United States Call Center Worker and Consumer Protection Act

United States Call Center Worker and Consumer Protection Act - Requires a business enterprise that employs 50 or more employees, excluding part-time employees, or 50 or more employees who in the aggregate work at least 1,500 hours per week, exclusive of overtime, in a call center to notify the Secretary of Labor at least 120 days before relocating such center outside of the United States. Subjects violators to a civil penalty of up to $10,000 a day. Directs the Secretary to maintain and make publicly available a list of all such employers that relocate a call center. Requires such an employer to remain on the list for up to three years after each relocation. Makes such an employer ineligible for federal grants or federal guaranteed loans for five years after being added to the list, except where the employer demonstrates that a lack of such loan or grant would threaten national security, result in substantial job loss in the United States, or harm the environment. Requires the head of federal or state executive agency or military department, when awarding a civilian or defense-related contract, to give preference to a U.S. employer that does not appear on the list. Requires a business entity that initiates or receives a customer service communication to require each of its employees or agents participating in the communication to disclose their physical location at the beginning of each such communication unless all involved employees or agents are located in the United States. Exempts any communication: (1) initiated by a consumer if the consumer knows or reasonably should know that the employee or agent is located outside the United States, or (2) related to the provision of emergency services. Requires such a business entity, upon request, to transfer a customer to a customer service agent who is physically located in the United States. Authorizes the Federal Trade Commission (FTC) to exclude certain classes or types of business entities or customer services communications from the requirements of this Act under exceptionally compelling circumstances. Sets forth enforcement provisions.

Postal Service Protection Act of 2011 - Sets forth rules for the recalculation of annuities for employees of the U.S. Postal Service (USPS) and for the redetermination of surplus or supplemental liabilities under the Civil Service Retirement System (CSRS). Prescribes the "average pay" to be used in calculating annuities and surplus amounts. Authorizes the transfer of surplus postal retirement contributions in FY2010 to the Postal Service Retiree Health Benefits Fund, the Postal Service Fund, and the Employees' Compensation Fund under the Federal Employees' Compensation Act (FECA) and to USPS for payment of its debt obligations. Eliminates the requirement for pre-funding of the Postal Service Retiree Health Benefits Fund. Sets forth criteria for the closing or consolidation of postal facilities. Allows USPS to provide any nonpostal service or product in a manner consistent with the public interest. Provides for the mailing of wine and beer sent by a licensed winery or brewery in accordance with the laws of the state, territory, or district where the addressee or agent takes delivery. Establishes in USPS the position of the Chief Innovation Officer who shall have proven expertise and success in the postal and shipping industry and in innovation, marketing, technology, and management. Establishes a Postal Innovation Advisory Commission. Requires the Postmaster General to report to Congress on a comprehensive strategy for maximizing USPS revenue through innovative postal and nonpostal products and services. Prohibits USPS from reducing the frequency of mail delivery to fewer than six days each week or from increasing the expected delivery time for market-dominant products.

Heart Disease Education, Analysis, Research, and Treatment for Women Act or the HEART for Women Act - Directs the Comptroller General to report on whether the presentation of clinical study safety and effectiveness data by sex, age, and racial subgroups complies with Food and Drug Administration (FDA) requirements. Requires the Secretary of Health and Human Services (HHS) to submit a response to such report, including a corrective action plan as needed. Requires the Director of the Office of Women's Health of FDA to report on the compliance of clinical studies of women's health with such FDA requirements, including requirements regarding: (1) the adequacy of representation of females, racial and ethnic minorities, and adults of all ages in approved clinical studies; and (2) the extent to which a summary of product safety and effectiveness data disaggregated by sex, age, and racial subgroup is available to the public. Requires the Director of the Office of Minority Health of FDA to submit a report that includes such information with respect to clinical studies of minority health. Amends the Public Health Service Act to require the Secretary to report on the quality of, and access to, care for women with heart disease, stroke, and other cardiovascular diseases and to include recommendations for eliminating disparities in, and improving the treatment of, heart disease, stroke, and other cardiovascular diseases in women. Reauthorizes a program to award grants for preventive heath services and referrals for medical treatment for women through entities that are screening women for breast or cervical cancer. Requires the Secretary to study the impact of the Patient Protection and Affordable Care Act on such services and make recommendations for improvement in the provision of preventive health services, referrals, and followup services to women eligible for such services.

Domestic Partnership Benefits and Obligations Act of 2011 - Amends provisions of federal civil service law to extend employment-related and retirement benefits to domestic partners of federal employees and to set forth requirements for establishing a domestic partnership, including the filing of an affidavit attesting to the existence and legitimacy of the partnership. Modifies provisions relating to the Civil Service Retirement System (CSRS) and the Federal Employees' Retirement System (FERS) to extend eligibility for annuity and survivor benefits to domestic partners of federal employees on the same basis as married employees. Requires the Office of Personnel Management (OPM) to prescribe regulations to provide that domestic partners and former domestic partners shall be considered as spouses or former spouses for purposes of creditable service determinations under CSRS and FERS. Makes domestic partners of federal employees eligible for: (1) the federal employee group life insurance (FEGLI) program, (2) federal employees health benefits (FEHB), (3) dental and vision benefit plans, and (4) long-term care insurance coverage. Grants the head of an federal agency authority to reimburse an employee for taxes incurred the domestic partner of such employee for travel or transportation reimbursements. Modifies provisions of the Federal Employees' Compensation Act (FECA) to make domestic partners of federal employees eligible for worker compensation benefits under such Act. Adds "domestic partner" to the list of relatives subject to restrictions on federal employment of relatives and related prohibitions. Includes a biological, adopted, or foster child of a domestic partner as a "son or daughter" for purposes of federal employee family and medical leave provisions. Allows a federal employee family and medical leave to care for a domestic partner. Requires the President to prescribe regulations necessary to ensure that specified provisions relating to the following are administered in a manner consistent with the purposes of this Act: (1) the Family and Medical Leave Act of 1993; (2) travel, transportation, and related payments and benefits under the Foreign Service Act of 1980 and for civilian employees of the Department of Defense (DOD); (3) certain benefits for members of the commissioned officer corps of the National Oceanic and Atmospheric Administration (NOAA); and (4) benefits related to federal employees or annuitants and benefits necessary to carry out the purposes of this Act. Amends the Ethics in Government Act of 1978 to make provisions of that Act applicable to domestic partners of federal employees to the same extent as married employees, including provisions relating to financial disclosure, government-wide limitations on outside earned income and employment, gifts to superiors and to federal employees, bribery, acceptance of travel expenses from nonfederal sources, taxes on self-dealing, and disqualification of a justice, judge, or magistrate judge. Requires reporting by: (1) the President on the implementation of this Act, and (2) the Government Accountability Office (GAO) on the effect of this Act on premiums or other periodic charges under FEHB and the impact of extending benefits to domestic partners on federal employee retention and recruitment efforts.

Cleaning Product Right to Know Act of 2011 - Requires a cleaning product manufactured or offered for sale, distributed in commerce, or imported into the United States to bear a label listing each of its ingredients: (1) by the name assigned by the International Nomenclature of Cosmetic Ingredients or, if there is no such name, by the name assigned by the International Union of Pure and Applied Chemistry or, if there is none, by its common chemical name; and (2) in descending order of predominance by weight, except that ingredients that constitute less than 1% of the product can be listed at the end in any order. Allows the Consumer Product Safety Commission (CPSC) to exempt from such labeling requirement: (1) an ingredient that is present in a product at such low levels that detection is not technologically feasible, or (2) for five-year periods, an ingredient that a manufacturer demonstrates to be a trade secret. Sets forth required disclosures for, and limitations to, a manufacturer's claim that an ingredient is a trade secret. Requires a product that is not in conformity with the labeling requirements and not exempt to be treated as a misbranded hazardous substance under the Federal Hazardous Substances Act (FHSA). Increases penalties for violations of FHSA. Authorizes any person to petition the CPSC to investigate claims that a product does not satisfy the labeling requirements. Requires: (1) each cleaning product manufacturer to make available on its website a complete list of ingredients for each product, including any potential adverse health effect of each ingredient; and (2) CPSC to provide on its website aggregated information that allows users to compare products made by different manufacturers.

Expresses the sense of Congress that: (1) child marriage is a violation of human rights and its prevention and elimination should be a U.S. foreign policy goal; and (2) educational opportunities for girls, economic opportunities for women, and reducing maternal and child mortality are critical to U.S. global health and development objectives, including efforts to prevent HIV/AIDS. Directs the Secretary of State, the Administrator of the United States Agency for International Development (USAID), and the heads of other relevant departments and agencies to collect and make available data on the incidence of child marriage in specified countries that receive U.S. foreign or development assistance where the practice of child marriage is prevalent. Amends the Foreign Assistance Act of 1961 to require that Department of State reports on human rights practices for specified countries include a description of the status of child marriage for each country in which child marriage is prevalent.

Local Flexibility for Transit Assistance Act - Authorizes the Secretary of Transportation (DOT) to make urbanized area formula grants for the operating costs of equipment and facilities for use in public transportation in an urbanized area with a population over 200,000 to a designated recipient, direct recipient, or subrecipient that provides public transportation in the area operating less than 100 buses in fixed-route service in the area during peak service hours. Authorizes a designated recipient or direct recipient that operates at least 100 buses in fixed-route service during peak service hours in an urbanized area with a population of more than 200,000 to use grant funds for the operating costs of public transportation equipment and facilities in such projects if: (1) the recipients are certified by the Secretary as being in a crisis period; and (2) the recipients' percentage of revenue for the operating costs of public transportation equipment and facilities from non-federal sources (excluding system-generated revenue) is equal to the previous fiscal year's revenue, or the revenue is derived from dedicated sources. Specifies percentage limitations on the use of funds for urbanized areas with populations between 200,000 and 500,000, between 500,000 and 1 million, and over 1 million. Defines "crisis period" to mean that: (1) the unemployment rate within the recipients' service area is 7% or higher for the preceding month, or (2) the national average retail price of regular gasoline during a quarter has increased by more than 10%.

Domestic Violence Leave Act - Amends the Family and Medical Leave Act of 1993 to entitle an eligible employee, his or her same-sex spouse, or domestic partner to up to 12 workweeks of leave during any 12-month period: (1) to care for such individual's family member, if the family member is addressing domestic violence, sexual assault, or stalking and their effects; or (2) because such individual is addressing such matters, he or she is unable to perform any of the functions of his or her position. Authorizes such individual to substitute any of his or her accrued paid vacation leave, personal leave, family leave, or medical or sick leave for any of the 12-week period of such leave. Authorizes an employer to require an employee to certify with documentation the basis of the leave request. Declares that nothing in this Act shall require an employer to provide paid sick leave or paid medical leave in any situation in which such employer would not normally provide any such paid leave. Amends federal civil service law to entitle civilian federal employees, their same-sex spouses, or domestic partners to the same leave allowance. Provides for the substitution of accrued paid annual or sick leave for any part of the 12-week period. Authorizes the employing agency to require an employee to certify with documentation the basis of the leave request.

Breast Density and Mammography Reporting Act of 2011 - Amends the Public Health Service Act to require mammography facilities to include information regarding the patient's individual measure of breast density in both the written report of the results of a mammography examination provided to the patient's physician and the summary of that written report given to patients. Requires the summary to: (1) convey the patient's risk of developing breast cancer associated with below, above, and average levels of breast density; and (2) include language communicating that individuals with more dense breasts may benefit from supplemental screening tests and should talk with their physicians about any questions or concerns regarding the summary.

Creating Hope Act of 2011 - Amends the Federal Food, Drug, and Cosmetic Act to revise the priority review voucher program for tropical diseases to: (1) include rare pediatric diseases; (2) allow unlimited transfers of vouchers under the program; and (3) require a sponsor intending to use a voucher to notify the Secretary of Health and Human Services (HHS) at least 90 days (currently, 365 days) before submission of the application. Revises provisions regarding the priority review user fee, including to make it payable upon notification of the Secretary of intent to use the voucher. Authorizes the Secretary, upon request of the manufacturer or sponsor of a new drug, to designate that a new drug is: (1) for a rare pediatric disease, and (2) an eligible treatment. Requires the Secretary to deem a rare pediatric disease product application to be incomplete if it does not contain a description of the sponsor's plan to market the product in the United States. Authorizes the Secretary to refuse to issue a priority review voucher upon the approval of a rare pediatric disease application if the Secretary finds that the sponsor lacks a good faith intention to market the product in the United States. Directs the Secretary to issue a guidance document setting forth the evidentiary support necessary to demonstrate such a good faith intention. Requires sponsors of applications under the priority review voucher program to report to the Secretary within five years after the approval of the application on the demand and distribution of the product within the United States.

Housing Opportunities Made Equal Act of 2011 or HOME Act of 2011 - Amends the Fair Housing Act, with respect to prohibited discrimination in housing sales and rentals, residential real estate-related transactions, and brokerage services, to specify that the race, color, religion, sex, familial status, or national origin basis of discrimination may be actual or perceived. Adds to the list of prohibited actual or perceived bases sexual orientation, gender identity, marital status, and source of income. Amends the Civil Rights Act of 1968, with respect to prohibited intimidation, interference, or injury of individuals, to specify that the race, color, religion, sex, familial status, or national origin basis of discrimination may be actual or perceived. Adds also to the list of prohibited actual or perceived bases sexual orientation, gender identity, marital status, or source of income. Redefines "discriminatory housing practice" to specify that the definition: (1) applies regardless of whether the discriminatory practices occur pre- or post-acquisition; and (2) includes a failure to comply with administrative requirements of the Secretary of Housing and Urban Development (HUD), including related regulations, in a manner affirmatively to further nondiscrimination policies. Redefines "familial status" to include individuals (under age 18) residing with: (1) a foster parent or another person having lawful physical custody of such individuals; or (2) anyone standing in loco parentis of such individuals (currently, the designee of such parent or other person having such custody, with the parent's or other person's written permission). Amends the Equal Credit Opportunity Act and the Fair Housing Act to grant the Attorney General pre-litigation subpoena power if there is reason to believe that any person may be in possession, custody, or control of any documentary material or information relevant to an investigation under the respective Act. Amends the Equal Credit Opportunity Act to prohibit discrimination against credit applicants on the basis of actual or perceived race or color, sex, sexual orientation, or gender identity. States that discrimination against a person because of a handicap includes the failure, in connection with a real estate-related transaction, to make reasonable accommodations for such persons. Revises the limitations on filing complaints and commencing civil actions by certain individuals alleging discriminatory housing practices to deem that the failure to design and construct a dwelling that meets requirements for reasonable modifications for handicapped persons shall continue (and with it the alleged discriminatory housing practice) until such time as the dwelling conforms to them.

Requires the Secretary to convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer to establish a plan to meet specified objectives relating to medical and psychosocial care workforce development, including: (1) disseminating to health care educators information relevant to providing medical and psychosocial services to persons with pediatric cancers; (2) adapting curricula for continuing education of the existing workforce; and (3) strengthening the emphasis on psychosocial health care in educational accreditation standards and professional licensing and certification. Reauthorizes and expands the National Cancer Institute's pediatric cancer research and awareness program to include research on: (1) pediatric cancer survivors within minority or other medically underserved populations, (2) health disparities in pediatric cancer survivorship outcomes, and (3) follow-up care for pediatric cancer survivors. Requires the Secretary to make grants to eligible entities to establish and operate a clinic for comprehensive long-term follow-up services for pediatric cancer survivors.

Fix America's Schools Today (FAST) Act of 2011 - Directs the Secretary of Education to allocate grants to states and, through them, subgrants to local educational agencies (LEAs) to modernize, renovate, or repair early learning or elementary or secondary education facilities. Requires the Secretary to allocate grants directly to the 100 LEAs with the largest numbers of children aged 5-17 living in poverty to modernize, renovate, or repair such facilities. Requires allocation of such funds among these LEAs in proportion to each LEA's respective share of school improvement funds under part A of title I of the Elementary and Secondary Education Act of 1965. Requires states to give subgrant priority to projects that comply with certain green building standards. Prohibits the use of such grants for new construction or routine maintenance costs. Reserves funds for a survey, by the National Center for Education Statistics, of nationwide public school construction, modernization, renovation, and repair needs. Directs the Secretary to allocate grants to states to modernize, renovate, or repair existing facilities at community colleges. Prohibits the use of such grants: (1) for routine maintenance costs, (2) on facilities used for events for which the public is charged admission, or (3) on facilities which are used for sectarian purposes. Requires states, in providing assistance to community college projects, to consider the extent to which the project complies with certain green building standards. Limits the amount of time states and LEAs have to obligate this Act's grants and subgrants. Requires, with certain exceptions, the iron, steel, and manufactured goods used in projects funded by this Act to be domestic. Applies the prevailing wage rate requirements of the Davis-Bacon Act to projects assisted pursuant to this Act.

Sets forth the duties of the Commission, which shall include: (1) evaluating HHS programs; (2) identifying current activities and critical gaps in federal efforts to support clinicians in providing care to people with pre-diabetes and diabetes; (3) using outcomes-based registry data to evaluate various care models and methods; (4) evaluating and expanding education and awareness to health care professionals regarding clinical practices for the prevention of diabetes and the precursor conditions of diabetes; and (5) developing and testing appropriate methods for outreach and dissemination of educational resources related to diabetes prevention and treatments. Requires the Commission to submit to the Secretary and Congress an operating plan for carrying out the activities of the Commission that includes specific activities the Commission plans to conduct and a budget for such activities.

Mechanical Insulation Installation Incentive Act of 2011 - Amends the Internal Revenue Code to allow an additional tax deduction for the cost of installing mechanical insulation property. Limits the amount of such deduction to the lesser of 30% or the reduction in energy loss from the installed mechanical insulation property compared to property that meets the minimum requirements of American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) standard 90.1-2007. Allows the cost of replacing mechanical insulation property to be treated as a deductible business expense in the current taxable year. Defines "mechanical insulation property" as insulation materials, facings, and accessory products: (1) placed in service in connection with a mechanical system which is located in the United States and of a character subject to an allowance for depreciation; and (2) utilized for thermal, acoustical, and personnel safety requirements for mechanical piping and equipment, hot and cold applications, and heating, venting and air conditioning applications which can be used in a variety of facilities. Allows a tax deduction for capital expenditures related to mechanical insulation property.
