Fair Access to Banking Act This bill places restrictions on certain banks, credit unions, and payment card networks if they refuse to do business with a person who complies with the law. Restrictions include prohibiting the use of electronic funds transfer systems and lending programs, termination of an institution's depository insurance, and specified civil penalties. Banks and other specified financial institutions are allowed to deny financial services to a person only if the denial is justified by a documented failure of that person to meet quantitative, impartial, risk-based standards established in advance by the institution. This justification may not be based upon reputational risks to the institution. Banks may also deny services to a person who engaged in rude or harassing conduct toward an employee of the bank. The bill establishes the right for a person to bring a civil action for a violation of this bill.

Improving Care and Access to Nurses Act or the I CAN Act This bill allows other health care providers besides physicians (e.g., nurses) to provide certain services under Medicare and Medicaid. Among other changes, the bill (1) allows a nurse practitioner or physician assistant to fulfill documentation requirements for Medicare coverage of special shoes for diabetic individuals; (2) expedites the ability of physician assistants, nurse practitioners, and clinical nurse specialists to supervise Medicare cardiac, intensive cardiac, and pulmonary rehabilitation programs; and (3) allows nurse practitioners to certify the need for inpatient hospital services under Medicare and Medicaid.

Hershel "Woody" Williams National Medal of Honor Monument Location Act This bill requires the authorized commemorative work honoring Medal of Honor recipients to be attached to, or not more than 1,000 feet from, the Lincoln Memorial. President Lincoln established the Medal of Honor award.

Shielding America's Youth From Exploitation Act or the SAYFE Act This bill requires the Department of Defense to establish an annual training for students who are enrolled in the Junior Reserve Officers' Training Corps (JROTC) regarding the prevention of sexual abuse. Such training must be provided by an entity other than a JROTC administrator or instructor.

Workplace Violence Prevention for Health Care and Social Service Workers Act This bill requires the Department of Labor to address workplace violence in health care, social service, and other sectors. Specifically, Labor must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence. The standard applies to employers in the health care sector, in the social service sector, and in sectors that conduct activities similar to those in the health care and social service sectors. In addition, Labor must promulgate a final standard within a specified time line.

American Innovation and R&D Competitiveness Act of 2023 This bill eliminates the five-year amortization requirement for research and experimental expenditures, thus allowing continued expensing of such expenditures in the taxable years in which they are incurred.

Pay Our Coast Guard Parity Act of 2023 This bill provides continuing appropriations to the Coast Guard for pay and benefits when there is a Coast Guard-specific funding lapse. Under the bill, a Coast Guard-specific funding lapse occurs when (1) a bill providing appropriations for the Coast Guard for a fiscal year has not been enacted before the beginning of that fiscal year, and no joint resolution providing continuing appropriations for the Coast Guard is in effect; and (2) a bill providing appropriations for the Department of Defense (DOD) for the fiscal year has been enacted before the beginning of the fiscal year, or a joint resolution providing continuing appropriation for DOD is in effect. If a Coast Guard-specific funding lapse occurs, the bill provides appropriations to the Coast Guard for pay and allowances for military members of the Coast Guard who perform active service or inactive-duty training; pay and benefits for certain civilian employees and contract employees; the payment of a death gratuity; payments for travel related to funerals, the dignified transfer of remains, and unit memorial services; and the temporary continuation of the basic allowance for housing for dependents of members of the Coast Guard dying on active duty. The bill generally provides the appropriations to the Coast Guard until the earlier of the enactment of specified Coast Guard appropriations legislation, the termination of the availability of appropriations for DOD, or two weeks after the beginning of the Coast Guard-specific funding lapse.

Ending Trading and Holdings in Congressional Stocks (ETHICS) Act This bill generally prohibits Members of Congress (and their spouses and dependents) from purchasing or selling certain investments, such as individual stocks and related financial instruments that are not diversified investment funds, Treasury securities, or other specified holdings. Violations of this prohibition are subject to specified civil penalties. Members must certify their compliance with the provisions of the bill, and the applicable House or Senate ethics office must make the certifications and related information (e.g., trust agreements; descriptions of assets held in trusts; and federal loans, grants, or related benefits that the Member received) available online. Additionally, the bill restricts certain communications between trustees and beneficiaries related to investments held in qualified blind trusts. Violations of the restriction are subject to specified civil penalties. Further, the bill imposes penalties for failing to comply with existing financial disclosure requirements and requires electronic filing of those disclosures in a searchable format.

Collegiate Housing and Infrastructure Act of 2023 This bill allows tax-exempt charitable or educational organizations to make collegiate housing and infrastructure grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) that apply such grants to their collegiate housing property. A collegiate housing and infrastructure grant is a grant to provide, improve, operate, or maintain collegiate housing property that may involve more than incidental social, recreational, or private purposes. The grant must be for purposes that would be permissible for a dormitory or other residential facility of the college or university with which the collegiate housing property is associated. The grant may not be used to provide physical fitness facilities.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Federal Firearms Licensee Protection Act of 2023 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

Strengthening Community Care Act of 2023 This bill extends funding through FY2028 for the Community Health Center Fund (CHCF) and the National Health Service Corps (NHSC) Fund. The CHCF supports grants for outpatient health care facilities that provide care to medically underserved populations; the NHSC Fund supports the provision of scholarships and student loan repayment awards to health care providers who agree to work in areas with health care provider shortages.

VA Supply Chain Management System Authorization Act This bill authorizes the Department of Veterans Affairs (VA) to implement an information technology system for the management of supply chains that meets specified requirements (e.g., is cloud based). The VA must complete the implementation of an information technology system for the management of supply chains by not later than three years after the enactment of this bill.

Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

National Nursing Workforce Center Act of 2023 This bill sets out a pilot program to support state agencies, state boards of nursing, nursing schools, or other eligible entities with establishing or expanding state-based nursing workforce centers that carry out research, planning, and programs to address nursing shortages, nursing education, and other matters affecting the nursing workforce. The bill also expands the authority of the Health Resources and Services Administration (HRSA) to establish health workforce research centers and specifically requires that HRSA establish a center focused on nursing.

Freedom of Association in Higher Education Act of 2023 This bill addresses freedom of association protections for college students in single-sex social organizations. Specifically, the bill gives students (or groups of students) enrolled at institutions of higher education (IHEs) the right to form or join social organizations, including single-sex social organizations. Additionally, the bill prohibits IHEs that participate in federal student-aid programs from taking adverse actions against single-sex social organizations or students who are members or prospective members of such organizations based solely on the practice of limiting membership to only individuals of one sex; taking actions that require or coerce members or prospective members of such organizations to waive protections provided under the bill, including as a condition of enrolling in the IHE; or imposing a recruitment restriction on a single-sex social organization that is not imposed upon other student organizations, unless the organization and IHE have entered into a written agreement allowing the restriction.

Expanding Veterans' Options for Long Term Care Act This bill requires the Department of Veterans Affairs (VA) to implement a three-year pilot program to assess the effectiveness of providing assisted living services to eligible veterans, including by assessing the satisfaction of veterans participating in the pilot program. Eligible veterans are those who (1) are eligible for assisted living services as determined by the VA; and (2) are already receiving nursing home level care paid for by the VA, are eligible for such care from the VA, or exceed the requirements for domiciliary care paid for by the VA but do not meet the requirements for nursing home level care paid for by the VA. The Inspector General of the VA must report to Congress on the pilot program, and the VA must submit a follow-up plan to address any deficiencies that are identified in the report.

Homecare for Seniors Act This bill allows tax-exempt distributions from health savings accounts (HSAs) to be used for qualified home care. Qualified home care means a contract to provide three or more of the following services in the residence of the service recipient: assistance with eating, assistance with toileting, assistance with transferring, assistance with bathing, assistance with dressing, assistance with continence, and medication adherence. The Department of Health and Human Services must carry out a campaign to increase public awareness of the in-home service expenses that are eligible for tax-free distribution from HSAs.

United States-Israel Future of Warfare Act of 2023 This bill requires the Department of Defense to establish the United States-Israel Future of Warfare Research and Development Fund to conduct collaborative defense projects between the United States and Israel in areas of emerging technologies (e.g., artificial intelligence). The purpose of the fund is to enable the Armed Forces of the United States and Israel to meet emerging defense challenges.

This bill requires the military departments to ensure that certain military service in a female cultural support team is included in an individual's military service record and in the computation of retired pay. Specifically, the bill addresses service of a member of the Armed Forces who served in a female cultural support team (with the personal development skill identifier of R2J or 5DK) from January 1, 2010, through August 31, 2021. The bill provides that individuals who performed such service (or their survivors) who have previously had a claim for service-connection denied may resubmit a claim for the same condition to be considered by the Department of Veterans Affairs (VA). For purposes of claims for service-connected disability or death, the VA must treat such service as engagement in combat with the enemy in the course of active duty. The VA must determine the effective date of the award by treating the date of the initial claim as the date on which the individual filed the awarded claim. The VA must also improve training and guidance for employees who may process claims for service-connected disability and death for individuals who served in a female cultural support team. Finally, the VA must conduct outreach to inform individuals who performed such service (or survivors of such individuals) that they may submit supplemental claims for service-connected disability or death incurred or aggravated in the course of service.

Equitable Community Access to Pharmacist Services Act This bill expands Medicare coverage to permanently include services provided by a pharmacist, including incidental services and supplies, related to testing, vaccines, and treatment for COVID-19, influenza, and certain other illnesses. Specifically, the bill provides for continued coverage of pharmacist services relating to evaluation and management of patients for testing and treatment for COVID-19, influenza, respiratory syncytial virus (RSV), or streptococcal pharyngitis (strep throat), as well as vaccines for pneumococcal disease, COVID-19, influenza, or hepatitis B. It also generally provides for coverage of pharmacist services during a public health emergency.

Economic Impact of Tolling Act This bill prohibits the Department of Transportation from implementing a congestion pricing program for any toll road, bridge, or tunnel until an economic impact analysis is completed and made available to the public.

Honoring Our Fallen Heroes Act of 2023 This bill extends death and disability benefits under the Public Safety Officers' Benefits Program (PSOB) to certain public safety officers who suffer from exposure-related cancer while on duty and their survivors. The PSOB program provides death, disability, and education benefits to public safety officers who are killed or injured in the line of duty and their survivors. The bill specifies that exposure-related cancer shall be presumed to constitute a personal injury in the line of duty if the public safety officer was exposed to or in contact with heat, radiation, or a carcinogen that is linked to an exposure-related cancer; the officer began serving as an officer not later than 5 years before the date of the diagnosis of an exposure-related cancer and the diagnosis occurred not later than 15 years after the last date of active service; and the exposure-related cancer directly and proximately resulted in the death or permanent and total disability of the officer. The Department of Justice's Bureau of Justice Assistance (BJA) must periodically review the definition of exposure-related cance r. It directs the BJA to add additional cancers to the definition under certain circumstances (e.g., a petition process).

Helping Ensure Life- and Limb-Saving Access to Podiatric Physicians Act or the HELLPP Act This bill adds podiatrists as covered physicians under the Medicaid program. Additionally, the bill revises certain documentation requirements related to Medicare coverage of therapeutic shoes for individuals with diabetes. Finally, the bill subjects payments made to a Medicaid provider or supplier to a continuing levy for federal taxes owed by the provider or supplier.

This bill increases the amount of educational assistance available to an individual pursuing a program of education under the Survivors' and Dependents' Educational Assistance (DEA) program at an institution located in the Philippines. Under current law, DEA educational assistance for an individual pursuing a program of education at an institution located in the Philippines is limited to $0.50 for each dollar. The bill makes an individual eligible for the full assistance amount.

Comprehensive Care for Alzheimer's Act This bill allows the Center for Medicare and Medicaid Innovation (CMMI) to test a Dementia Care Management Model that provides comprehensive care to Medicare beneficiaries with Alzheimer's disease or a related dementia. Under the model, participating health care providers receive payment under Medicare for comprehensive care management services that are provided to individuals with diagnosed dementia, excluding Medicare Advantage enrollees, hospice care recipients, and nursing home residents. Required services include medication management, care coordination, and health, financial, and environmental monitoring, as well as trainings and other support services for unpaid caregivers. Providers must furnish services through interdisciplinary teams and must ensure access to a team member or primary care provider 24-7. The CMMI must set payments and determine quality measures for the model in accordance with specified requirements. The bill also allows the CMMI to design a similar model under Medicaid.

Chiropractic Medicare Coverage Modernization Act of 2023 This bill expands Medicare coverage of chiropractic services to include all services provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine.

America Works Act of 2023 This bill expands applicability of the work requirements for Supplemental Nutrition Assistance Program (SNAP) recipients who are able-bodied adults without dependents (ABAWDs). (SNAP recipients who are ABAWDs have work-related requirements in addition to the general SNAP work registration and employment and training requirements.) Specifically, this bill applies the work requirements for ABAWDs to adults who are not over 65 years old, whereas these requirements currently apply to adults who are not over 50 years old. Further, the ABAWD exemption for a parent or household member with responsibility for a dependent child is restricted to a dependent child under the age of seven. Currently, the child must be under the age of 18. The bill also amends an ABAWD waiver program that allows state exemptions based on an area having an unemployment rate of over 10% or an insufficient number of jobs. Specifically, the bill repeals the second basis for a state exemption, which applies to areas that have an insufficient number of jobs. Under current law, a state agency may exempt up to 12% of SNAP recipients from the ABAWD work requirements for each fiscal year; unused exemptions may be carried over and used in a subsequent fiscal year. Under the bill, unused exemptions may not be carried over.

Veterans' Appeals Backlog Improvement Act This bill requires the Department of Veterans Affairs (VA) to establish programs that provide employment opportunities within the VA and the Board of Veterans' Appeals (BVA). Specifically, the bill requires the VA to establish a competitive internship program to provide high-achieving law students with an opportunity to gain experience with the BVA. The VA must also establish a nine-year competitive honors pilot program to recruit high-achieving law students, recent law school graduates, and entry-level attorneys for employment. Under the pilot, the VA must (1) provide student loan repayment benefits to participants, (2) enter into participant agreements that outline terms of the program, (3) assign mentors who are outside of the participant's chain of command, and (4) provide participants with at least one assignment within the VA's Office of General Counsel. The bill also requires the VA to report on improving access to tele-hearings before the BVA (held by picture and voice transmission).

Expanding America's National Cemetery Act of 2023 This bill requires the Department of Veterans Affairs, before Arlington National Cemetery reaches capacity, to expand or otherwise modify an existing national cemetery to ensure that full military honors are provided in a specified manner. Specifically, the VA must expand or modify such a cemetery to ensure that full military honors are provided (1) in a manner consistent with the full military honors provided for interment in Arlington National Cemetery as of March 31, 2023; and (2) using the eligibility criteria in effect on March 31, 2023, for providing full military honors for interment in Arlington National Cemetery.

Sultana Steamboat Disaster Commemorative Coin Act of 2023 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occured on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society for the purpose of establishing, operating, and maintaining a museum.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

Law Enforcement Officers Equity Act This bill expands the definition of law enforcement officer under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS). Specifically, the bill expands the definition to include (1) federal employees whose duties encompass the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. The bill deems service performed by an incumbent law enforcement officer on or after the enactment date of this bill to be service performed as a law enforcement officer for retirement purposes. The past service of such incumbents shall be treated as service performed by a law enforcement officer for retirement purposes only if a written election is submitted to the Office of Personnel Management within five years after the enactment of this bill or before separation from government service, whichever is earlier. An incumbent who makes an election before the enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. A law enforcement officer shall not be subject to mandatory separation during the three-year period beginning on the enactment of this bill.

Military Spouse Hiring Act This bill expands the Work Opportunity Tax Credit (WOTC) to include the hiring of a qualified military spouse. (The WOTC permits employers who hire individuals who are members of a targeted group such as qualified veterans, ex-felons, or long-term unemployment recipients to claim a tax credit equal to a portion of the wages paid to those individuals.) A qualified military spouse is any individual who is certified by the designated local agency as being (as of the hiring date) a spouse of a member of the Armed Forces.

States Handling Access to Reciprocity for Employment Act or the SHARE Act This bill requires the Federal Bureau of Investigation to make available criminal history record information to a state occupational or professional licensing authority for background checks of individuals seeking a license under an interstate compact. A state licensing authority may not share criminal history record information with the compact's commission, any other state entity or licensing authority, or the public, but may inform the compact's commission of completion of a background check.

Federal Firefighter Pay Equity Act This bill modifies certain pay calculations that are used to determine retirement and annuity benefits for federal firefighters. Specifically, the bill adjusts the method of determining the average pay of a federal firefighter by adding one-half of a firefighter's basic hourly rate multiplied by the number of overtime hours included as part of such firefighter's regular tour of duty. It also requires the Office of Personnel Management to issue regulations that cap the number of hours in a regular workweek, which may not exceed 60 hours per week.

Fair and Open Competition Act or the FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers to make an agreement with a labor union to require employees to join such union as a condition of employment. Currently, at least 27 states have enacted laws prohibiting employers from compelling employees to become members of a union as a condition of employment.

Stop CCP Fentanyl Act This bill imposes sanctions on various Chinese government officials and entities. It also establishes a cause of action against China’s government or Chinese government officials for certain harms stemming a fentanyl-related overdose. Specifically, the bill requires the President to impose visa- and property-blocking sanctions on (1) the president of China, (2) the chairman of the Chinese Communist Party (CCP), (3) China’s State Council, and (4) China’s Politburo Standing Committee. The President may waive the sanctions upon certifying that (1) China’s government and the CCP have taken all reasonable measures to prevent the flow of fentanyl produced in China into the United States, and (2) the intelligence community has determined that amount of fentanyl from China and the deaths resulting from overdoses of such fentanyl has dropped 98%. This bill also authorizes a U.S. national or lawful permanent resident to sue certain Chinese government officials or the Chinese government for the death of an immediate family member caused by an overdose by fentanyl (or fentanyl analogue) manufactured using fentanyl precursors from China. Property blocked pursuant to sanctions under this bill may be used to satisfy a judgment from such a lawsuit.

250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

Outdoors for All Act This bill directs the Department of the Interior to establish an outdoor recreation legacy partnership grant program under which Interior may award grants to states, certain political subdivisions of a state, special purpose districts, Indian tribes, or Alaska Native or Native Hawaiian communities or organizations. Funds must be used for projects to (1) acquire land and water for parks and other outdoor recreation purposes in qualifying areas, and (2) develop new or renovate existing outdoor recreation facilities that provide outdoor recreation opportunities to the public in qualifying areas. Qualifying area means an urbanized area or urban cluster that has a population of 25,000 or more in the most recent census, two or more adjacent urban clusters with a combined population of 25,000 or more in the most recent census, or an area that is administered by an Indian tribe or an Alaska Native or Native Hawaiian community organization. Interior shall give priority to projects that create or significantly enhance access to park and recreational opportunities in an urban neighborhood or community, engage and empower underserved communities and youth, provide opportunities for employment or job training for youth or underserved communities, establish or expand public-private partnerships, and take advantage of coordination among various levels of government.

Health Care Fairness for Military Families Act of 2023 This bill modifies the extension of dependent coverage under TRICARE by allowing a dependent under the age of 26 to be covered without an additional premium. Additionally, the bill authorizes such coverage of dependents without an additional premium regardless of whether they are eligible to enroll in an employer-sponsored plan.

Dustoff Crews of the Vietnam War Congressional Gold Medal Act This bill provides for the award of a single Congressional Gold Medal to Dustoff crews (helicopter air ambulance crews) of the Vietnam War in recognition of their heroic military service.

Commitment to Veteran Support and Outreach Act This bill authorizes the Department of Veterans Affairs (VA) to provide grants to states and Indian tribes to implement programs that improve outreach and assistance to veterans and their families to ensure that such individuals are fully informed about veterans' benefits and programs. Specifically, the VA may provide grants to states and tribes to (1) implement or enhance outreach activities; (2) increase the number of county or tribal veterans service officers in the state or tribe; or (3) expand, implement, or otherwise enhance existing programs and services of the existing state or tribal organization that is recognized by the VA in the preparation, presentation, and prosecution of claims for veterans benefits through representatives who hold positions as county or tribal veterans service officers. The VA must prioritize awarding grants in areas with a critical shortage of county or tribal veterans service officers, areas with high rates of suicide among veterans, and areas with high rates of referrals to the Veterans Crisis Line. During FY2024-FY2028, the VA is authorized to hire two or more additional full-time equivalent employees in the VA's Office of General Counsel to carry out duties under the accreditation, discipline, and fees program.
