Taking Responsible Action for Community Safety Act - Revises requirements with respect to the consolidation, merger, or acquisition of control (transaction) involving rail carriers to require public hearings in the affected communities if public hearings on a proposed transaction are held. Requires the Surface Transportation Board, in a proceeding with respect to a transaction that involves at least one Class I railroad (under current law, involving the merger or control of at least two Class I railroads), to consider the safety and environmental effect of the proposed merger on local communities, intercity rail passenger transportation, and commuter rail passenger transportation. Prohibits the Board from approving mergers if their adverse impacts on safety and on affected communities outweigh their transportation benefits. Authorizes the Board to impose conditions to mitigate the effect of mergers on local communities.

Bolster America's Resources through Responsible Exploratory Leasing Act or the BARREL Act - Declares as having no force or effect federal prohibitions against the expenditure of appropriated funds to conduct oil and gas leasing and preleasing activities for areas of the Outer Continental Shelf (OCS) of the United States adjacent to Cuba. Revokes all withdrawals of federal submerged lands of the OCS adjacent to Cuba from leasing for exploration for, and development and production of, oil and natural gas. Terminates certain restrictions under the Consolidated Appropriations Act, 2008 on the use of funds for certain offshore leasing and related activities with respect to any location on the OCS adjacent to Cuba. Directs the Secretary of the Interior promptly to conduct lease sales for such locations on the OCS in accordance with the Outer Continental Shelf Lands Act and other federal law.

Colonel Charles Young Home National Historical Site Study Act - Directs the Secretary of the Interior, in consultation with the Secretary of the Army, to conduct a study of the Colonel Charles Young Home, a National Historic Landmark in Xenia, Ohio, and associated locations and museums (the study area) to assess its national significance and the suitability and feasibility of including it as a unit of the National Park System. Requires the Secretary, if the study area meets the criteria for inclusion, to include it as a unit of the System. Provides for: (1) the consideration of an affiliation of the study area with the National Museum of the United States Army, the Buffalo Soldiers National Museum, or other entities associated with Colonel Charles Young in order to focus on his life and the African-American military experience; and (2) an investigation of the historical relationship of the Colonel Charles Young Home with the Underground Railroad.

Medicare DMEPOS Competitive Acquisition Reform Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to delay generally until after 2011 full implementation of the Medicare competitive acquisition program for the purchase of durable medical equipment (DME), prosthetics, orthotics, and supplies (DMEPOS). Revises such program, dividing its implementation into two rounds, and specifying covered item updates for 2009-2014. Prescribes requirements for application of accreditation in implementing quality standards. Requires suppliers to disclose subcontractors. Directs the Secretary of Health and Human Services to provide for a competitive acquisition ombudsman within the Centers for Medicare & Medicaid Services to respond to complaints and inquiries by suppliers and individuals. Specifies topics for the Comptroller General's required study and report to Congress on the impact of competitive acquisition of DME on suppliers, manufacturers, and patients. Sets forth a special rule for the competitive acquisition program for diabetic testing strips.

Veterans Disability Benefits Claims Modernization Act of 2008 - Requires the Secretary of Veterans Affairs to conduct a study on adjusting the schedule for rating veterans' disabilities in order to base such schedule on current standards, practices, and codes in common use by the medical, mental health, and disability professions. Establishes in the Department of Veterans Affairs (VA) the Advisory Committee on Disability Compensation to consult with and advise the Secretary with respect to the maintenance and periodic readjustment of the above schedule. Directs the Secretary to conduct a study on the: (1) employee work credit system of the VA's Veterans Benefits Administration (VBA), which is used to measure the work production of VBA employees; and (2) VBA work management system, with the goal of improving accountability, quality, and accuracy and reducing the time for processing claims. Requires the Secretary to: (1) develop a certification examination for VBA employees and managers responsible for processing benefits claims; and (2) evaluate the training of VBA employees responsible for matters relating to veterans' compensation or pension benefits. Directs the Secretary to conduct a study of the use of information technology at the VBA, including the technology known as "VistA." Allows a claim beneficiary to be substituted as a claimant in the case of the death of a veteran claimant while a claim is awaiting adjudication or appeal.

American Energy Independence and Price Reduction Act - Directs the Secretary of the Interior to implement a competitive leasing program for the exploration, development, and production of the oil and gas resources on the Coastal Plain of Alaska. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal the prohibition against leasing or other development leading to production of oil and gas from the Arctic National Wildlife Refuge (ANWR). Deems any oil and gas leasing programs and activities authorized by this Act to be in compliance with ANWR purposes. Authorizes the Secretary to designate up to 45,000 acres of the Coastal Plain as a Special Area, after consultation with the state of Alaska, the city of Kaktovik, and the North Slope Borough. Permits directional drilling in the Special Area. Prescribes procedures governing Coastal Plain lease sales, as well as terms and conditions, including: (1) environmental protection; (2) federal and state distribution of revenues; (3) rights-of-way; and (4) local government impact aid and community service assistance. Sets forth: (1) a "no significant adverse effect" standard to govern Coastal Plain activities; and (2) guidelines for expedited judicial review of complaints. Establishes the ANWR Alternative Energy Trust Fund.

Amends the Servicemembers Civil Relief Act to provide for the protection of child custody arrangements for parents who are members deployed in support of a contingency operation. States that if a motion for change of custody of a child of such a member is filed while the member is so deployed, no court may enter an order modifying or amending a previous child custody judgment, except if there is clear and convincing evidence that it is in the best interest of the child. Prohibits any court from considering a member's absence due to deployment, or possible deployment, in support of a contingency operation in determining the best interest of the child.

Clean Global War on Terror Supplemental Appropriations Act, 2008 - Makes emergency supplemental FY2008 appropriations for specified activities related to the war on terror, international affairs, and national defense matters to the Departments of Agriculture (including food relief to certain foreign countries), of Justice, of Defense (military, including funds for Afghan and Iraqi security forces), of Defense (military construction), and of State (including international peacekeeping activities). Rescinds certain funds made available in: (1) the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 for the Defense Health Program; and (2) the Consolidated Appropriations Act, 2008 for the Joint Improvised Explosive Device Defeat Fund. Makes additional supplemental appropriations for the war on terror, international affairs, and national defense matters to the Departments of Agriculture (including food relief to certain foreign countries), of Justice, of Defense (military, including funds for Afghan and Iraqi security forces), and of State and related agencies. Designates each amount in this Act as an emergency requirement.

Clean Energy Tax Stimulus Act of 2008 - Amends the Internal Revenue Code to extend certain tax incentives for energy production and conservation. Extends through 2009 the tax credit for the production of electricity from renewable resources (e.g., biomass, geothermal energy, landfill gas, and trash combustion). Includes marine and hydrokinetic renewable energy as a renewable resource eligible for such credit. Allows sales of electricity produced from renewable resources to regulated public utilities. Extends through 2016 the energy investment tax credit for solar energy, fuel cell, and microturbine property. Repeals the dollar per kilowatt limitation for fuel cell property under the energy investment tax credit. Allows public electric utilities to qualify for such credit. Extends through 2009 the tax credit for residential energy efficient property expenditures. Repeals the $2,000 limitation on the tax credit for solar electric property. Allows an offset against the alternative minimum tax (AMT) of tax credit amounts. Extends through 2009 the tax credit for investment in clean renewable energy bonds. Increases the national limitation amount for such bonds. Extends through 2009 deferral provisions relating to the recognition of gain by certain electric utilities. Extends through 2009 the tax credit for nonbusiness energy property. Includes residential biomass fuel stoves (pellet stoves) as eligible energy property for purposes of such credit. Extends through 2010 the tax credit for energy efficient new homes. Extends through 2009 the tax deduction for energy efficient commercial buildings and increases the allowable amount of such deduction. Extends the tax credit for energy efficient appliances to include appliances produced in 2008, 2009, and 2010. Revises and updates energy efficiency standards for such appliances in accordance with the Energy Independence and Security Act of 2007.

Caleb Martin-Travis Dodson Wounded Warrior Retention Act - Authorizes a member of the Armed Forces who would normally be retired, placed on the temporary disability retired list, or separated as the result of a combat-related disability to elect to instead be retained on active service in an active status, as long as the member: (1) remains medically able to perform noncombat-related military occupational specialties or duties; and (2) is not disqualified from performing such specialties or duties because of performance, mandatory retirement for age, or other reasons. Subjects members placed in such status to periodic physical examinations, as provided to members placed on the temporary disability retired list. Authorizes the Secretary of Defense to permit, on a case-by-case basis, the reenlistment or appointment in such status of a member who, during the period beginning on September 1, 2001, and ending on the date of enactment of this Act, was retired or separated as the result of a combat-related disability. Requires a report from the Secretary to Congress on the number and types of noncombat-related military occupational specialties in the Armed Forces and Department of Defense (DOD) civilian employee positions that would be available for such members.

Boy Scouts of America Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the founding of the Boy Scouts of America. Requires the coin design to be emblematic of the 100 years of the organization. Restricts issuance of such coins to February 8 through December 31, 2010. Subjects coin sales to a surcharge of $10 per coin. Requires payment of such surcharges to the National Boy Scouts of America Foundation, to be made available to local councils in the form of grants for the extension of Scouting in hard-to-serve areas.

Hubbard Act - Amends federal employment, armed forces, military pay, and veterans' benefits law to authorize the provision of the following benefits to a member of the Armed Forces who is discharged at the member's request pursuant to a Department of Defense (DOD) policy permitting the early discharge of a member who is the only surviving child in a family in which the father or mother, or one or more siblings, served in the Armed Forces and, incident to such service, was killed, died as a result of wounds, accident, or disease, is in a captured or missing in action status, or is permanently disabled: (1) continued payment, through the original agreed-upon service period, of any bonus, incentive, or similar benefit to which the member was entitled during service; (2) separation pay, even though the member has completed less than six years of active service before discharge; (3) transitional health care, on the same basis as an active-duty member, for 180 days after discharge; (4) transitional commissary and exchange benefits, on the same basis as an active-duty member, for two years after discharge; (5) veterans' housing loan, employment and training, and basic educational assistance; (6) federal unemployment compensation; and (7) veteran's preference for federal employment purposes. Makes this Act effective with respect to any such discharge granted after September 11, 2001.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

Recognizes that: (1) the overall progress being made on the ground in Iraq is undeniable; (2) much of this progress is due to the skill and valor of the American service member; and (3) the decision by the President and our military leadership to provide a surge of troops to implement a new counterinsurgency strategy was the correct course of action.

Amends Rule X (Organization of Committees) of the Rules of the House of Representatives to revise the composition of the Committee on Standards of Official Conduct. Requires Committee members to be appointed jointly by the Speaker of the House and the minority leader: three from the majority party, three from the minority party, and four former Members who have not been registered lobbyists for the last two years. (Currently the Speaker picks five and the minority leader picks five.) Limits chairmanship of the Committee to a current Member only. Rotates chairmanship of the Committee between the two parties from Congress to Congress after the 111th Congress, regardless of which party is in the majority. Requires the chairmanship for the 111th Congress to be held by a member of the majority party. Amends Rule II (Other Officers and Officials) to require the Inspector General, upon receipt, to transmit to the Committee (without any change) any written information submitted by an outside individual or organization of an alleged violation of the Code of Official Conduct by Members, Delegates, the Resident Commissioner, or House officers or employees. Amends Rule XI (Procedures of Committees and Unfinished Business) to require the Committee to publish a monthly report on its investigative activities, without disclosing the name of any individual who is the subject of any allegation or its particulars. Requires the Committee to: (1) disclose publicly its inability to reach a resolution of an alleged violation; and (2) forward the complaint and all accompanying documentation to the Department of Justice (DOJ) for its consideration if such impasse persists. Requires the Committee to disclose publicly whether a Member, Delegate, Resident Commissioner, or House officer or employee is under investigation.

Josh Miller Helping Everyone Access Responsive Treatment in Schools Act of 2007, or the Josh Miller HEARTS Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to local educational agencies (LEAs) to: (1) purchase automated external defibrillators (AEDs) for use in their schools; and/or (2) provide training to meet the requirement that at least five adult employees or volunteers at each school with an AED successfully complete training in its use and in cardiopulmonary resuscitation (CPR). Requires LEA grant applicants also to demonstrate that: (1) the AEDs are integrated into the schools' medical emergency response procedures; and (2) emergency services personnel are notified of their locations.

Amends the Internal Revenue Code to modify the standards for imposing penalties on tax return preparers for understatements of tax to require: (1) substantial authority for a position with respect to an item on a tax return if such position was not disclosed with the return; and (2) a reasonable basis for a position which was disclosed with the return. Requires tax return preparers to have a reasonable belief that a position with respect to a tax shelter or a reportable transaction (a transaction having a potential for tax avoidance or evasion) will more likely than not be sustained on its merits.

Amends the Dayton Aviation Heritage Preservation Act of 1992 to provide for the acquisition and inclusion of certain additional sites to the Dayton Aviation Heritage National Historical Park. Authorizes the Secretary of the Interior to make grants to partners of the Park, including the Aviation Trail, Inc., the Ohio Historical Society, and Dayton History, for projects not requiring federal involvement other than providing financial assistance, identifying the specific partner grantee and the specific project. Limits projects funded through these grants to construction and development on non-federal property within the boundaries of the Park. Instructs that any project funded by such grants support the purposes of the Park, be consistent with the Park's general management plan, and enhance public use and enjoyment of the park. Removes the Neil Armstrong Air & Space Museum, Wapakoneta, Ohio, from inclusion in the boundaries of the the National Aviation Heritage Area.

Partnership for Children and Families Act - Amends part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act to revise the eligibility requirements for adoption assistance and foster care maintenance payments, eliminating certain income criteria. Allows each state with an approved part E plan to apply to the Secretary of Health and Human Services to: (1) receive foster care maintenance payment savings achieved (in a "child welfare reinvestment fund") by reducing the total number of days children in the state experience in foster care during the fiscal year; and (2) use the savings to provide children with family preservation services, family support services, time-limited family reunification services, and adoption promotion and support services, and to train the staff of state and local child welfare agencies in effective service practices.

Military Construction and Veterans Affairs and Related Agencies Appropriations Act, 2008 - Appropriates funds for FY2008 for the Department of Defense (DOD) for: (1) military construction for the Army, Navy and Marine Corps, and Air Force (military departments), DOD, the Army and Air National Guard, and the Army, Navy, and Air Force reserves; (2) the North Atlantic Treaty Organization (NATO) Security Investment Program; (3) family housing construction and related operation and maintenance for the military departments and DOD; (4) the Department of Defense Family Housing Improvement Fund; (5) DOD chemical demilitarization construction; and (6) the Department of Defense Base Closure Accounts of 1990 and 2005. Appropriates funds for the Department of Veterans Affairs (VA) for: (1) the Veterans Benefits Administration; (2) readjustment benefits; (3) veterans insurance and indemnities; (4) the Veterans Housing Benefit Program Fund; (5) the Vocational Rehabilitation Loans Program; (6) the Native American Veteran Housing Loan Program; (7) guaranteed transitional housing loans for homeless veterans; (8) the Veterans Health Administration; (9) the National Cemetery Administration; (10) the Office of Inspector General; (11) construction for major and minor projects; and (12) grants for the construction of extended care facilities and veterans cemeteries. Appropriates funds for: (1) the American Battle Monuments Commission; (2) the U.S. Court of Appeals for Veterans Claims; (3) cemeterial expenses, Army; and (4) the Armed Forces Retirement Home. Specifies restrictions and authorities regarding the use of funds appropriated in this Act.

Affordable Footwear Act of 2007 - Expresses the sense of Congress that the elimination of duty on certain imported footwear would provide significant benefit to U.S. consumers, particularly lower-income families. Amends the Harmonized Tariff Schedule of the United States to provide for the duty-free treatment of certain footwear (including children's shoes) made of rubber or plastics that are imported into the United States. Amends the Caribbean Basic Economic Recovery Act to provide footwear imported directly from Haiti into the United States with the same preferential treatment that is provided to certain imported footwear under the Dominican Republic-Central American-United States Free Trade Agreement.

Promoting Health Information Technology Act - Amends the Public Health Service Act to establish the Office of the National Coordinator of Health Information Technology. Establishes a public-private Partnership for Health Care Improvement to recommend specific actions to achieve a nationwide interoperable health information technology infrastructure. Provides for the adoption by the federal government of standards for the electronic exchange of health information. Establishes the American Health Information Community to provide advice to the Secretary of Health and Human Services and the heads of any relevant federal agencies concerning the policy considerations related to health information technology. Authorizes the Secretary to award grants for the: (1) purchase of qualified health information technology systems; (2) implementation of regional or local health information plans; and (3) development of academic curricula integrating qualified health information technology systems in the clinical education of health professionals. Requires the Secretary to provide for the development and use of health care quality measures to measure the quality and efficiency of health care that patients receive. Extends health information privacy requirements to an operator of a health information electronic database. Gives individuals the right to inspect and obtain a copy of their protected health information stored in electronic format. Directs the Comptroller General to report on the circumstances in which it is necessary and workable to require that individuals be notified if their individually identifiable health information is wrongly disclosed. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality, to develop a Health Information Technology Resource Center.

Expresses support and sympathy for the victims of the flooding that occurred across much of Ohio and the surrounding region in August 2007. Conveys gratitude to those who responded to this emergency and who continue working to restore normalcy. Commends the people of Ohio for their indomitable spirit and for the grace and magnanimity with which they have supported one another during the flooding and continuing recovery.
