Law Enforcement Mental Health and Wellness Act of 2017 This bill directs the Department of Justice (DOJ) to report on Department of Defense and Department of Veterans Affairs mental health practices and services that could be adopted by law enforcement agencies. Additionally, DOJ's Office of Community Oriented Policing Services must report on programs to address the psychological health and well-being of law enforcement officers. The bill amends the Omnibus Crime Control and Safe Streets Act of 1968 to expand the allowable use of grant funds under the Community Oriented Policing Services (COPS) program to include establishing peer mentoring mental health and wellness pilot programs within state, local, and tribal law enforcement agencies. DOJ must coordinate with the Department of Health and Human Services to develop educational resources for mental health providers regarding the culture of law enforcement agencies and therapies for mental health issues common to law enforcement officers. DOJ must also: (1) review existing crisis hotlines, recommend improvements, and research annual mental health checks; (2) examine the mental health and wellness needs of federal officers; and (3) ensure that recommendations, resources, or programs under this bill protect the privacy of participating officers.

Frederick Douglass Trafficking Victims Prevention and Protection Reauthorization Act of 2017 This bill authorizes local educational agencies to establish programs to educate children on the dangers of severe forms of trafficking in persons. Diplomatic or consular posts shall designate an employee to receive information from any person who was a victim of a severe form of trafficking in persons while in the United States. The Department of Health and Human Services may carry out a Human Trafficking Victims Reintegration Through Employment Program. Department of Justice (DOJ) victim services grants may be used for programs that provide trauma-informed care or long-term housing for: (1) youth transitioning from foster care, and (2) women or girls in underserved populations. Airlines that contract with the federal government shall provide personnel with training in recognizing human trafficking incidents. Federal Acquisition Institute curricula for the acquisition workforce shall include a course on the law relating to human trafficking and government contracting. The United States Advisory Council on Human Trafficking Council is extended to September 30, 2020. The bill sets forth agency actions to prevent funding of human trafficking. DOJ law enforcement grants may be used to designate at least one prosecutor for cases of severe forms of trafficking in persons. Civil damages awarded in an action brought for slavery or trafficking in persons are excluded from gross income. The Secretary of the Treasury and the United States Trade Representative are included in the Interagency Task Force to Monitor and Combat Trafficking. The bill provides for transparency in U.S. Agency for International Development anti-trafficking expenditures. The bill authorizes appropriations through FY2021 for: (1) specified anti-trafficking programs and entities, and (2) U.S. Customs and Border Protection for on-site anti-trafficking training for airport and airline personnel.

Remote Transactions Parity Act of 201 7 This bill authorizes each member state under the Streamlined Sales and Use Tax Agreement (the multistate agreement for the administration and collection of sales and use taxes adopted on November 12, 2002) to require all remote sellers not qualifying for a small remote seller exception to collect and remit sales and use taxes with respect to remote sales under provisions of the agreement, but only if such agreement includes minimum simplification requirements relating to the administration of the tax, audits, and streamlined filing. States that have not adopted the agreement must adopt and implement minimum simplification requirements for the administration of sales and use taxes in order to require the collection of such taxes. Under the remote seller exception, a state may only require the collection of sales and use taxes by a remote seller if the seller: (1) has gross annual receipts exceeding specified amounts, which are phased in from $10 million for the first year following the effective date, to $5 million for the second year, and $1 million for the third year; or (2) utilizes an electronic marketplace for the purpose of making products or services available for sale to the public. The bill defines "remote sale" as a sale that originates in one state and is sourced to another state in which the seller would not legally be required to pay, collect, or remit state or local sales and use taxes without the authority provided by this bill. The bill also prohibits states from beginning to exercise the authority granted by this bill for a specified period after enactment.

Enhancing Credit Opportunities in Rural America Act of 2017 or the ECORA Act of 2017 This bill amends the Internal Revenue Code to exclude from gross income interest received by a lender from real estate loans secured by agricultural real estate or by a leasehold mortgage (with a status as a lien) on agricultural real estate. Agricultural real estate includes real property that is substantially used for the production of one or more agricultural products. It also includes any single family residence that is: (1) the principal residence of its occupant, (2) located in a rural area which is not within a Metropolitan Statistical Area and has a population of 2,500 or less; and (3) is purchased or improved with the proceeds of a loan secured by property used for the production of one or more agricultural products.

Unauthorized Spending Accountability Act of 2017 This bill establishes a three-year budgetary level reduction schedule with respect to unauthorized programs funded through the annual appropriations process. The term "budgetary level" refers to an allocation provided to the congressional appropriations committees under section 302(a) of the Congressional Budget Act of 1974 by a congressional budget resolution or a deeming resolution. The schedule applies to programs included in the Congressional Budget Office's annual report listing programs that are funded through the appropriations process and have an authorization of appropriations that has either expired or will expire during the year. For the first year after a program's authorization has expired, the bill requires the budgetary level to be reduced by 10% of the funds appropriated for the program in the expiring fiscal year. The bill then requires reductions of 15% in the second and third years before terminating the program at the end of the third unauthorized year. Programs that are reauthorized during the three-year period are exempt from the budgetary level reductions if the reauthorization contains a sunset provision limiting the authorization of appropriations period to no more than three years. The bill establishes the Spending and Accountability Commission to review all mandatory spending programs and submit to Congress a legislative proposal to establish an authorization cycle for discretionary spending programs. The commission may recommend legislation to replace the budgetary level reductions required by this bill with reductions in mandatory spending. The commission's reauthorization schedule must limit reauthorizations to three years, include the budgetary level reductions established by this bill, and establish a mechanism for replacing the budgetary level reductions with reductions to mandatory spending programs. The House of Representatives must consider the commission's proposal using specified expedited legislative procedures.

Promotion and Expansion of Private Employee Ownership Act of 201 7 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Protecting the Rights of IndiViduals Against Technological Exploitation Act or the PRIVATE Act This bill amends the Uniform Code of Military Justice to prohibit a person from knowingly and wrongfully broadcasting or distributing an intimate visual image of a private area of another individual who is at least 18 years old, who is identifiable from the image or from information displayed in connection with the image, and who does not explicitly consent, if the person knows or reasonably should have known that: the image was made under circumstances in which the individual depicted retained a reasonable expectation of privacy regarding any broadcast or distribution of such image; and the broadcast or distribution of the intimate visual image is likely to cause harm, harassment, intimidation, emotional distress, or financial loss for the individual depicted or to harm substantially the depicted individual's health, safety, business, calling, career, financial condition, reputation, or personal relationships. The perpetrator of such offense is guilty of wrongful distribution of intimate visual images and shall by punished as a court-martial may direct.

Strengthen Employment And Seasonal Opportunities Now (SEASON) Act This bill amends the Immigration and Nationality Act to provide, effective as if enacted on January 1, 2017, that a returning H-2B visa alien (temporary nonagricultural worker) who has already been counted toward the applicable numerical limitation during a fiscal year: (1) shall not again be counted toward such limitation during each succeeding consecutive fiscal year in which the alien is issued an H-2B visa or otherwise provided such status, but (2) shall be considered a returning worker. "Other temporary service or labor" for H-2B purposes means that an employer's need for labor will not exceed 1 year and is a seasonal (not to exceed 10 months), peak load, or intermittent need, unless it is a one-time occurrence not exceeding 3 years. An H-2B employer shall file an employee petition with the Department of Homeland Security. Additional filings with the Department of Labor are not required. H-2B employer requirements are set forth regarding: (1) petitions, (2) admissions and maximum stay in status, (3) housing, (4) enforcement, (5) transportation, (6) recruitment, (7) U.S. worker protections, and (8) wages. An H-2B worker shall not be entitled to: (1) tax credit assistance for a qualified health plan, and shall be subject to plan rules applicable to individuals not lawfully present in the United States; (2) the child tax credit; and (3) the earned income tax credit.

Workplace Advancement Act This bill amends the Fair Labor Standards Act of 1938 to prohibit discharging or retaliating against any employee because such employee has inquired about, discussed, or disclosed comparative compensation information for the purpose of determining whether the employer is compensating an employee in a manner that provides equal pay for equal work. The prohibition does not apply to instances in which an employee who has access to the wage information of other employees as a part of the employee's job functions discloses such wages to an individual who has no access to them, except in response to a charge or complaint or in furtherance of an investigation, proceeding, hearing, or action with respect to prohibited sex discrimination, including an investigation conducted by the employer. It is the sense of Congress that: (1) gender-based discrimination in wages or compensation violates existing law, and (2) Congress recommits itself to the principles of equal pay for equal work.

Allow States and Victims to Fight Online Sex Trafficking Act of 2017 This bill amends the Communications Act of 1934 to specify that communications decency provisions protecting providers or users of interactive computer services from liability for the private blocking or screening of offensive material shall not be construed to impair the enforcement of, or limit availability of victim restitution or civil remedies under, state or federal criminal or civil laws relating to sexual exploitation of children or sex trafficking. The bill amends the federal criminal code to specify that the violation for benefiting from "participation in a venture" engaged in sex trafficking of children, or by force, fraud, or coercion, includes knowing or reckless conduct by any person or entity and by any means that furthers or in any way aids or abets the violation. A provider of an interactive computer service that publishes information provided by an information content provider with reckless disregard that the information is in furtherance of a sex trafficking offense shall be subject to a criminal fine or imprisonment for not more than 20 years.

Ambulatory Surgical Center Quality and Access Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to: (1) require the payment system for ambulatory surgical center (ASC) services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revise quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) require the Department of Health and Human Services (HHS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, HHS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.)

Rural Access to Hospice Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to allow payment under Medicare for certain services furnished to hospice patients by rural health clinics and federally qualified health centers (FQHCs). With respect to a patient who elects to receive hospice care under Medicare, current law generally limits payment for services that are either duplicative of such care or related to the treatment of the individual's terminal illness. However, current law exempts from this limitation: (1) physicians' services furnished by an attending physician not employed by the hospice program; and (2) services provided or arranged by the hospice program. The bill expands this exemption with regard to rural health clinic and FQHC services. Specifically, the payment limitation shall not apply to such services that: (1) would otherwise be physicians' services if furnished by an individual unaffiliated with a rural health clinic or FQHC; and (2) are either arranged by the hospice program or furnished by an attending physician not employed by the hospice program.

Prevent All Soring Tactics Act of 2017 or the PAST Act This bill amends the Horse Protection Act to establish a new system for inspecting horses for soring, revise penalties for violations of the Act, and modify enforcement procedures. The soring of horses is any of various actions taken on a horse's limb to produce a higher gait that may cause pain, distress, inflammation, or lameness. The Department of Agriculture (USDA) must establish requirements to license, train, assign, and oversee persons hired by the management of horse shows, exhibitions, sales, or auctions to detect and diagnose sore horses. A license may not be issued to a person with conflicts of interest, and USDA must give preference to veterinarians. USDA may revoke a license for unsatisfactory performance. USDA must assign licensed inspectors after receiving notice that management intends to hire the inspectors. An inspector must issue a citation for violations and notify USDA of violations. USDA must publish information on violations of this bill and disqualify a horse that is sore. The bill prohibits a person in any horse show, exhibition, sale, or auction from causing or directing a horse to become sore for the purpose of showing, exhibiting, selling, or auctioning the horse. The bill prohibits the use of specified devices on a Tennessee Walking, a Racking, or a Spotted Saddle horse at a show, exhibition, sale, or auction. The bill increases the maximum criminal and civil liability penalties for certain violations. USDA may disqualify violators from specified activities related to horse shows, exhibitions, sales, and auctions.

This bill revises provisions concerning military technicians (dual status), including by: (1) transferring authority to issue regulations regarding the employment, use, and status of such technicians from the Departments of the Army and the Air Force to the Department of Defense (DOD); and (2) requiring that such individuals be outside the competitive service and be appointed and administered by an adjutant general. An individual who becomes employed as such a technician while already a member of a reserve component of the armed forces shall not have to repay any enlistment, reenlistment, or affiliation bonus provided before such employment. The bill: (1) makes such technicians eligible for TRICARE, and (2) sets forth FY2018 end strengths for the Army National Guard and the Air National Guard. The National Defense Authorization Act for Fiscal Year 2016 is amended to reduce from 20% to 4.8% the percentage of technician positions filled in administration, clerical, finance, and office service occupations as of October 1, 2017, that DOD must convert to civilian positions. A governor or the commanding general of the District of Columbia National Guard may order a member of the National Guard to perform active Guard and Reserve duty in support of state missions. Farmers Undertake Environmental Land Stewardship Act or the FUELS Act This bill amends the Water Resources Reform and Development Act of 2014 to require the Environmental Protection Agency, in implementing the Spill Prevention, Control, and Countermeasure rule (concerning oil pollution prevention) with respect to any farm, to: require certification by a professional engineer for a farm with an aggregate aboveground storage capacity of more than 42,000 gallons (currently, 20,000 gallons); allow self-certification by the owner or operator of a farm with an aggregate aboveground storage capacity of more than 10,000 gallons but less than 42,000 gallons (currently, of less than 20,000 gallons and more than the lesser of 6,000 gallons and the adjustment quantity established under such Act); and not require compliance with the rule by any farm with an aggregate aboveground storage capacity of 10,000 gallons or less (currently, of more than 2,500 gallons and less than the lesser of 6,000 gallons and such adjustment quantity). The rule shall apply to aboveground storage containers at farms on a separate parcel that have an individual capacity of not more than 1,320 gallons (currently, 1,000 gallons) and an aggregate capacity of not more than 3,000 gallons (currently, 2,500 gallons).

Israel Anti-Boycott Act

Israel Anti-Boycott Act This bill declares that Congress: (1) opposes the United Nations Human Rights Council resolution of March 24, 2016, which urges countries to pressure companies to divest from, or break contracts with, Israel; and (2) encourages full implementation of the United States-Israel Strategic Partnership Act of 2014 through enhanced, governmentwide, coordinated U.S.-Israel scientific and technological cooperation in civilian areas. The bill amends the Export Administration Act of 1979 to declare that it shall be U.S. policy to oppose: requests by foreign countries to impose restrictive practices or boycotts against other countries friendly to the United States or against U.S. persons; and restrictive trade practices or boycotts fostered or imposed by an international governmental organization, or requests to impose such practices or boycotts, against Israel. The bill prohibits any U.S. person engaged interstate or foreign commerce from supporting: any request by a foreign country to impose any boycott against a country that is friendly to the United States and that is not itself the object of any form of boycott pursuant to United States law or regulation, or any boycott fostered or imposed by any international governmental organization against Israel or any request by any international governmental organization to impose such a boycott. The bill amends the Export-Import Bank Act of 1945 to include as a reason for the Export-Import Bank to deny credit applications for the export of goods and services between the United States and foreign countries, opposition to policies and actions that are politically motivated and are intended to penalize or otherwise limit commercial relations specifically with citizens or residents of Israel, entities organized under the laws of Israel, or the government of Israel.

Iran Ballistic Missiles and International Sanctions Enforcement Act This bill states that it is U.S. policy to prevent Iran from undertaking any activity related to nuclear-capable ballistic missiles. The President shall report to Congress regarding the foreign and domestic supply chain in Iran that supports Iran's ballistic missile program. The report shall identify individuals and companies involved in such activities. The President shall submit to Congress a determination of whether any Iranian ballistic missile test violates United Nations Security Council Resolution 2231. Such resolution endorses the Joint Comprehensive Plan of Action and sets out a mechanism to monitor Iranian compliance. The President shall impose sanctions against: (1) Iranian government agencies involved in ballistic missile development; (2) foreign entities that supply material for, or otherwise facilitate or finance, such efforts; (3) foreign persons or foreign government agencies that import, export, or re-export prohibited arms or related material to or from Iran; and (4) foreign persons or entities that transfer goods or technologies contributing to Iran's ability to acquire or develop ballistic missiles, including launch technology, and destabilizing numbers and types of advanced conventional weapons. The President shall investigate potential violations of ballistic missile and conventional weapons sanctions against Iran. The President shall report to Congress regarding credible information about Iran's violations of arms restrictions and attempts to pursue sanctionable activities.

Palliative Care and Hospice Education and Training Act

Palliative Care and Hospice Education and Training Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to provide support for Palliative Care and Hospice Education Centers. These centers must improve the training of health professionals in palliative care and establish traineeships for individuals preparing for advanced education nursing degrees, social work degrees, or advanced degrees in physician assistant studies in palliative care. HHS may provide support to schools of medicine, schools of osteopathic medicine, teaching hospitals, and graduate medical education programs for training physicians who plan to teach palliative medicine. HHS must: (1) provide Palliative Medicine and Hospice Academic Career Awards to individuals to promote their career development; (2) support entities that operate a Palliative Care and Hospice Education Center; (3) support advanced practice nurses, social workers, physician assistants, pharmacists, chaplains, or students of psychology pursuing an advanced degree in palliative care or related fields; and (4) award grants to schools of nursing, health care facilities, or programs leading to certification as a nurse assistant to train individuals in providing palliative care. The Agency for Healthcare Research and Quality must provide for a national education and awareness campaign to inform patients, families, and health professionals about the benefits of palliative care. The National Institutes of Health must expand national research programs in palliative care.

Affordable Housing Credit Improvement Act of 2017 This bill amends the Internal Revenue Code, with respect to the low-income housing credit, to rename the credit "the affordable housing credit" and make several modifications to the credit. The bill revises tenant eligibility requirements, with respect to: the average income test, income eligibility for rural projects, increased tenant income, student occupancy rules, and tenant voucher payments that are taken into account as rent. The bill revises various requirements to: establish a 4% minimum credit rate for certain projects, permit relocation costs to be taken into account as rehabilitation expenditures, repeal the qualified census tract population cap, require housing credit agencies to make certain determinations regarding community revitalization plans, prohibit local approval and contribution requirements, increase the credit for certain projects designated to serve extremely low-income households, increase the credit for certain bond-financed projects designated by state agencies, increase the population cap for difficult development areas, and eliminate the basis reduction for a property that receives the tax credit for investments in energy property if the affordable housing credit is allowed for the property. The bill also modifies requirements regarding the reconstruction or replacement period after a casualty loss, rights related to building purchases, the prohibition on claiming acquisition credits for properties placed in service in the previous 10 years, foreclosures, and projects that assist Native Americans.
