Protect Our Troops and Our Constitution Act of 2008 - Prohibits funds from being used to: (1) establish or maintain any permanent or long-term U.S. military base or facility in Iraq; or (2) implement any agreement that is consistent with U.S. security commitments to Iraq under the Declaration of Principles or any agreement that provides "authority to fight" for U.S. Armed Forces engaged in combat operations other than for self-defense purposes, unless the agreement is an Article II treaty with respect to which the Senate has given its advice and consent to ratification or the agreement is approved by an Act of Congress enacted after the date of the enactment of this Act. Expresses the sense of Congress that: (1) long-term U.S.-Iraq relations should be determined by the U.S. Administration taking office on January 20, 2009; (2) in determining its policy toward Iraq such Administration should consult with Congress, the government of Iraq, Coalition partners, and Iraq's neighbors; and (3) to maintain international legal authority as well as immunity from Iraqi prosecution for U.S. Armed Forces and other Coalition forces operating in Iraq while such Administration determines policy toward Iraq the current U.S. Administration should encourage the government of Iraq to request renewal of the U.N. mandate for Iraq beyond December 31, 2008.

Amends Atomic Energy Act of 1954 to prohibit the Nuclear Regulatory Commission (NRC) from issuing a license authorizing the importation into the United States of: (1) low-level radioactive waste; or (2) specific radioactive waste streams exempted from regulation under the Low-Level Radioactive Waste Policy Act. Exempts from such prohibition low-level radioactive waste: (1) that is being returned to a U.S. government or military facility authorized to possess it; or (2) resulting from the use in a foreign country of nuclear material obtained by the foreign user from an entity in the United States that is being returned to the United States for management and disposal. Authorizes the President to waive the prohibition and authorize the grant of a specific license only after finding that such importation would meet an important national or international policy goal.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

Provides transitional health care (medical and dental care and other military-related health benefits) for 180 days following separation for members of the Armed Forces separated from active duty who agree to become a member of the Selected Reserve of the Ready Reserve.

Physician Payments Sunshine Act of 2008 - Amends part A of title XI of the Social Security Act to require quarterly transparency reports to the Secretary of Health and Human Services of payments to physicians or their employers, or to a covered organization in which a physician has a significant professional membership interest, by manufacturers of covered drugs, devices, or medical supplies under titles XVIII (Medicare), XIX (Medicaid), or XXI (State Children's Health Insurance Program (SCHIP)) of the Social Security Act. Amends the Internal Revenue Code to prohibit tax deductions for the advertising, promotion, or marketing by manufacturers of drugs, devices, and medical supplies on whom a penalty is imposed for failing to meet the requirements of this Act.

Make Our Veterans Smile Act of 2008 - Directs the Secretary of Veterans Affairs, beginning on January 1, 2009, to provide non-service-connected dental services and treatment and related dental appliances to all veterans with a service-connected disability. (Current law requires the Secretary to provide such services and treatment only to veterans with service-connected disabilities rated as total.)

Prohibits the Secretary of the Interior from offering for oil and gas leasing, or specified related activities, any tract located in the Lease Sale 193 Area of the Alaska Outer Continental Shelf Region before the earlier of: (1) the listing of the polar bear as a threatened or endangered species under the Endangered Species Act of 1973 and a final decision regarding determination of its critical habitat; or (2) the date the Secretary publishes a determination that such listing is not warranted.

Grand Canyon Watersheds Protection Act of 2008 - Withdraws the approximately 1,068,908 acres of the Tusayan Ranger District and federal land managed by the Bureau of Land Management (BLM) in the vicinity of Kanab Creek and in House Rock Valley from: (1) all forms of entry, appropriation, and disposal under the public land laws; (2) location, entry, and patent under the mining laws; and (3) operation of the mineral leasing, geothermal leasing, and mineral materials laws. Subjects such withdrawal to valid, existing rights.

Missing Mercury in Manufacturing Monitoring and Mitigation Act - Declares that the United States should develop policies and programs that will reduce: (1) mercury use and emissions; (2) mercury releases from the reservoir of mercury currently in use or circulation; and (3) exposures to mercury, particularly of women of childbearing age and young children. Amends the Toxic Substances Control Act to prohibit the manufacture of chlorine or caustic soda using mercury cells, effective January 1, 2012. Requires the owner or operator of each chlor-alkali facility to submit to the Environmental Protection Agency (EPA) Administrator and the state in which the facility is located an annual report for 2009-2012 concerning mercury waste, emissions, and content in products. Requires the Administrator to : (1) conduct a comprehensive mercury inventory covering the life and closure of chlor-alkali facilities that cease operations on or after January 1, 2009; and (2) obtain mercury purchase records and such other information from each such facility as are necessary to determine the magnitude and nature of mercury releases from the facility into air and other environmental media.

Entitles federal employees who satisfy age and service requirements for immediate or early retirement under the Federal Employees' Retirement System or the Foreign Service Pension System and who are separated from service or transferred to a position not subject to either of those retirement systems to a lump-sum payment for 15% of the amount of their accumulated sick leave exceeding 500 hours. Prohibits such a payment from exceeding $10,000. Excludes hours of sick leave that are creditable in the computation of any other compensation or benefit.

Federal Land Assistance, Management and Enhancement Act or FLAME Act - Establishes in the Treasury the Federal Land Assistance, Management, and Enhancement Fund (the Flame Fund). Requires amounts in the Flame Fund to be made available to the Secretary of the Interior and the Secretary of Agriculture (the Secretaries) to pay the costs of catastrophic emergency wildland fire suppression activities that are separate from amounts annually appropriated for the predicted annual workload for such activities. Provides for amounts in the Flame Fund to be made available to the Secretaries only after such Secretaries issue a declaration that a wildland fire suppression activity is eligible for funding through the Fund. Directs such Secretaries to establish an accounting and reporting system for the Flame Fund. Requires such Secretaries to: (1) annually report on the use of the funds from the Flame Fund, together with recommendations that the Secretaries may have to improve administrative control and oversight of the Fund; and (2) submit a report that contains a cohesive wildland fire management strategy, consistent with the recommendations of the Comptroller General reports regarding such issue.

Veterans Substance Use Disorders Prevention and Treatment Act of 2008 - Requires each substance use disorder treatment plan developed by a Department of Veterans Affairs (VA) medical center to ensure that such center provides ready access to a full continuum of care for substance use disorders for veterans in need of such care. Outlines the treatment and services that will be considered a full continuum of care. Requires the Secretary of Veterans Affairs to provide outreach to veterans of Operations Enduring Freedom or Iraqi Freedom concerning the availability of such care. Requires the Secretary to ensure that amounts made available to the VA for substance use disorder care, treatment, and services are allocated to ensure a full continuum of such care to veterans regardless of the location of their residence. Directs the Secretary to carry out a two-year pilot program to test the feasibility and advisability of providing veterans who seek treatment for substance use disorders with access to a computer-based self-assessment, education, and specific treatment program through a secure Internet website operated by the Secretary.

Directs the Secretary of Commerce, acting through the Under Secretary for Oceans and Atmosphere, to prescribe regulations to reduce the incidence of vessels colliding with North Atlantic right whales by limiting the speed of vessels. Requires those regulations to incorporate the whale protection measures contained in a specified proposed rule and to provide the same or greater level of protection.

Bear Protection Act of 2008 - Amends the Lacey Act Amendments of 1981 to make it unlawful for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce bear viscera. Defines "bear viscera" as the body fluids or internal organs of a bear, including its gallbladder and excluding its blood or brains. Provides that this Act does not affect the regulation by any state of its bear populations or affect the hunting of bears that is lawful under state laws.

International Renewable Energy Agency (IRENA) Act of 2008 - Requires the President: (1) acting through the Secretary of State and in coordination with the Secretary of Energy, to seek to establish an International Renewable Energy Agency; and (2) to direct the United States Permanent Representative to the United Nations to use the voice and vote of the United States to seek to establish such an agency. Provides that such agency should: (1) support governments in establishing policies and programs that promote renewable energy and energy efficiency measures; (2) assist in conducting country studies of the potential of renewable energy; (3) provide a global status report for renewable energy; (4) provide long-term projections and scenarios to identify market potential, barriers to deployment, and failures in markets and policies, as well as plan for future demand for renewable energy; (5) organize training programs, information campaigns, and courses relating to renewable energy for civil servants, scientists, businesses, and nongovernment organizations; (6) assist in developing and supplying curricula relating to renewable energy for schools and universities; (7) cooperate with financing institutions to develop and support innovative financing mechanisms to promote renewable energy and energy efficiency measures; (8) facilitate the transfer of knowledge and best practices gained from successful renewable energy programs; (9) develop common, nondiscriminatory international norms and quality standards including certification relating to renewable energy; and (10) draft and disseminate statistics, technology information, reports on project implementation, and progress of legislation and policy programs relating to renewable energy.

Toxic Chemical Exposure Reduction Act of 2008 or the TCE Reduction Act of 2008 - Amends the Safe Drinking Water Act to require the Administrator of the Environmental Protection Agency (EPA) to publish a health advisory, including cancer risks, for trichloroethylene that fully protects, with an adequate margin of safety, the health of susceptible populations (including pregnant women, infants, and children), taking into consideration body weight, exposure patterns, and all routes of exposure. Requires the Administrator to promulgate a national primary drinking water regulation for trichloroethylene: (1) that is protective of susceptible populations; and (2) the maximum contaminant level of which is as close to the maximum contaminant level goal for trichloroethylene, and as protective of those susceptible populations, as is feasible. Requires consumer confidence reports to disclose the presence of, and the potential health and cancer risks to susceptible populations from exposure to, trichloroethylene in drinking water. Requires the Administrator to: (1) publish a health advisory (including cancer risks) for trichloroethylene that fully protects the health of susceptible populations from vapor intrusion; (2) establish an integrated risk information system reference concentration of trichloroethylene vapor that is protective of susceptible populations; and (3) apply such reference concentration with respect to any potential vapor intrusion-related investigations or actions to protect public health with respect to trichloroethylene exposure carried out pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 and the Safe Drinking Water Act.

Recognizes the importance of the National School Breakfast Program and its overall positive effect on the lives of low-income children and families, as well as its effect on helping to improve a child's overall classroom performance. Expresses the support of the House of Representatives for states that have successfully implemented school breakfast programs in order to improve the test scores and grades of their participating students. Encourages states to: (1) strengthen their school breakfast programs by improving student access; (2) promote improvements in the nutritional quality of breakfasts served; and (3) inform students and parents of healthy nutritional and lifestyle choices.

Recovery and Stability of Iraq Act of 2008 - Establishes within the Executive Office of the President the position of Iraqi Displacement Coordinator who shall identify programs that address the humanitarian needs of displaced Iraqis and who shall advise and coordinate with the heads of appropriate U.S. departments and agencies, the government of Iraq, countries hosting displaced Iraqis in the region, the United Nations, and other involved nongovernmental and international organizations. Directs the Coordinator to: (1) design a comprehensive strategy to address the needs of displaced Iraqis; and (2) encourage the government of Iraq to develop a long-term plan for the voluntary and safe return of displaced Iraqis to their homes.

Coastal State Climate Change Planning Act of 2008 - Amends the Coastal Zone Management Act of 1972 to establish a coastal climate change adaptation planning and response program to provide assistance to coastal states to voluntarily develop coastal climate change adaptation plans and to provide financial and technical assistance and training to enable coastal states to implement those plans through coastal states' enforceable policies. Authorizes, subject to the availability of appropriations, grants to coastal states for developing the plans and grants for implementation.

Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to require the President to establish a grant program for the revitalization of waterfront brownfield sites. Authorizes such grants to be used for reuse planning, site characterization and assessment, or remediation at waterfront brownfields sites, including the integration of activities related to the design and implementation of water quality improvements, low impact development approaches, green infrastructure, remediation and management of sediments, or flood damage prevention associated with brownfields remediation and reuse. Authorizes the Administrator of the Environmental Protection Agency (EPA) to provide training, research, and technical assistance to individuals and organizations to facilitate waterfront brownfields revitalization. Authorizes funding for brownfields revitalization for FY2008-FY2012. Requires the Administrator to establish and serve as chairperson of a task force on waterfront brownfields revitalization that shall identify: (1) funding and technical assistance resources; (2) barriers to and solutions for revitalization; and (3) methods to coordinate interagency efforts.

Strategic Petroleum Reserve Fill Suspension and Consumer Protection Act of 2008 - Directs the Secretary of Energy to suspend, during calendar year 2008, petroleum acquisition for the Strategic Petroleum Reserve (SPR) through the royalty-in-kind program or any other acquisition method. Authorizes resumption of such acquisition during calendar 2008 not earlier than 30 days after the Secretary notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $50 or less per barrel.

Military Pain Care Act of 2008 - Directs the Secretaries of Defense, Veterans Affairs, and Health and Human Services and the Surgeon General of the United States to develop and implement a pain care initiative in all military health care facilities. Requires the initiative to ensure that all active and retired military personnel and dependents receiving treatment in military health care facilities: (1) are assessed for pain at the time of admission or initial treatment, and periodically thereafter, using a professionally recognized pain assessment tool or process; and (2) receive appropriate pain care consistent with recognized means for assessment, diagnosis, treatment, and management of acute and chronic pain, including, as appropriate, access to specialty pain management services. Requires: (1) Department of Defense (DOD) contracts for medical care for military retirees, dependents, and survivors to include the provision of appropriate care for the treatment of pain; and (2) a Comptroller General study on the adequacy of pain care in DOD health care facilities, services, and programs.

Extends the special survivor indemnity allowance to survivors of members of the Armed Forces who die either in the line of duty or while on active duty after: (1) becoming eligible for retired pay; (2) qualifying, but not applying for, retired pay; or (3) completing 20 years of active service but before eligibility for retirement as a commissioned officer because the member has not completed ten years of active commissioned service.

Coastal State Renewable Energy Promotion Act of 2008 - Amends the Coastal Zone Management Act of 1972 to authorize grants to eligible coastal states to support voluntary state efforts to initiate and complete surveys of portions of coastal state waters and federal waters adjacent to a state's coastal zone to identify potential areas suitable or unsuitable for the exploration, development, and production of renewable (wind, wave, current, tidal, or ocean thermal) energy that are consistent with the enforceable policies of coastal management plans. Requires suitable areas to be given priority consideration by federal agencies for the siting, licensing, leasing, or permitting of renewable energy facilities and requires unsuitable areas to be avoided by federal agencies to the maximum extent practicable.

Climate Change Center and Clearinghouse Act of 2008 - Amends the Small Business Act to establish: (1) the Office of Environment, Energy, and Climate Change within the Small Business Administration (SBA); and (2) the Climate Change Center and Clearinghouse within such Office. Requires the Office to: (1) oversee and administer the Center; (2) promote energy efficiency efforts for, and efforts to reduce energy costs of, small businesses; and (3) oversee efforts by small businesses to develop renewable energy technologies. Requires the Center to: (1) provide information to small businesses on assessing and managing the impacts of climate change and on cost savings and revenue gains possible through carbon credit trading opportunities and federal and state renewable energy and energy efficiency tax relief programs, purchase incentives, and rebate programs; (2) ensure that such information is provided to small businesses on an accessible website and through nationwide workshops; (3) coordinate federal agency efforts to provide support to small businesses for the purpose of maintaining competitiveness while developing green products or services, implementing green business practices, or reducing pollution; (4) develop a baseline study that provides a broad analysis that aggregates small business energy consumption and emissions; (5) raise awareness among small businesses of the information, technical support, and network opportunities made available through the Energy Star Program to reduce energy waste and energy costs; (6) develop a carbon footprint website that contains information on how small business concerns can reduce their carbon footprint, links to other carbon footprint websites, and a calculator for obtaining an estimate of a small business's carbon emissions based on electricity usage, heating fuel usage, and fleet mileage; and (7) develop a marketing plan. Directs: (1) the President to establish an interagency working group to establish goals and priorities for the Center and to provide for interagency coordination of Center activities; and (2) the Administrator of SBA to specify a detailed definition for the terms "green products or services" and "green business practices."

Provides that, if the federal medical assistance percentage (FMAP) determined under title XIX (Medicaid) of the Social Security Act without regard to this Act for a state for FY2008 is less than the FMAP as so determined for FY2007, the FY2007 FMAP shall be substituted for the FMAP for the third and fourth calendar quarters of FY2008, before the application of this Act. Provides that, if the FMAP determined without regard to this Act for a state for FY2009 is less than the FMAP as so determined for FY2008, the FY2008 FMAP shall be substituted for the FMAP for the first, second, and third calendar quarters of FY2009, before the application of this Act. Provides that, for each eligible state for the third and fourth calendar quarters of FY2008, and for the first, second, and third calendar quarters of FY2009, the FMAP shall be increased by 2.95 percentage points. Provides for an increase in the cap on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Declares that, only for FMAP computation purposes, any significant disproportionate employer pension or insurance fund contribution shall be disregarded in computing the per capita income of a state, but not in computing the per capita income for the continental United States (and Alaska) and Hawaii.

Paul D. Wellstone Muscular Dystrophy Community Assistance, Research, and Education Amendments of 2008 - Amends the Public Health Service Act to designate centers of excellence for research on various forms of muscular dystrophy as Paul D. Wellstone Muscular Dystrophy Cooperative Research Centers. Requires the Muscular Dystrophy Interagency Coordinating Committee to give special consideration to enhancing the clinical research infrastructure required to test emerging therapies for the various forms of muscular dystrophy. Requires the Secretary of Health and Human Services to ensure that any data on patients that is collected as part of the Muscular Dystrophy Surveillance, Tracking and Research Network (MD STARnet) is regularly updated to reflect changes in patient condition over time. Requires the Director of the Centers for Disease Control and Prevention (CDC) to: (1) report to the appropriate congressional committees on MD STARnet and data collection; and (2) provide prospective health outcome data on the health and survival of people with muscular dystrophy. Requires the Director of CDC, in carrying out a program to provide information and education on muscular dystrophy to health professionals and the general public, to: (1) partner with leaders in the muscular dystrophy patient community; and (2) widely disseminate the Duchenne-Becker muscular dystrophy care considerations. Requires the Director of the Agency for Healthcare Research and Quality to: (1) evaluate the available scientific evidence to develop and issue an initial set of care considerations for Duchenne-Becker muscular dystrophy and provide ongoing review and updates where appropriate; and (2) replicate the same methodology used to develop such care considerations as a model for other muscular dystrophies.
