Amends the Missing Children's Assistance Act to include within the definition of "missing child" a child (less than 18 years of age) whose whereabouts are known to the child's legal custodian from whose control such child: (1) was removed in violation of law; or (2) is believed by such custodian to have been taken out of the Untied States without the consent of such custodian by, or for the benefit of, an individual who may possibly claim custodial rights with respect to such child.

Post-9/11 Veterans Educational Assistance Act of 2008 - Amends federal veterans' benefits provisions to entitle to educational assistance under the Montgomery GI Bill individuals in certain length-of-service categories who, commencing on or after September 11, 2001, serve on active duty in the Armed Forces. Establishes the duration of such assistance (in most cases 36 months) and assistance amounts. Requires programs of education pursued with such assistance to be approved by the Secretary of Veterans Affairs. Allows for the pursuit of an approved program of education while on active duty. Allows, under such assistance, for the pursuit of: (1) programs on less than a half-time basis; (2) apprenticeship or other on-job training; (3) correspondence courses; (4) flight training; (5) tutorial assistance; and (6) licensure and certification tests. Makes individuals entitled to assistance under this Act also eligible for supplemental educational assistance for additional active duty service. Requires the Secretary to carry out a program, to be known as the "Yellow Ribbon G.I. Education Enhancement Program," under which colleges and universities may enter into an agreement with the Secretary to cover, for certain individuals, a portion of established charges not otherwise covered and match contributions toward such costs. Requires educational assistance under this Act to be used within 15 years of the individual's discharge or release from active duty (with exceptions). Allows individuals currently under the Montgomery GI Bill educational assistance program to elect to participate in the post-9/11 educational assistance program with respect to any unused entitlement.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Child Protection Improvements Act of 2008 - Amends the National Child Protection Act of 1993 to direct the Attorney General to provide for a program for national criminal history background checks for child-serving organizations. Amends the PROTECT Act to provide for an extension of the Child Safety Pilot Program.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

Provides transitional health care (medical and dental care and other military-related health benefits) for 180 days following separation for members of the Armed Forces separated from active duty who agree to become a member of the Selected Reserve of the Ready Reserve.

National Guard Empowerment and State-National Defense Integration Act of 2008 - Adds the Chief of the National Guard Bureau (Chief) to the Joint Chiefs of Staff. Requires the Chief to: (1) identify gaps between federal and state military capabilities to prepare for and respond to emergencies; and (2) make recommendations to the Secretary of Defense for military assistance to civil authorities to address such gaps. Requires annual defense budget documents to specify separate amounts for training and equipment for the National Guard for military assistance to civil authorities and other domestic operations. Redesignates the: (1) Director and Deputy Director of the Army National Guard as the Vice Chief and Deputy Vice Chief of the Army National Guard; and (2) Director and Deputy Director of the Air National Guard as the Vice Chief and Deputy Vice Chief of the Air National Guard. Treats Vice Chief service as an adjutant general as joint duty experience for assignment or promotion purposes. States that the United States Northern Command and the United States Pacific Command shall be the combatant commands principally responsible for the military support of civil authorities in the United States. Requires the Commander of each Command and the Chief to enter into a memorandum of understanding setting forth the operational relationships, and individual roles and responsibilities, during responses to domestic emergencies among such Commands and the National Guard Bureau. Directs the Secretary to assure that tactical control of the Armed Forces on duty within a state or possession is vested in the governor thereof when such forces are engaged in emergency response activities. Requires the officer serving as: (1) Commander of Army North Command to be an officer in the Army National Guard; and (2) Commander of Air Force North Command to be an officer in the Air National Guard. Expresses the sense of Congress that, in assigning officers to such positions, the President should afford a preference to officers who have served as a state adjutant general. Requires at least one of each of three specified commander and deputy commander joint task force positions to be an officer in the Army or Air National Guard.

Credit Card Fair Fee Act of 2008 - Authorizes providers of a single covered electronic payment system (e.g. Visa or Mastercharge credit cards) and any merchants to jointly negotiate and agree upon rates and terms for access to such a system. Defines covered electronic payment system as any system that has been used for at least 20% of the combined dollar value of U.S. credit, signature-based debit, and PIN-based debit card payments processed in the applicable base year. Grants limited antitrust immunity to such providers and merchants, as well as to those providers who jointly determine among themselves the proportionate division of paid access fees. Sets forth procedures to determine rates and terms for access to a covered electronic payment system. Prohibits any other rates and terms from being imposed upon a merchant for accessing a covered electronic payment system except as specified in a voluntarily negotiated access agreement. Creates a panel of three full-time Electronic Payment System Judges, appointed by the Antitrust Division of the Department of Justice and the Federal Trade Commission Bureau of Competition, to determine the schedule of rates and terms for three-year periods. Subjects any determination of such Judges to judicial review. Authorizes providers and merchants to engage in voluntarily negotiated access agreements. Declares that such voluntarily negotiated access agreements shall be given effect with respect to the signatories in lieu of any determination by the Judges.

Recognizes the importance of the National School Breakfast Program and its overall positive effect on the lives of low-income children and families, as well as its effect on helping to improve a child's overall classroom performance. Expresses the support of the House of Representatives for states that have successfully implemented school breakfast programs in order to improve the test scores and grades of their participating students. Encourages states to: (1) strengthen their school breakfast programs by improving student access; (2) promote improvements in the nutritional quality of breakfasts served; and (3) inform students and parents of healthy nutritional and lifestyle choices.

Full Faith in Veterans Act of 2008 - Directs the Secretary of Veterans Affairs to accept as sufficient proof of service-connection of post-traumatic stress disorder (PTSD) alleged to have been incurred in or aggravated by active military service a diagnosis of PTSD by a mental health professional, together with a written determination that such disorder is related to the veteran's service, if consistent with the circumstances, conditions, or hardships of such service, notwithstanding that there is no official record of such incurrence or aggravation during such service. Requires the Secretary to resolve every reasonable doubt in favor of the veteran. Allows PTSD service-connection to be rebutted by clear and convincing evidence. Directs the Secretary to require Department of Veterans Affairs (VA) employees responsible for rating disabilities, evaluating claims for disability compensation for PTSD, or adjudicating disability compensation ratings to complete a certification program established by the Secretary. Requires the Secretary to: (1) conduct audits of examinations of veterans who submit claims for disability compensation for PTSD; (2) update the schedule for rating disabilities with respect to PTSD, traumatic brain injury, and other mental disorders; (3) implement new PTSD criteria; (4) implement a holistic treatment approach for veterans with PTSD; and (5) require VA employees responsible for adjudicating disability compensation ratings to take into consideration veterans' treatment records from readjustment counseling centers and written opinions of mental health professionals.

Strategic Petroleum Reserve Fill Suspension and Consumer Protection Act of 2008 - Directs the Secretary of Energy to suspend, during calendar year 2008, petroleum acquisition for the Strategic Petroleum Reserve (SPR) through the royalty-in-kind program or any other acquisition method. Authorizes resumption of such acquisition during calendar 2008 not earlier than 30 days after the Secretary notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $50 or less per barrel.

No Discrimination in Health Insurance Act of 2008 - Amends the Employee Retirement Income Security Act (ERISA), the Internal Revenue Code, and the Public Health Service Act to prohibit a group health plan from imposing any preexisting conditions exclusion. Requires each health insurance issuer that offers health insurance coverage in the group market in a state to: (1) accept every employer in the state that applies for such coverage; (2) accept enrollment for every eligible individual who applies during the enrollment period; (3) charge the same premium price for the same coverage; and (4) openly disclose such premium price. Eliminates provisions allowing nonfederal governmental plans to opt out of certain group health plan requirements. Prohibits health insurance issuers that offer coverage in the individual market to individuals residing in an area from: (1) declining to offer such coverage to, or denying enrollment of, eligible individuals in the area who desire to enroll; or (2) imposing any preexisting conditions exclusion. Defines "eligible individual" to mean: (1) a U.S. citizen or national; (2) an alien lawfully admitted to the United States for permanent residence; or (3) an alien who is otherwise lawfully residing in the United States. Requires such issuers to: (1) charge the same premium price for the same coverage, including coverage offered in the group market; and (2) openly disclose such premium price. Authorizes the Secretary of Health and Human Services to establish rules to deter individuals from: (1) enrolling in individual health insurance coverage only after they develop an illness or injury; or (2) disenrolling for periods in which they are unlikely to require such coverage.

Grants for Renewable and Energy Efficiency Needs School Improvement Act or the GREEN School Improvement Act - Requires the Secretary of Education to allocate funds to states to provide competitive grants to local educational agencies and eligible entities to make energy improvements to schools that result in a direct reduction in school energy costs, an improvement in teacher and student health, or the installation of renewable energy technologies. Requires a priority to be given to high-need local agencies and local agencies designated with a specified metrocentric locale codes. Sets forth grant application requirements, including a needs assessment for the schools involved and a description of the benefits and costs of the energy improvements to be made. Authorizes a state agency to require matching funds. Requires the Secretary of Education to make competitive grants to states to develop guidelines and standards for energy improvements and new facility construction. Requires recipients of grants under this Act to report on their use of funds. Requires the Secretary to use report results to publish best practices: (1) for school energy improvement activities; and (2) to further the goal of developing nationwide and regional guidelines and standards for improvements, modernizations, renovations, and new construction. Directs the Comptroller General to carry out a study on: (1) the costs of repair, renovation, and construction for public elementary schools and secondary schools; (2) federal, state, local, and private expenditures for such costs; and (3) the potential of federal funding to address the repair, renovation, and construction needs of such schools with energy improvements.

Credit Cardholders' Bill of Rights Act of 2008 - Amends the Truth in Lending Act to prohibit a creditor from using certain adverse information, including information in a consumer report or any change in a consumer's credit score, as the basis for increasing any annual percentage rate (APR) of interest on the consumer's outstanding balance under an open end consumer credit plan, except for actions or omissions of the consumer directly related to such account. (Thus eliminates the universal default for credit already outstanding.) Bars a creditor from changing any term of the contract or agreement of an open end consumer credit plan until contract renewal, except for specific material reasons already contained in the contract or agreement. Requires advance notice of credit card account rate increases. Authorizes a consumer who receives such notice to: (1) cancel the credit card without penalty or the imposition of any fee; and (2) pay any outstanding balance that accrued before the effective date of the increase at the APR and in the repayment period in effect before notice was received. Prohibits a creditor from imposing interest on credit repaid within the interest-free repayment time period. (Thus prohibits double cycle billing). Prohibits the imposition of fees on any outstanding balance on a credit card account attributable only to accrued interest on previously repaid credit. Requires each periodic statement of account to provide specified information on obtaining the payoff balance. Prohibits a creditor from furnishing information to a consumer reporting agency concerning a newly opened credit card account until the consumer has used or activated the credit card. Details mandatory pro rata payment allocations by a creditor. Authorizes a consumer to opt-out of creditor authorization of over-the-limit transactions if fees are imposed. Restricts the frequency of over-the-limit fees. Specifies the contents of credit card price and availability information the Board of Governors of the Federal Reserve System must collect and make public semiannually. Prescribes a standard for the initial issuance of subprime or "fee harvester" cards (accounts requiring first-year fee payments in excess of 25% of the total amount of credit authorized).

Armed Forces Suicide Prevention Act of 2008 - Directs the Secretary of Defense to undertake specified actions to enhance the suicide prevention programs of the Department of Defense (DOD), including: (1) suicide prevention training for all members of the Armed Forces and DOD civilian health care community and family support professionals; and (2) a suicide prevention outreach program throughout the Armed Forces and military family communities. Directs the Secretary to provide readjustment assistance to spouses and parents of members returning from deployments, including information on: (1) ways to identify signs and symptoms of risk factors for suicide; and (2) the national suicide prevention hotline and other suicide prevention resources. Authorizes the Secretary to award grants and enter into cooperative agreements to identify and implement within DOD strategies for: (1) the recruitment and retention of qualified military behavioral health professionals to provide mental health services, and substance abuse disorder prevention and treatment services, to members; and (2) reducing the stigma associated with seeking mental health treatment.

Delays until April 1, 2009, implementation of proposed changes to payment rules under title XIX (Medicaid) of the Social Security Act for case management and targeted case management services. Prohibits the Secretary of Health and Human Services, before such date, from taking any action to restrict coverage or payment under Medicaid if such action is more restrictive than the administrative action, policy, or practice that applies to coverage of, or payment for, such services under Medicaid on December 3, 2007. Makes null and void any such action taken by the Secretary between December 4, 2007, and March 31, 2009, that is based in whole or in part on such interim final rule.

Justice for Victims of Torture and Terrorism Act - Amends the National Defense Authorization Act for Fiscal Year 2008 (the Act) to remove the authority of the President to grant the government of Iraq immunity from actions by victims of terror seeking compensation for injuries caused by officials, employees, or agents of the government of Iraq during the time such government was classified as a state sponsor of terrorism if: (1) it is the interest of national security; (2) it promotes the reconstruction of, the consolidation of democracy in, and the relations of the United States with, Iraq; and (3) Iraq continues to be a reliable ally of the United States and partner in combating acts of international terrorism. Deems ineffective, on the date of the enactment of this Act, any such immunity granted to the government of Iraq by the Act.

Combat Veterans Debt Elimination Act of 2008 - Prohibits the Secretary of Veterans Affairs from collecting debts owed to the United States by certain veterans who die as a result of a service-connected disability incurred or aggravated on active duty in a war after the Persian Gulf War or a combat zone after September 11, 2001, if the Secretary determines, in his or her discretion, that the termination of collection is in the best interest of the United States. Excepts any amounts owed the United States under federal housing and small business loan programs from such prohibition on debt collection.

Green Transportation Infrastructure Research and Technology Transfer Act - Amends federal transportation law to direct the Secretary of Transportation (Secretary) to make grants to nonprofit institutions of higher learning or consortia to establish and operate regional university transportation centers to carry out green transportation infrastructure research and development (R&D) and technology transfer activities. Directs the National Highway Institute of the Federal Highway Administration to continually develop courses relating to the application of emerging technologies for, among other things, the use of green transportation infrastructure for environmental protection and mitigating environmental impacts of transportation construction. Authorizes the Secretary to make grants under a local technical assistance program to assist rural, local transportation agencies and tribal governments to develop and expand expertise in road and transportation areas, including options with respect to green transportation infrastructure.

Condemns the ongoing Iranian-enabled rocket attacks on Israeli civilians and places responsibility for launching the attacks on Hamas and other terrorist organizations in Gaza. Supports the government of Israel's right to defend its territory. Recognizes the difficult balance Israel faces with the competing pressures of being the primary supplier of numerous necessities for Palestinian civilians, even while rockets are being fired at Israel from Palestinian areas. Supports Palestinian civilians who reject Hamas and all forms of terrorism. Reaffirms the friendship between the governments and the people of Israel and the United States.

Securing Success for Veterans on Campus Act of 2008 - Amends the Higher Education Act of 1965 to direct the Secretary of Education to award three-year grants to institutions of higher education to develop model programs that require each grantee to establish a campus Center of Excellence for Veteran Student Success that provides a single point of contact for the coordination of comprehensive support services for students who are veterans. Requires the Secretary to develop an evaluation and accountability plan for measuring the effect such programs have on veterans' success in postsecondary education.

Beginning Farmers and Ranchers Act of 2007 [ sic ] - Amends the Internal Revenue Code to exclude from gross income 100% of the gain, up to $500,000, from the sale of qualified farm property to a first-time farmer who certifies that such property will be used for farming purposes for 10 years. Allows: (1) a 50% exclusion for the sale of qualified farm property to any other person who certifies that such property will be used for farming purposes for 10 years; and (2) a 25% exclusion for the sale of qualified farm property to any other person for any other use. Defines "qualified farm property" as real property located in the United States which is used for farming purposes for a specified three-year period and in which there was material participation by the taxpayer or the taxpayer's spouse or family member. Requires the recapture of tax benefits if qualified farm property is sold or ceases operation as a farm before the required 10-year period.

Tire Investment, Recovery and Extension Act of 2007 [ sic ]or the TIRE Act of 2007 [ sic ] - Amends the Internal Revenue Code to allow taxpayers who regularly use more than 100 vehicles a year in a trade or business (vehicle fleet operators) a tax credit for the purchase of new or retread tires made from recycled rubber.

Emergency Unemployment Compensation Act of 2008 - Provides for federal-state agreements during a period of rising unemployment under which a state will pay emergency unemployment compensation to individuals who: (1) have exhausted all rights to regular compensation under state or federal law for a benefit year (excluding any benefit year that ended before March 1, 2007); (2) have no rights to regular compensation or extended compensation with respect to a week under such law or any other state unemployment compensation law or to compensation under any other federal law; and (3) are not receiving compensation for such week under the unemployment compensation law of Canada. Requires federal payments to states to cover 100% of such temporary extended unemployment compensation payments. Provides for federal-state agreements for increased regular unemployment compensation payments to certain individuals. Amends the Social Security Act to provide for special transfers to state accounts in the Unemployment Trust Fund for unemployment compensation modernization incentive payments and for administration.

Directs the Secretary of Agriculture to conduct studies on: (1) the economic and trade impact of exports of food products from cloned animals; (2) Department of Agriculture programs to monitor products from cloned animals in the food supply; (3) the health effects and costs attributable to milk from cloned animals in the food supply; and (4) the safety of food products derived from cloned animals.

Bureau of Alcohol, Tobacco, Firearms, and Explosives Reform and Firearms Modernization Act of 2007 - Amends the federal criminal code to revise the civil penalties for violations of firearms law and the procedures for assessing such penalties. Revises the definition of "willfully" for purposes of firearms violations and standards for criminal violations of firearms recordkeeping requirements. Requires the Attorney General to: (1) make preliminary determinations on firearms license applications and notify applicants in writing of a proposed denial; and (2) establish guidelines for Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) inspections, examinations, or investigations of possible firearms violations. Prohibits ATF from disclosing information on firearms purchasers other than to a court, law enforcement agency, or prosecutor. Permits an owner of a firearms business whose license is expired, surrendered, or revoked 60 days to liquidate inventory. Requires any state agency that stores or keeps explosive materials to report to the Attorney General on the location and amount of such materials. Allows the transfer and possession of machineguns for use by federal security contractors. Prohibits taxes or user fees for background checks under the Brady Handgun Violence Prevention Act. Eliminates the requirement of written permission for the use of a handgun for lawful purposes by a minor (under age 18) where a parent or legal guardian is present at all times during such use. Restricts the disclosure of information in the ATF firearms trace system database. Increases penalties for possession of firearms by felons with prior convictions of a crime of violence or a serious drug offense.

S Corporation Modernization Act of 2007 - Amends the Internal Revenue Code to revise the tax treatment of S corporations, including by: (1) reducing from 10 to 7 years the period during which S corporation built-in gains are subject to tax; (2) allowing nonresident aliens to qualify as beneficiaries of an electing small business trust (ESBT); (3) repealing mandatory termination of S corporation elections for excessive passive investment income; (4) allowing S corporations to increase passive investment income from 25 to 60% without incurring additional tax; (5) allowing individual retirement accounts to be S corporation shareholders; and (6) allowing ESBTs to claim expanded charitable tax deductions. Directs the Comptroller General to study and report to Congress on entity neutrality under the Internal Revenue Code with respect to S corporations, limited liability companies, and other pass-through entities.

Recognizes the need to pursue research into the causes, treatment, and a cure for primary lateral sclerosis. Commends: (1) hospitals, community clinics, educational institutes, and other organizations that are working to increase awareness of, and conducting research for methods to help patients suffering from, the disorder; and (2) the Spastic Paraplegia Foundation for its efforts to educate, support, and provide hope for individuals who suffer from the disorder, while funding research to help find a cure. Expresses support for the designation of a Hardy Brown Primary Lateral Sclerosis Awareness Month.
