Climate MATTERS Act of 2008

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.

Twenty-first Century Communications and Video Accessibility Act of 2008 - Amends the Communications Act of 1934 to define "disability." Requires that equipment providing IP-enabled voice communication services via a built-in speaker provide an internal means for hearing aid use. Redefines "telecommunications relay services." Requires interconnected VoIP (Voice over Internet Protocol) providers and providers of voice communications using an IP-enabled service to contribute to the Telecommunications Relay Services Fund. Requires, unless it would be an undue burden (significant difficulty or expense), that equipment and services for IP-enabled communication be usable by individuals with disabilities. Requires, if such requirements are an undue burden, that the equipment or service be compatible with existing commonly used devices or specialized customer equipment, unless that requirement would be an undue burden. Establishes an accessible products and services clearinghouse. Declares that the transmission and receipt of text messages are telecommunications services for purposes of access by persons with disabilities. Adds telecommunications and IP-enabled communication services needed by individuals with disabilities to the services supported by Lifeline and Link Up programs and other federal universal service support mechanisms. Makes eligible for universal service support certified programs for the distribution of equipment to make telecommunications and IP-enabled communication service accessible by deaf-blind individuals. Requires seamless text communication among interconnected VoIP services, IP-enabled communication services, and telecommunications services. Requires a Federal Communications Commission (FCC) inquiry and report concerning: (1) closed captioning decoder and video description capability; (2) user interfaces; and (3) video programming guides and menus. Revises provisions concerning any apparatus designed to receive television pictures broadcast simultaneously with sound to require that any apparatus that receives or displays video programming transmitted simultaneously with sound be capable of decoding closed captioning, delivering video description, and conveying emergency information, including Emergency Alert System messages, accessibly to blind or visually-impaired individuals. Requires the FCC video description regulations contained in the Implementation of Video Description of Video Programming, Report and Order to be considered to be in full force and effect and applicable to video programming published after enactment of this Act. Requires identification of methods to convey emergency information accessibly to blind or visually-impaired individuals. Requires that apparatus to receive or display video, including using IP-enabled communication services, allow control by individuals with disabilities and that on-screen menus be accompanied by audio output to enable control by blind or visually impaired individuals. Requires each provider or owner of video programming and each multichannel programming distributor to ensure that video programming information and selection provided by means of a navigational device, guide, or menu is accessible in real-time by individuals with disabilities who are unable to read the visual display.

Establishes the Energy Efficiency and Renewable Energy Fund to serve as depository for fees received under this Act. Makes it unlawful, as well, for any person to hold a contract or agreement of sale of a specified energy commodity for future delivery, which is otherwise an excluded swap transaction or an exempt transaction, unless the CFTC has certified that the person has the capacity to produce or manufacture the commodity.

Amends such federal laws to establish the same polling place hours in the United States for both congressional and presidential elections, namely from 10:00 a.m. EST on Saturday till 6:00 p.m. EST on Sunday, with polls allowed to close between the hours of 10:00 p.m. local time on Saturday and 6:00 a.m. local time on Sunday as provided by the law of the state in which the polling place is located. Cure and Understanding through Research for Alzheimer's Act of 2008 or La Cura Act of 2008 - Amends the Public Health Service Act to require the Director of the National Institutes of Health (NIH) to ensure sufficient resources for activities relating to Alzheimer's disease and Hispanic communities, including by: (1) increasing efforts in epidemiological work in Hispanic subgroups; (2) allocating resources to the National Institute on Aging Alzheimer's disease research centers and other academic centers involved in such research to increase participation of Hispanics and other underrepresented ethnic groups in research and clinical trials in sufficient numbers to draw valid conclusions; and (3) conducting social, behavioral, and health services research to understand the underlying reasons why Hispanic individuals delay diagnosis and underutilize services, to identify culturally and linguistically appropriate approaches to address such delays and underutilization, and to identify approaches for providing, and improving the quality of, culturally competent care. Requires the Director to expand and intensify NIH efforts to educate communities about the importance of research relating to Alzheimer's disease and to respond effectively to cultural concerns about participation in such research. Authorizes appropriations for a program of grants to states to carry out demonstration programs related to Alzheimer's disease. Requires the Secretary of Health and Human Services, acting through the Centers for Disease Control and Prevention (CDC), to conduct an aggressive, evidence-based education and outreach program to promote public awareness and risk reduction with respect to Alzheimer's disease, particularly to Hispanic populations.

GREEN Act of 2008

Green Resources for Energy Efficient Neighborhoods Act of 2008 or the GREEN Act of 2008 - Sets forth provisions concerning Housing of Urban Development (HUD) energy efficiency and conservation standards and green building standards for structures (conservation standards). Requires the Secretary of HUD to conduct a program to demonstrate the effectiveness of funding a portion of the costs of carrying out energy efficiency and conservation and green building measures for multifamily housing projects for which rental assistance is provided under a covered multifamily assistance program. Amends the Housing and Community Development Act of 1992 to provide for credits for Fannie Mae and Freddie Mac for mortgage purchases that support housing that meets conservation standards. Amends the Federal National Mortgage Association Charter Act, the Federal Home Loan Mortgage Corporation Act, and the Federal Home Loan Bank Act to include provisions concerning energy-efficient mortgages and location-efficient mortgages. Amends the National Housing Act to require the Secretary to: (1) ensure that the aggregate outstanding principal obligation of mortgages on single-family housing meeting energy efficiency standards that are insured by the Secretary is not less than $1 billion; and (2) conduct an energy efficient mortgages education and outreach campaign. Amends the Home Mortgage Disclosure Act of 1975 to require the disclosure of the number and dollar amount of mortgage loans that are energy efficient and location efficient. Prohibits insurers from denying homeowner insurance coverage or discriminating in coverage for structures that are not connected to, or not able to receive electricity from, electric power providers. Requires the Secretary to establish incentives for developers to: (1) increase the energy efficiency of multifamily housing; and (2) certify that trees, shrubs, grasses, and other plants are planted properly. Sets forth provisions concerning energy saving techniques and energy performance requirements for manufactured homes. Requires the Secretary to conduct a pilot program to facilitate the financing of cost-effective capital improvements for covered assisted housing projects to improve their energy efficiency and conservation. Amends the Housing and Community Development Act of 1974 to require the Secretary to make grants for energy efficiency improvements in housing. Amends the Cranston-Gonzalez National Affordable Housing Act of 1990 to require state and local housing strategies to include provisions to encourage sustainable development for affordable housing. Requires the Secretary to make grants to nonprofit organizations to increase low-income community development capacity. Amends the United States Housing Act of 1937 to: (1) direct the Secretary to ensure that public housing agencies will receive the full financial benefit from reductions in utility costs resulting from contracts to undertake energy conservation improvements in connection with revitalization plans; and (2) prohibit the Secretary from making grants for demolition, site revitalization, replacement housing, and tenant-based assistance unless the applicant's proposed revitalization plan meets green development requirements. Amends the Community Reinvestment Act of 1977 to require federal financial supervisory agencies, in assessing the record of a financial institution, to consider specified energy efficiency and environmental ventures undertaken by the institution. Amends the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 to direct: (1) federal financial institution regulatory agencies to require their standards for the performance of real estate appraisals to consider renewable energy sources for, or energy-efficiency or energy-conserving improvements or features of, the property in determining its value; and (2) the Appraisal Subcommittee to establish requirements for appraisers regarding energy-efficiency features and guidelines for appraising photovoltaic measures and training of appraisers. Directs the Secretary to require the Housing Assistance Council to establish incentives for compliance by structures assisted by the Secretary and HUD's Office of Rural Housing and Economic Development with energy efficiency requirements. Establishes in the Treasury the Alternative Energy Sources State Revolving Fund. Amends the Federal Deposit Insurance Act and the Federal Credit Union Act to require federal banking agencies to prescribe guidelines encouraging the establishment and maintenance of green banking centers by insured depository institutions to provide consumers information on home energy ratings, financing for energy-saving improvements to property, and beneficial terms for mortgages or loans that meets energy-efficiency standards.

Invest in Energy Independence Act - Instructs the Secretary of Energy to publish a plan to: (1) exchange light grade petroleum from the Strategic Petroleum Reserve (SPR) for an equivalent volume of heavy grade petroleum plus certain cash bonus bids received that reflect the difference in the market value between light grade and heavy grade petroleum and the timing of deliveries of the heavy grade petroleum; (2) deposit into the SPR Petroleum Account, from the gross proceeds of the cash bonus bids, the amount necessary to pay for the costs of the exchange; (3) deposit 90% of the remaining net proceeds from the exchange into the Energy Independence and Security Fund established by this Act; and (4) deposit the remaining balance into the SPR Petroleum Account to acquire additional petroleum for the SPR. Directs the Secretary to study and report to Congress on the potential for additional exchanges from the SPR. Establishes in the Treasury the Energy Independence and Security Fund. Instructs the Secretary to distribute amounts from the Fund to specified energy activities, including: (1) energy research of the Advanced Research Projects Agency; (2) wind and solar energy research and development; (3) low-income weatherization; (4) advanced vehicles research, development, demonstration; and (5) smart grid technology research and development.

Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to establish and maintain a scientific registry of stillbirths in the United States, which shall include for each stillbirth information on the stillborn fetus and the mother's health and pregnancy as collected and submitted by states on the U.S. Standard Report of Fetal Death. Requires the Secretary to: (1) provide for the development of a standard definition of stillbirth and a standard protocol for stillbirth data collection and surveillance; and (2) carry out a national campaign to increase public and state awareness of such definition and protocol and public awareness and knowledge of stillbirths.

Clean Boating Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to provide that no permit shall be required by the Administrator of the Environmental Protection Agency (EPA) under the national pollutant discharge elimination system for the discharge from a recreational vessel of graywater, bilge water, cooling water, weather deck runoff, oil water separator effluent, or effluent from properly functioning marine engines or for any other discharge that is incidental to the normal operation of such vessel. Defines a "recreational vessel" as any vessel that is leased, rented, or chartered to a person for that person's pleasure or that is manufactured or used primarily for pleasure, excluding vessels that are subject to Coast Guard inspection and that are engaged in commercial use or that carry paying passengers. Requires the Administrator to: (1) develop management practices for recreational vessels to mitigate the adverse impacts on U.S. waters of discharges incidental to normal vessel operation (excluding sewage) in any case in which the Administrator determines that the use of those practices is reasonable and practicable; and (2) promulgate federal standards of performance (which may distinguish among vessel types) for each discharge for which such a management practice is developed. Requires the Secretary of the department in which the Coast Guard is operating to promulgate regulations governing the design, construction, installation, and use of management practices for recreational vessels as necessary to meet such standards. Prohibits the owner or operator of a recreational vessel from operating in U.S. waters if such owner or operator is not using applicable management practices in compliance with such regulations.

Declares that this Act does not limit or prevent individualized medical care performed on great apes by licensed veterinarians for the benefit of the great apes. Requires the Secretary of Health and Human Services (HHS) to provide for the permanent retirement of all great apes that are owned or under the control of the federal government and that have been used for invasive research. Authorizes the Secretary to provide for the euthanizing of such apes if it is in their best interest as determined by an attending veterinarian and endorsed by a second, unaffiliated veterinarian. Defines "invasive research" to mean experimental research that may cause death, bodily injury, pain, distress, fear, injury, or trauma to great apes. Excludes: (1) close observation of natural or voluntary behavior, provided that it does not require the removal of apes from their social group or environment or require an anesthetic or sedation event to collect data or record observations; or (2) post-mortem examinations of great apes following their natural death.

Hubbard Act - Amends federal employment, armed forces, military pay, and veterans' benefits law to authorize the provision of the following benefits to a member of the Armed Forces who is discharged at the member's request pursuant to a Department of Defense (DOD) policy permitting the early discharge of a member who is the only surviving child in a family in which the father or mother, or one or more siblings, served in the Armed Forces and, incident to such service, was killed, died as a result of wounds, accident, or disease, is in a captured or missing in action status, or is permanently disabled: (1) continued payment, through the original agreed-upon service period, of any bonus, incentive, or similar benefit to which the member was entitled during service; (2) separation pay, even though the member has completed less than six years of active service before discharge; (3) transitional health care, on the same basis as an active-duty member, for 180 days after discharge; (4) transitional commissary and exchange benefits, on the same basis as an active-duty member, for two years after discharge; (5) veterans' housing loan, employment and training, and basic educational assistance; (6) federal unemployment compensation; and (7) veteran's preference for federal employment purposes. Makes this Act effective with respect to any such discharge granted after September 11, 2001.

Post-9/11 Veterans Educational Assistance Act of 2008 - Amends federal veterans' benefits provisions to entitle to educational assistance under the Montgomery GI Bill individuals in certain length-of-service categories who, commencing on or after September 11, 2001, serve on active duty in the Armed Forces. Establishes the duration of such assistance (in most cases 36 months) and assistance amounts. Requires programs of education pursued with such assistance to be approved by the Secretary of Veterans Affairs. Allows for the pursuit of an approved program of education while on active duty. Allows, under such assistance, for the pursuit of: (1) programs on less than a half-time basis; (2) apprenticeship or other on-job training; (3) correspondence courses; (4) flight training; (5) tutorial assistance; and (6) licensure and certification tests. Makes individuals entitled to assistance under this Act also eligible for supplemental educational assistance for additional active duty service. Requires the Secretary to carry out a program, to be known as the "Yellow Ribbon G.I. Education Enhancement Program," under which colleges and universities may enter into an agreement with the Secretary to cover, for certain individuals, a portion of established charges not otherwise covered and match contributions toward such costs. Requires educational assistance under this Act to be used within 15 years of the individual's discharge or release from active duty (with exceptions). Allows individuals currently under the Montgomery GI Bill educational assistance program to elect to participate in the post-9/11 educational assistance program with respect to any unused entitlement.
