Animal Fighting Prohibition Enforcement Act of 2007

Animal Fighting Prohibition Enforcement Act of 2007 - Amends the federal criminal code to prohibit: (1) sponsoring or exhibiting a bird in a fighting venture in a state where it would not otherwise be in violation of the law, only if the person knew that any bird in the venture was knowingly bought, sold, delivered, transported, or received in interstate or foreign commerce for such purpose; or (2) knowingly sponsoring or exhibiting in an animal fighting venture any other animal that was moved in interstate or foreign commerce. Prohibits knowingly: (1) selling, buying, transporting, delivering, or receiving, for purposes of transportation in interstate or foreign commerce, any dog or other animal to participate in an animal fighting venture; (2) using interstate mail service for commercial speech promoting an animal fighting venture except as performed outside the limits of the states (with an exception for bird fights in states whose laws allow them); or (3) selling, buying, transporting, or delivering in interstate or foreign commerce a knife, gaff, or other sharp instrument to be attached to the leg of a bird for use in an animal fighting venture. Increases the penalties to a fine and up to three years' imprisonment for violations.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956 and the Revised Statutes of the United States to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from determining that real estate brokerage activity or real estate management activity is financial in nature, is incidental to any financial activity, or is complementary to a financial activity. (In effect, prohibits financial holding companies and national banks from engaging, directly or indirectly, in real estate brokerage or real estate management activities.) Exempts from such prohibition: (1) activities of a bank holding company (or any affiliate) that directly relate to managing any real property owned by national banks or their affiliates; and (2) the right, power, or ability of any financial holding company to engage in any activity, or acquire or retain the shares of any company engaged in an activity authorized for financial holding companies on December 6, 2001 ("grandfather clause").

Credit Monitoring Clarification Act - Amends the Credit Repair Organizations Act to cite conditions under which provision to a consumer of credit reports, credit score analysis, and assistance in a case of identity theft shall not be considered as an activity to improve a consumer's credit status, which is subject to regulation under such Act. Exempts from regulation under such Act any person (credit repair organization, or CRO) representing that it can modify or remove, or assist the consumer in modifying or removing, any information in the consumer's credit report if the CRO gives clear and conspicuous notice, before the consumer pays or agrees to pay it, that: (1) neither the consumer nor anyone else has the right to have accurate and current information removed from a credit report; and (2) the consumer has the right to dispute any inaccurate information by contacting the credit bureau directly. Requires a CRO, to qualify for this exemption from regulation, also to give the consumer, before payment or agreement to pay, a specified disclosure entitled "Your Rights Concerning Your Consumer Credit File."

Health Care Access and Rural Equity (H-CARE) Act of 2006 - Amends title XVIII (Medicare) of the Social Security Act with respect to: (1) the Medicare disproportionate share hospital (DSH) adjustment for rural hospitals; (2); payment for clinical laboratory tests furnished by critical access hospitals; (3) rebasing for sole community hospitals; (4) establishment of a rural community hospital program; (5) extension of the Medicare rural hospital hold harmless provision under the prospective payment system (PPS) for hospital outpatient department services; (6) coverage of marriage and family therapist services and mental health counselor services under Medicare part B (Supplementary Medical Insurance); (7) permanent treatment of certain physician pathology services under Medicare; (8) extension of the Medicare incentive payment program for a physician scarcity area; (9) proportional representation of interests of rural areas on the Medicare Payment Advisory Commission; and (10) additional payments for providers furnishing ambulance services in rural areas and prompt payment of clean claims by Medicare prescription drug plans and MedicareAdvantage-Prescription Drug (MA-PD) plans under the Medicare part D (Voluntary Prescription Drug Benefit Program). Amends the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 to extend: (1) certain Medicare hospital wage index reclassifications and disregarding hospital reclassifications for purposes of group reclassifications; (2) Medicare reasonable costs payments for certain clinical diagnostic laboratory tests furnished to hospital patients in certain rural areas; and (3) the temporary Medicare payment increase for home health services furnished in a rural area. Amends the Public Health Service Act to: (1) authorize the Secretary of Health and Human Services to award competitive grants to eligible entities in rural areas for purchase and enhanced utilization of qualified health information technology systems; (2) establish a capital infrastructure revolving loan program and a Rural Health Quality Advisory Commission; and (3) provide for delta rural disparities and health systems development.

Fair Fund Improvement Act - Amends the Sarbanes-Oxley Act of 2002 to revise the requirement that, if the Securities Exchange Commission (SEC) obtains an order requiring disgorgement for a violation, and also obtains a civil penalty, such penalty shall, at SEC motion or discretion, be added to the disgorgement fund for the benefit of victims. Repeals the initial requirement for a disgorgement order. Declares that, if the SEC obtains a civil penalty for violation of securities laws, the penalty shall, upon SEC motion, be added to and become part of a disgorgement or other fund established for the benefit of the victims of such violation. Authorizes the SEC to enter into contracts to retain private legal counsel to collect delinquent judgments and orders.

Joshua Omvig Veterans Suicide Prevention Act - Directs the Secretary of Veterans Affairs to develop and implement a comprehensive program for reducing the incidence of suicide among veterans. Requires the program to include: (1) mandatory training for appropriate staff and contractors of the Department of Veterans Affairs who interact with veterans; (2) screening of veterans who receive medical care at a Department facility for suicide risk factors; (3) referral of at-risk veterans for counseling and treatment; (4) a suicide prevention counselor at each Department medical facility; (5) research for suicide prevention and for mental health care for veterans who have experienced sexual trauma while in military service; (6) 24-hour veterans' mental health care availability; and (7) a toll-free hotline. Expresses the sense of Congress that: (1) suicide among veterans suffering from post-traumatic stress disorder (PTSD) is a serious problem; and (2) the Secretary should take in the special needs of PTSD-afflicted veterans in developing and implementing the program.

Comprehensive Veterans' Data Protection and Identity Theft Prevention Act of 2006 - Places upon the Secretary of Veterans Affairs an affirmative obligation to protect from any data breach the sensitive personal information of veterans and any other individuals that the Department of Veterans Affairs possesses, creates, or maintains, as well as information or tools (including passwords and encryption keys) used to protect the integrity of such data. Requires the Secretary to: (1) implement and maintain reasonable security policies and procedures to protect such information; and (2) prescribe policies and procedures regarding employee and third party access to, and use of, such information which the Department receives, maintains, or transmits. Directs the Secretary, upon discovery of a data breach, to: (1) notify the United States Secret Service, the Department's Inspector General, the congressional veterans' committees, and the Federal Trade Commission (FTC); (2) notify each individual whose information was acquired or accessed by an unauthorized person; and (3) place a conspicuous notice on the Department's Internet website. Requires the Secretary, upon request of an affected individual, to: (1) include a fraud alert in the file of the individual with each nationwide consumer reporting agency; (2) apply a security freeze to the file of such individual; and (3) provide free damage mitigation services, including credit monitoring and annual copies of consumer credit reports. Establishes within the Department an Ombudsman for Data Security.

Makes the Secretary responsible for providing any notices and file monitoring required under this Act at no cost to the persons affected by the breach. Requires the Secretary to make available to a person affected, upon request, a service that monitors nationwide credit activity from a consumer reporting agency for six months for free.

Executive Branch Reform Act of 2006 - Requires recording and filing by each executive branch official with the Office of Government Ethics on any significant contact made between that official and any private party relating to an official government action. Outlines the authorities and responsibilities of the Director of the Office of Government Ethics with regard to such reports. Sets prohibitions on covered executive branch officials who are entering or leaving government service. Amends the Office of Federal Procurement Policy Act to modify provisions relating to procurement officials. Sets a prohibition on the personal and substantial involvement by certain former contractor employees in the award or administration of government contracts. Sets a prohibition on unauthorized expenditure of funds for publicity or propaganda purposes. Requires an advertisement or other communication paid for by an executive agency to disclose that such advertisement or communication is paid for by that agency. Directs each federal agency to submit to the Archivist of the United States and specified congressional committees a report describing the use of "pseudo" classification designations. Requires the Archivist to: (1) report on the use of "pseudo" classification designations; and (2) promulgate regulations banning "pseudo" classification designations. Prohibits an employee or applicant for employment of a covered agency from being discriminated against as a reprisal for disclosing covered information to an authorized Member of Congress or to an authorized official of an executive agency, the Department of Justice, or the Inspector General of the employee's employing covered agency.

Independent Pharmacy Protection Act of 2006 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to require each prescription drug plan contract entered into with a plan sponsor to provide for: (1) the availability of direct deposit payments; (2) an increased dispensing fee for generic drugs; and (3) payments within 10 days for certain pharmacies. Requires the dispensing fee paid to a participating pharmacy for a generic covered part D drug therapeutically equivalent and bioequivalent to a brand name covered part D drug dispensed through the pharmacy to be at least 50% greater than the dispensing fee for the brand name drug. Limits to $10 the dispensing fee paid to a participating pharmacy for a generic covered part D drug. Prohibits a prescription drug plan, subject to exception by the Secretary of Health and Human Services, from decreasing the dispensing fee paid to a participating pharmacy for a brand name drug to an amount less than the dispensing fee paid for it on the date of enactment of this Act. Applies this Act to contracts with a Medicare Advantage organization in the same manner as they apply to those with a prescription drug plan sponsor.

Stafford Disaster Relief and Emergency Assistance Act to prohibit the termination or demotion of, or other discrimination in the terms and conditions of employment against, an employee who, when activated by the Federal Emergency Management Agency (FEMA) as a disaster assistance employee reservist, is absent from or late to work. Makes this provision inapplicable if such person is absent for more than 90 days per calendar year. Allows an employer to: (1) charge against the employee's regular pay any time that an employee loses from employment because of such activation; and (2) request the employee to provide written verification from FEMA of the time and dates of such activation. Requires any such employee to make a reasonable effort to notify his or her employer of such absences or lateness. Authorizes a person who has been terminated, demoted, or otherwise discriminated against in violation of this Act to bring a civil action in U.S. district court if the action is commenced within one year after the violation.

Requires the Secretary to provide for recovery of payment reductions owing to such offset from those part D or Medicare Advantage-Prescription Drug (MA-PD) plans that would otherwise be responsible for the expenditures made by the states.
