Rebuilding Economic Prosperity and Opportunity for Ukrainians Act or the REPO for Ukrainians Act This bill requires or authorizes various actions related to the confiscation and disposition of Russian sovereign assets (which include funds and other property of Russia's central bank, direct investment fund, or ministry of finance). Under the bill, the President must require U.S. financial institutions to notify the Department of the Treasury of any Russian sovereign assets located at such institutions. The President may confiscate any such assets subject to U.S. jurisdiction. Confiscated funds and the proceeds of liquidated property must be deposited into the Ukraine Support Fund established by the bill. The Ukraine Support Fund shall be used by the Department of State to compensate Ukraine for damages caused by the Russian invasion. The Ukraine Support Fund may also support an international body or mechanism for (1) reconstruction and rebuilding efforts in Ukraine, (2) humanitarian assistance to the Ukrainian people, or (3) other purposes which support the recovery of Ukraine and the welfare of the Ukrainian people. The bill also directs the President to seek to establish, with foreign partners, an international mechanism to provide compensation to Ukraine using the Ukraine Support Fund and Russian sovereign assets confiscated by foreign partners. Additionally, the bill sets policy on related topics, such as specifying that the United States should lead an international sanctions regime to freeze Russian sovereign assets in conjunction with allies and partners.

Fair Access to Agriculture Disaster Programs Act This bill waives the adjusted gross income limitations for payments or benefits under specific Department of Agriculture (USDA) disaster assistance programs for a person or legal entity that derives a portion of their income from agriculture. (Currently, a person or entity is not eligible to receive certain benefits during a crop, fiscal, or program year if their average gross income exceeds $900,000.) Specifically, in the case of an excepted payment or benefit, the adjusted gross income limitation is waived if 75% or more of the average adjusted gross income for the person or entity is derived from farming, ranching, or silviculture activities. These activities include agritourism, direct-to-consumer marketing of agricultural products, and the sale of agricultural equipment owned by such person or entity. The bill applies to the USDA Livestock Indemnity Program; Livestock Forage Disaster Program; Emergency Assistance for Livestock, Honey Bees, and Farm-Raised Fish Program; Tree Assistance Program; and Noninsured Crop Disaster Assistance Program.

Sustaining Healthy Ecosystems, Livelihoods, and Local Seafood Act or the SHELLS Act This bill directs the Department of Agriculture (USDA) to establish an Office of Aquaculture and an Aquaculture Advisory Committee. The term aquaculture means the propagation and rearing of aquatic species in controlled or selected environments, including ocean ranching (with exclusions). Specifically, the Office of Aquaculture must encourage and promote aquaculture operations that promote U.S. food security and limit adverse environmental effects. USDA must also establish a 14-member Aquaculture Advisory Committee to advise USDA on (1) developing and advancing aquaculture best practices; (2) the history, use, and preservation of indigenous and traditional aquaculture practices and ecological knowledge; and (3) providing technical assistance to aquaculture farmers and businesses.

This resolution states that BridgeUSA programs are vital to the economy and to U.S. national interests. The resolution also states that U.S. embassies and consulates should prioritize processing J-1 visas for such programs. (BridgeUSA is the name for what was formerly known as the Exchange Visitor Program. Participants from other countries come to the United States to participate in various exchange programs, such as exchange programs for professors, trainees, interns, and au pairs.)

Expanded Telehealth Access Act This bill expands the types of health care practitioners who may provide telehealth services under Medicare. Specifically, the bill permanently allows audiologists, physical therapists, occupational therapists, speech-language pathologists, and other providers designated by the Centers for Medicare & Medicaid Services to provide telehealth services under Medicare. It also specifically allows occupational therapy assistants and physical therapist assistants to provide such services.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Midwives for Maximizing Optimal Maternity Services Act of 2023 or the Midwives for MOMS Act of 2023 This bill establishes grants within the Health Resources and Services Administration (HRSA) for establishing or expanding midwifery programs at institutions of higher education and nursing schools. In awarding grants, HRSA must give special consideration to institutions that focus on increasing the number of midwife professionals from underrepresented groups and promote practicing in areas with limited access to professional health care.

Daniel J. Harvey Jr. and Adam Lambert Improving Servicemember Transition to Reduce Veteran Suicide Act This bill requires the Department of Defense and Department of Veterans Affairs to jointly carry out a five-year pilot program to assess the feasibility and advisability of providing certain services and a module comprised of specified elements as part of the pre-separation transition process for members of the Armed Forces for the purpose of reducing the incidence of suicide among veterans.

Veterans National Traumatic Brain Injury Treatment Act This bill requires the Department of Veterans Affairs to implement a five-year pilot program to furnish, under the Veterans Community Care Program, hyperbaric oxygen therapy to veterans with traumatic brain injuries or post-traumatic stress disorder.

Love Lives On Act of 2023 This bill extends entitlement for various benefit programs and services for surviving spouses of deceased members of the Armed Forces or veterans. First, the bill removes the expiration on a surviving spouses' entitlement to educational assistance through the Marine Gunnery Sergeant John David Fry Scholarship (Fry Scholarship). The bill also provides that the remarriage of a surviving spouse must not bar the furnishing of dependency and indemnity compensation to such spouse. Next, the Department of Defense may not terminate the payment of an annuity for a surviving spouse under the Survivor Benefit Plan solely because the surviving spouse remarries. Additionally, the bill provides commissary store and MWR retail facility (e.g., exchange store) access to surviving spouses regardless of the martial status of the spouse. Such spouses must be entitled to use such stores and facilities to the same extent and on the same basis as surviving spouses who did not remarry. The bill expands the definition of a dependent under TRICARE to include a remarried widow or widower whose subsequent marriage has ended due to death, divorce, or annulment. Finally, the bill modifies the definition of a surviving spouse for purposes of veterans benefits to include same sex marriages.

Transnational Criminal Organization Illicit Spotter Prevention and Elimination Act This bill provides for criminal penalties for certain conduct that interferes with U.S. border control measures. Specifically, a person who knowingly transmits the location or activities of law enforcement with the intent to further a crime related to immigration, customs, or controlled substances may be imprisoned for a maximum of 10 years. A person who knowingly damages or destroys a device deployed to control the border or port of entry may be imprisoned for a maximum of 10 years. Additionally, the bill provides for enhanced punishment for carrying or using a firearm in connection with certain criminal immigration violations such as assisting a non-U.S. national ( alien under federal law) who is inadmissible due to a felony conviction.

Caregiver Outreach and Program Enhancement Act or the COPE Act This bill authorizes the Department of Veterans Affairs to award grants to implement, coordinate, improve, or enhance mental health counseling, treatment, or support for family caregivers of veterans participating in the family caregiver program. Additionally, the Government Accountability Office must report on the provision of mental health support to caregivers of veterans.

VA Medical Center Security Report Act of 2023 This bill requires the Department of Veterans Affairs (VA) to annually survey certain VA medical center employees (i.e., police chiefs, facility emergency management leaders, medical center directors, or a person carrying out the responsibilities of one of these positions in an acting capacity) to collect information regarding security at each VA medical center. The bill also requires the VA to submit an annual report to Congress on the security at VA medical centers. Among other elements, the report must include the results of the annual survey and a plan for addressing any security weaknesses identified in the results.

Protecting Veteran Community Care Act This bill requires the Department of Veterans Affairs (VA) to furnish residential mental health or substance-use services to certain veterans through the Veterans Community Care Program (VCCP). Specifically, the VA must furnish such care if a veteran (1) meets VA criteria for priority admission to a VA Mental Health Residential Rehabilitation Treatment Program and the VA is unable to accommodate priority admission, or (2) has contacted the VA to request such mental health services and the VA is not able to furnish such services in a manner that complies with VA access standards for specialty care provided under the VCCP. The VA must ensure that a referral to an alternate Mental Health Residential Rehabilitation Treatment Program does not take precedence over timely access to mental health or substance-use services unless the referral is requested by the veteran. The VA is prohibited from determining a veteran is ineligible for VCCP care solely because VCCP providers are unable to comply with wait times or access standards. If multiple options for care or services are available, the VA must permit a veteran to elect the option the veteran prefers. Additionally, the bill provides minimum standards for residential mental health or substance-use services provided under the VCCP (e.g., treatment programs or facilities must be licensed and accredited for the specified services).

Increasing Competitiveness for American Drones Act of 2023 This bill establishes and extends certain rules and authorities related to unmanned aircraft systems (UAS) and operations. Specifically, the bill requires the Federal Aviation Administration (FAA) to establish a regulatory pathway for certification or approval of UAS to enable commercial beyond visual line of sight (BVLOS) operations, including a risk assessment methodology. Additionally, the bill establishes the Office of Associate Administrator of UAS Integration within the FAA. Among other duties, the office must (1) ensure and oversee the safe integration of UAS into the national airspace system, and (2) encourage and facilitate a commercially viable UAS industry and the leadership of the United States in UAS. The bill also establishes the UAS Certification Unit to develop and implement the UAS certification or approval processes for BVLOS operations. The bill extends the FAA's UAS Test Site Program, which provides verification of the safety of public and civil UAS, operations, and related navigation procedures before their integration into the national airspace system. The bill also modifies the program to require the FAA to use modeling and simulation tools to assist in the testing, evaluation, verification, and validation of UAS. Further, the bill extends the special authority for the Department of Transportation to provide exemptions from some requirements for UAS by using a risk-based approach to determine if certain UAS may operate safely in the national airspace system.

American Battlefield Protection Program Enhancement Act This bill expands the National Park Service's American Battlefield Protection Program. The bill expands the battlefield acquisition grant program to allow grants to be (1) awarded to Indian tribes and nonprofit organizations, and (2) awarded to acquire certain Revolutionary War or War of 1812 battlefields. The bill expands eligibility for the battlefield restoration grant program to include battlefield land that is owned by a state, tribe, local government, or nonprofit organization. Not later than 2 years after this bill's enactment and every 10 years thereafter, the American Battlefield Protection Program must report to Congress on preservation activities and the condition of battlefields.

Give Kids a Chance Act of 2023 This bill authorizes certain targeted clinical trials involving combinations of drugs to treat pediatric cancer. Specifically, the bill modifies requirements relating to molecularly targeted pediatric cancer investigations so as to authorize investigations of new drugs that are used in combination with active ingredients that have already been approved and that (1) have been determined to be the standard of care for treating a pediatric cancer, or (2) have been approved to treat an adult cancer and are directed at molecular targets for pediatric cancer. The Food and Drug Administration must issue guidance and report on the bill's implementation. The Government Accountability Office must report on the effectiveness of the bill's changes with respect to the development of pediatric cancer drugs.

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Specifically, this bill applies to motor vehicles manufactured in the United States, imported into the United States, or shipped in interstate commerce after the rule's effective date. The DOT rule must require all such vehicles to have devices that can receive signals and play content transmitted by AM broadcast stations or digital audio AM broadcast stations installed as standard equipment. Prior to the effective date of the rule, manufacturers that do not include devices that can access AM broadcast stations as standard equipment must inform purchasers of this fact through clear and conspicuous labeling. DOT may assess civil penalties against any manufacturer that fails to comply with the mandate. The Department of Justice may also bring a civil action to enjoin a violation. Further, the Government Accountability Office must study and report on whether a reliable alternative communication system exists for delivering emergency alerts and consider the (1) cost to drivers and passengers of receiving communications through an alternative system, and (2) cost and time required to develop and implement an alternative.

VA Canine Reporting Act of 2023 This bill requires the Department of Veterans Affairs to report on the average time it took to provide a veteran with a service or guide dog in the prior year. The report must also include legislative recommendations to reduce such wait time.

Sailor Standard of Care Act of 2023 This bill requires the Department of the Navy (DON) to implement policies and procedures related to mental health and quality of life for members of the Navy. Specifically, the DON must provide additional resources to any unit with greater than 15 members designated for limited duty at a given time. (Generally, limited duty status is designated for medical reasons and can be permanent or temporary.) The DON must require that members who are designated for limited duty receive a mental health screening upon such designation and once every 60 days for the duration of the designation. The DON must establish a framework to ensure (1) centralized leadership for the management of members of the Navy who are designated for limited duty, and (2) members who have suicidal ideations or other mental health care needs have smooth transitions during transfers between units or while designated for limited duty. The DON must brief Congress on the average number of days for the medical separation of a member previously designated for limited duty and recommendations for steps the DON may take to streamline and expedite timely separation. The Office of the Assistant Secretary of the Navy for Manpower and Reserve Affairs must establish and maintain a dashboard to track quality of life programs (e.g., childcare programs) of the DON and the rate of usage of each program. The DON must study recent cases in which multiple suicides occurred within 30 days of each other among members assigned to the same unit or command.

Disrupt Fentanyl Trafficking Act of 2023 This bill requires the Department of Defense (DOD) to develop and submit a strategy to use existing authorities to target, disrupt, or degrade threats to national security that are caused or exacerbated by fentanyl trafficking. The strategy must be submitted in an unclassified form, but it may include a classified index. Additionally, DOD must seek to enhance cooperation with defense officials of Mexico to target, disrupt, and degrade transnational criminal organizations within Mexico that traffic fentanyl.

Historic Preservation Fund Reauthorization Act This bill extends through FY2033 and increases funding for the National Park Service's Historic Preservation Fund. The funding is provided from revenues from Outer Continental Shelf oil and gas leases, and awards from the fund are made to states and other entities, including tribes and nonprofits.

PREEMIE Reauthorization Act of 2023 This bill reauthorizes through FY2028 and otherwise modifies research and education programs for preventing premature births. In particular, the bill expands the scope of education programs for health care providers and the public to address the importance of screening for and treatment of chronic conditions as part of preconception and prenatal care. Additionally, the bill requires the Department of Health and Human Services (HHS) to establish an interagency working group to improve the coordination of programs and activities to prevent preterm birth, infant mortality, and related adverse effects. (Current law permits HHS to establish such a working group.) The bill also requires HHS to support a study carried out by the National Academies of Sciences, Engineering, and Medicine on matters related to premature births, such as the financial costs and factors that affect preterm birth rates.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Port Crane Security and Inspection Act of 2023 This bill limits the operation of foreign cranes at U.S. ports. Foreign cranes are those that have information technology and operational technology components that (1) were manufactured by companies that are subject to the control or influence of a country designated as a foreign adversary, and (2) connect to ports' cyber infrastructure. Foreign cranes that are contracted for on or after the date of the bill's enactment may not operate at a U.S. port. The bill also prohibits, effective five years after the date of the bill's enactment, foreign cranes at U.S. ports if the cranes use software or other technology manufactured by a company owned by a country designated as a foreign adversary. Additionally, the Cybersecurity and Infrastructure Security Agency (CISA) must (1) inspect foreign cranes for potential security risks or threats before they are placed into operation, (2) assess the threat posed by security risks or threats of existing or newly constructed foreign cranes, and (3) take any crane that poses a security risk or threat offline until the crane can be certified as no longer being a risk or threat. CISA must also report to Congress about security risks or threats posed by foreign cranes at U.S. ports.

Supporting Apprenticeship Colleges Act of 2023 This bill directs the Department of Education to award grants to institutions of higher education that sponsor construction and manufacturing-oriented registered apprenticeship programs for (1) expanding or supporting outreach to high schools, local businesses, local workforce development boards, and apprenticeship intermediaries; and (2) providing advising and support services to students who are enrolled in these apprenticeship programs.

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Back the Blue Act of 2023 This bill establishes new criminal offenses for killing, assaulting, and fleeing to avoid prosecution for killing a judge, law enforcement officer, or public safety officer. Additionally, the bill expands the list of statutory aggravating factors in death penalty determinations to also include the killing or attempted killing of a law enforcement officer, judge, prosecutor, or firefighter or other first responder; broadens the authority of federal law enforcement officers to carry firearms; and limits federal court review of challenges to state court convictions for killing a public safety officer or judge.

Safeguarding Our Forces Abroad Act or the SOFA Act This bill requires the Department of Defense (DOD) to reduce, at a rate of 1% each month, the number of members of the Armed Forces stationed in foreign countries where (1) at least 1,000 members of the Armed Forces were stationed in the previous fiscal year, and (2) there are not enforceable Status of Forces Agreements in place that contain specified elements. Specifically, the bill applies to countries that do not have enforceable Status of Forces Agreements in place that prohibit pretrial detention of any member of the Armed Forces who has been accused of committing a non-violent crime, guarantees an accused member of the Armed Forces immediate access to legal counsel and language translation services during the legal process, guarantees an accused member of the Armed Forces may not be compelled to be a witness against themselves, and guarantees an accused member of the Armed Forces will be protected from confessions obtained through torture, coercion, threats, violence, or any means of improper influence. The requirement to reduce force numbers may be waived if DOD certifies to Congress that it is in the national security interests of the United States to avoid a reduction in forces.

Military Suicide Prevention in the 21st Century Act This bill requires the Department of Defense to carry out a two-year pilot program to program suicide prevention resources onto smart devices issued to members of the Armed Forces and to provide training on these resources.

This bill requires the Department of Defense (DOD) to establish a task force to examine matters relating to the mental health of members of the Armed Forces. The task force must submit a report to DOD that includes recommendations related to the mental health services provided to members of the Armed Forces. DOD must develop a plan based on the recommendations of the task force.

Sergeant First Class Michael Clark TRICARE Reserve Parity Act This bill extends the period of eligibility for health benefits under TRICARE Reserve Select for immediate family members to three years beyond the date of the death of a member of a reserve component. Under current law, the eligibility period continues for six months beyond the date of the death.

Protecting Patients Against PBM Abuses Act This bill establishes requirements for Medicare pharmacy benefit managers (PBMs) with respect to remuneration, payments, and fees. Specifically, the bill restricts PBMs that are under contract with plans under the Medicare prescription drug benefit or Medicare Advantage from (1) receiving income for their services other than flat dollar amount service fees; (2) basing any service fees on the prices of covered drugs or any associated discounts, rebates, or other remuneration; (3) charging plan sponsors for ingredient costs or dispensing fees in amounts that are different than what is reimbursed to the pharmacy; or (4) reimbursing network pharmacies for less than that what is reimbursed to PBM-affiliated pharmacies. Such PBMs must also report on the difference between certain costs for drugs on the plan's formulary and those that are not on the formulary but are therapeutically equivalent. PBMs must also report certain information regarding rebates and fees they receive from drug manufacturers; the Centers for Medicare & Medicaid Services must publish this and other information that is currently reported by PBMs online.

Flight Education Access Act This bill increases federal student loan limits for students in undergraduate flight education and training programs. It also establishes a grant program to support the education of future pilots and to diversify the pilot training workforce. Specifically, the bill increases the maximum aggregate amount of Federal Direct Unsubsidized Stafford Loans to $111,000 for dependent students and $137,500 for independent students. It also increases the maximum aggregate amount of Federal Direct Stafford Loans to $65,000. The bill directs the Department of Education (ED) to collect data and annually calculate the completion rate of each undergraduate flight education and training program at each eligible institution. The bill also requires the Government Accountability Office to (1) examine and review the implementation of this bill, (2) develop recommendations for ED on any changes to improve the bill's implementation, and (3) submit a report to Congress on its findings and recommendations. The bill directs ED to award grants to eligible partnerships to (1) support the education of future airline and commercial pilots, (2) diversify the pilot training workforce, and (3) generate interest and support for a career as an airline and commercial pilot. An eligible partnership is a collaboration between at least one workforce partner (e.g., a labor organization representing aircraft pilots or an entity that employs pilots) and at least one educational partner (e.g., a local or state educational agency).

Veteran Improvement Commercial Driver License Act of 2023 This bill authorizes approval of certain commercial driver education programs for purposes of Department of Veterans Affairs (VA) educational assistance if the programs meet specified requirements. Under current law, the VA may not approve enrollment of a veteran in courses for programs that do not lead to a standard degree that are offered at a new branch (i.e., a branch that has been operating for less than 2 years) of an educational institution. Under the bill, a commercial driver education program offered at a new branch of an educational institution may be approved if it is appropriately licensed and uses the same curriculum as a commercial driver education program offered by the educational institution at another location that is already approved for purposes of VA educational assistance. The educational institution must submit a report demonstrating the curriculum at the new branch is the same as the curriculum at the primary location in order to be exempt from the current prohibition against course approval at new branches.

Filipino Veterans Family Reunification Act of 2023 This bill exempts from worldwide or numerical limitations certain family-sponsored immigrant visas for the sons and daughters of Filipino World War II veterans who were naturalized under certain laws providing for naturalization for service during World War II.

Electronic Health Record Program Restructure, Enhance, Strengthen, and Empower Technology Act of 2023 or the EHR Program RESET Act of 2023 This bill establishes within the Veterans Health Administration a program to modernize the electronic health record and other relevant health information technology systems of the Department of Veterans Affairs (VA). The bill also establishes the Electronic Health Record and Health Information Technology Modernization Program Management Office and a position of Deputy Chief Information Officer for Electronic Health Record and Health Information Technology to implement the program. The VA must exceed or meet certain standards at its facilities that are using the Oracle Cerner product before it may initiate new deployments of the product. The bill requires additional information to be included in the quarterly updates on the Electronic Health Record Modernization Program, such as data on retention, morale, and turnover at sites using the new electronic health record. Within 275 days after the enactment of this bill, the VA must terminate all of its contracts with Oracle Cerner for training and change management related to electronic health record modernization and cease to issue task orders for such activities from Oracle Cerner or its subcontractors. The VA must designate one senior official (GS-15 or higher) as the lead negotiator on all current and future contracts relating to the new electronic health record. The Chief Acquisition Officer of the VA must contract with an entity to independently verify and validate the modernization efforts of certain VA programs (e.g., the Electronic Health Record Modernization Program).
