Statutory Pay-As-You-Go Act of 2009

Statutory Pay-As-You-Go Act of 2009 - Requires the Congressional Budget Office (CBO), as soon as practicable after Congress completes action on any Pay-As-You-Go (PAYGO) legislation, to provide an estimate of its budgetary effects to the Office of Management and Budget (OMB). Requires OMB to maintain and make publicly available a document containing a PAYGO ledger and, within seven days (excluding weekends and legal holidays) after the enactment of any PAYGO legislation, record on such ledger its estimate of the legislation's budgetary effects in each fiscal year, applying the look-back and averaging requirements of this Act. Exempts from the requirements of this Act any PAYGO legislation designated as an emergency requirement by the President and enacted by Congress. (Requires OMB to display the budgetary effects of such legislation as an addendum in the document containing the PAYGO ledger but not record the budgetary effects in it.) Requires OMB: (1) to make publicly available an annual PAYGO report and publish a notice of it in the Federal Register, including information on how it can be obtained; and (2) if such report shows a debit on the PAYGO ledger for the budget year, to prepare and the President to issue a sequestration order for submission to Congress. Prescribes requirements for calculating a sequestration for certain nonexempt and Medicare mandatory programs. Sets forth a special temporary rule to address the scoring of legislation affecting current policy for: (1) payments made under title XVIII (Medicare) of the Social Security Act for physician services; (2) the Estate and Gift Tax and the Alternative Minimum Tax (AMT) under the Internal Revenue Code; and (3) provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 or the Jobs and Growth Tax Relief and Reconciliation Act of 2003 that amended the Code extending middle-class tax cuts for individuals (or provisions in later statutes further amending such amendments). Makes such rule effective through December 31, 2010, or, in specified circumstances, until December 31, 2011. Amends the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) to modify the assumptions used to calculate the baseline. Requires: (1) temporary mandatory funding and tax provisions related to major natural or man-made disasters to be assumed to expire on schedule, and discretionary funding for them to not be projected; and (2) the baseline to include a disaster allowance that is not designated as mandatory or discretionary and is not allocated to any congressional committee. Amends the Gramm-Rudman-Hollings Act to specify additional Social Security, veterans, Tier I Railroad Retirement benefits and other programs and activities exempt from a sequestration order as well as certain economic recovery programs.

Requires any translator tower built under this Act to reasonably facilitate the collocation of any wireless communications or broadband equipment (unless there is clear evidence of unresolvable signal interference issues).

Comprehensive Problem Gambling Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), acting through the Administrator of the Substance Abuse and Mental Health Services Administration, to establish and implement programs for the identification, prevention, and treatment of problem and pathological gambling. Requires the Secretary to carry out a national campaign to increase knowledge and raise awareness of problem gambling. Requires the Secretary to: (1) administer and coordinate the voluntary donation of resources to assist in implementing new programs and augmenting existing national campaigns to provide national strategies for dissemination of information intended to address problem gambling; (2) encourage media outlets to provide information aimed at preventing problem gambling; and (3) target radio and television audiences of, but not limited to, sporting events and gambling. Requires the President to: (1) establish and implement a national program of research on problem gambling; (2) appoint an advisory commission to coordinate federal research; and (3) consider the National Gambling Impact Study Commission's recommendations. Authorizes the Secretary to make grants to states, local, and tribal governments, and nonprofit agencies to provide comprehensive services with respect to treatment and prevention of, and education about, problem gambling. Directs the President, acting through the Administrator, to develop a Treatment Improvement Protocol for problem gambling Expresses the sense of Congress that every state should contribute a percentage of its revenue from gambling towards prevention and treatment of, and services and education about, problem gambling.

Consumer Assistance to Recycle and Save Act - Establishes in the National Highway Traffic Safety Administration (NHTSA) a voluntary Consumer Assistance to Recycle and Save Program through which the Secretary of Transportation shall: (1) authorize the issuance of an electronic voucher to offset the purchase or lease price for a new fuel efficient automobile upon the surrender of an eligible trade-in vehicle to a participating dealer; (2) register dealers for Program participation; (3) make electronic payments to them for eligible transactions they accept between specified dates; and (4) establish and provide for the enforcement of measures to prevent and penalize fraud under the Program. Prescribes requirements, including combined fuel economy, for $3,500 and $4,500 vouchers to offset the purchase or lease price for a qualifying passenger automobile or truck. Limits the number of vouchers to one per customer, including joint registered owners of a single eligible trade-in vehicle. Requires a dealer to certify about each eligible trade-in vehicle that the dealer: (1) will arrange for transfer to the United States of the vehicle's title; (2) will accept possession of the vehicle on behalf of the United States; (3) has not and will not sell, lease, exchange, or otherwise dispose of the vehicle for use as an automobile anywhere in the world; and (4) will transfer, on behalf of the United States, the vehicle and its title to an entity that will ensure that the vehicle will be crushed or shredded within the Program period, and has not been, and will not be, sold, leased, exchanged, or otherwise disposed of for use as an automobile anywhere in the world. Prescribes standards which any regulations issued by the Secretary for the Program must meet. Makes it unlawful for any person to violate this Act or any regulations issued under it, particularly by fraud. Prescribes civil penalties for any such violation. Directs the Secretary to make Program information available on an Internet website and through other means.

Automobile Dealer Economic Rights Restoration Act of 2009 - Prohibits an automobile manufacturer (manufacturer) in which the federal government has an ownership interest, or which receives loans from the federal government, from depriving an automobile dealer (dealer) of its economic rights. Requires the manufacturer to honor those rights as they existed for Chrysler LLC and General Motors Corporation dealers prior to the commencement of the bankruptcy cases of each corporation, including dealer rights to recourse under state law. Requires the appropriate manufacturer to restore the franchise agreement between the dealers and Chrysler LLC or General Motors that was in effect prior to the commencement of their respective bankruptcy cases, and to take assignment of such agreements. States that nothing in this Act is intended to make null and void the transfer of substantially all the assets of such corporations.

National Transportation Objectives Act of 2009 - Establishes: (1) national transportation objectives to provide a 21st century vision for the national surface transportation system, including to promote energy efficiency and achieve energy security, ensure environmental protection and safety for all transportation users, improve economic competitiveness and transportation system conditions, and provide equal access to transportation in urban, suburban, and rural communities; and (2) national transportation performance targets to meet such objectives, including to reduce per capita vehicle miles traveled by 16% and transportation-generated carbon dioxide levels by 40%, triple walking, biking, and public transportation use, increase freight transportation provided by railroad and intermodal services by 20%, and improve public safety and lower congestion costs by reducing traffic crashes by 50%. Directs the Secretary of Transportation to: (1) develop baseline levels and appropriate data collection systems for meeting the national transportation performance targets; and (2) develop and implement a National Surface Transportation Performance Plan.

Indian Health Care Improvement Act Amendments of 2009 - Amends the Indian Health Care Improvement Act to revise requirements for health care programs and services for Indians, Indian tribes, tribal organizations, and urban Indian organizations. Replaces the Urban Health Programs Branch with a Division of Urban Indian Health. Authorizes grants to urban Indian organizations for health information technology, telemedicine services development, and related infrastructure. Directs the Secretary of Health and Human Services, acting through the Indian Health Service, to provide programs of comprehensive behavioral health, prevention, and treatment. Excludes from gross income: (1) services or benefits provided or purchased by the Service; and (2) services or benefits provided by a tribe or tribal organization, directly or through insurance. Declares that these provisions are not intended as an inference to the tax treatment of governmental benefits provided by tribes to Indians. Reauthorizes the Indian Health Care Improvement Act. Amends the Indian Self-Determination and Education Assistance Act to direct the Secretary to establish the Native American Health and Wellness Foundation. Expands coverage for qualified Indians in the State Children's Health Insurance Program (CHIP, formerly known as SCHIP) under title XXI of the Social Security Act (SSA), as well as under Medicare (SSA title XVIII) and Medicaid (SSA title XIX). Authorizes related payments to Indian Health Programs operating in the state.

Correction of Long-Standing Errors in Agencies' Unsustainable Procurements Act of 2009 or the CLEAN-UP Act - Requires executive agencies to ensure that: (1) inherently governmental functions, functions closely related to such functions, and mission-essential functions are performed by federal employees; (2) other functions are performed by the more efficient form of personnel, whether federal employees, contractors, or military personnel; and (3) consideration is given to using federal employees to perform new functions on a regular basis. Requires each agency head to submit to the Director of the Office of Management and Budget (OMB): (1) an annual report on service contracts for new work; (2) a Functions At Risk Report that describes those functions required to be performed by federal employees that are actually performed by contractors (requires agencies to reduce the total number of contractor employees described in that Report by 70% within six years); and (3) a strategic human capital plan to ensure the capability of the agency's federal employee workforce to perform agency functions. Prohibits an agency from conducting a public-private competition for any function that such plan identifies as experiencing a gap in its federal employee workforce. Requires agencies subject to the Federal Activities Inventory Reform Act of 1998 (other than the Department of Defense [DOD]) to: (1) submit an annual inventory of activities performed pursuant to contracts for services; (2) review those contracts and identify activities that should be considered for conversion to performance by civilian employees; and (3) develop a plan for such conversion by June 30 of the following year. Authorizes agency heads to expedite the hiring of certain professionals in shortage category positions. Requires the Director to: (1) develop guidelines for the establishment of business process re-engineering projects; and (2) conduct annual performance reviews of such projects that are ongoing. Sets forth revisions, requirements, and restrictions applicable to studies and public-private competitions for the conversion of agency functions to contractor performance pursuant to OMB Circular A-76.

Homeowners' Defense Act of 2009 - Establishes the National Catastrophe Risk Consortium as a nonprofit, nonfederal entity to: (1) maintain an inventory of catastrophe risk obligations held by state reinsurance funds, state residual insurance market entities, and state-sponsored providers of natural catastrophe insurance; (2) issue, on a conduit basis, securities and other financial instruments linked to catastrophe risks insured or reinsured through Consortium members; (3) coordinate reinsurance contracts; (4) act as a centralized repository of state risk information accessible by certain private-market participants; and (5) establish a database to perform research and analysis that encourages standardization of the risk-linked securities market. Authorizes the Secretary of the Treasury to guarantee holders of debt against loss of principal or interest, or both, on any such debt issued by eligible state programs for purposes of promoting the availability of private capital to provide liquidity and capacity to state catastrophe insurance programs and expediting the payment of claims under such programs and better assist the financial recovery from significant natural catastrophes. Provides separate limits on the total principal amount of such obligations for programs that cover earthquake peril and those that cover all other perils. Directs the Secretary to make contracts for reinsurance coverage available for purchase by eligible state programs. Provides pricing guidelines and a limit on aggregate potential federal liability. Establishes a Federal Natural Catastrophe Reinsurance Fund in the Treasury to be funded by amounts received from the sale of reinsurance coverage contracts, amounts appropriated for liability for claims payment, and earnings on investments. Directs the Secretary of Housing and Urban Development (HUD) to establish and carry out a program of grants to eligible entities to develop, enhance, or maintain programs to prevent and mitigate losses from natural catastrophes. Requires a study of the need for and impact of expanding the programs established by this Act to apply to insured losses of eligible state programs for losses arising from commercial insurance policies that provide coverage for properties composed predominantly of residential rental units.

Prohibits separate financial requirements or more restrictive treatment limitations. Limits required benefits for prosthetic devices and custom orthotic devices and related services to the most appropriate model that adequately meets the medical requirements of the patient. Requires benefits to include repairs and replacements as determined appropriate by the treating physician. Prohibits any annual or lifetime dollar limitation on benefits for prosthetic devices and custom orthotic devices and related services unless such limitation applies in the aggregate to all benefits.

Pathways to College Act

Pathways to College Act - Authorizes the Secretary of Education to award competitive five-year grants to local educational agencies that serve mostly high-need high schools for programs to increase the number of students from low-income families who attend college. Defines "high-need high schools" as those where at least one-half of the students are from low-income families. Requires grantees to use such funds to: (1) train teachers and counselors to provide students with advice concerning postsecondary education; (2) implement a comprehensive college guidance program for all students which exposes them to postsecondary information and planning assistance before the end of their first semester of high school; (3) ensure that their schools develop comprehensive, school-wide plans of action to strengthen their college-going culture; (4) create or maintain a postsecondary access center in each school that provides information on colleges and universities, career opportunities, and financial aid options; and (5) provide a setting in which professionals working in college access programs can meet with students. Directs the Secretary to provide technical assistance to grantees in calculating and analyzing their college-going rates and adopting best practices for elevating such rates. Requires grantees periodically to evaluate the success of their grant activities and use the evaluations to refine such activities and their performance measures. Directs the Secretary to conduct an independent evaluation of the grant program which includes an assessment of the program's affect on high school graduation and college-going rates.

Authorizes the Board to designate Fish Habitat Partnerships to: (1) coordinate Plan implementation at a regional level; (2) identify strategic priorities; (3) recommend habitat projects; and (4) develop and carry out fish habitat conservation projects. Establishes Partnership approval criteria, including that a Partnership: (1) include representatives of a diverse group of public and private partners focused on conservation of aquatic habitats to achieve results across jurisdictional boundaries and public and private land; and (2) is able to address issues and priorities on a nationally significant scale. Directs the Secretary of the Interior to fund, from amounts appropriated under this Act, up to 50% of the cost of approved fish habitat conservation projects on nonfederal and 100% of projects on federal land or water. Requires the Director of the U.S. Fish and Wildlife Service to: (1) establish the National Fish Habitat Conservation Partnership Office within the Service; and (2) develop the Office's interagency operational plan. Requires the Director, the Assistant Administrator of the National Oceanic and Atmospheric Administration (NOAA), and the Director of the United States Geological Survey (USGS) to provide technical and scientific assistance to the Partnerships, the project participants, and the Board.

Directs the Administrator to: (1) publish a report regarding federal prime contracts awarded to businesses identified as small businesses for purposes of achieving small business contracting goals; and (2) establish procedures to ensure that the Central Contractor Registration database provides an adequate warning regarding criminal penalties for misrepresenting the status of a small business or person in order to obtain federal contracts. Provides for enforcement of complaints about the classification of a business for such purposes.

Medicare Orthotics and Prosthetics Improvement Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act with respect to recognized independent accreditation organizations which apply quality standards for suppliers of items and services relating to prosthetic devices and orthotics and prosthetics. Directs the Secretary of Health and Human Services (HHS) to designate and approve an independent accreditation organization for such purposes only if it is the American Board for Certification in Orthotics and Prosthetics, Inc., the Board for Orthotist/Prosthetist Certification, or a program that the Secretary determines has accreditation and approval standards essentially equivalent to those of such a Board. Requires such organization to satisfy all applicable criteria of the provider qualification designation for each of specified categories of prosthetics and orthotics. Requires application to prosthetic devices and orthotics and prosthetics generally of existing accreditation and licensure requirements for certain custom-fabricated prosthetics and custom-fabricated orthotics, as well as those categorized as custom-fitted high or custom-fitted low. Modifies the Medicare payment methodology for prosthetic devices and orthotics and prosthetics to require the Secretary, for payment purposes, to take into account practitioner qualifications and complexity of care. Directs the Secretary to report to Congress on: (1) the steps taken by the Department of HHS to ensure that such licensure and accreditation requirements are enforced; and (2) the effect of the requirements of this Act on the occurrence of fraud and abuse under the Medicare program with respect to prosthetic devices and orthotics and prosthetics.

Requires the Comptroller General to study and report to Congress on the applicability and impact of this Act.

Agricultural Job Opportunities, Benefits, and Security Act of 2009 or the AgJOBS Act of 2009 - Directs the Secretary of Homeland Security (DHS) to confer "blue card status" upon an alien who: (1) has performed agricultural employment in the United States for at least 863 hours or 150 work days during the 24-month period ending on December 31, 2008, or earned at least $7,500 from U.S. agricultural employment; (2) applied for such status during the 18-month application period beginning on the first day of the seventh month that begins after the date of enactment of this Act; (3) is otherwise admissible to the United States; and (4) has not been convicted of any felony or a misdemeanor, an element of which involves bodily injury, threat of serious bodily injury, or harm to property in excess of $500. Limits the number of blue cards that may be issued during the five-year period beginning on the date of the enactment of this Act. Directs the Secretary to adjust a blue card alien (and spouse and minor children) to permanent resident status if the alien has fulfilled specified periods of agricultural employment. Amends the Social Security Act to exempt blue card aliens from prosecution for social security-related identity or payment false statements if such conduct occurred prior to the granting of blue card status. Amends the Immigration and Nationality Act to revise H-2A visa (agricultural labor or temporary or seasonal services) provisions. Replaces the existing labor certification requirement with a labor attestation requirement containing: (1) a description of the nature and location of the job; (2) the job's expected beginning and ending dates; (3) the number of jobs; and (4) specified labor assurances respecting job opportunities covered by collective bargaining agreements and non-covered job opportunities.

Requests the Secretaries to submit to Congress a list of statutory barriers that prevent each department from expanding access to mental health counseling services to family members of veterans. Urges the Secretary to aggressively work with Congress, veterans service organizations, and others to determine how to best meet the needs of veterans and their family members.

Requires an electronic payment system network to disclose its contract terms to the merchant, including its complete operating rules, without restricting the merchant's use of such information. Directs the Federal Trade Commission (FTC) to prescribe regulations to: (1) ensure that the rules, terms, and conditions to which a merchant or consumer is subject under an agreement with an electronic payment system network are neither unfair nor deceptive to consumers and merchants, nor anticompetitive; (2) prohibit any unfair or deceptive act or practice or anticompetitive act or practice that may result from such rule, term, or condition; and (3) regularly review such rules, terms, and conditions. Directs the Board of Governors of the Federal Reserve System to collect and disseminate to the public: (1) complete information on fees charged by each electronic payment system network in connection with consumer-initiated transactions; and (2) the rules, terms, and conditions to which a merchant or a consumer is subject under an agreement with an electronic payment system network for transactions using payment cards.

Requires the Administrator of the program to: (1) enter into contracts with health insurance issuers to provide health insurance coverage under this Act; and (2) enter into agreements with entities to serve as navigators to provide information about the program, provide referrals to applicable agencies for any grievance, complaint, or question, and assist in enrollment. Requires a participating employer to ensure that each eligible employee has an opportunity to enroll in a plan. Sets forth requirements for health plans offered under this Act. Requires the Administrator to contract with the National Association of Insurance Commissioners to study: (1) the rating requirements that apply to health insurance purchased in the small group markets in the states and to develop recommendations concerning rating requirements; and (2) the administrative procedures that apply to the program and to health insurance purchased in the small group markets in states. Sets forth premium-setting rules for plans under this Act. Allows a state to prohibit participation in this program if the state offers alternative health benefit plans. Amends the Internal Revenue Code to allow a tax credit for small employers for qualified employee health insurance expenses under this Act.

Requires fines to be based upon the nature and severity of the violation, the size of the firearms business involved, and the prior record of the firearm's licensee. Prohibits consideration of the amount of fines or license revocations imposed by agents of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) in the retention, promotion, or transfer of such agents. Revises the definition of "willfully" for purposes of firearms violations and standards for criminal violations of firearms recordkeeping requirements. Requires the Attorney General to: (1) make preliminary determinations on firearms license applications and notify applicants in writing of a proposed denial; and (2) establish guidelines for ATF inspections, examinations, or investigations of possible firearms violations. Permits an owner of a firearms business whose license is expired, surrendered, or revoked 60 days to liquidate inventory. Allows purchasers of existing firearms businesses the right to cure firearms violations attributable to such businesses. Allows the transfer, possession, and importation of machineguns for industry testing, research and training, national security services, and motion picture or television production. Eliminates the requirement of written permission for the use of a handgun for lawful purposes by a minor (under age 18) where a parent or legal guardian is present at all times during such use. Prohibits the Attorney General from electronically retrieving inactive firearms licensee information by name or personal identification code. Directs the Attorney General to authorize the importation of all frames or receivers of rifles, or barrels for firearms other than handguns, if the importation is for repair or replacement purposes.
