Depositor Protection Act of 2023 This bill expands Federal Deposit Insurance Corporation (FDIC) protections and the actions the FDIC is allowed to take, including in the event of an institutional failure. First, the bill expands for two years FDIC deposit insurance for an amount up to $100,000,000 that a depositor maintains at an insured depository institution in a noninterest-bearing transaction account. (Currently, the FDIC insures deposits up to $250,000.) The bill also increases the reciprocal deposit limit applicable to depository institutions. (Reciprocal deposits are used by institutions to increase the availability of deposit insurance by splitting large deposits using a reciprocal network of institutions.) For 90 days after the date of enactment, the bill allows for the acquisition of distressed banks by a bank holding company without regulatory approval under certain circumstances. The bill also allows the FDIC to facilitate a merger, sale, assumption of liabilities, or stock acquisition involving the failure of a large institution using an adjusted least-cost resolution calculation.

Opportunity Zones Transparency, Extension, and Improvement Act This bill revises rules and reinstates reporting requirements relating to qualified opportunity zones (economically distressed communities where new investments, under specified conditions, may be eligible for preferential tax treatment). Specifically, the bill terminates the designation of zones that are disqualified due to median family income exceeding 130% of national median family income and permits states to identify and expand terminations of such zones. The bill also reinstates reporting requirements for qualified opportunity zones and imposes penalties for noncompliance with such requirements, extends the opportunity zones temporary deferral period for qualifying capital gain through 2028, and establishes a State and Community Dynamism Fund to support public and private investment in qualified opportunity zones.

No Bailout for Sanctuary Cities Act This bill makes a state or political subdivision of a state ineligible for any federal funds the jurisdiction intends to use to benefit non-U.S. nationals (i.e., aliens under federal law) who are unlawfully present if the jurisdiction withholds information about citizenship or immigration status or does not cooperate with immigration detainers. Specifically, such funds are denied to any jurisdiction that has a law, policy, or practice that prohibits or restricts any government entity from maintaining, sending, or receiving information regarding the citizenship or immigration status of any individual; exchanging information regarding an individual's citizenship or immigration status with a federal, state, or local government entity;  complying with a valid immigration detainer from the Department of Homeland Security (DHS); or  notifying DHS about an individual's release from custody. The funding restriction does not apply to a law, policy, or practice that only applies to an individual who comes forward as a victim of or a witness to a criminal offense. The bill applies beginning in the fiscal year following its enactment.

Stop Campus Hazing Act

Stop Campus Hazing Act This bill requires institutions of higher education (IHEs) that participate in federal student aid programs to report hazing incidents. Specifically, the bill requires each IHE to disclose hazing incidents that were reported to campus security authorities or local police agencies in its annual security report. The bill defines the term hazing to mean any intentional, knowing, or reckless act committed by a person against a student (regardless of that student's willingness to participate), that (1) is connected with an initiation into, an affiliation with, or the maintenance of membership in, an organization (e.g., a club, athletic team, fraternity, or sorority); and (2) causes or is likely to contribute to a substantial risk, above the reasonable risk encountered in the course of participation in the IHE or the organization, of physical injury, mental harm, or degradation. In addition, each IHE must develop and distribute as part of its annual security report a statement of policy regarding the following: (1) a comprehensive program to prevent hazing, which must include information on hazing awareness and hazing prevention; and (2) the IHE's current campus policies on hazing, which must include procedures that comply with specified collection and reporting requirements.

Insurance Data Protection Act This bill limits the ability of federal entities to compel insurance companies to share information. Specifically, the bill eliminates the subpoena power of the Federal Insurance Office. Under current law, the office has the power to subpoena information from insurers to, among other purposes, identify issues that could contribute to a systemic crisis in the insurance industry or the U.S. financial system. The bill also eliminates the ability of the Office of Financial Research to subpoena insurance companies. When seeking to collect insurance company data under specified consumer protection laws, a financial regulator must obtain the data from other regulators or from publicly available sources if possible. Otherwise, the financial regulator may only collect this data directly from the insurance company if it complies with the Paperwork Reduction Act.

Farmer-Informed WOTUS Act of 2023 This bill requires the Department of Agriculture (USDA) to establish an advisory committee that is representative of the U.S. farming and ranching sectors to make recommendations on the impact of waters of the United States (WOTUS) regulations on U.S. agriculture and environmental protection. (The Clean Water Act [CWA] protects navigable waters , which the statute defines as WOTUS. Because the CWA does not further define this term, the agencies that implement the CWA have defined WOTUS in regulations.) Specifically, USDA must establish an advisory committee to study and develop recommendations to address matters such as the impact of the prior-converted farmland exemption on agricultural operations, the impact of WOTUS regulations on secure food supply chains and rural infrastructure, and how to develop safe harbor conditions for farmers who observe certain conservation practices. Federal agencies must provide to the committee any information requested by the committee chair. The advisory committee terminates 90 days after completing reporting requirements.

Protecting U.S. Farmland and Sensitive Sites From Foreign Adversaries Act This bill expands the jurisdiction of the Committee on Foreign Investment in the United States (CFIUS) related to agriculture and land transactions. (CFIUS reviews the national security implications of foreign investment in the United States.) Specifically, the bill requires parties to an elevated risk real estate transaction to submit a mandatory declaration to CFIUS. Generally, this requirement applies to a transaction for a purchase or lease of certain real estate (e.g., real estate that is in close proximity to a sensitive site, such as a military installation or airspace) by a foreign adversary entity (e.g., a foreign person subject to the jurisdiction of a foreign adversary, such as China or Russia). Additionally, the bill creates a presumption that an elevated risk real estate transaction presents a risk to national security that cannot be resolved through any agreement or condition unless CFIUS (1) determines, based on clear and convincing evidence, that the risk to national security of the transaction can be resolved in a manner other than by suspending or prohibiting the transaction; and (2) notifies Congress about this determination and its reasoning.  The bill authorizes CFIUS to consider U.S. food security as a factor in its national security reviews.  The bill also expands the membership of CFIUS to include the Secretary of Agriculture on all transactions related to the purchase of agriculture land, agriculture biotechnology, and any other transaction related to the agriculture industry in the United States.

American Confidence in Elections Act or the ACE Act This bill addresses election administration and security, campaign finance, and other related provisions. Specifically, the bill directs the Election Assistance Commission's (EAC's) Standards Board and Local Leadership Council to issue voluntary considerations for states about various aspects of election administration. Additionally, the bill  reduces certain election assistance payments for states and local jurisdictions that allow noncitizens to vote; requires states to provide designated congressional election observers with full access to observe the administration procedures of federal elections; prohibits federal agencies from using funds made available for salaries and expenses to solicit or enter into agreements with nongovernmental organizations to conduct voter registration or voter mobilization activities on the agency's property or website;   prohibits federal funds for election administration for states that allow ballot harvesting, with exceptions; establishes various requirements for elections in the District of Columbia; makes various changes to the EAC; and prohibits foreign nationals from making contributions or donations in connection with state or local ballot initiatives or referenda. The bill also establishes the Twentieth Amendment Section Four Panel, which must recommend to Congress model legislation to resolve any vacancy created by the death of a candidate in a contingent presidential or vice-presidential election. The bill makes changes to campaign finance, including by (1) repealing limits on coordinated party expenditures, and (2) prohibiting federal funds from being used to make payments in support of a congressional election campaign. It also makes changes to the Federal Election Commission.

In an emergency situation, two-thirds of the House of Representatives and the Senate may authorize additional expenditures that are not otherwise permitted by the amendment. The additional expenditures must be for a limited time, and debts incurred from the expenditures must be paid as soon as practicable.

Ending Agricultural Trade Suppression Act This bill restricts state and local governments from imposing certain standards or conditions on the preharvest production of agricultural products sold or offered for sale in interstate commerce. Specifically, it prohibits the imposition of such standards or conditions if (1) the production occurs in another state, and (2) the standard or condition adds to requirements applicable under federal law and the laws of the state and locality where the product is produced. The bill also allows for a private right of action to challenge state or local regulations relating to agricultural goods sold in interstate commerce. A person may bring an action in (1) the U.S. district court for the judicial district in which the person is affected by a regulation or the person resides, operates, or does business; or (2) any other appropriate court with jurisdiction.

(Generally, IEPs are individualized plans to ensure that a child with a disability receives a free appropriate public education.) Under current law, states and local educational agencies (LEAs) must convene a team to develop an IEP. The composition of the team that develops the IEP is outlined in current law and allows for other individuals who have knowledge or special expertise regarding the child (including related services personnel, as appropriate) to participate in this team. This bill requires the relevant agency (e.g., the LEA or state educational agency) to notify the child's parents of their right to include these other individuals with knowledge or special expertise on the child's IEP team.

Federal Assistance to Initiate Repayment Act or the FAIR Act This bill makes various changes to the federal student loan system, including by establishing a new income-driven repayment plan and limiting the authority of the Department of Education (ED) to propose or issue regulations and executive actions related to federal student aid programs. The bill directs ED to provide at least 12 notices to each borrower of a federal student loan indicating (1) the date on which the borrower is required to make monthly loan payments; (2) the borrower's options for repayment; and (3) the options available to a borrower who is in default, including the option to consolidate or rehabilitate loans. ED must also conduct additional outreach to at-risk borrowers. Additionally, the bill replaces existing federal student loan repayment plans with one standard 10-year repayment plan and one income-driven repayment plan. The bill outlines the terms of this new income-driven repayment plan. The bill provides deferment options for borrowers with loans made on or after July 1, 2024. The bill prohibits ED from authorizing additional deferment options or periods of deferment other than those authorized by this bill. The bill allows borrowers to rehabilitate a defaulted loan twice (currently, only once). The bill also prohibits ED from issuing a proposed rule, final regulation, or executive action related to federal student aid programs if ED determines that the rule, regulation, or action (1) is economically significant, and (2) would result in an increase in a subsidy cost.

Schools Not Shelters Act This bill prohibits using the facilities of certain schools that receive federal financial assistance to provide shelter or housing for any non-U.S. national ( alien under federal law) who has not been admitted for lawful entry. Specifically, this bill shall apply to the facilities of (1) public elementary or secondary schools, and (2) institutions of higher education. This prohibition shall not apply to shelter or housing provided in response to certain disasters such as a fire, flood, explosion, or tornado for which there has been a disaster declaration.

The bill also requires the Centers for Disease Control and Prevention to annually disseminate best practices for preventing maternal mortality and morbidity to hospitals, professional societies, and perinatal quality collaboratives (i.e., networks of perinatal care providers and public health professionals that work to improve pregnancy outcomes through continuous quality improvement).

Accreditation for College Excellence Act of 2023 This bill revises the requirements for an accrediting agency to be recognized by the Department of Education as a reliable authority on the quality of education being offered at an institution of higher education (IHE). Specifically, an accrediting agency must confirm that its standards do not require, encourage, or coerce an IHE to (1) support or oppose specific partisan or political beliefs or viewpoints on social or political issues; or (2) support the disparate treatment of any individual or group on the basis of sex, race, or ethnicity. Additionally, an accrediting agency must confirm that its standards do not prohibit an IHE from having a religious mission. The accrediting agency may not prohibit the IHE from requiring an applicant, student, or employee to provide a statement of faith or adhere to a code of conduct. The bill also prohibits an accrediting agency from adopting additional standards for accreditation that are not specifically authorized by statute.
