Medicare Mental Health Access Act This bill amends title XVIII (Medicare) of the Social Security Act to expand the definition of "physician," for purposes of the Medicare program, to include a clinical psychologist with respect to the furnishing of qualified psychologist services. The bill excludes a clinical psychologist, in 2017 and 2018, from certain negative payment adjustments for failing to be a meaningful electronic health records user.

Freedom for Workers to Seek Opportunity Act

Freedom for Workers to Seek Opportunity Act This bill: (1) prohibits employers from entering into not-to-compete covenants with any grocery store employees engaged in commerce or in the production of goods for commerce, and (2) requires an employer of such employees to post a notice of this prohibition in a conspicuous place on the employer's premises. No employers who own or operate at least one grocery store may, in conjunction with the purchase of one or more grocery stores owned or operated by another employer, include in any agreement between such employers any provision that restricts either employer from hiring a grocery store employee of the other employer. An employer who acquires the operation of another employer and retains in employment a grocery store employee of the former employee at the same grocery store of the former employer shall continue to recognize, for all employment purposes, the seniority of that grocery store employee, and, to the extent practicable, make available to such employees any benefits made available by the former employer. The Secretary of Labor shall: (1) enforce a complaint of a violation of this Act in the same manner as a complaint of a violation of the Fair Labor Standards Act of 1938, and (2) impose a specified civil fine on any employer who violates this Act.

Individual Assistance Improvement Act of 2015

Individual Assistance Improvement Act of 2015 This bill requires the Federal Emergency Management Agency (FEMA) to submit to Congress an annual report on recommendations for improving federal assistance for small states and rural areas under the Robert T. Stafford Disaster Relief and Emergency Assistance Act and additional resources required for such improvements. In measuring the severity, magnitude, and impact of a disaster and evaluating the need for assistance to individuals under that Act, FEMA shall not apply, with respect to a rural area, the factor relating to concentration of damages. FEMA shall provide the governor or the chief executive of an Indian tribal government with documentation related to a major disaster declaration decision within 25 days after such individual requests that documentation, including: (1) an analysis of the factors that it considered in making the decision, and (2) its rationale. The Government Accountability Office shall conduct a comprehensive review of: (1) FEMA's damage assessment processes for major disaster declarations, and (2) the teams that carry out such processes. FEMA shall conduct a study, biennially, to: (1) compare the average amount of individual assistance provided per person for each major disaster declared during the five most recently completed fiscal years, the average damages realized per individual for each disaster, and the average damages realized per individual for each event where a request for a major disaster declaration was denied during the five most recently completed fiscal years; and (2) collect the data needed to update a table relating to the average amount of individual assistance by state.

CLEANER Act of 2015 or the Closing Loopholes and Ending Arbitrary and Needless Evasion of Regulations Act of 2015 This bill amends the Resource Conservation and Recovery Act to eliminate the exemption for waste derived from the exploration, development, or production of crude oil, natural gas, or geothermal energy from regulations governing the disposal of hazardous waste. Within a year of this bill's enactment, the Environmental Protection Agency (EPA) must: determine whether waste associated with oil, gas, or geothermal energy activities meet the criteria promulgated for the identification or listing of hazardous waste; identify or list as hazardous waste any of those wastes if they meet the identification or listing criteria; and promulgate regulations regarding standards applicable to generators, transporters, and owners and operators of facilities for the treatment, storage, or disposal of those wastes. The EPA may modify the regulation of those standards to consider the special characteristics of those wastes so long as the modified regulations protect human health and the environment. Within a year of this bill's enactment, the EPA must promulgate revisions of certain criteria concerning landfills and waste management practices of open dumping for facilities that may receive wastes that are: (1) associated with those activities, and (2) not identified or listed as hazardous waste. Those revisions must: protect human health and the environment, while allowing consideration of the practicable capability of such facilities; and require groundwater monitoring as necessary to detect contamination; establish criteria for the acceptable location of new or existing facilities; and provide for corrective action and financial assurance as appropriate.

Community-Based Independence for Seniors Act of 2015 This bill amends title XVIII (Medicare) of the Social Security Act to establish a Community-Based Institutional Special Needs Plan demonstration program through which up to five eligible Medicare Advantage (MA) organizations shall provide home and community-based care to eligible Medicare beneficiaries. For purposes of the demonstration program, an eligible Medicare beneficiary is ineligible for Medicaid and unable to perform two or more activities of daily living. The Centers for Medicare & Medicaid Services (CMS) shall establish payment rates for eligible MA plans under the demonstration program. Such payment rates are capped but shall be in addition to payments otherwise made to MA organizations with respect to such plans. CMS shall also: (1) help to educate eligible Medicare beneficiaries on the availability of the program, and (2) provide for program evaluation by an independent third party.

Stop Foreign Donations Affecting Our Elections Act This bill amends the Federal Election Campaign Act of 1971 to prohibit political committees from accepting any Internet credit card contribution unless: the individual or entity making the contribution is required, at the time of the contribution, to disclose the credit card's verification value; and the billing address associated with the card is located in the United States or, if the contribution comes from an individual U.S. citizen living outside of the United States, the individual gives the committee the U.S. mailing address he or she uses for voter registration. In the case of an Internet credit card contribution: the person receiving the contribution shall forward it to the treasurer of the political comittee within 10 days, together with the name and address of the contributor and the date of receipt; and the treasurer shall keep an account of the contributor's name and address, together with the date and amount of the contribution.

Clean Energy Victory Bond Act of 2015 This bill directs the Department of the Treasury to issue, and promote the purchase of, Clean Energy Victory Bonds to pay for the energy-related tax benefits established or extended by this Act. The bill amends the Internal Revenue Code to: extend through 2023 the tax credit for investment in solar energy property, geothermal heat pumps, fuel cell property, microturbine property, combined heat and power system property, and small wind energy property; allow an energy tax credit for investment in offshore wind facilities placed in service before January 1, 2022; extend through 2024 the tax credit for residential energy efficiency improvements; extend through 2023 the placed-in-service requirement for wind facilities and other renewable energy facilities for purposes of the tax credit for producing electricity from renewable resources; extend through 2023 the tax credit for nonbusiness residential energy property; allow a new tax credit, through 2024, for home energy efficiency improvements that increase energy efficiency by at least 20%; extend through 2023 the tax credit for new energy efficient homes; and increase, and extend through 2023, the tax deduction for energy efficient commercial buildings. The bill directs the Department of Energy to establish a voluntary voucher program, through 2018, for the purchase of plug-in electric vehicles.

SENIORS Act of 2015

Saving the Earnings and Noting the Investment of Our Retired Seniors Act of 2015 or the SENIORS Act of 2015 This bill expresses the sense of Congress on a cost-of-living increase to Social Security benefits for seniors. The Department of the Treasury shall disburse a one-time payment to certain individuals who are entitled to a benefit under title II (Old Age, Survivors and Disability Insurance) of the Social Security Act (SSAct), an annuity under the Railroad Retirement Act of 1974, or a veterans benefit, or are eligible for a cash benefit under SSAct title XVI (Supplemental Security Income). The amount disbursed shall be 12% of the amount of such benefit payment or SSI cash benefit payable to the individual for November 2015. The Internal Revenue Code is amended to require a Social Security number to claim the refundable portion of the child tax credit. As offsets for these payments: all balances under the United States Enrichment Corporation Fund are hereby permanently rescinded; of the amounts obligated, but not expended, under the Emergency Economic Stabilization Act of 2008 for the Making Home Affordable Program, Treasury shall transfer $2.5 million to the general fund of the Treasury; and of the funds made available to the Department of Energy under the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 for the Advanced Technology Vehicles Manufacturing Loan Program Account for the cost of direct loans as authorized by the Energy Independence and Security Act of 2007, the unobligated balance is hereby rescinded.

Seniors And Veterans Emergency (SAVE) Benefits Act This bill directs the Department of the Treasury to disburse a payment equal to 3.9% of the average amount of annual benefits to certain individuals (except prisoners, fugitive felons, or aliens) who are entitled to a specified benefit under title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act (SSA), an annuity under the Railroad Retirement Act of 1974, a veterans benefit, or are eligible for a cash benefit under SSA title XVI (Supplemental Security Income), including a special benefit for individuals who perform substantial gainful activity despite severe medical impairment. A refundable income tax credit is allowed for the first taxable year beginning in 2015 in an amount equal to $581 for certain eligible government retirees who do not receive such a payment. The Internal Revenue Code is amended, with respect to the $1 million limitation on the deductibility of employee compensation, to: eliminate the exemption from that limitation for compensation payable on a commission basis or upon the attainment of a performance goal; extend the limitation to any individual who is a current or former officer, director, or employee of a publicly-held corporation; and apply the limitation to all publicly-held corporations required by the Securities and Exchange Commission to register securities and provide periodic reports to their investors.

Bring the Ancient One Home Act of 2015 This bill directs the Chief of the Army Corps of Engineers to transfer the human remains known as Kennewick Man or the Ancient One that are part of archaeological collection number 45BN495 to the Washington State Department of Archaeology and Historic Preservation on the condition that such Department disposes of and repatriates the remains to the Indian tribes and band referred to in the letter from Secretary of the Interior Bruce Babbitt to Secretary of the Army Louis Caldera relating to the human remains, dated September 21, 2000. The Corps of Engineers shall be responsible for any costs associated with the transfer.

Secure Refugee Process Act of 2015 This bill declares that no alien shall be admitted as a refugee: whose identity has not been satisfactorily established pursuant to Department of Homeland Security procedures, which shall address any insufficient, conflicting, or unreliable information, including biographic and biometric data that is unresolved at the time of admission; and if, by the time of admission, the alien's identity has not been checked against specified federal records or databases to determine any national security, criminal, or other grounds on which the alien may be inadmissible. An alien may only be admitted as a refugee after DHS certifies that all provisions of this Act have been complied with and that the alien has not been firmly resettled in a safe third country. DHS shall report to Congress monthly regarding the total number of refugee applicants of special interest and the number of such applicants whose applications were denied. The Inspector General of DHS shall conduct an annual risk-based review of a sampling of certifications and report its findings to Congress.

Jason Simcakoski PROMISE Act

Promoting Responsible Opioid Management and Incorporating Scientific Expertise Act or the Jason Simcakoski PROMISE Act This bill directs the Department of Veterans Affairs (VA) and the Department of Defense (DOD) to jointly update the VA/DOD Clinical Practice Guideline for Management of Opioid Therapy for Chronic Pain, including guidelines regarding: prescribing opioids for outpatient treatment of chronic, non-cancer pain; contraindications for opioid therapy; treatment of patients with post-traumatic stress disorder, psychiatric disorders, or a history of substance abuse or addiction; case management for patients transitioning between inpatient and outpatient health care and between DOD and non-DOD health care; routine and random urine drug tests to help prevent substance abuse; and options to augment opioid therapy with other clinical and complementary and integrative health services to minimize opioid dependence. The VA shall: expand the opioid safety initiative to include all VA medical facilities, including providing employees with pain management training, and establishment of pain management teams; track and monitor opioid use, including through the use of state program information; increase the availability of Food and Drug Administration-approved opioid receptor antagonists; modify the computerized patient record system to ensure that any health care provider that accesses a veteran's record will be immediately notified whether the veteran is receiving opioid therapy and has a history of substance use disorder or opioid abuse; establish standard protocols for the designation of pain management teams at each VA medical facility; carry out a pilot program to assess the feasibility of using wellness programs to complement pain management and related health care services to veterans; carry out a program of internal audits to improve health care services to veterans and their families; and provide to the medical board of each state in which a VA health care provider is licensed information about such provider's medical license violations. The Creating Options for Veterans' Expedited Recovery Commission is established to examine the evidence-based therapy treatment model used by the VA for treating mental health conditions of veterans and the potential benefits of incorporating complementary alternative treatments available in non-VA facilities. The Government Accountability Office shall report to Congress on the VA's opioid safety initiative and patient advocacy program. The VA shall request from the medical board of each state in which a prospective health care provider has a medical license information on: (1) medical license violations during the past 20 years, and (2) any settlement agreements for a medical-related disciplinary charge.

Department of Veterans Affairs Veterans Education Relief and Restoration Act of 2015 This bill declares that, if a veteran is forced to discontinue a course as a result of a a permanent school closure and did not receive credit or lost training time toward completion of the education program, Department of Veterans Affairs (VA) educational assistance payments shall not, for a specified period of time, be: charged against the individual's entitlement to educational assistance, or counted against the aggregate period for which such assistance may be provided. The bill applies to courses and programs of education discontinued beginning with FY2015. The VA may continue to pay educational assistance and subsistence allowances to eligible veterans and eligible persons enrolled in specified courses for up to 4 weeks in any 12-month period when schools are temporarily closed under an established policy based on an executive order of the President or due to an emergency situation. The VA may also continue to pay a monthly housing stipend following a permanent school closure, but only until the earlier of: (1) the date of the end of the term, quarter, or semester during which the school closure occurred; and (2) the date that is four months after the school closure.

Gun Violence Research Act This bill amends the Public Health Service Act to specifically include injuries from gun violence as a research subject for the Centers for Disease Control and Prevention (CDC). Nothing in the CDC's research authorization may be construed to authorize support for advocacy or promotion of gun control. The CDC must improve the National Violent Death Reporting System, particularly through the voluntary participation of additional states. Nothing in the Patient Protection and Affordable Care Act may be construed to prohibit a health care provider from discussing guns or gun safety with a patient or reporting a patient's threat of violence.

Early Childhood Nutrition Improvement Act

Early Childhood Nutrition Improvement Act This bill amends the Richard B. Russell National School Lunch Act to revise several provisions related to the child and adult care food program. Under current law: (1) an institution that provides child or day care under the program may be reimbursed for up to two meals and one supplement per day per child; and (2) a family or group day care home sponsoring organization may receive the same maximum reimbursement, but only with respect to a child maintained in a child care setting for at least eight hours per day. The bill eliminates this distinction between institutions and sponsoring organizations, and increases maximum reimbursement for both to: (1) two meals and one supplement or one meal and two supplements per day per child; or (2) three meals and one supplement or two meals and two supplements per day per child, for each child maintained in a child care setting for at least eight hours per day. A determination of a for-profit day care center's eligibility to participate in the program shall be in effect for six months. The Department of Agriculture (USDA) must issue guidance and, as appropriate, regulations to assist in ensuring a fair and effective process for the identification, review, and correction of serious program deficiencies. USDA shall establish an advisory committee to examine the feasibility of reducing unnecessary or duplicative paperwork for those participating or seeking to participate in the program.

Information Reporting Simplification Act of 2015 This bill amends the Internal Revenue Code, with respect to penalties for filing erroneous tax returns, to set forth a safe harbor rule for errors on tax information returns and payee statements. If any such return or statement has one or more incorrect dollar amounts, but no single amount in error differs from the correct amount by more than $100, and no single amount reported for tax withheld on any information return differs from the correct amount by more than $25, then no correction shall be required and such return or statement shall be treated as having been filed with all of the correct required information.

Historic Tax Credit Improvement Act of 2015 This bill amends the Internal Revenue Code, with respect to the tax credit for the rehabilitation of buildings and historic structures, to: (1) allow an increased 30% credit, up to $750,000, for projects with rehabilitation expenditures not exceeding $3.75 million, for which no credit was allowed in either of the 2 prior taxable years (smaller projects); (2) allow the transfer of tax credit amounts for smaller projects; (3) treat a building as substantially rehabilitated if rehabilitation expenditures exceed the greater of 50% of the adjusted basis of the building or $5,000 (currently, the greater of the adjusted basis of the building or $5,000); (4) exempt from tax the proceeds of a state historic tax; and (5) set forth special rules for the tax treatment of tax-exempt use property and functionally-related historic structures.

Security and Financial Empowerment Act of 2015 This bill amends the Violence Against Women Act to require the National Resource Center on Workplace Response provide information and assistance through domestic violence or sexual assault coalitions and survivor service organizations. These organizations and coalitions shall provide resource materials and assistance to employees, employers, and labor organizations to aid in efforts to develop adequate workplace responses to domestic and sexual violence. In addition, the bill requires employers to provide employees 30 days of leave per year, including 56 hours of earned paid leave, which can be used as a result of domestic violence, dating violence, sexual assault, or stalking of an employee or an employee's family member. States may provide nonrecurring short-term emergency benefits to employees using such leave. Survivors' Employment Sustainability Act The Survivors' Employment Sustainability Act prohibits employers, public benefit agencies, and insurers from discriminating against survivors of: domestic violence, dating or sexual violence, sexual assault, or stalking. Under the Internal Revenue Code, employers must give unemployment compensation to survivors who are separated from work due to conditions related to the individuals being survivors. The bill amends title IV part A (Temporary Assistance for Needy Families) (TANF) of the Social Security Act to require state agency personnel that administer TANF programs to be adequately trained to assist survivors seeking assistance. The Department of Health and Human Services (HHS) must study the barriers survivors encounter to maintain economic security. HHS may arrange financial literacy support for survivors. The Department of Labor must establish a public outreach campaign.

Stolen Identify [ sic ] Refund Fraud Prevention Act of 2015 This bill amends the Internal Revenue Code to: (1) require returns relating to employee wage statements, payment of wages in the form of group-term life insurance, and any payments required to be reported on Form 1099-MISC with respect to non-employee compensation to be filed on or before February 15 of the year following the calendar year to which such returns relate; (2) require the Department of the Treasury to notify a taxpayer of an unauthorized use of the identity of such taxpayer and any criminal charges relating to such unauthorized use; (3) require a taxpayer identifying number on W-2 forms instead of a Social Security number; and (4) impose a criminal penalty on any person who willfully misappropriates another person's taxpayer identity. The Internal Revenue Service (IRS) shall: (1) ensure that taxpayers who have been adversely affected by identity theft have a centralized point of contact at the IRS, (2) implement a program to allow a taxpayer who has filed an identity theft affidavit to elect to prevent the processing of any tax return submitted in an electronic format by the taxpayer or a person purporting to be the taxpayer, and (3) report biannually to congressional tax committees on taxpayer identity theft and tax refund fraud and actions taken to combat it. The bill amends the Social Security Act to allow the IRS access to information in the National Directory of New Hires for the sole purpose of identifying and preventing fraudulent tax return filings and claims for tax refunds.

Revises the list of activities of national significance for families and other caregivers, for which the Administration's grants may be used, to specify those provided to individuals with greatest social need which: (1) address physical and mental health, disabilities, and health disparities; (2) provide long-term care, including in-home and community-based care; (3) provide informal care and formal care in a facility setting; (4) provide access to culturally responsive health and human services; and (5) address other gaps in assistance and issues of particular importance to older individuals with the greatest social need. Requires a State Long-Term Care Ombudsman to collect and analyze discrimination data with respect to LGBT older individuals in the admission to, transfer or discharge from, or lack of adequate care provided in long-term care settings.

Under current law, the Centers for Medicare & Medicaid Services must annually determine the monthly actuarial rate upon which Part B premiums and deductibles are based. The bill temporarily freezes that rate at the 2015 level for enrollees, effectively preventing increases to premiums and deductibles for those enrollees in 2016. (Current law already protects Part B enrollees whose benefits are deducted from their Social Security benefits from premium increases that would result in a smaller Social Security check.)

The U.S. government, through USAID and other relevant executive branch agencies, should identify and remove financial barriers to strengthen access to delivery systems for vulnerable and marginalized populations by leveraging public and private capital to expand delivery of interventions for maternal, newborn, and child health.

National Park Service Centennial Act

National Park Service Centennial Act This bill establishes the National Park Centennial Challenge Fund in the Treasury to finance signature projects and programs to enhance the National Park System (NPS) as it approaches its centennial in 2016. There is also established in the Treasury a Public Lands Centennial Fund. The Department of the Interior and the Department of Agriculture shall jointly establish a program under which funds from the Centennial Fund are made available to federal land or water management agencies to support projects that: enhance visitor services and outdoor recreational opportunities, restore lands and waters, repair facilities or trails, or increase energy and water efficiency. National Park Foundation Endowment Act The National Park Foundation shall establish the Second Century Endowment for the National Park Service. The National Park Service Second Century Fund is established in the Treasury. Interior shall undertake a broad program of the highest quality interpretation and education. The Public Lands Corps Act of 1993 is amended to increase from 25 to 30 the age limit for participants in the Public Lands Corps. This bill makes permanent the Volunteers in the Parks Program. Interior may establish a Visitor Services Management Authority (VSMA) to administer commercial visitor services programs and activities of the NPS, including the award and administration of commercial visitor facilities and services management contracts pursuant to this Act. A VSMA revolving fund is established for expenses necessary for the management, improvement, enhancement, operation, construction, and maintenance of commercial visitor services and facilities and payment of possessory interest and leasehold surrender interest.

Big Cat Public Safety Act

Big Cat Public Safety Act This bill amends the Lacey Act Amendments of 1981 to prohibit any person from breeding or possessing any live animal of any prohibited wildlife species (i.e., any live species of lion, tiger, leopard, cheetah, jaguar, or cougar or any hybrid of such species). Breeding means facilitating propagation or reproduction (whether intentionally or negligently), or failing to prevent propagation or reproduction. The bill extends forfeiture provisions to fish, wildlife, or plants that are bred or possessed. The bill revises the list of entities that are exempt from Lacey Act prohibitions to include: institutions accredited by the Association of Zoos and Aquariums; certain facilities that have an active written contract with an Association of Zoos and Aquariums Species Survival Plan or Taxon Advisory Group for breeding prohibited wildlife species; persons who do not allow the transportation and display of prohibited wildlife species off-site; current owners of animals that were born before this bill's enactment if the animals are registered with the Animal and Plant Health Inspection Service within 180 days; and certain traveling circuses that hold Class C licenses under the Animal Welfare Act. Entities exempt from Lacey Act prohibitions must require that current owners and circuses not allow direct contact between the public and the prohibited wildlife species.

WAGE Act

Workplace Action for a Growing Economy Act or the WAGE Act This bill amends the National Labor Relations Act to require the National Labor Relations Board (NLRB) to award back pay and additional liquidated damages equal to double the back pay, without any reduction, to any employee against whom an employer has discriminated with regard to hiring or because the employee has filed charges or given testimony or if the employer has committed an unfair labor practice resulting in the employee's discharge or other serious economic loss. Civil penalties are established for violations of posting requirements and any violations causing serious economic loss to employees. Whenever it is charged that an employer has engaged in an unfair labor practice that significantly interferes with, restrains, or coerces employees in the exercise of guaranteed rights and involves discharge or other serious harm to an employee, the preliminary investigation of the charge shall be made forthwith and given priority generally over all other cases. The U.S. district court shall: (1) have jurisdiction to grant injunctive relief or a temporary restraining order to protect the rights guaranteed, and (2) shall grant the relief requested unless the court concludes that there is no reasonable likelihood that the NLRB will succeed on the merits of the NLRB's claim. A person injured by an unfair labor practice may bring a civil action in the appropriate district court. Unauthorized aliens may be paid back pay under a court order directing reinstatement of an employee. In any case where the NLRB finds that an election to determine a collective bargaining representative should be set aside because the employer committed a violation or otherwise interfered with a fair election, it shall issue an order requiring the employer to collectively bargain with the labor organization. The NLRB shall dismiss any petition to represent a unit if in an election a majority of the valid votes cast in an appropriate unit have not been cast in favor of representation by the labor organization. The NLRB shall promulgate regulations requiring each employer to post and maintain, in conspicuous places, a notice setting forth the rights and protections afforded employees under such Act. Each order of the NLRB shall take effect 30 days after notice of an NLRB order is given, unless the NLRB directs otherwise. The NLRB shall apply to the district court in which an unfair labor practice or other subject of the order occurred for the enforcement of an order if any person or entity fails or neglects to obey it.
