Paycheck Fairness Act

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation, (2) is job-related with respect to the position in question, and (3) is consistent with business necessity. Makes such defense inapplicable where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential, and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer who has made a substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey, (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity, and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner [ sic ] of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Great Ape Protection and Cost Savings Act of 2011 - Prohibits: (1) conducting invasive research on great apes; (2) possessing, maintaining, or housing a great ape for the purpose of conducting invasive research; (3) using federal funds to conduct such research on a great ape or to support an entity conducting or facilitating invasive research on a great ape either within or outside of the United States; (4) knowingly breeding a great ape for the purpose of conducting or facilitating such research; (5) transporting, moving, delivering receiving, leasing, renting, donating, purchasing, selling, or borrowing a great ape in interstate or foreign commerce for conducting or facilitating such research; and (6) transferring federal ownership of a great ape to a non-federal entity unless the entity is a suitable sanctuary. Defines "great ape" as any chimpanzee, bonobo, gorilla, orangutan, or gibbon. Defines "invasive research" as research that may cause death, injury, pain, distress, fear, or trauma to great apes, including drug testing or exposure to a substance or isolation, social deprivation, or other experimental manipulations that may be detrimental to the ape's health or psychological well-being. Requires the Secretary of Health and Human Services (HHS) to effectuate the permanent retirement of all great apes that are owned by the federal government and that are being maintained in any facility for the purpose of breeding for, holding for, or conducting invasive research. Sets forth civil penalties for violations of this Act. Establishes in the Treasury the Great Ape Sanctuary System Fund to be administered by the Secretary for construction, renovation, and operation of  the sanctuary system for surplus chimpanzees.

STANDUP Act

Safe Teen and Novice Driver Uniform Protection Act of 2011 or STANDUP Act - Authorizes the Secretary of Transportation to award incentive grants to states with graduated driver licensing laws that require novice drivers younger than age 21 to comply with a two-stage licensing process before receiving an unrestricted driver's license. Requires such laws, at a minimum, to include: (1) a learner's permit stage that commences at age 16 or older, lasts at least six months, prohibits driver use of a cellular phone or other communications device in nonemergency situations, and remains in effect until commencement of the intermediate stage or the driver attains age 18; (2) an intermediate stage in effect until the driver attains age 18 that commences immediately after expiration of the learner's permit stage, lasts at least six months, prohibits driver use of a cellular phone or other communications device in nonemergency situations, prohibits nighttime driving, prohibits more than one non-familial passenger under age 21 unless there is a licensed driver at least age 21 present in the vehicle; and (3) any other requirement that the Secretary may require. Deems a state that meets such minimum requirements to be in compliance regardless of whether a state law, enacted before January 1, 2011, establishes a class of license that permits licensees younger than age 18 to drive a motor vehicle in connection with work performed on or for the operation of a farm owned by family members of the licensees. Directs the Secretary to withhold a certain percentage of federal-aid highway funds from states that do not comply with the requirements of this Act.

Defines "9/11 first responders" as emergency responders and recovery and cleanup workers who responded to the terrorist attacks that occurred on September 11, 2001, in New York City, in Shanksville, Pennsylvania, and at the Pentagon (including the aftermath of such attacks).

Employment Non-Discrimination Act - Prohibits employment discrimination on the basis of actual or perceived sexual orientation or gender identity by covered entities (employers, employment agencies, labor organizations, or joint labor-management committees). Prohibits preferential treatment or quotas. Allows only disparate treatment claims. Prohibits related retaliation. Makes this Act inapplicable to: (1) religious organizations, and (2) the relationship between the United States and members of the Armed Forces. Declares that this Act does not repeal or modify any federal, state, territorial, or local law creating a special right or preference concerning employment for a veteran. Provides for the construction of this Act regarding: (1) enforcement by employers of rules and policies, (2) sexual harassment, (3) certain shared facilities such as showers or dressing facilities, (4) construction of new or additional facilities, (5) dress and grooming standards, and (6) provision of employee benefits to married vs. unmarried couples. Declares that, in this Act, "married" refers to marriage as that term is defined in the Defense of Marriage Act (a legal union between one man and one woman). Prohibits the Equal Employment Opportunity Commission (EEOC) from collecting statistics from covered entities on actual or perceived sexual orientation or gender identity or compelling the collection by covered entities of such statistics. Provides for enforcement, including giving the EEOC, the Librarian of Congress, the Attorney General, and U.S. courts the same enforcement powers as they have under specified provisions of the Civil Rights Act of 1964, the Government Employee Rights Act of 1991, and other specified laws. Allows actions and proceedings, subject to exception, against the United States and the states.

Bus Uniform Standards and Enhanced Safety Act of 2011 or the BUSES Act of 2011 - Directs the Secretary of Transportation to issue regulations to require: (1) monitoring of the safety performance of motorcoach service providers and other commercial motor carriers of passengers; and (2) progressive interventions to correct unsafe practices, and if they are not corrected, an enforcement action. Authorizes the Secretary to organize special enforcement strike forces to target commercial motor vehicle operators when appropriate. Directs the Secretary to: (1) prescribe regulations to establish minimum training requirements for motorcoach drivers, (2) review testing requirements for a commercial driver's license passenger endorsement, (3) develop requirements for the testing of medical examiners who examine commercial motor vehicle operators for physical fitness and seek to be listed in the national registry, (4) review annually the implementation of the commercial driver's license requirements of at least 10 states to assess the validity of physical examination reports and medical certificates submitted by certified medical examiners, and (5) establish the national registry of medical examiners. Sets forth additional Medical Review Board functions. Requires the Secretary to review and report to Congress on federal commercial motor vehicle safety inspection standards. Revises federal motor carrier registration requirements. Directs the Secretary to prescribe federal motor vehicle safety standards for occupant protection systems for new and existing motorcoaches. Amends the Internal Revenue Code to provide a qualified motorcoach safety credit to a taxpayer for the costs of new and existing motorcoaches to comply with the federal motor vehicle safety standards. Requires the Secretary to provide grants (not to exceed $20,000 per vehicle) to motorcoach operators to assist with the cost of retrofitting motorcoaches in order to comply with such federal standards. Amends the Small Business Act to grant the Administrator of the Small Business Administration (SBA) the authority to make SBA loans and loan guarantees to motorcoach operators to retrofit their buses and motorcoaches for occupant protection.

Fair Elections Now Act - Amends the Federal Election Campaign Act of 1971 (FECA) with respect to: (1) candidate benefits of fair elections financing of House of Representatives election campaigns; (2) allocations to candidates from the Fair Elections Fund established by this Act; (3) 500% matching payments to candidates for certain small dollar contributions; (4) Fund allocation eligibility requirements; (5) certification of a federal election candidate as a participating candidate; (6) contribution, expenditure, and fundraising requirements; (7) a public debate requirement; (8) remission to the Fair Elections Fund of unspent funds after an election; (9) establishment of the Fair Elections Fund and of a Fair Elections Oversight Board; (10) civil penalties for violation of contribution and expenditure requirements; and (11) transfer of a portion of collected civil money penalties into the Fair Elections Fund. Prohibits: (1) use of contributions by a participating candidate for any purposes other than an election campaign, and (2) establishment of joint fundraising committees with any political committee other than a candidate's authorized committee. Prescribes a limitation on coordinated expenditures by political party committees with participating candidates. Amends FECA to empower the Federal Election Commission (FEC) to petition the U.S. Supreme Court for a writ of certiorari to appeal a civil action. Requires all designations, statements, and reports required to be filed under FECA to be filed: (1) directly with the FEC, and (2) in electronic form accessible by computers. Reduces from 48 hours to 24 hours after their receipt the deadline for the FEC to make designations, statements, reports, or notifications available to the public in the FEC office and on the Internet.

Requires LEA grant applicants also to demonstrate that: (1) the AEDs are integrated into the schools' emergency response procedures, and (2) emergency services personnel are notified of their locations. Gives grant priority to schools that: (1) lack an AED; (2) typically have a significant number of students, staff, and visitors present during the day; (3) generally have a longer wait for emergency medical services than other public facilities in the community; and (4) have not received funds under the Rural Access to Emergency Devices Act.

United States Postal Service Pension Obligation Recalculation and Restoration Act of 2011 - Prescribes the "average pay" and the appropriate percentage thereof to be used in determining annuities for civilian employment with the United States Postal Service (USPS) for purposes of provisions relating to future benefits attributable to such employment in order to calculate the amount of any USPS surplus or supplemental liability under the Civil Service Retirement System. Requires the Office of Personnel Management (OPM): (1) within six months after enactment of this Act, to determine (or, if applicable, redetermine) the amount of such surplus or liability as of the close of the most recently ending fiscal year using the methodology required under this Act; and (2) if the result is a surplus, to transfer the surplus amount to the Postal Service Retiree Health Benefits Fund within 15 days after the determination of a surplus. Provides for an alternate determination of an USPS surplus or supplemental liability for FY2016-FY2020. Requires transfer of certain surplus postal retirement contributions in FY2011 to the Postal Service Retiree Health Benefits Fund or the Employees' Compensation Fund under the Federal Employees' Compensation Act (FECA). Expresses the intent of Congress that this Act shall apply to allocations of past, present, and future benefit liabilities between the USPS and the Treasury.

Directs the government to make public records available on the Internet at no charge, except as imposed by federal law before this Act's enactment. Requires: (1) public records to be permanently available on the Internet; (2) current information technology capabilities to be applied to the means by which records are made available and to the formats in which they are available; and (3) each agency to publish on the Internet a comprehensive, searchable, machine processable list of all records it makes publicly available. Delineates the roles of the Director of the Office of Management and Budget (OMB), the Administrator of the Office of Electronic Government, and the chief information officers of independent regulatory agencies, including granting narrow case-by-case exceptions to the Internet publication requirement if an agency requests an exception and demonstrates that: (1) there is a clear and convincing reason for the record to not be made available on the Internet, and (2) on balance the harm caused by disclosure significantly outweighs the public's interest in having the record available on the Internet. Directs the Inspector General of each agency to conduct periodic reviews regarding agency compliance with Internet publication requirements. Sets forth provisions regarding enforcement of public access by private individuals or organizations. Urges: (1) judicial and legislative agencies to adopt or adapt the Advisory Committee's recommendations, and (2) the Government Printing Office (GPO) to make all of its publications permanently available on the Internet in a multiplicity of formats.

Congressional Made in America Promise Act of 2011 - Amends the Buy American Act to apply Buy American requirements to articles, materials, and supplies acquired for the use of any legislative branch office, including the House of Representatives and the Senate, in the same manner as the Act applies with respect to articles, materials, and supplies acquired for the use of a department or independent establishment. Prescribes a special rule in the case of any product which bears an official congressional insignia (including a mark resembling an official seal) that is acquired for the use of a legislative branch office. Prohibits the head of such office from making a determination under the Act that it is inconsistent with the public interest to enter into a contract in accordance with the Act. Makes inapplicable to products with an official congressional insignia the exceptions to the Buy American rule for: (1) articles, materials, or supplies not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities and of satisfactory quality; or (2) manufactured articles, materials, or supplies procured under any contract the award value of which is less than or equal to the micro-purchase threshold. (Thus applies the Buy American rule to any legislative branch office purchase of products with an official congressional insignia, without exception.)

Stop Trading on Congressional Knowledge Act - Amends the Securities Exchange Act of 1934 and the Commodity Exchange Act to direct both the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) to prohibit purchase or sale of either securities, security-based swaps, or commodities for future delivery or swap by a person in possession of material nonpublic information regarding pending or prospective legislative action if the information was obtained: (1) knowingly from a Member or employee of Congress, (2) by reason of being a Member or employee of Congress, or (3) from other federal employees and derived from their federal employment. Amends the Code of Official Conduct of the Rules of the House of Representatives to prohibit any Member, officer, or employee of the House from disclosing material nonpublic information relating to any pending or prospective legislative action relating to any publicly-traded company or to any commodity if such person has reason to believe that the information will be used to buy or sell the securities of that publicly traded company or that commodity for future delivery based on such information. Directs both the Committee on Agriculture and the Committee on Financial Services of the House of Representatives to hold hearings on the implementation by the CFTC and the SEC of such financial transaction prohibitions. Amends the Ethics in Government Act of 1978 to require formal disclosure of certain securities and commodities futures transactions to either the Clerk of the House of Representatives or the Secretary of the Senate. Amends the Lobbying Disclosure Act of 1995 to subject to its registration, reporting, and disclosure requirements, as well as requirements for identification of clients and covered legislative and executive officials, all political intelligence activities, contacts, firms, and consultants. Requires the Comptroller General to include political intelligence activities, contacts, firms, and consultants in its annual compliance audits and reports.

Requires such study to assess the professional capacity of the social work workforce to serve and respond successfully to the increasing biopsychosocial needs of individuals, groups, and communities in certain areas, including aging and child welfare. Terminates the Commission 30 days after it submits such report within 18 months of its first meeting. Authorizes the Secretary to award: (1) workplace improvement grants to eligible entities and individuals to address workplace concerns for the social work profession, including caseloads, compensation, social work safety, supervision, and working conditions; and (2) research grants, education and training grants, and community-based programs of excellence grants. Directs the Secretary to: (1) contract with a national social work entity to serve as a coordinating center and clearinghouse for information on activities funded under the grants, and (2) develop a multi-media outreach campaign and issue public service announcements that advertise and promote the social work profession.

Strengthening Medicare And Repaying Taxpayers Act of 2011- Amends title XVIII (Medicare) of the Social Security Act with respect to any settlement, judgment, award, or other payment between a Medicare claimant and an applicable plan involving a payment made for items and services by the Secretary of Health and Human Services (HHS). Declares that, in the case of a payment to the claimant by the Secretary, and beginning 120 days before the reasonably expected date of a settlement, judgment, award, or other payment, the claimant or applicable plan may at any time but only once: (1) notify the Secretary that a payment is reasonably expected, and (2) request a statement of the conditional payment reimbursement amount for any payments subject to the required reimbursement. Requires the Secretary to respond to such a request, within 65 days after receiving it, with a statement of reimbursement amount. Prescribes procedures for the claimant, an applicable plan, or specified related entities to follow if the Secretary fails to provide such a statement. Specifies circumstances: (1) in which the claimant, an applicable plan, or specified related entities are shielded from liability for certain payments; and (2) in which the Secretary shall be exempt from any obligation for a statement of reimbursement. Directs the Secretary to promulgate regulations establishing a right of appeal and appeals process, with respect to any determination for a payment made under such title for an item or service under a primary plan, under which the applicable plan involved, or an attorney, agent, or third party administrator on behalf of such applicable plan, may appeal such determination. Exempts a primary plan, and an entity receiving payment from a primary plan, from any obligation to reimburse the appropriate Trust Fund for a Medicare payment by the Secretary with respect to any settlement, judgment, award, or other payment by an applicable plan constituting a total payment obligation to a claimant of not more than the single threshold amount calculated by the Chief Actuary of the Centers for Medicare & Medicaid Services (CMS). Requires the Chief Actuary to calculate and publish the single threshold amount annually. Makes discretionary rather than mandatory the current civil money penalty for an applicable plan's noncompliance with requirements to submit insurance information about a claimant. Requires the severity of each penalty to be based on the knowing, willful, and repeated nature of the violation. Prescribes requirements for the specification of practices for which sanctions will not be imposed on a plan (safe harbors). Directs the Secretary to modify insurance information reporting requirements so that a plan, in complying with them, is permitted but not required to access or report beneficiary Social Security account numbers or health identification claim numbers. Sets a three-year statute of limitations on a Medicare secondary payer claim by the Secretary for reimbursement against an applicable plan that becomes a Medicare primary payer pursuant to a settlement, judgment, award, or other judicial action.

Directs specified congressional committees to hold hearings on the implementation of such a withdrawal of approval.

Authorizes the President to issue such a proclamation citing the geographic area, gasoline or other petroleum distillate, and time period (not to exceed 30 consecutive days) covered. Permits such a proclamation to be renewed as the President determines appropriate and to include a period of up to one week preceding a reasonably foreseeable emergency. Sets forth factors to be considered in determining if a violation of this Act has occurred. Requires the Federal Trade Commission (FTC) to enforce a violation of this Act as an unfair or deceptive act or practice and to give priority to enforcement actions concerning companies with U.S. sales over $10 billion per year. Prescribes civil and criminal penalties for violations, but limits the criminal penalty to criminal actions brought by the Department of Justice (DOJ). Authorizes a state to bring a civil action to enforce this Act. Declares that nothing in this Act preempts any state law.
