Save the Children Act of 2016

Save the Children Act of 2016 This bill directs the Departments of State, Justice, Homeland Security (DHS), and Health and Human Services to establish the Save the Children program to grant nonimmigrant visas to certain young minor children from Syria between the ages of 3 and 10 to enter and remain in the United States until there is a sustained reduction of civil war violence in Syria and a substantial reduction in the numbers of newly displaced Syria inhabitants. The bill establishes in the DHS Office of Refugee Resettlement a Coordinator of the Save the Children program. The program shall terminate six months after the State Department certifies that there is a sustained reduction of civil war violence in Syria and a substantial reduction in the numbers of newly displaced Syria inhabitants. The program provides for the admission of not more than 5,000 children in the first year and 10,000 children for each of the second and third years. The bill amends the Immigration and Nationality Act to establish a nonimmigrant W-visa for an alien who: (1) is resident in or was born in Syria but is currently a displaced person or refugee living in another country, (2) is between 3 and 10 years old, and (3) has been approved by the State Department to temporarily reside in the United States. Program aliens may remain in the United States until the State Department certifies that there is a sustained reduction of civil war violence in Syria and a substantial reduction in the numbers of newly displaced Syria inhabitants, with a six-month grace period for reunification efforts.

Prescription Drug and Medical Device Price Review Board Act of 2016

Prescription Drug and Medical Device Price Review Board Act of 2016 This bill establishes the Prescription Drug and Medical Device Price Review Board within the Food and Drug Administration. Each manufacturer of a prescription drug or medical device that is sold in the United States must submit to the board: each type of prescription drug and medical device that it sells in the United States, or in a country that is a member of the Organization for Economic Co-operation and Development; the price charged by the manufacturer for the drug or device; and the costs of the manufacturer to produce them. The board must establish a formula for determining whether the average manufacturer price of a prescription drug or medical device over an annual quarter is an excessive price. Manufacturers may not charge excessive prices. Individuals may petition the board to determine whether the price for a prescription drug or medical device is excessive. The board may subject violators to reduced patent terms, civil penalties, and increased Medicaid rebates. The bill amends the Internal Revenue Code to impose a tax on the sale of prescription drugs or medical devices that have excessive prices. The board must allow individuals to import from approved counties prescription drugs and devices that are comparable to prescription drugs and devices with excessive prices.

National Guard Bonus Repayment and Financial Relief Act This bill requires the Army to review all bonuses, incentive pays, or similar benefits received by members of the Army National Guard between January 1, 2004, and December 31, 2010, to determine if such benefits were issued erroneously and to either: (1) waive repayment of such an erroneous payment if the member concerned fully satisfies any period of service otherwise agreed to or imposed upon the member in connection with receipt of the payment; or (2) repay any such erroneous payment and any interest that was repaid by a member before this bill's enactment if the member fully satisfies any such period of service. The Army may require an Army National Guard member to repay any such erroneous payment upon determining that: (1) the member knowingly received the benefit through fraud or misrepresentation in which the member participated, or (2) repayment is otherwise consistent with provisions governing repayment of unearned pay. For any such member granted relief under this bill, the Army shall: (1) notify all consumer credit reporting agencies that any debt subject to the relief was never valid, and (2) provide assistance to the member facing financial hardship as a result of recoupment actions taken in connection with receipt of the payment. A consumer reporting agency notified of the invalidity of such a debt may not, after the date of notice, make any consumer report containing information relating to the debt.

Enhancing Minority and Women Representation in NIH Medical Research Act of 2016 This bill amends the Public Health Service Act to require the National Institutes of Health (NIH), in assessing research priorities, to publish data on certain clinical research study populations. The NIH must foster collaboration among clinical research projects that use human subjects and that collect similar data to increase the number and diversity of subjects. The strategic plans of the national research institutes must ensure that future activities take into account women and minorities and are focused on reducing health disparities. Advisory council reports must include certain demographic data for clinical research subjects. The results of NIH-funded clinical trials that include women and minorities must be submitted to NIH's clinical trial data bank. The National Institute on Minority Health and Health Disparities may foster partnerships among the national research institutes and encourage the funding of collaborative research projects to achieve NIH goals related to minority health and health disparities. The NIH must develop policies for NIH-funded basic research projects to assess how differences between male and female cells, tissues, or animals may be examined and analyzed.

Partnerships for Progress and Prosperity Act or the P3 Act This bill requires the Department of Education (ED) to award grants to local educational agencies (LEAs) and institutions of higher education for the improvement of students' education in science, technology, engineering, and mathematics (STEM). Each grantee shall partner with an employer in a STEM field to: assist students in obtaining internships or apprenticeships, develop STEM coursework curricula and metrics, carry out dual-credit courses, provide tutoring and mentoring, enable students and teachers to attend STEM events outside of the classroom, provide after-school and summer STEM programs, and purchase educational materials or equipment to facilitate STEM instruction. In awarding grants under the program, ED shall give special consideration to applicants that: promote in-classroom engagement between STEM professionals and students; use technology-based materials and content; pair mentors and tutors with students struggling to meet curriculum benchmarks; in the case of LEA applicants, serve schools in which most students are eligible for free or reduced-price lunch; and propose to use grant funds to target interventions for populations that are traditionally underrepresented in STEM fields. Each grantee shall provide matching funds equal to 50% of the grant amount.

The credit is equal to 15% of the amount paid or incurred by the taxpayer during the year for a transit pass that the taxpayer, the taxpayer's spouse, or a dependent uses for travel between the residence and place of employment of the taxpayer, spouse, or dependent. Accessible Instructional Materials in Higher Education Act or the AIM HEA Act This bill directs the Speaker of the House of Representatives, the President pro tempore of the Senate, and the Secretary of Education to establish an independent commission to develop and issue voluntary accessibility guidelines for postsecondary electronic instructional materials and an annotated list of information technology standards. The Department of Education must review and, as appropriate, update the voluntary guidelines and information technology standards every five years. An institution of higher education (IHE) that uses electronic instructional materials or related technologies that conform to the voluntary guidelines is deemed to be in compliance with its obligations under the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990. An IHE that uses electronic instructional materials or related technologies that do not fully conform to the voluntary guidelines qualifies for a limited safe harbor from monetary liability under the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 if the IHE complies with specified requirements.

Immigration Courts Bail Reform Act This bill amends the Immigration and Nationality Act to eliminate the minimum bond amount needed to release a detained alien. An immigration judge may review an initial custody determination for an adult alien, subject to specified rules, which include the following: the Department of Homeland Security (DHS) shall, within 72 hours, file the notice to appear or charging document with the appropriate immigration court and serve such notice on the detained alien; except for criminals or suspected terrorists, DHS may continue to detain an alien only if no conditions will reasonably assure the alien's appearance and the safety of any other person and the community; the Department of Justice shall ensure that an alien has the opportunity to promptly appear before an immigration judge for a custody redetermination hearing; except for criminals or suspected terrorists, an immigration judge shall review the custody determination de novo and may continue to detain the alien only if DHS demonstrates that no conditions will reasonably assure the alien's appearance and the community's safety; DHS and an immigration judge shall order an alien's release on personal recognizance or upon an unsecured appearance bond unless such release will not reasonably assure the alien's appearance or the community's safety; if DHS or an immigration judge determines that such release will not reasonably assure the alien's appearance or such safety, DHS or the immigration judge shall order the alien's release under the least restrictive conditions that will assure the alien's appearance and the community's safety; DHS or an immigration judge shall consider the alien's financial ability in determining whether to impose a bond as a condition of release; and DHS or an immigration judge may not impose a financial condition that results in an alien's detention.

Computer Science for All Act of 2016 This bill establishes a program through which the Department of Education (ED) shall award grants to states, local educational agencies, and eligible tribal schools to serve as models for national replication of computer education expansion efforts. A grant application shall include specified plans that demonstrate the applicant's ability to carry out an ambitious expansion effort for all students, including traditionally underrepresented students. A grant recipient shall use the grant funds to: train teachers to teach computer science; expand access to high-quality learning materials and online learning options; create plans for expanding overall access to science, technology, engineering, arts, and mathematics (STEAM) classes; utilize computer science as a catalyst for increased interest in STEAM more broadly; reduce course equity gaps for all students; and ensure additional support and resources. A grantee may also use grant funds to: build effective regional collaborations, recruit and hire instructional personnel, prepare for effectively sustaining project activities after the grant period ends, and disseminate information about effective practices. At least semi-annually, a grantee must report to ED on specified data related to the number of students served through program activities.

Election Infrastructure and Security Promotion Act of 2016 This bill directs the Department of Homeland Security (DHS) to: (1) designate voting systems used in the United States as critical infrastructure; (2) include threats of compromise, disruption, or destruction of voting systems in national planning scenarios; and (3) conduct a campaign to proactively educate local election officials about the designation of voting systems as critical infrastructure and election officials at all levels of government of voting system threats. In furtherance of local election official preparedness and response, DHS shall conduct research and development to mitigate the consequences of voting systems threats. DHS shall prepare and submit to Congress a comprehensive plan to protect and prepare the critical infrastructure of the voting systems used in the United States against threats, including from acts of terrorism. The National Institute of Standards and Technology (NIST) shall develop standards for ensuring the operational security of the voting systems used in elections for federal office. This bill amends the Help America Vote Act of 2002 to require a state, in operating the voting system, to comply with applicable standards for ensuring the operational security of voting systems. The testing and certification of voting systems hardware and software shall test whether voting systems are in compliance with applicable standards developed by NIST for ensuring the operational security of voting systems. NIST shall develop standards for ensuring that the process by which ballots are counted in elections for federal office is transparent and permits voters to verify that votes in such elections are counted correctly. States shall comply with applicable standards, in operating the voting system, for ensuring that the process by which ballots are counted in elections for federal office is transparent and permits voters to verify that votes in such elections are counted correctly. The National Science Foundation shall establish an election technology innovation research and development program.

Election Integrity Act of 2016 This bill amends the Help America Vote Act of 2002 to: (1) prohibit states or jurisdictions from purchasing or otherwise acquiring for use in an election for federal office a direct recording electronic voting system or other electronic voting system that does not produce a voter-verified paper record; (2) prohibit imposition of conditions on voting by mail; (3) make mandatory the availability of early voting; and (4) require sufficient polling places, equipment, and resources to facilitate voting. The Director of the National Science Foundation shall make grants to eligible entities to study, test, and develop accessible ballot voting, verification, and casting mechanisms and devices and best practices to enhance the accessibility of paper ballot voting and verification mechanisms for individuals with disabilities, for voters whose primary language is not English, and for voters with difficulties in literacy. Each state shall, except when the winning candidate had no opponent or received 80% or more of the votes, administer audits of federal election results, without advance notice to the precincts selected, consisting of random hand counts of the voter-verified paper ballots. This bill amends the Federal Election Campaign Act of 1971 to make it unlawful for a chief state election administration official, unless he or she or a family member is a candidate, to take an active part in political management or in a political campaign for federal office over which such official has supervisory authority. Mandatory response by the Attorney General is required to allegations of voter intimidation or suppression by law enforcement officers and other government officials. The Election Assistance Commission shall study and, on the basis of the findings of the study, issue standards for states to follow in establishing an appropriate number and geographic distribution of voting sites in elections for federal office.

Halt Arms and Promote Peace in South Sudan Act This bill expresses the sense of Congress with respect to the civil war in South Sudan. The bill: (1) requires a validated license to export dual use goods or technology to South Sudan, and (2) prohibitis issuing an export license to South Sudan for any item on the United States Munitions List. The bill provides that the Department of State should seek to engage with relevant institutions to impose coordinated asset blocking and travel ban sanctions on persons who have violated a cease fire in South Sudan or who knowingly transferred arms to any party to hostilities in that country. The President shall direct the U.S. Permanent Representative to the United Nations to use U.S. influence to seek: (1) imposition of targeted sanctions against all parties to hostilities in South Sudan, and (2) an arms embargo against the government of South Sudan and all other parties to hostilities in that country. Upon making a determination that a cease fire exists and progress toward implementing the agreement is being made, the State Department shall: (1) develop a strategy to strengthen food security in South Sudan, (2) assess South Sudan's participation in the Feed the Future initiative, and (3) facilitate South Sudan's participation in the Power Africa and the Trade Africa programs. The President shall report on: (1) the imposition of such sanctions, and (2) activities and finances of persons supplying arms to South Sudan. The State Department shall report on: (1) progress towards peace in South Sudan, and (2) atrocities committed during the civil war in South Sudan. The Department of the Treasury shall determine whether South Sudan is a jurisdiction of primary money laundering concern.

Strengthening Social Security Act of 2016 This bill amends the Internal Revenue Code to prescribe special rules for the determination of taxable wages and self-employment income above the contribution and benefit base after 2016. Title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act (SSAct) is amended to: (1) increase from 90% to 95% over five years the first bend point factor used in determining the primary OASDI insurance amount; and (2) include surplus average indexed monthly earnings in the determination of such amounts. The Bureau of Labor Statistics of the Department of Labor shall prepare and publish the Consumer Price Index for Elderly Consumers (CPI-EC) that indicates changes over time in expenditures for consumption which are typical for individuals in the United States who have attained early retirement age for purposes of an old-age, wife's, or husband's insurance benefit. The bill amends the SSAct to make the CPI-EC the applicable Consumer Price Index for computation of cost-of-living increases in OASDI benefits for such individuals. The bill revises OASDI benefits for a widow or widower to provide benefits at a level equal to at least 75% of the amount received prior to the death of a spouse. The bill prevents any decrease in the benefit level of supplemental security income recipients resulting from any increase in other social security benefits in this bill.

Iraq and Syria Genocide Relief and Accountability Act of 2016 This bill directs the Department of State to provide assistance to entities taking specified criminal and judicial actions against individuals who are suspected of committing genocide, crimes against humanity, or war crimes in Iraq since January 2014 or in Syria since March 2011. The State Department shall encourage foreign governments to identify and prosecute individuals who are suspected of committing such crimes, including members of foreign terrorist organizations operating in Iraq or Syria. The Department of Justice shall review existing criminal statutes concerning genocide, crimes against humanity, and war crimes to determine: the extent to which U.S. courts have jurisdiction over such crimes where the perpetrators or victims are U.S. nationals, residents, or persons present in a U.S. territory; current statutes that would apply to such conduct and whether additional statutory authorities are necessary; and the extent to which the absence of criminal statutes defining the crimes or granting jurisdiction impede their prosecution in U.S. courts. The State Department shall identify: threats of persecution, genocide, crimes against humanity, and forced migration against members of Iraqi or Syrian religious or ethnic groups with respect to whom the Islamic State of Iraq and Syria (ISIS) has committed such crimes in Iraq or Syria since January 2014 or who are members of other persecuted religious or ethnic groups; humanitarian, stabilization, and recovery needs of these individuals; and assistance provided by the United States, the U.N., and other entities, including faith-based entities. The Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1990 is amended to: include as a category for U.S. refugee determinations aliens who are or were nationals and residents of Iraq or Syria and who share common characteristics that identify them as targets of persecution on account of religion or membership in an ethnic minority in such foreign states, include in such category aliens who are or were nationals and residents of Iraq or Syria and who are members of a religious or ethnic community against which genocide has been committed or that has otherwise been identified as a persecuted group, and extend such Act's coverage to refugee applications submitted before October 1, 2017.

Streamlining Income-driven, Manageable Payments on Loans for Education Act or the SIMPLE Act This bill amends the Higher Education Act of 1965 to revise the process for enrolling a borrower in federal student loan repayment plans when the borrower is delinquent on payments for student loans under the Direct Loan program. Specifically, the Department of Education (ED) may use the tax information of certain delinquent borrowers for purposes of calculating their income-driven repayment plan options. ED must notify those borrowers about their delinquency and repayment plan options. ED must also establish and implement procedures for automatically recertifying the income of certain delinquent borrowers for the purpose of determining their repayment obligations.
