Amends the Water Resources Development Act of 1996 to eliminate the pilot program status of the Chesapeake Bay environmental restoration and protection program. Permits the nonfederal share of project costs of a local cooperation agreement to include in-kind services. Treats funds provided for a project by a federal agency other than the Corps of Engineers as nonfederal funds for purposes of cost sharing requirements. Authorizes the Secretary of the Army to carry out projects under the program in the Chesapeake Bay watershed, with the goal of carrying out projects in Delaware, New York, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia (currently the Secretary is required to establish at least one project in each of Maryland, Virginia, and Pennsylvania). Directs the Secretary to establish a program, to be administered by the National Fish and Wildlife Foundation, to provide small watershed grants for technical and financial assistance to local governments and nonprofit organizations in the Chesapeake Bay region. Permits the use of grant funds only for implementation of cooperative tributary basin and other Chesapeake Bay-wide strategies that address storm water management or the establishment, restoration, protection, or enhancement of natural habitat associated with the Chesapeake Bay ecosystem. Increases the authorization of appropriations for the Cheasapeake Bay program. Directs the Secretary to develop at federal expense and submit to Congress a comprehensive plan to prioritize projects within the Chesapeake Bay watershed.

Special Criminal Contempt of Congress Procedures Act of 2008 - Establishes alternate procedures for the prosecution of current or former officers or employees of the executive branch found in contempt of Congress for refusal to testify or produce documents in response to a congressional subpoena. Establishes a Special Division of the U.S. Supreme Court to hear such criminal contempt cases. Requires the Chief Justice of the U.S. Supreme Court to designate three judges or justices, one of whom shall be an active judge of the U.S. Court of Appeals for the District of Columbia, to serve on the Special Division. Requires the Special Division to appoint a special advocate to serve as the prosecuting attorney in criminal contempt cases after the Attorney General declines to present such cases to a grand jury. Grants full power and independent authority to the special advocate to exercise all prosecutorial functions and powers. Sets forth provisions for the removal of the special advocate and the termination of the special advocate's authority. Makes this Act effective on January 20, 2009.

Providing Real Outreach for Veterans Act of 2008 or PRO-VETS Act of 2008 - Directs the Secretary of Veterans Affairs (Secretary) to enter into an agreement with the Secretary of Defense for the transfer of data to the Secretary for providing members of the Armed Forces and veterans with individualized information concerning veterans' benefits that each member and veteran may be eligible for. Requires the Secretary, after receiving such data, to: (1) compile a list of all benefits for which each member or veteran may be eligible; (2) notify the member or veteran (or their legal representative) of such benefits; and (3) provide a second notification if the member or veteran does not apply for a listed benefit within 60 days, as well as annual notifications thereafter. Requires additional notifications based on changed circumstances. Allows each member or veteran the option to decline further notifications. Directs the Secretary to use transferred data to reduce the amount of information that a member or veteran must provide when applying for benefits. Requires the Secretary of Defense to provide a member or veteran the opportunity to decline authorization for the transfer of information under this Act.

Recreational Performance Outerwear Apparel Act of 2008 - Amends the Harmonized Tariff Schedule of the United States to provide for the duty-free treatment of certain recreational performance outerwear. Establishes the Sustainable Textile and Apparel Research Fund (STAR Fund). Requires the Secretary of the Treasury to: (1) impose and collect, with specified exceptions, a fee of 1.5% of the appraised value of imported recreational performance outerwear and to deposit amounts collected into the STAR Fund; and (2) make quarterly distributions from the STAR Fund to one or more appropriate organizations to conduct applied research, development, and education activities to enhance the competitiveness of U.S. businesses in clean, eco-friendly apparel, other textile and apparel products, and sewn-product design and manufacturing.

Timley Due Process for the Disabled Act of 2008 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to direct the Commissioner of Social Security to: (1) establish time frames, within specified limits, to ensure timely disability determinations; and (2) establish a program for the monitoring of disability determinations in reconsideration.

Amends the Energy Policy and Conservation Act to revise requirements for the sale by the Secretary of Energy of products from the Northeast Home Heating Oil Reserve. Authorizes the Secretary to sell from the Reserve if the President finds that: (1) there is a severe energy supply interruption (as under existing law); or (2) the price of home heating oil threatens the health and safety of residents of the Northeast. Requires the Secretary to sell specified percentages of the quantity of products in the Reserve as of November 1 of a fiscal year if the President finds that, on successive monthly winter dates of the same fiscal year, the average retail price of No.2 heating oil in the Northeast is equal to or more than $4.00 per gallon. Requires the Secretary to use: (1) half of any revenue derived from such sales to provide assistance to low-income consumers of heating oil under the Weatherization Assistance Program for Low-Income Persons of the Energy Conservation and Production Act; and (2) half to provide any additional home energy assistance needs of one or more state arising from a natural disaster or other emergency.

Great Lakes Legacy Reauthorization Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to include aquatic habitat restoration activities among activities the Great Lakes National Program Office is authorized to implement for the remediation of sediment contamination in areas of concern. Prohibits the Administrator of the Environmental Protection Agency (EPA) from implementing such a remediation project if any nonfederal sponsor has not entered into a written agreement with the Administrator under which each party agrees to carry out its responsibilities and requirements for the project. Revises provisions concerning the nonfederal share of the project costs. Requires the Administrator to implement at federal expense the initial site characterization of a project for the remediation of contaminated sediment. Repeals a prohibition against implementing a project unless the nonfederal sponsor agrees to maintain aggregate expenditures from all other sources for remediation programs in the area of concern in which the project is located at or above the average level of such expenditures in the two fiscal years preceding the date on which the project is initiated. Authorizes appropriations through FY2013 for: (1) such remediation projects; and (2) the development and use of innovative approaches, technologies, and techniques for such remediation. Limits to 20% the amount of funds appropriated for remediation projects that may be used for site characterization.

Recognizes the 25th anniversary of "Black July" and mourns its victims and the victims of the ongoing violence in Sri Lanka. Condemns attacks on civilian populations by the Liberation Tigers of Tamil Eelam (LTTE) and urges the cessation of violence and the recruitment of child soldiers. Urges the government of Sri Lanka to pursue a political resolution, rather than a military solution, to the conflict. Calls upon the President to urge Sri Lanka to accept an international human rights monitoring presence. Supports U.S. efforts to work with the government of Sri Lanka, other relevant stakeholders to the conflict, and the international community to facilitate humanitarian operations, hold accountable violators of human rights and international humanitarian law, and promote conditions for a lasting peace.

National Guard Technician Recruitment and Retention Act of 2008 - Provides that if an individual is first employed by the National Guard as a military technician (dual status) while already a member of a reserve component, the Secretary of the military department concerned may not require the individual to repay any enlistment, reenlistment, or affiliation bonus connected with the individual's enlistment or reenlistment before such employment. Prohibits such individual from being precluded from receiving any such bonus or denied the opportunity to participate in any Department of Defense (DOD) educational loan repayment program as an additional incentive to accept and maintain reserve membership. Repeals the prohibition against overtime pay for such technicians.

Mental Health for Heroes' Families Act of 2008 - Removes the requirement that, in order for family members of a veteran being treated in a Department of Veterans Affairs (VA) hospital for a non-service-connected disability to be eligible for counseling, training, and mental health services in connection with the veteran's treatment: (1) such services must have been initiated during the veteran's hospitalization; and (2) the continued provision of such services on an outpatient basis is essential to permit the veteran's discharge from the hospital.

Prohibits the use of funds made available to the Department of Defense (DOD) for propaganda purposes within the United States not otherwise specifically authorized by law. Directs the DOD Inspector General and the U.S. Comptroller General to each conduct a study of, and report to Congress on, the extent to which the DOD has violated the prohibition on propaganda established in specified laws. Defines "propaganda" as any form of communication in support of national objectives designed to influence the opinions, emotions, attitudes, or behavior of the people of the United States in order to benefit the sponsor, either directly or indirectly.

Medical Device Safety Act of 2008 - Amends the Federal Food, Drug, and Cosmetic Act to provide that provisions preempting state and local requirements for medical devices intended for human use shall not be construed to modify or otherwise affect any action for damages or the liability of any person under state law. Makes this Act effective as if it were included in the Medical Device Amendments of 1976 and applicable to any civil action pending or filed on or after the date of enactment of this Act.

Recognizes the essential role played by Landing Ship Tanks (LSTs) during World War II, the Korean war, the Vietnam war, Operation Desert Shield, Operation Desert Storm, and many other military and humanitarian operations. Honors the service of the Navy and Coast Guard sailors who served their country aboard the LSTs. Acknowledges the debt modern amphibious operations owe to the LST sailors and ships. Commends the many volunteers of the USS LST Ship Memorial who have preserved the LST 325 as a living memorial in honor and remembrance of the ships and veterans in their service.

Calls for the release of all religious prisoners in Iran and for U.S. officials to speak out publicly about the deteriorating conditions for freedom of thought, conscience, and religion or belief in Iran. Calls on the United Nations Human Rights Council to monitor and demand compliance with the recommendations of the representatives of those special mechanisms that have already visited Iran. Supports: (1) the continued designation of Iran as a "country of particular concern" under the International Religious Freedom Act of 1998; (2) funding to promote democracy and human rights in Iran; (3) the commission of an independent review of Voice of America Persian and Radio Farda; and (4) the establishment of a diplomatic envoy to Iran. Calls on the government of Iran to: (1) release all prisoners held because of their religious or political beliefs; and (2) respect the human rights of all its citizens.

Increasing Transparency and Accountability in Oil Prices Act of 2008 - Expresses the sense of the House of Representatives that the President should immediately send to Congress a request for emergency appropriations for FY2008 for the Commodity Futures Trading Commission (CFTC) in an amount that is sufficient to: (1) help restore public confidence in energy commodities markets and federal oversight of those markets; (2) potentially impose limits on excessive speculation that may be increasing the price of oil, gasoline, diesel, and other energy commodities; (3) significantly improve the information technology capabilities of the CFTC to help it effectively regulate the energy futures markets; and (4) fund at least 100 new full-time positions at the CFTC to oversee energy commodity market speculation and to enforce the Commodity Exchange Act. Amends the Commodity Exchange Act to provide for additional employees for improved enforcement. Amends the Commodity Exchange Act to address the kind of case in which the CFTC grants or considers granting relief to a foreign board of trade from the requirement that it become a designated contract market, derivatives transaction execution facility, or other registered entity with respect to an energy commodity physically delivered in the United States. Requires the CFTC, before granting or considering such relief, to determine that the foreign board of trade: (1) applies comparable principles or requirements regarding the daily publication of trading information and position limits or accountability levels for speculators as apply to a designated contract market, derivatives transaction execution facility, or other registered entity trading energy commodities physically delivered in the United States; and (2) provides such information to the Commission regarding the extent of speculative and nonspeculative trading in the energy commodity that is comparable to the information the Commission determines necessary to publish a Commitment of Traders report for such a designated contract market, derivatives transaction execution facility, or other registered entity. Requires the Commission to disaggregate and make public monthly: (1) the number of positions and total value of index funds and other passive, long-only positions in energy markets; and (2) data on speculative positions relative to bona fide physical hedgers in those markets.

Prevent Unfair Manipulation of Prices Act of 2008 - Amends the Commodity Exchange Act (CEA) to extend the regulatory authority of the Commodity Futures Trading Commission (CFTC) to certain transactions in derivatives involving specified energy commodities ("included energy transactions"), including those on foreign boards of trade. Defines "included energy transaction" as a contract, agreement, or transaction in an energy commodity for future delivery that: (1) provides for a delivery point in the United States; or (2) is transacted on a computer terminal located in the United States. Prohibits the CFTC from exempting from regulation any "included energy transaction" unless certain notice to Congress and public comment requirements are met. Declares null and void any CFTC "no-action letter" exemptions from CEA requirements for "included energy transactions." Requires the CFTC to establish uniform limits on the aggregate number of positions with respect to "included energy transactions" which may be held by any person for the prompt month, for each month, and for all months in all markets subject to CFTC jurisdiction. Excludes swaps involving "included energy transactions" from any CEA exemption for bona fide hedging transactions. Defines "bilateral included energy transaction" as an included energy transaction executed or traded other than on or through a trading facility. Exempts such transactions from the requirement that transactions be made on or through a designated contract market. Applies to "bilateral included energy transactions" certain reporting and recordkeeping requirements. Instructs the CFTC to publish monthly on its website: (1) the aggregate number and value of long and short positions held by a person in any portfolio constructed to match or track the components of an index of all commodities; and (2) the portion of the positions that are net long positions in "included energy transactions." Amends the Natural Gas Act and the Federal Power Act to set forth enforcement powers of the Federal Energy Regulatory Commission (FERC), including cease-and-desist proceedings, temporary orders, and general implementation authority.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.

Home Energy Affordability Tax Relief Act of 2008 or the HEATR Act of 2008 - Amends the Internal Revenue Code to allow individual taxpayers an income-based refundable tax credit for residential energy costs. Limits such credit to the lesser of 33% of such costs or $500.

Twenty-first Century Communications and Video Accessibility Act of 2008 - Amends the Communications Act of 1934 to define "disability." Requires that equipment providing IP-enabled voice communication services via a built-in speaker provide an internal means for hearing aid use. Redefines "telecommunications relay services." Requires interconnected VoIP (Voice over Internet Protocol) providers and providers of voice communications using an IP-enabled service to contribute to the Telecommunications Relay Services Fund. Requires, unless it would be an undue burden (significant difficulty or expense), that equipment and services for IP-enabled communication be usable by individuals with disabilities. Requires, if such requirements are an undue burden, that the equipment or service be compatible with existing commonly used devices or specialized customer equipment, unless that requirement would be an undue burden. Establishes an accessible products and services clearinghouse. Declares that the transmission and receipt of text messages are telecommunications services for purposes of access by persons with disabilities. Adds telecommunications and IP-enabled communication services needed by individuals with disabilities to the services supported by Lifeline and Link Up programs and other federal universal service support mechanisms. Makes eligible for universal service support certified programs for the distribution of equipment to make telecommunications and IP-enabled communication service accessible by deaf-blind individuals. Requires seamless text communication among interconnected VoIP services, IP-enabled communication services, and telecommunications services. Requires a Federal Communications Commission (FCC) inquiry and report concerning: (1) closed captioning decoder and video description capability; (2) user interfaces; and (3) video programming guides and menus. Revises provisions concerning any apparatus designed to receive television pictures broadcast simultaneously with sound to require that any apparatus that receives or displays video programming transmitted simultaneously with sound be capable of decoding closed captioning, delivering video description, and conveying emergency information, including Emergency Alert System messages, accessibly to blind or visually-impaired individuals. Requires the FCC video description regulations contained in the Implementation of Video Description of Video Programming, Report and Order to be considered to be in full force and effect and applicable to video programming published after enactment of this Act. Requires identification of methods to convey emergency information accessibly to blind or visually-impaired individuals. Requires that apparatus to receive or display video, including using IP-enabled communication services, allow control by individuals with disabilities and that on-screen menus be accompanied by audio output to enable control by blind or visually impaired individuals. Requires each provider or owner of video programming and each multichannel programming distributor to ensure that video programming information and selection provided by means of a navigational device, guide, or menu is accessible in real-time by individuals with disabilities who are unable to read the visual display.

Affirms the strong and historic ties between the United States and the Kingdom of Saudi Arabia. Disapproves of the May 2008 Memorandum of Understanding between the government of the United States of America and the government of the Kingdom of Saudi Arabia Concerning Cooperation in Nuclear Energy and Other Energy Fields. Reiterates that the United States is committed to nuclear weapons nonproliferation and to preventing the Islamic Republic of Iran's acquisition of nuclear weapons. States that: (1) no agreement for nuclear cooperation between the United States and the Kingdom of Saudi Arabia may enter into force on or after the date of the enactment of this Act; and (2) no nuclear materials and equipment or sensitive nuclear technology shall be exported or reexported, or transferred or retransferred, and no federal agency shall issue any license or authorization for the export or reexport, or transfer or retransfer of these items or assistance to the Kingdom of Saudi Arabia if the end user is a nuclear production or utilization facility, or if the President determines that the material, equipment, technology, or item may be diverted to such a facility.

Horse Transportation Safety Act of 2008 - Prohibits a person from transporting a horse in interstate commerce in a motor vehicle containing two or more levels stacked on top of one another. Sets forth civil penalties for persons who knowingly violate such prohibition.

Responsible Ownership of Public Land Act - Directs the Secretary of the Interior to establish an annual production incentive fee for federal onshore and offshore lands subject to a lease for production of oil or natural gas under which production is not occurring. Prescribes the fee amount for each acre of land from which oil or natural gas is produced for less than 90 days in a calendar year. Establishes the Energy Efficiency and Renewable Energy Fund to serve as depository for fees received under this Act. Enumerates energy programs to be funded with such fees, including: (1) low-income home energy assistance; (2) advanced vehicles research, development, and demonstration; (3) new technologies to improve the energy efficiency of and reduce greenhouse gas emissions from buildings; (4) energy storage systems to support electric drive vehicles, stationary applications, and electricity transmission and distribution; (5) next-generation wind turbines; (6) weatherization assistance low income housing; and (7) wind and solar energy research and development.

Amends the Commodity Exchange Act to make it unlawful for a person to enter into or execute an otherwise excluded swap transaction or exempt transaction involving crude oil, heating oil, gasoline, or diesel fuel (specified energy commodity), unless the person has been certified by the Commodities Future Trading Commission (CFTC) as having the capacity of accepting physical delivery of the commodity. Makes it unlawful, as well, for any person to hold a contract or agreement of sale of a specified energy commodity for future delivery, which is otherwise an excluded swap transaction or an exempt transaction, unless the CFTC has certified that the person has the capacity to produce or manufacture the commodity.

Responsible Federal Oil and Gas Lease Act - Prohibits the Secretary of the Interior from authorizing any new lease for exploration or production of oil or natural gas unless the lessee: (1) certifies for each existing lease that the lessee has diligently developed the lands in order to produce oil or natural gas, or is producing oil or natural gas from such lands; or (2) has relinquished all federal oil and gas leases that are not being diligently developed. Instructs the Secretary to promulgate diligent development regulations that: (1) include benchmarks for oil and gas development to ensure that leaseholders produce oil and gas from each lease within the five-year original term of the lease; and (2) require each leaseholder to submit a diligent development plan showing how the lessee will meet the benchmarks. Establishes a civil penalty for noncompliance with this Act. Amends the Outer Continental Shelf Lands Act, the Mineral Leasing Act, and the Mineral Leasing Act for Acquired Lands Act to set forth lease terms for an initial period of five years, renewable for additional one-year periods, subject to specified conditions.

Ban Poisonous Additives Act of 2008 - Amends the Federal Food, Drug, and Cosmetic Act to deem to be adulterated a food in a container that is composed, in whole or in part, of bisphenol A or that can release bisphenol A into food.

Working Families Gas Tax Credit Act of 2008 - Amends the Internal Revenue Code to allow a tax credit for up to $500 ($1,000 in the case of a joint return) of the cost of gasoline and diesel used in highway vehicles for a nonbusiness purpose when the increase in the price of a gallon of gasoline exceeds the annual inflation rate by not less than 300%. Phases out the amount of such credit for taxpayers with adjusted gross incomes exceeding $75,000 ($150,000 in the case of a joint return).

Impeaches President George W. Bush for high crimes and misdemeanors. Sets forth articles of impeachment stating that President Bush, in violation of his oath of office: (1) illegally spent public dollars on a secret propaganda program to manufacture a false cause for war against Iraq; (2) misused intelligence reports to deceive Congress and the public about a connection between Saddam Hussein and al Qaeda and the the terrorist attacks of September 11, 2001; (3) mislead Congress and the public into believing that Iraq possessed weapons of mass destruction and posed an imminent threat to the United States; (4) illegally misspent funds to begin a war in secret prior to congressional authorization; (5) invaded Iraq in violation of U.S. law, the United Nations Charter, and international criminal law and failed to obtain a declaration of war; (6) failed to protect U.S. troops in Iraq by not providing them with body and vehicle armor and promoted false stories about the deaths and injuries of members of the U.S. military; (7) used public funds to construct permanent U.S. military bases in Iraq; (8) invaded Iraq to obtain control of its oil resources; (9) created a secret task force to guide U.S. energy and military policy in usurpation of the role of Congress in legislating such policy; (10) misused classified intelligence information and conspired to identify a covert agent of the Central Intelligence Agency (CIA); (11) established policies granting U.S. government contractors in Iraq immunity from prosecution; (12) recklessly misspent public dollars on private contractors in Iraq; (13) detained U.S. citizens and foreign captives indefinitely and without charge; (14) authorized torture of captives in Afghanistan and Iraq; (15) kidnapped and transported individuals to countries known to practice torture; (16) authorized the arrest and detention of at least 2,500 children as enemy combatants in violation of the Geneva Convention; (17) mislead Congress and the public about threats from Iran; (18) created secret laws through the issuance of legal opinions by the Department of Justice and violated the Posse Comitatus Act; (19) authorized warrantless electronic surveillance of U.S. citizens; (20) directed telecommunication companies to create databases of the private telephone numbers and emails of U.S. citizens; (21) used signing statements to claim the right to violate laws enacted by Congress; (22) failed to comply with congressional subpoenas and instructed former executive branch employees not to comply with such subpoenas; (23) tampered with the conduct of free and fair elections and corrupted the administration of justice; (24) conspired to violate the voting rights of U.S. citizens; (25) pursued policies calculated to destroy the Medicare program; (26) failed to prepare for the predictable disasters caused by Hurricane Katrina; (27) mislead Congress and the public in an effort to undermine efforts to address global climate change; and (28) failed to take proper steps to protect the United States against the terrorist attacks of September 11, 2001, obstructed investigations into such attacks, and recklessly endangered the health of first responders near the site of such attacks.

Commends national and community organizations for promoting safe Internet use and providing information and training that develops critical thinking and decision making skills needed to use the Internet safely. Calls on parents, educators, Internet safety organizations, law enforcement, community leaders, Internet service providers, and volunteers to increase their efforts to raise the level of awareness for the need for online safety.
