National Defense Energy Savings Act of 2003 - Authorizes the Secretary of Defense to: (1) enter into an energy savings performance contract (for a period of up to 25 years) for the sole purpose of achieving ancillary energy savings and benefits; and (2) incur obligations under the contract to finance energy conservation measures so long as guaranteed savings exceed the debt service requirements. Directs the Secretary to issue final rules establishing implementation procedures and methods that meet specified requirements. Authorizes the Secretary to implement a pilot program to enter into up to ten energy savings performance contracts in nonbuilding applications.

Marriage Protection Act of 2003 - Amends the Federal judicial code to deny Federal courts jurisdiction to hear or determine any question pertaining to the interpretation of the Defense of Marriage Act or the Federal statute defining marriage.

Amends the Federal Insecticide, Fungicide, and Rodenticide Act to permit the Administrator of the Environmental Protection Agency (EPA) to register a Canadian pesticide that: (1) has not been previously disapproved; (2) is identical or substantially similar in composition to a comparable domestic pesticide already registered; and (3) is registered in Canada by the registrant (or affiliate) of the comparable domestic pesticide. Requires the Administrator to obtain the confidential statement of formula for the pesticide to determine if it is in fact identical or substantially similar to a comparable domestic pesticide. Stipulates that any Canadian pesticide the Administrator registers must bear an approved label which completely covers the original Canadian label. Prohibits actions in Federal court against: (1) the Administrator acting as a registering agency for damages resulting from the use of a product registered under this Act; or (2) registrants for damages resulting from adulteration or compositional alterations of such a product if the registrant could not reasonably have knowledge of such adulteration or alterations.

Marine Corps 230th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 500,000 one dollar coins which shall be emblematic of the warrior ethos of the United States Marine Corps. Requires all surcharges from the sale of the coins to be paid to the Marine Corps Heritage Foundation for construction of the Marine Corps Heritage Center.

Commission on the Accountability and Review of Federal Agencies Act - Establishes the Commission on the Accountability and Review of Federal Agencies to: (1) evaluate executive agencies and their programs; and (2) submit to Congress a plan recommending agencies and programs that should be realigned or eliminated and proposing implementing legislation. Directs the President to: (1) establish a systematic method for assessing the effectiveness and accountability of agency programs; and (2) submit to the Commission assessments of not less than half of the programs that use such method. Prohibits the implementation of such method until it has been reviewed and accepted by the Commission. Requires the Commission to consider submitted assessments in evaluating programs. Requires the President to identify common performance measures for programs having similar functions and provide the Commission with data on such measures.

Advancing Justice Through DNA Technology Act of 2003 - Rape Kits and DNA Evidence Backlog Elimination Act of 2003 - Amends: (1) the DNA Analysis Backlog Elimination Act of 2000 to reauthorize the Act; (2) the DNA Identification Act of 1994 (Identification Act) to expand the scope of DNA samples to be included in the Combined DNA Index System (CODIS); and (3) the Violence Against Women Act to authorize grants to increase the availability of legal assistance to victims of dating violence. DNA Sexual Assault Justice Act of 2003 - Amends the Identification Act to require that CODIS include only information on DNA identification records and analyses that are prepared by laboratories that: (1) have been accredited by a nationally recognized nonprofit professional association of forensic scientists within two years; and (2) undergo external audits at least every two years that demonstrate compliance with specified standards. Authorizes the Attorney General to make grants for: (1) DNA training and education; (2) sexual assault forensic examination programs; (3) research and development; (4) using DNA technology to identify missing persons; and (5) tribal domestic violence and sexual assault coalitions. Expands and reauthorizes the Paul Coverdell Forensic Sciences Improvement Grant Program. Innocence Protection Act of 2003 - Sets forth conditions under which a Federal prisoner may obtain post-conviction DNA testing of specific evidence. Directs the Attorney General to award grants to States to improve the quality of legal representation in State capital cases.

Tax Reform Action Commission Act of 2003 - Establishes in the legislative branch a Tax Reform Action Commission to make specific recommendations to Congress for the reform of the internal revenue laws in a manner that produces a system that is: (1) simple, transparent, and efficient; (2) fair and equitable to all Americans; and (3) neutral between different activities and between current consumption and future consumption.

Benjamin Franklin Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue one dollar coins emblematic of the life and legacy of Benjamin Franklin (not more than 250,000 bearing his image as a young statesman and not more than 250,000 with his image as an older numismatist). Directs that all sales include a $10 per coin surcharge, which shall be paid by the Secretary to the Benjamin Franklin Tercentenary Commission, to be used to educate people about Franklin's legacy.

District of Columbia Personal Protection Act - Amends the District of Columbia Code to provide that the D.C. Council's regulatory authority regarding firearms, explosives, and weapons in the District shall not be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise permitted to possess firearms under Federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by Federal law nor regulated by the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Repeals the District's: (1) registration requirement for possession of firearms; (2) prohibition on registration of pistols (handguns); (3) prohibition on possession of handgun ammunition; (4) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked; (5) related firearm registration requirements such as applicant qualifications and filing deadline. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Eliminates criminal penalties for possessing an unregistered firearm. Amends Federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person.

Safeguarding Our Religious Liberties Act - Declares that among those powers reserved to the States and their political subdivisions are the powers to display the Ten Commandments, to recite the Pledge of Allegiance, and to recite the national motto on or within property owned or administered by them. Declares that: (1) the Pledge of Allegiance shall be, "I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with Liberty and justice for all."; and (2) the national motto shall be, "In God we trust." Excepts from the jurisdiction of Federal courts inferior to the Supreme Court the display of the Ten Commandments and the use of the word "God" in the Pledge of Allegiance.

Celia Cruz Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 300,000 one dollar silver coins and 500,000 half dollar clad coins emblematic of Celia Cruz (known as the "Queen of Salsa") and her legacy. Establishes surcharges of ten dollars per coin for the dollar coin and three dollars per coin for the half dollar coin, which shall be paid to the Celia Cruz Foundation.

Defines "human person" and "human being" as including each and every member of the species homo sapiens at all stages of life, including, but not limited to, the moment of fertilization, cloning, or other moment at which an individual member of the human species comes into being.

Currency Harmonization Initiative through Neutralizing Action Act of 2003 - Directs the Secretary of the Treasury to analyze annually the exchange rate policies of the People's Republic of China, and to impose additional tariffs, if necessary, to equalize any currency manipulations.

Exempts from the requirement to pay subsistence charges while hospitalized in a military facility an officer or former officer, or an enlisted member or former enlisted member not entitled to retired or retainer pay or equivalent pay, who is hospitalized in a military facility because of an injury incurred: (1) as a direct result of armed conflict; (2) while engaged in hazardous service; (3) in the performance of duty under conditions simulating war; or (4) through an instrumentality of war.

Amends the Brady Handgun Violence Prevention Act to authorize licensed firearms dealers to conduct firearms transfers and business with other licensed dealers away from the business premises from which such a person is licensed to conduct business, without requiring the payment of a separate fee under the Act for doing so.

Amends title XVIII (Medicare) of the Social Security Act to provide for Medicare recognition of the services of respiratory therapists that are furnished as part-time or intermittent nursing care or physical therapy services under a plan of care for home health services. Directs the Secretary of Health and Human Services to study and report to Congress on the impact of paying for the services of respiratory therapists as a separate benefit under part B (Supplementary Medical Insurance) of Medicare, and as an explicit component of the several benefits under part A (Hospital Insurance) of Medicare.

USA Jobs Protection Act of 2003 - Amends the Immigration and Nationality Act to revise L-1 nonimmigrant visa provisions (intracompany transfers). Prohibits the admission of an L-1 worker unless the employer files an application with the Secretary of Labor stating that the employer will: (1) not place the worker with another employer; (2) make the L-1 application available for public examination and compilation by the Secretary; (3) provide wage comparability; and (4) not displace U.S. workers during the period of 180 days before and after the L-1 hiring. Requires an employer, prior to petitioning for admission of a specialized knowledge L-1 worker, to file an application with the Secretary stating that good faith steps have been taken to recruit U.S. workers for the job for which the L-1 worker is sought. Directs the Secretary of Homeland Security to consult annually with the Secretary respecting the use and effect of blanket L-1 petitions. Increases the L-1 prior employment abroad requirement. Reduces the period of L-1 admission. Establishes an L-1 employer petition fee. Authorizes the Secretary of Labor to initiate an L-1 employer investigation. Revises H-1B nonimmigrant visa provisions (temporary workers) to: (1) subject all H-1B employers (currently H-1B dependent employers) to such provisions; (2) lengthen U.S. worker displacement protection; and (3) authorize the Secretary of Labor to initiate an H-1B employer investigation. Directs the General Accounting Office to investigate the implementation and impact of amendments made by this Act.

American Veterans Disabled for Life Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 500,000 one dollar silver coins in commemoration of disabled American veterans, which shall be emblematic of the design selected by the Disabled Veterans' LIFE Memorial Foundation for the American Veterans Disabled for Life Memorial. Requires: (1) all sales of the coins include a ten dollar per coin surcharge; and (2) the surcharges received to be paid to the Foundation to establish an endowment to support the construction of American Veterans' Disabled for Life Memorial in Washington, D.C.

Home School Non-Discrimination Act of 2003 - Expresses the sense of the Congress that parents who choose private home education should be encouraged within the framework provided by the Constitution. Amends the Higher Education Act of 1965 (HEA) with respect to: (1) student aid eligibility of home-schooled students who have satisfied certain secondary education standards; and (2) institutional aid eligibility of the higher education institutions that such students attend. Amends the Individuals with Disabilities Education Act (IDEA) to provide, if a parent does not consent to an initial evaluation or special education or related services for a child with a disability, the local educational agency shall not be required to convene an individualized education program (IEP) meeting or develop an IEP for such child. Amends the Internal Revenue Code with respect to qualified elementary and secondary education expenses (the Coverdell Education Savings Account) to include home schools if they are treated as a home school or private school under State law. Amends the part of the General Education Provisions Act known as the Family Educational Rights and Privacy Act of 1974 to prohibit release of certain information on and educational records of students in non-public education, including any student educated at home or in a private school in accordance with State law, without written parental consent. Amends HEA to include students at home schools, whether treated as a home school or a private school under State law, among those prospective secondary school graduates eligible to apply for the Robert C. Byrd Honors Scholarship Program for higher education. Amends the Fair Labor Standards Act of 1938 to direct the Secretary of Labor to extend the hours and periods of permissible employment of employees between the ages of 14 and 16 years who are privately educated at a home school, whether the home school is treated as a home school or a private school under State Law, beyond those hours and periods applicable to employees of such ages who are educated in traditional public schools. (Thus allows home-school students to be employed during the traditional school day.)

Transit System Flexibility Protection Act of 2003 - Permits the Secretary of Transportation to: (1) make mass transportation formula grants for an urbanized area with a population of less than 360,000 (under current law, the population limit is 200,00); and (2) make such grants to a transit system with a population greater than 360,000 if the system operates fewer than 100 buses on fixed route service during peak hours.

United States Agricultural Products Market Access Act of 2003 - Amends the Trade Act of 1974 to direct the United States Trade Representative (USTR) to identify those foreign countries that: (1) deny fair and equitable market access to U.S. agricultural products or apply standards for the importation of U.S. agricultural products that are not related to public health concerns or cannot be substantiated by reliable analytical methods; and (2) are determined by the USTR to be priority foreign countries. Limits the identification of priority foreign countries to those that engage in the most onerous or egregious acts which have the greatest adverse impact on the relevant U.S. products. Provides that if available information indicates that such action is appropriate, the USTR may at any time: (1) revoke the identification of any foreign country as a priority foreign country; or (2) identify any foreign country as a priority foreign country. Provides funding for additional staff for the Office of the Assistant U.S. Trade Representative for Agricultural Affairs and Office of the Assistant U.S. Trade Representative for Monitoring and Enforcement. Requires the U.S. Trade Representative to initiate an investigation (without waiting for a petition by an interested person) regarding any act, policy, or practice of a priority foreign country identified under this Act.

Law Enforcement Officers Equity Act - Redefines the term "law enforcement officer" under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS) to include: (1) Federal employees not otherwise covered by such term whose duties include the investigation or apprehension of suspected or convicted individuals and who are authorized to carry a firearm; and (2) such employees of the Internal Revenue Service whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns. Requires that such service which is performed by an incumbent law enforcement officer be treated: (1) on or after the enactment date of this Act, for all purposes, as service performed as a law enforcement officer, irrespective of how such service is treated under the following; and (2) before, on, or after such date, for purposes of CSRS and FERS, as service performed as such an officer, but only if an appropriate written election is submitted to the Office of Personnel Management five years after such date or before separation from Government service, whichever is earlier. Provides that nothing under current law respecting mandatory separation from Government service under CSRS or FERS shall cause the involuntary separation of an officer before the end of the three-year period beginning on such date.

Parent's Right to Know Act of 2003 - Prohibits making available any funds appropriated for carrying out title X of the Public Health Service Act (Population Research and Voluntary Family Planning Programs) to any family planning project under specified provisions of that title if any service provider in the project knowingly provides contraceptive drugs or devices to a minor, unless: (1) the minor is emancipated; (2) by court direction; (3) the provider has given actual written notice to the custodial parent or guardian five days in advance; or (4) the minor has written consent of a custodial parent or guardian.

Death Tax Repeal Permanency Act of 2003 - Declares that the sunset provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 shall not apply to Title V: Estate, Gift, and Generation-skipping Transfer Tax Provisions of such Act. (Makes the repeal of estate and generation-skipping taxes under the Internal Revenue Code, and certain reductions of the gift tax, permanent.)

Children's Hope Act of 2003 - Amends the Internal Revenue Code to provide for a credit ($100, $200 for joint return) which is dependent on enactment of State qualified scholarship tax credits and which is allowed against the Federal income tax for charitable contributions to education investment organizations (as defined by this Act) that provide qualifying assistance for elementary and secondary education. Excludes from gross income amounts received from an education investment organization for qualified elementary and secondary education expenses.

Helpers Job Opportunity Act - Provides for the creation of an additional category of laborers or mechanics known as helpers under the Davis-Bacon Act. Requires a helper of a laborer or mechanic to be paid the prevailing wage of helpers of laborers or mechanics employed on similar projects in the same subdivision of the State.

Assistant United States Attorneys Retirement Benefit Equity Act of 2003 - Makes applicable to Assistant United States Attorneys the provisions of the Civil Service Retirement System and the Federal Employees Retirement System that apply to Federal law enforcement officers. Directs the Department of Justice to provide notice to incumbent Assistant U.S. Attorneys as to their election rights under this Act and the effects of making or not making a timely election under this Act. Allows such incumbents to elect the option to be treated either: (1) in accordance with the amendments made by this Act; or (2) as if this Act had never been enacted.

Highway Funding Equity Act of 2003 - Revises Federal highway funding minimum guarantee provisions. Requires the Secretary of Transportation, for each of FY 2004 through 2009, to allocate among the States amounts sufficient to ensure that: (1) the percentage for each State of the total apportionments for the fiscal year for the National Highway System (NHS), the high priority projects program, the Interstate maintenance program, the surface transportation program, metropolitan planning, the highway bridge replacement and rehabilitation program, the congestion mitigation and air quality improvement program, the recreational trails program, the Appalachian development highway system, and the basic minimum guarantee equals or exceeds 95 percent of the ratio that the estimated tax payments to the Highway Trust Fund (HTF) (other than the Mass Transit Account) attributable to highway users in the State bears to such payments attributable to highway users in all States (with a specified exception for any State having a population density of less than 50 individuals per square mile); and (2) when HTF allocations (other than from the Mass Transit Account, for such programs, emergency relief, and the discretionary minimum guarantee) for the fiscal year have been identified, the percentage for each State of all of those allocations for the fiscal year equals or exceeds the percentage that is equal to 95 percent of such tax payments ratio. Sets forth provisions regarding: (1) the programmatic distribution of NHS funds exceeding $2.8 billion; (2) the apportionment of the remainder of funds to the States; and (3) required adjustments where the sum of State percentages exceeds 100.

National War Permanent Tribute Historical Database Act - Authorizes the Secretary of the Interior to establish and maintain the National War Permanent Tribute Historical Database for identifying and cataloging the many thousands of permanent tributes that commemorate U.S. military conflicts and the service and sacrifice of U.S. Armed Forces. Requires the Database to be publicly accessible through the Internet or other means in a format that permits the public to submit information for the purpose of updating and expanding the Database. Directs the Secretary to report to Congress assessing the efficacy and desirability of establishing a permanent fund within the Treasury for the repair, restoration, and maintenance of the memorials identified and cataloged.

Farming Flexibility Act of 2003 - Amends the Farm Security and Rural Investment Act of 2002 with respect to oilseed base acres to: (1) deem the planting, prevented planting, or production of fruits or vegetables to be the same as the planting, prevented planting, or production of oilseeds for purposes of oilseed base acre calculations; and (2) permit fruit or vegetable production on oilseed base acres, except that direct payments and counter-cyclical payments for oilseeds shall be reduced by an acre for each acre planted to a fruit or vegetable.

Ten Commandments Defense Act of 2003 - Declares the following : (1) that the power to display the Ten Commandments on or within property owned or administered by the several States or their political subdivisions is among the powers reserved to the States respectively (under the Tenth Amendment of the U.S. Constitution); (2) that the expression of religious faith by individual persons on or within property owned or administered by the several States or their political subdivisions is among the rights secured (under the First Amendment) against laws respecting an establishment of religion or prohibiting the free exercise of religion made or enforced by the Federal Government; and (3) that the expression of religious faith by individual persons on or within property owned or administered by the several States or their political subdivisions is among the liberties of which no State shall deprive any person without due process of law made in pursuance of powers reserved to the States respectively.

Unborn Victims of Violence Act of 2003 or Laci and Conner's Law - Provides that: (1) whoever engages in conduct that violates specified provisions of the Federal criminal code, the Controlled Substances Act of 1970, or the Atomic Energy Act of 1954, or specified articles the Uniform Code of Military Justice (conduct constituting certain Federal violent crimes) and thereby causes the death of, or bodily injury to, a child who is in utero, shall be guilty of a separate offense; and (2) the punishment for that separate offense shall be the same as that provided under Federal law for that conduct had that injury or death occurred to the unborn child's mother. Specifies that a violation of such provisions does not require proof that: (1) the person engaging in the conduct had knowledge or should have had knowledge that the victim of the underlying offense was pregnant; or (2) the defendant (or accused) intended to cause the death of, or bodily injury to, the unborn child. Prohibits imposition of the death penalty for an offense under this Act. Bars prosecution under this Act: (1) of any person for conduct relating to an abortion for which the consent of the pregnant woman, or a person authorized by law to act on her behalf, has been obtained or for which such consent is implied by law; (2) for conduct relating to any medical treatment of the pregnant woman or her unborn child; or (3) of any woman with respect to her unborn child.

Iraq Cultural Heritage Protection Act - Bans the importation into the United States of any archaeological or cultural material of Iraq that was removed from Iraq after the issuance of Executive Order 12722 of August 2, 1990, unless the Government of Iraq certifies that the exportation of such material from Iraq was not in violation of Iraqi law. Requires U.S. custom officers to detain such material until it can be certified as legally exported from Iraq. Subjects to seizure and forfeiture any Iraqi archaeological or cultural material that is illegally imported into the United States or that cannot be certified as legally exported from Iraq. Requires the return to Iraq of any archaeological or cultural material forfeited under this Act. Defines "country of origin" for purposes of applying U.S. tariff and customs laws to certain archaeological materials. Amends the Convention on Cultural Property Implementation Act to: (1) redefine an object of archaeological interest as one that is at least 100 years old (currently, at least 250 years old); (2) limit the period during which import restrictions under the Act may be placed on the archaeological or ethnological material of any country to ten years (subject to extensions by the President for emergency conditions) after the date such restrictions are published in the Federal Register; and (3) extend from five to ten years the effective period of bilateral or multilateral agreements for import restrictions on archaeological or ethnological materials.

Charitable Giving Act of 2003 - Amends the Internal Revenue Code with respect to charitable giving and charitable organizations to: (1) allow a deduction for a portion of charitable contributions to individuals who do not itemize; (2) allow tax-free distributions from individual retirement accounts for charitable purposes; (3) increase the cap on corporate charitable contributions; (4) provide a special rule for charitable contributions of food inventory; (5) revise certain excise taxes related to private foundations; (6) modify the excise tax on unrelated business taxable income of charitable remainder trusts; (7) extend and expand the charitable contribution for scientific property used for research and for computer technology and equipment used for educational purposes; (8) adjust the basis of S corporation stock for certain charitable contributions; (9) suspend the tax-exempt status of terrorist organizations; (10) revise church tax inquiry provisions; (11) revise declaratory judgment remedy provisions relating to tax-exempt organizations; (12) exclude from gross income certain landowner initiatives programs to conserve endangered habitats or species; (13) repeal the grassroots expenditure limit for charitable organizations; and (14) set forth a private foundation's permitted holdings, including provisions relating to a corporation that is publicly traded and publicly controlled. Amends title IV of the Social Security Act to authorize the Secretary of Health and Human Services to make grants to any private entity that operates a promising social services program (as defined by this Act). Amends the Assets for Independence Act to authorize appropriations for the assets for independence programs. Expresses the sense of Congress encouraging corporate contributions to faith-based organizations. Amends the Runaway and Homeless Youth Act to include maternity group homes (as defined by this Act) within the program for transitional living youth projects for homeless youth. Authorizes FY 2003 and 2004 appropriations for such group homes.
