Unrelenting Markups on Petroleum Act of 2021 or the PUMP Act of 2021 This bill suspends the excise tax on gasoline other than aviation gasoline during a specified holiday period. The bill defines holiday period as the period beginning on the enactment date of this bill and ending on the latest of (1) the first date after enactment on which the public health emergency declared for COVID-19 is no longer in effect, or (2) 180 days after enactment.

Jump-Start the Economy with Jobs Act This bill requires each state that offers pandemic unemployment assistance (PUA) or pandemic emergency unemployment compensation (PEUC) to condition benefit eligibility for a long-term unemployed individual on an employer's confirmation that work is unavailable for the unemployed individual. Specifically, each state unemployment agency must request confirmation from the unemployed individual's most recent employer that the individual's position is not available at the time of the request. Unless the employer provides this confirmation, the state must terminate the individual's PUA or PEUC. The bill's provisions apply only to long-term unemployed individuals who have received PUA or PEUC for more than 30 weeks of unemployment.

National Strategic and Critical Minerals Production Act of 2021 This bill sets forth environmental review requirements for the mine permitting process and limits the review to 30 months. Under the bill, projects that provide minerals vital to job creation, energy infrastructure, coastal resilience and restoration, economic competitiveness, and national security must be considered to be infrastructure projects as described in Executive Order 13807, titled Establishing Discipline and Accountability in the Environmental Review and Permitting Process for Infrastructure Projects and dated August 15, 2017. This order directed agencies to ensure that the environmental review and permitting process for infrastructure is coordinated, predictable, and transparent. The Bureau of Land Management (BLM) or the Forest Service must appoint a project lead for the mine permitting process to coordinate with other agencies to ensure that the agencies minimize delays, set and adhere to timelines for completion of the permitting process, set clear permitting goals, and track progress against goals. The project lead must also determine the amount of financial assurance required for reclamation of a mineral exploration or mining site. The bill considers the requirements of the National Environmental Policy Act of 1969 to be satisfied if the BLM or the Forest Service determines that the agency issuing the permit will address specified factors, such as environmental impacts of the permit or alternatives to issuance of the permit. Additionally, the bill exempts projects on National Forest System land from regulations that prohibit timber tree cutting and road construction in areas without roads.

This bill prohibits any executive agency from contravening Executive Order 13950 (Combating Race and Sex Stereotyping), except as such order relates to contractors and grant recipients.
