Fair Elections Now Act

Fair Elections Now Act - Amends the Federal Election Campaign Act of 1971 (FECA) with respect to: (1) candidate benefits of fair elections financing of House of Representatives election campaigns; (2) allocations to candidates from the Fair Elections Fund established by this Act; (3) 500% matching payments to candidates for certain small dollar contributions; (4) Fund allocation eligibility requirements; (5) certification of a federal election candidate as a participating candidate; (6) contribution, expenditure, and fundraising requirements; (7) a public debate requirement; (8) remission to the Fair Elections Fund of unspent funds after an election; (9) establishment of the Fair Elections Fund and of a Fair Elections Oversight Board; (10) civil penalties for violation of contribution and expenditure requirements; and (11) transfer of a portion of collected civil money penalties into the Fair Elections Fund. Prohibits: (1) use of contributions by a participating candidate for any purposes other than an election campaign, and (2) establishment of joint fundraising committees with any political committee other than a candidate's authorized committee. Prescribes a limitation on coordinated expenditures by political party committees with participating candidates. Amends FECA to empower the Federal Election Commission (FEC) to petition the U.S. Supreme Court for a writ of certiorari to appeal a civil action. Requires all designations, statements, and reports required to be filed under FECA to be filed: (1) directly with the FEC, and (2) in electronic form accessible by computers. Reduces from 48 hours to 24 hours after their receipt the deadline for the FEC to make designations, statements, reports, or notifications available to the public in the FEC office and on the Internet.

New Alternative Transportation to Give Americans Solutions Act of 2011 - Amends the Internal Revenue Code to: (1) allow an excise tax credit through 2016 for alternative fuels and fuel mixtures involving compressed or liquefied natural gas; (2) allow an income tax credit through 2016 for alternative fuel motor vehicles powered by compressed or liquefied natural gas and make Indian tribal governments eligible for such credit; (3) modify the tax credit percentage for alternative fuel vehicles fueled by natural gas or liquefied natural gas; (4) allow a new tax credit for the production of vehicles fueled by natural gas or liquefied natural gas; and (5) extend through 2016 the tax credit for alternative fuel vehicle refueling property expenditures for refueling property relating to compressed or liquefied natural gas and allow an increased credit for such property. Requires the Secretary of Energy to provide funding to improve the performance, efficiency, and integration of natural gas powered motor vehicles and heavy-duty on-road vehicles. Authorizes the Secretary to make grants to manufacturers of light and heavy duty natural gas vehicles for the development of engines that reduce emissions, improve performance and efficiency, and lower cost. Expresses the sense of Congress that the Environmental Protection Agency (EPA) should streamline the process for certification of natural gas vehicle retrofit kits to promote energy security and provide incentives to encourage and reward manufacturers who produce natural gas powered vehicles. Amends the Energy Policy Act of 1992 to allocate funds for vehicles that are repowered or converted to operate on an alternative fuel.

National Manufacturing Strategy Act of 2011 - Expresses the sense of Congress that: (1) the U.S. government should promote policies related to the nation's manufacturing sector intended to promote growth, sustainability, and competitiveness, create well-paying jobs, enable innovation and investment, and support national security; and (2) the President and Congress should act promptly to pursue policies consistent with a National Manufacturing Strategy (Strategy). Directs the President, every four years, to submit to Congress, and publish on a public website, a Strategy. Directs the President to establish the President's Manufacturing Strategy Board to: (1) advise the President and Congress on issues affecting the nation's manufacturing sector; (2) conduct a comprehensive analysis of such sector; (3) develop a Strategy; and (4) report annually to the President and Congress on the current state of U.S. manufacturing. Directs the Comptroller General, in each of 2013, 2017, and 2021, to submit to Congress an assessment and analysis of the Strategy. Directs the President, in developing each Strategy, to enter into an agreement with the National Academy of Sciences (NAS) to conduct a study concerning U.S. manufacturing and related assessments and reviews. Requires the NAS to report each study's results to Congress and the President. Requires the President, in preparing each annual budget, to include information regarding that budget's consistency with the goals and recommendations included in the latest Strategy.

American Jobs Matter Act of 2011 - Requires an executive agency to state in a solicitation for competitive proposals that the agency may consider information that the offeror may include on the effects awarding the contract to the offeror would have on employment within the United States (jobs impact statement). Allows such statement to include a guarantee that jobs created or retained in the United States will not be moved outside the United States after award of the contract. Requires each agency to: (1) assess, annually, the accuracy of such a statement submitted by an offeror awarded a contract; (2) submit an annual report on the frequency of use of such statements in evaluating competitive proposals; and (3) track the number of jobs created or retained during the performance of a contract awarded to an offeror that submitted such a statement. Authorizes an agency to evaluate whether a contractor should be proposed for debarment if the number of jobs that the agency estimates will be created based on such statement significantly exceeds the number created or retained. Sets forth analogous provisions for defense contracts. Requires revision of the Federal Acquisition Regulation to implement the amendments made by this Act.

United States Postal Service Pension Obligation Recalculation and Restoration Act of 2011 - Prescribes the "average pay" and the appropriate percentage thereof to be used in determining annuities for civilian employment with the United States Postal Service (USPS) for purposes of provisions relating to future benefits attributable to such employment in order to calculate the amount of any USPS surplus or supplemental liability under the Civil Service Retirement System. Requires the Office of Personnel Management (OPM): (1) within six months after enactment of this Act, to determine (or, if applicable, redetermine) the amount of such surplus or liability as of the close of the most recently ending fiscal year using the methodology required under this Act; and (2) if the result is a surplus, to transfer the surplus amount to the Postal Service Retiree Health Benefits Fund within 15 days after the determination of a surplus. Provides for an alternate determination of an USPS surplus or supplemental liability for FY2016-FY2020. Requires transfer of certain surplus postal retirement contributions in FY2011 to the Postal Service Retiree Health Benefits Fund or the Employees' Compensation Fund under the Federal Employees' Compensation Act (FECA). Expresses the intent of Congress that this Act shall apply to allocations of past, present, and future benefit liabilities between the USPS and the Treasury.

Prohibits group health plans from reducing retiree health benefits after the retirement of a plan beneficiary. Requires such plans to adopt provisions barring post-retirement reductions in retiree health benefits. Requires group health plan sponsors to grant benefit restoration to retired plan participants. Authorizes the Secretary of Labor to waive or vary requirements for benefit restoration if compliance with such requirements would: (1) be adverse to the interests of plan participants in the aggregate, (2) not be administratively feasible, and (3) cause substantial business hardship to plan sponsors. Authorizes the Secretary to assess civil penalties for violations of this Act.

Repeals also the windfall elimination requirement with respect to computation of an individual's primary insurance amount under which OASDI retirement or disability benefits are reduced if the individual receives a federal, state, or local government pension, did not pay Social Security taxes during the years of government service, and so did not earn entitlement to Social Security benefits for those years.

Repeals provisions of the Patient Protection and Affordable Care Act (PPACA) and the Health Care and Education Reconciliation Act of 2010 related to: (1) the disproportionate share hospital (DSH) allotment for Tennessee and Hawaii; (2) an adjustment to the federal medical assistance percentage (FMAP) for qualifying disaster-recovery states; (3) the establishment of a floor on the area wage index for a frontier state for purposes of a geographic adjustment to Medicare payments to hospitals for inpatient services; (4) the eligibility for Medicare coverage of certain individuals exposed to environmental health hazards; and (5) the appropriation of funds for debt service on, or direct construction or renovation of, a health care facility that provides research, inpatient, tertiary care, or outpatient clinical service. Amends PPACA to eliminate revisions to the formula for determining the wage index applicable to Section 508 hospitals. (Section 508 of the Medicare Modernization Act of 2003 allows the temporary reclassification of a hospital with a low Medicare area wage index to a nearby location with a higher index so that the hospital will receive the higher Medicare reimbursement rate.) Makes this Act effective as if it were included in PPACA or, if applicable, the Health Care and Education Reconciliation Act of 2010.

Imposes the same restrictions on the President with respect to receiving a disbursement of basic pay during such period.

Reform the Postal Service for the 21st Century Act - Urges the Postal Service to consider: (1) a simplified rate structure for election ballots sent by voters; (2) creating a Forever Box for customers to mail parcels of a certain size, analogous to the Forever Stamp; and (3) establishing and marketing packages of postal services and products. Requires the Postal Service to implement a plan to replace or convert, by January 1, 2017, 2,000 gasoline-powered delivery vehicles with electric vehicles manufactured in the United States. Authorizes the Post Service to: (1) borrow money and issue obligations as necessary to carry out such plan or to help finance energy efficiency projects for operations and facilities; and (2) use its capabilities, including its vehicles, to provide services, other than postal services, to generate revenue if providing such service is consistent with the public interest. Requires the Postal Service to submit a plan on the co-location of post offices at retail facilities while ensuring continued service to small communities and rural areas. Allows wine or malt beverages to be mailed by a licensed winery or brewery for direct delivery by the Postal Service to an addressee who is at least 21 years of age. Requires the Postal Service to study and report on: (1) ways to promote the use of transpromotional mailings (from more than one source) and consolidated mailings (from more than one agency), and (2) the costs to executive agencies of sending mail by using the Postal Service compared to other carriers. Authorizes the Postal Service to: (1) enter arrangements whereby the sender may defer payment of postage until the item has been delivered; (2) promote the creation of mailing pools to allow members to take advantage of postage rates applicable to bulk mailings and other discounts; and (3) carry out a pilot program to test an integrated electronic system for the receipt, storage, transport, and delivery of mail directed to physical addresses and post office boxes. Establishes an advocate for competition in the Postal Service and the Postal Regulatory Commission. Requires the Postmaster General and the Commission to issue a policy on contracting officer delegations of authority. Sets forth provisions concerning postal contracts, including requirements for: (1) posting justifications of noncompetitive contracts, and (2) a review of ethical issues relating to proposed contracts. Requires the Postal Service to: (1) publish notice and provide a period for public comment before adding, eliminating, or modifying any mailing rules; and (2) report on implementing special classifications and service agreements in connection with the establishment and operation of a system for regulating rates and classes for market-dominant products. Requires the Postal Service and the Commission to report on creating a not-for-profit venture capital program to help the Postal Service identify and develop electronic communication products that would increase net revenue.

Recognizes the right of the qualified Native Hawaiian constituents to reorganize the single Native Hawaiian governing entity to provide for their common welfare and to adopt appropriate organic governing documents. Establishes a Commission to: (1) prepare and maintain a roll of such constituents, and (2) certify that individuals on the roll meet the definition of qualified Native Hawaiian. Outlines the process for the reorganization, which includes forming a Native Hawaiian Interim Governing Council. Reaffirms the special political and legal relationship between the United States and the Native Hawaiian people upon the Secretary's approval of the organic governing documents and the installation of officers elected to the Native Hawaiian governing entity. Extends federal recognition to the governing entity as the representative sovereign governing body of the Native Hawaiian people. Authorizes the United States, upon the reaffirmation of such political and legal relationship, together with the state of Hawaii, to enter into negotiations with the governing entity for an agreement addressing matters that include: (1) land, natural resource, and asset transfers; (2) governing powers and responsibilities; and (3) grievances. Prohibits Native Hawaiians or their governing entity from conducting gaming activities as a matter of claimed inherent authority or under the authority of federal law.

Congressional Made in America Promise Act of 2011 - Amends the Buy American Act to apply Buy American requirements to articles, materials, and supplies acquired for the use of any legislative branch office, including the House of Representatives and the Senate, in the same manner as the Act applies with respect to articles, materials, and supplies acquired for the use of a department or independent establishment. Prescribes a special rule in the case of any product which bears an official congressional insignia (including a mark resembling an official seal) that is acquired for the use of a legislative branch office. Prohibits the head of such office from making a determination under the Act that it is inconsistent with the public interest to enter into a contract in accordance with the Act. Makes inapplicable to products with an official congressional insignia the exceptions to the Buy American rule for: (1) articles, materials, or supplies not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities and of satisfactory quality; or (2) manufactured articles, materials, or supplies procured under any contract the award value of which is less than or equal to the micro-purchase threshold. (Thus applies the Buy American rule to any legislative branch office purchase of products with an official congressional insignia, without exception.)

Requires the Secretary of Health and Human Services (HHS), when a state requests an adjustment of a medical-loss ratio, to defer to the state's findings and determinations as to whether enforcing the required medical-loss ratio may destabilize the individual or small group markets for health insurance.

Stop Trading on Congressional Knowledge Act - Amends the Securities Exchange Act of 1934 and the Commodity Exchange Act to direct both the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) to prohibit purchase or sale of either securities, security-based swaps, or commodities for future delivery or swap by a person in possession of material nonpublic information regarding pending or prospective legislative action if the information was obtained: (1) knowingly from a Member or employee of Congress, (2) by reason of being a Member or employee of Congress, or (3) from other federal employees and derived from their federal employment. Amends the Code of Official Conduct of the Rules of the House of Representatives to prohibit any Member, officer, or employee of the House from disclosing material nonpublic information relating to any pending or prospective legislative action relating to any publicly-traded company or to any commodity if such person has reason to believe that the information will be used to buy or sell the securities of that publicly traded company or that commodity for future delivery based on such information. Directs both the Committee on Agriculture and the Committee on Financial Services of the House of Representatives to hold hearings on the implementation by the CFTC and the SEC of such financial transaction prohibitions. Amends the Ethics in Government Act of 1978 to require formal disclosure of certain securities and commodities futures transactions to either the Clerk of the House of Representatives or the Secretary of the Senate. Amends the Lobbying Disclosure Act of 1995 to subject to its registration, reporting, and disclosure requirements, as well as requirements for identification of clients and covered legislative and executive officials, all political intelligence activities, contacts, firms, and consultants. Requires the Comptroller General to include political intelligence activities, contacts, firms, and consultants in its annual compliance audits and reports.

National Language Act of 2011 - Makes English the official language of the U.S. government. Requires the government to: (1) conduct its official business in English, including publications, income tax forms, and informational materials; and (2) preserve and enhance the role of English as the official language of the United States. Provides that no person has a right, entitlement, or claim to have the government act, communicate, perform, or provide services or materials in any other language, unless specifically stated in applicable law. Provides that this Act is inapplicable to the use of a language other than English for religious purposes, for training in foreign languages for international communication, or in school programs designed to encourage students to learn foreign languages. Allows the U.S. government to provide interpreters for persons over age 62. Repeals provisions of the Voting Rights Act of 1965 regarding bilingual election requirements and regarding congressional findings of voting discrimination against language minorities, prohibition of English-only elections, and other remedial measures. Amends the Immigration and Nationality Act to require that all public ceremonies in which the oath of allegiance is administered pursuant to such Act be conducted solely in English. Prohibits this Act from preempting any state law.

Amends the Wilson Act to eliminate the requirement that a state or territory regulate all fermented, distilled, or other intoxicating liquors or liquids transported into such jurisdiction to the same extent and in the same manner as such liquors or liquids produced in such jurisdiction.

GSE Bailout Elimination and Taxpayer Protection Act - Sets a deadline for the Director of the Federal Housing Finance Agency (FHFA) to terminate the conservatorship of either the Federal National Mortgage Association (Fannie Mae) or the Federal Home Loan Mortgage Corporation (Freddie Mac) if the Director determines that it is financially viable. (Refers to both Fannie Mae and Freddie Mac as enterprises [government-sponsored enterprises, or GSEs].) Requires the Director to appoint the FHFA immediately as receiver of either enterprise if it is found not to be financially viable. Amends the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (FHEFSSA) to repeal: (1) its housing goals, and (2) the housing trust fund. Amends the Housing and Community Development Act of 1992 to restrict the authority of an enterprise to acquire mortgage assets following its emergence from conservatorship. Repeals certain temporary, general, and permanent high-cost area increases to conforming loan limits. Establishes new conforming loan limits. Amends FHEFSSA to require the Director to require each enterprise to charge a guarantee fee, in connection with any mortrgage guaranteed after a specified three-year period, in an amount equivalent to that which the enterprise would charge if it were held to the same capital standards as private banks or financial institutions. Amends the Federal National Mortgage Association Charter Act (FNMACA) and the Federal Home Loan Mortgage Corporation Act (FHLMCA) to prohibit reduction in the rate of dividends paid on each enterprise's Variable Liquidation Preference Senior Preferred Stock. Amends FHEFSSA to require the Director to establish minimum levels of capital for the enterprises, including levels in excess of such minimums as necessary or appropriate in light of an enterprise's particular circumstances. Authorizes the Director to deem failure of an enterprise to maintain revised minimum capital levels to constitute an unsafe and unsound condition. Amends FNMACA and FHLMCA to: (1) prohibit the enterprises from purchasing mortgages if the mortgagor has paid less than the specified minimum downpayment; and (2) require the enterprises to pay state and local taxes. Repeals the exemption of mortgage-backed securities and subordinate obligations of Fannie Mae, as well as mortgage-backed securities of Freddie Mac, from regulation by the Securities and Exchange Commission (SEC), thus subjecting such securities and obligations to SEC regulation. Prescribes a deadline and procedures for the wind down of operations and dissolution of an enterprise three years after enactment of this Act.

Welfare Reform Act of 2011 - Welfare Reform Restoration Act - Amends part A (Temporary Assistance for Needy Families) (TANF) of title IV of the Social Security Act to revise the TANF program by: (1) eliminating the temporary modification of the caseload reduction credit, and (2) reducing funding of state family assistance grants. Amends the Food and Nutrition Act of 2008 to: (1) restore its former name, the Food Stamp Act of 1977, and restore its text as if the Food, Conservation, and Energy Act of 2008 had not been enacted; (2) rename supplemental nutrition assistance program benefits as the food stamp program; (3) revise work requirements for the food stamp program; and (4) require able-bodied work eligible adult members of a family unit to participate in a work activation program during a full month of participation in the food stamp program, fulfilling specified levels of work activity during that month. (Work activation means, not employment, but supervised job search, community service activities, education and job training, workfare, or drug and alcohol treatment.) Specifies a financial reward for any state that reduces its food stamp caseload below calendar 2006 levels. Requires the President to include means-tested welfare spending in every budget submission. Amends the Congressional Budget and Impoundment Control Act of 1974 and the Congressional Budget Act of 1974 to define and establish an aggregate cap for means-tested welfare spending. Directs the Secretary of Health and Human Services (HHS) to provide grants to states to reward reductions in poverty and government dependence and increases in self-sufficiency. Prohibits the expenditure for abortions, with certain exceptions, of any funds authorized or appropriated by federal law, and funds in any trust fund to which funds are authorized or appropriated by federal law. Prohibits funding for health benefits plans that cover abortion. Prohibits the allowance of any tax credit with respect to amounts paid or incurred for an abortion or with respect to amounts paid or incurred for a health benefits plan (including premium assistance) that includes coverage of abortion.

Respect for Rights of Conscience Act of 2011 - Amends the Patient Protection and Affordable Care Act (PPACA) to permit a health plan to decline coverage of specific items and services that are contrary to the religious beliefs of the sponsor, issuer, or other entity offering the plan or the purchaser or beneficiary (in the case of individual coverage) without penalty.  Declares that such plans are still considered to: (1) be providing the essential health benefits package or preventive health services, (2) be a qualified health plan, and (3) have fulfilled other requirements under PPACA. Declares that nothing in PPACA shall be construed to authorize a health plan to require a provider to provide, participate in, or refer for a specific item or service contrary to the provider's religious beliefs or moral convictions. Prohibits a health plan from being considered to have failed to provide timely or other access to items or services or to fulfill any other requirement under PPACA because it has respected the rights of conscience of such a provider. Prohibits an American Health Benefit Exchange (a state health insurance exchange) or other official or entity acting in a governmental capacity in the course of implementing PPACA from discriminating against a health plan, plan sponsor, health care provider, or other person because of an unwillingness to provide coverage of, participate in, or refer for, specific items or services. Creates a private cause of action for the protection of individual rights created under this Act. Authorizes any person or entity to assert a violation of this Act as a claim or defense in a judicial proceeding. Designates the Office for Civil Rights of the Department of Health and Human Services (HHS) to receive and investigate complaints of discrimination based on this Act. Makes this Act effective as if it were included in PPACA.

Reestablishes the NARAB without contingent conditions as a nonprofit corporation to prescribe, on a multi-state basis, licensing and insurance producer qualification requirements and conditions. Retains states' regulatory authority over: (1) licensing, supervision, disciplining, and setting of licensing fees for insurance producers; and (2) insurance-related consumer protection and unfair trade practices. Prohibits NARAB from establishing criteria that unfairly limit the ability of a small insurance producer to become a member of NARAB. Authorizes NARAB to: (1) establish membership criteria, including a mandatory criminal background check for state-licensed insurance producers, and (2) deny membership to a state-licensed insurance producer on the basis of the criminal history information obtained. Authorizes the NARAB to deny membership to any state-licensed insurance producer for failure to meet membership criteria. States that NARAB membership authorizes an insurance producer to engage in the business of insurance in any state for any lines of insurance specified in the producer's home state license, including claims adjustments and settlement, risk management, and specified insurance-related consulting activities. Retains state regulatory jurisdiction regarding consumer protection and market conduct. Requires NARAB to: (1) receive and investigate consumer complaints, maintaining a toll-free telephone number; and (2) refer any such complaint to the state insurance regulator. Authorizes the NARAB to coordinate with state insurance regulators to establish: (1) a central clearinghouse, and (2) a national database for the collection of regulatory information concerning the activities of insurance producers.

Prohibits an increase after: (1) April 1, 2006, in a premium, deductible, copayment, or other charge prescribed by the Secretary of Defense for medical and dental health care coverage for military personnel; and (2) September 30, 2011, in the dollar amount of a cost-sharing requirement under the DOD pharmacy benefits program. Prohibits: (1) charges for DOD inpatient care from exceeding $535 per day; and (2) beginning on October 1, 2011, an increase in premiums under TRICARE (a DOD managed health care program) for certain members of the Selected Reserve and Retired Reserve.

Bureau of Alcohol, Tobacco, Firearms, and Explosives Reform Act of 2011 - Amends the federal criminal code to revise the civil penalties for violations of firearms law and the procedures for assessing such penalties. Requires fines to be based upon the nature and severity of the violation, the size of the firearms business involved, and the prior record of the firearm's licensee. Prohibits consideration of the amount of fines or license revocations imposed by agents of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) in the retention, promotion, or transfer of such agents. Revises the definition of "willfully" for purposes of firearms violations and standards for criminal violations of firearms recordkeeping requirements. Declares that repetition of a recordkeeping violation, regardless of frequency, shall not be considered evidence that the licensee committed the violation knowingly and in intentional disregard of a legal duty. Requires the Attorney General to: (1) make preliminary determinations on firearms license applications and notify applicants in writing of a proposed denial; and (2) establish guidelines for ATF inspections, examinations, or investigations of possible firearms violations. Permits an owner of a firearms business whose license is expired, surrendered, or revoked 60 days to liquidate inventory. Allows purchasers of existing firearms businesses the right to cure firearms violations attributable to such businesses. Allows the transfer, possession, and importation of machineguns for industry testing, research and training, national security services, and motion picture or television production. Eliminates the requirement of written permission for the use of a handgun for lawful purposes by a minor (under age 18) where a parent or legal guardian is present at all times during such use. Revises firearms licensee recordkeeping requirements, including by prohibiting: (1) the Attorney General from electronically recording firearms transaction information of a discontinued firearms or ammunition business by name or personal identification code; and (2) any rule or regulation or administration action from establishing any comprehensive or partial system of registration of firearms, firearms owners, or firearms transactions or dispositions. Directs the Attorney General to authorize the importation of all frames or receivers of rifles, or barrels for firearms other than handguns, if the importation is for repair or replacement purposes.
