This resolution requires the Joint Committee on the Library to approve or deny the statue of Rev. Billy Graham for placement in the National Statuary Hall within 30 days after North Carolina submits (1) photographs of the statue, (2) dimensions of the statue and pedestal, (3) the final weight of the statue and pedestal, and (4) any inscriptions on the statue.

Veterans Heroin Overdose Prevention Examination Act or the Veterans HOPE Act This bill requires the Department of Veterans Affairs (VA) to complete a review of the deaths of all covered veterans who died from opioid overdoses during the five-year period preceding the enactment of this bill. Covered veterans are those who received VA hospital care or medical services during the five-year period preceding the death of the veteran. The VA shall report on the results of the review and make such report publicly available.

Keep Food Local and Affordable Act of 2021 This bill freezes the minimum wage for H-2A (temporary agricultural workers) in certain states through December 31, 2022. Specifically, the bill prohibits an increase to the adverse effect wage rate for H-2A workers in any state (1) that had an unemployment rate of not more than 5% in the Bureau of Labor Statistics' August 2021 report; or (2) where the food price index, according to bureau reports, increased by more than 3% between December 2020 and September 2021 and the governor requests a freeze to the adverse effect wage rate. (Generally, the minimum wage for an H-2A worker is the highest of the adverse effect wage rate, the prevailing hourly wage or piece rate, the federal minimum wage, or the applicable state minimum wage.)

Illegal Immigrant Payoff Prohibition Act This bill prohibits the payment of a settlement to an alien for a civil action brought against the United States in connection with the alien's inadmissibility to, or unlawful presence in, the United States.

Autonomy for Disabled Veterans Act This bill increases the maximum amount authorized under the Home Improvements and Structural Alterations (HISA) grant program to $10,000 for veterans with a service-connected disability and $5,000 for those with disabilities that are not service-connected. The HISA grant program provides medically necessary improvements and structural alterations to veterans' (or service members') primary residence for specified purposes (e.g., allowing for entrance to their home). The bill requires the Department of Veterans Affairs to increase the dollar amount of the grant in accordance with inflation as determined by the Consumer Price Index.

Supporting Every at-Risk Veteran In Critical Emergencies Act of 2021 or the SERVICE Act of 2021 This bill authorizes the Office of Community Oriented Policing Services within the Department of Justice to make grants to support the creation and operation of veterans' response teams in state, local, and tribal law enforcement agencies.

Forage Fish Conservation Act of 2021 This bill addresses the management and conservation of forage fish. The Department of Commerce must issue a definition for the term forage fish . It must consider certain factors in defining such term, including whether a species covered by the definition (1) is at a low trophic level; (2) is generally small to intermediate-sized; (3) occurs in schools or other dense aggregations; (4) contributes significantly to the diets of other fish, marine mammals, or birds; and (5) serves as a conduit for energy transfer to species at a higher trophic level. Commerce must also establish guidelines to assist regional fishery management councils in (1) developing a list of unmanaged forage fish areas and prohibiting the development of any new forage fish fisheries until the potential impacts of such fisheries have been assessed; and (2) setting annual catch limits for forage fish fisheries that assess, specify, and reduce such limits by the diet needs of other fish species and marine wildlife. The bill adds shad (American shad and hickory shad) and river herring (blueback herring and alewife) to the list of managed stocks for the New England and Mid-Atlantic Fishery Management Council.

Access to Breast Cancer Diagnosis Act of 20 21 This bill prohibits private health insurance plans from imposing higher cost-sharing requirements on breast cancer diagnostic examinations than initial breast cancer screening examinations. Diagnostic examinations are generally required after an initial screening detects an abnormality and typically require additional mammogram images (e.g., x-rays).

Patient Advocate Tracker Act This bill requires the Office of Patient Advocacy within the Veterans Health Administration to establish an information technology system that allows veterans or their representatives to electronically file a complaint with a patient advocate and review the status of a filed complaint.

State, Local, Tribal, and Territorial Fiscal Recovery, Infrastructure, and Disaster Relief Flexibility Act This bill allows states, tribes, territories, and localities to use certain COVID-19 relief funds for new categories of spending, including for natural disasters and infrastructure projects. It also makes changes to expenditure deadlines and other aspects of this funding. Specifically, recipients may use funds for emergency relief from natural disasters and associated negative economic impacts of natural disasters. In addition, recipients may use a portion of their COVID-19 relief funds for designated infrastructure projects, such as nationally significant freight and highway projects. Furthermore, the bill allows recipients to expend COVID-19 relief funds on these types of infrastructure projects until September 30, 2026. Under current law, recipients must expend the funds by December 31, 2024. Other changes in the bill include (1) modifying eligibility and allocation requirements for funding set aside for counties and Indian tribes that are near public lands, (2) allowing Indian tribes an additional year to expend their COVID-19 relief funds, and (3) establishing a process for government entities to decline COVID-19 relief funds and requiring any declined funds to be used to reduce the federal deficit.

Fentanyl Penalties Parity Act This bill modifies the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, imports, exports, or possesses with intent to distribute fentanyl. Specifically, the bill reduces from 400 to 20 grams the fentanyl quantity and from 100 to 5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for high-level first-time or repeat offenders. It also reduces from 40 to 2 grams the fentanyl quantity and from 10 to 0.5 grams the fentanyl analogue quantity that trigger a mandatory minimum prison term for low-level first-time or repeat offenders.

This resolution recognizes the ultimate sacrifice of the unknown soldiers interred at Arlington National Cemetery and expresses gratitude and appreciation of all the members of the Armed Forces who have served during wars and peacetime. Additionally, the resolution commends all members of the 3d Infantry Regiment, specifically those who guard the Tomb of the Unknown Solider.

Save Our Servicemembers Act of 2021 This bill requires the Office of the Under Secretary of Defense for Personnel and Readiness within the Department of Defense (DOD) to evaluate and standardize DOD's suicide prevention efforts. Specifically, the bill directs the Defense Suicide Prevention Office to collaborate with each military department to (1) develop and implement a process to ensure that individual nonclinical suicide prevention efforts are assessed for effectiveness, and (2) develop consistent suicide-related definitions for use throughout DOD. The bill also requires the use of such suicide-related definitions in any updated policies of DOD or each military department.

Prohibiting IRS Financial Surveillance Act This bill prohibits the Department of the Treasury from requiring a financial institution to report the transfers into and out of a financial account. This prohibition does not apply to laws or regulations in effect on October 1, 2021.

Improving the Health of Children Act This bill reauthorizes through FY2026 programs and activities of the Centers for Disease Control and Prevention (CDC) for researching and preventing birth defects, developmental disabilities, and other conditions. Specifically, the bill reauthorizes the National Center on Birth Defects and Developmental Disabilities. The center carries out activities to advance the health and well-being of vulnerable populations, including infants with birth defects, children with developmental disabilities, and individuals of all ages with disabilities or blood disorders. In addition, the bill reauthorizes a CDC program that supports research on and raises awareness about the effects of folic acid in preventing birth defects.

Veterans Census-Enabled National Treatment Equitable Resource Supplement for Mental Health Act of 2021 or the Vet CENTERS for Mental Health Act of 2021 This bill requires the Department of Veterans Affairs (VA) to ensure the number of Vet Centers in certain states is increased by at least one additional center if the VA determines the state meets specified requirements. The VA must also establish a community-based outpatient clinic in each state that does not share a land border with another state, is located at least 2,000 miles from the contiguous United States, and contains no such clinic.

Establishing New Authorities for Businesses Laundering and Enabling Risks to Security Act or the ENABLERS Act This bill expands the definition of a financial institution for purposes of reporting suspicious transactions, anti-money laundering programs, and other related measures. Specifically, the bill expands this definition to include persons who provide investment advice for compensation; persons who trade in works of art, antiques, or collectibles; attorneys, law firms, or notaries involved in financial or related activity on behalf of another person; certain trusts and company service providers; certified public accountants and public accounting firms; persons engaged in the business of public relations, marketing, communications, or other similar services in such a manner as to provide another person anonymity or deniability; and persons engaged in the business of providing third-party payment services. Additionally, the Financial Crimes Enforcement Network must establish a task force to develop a strategy to impose anti-money laundering safeguards and enforce requirements on certain professions. Finally, domestic title insurance companies must obtain, maintain, and report to the Department of the Treasury information on the beneficial owners of entities that purchase or sell residential or commercial real estate in transactions involving the domestic title insurance company.

This bill requires online marketplaces (e.g., Amazon) to collect and verify certain contact and financial information from third-party sellers whose transactions and related revenues exceed specified thresholds. Subject to certain exceptions, online marketplaces must clearly and conspicuously disclose the contact information of certain high-volume third-party sellers to consumers and must also provide consumers with methods to report suspicious activity on the marketplace. The bill provides the Federal Trade Commission and state attorneys general with the authority to enforce these requirements.

Health Emergencies Are Literally Tenets of HHS Act of 2021 or the HEALTH Act of 2021 This bill expands the authorities and responsibilities of the Department of Health and Human Services (HHS) with respect to federal responses to public health and other emergencies and the Strategic National Stockpile. Specifically, the bill expands the responsibility of HHS to lead federal public health and medical responses to expressly include national disasters or emergencies declared under presidential authorities. Additionally, the bill provides authority for HHS to deploy the Strategic National Stockpile in consultation with the Department of Homeland Security (DHS), rather than as required by DHS.

Prevent All Soring Tactics Act of 2021 or the PAST Act of 2021 This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

Protecting Financial Privacy Act of 2021 This bill prohibits a federal agency from creating, implementing, or administering a program that requires financial institutions or individuals to report on the balances of, transactions involving, or transfers into and out of financial accounts. This prohibition does not apply to laws or regulations in effect on September 1, 2021, or to the Bank Secrecy Act (laws that require financial institutions and other entities to report on certain financial transactions to prevent money laundering, the financing of terrorism, and other criminal activity). This prohibition does apply, however, to regulations issued under the Bank Secrecy Act after September 1, 2021.

Small Entrepreneurs' Empowerment and Development Act of 2021 or the SEED Act of 2021 This bill establishes an exemption to certain securities regulations for small offerings of securities. Specifically, securities registration is not required for a sale of securities if the total amount of securities sold by the issuer during the preceding 12-month period sale does not exceed $250,000. Furthermore, the Securities and Exchange Commission must issue rules under which an issuer is disqualified from offering securities through this exemption. These rules must disqualify any such offering or sale of securities by a person subject to specified regulatory disciplinary actions or convicted of certain felonies or misdemeanors.

This resolution condemns Belarusian authorities' assault on freedom of expression and human rights in Belarus since the August 2020 presidential election. The resolution also calls for the immediate release of journalists, cultural figures, and dissidents currently held as political prisoners in Belarus. Furthermore, the resolution calls on the Biden Administration to support initiatives to assist survivors of torture and other human rights violations from Belarus, including by working with allies in the region to grant them protection and providing avenues for them and their families to access safety in the United States; examine all available accountability options for violators of human rights and fundamental freedoms; and demand that Belarus cooperate fully with international partners and organizations, including the United Nations High Commissioner for Human Rights. Finally, the resolution supports the aspirations of the Belarusian people in their struggle for freedom and human rights.

Equal Access to the Right Nutrition for Military Families (EARN) Act of 2021 This bill facilitates the participation of military households in the Supplemental Nutrition Assistance Program (SNAP) by excluding from income limits the housing allowance provided to members of the Armed Forces and modifying administration and other aspects of the program.

Counter-Kleptocracy Act This bill addresses prevention and elimination of corruption globally. The Department of State must (1) annually rank, using specified standards, foreign countries based on their efforts to eliminate corruption; and (2) designate an anti-corruption contact in the diplomatic mission of any country that does not meet the standards. The State Department must also evaluate whether to sanction foreign persons engaged in significant corruption (1) in countries that make de minimis or no efforts to meet the standards, or (2) connected to a designated Russian pipeline project. The President may temporarily sanction foreign persons engaging in public corruption activities (e.g. bribery). The bill makes it a federal crime for foreign officials to demand or accept bribes to influence the performance of an official act or otherwise confer an improper advantage. Officials who engage in this conduct are subject to a fine, a prison term, or both. Funds recovered by prosecuting this crime shall be deposited into a new fund in the Treasury for anti-corruption initiatives. The Department of Justice must make publicly available an accounting of property relating to foreign government corruption that is forfeited to the United States. The bill addresses issues concerning U.S. visas, including related to (1) abuse of investor visas by corrupt foreign officials or criminals, and (2) foreign individuals denied admission to the United States because of adverse foreign policy consequences. The bill also prohibits extraditions based solely on, and otherwise addresses, International Criminal Police Organization communications.

Maximizing Outcomes through Better Investments in Lifesaving Equipment for (MOBILE) Health Care Act This bill expands and otherwise modifies the allowable uses of New Access Point grant funds. These grants help health centers establish new delivery sites to provide comprehensive primary care to medically underserved populations. Specifically, health centers may use funds to construct or renovate buildings or to set up mobile medical clinics. In addition, a mobile clinic may qualify for grant funding as a new delivery site regardless of whether it is associated with a permanent, full-time site.

Afghanistan Withdrawal Oversight and Liability Act or the AWOL Act This bill prohibits using federal funds appropriated for FY2021 to provide support to the Taliban. The bill also requires reports and certifications related to Afghanistan. Specifically, no FY2021 funds may be used to (1) make payments or contributions of material support to the Taliban, or (2) provide relief from sanctions against the Taliban or its leaders. The bill requires the President to report to Congress on efforts to evacuate U.S. citizens and lawful permanent residents from Afghanistan. The President must also certify to Congress when all such individuals seeking evacuation from Afghanistan have been evacuated. The Department of State must periodically report to Congress on any agreements between the United States and the Taliban. Within seven days of the United States reaching an agreement with the Taliban, the State Department must provide to Congress all materials relevant to that agreement. The bill also requires the Office of the Inspector General of the State Department to report to Congress about the State Department's compliance with legal requirements in connection to agreements with the Taliban. Specifically, the office must assess compliance with a law that requires the State Department to provide certain information to Congress when the United States enters certain international agreements. The Department of Defense must report to Congress concerning U.S. equipment, property, and classified material that was destroyed, surrendered, or abandoned in Afghanistan during a period starting from February 29, 2020.

Open Schools Responsibly Act This bill limits civil liability for elementary and secondary schools and institutions of higher education relating to any harm arising from exposure to, or infection by, COVID-19 suffered by a student, employee, or visitor. Specifically, a school or institution shall not be liable for such harm if the school or institution was in compliance with applicable state requirements. However, a school or institution may be liable for acts or omissions that constitute willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious flagrant indifference to the rights or safety of the individual harmed.

Guarantee Oversight and Litigation on Doping Act or the GOLD Act This bill expands federal enforcement for criminal offenses related to international doping fraud conspiracies. Specifically, the bill makes the offenses predicate offenses (i.e., underlying offenses) for prosecutions under the federal money laundering statute and the federal racketeering statute.

Registration for Index-Linked Annuities Act This bill requires the Securities and Exchange Commission (SEC) to create a new form for the registration of index-linked annuities to ensure that a purchaser can make a knowledgeable decision. The bill defines a registered index-linked annuity as an annuity that is deemed a security, that must be registered with the SEC, and that is issued by an insurance company subject to state supervision. Furthermore, the returns of these annuities (1) are based on the performance of a specified benchmark index or rate, and (2) may be subject to a market value adjustment if amounts are withdrawn early.

Transnational Repression Accountability and Prevention Act of 2021 or the TRAP Act of 2021 This bill establishes requirements related to U.S. cooperation with International Criminal Police Organization (INTERPOL) communications. Specifically, no U.S. agency or department may extradite an individual based solely on an INTERPOL notice. In addition, the Department of Justice and the Department of State must take certain actions to support reforms to increase transparency of INTERPOL, including with respect to its communications. The bill also requires reports on countries that abuse INTERPOL communications for political motives and other unlawful purposes.

Border Security for America Act of 2021 This bill addresses border security and related issues. For example, the bill requires the Department of Homeland Security (DHS) to resume all activities to construct a border barrier system along the U.S.-Mexico border that were underway or planned prior to January 20, 2021; requires DHS to deploy, in addition to physical barriers, tactical infrastructure and technology to achieve situational awareness and operational control of the southwest border; authorizes U.S. Customs and Border Protection (CBP) to carry out a program to acquire innovative commercial items through a competitive selection of proposals; imposes certain requirements for DHS border security technology acquisition programs that have a total expenditure of at least $300 million; requires CBP to implement certain technologies, including a program to establish a biometric exit data system at ports of entry; requires CBP to increase or maintain certain staffing levels for agents, officers, processing coordinators, and other positions; requires CBP to implement a workload staffing model for the U.S. Border Patrol and for CBP's Air and Marine Operations; and provides statutory authority through FY2026 for Operation Stonegarden, a Federal Emergency Management Agency program that provides grants to states and territories involved in certain active CBP border security operations.

21st Century Broadband Deployment Act This bill establishes grant programs within the National Telecommunications and Information Administration for partnerships of states, localities, and broadband service providers to carry out projects to expand access to fixed and mobile broadband service in unserved areas identified on specified Federal Communications Commission maps.

Counting Overlooked Base Impact Aid Act or the COBIA Act This bill requires the commanders of each military installation to annually submit written certification to their respective military departments verifying whether they have confirmed the information contained in all Impact Aid source check forms received from local educational agencies (LEAs) as of the date of such certification. Such forms are submitted by LEAs to confirm the number and identity of children eligible to be counted for purposes of the federal Impact Aid program.

Military Spouse Tax Act This bill provides that a spouse of a service member may retain their personal residence or domicile for purposes of taxation. The bill authorizes a service member and the spouse of the member to elect to use the following locations for purposes of taxation: the residence or domicile of the member, the residence or domicile of the spouse, or the permanent duty station of the member.

Commitment to Veteran Support and Outreach Act This bill authorizes the Department of Veterans Affairs (VA) to provide grants to states to implement programs that improve outreach and assistance to veterans and their families to ensure that such individuals are fully informed about veterans' benefits and programs. Specifically, the VA may provide grants to states to (1) implement or enhance outreach activities or activities to assist in the development and submittal of claims for veterans, or (2) increase the number of county or tribal veterans service officers in the state. The VA must prioritize awarding grants in areas with a critical shortage of county or tribal veterans service officers, areas with high rates of suicide among veterans, and areas with high rates of referrals to the Veterans Crisis Line.

Protecting Life on College Campus Act of 2021 This bill prohibits the award of federal funds to an institution of higher education (IHE) that hosts or is affiliated with a school-based service site that provides abortion drugs or abortions to its students or to employees of the IHE or the site. An IHE that hosts or is affiliated with a site must, in order to remain eligible for federal funds, annually certify that the site does not provide abortion drugs or abortions to students or employees.
