Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to support research on and facilitate access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Collaborative for Neurodegenerative Diseases, which shall support the development and regulatory approval of drugs that address ALS and other rare neurodegenerative diseases.

Health and Fitness Recovery Act of 2020 This bill establishes through December 31, 2020, and provides funding for the Health Club Recovery Fund, from which the Department of the Treasury shall make grants to eligible health and fitness facilities to provide relief during the COVID-19 (i.e.,coronavirus disease 2019) pandemic. For the grant program's initial period, Treasury must (1) prioritize awarding grants to entities serving marginalized and underrepresented communities, and (2) only award grants to eligible health and fitness facilities with annual revenues of less than $1.5 million. Further, an entity that received a loan under the Paycheck Protection Program established to support small businesses in response to COVID-19 may not apply for or use grant amounts for the same expenses for which it received the paycheck protection loan. Allowable uses for grant amounts include payroll costs, mortgage or rent payments, utilities, and maintenance expenses.

Independent Advisory Committee Review of E-Cigarette Applications Act This bill requires the Food and Drug Administration (FDA) to refer to the Tobacco Products Scientific Advisory Committee certain applications for premarket review of a new tobacco product, such as an e-cigarette. (Currently, the FDA may refer an application to the committee but is generally not required to do so.) The FDA shall notify the committee when receiving such an application. If the FDA intends to issue an order on an application, the FDA shall refer the application to the committee. With respect to a referred application, the committee shall make a public vote and issue recommendations about the application. The committee must also make public a list of all applications for premarket review of new tobacco products.

Specifically, the bill sets forth provisions to address management reform and accountability, including the establishment of an Office of Biometric Identity Management within the Management Directorate of DHS; intelligence and information sharing, including requiring annual assessments of the terrorist threat to the homeland; cybersecurity, including the establishment of a Cybersecurity Advisory Committee within the Cybersecurity and Infrastructure Security Agency; border and visa security, including directing U.S. Customs and Border Protection to hire specified numbers of agents and authorizing an immigration advisory program to assist air carriers and security employees at foreign airports with review of traveler information during the processing of U.S.-bound flights; transportation security, including requiring the Transportation Security Administration to establish a task force to analyze emerging and potential future threats and requiring DHS to prioritize the research and facilitation of next generation technologies to detect explosives in the nation's surface transportation systems; emergency preparedness, response, and recovery, including modifying specified grant programs and reauthorizing the Federal Emergency Management Agency (FEMA); and pandemic preparedness, including establishing a medical countermeasures program to facilitate personnel readiness and protection for DHS employees and working animals and individuals in its care and custody, in the event of a chemical, biological, radiological, nuclear, or explosives attack, naturally occurring disease outbreak, or pandemic, and to support DHS mission continuity.

The standardization shall permit an individual to (1) enroll at a TSA-designated universal enrollment center once and use the application for one of such programs to enroll in two or more of such programs, (2) pay a fee that is less than the sum of the fees charged individually for each separate application, and (3) undergo a streamlined and expeditious renewal process. Long Island All-Water Helicopter Route Act of 2020 This bill extends the special air traffic rule for civil helicopters operating under visual flight rules (VFR) along the North Shore in Long Island, New York to use the New York North Shore Helicopter Route. (VFR are a set of regulations under which a pilot operates an aircraft in weather conditions generally clear enough to allow the pilot to see where the aircraft is going.) The Federal Aviation Administration (FAA) must conduct a rulemaking proceeding to promulgate a new special air traffic rule for civil helicopters operating VFR along the North Shore and South Shore of Long Island, New York in accordance with specified requirements of the bill. A person who pilots a civil helicopter operating VFR along Long Island, New York's northern shoreline or southern shoreline may deviate from the North Shore Helicopter Route or South Shore Helicopter Route requirements: (1) for safety or weather conditions; or (2) when transitioning to or from a destination or point of landing, except for on the North Shore Helicopter Route when departing from or arriving to certain locations. If safety or weather conditions cause a person piloting a civil helicopter operating VFR to deviate from either route, the person must submit a one page report to the FAA identifying the condition not later than 14 days after landing.

Defend COVID Research from Hackers Act This bill authorizes the President to impose visa-blocking, property-blocking, or economic sanctions on a foreign person that is involved in activities that are reasonably likely to result in a significant threat to U.S. national security, foreign policy, public health, economic health, or financial stability. The Department of State must submit a report detailing the extent of known or attempted cyber-enabled activities by foreign persons related to COVID-19 (i.e., coronavirus disease 2019) and assessing whether those activities qualify for the imposition of sanctions. Further, the bill provides penalties for a person who knowingly traffics in access to a protected computer if the trafficker knows the protected computer has been damaged in a prohibited manner. The bill also authorizes an injunction against a person who causes damage through accessing a protected computer or transmitting a program, information, code, or command to a protected computer.

Edith Shorougian Senior Victims of Fraud Compensation Act This bill adds a new source of revenue for the Crime Victims Fund and expands the allowable use of victim compensation grant funds. Specifically, the bill directs any monetary payment made to the federal government as a fine or penalty under a deferred prosecution agreement, non-prosecution agreement, or other settlement agreement in relation to an alleged criminal act to be deposited into the fund. Additionally, the bill allows victim compensation grant funds to be used to compensate elderly victims for property loss resulting from financial fraud, abuse, or exploitation. Currently, victim compensation grant funds may not be used to compensation for property loss (with limited exceptions). An elderly victim is a victim who is at least 60 years of age.

Coronavirus Economic Relief for Transportation Services Act This bill requires the Department of the Treasury to provide grants and other forms of emergency assistance to certain providers of transportation services that have experienced a significant revenue loss as a direct or indirect result of COVID-19 (i.e., coronavirus disease 2019). Treasury must ensure equal access to the assistance for small, minority-owned, and women-owned businesses. As a condition of receipt of assistance, Treasury must require that a provider of transportation services agree to (1) use the funds, on a priority basis, to maintain through December 31, 2020, pay, paid administrative leave, and benefits to all employees after making any adjustments required for retirement or voluntary employee separation; and (2) recall or rehire any employee laid off, furloughed, or terminated because of reduced service as a result of COVID-19, to the extent warranted by increased service levels.

The COVID-19 Hospital and Health Provider Loan Forgiveness Act of 2020 This bill establishes and otherwise modifies requirements for the Medicare Accelerated and Advance Payment Program during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). The program provides Medicare payments in advance to eligible providers experiencing claims or cash flow disruptions, such as during national emergencies; the program was specifically expanded in response to COVID-19 to encompass more types of providers, subject to certain recoupment and repayment provisions. The bill requires the Centers for Medicare & Medicaid Services to waive recoupment and repayment for providers who meet specified requirements. Among other criteria, providers must not have engaged in surprise billing practices with respect to COVID-19 patients. Providers must still repay any amounts not used for COVID-19 expenses; the bill caps the interest rate on such repayments at 2% upon a demonstration of hardship. The bill also requires private health insurers to treat out-of-network COVID-19 services as in-network for purposes of payment and cost-sharing.

Promising Pathway Act

Promising Pathway Act This bill establishes a provisional approval pathway for medicines intended for serious or life-threatening diseases, including illnesses posing a threat of epidemic or pandemic. The period of the provisional approval is for two years and is potentially renewable. The Food and Drug Administration (FDA) must establish a priority review system to evaluate completed provisional approval applications within 90 days of receipt. A provisional approval application may be approved if the FDA determines that (1) there is substantial evidence of safety for the drug; and (2) there is relevant early evidence of efficacy, based on adequate and well-controlled investigations. During the COVID-19 (i.e., coronavirus disease 2019) pandemic, or another epidemic or pandemic, the FDA must accept and review various portions of a provisional approval application on a rolling basis. The manufacturer of a provisionally approved drug must require patients to participate in an observational registry. A manufacturer that fails to comply with registry requirements is subject to civil penalties. A provisionally approved drug must be labeled as such. If a drug that receives provisional approval status is not brought to market within 180 days of the approval, the approval must be rescinded. The bill also limits the liability of a manufacturer of a provisionally approved drug with respect to any claim under state law alleging that the drug is unsafe or ineffective. Private health insurers and federal health care programs shall not deny coverage of a provisionally approved drug on the basis of it being experimental.

Great American Outdoors Act

Great American Outdoors Act This bill establishes the National Parks and Public Land Legacy Restoration Fund to support deferred maintenance projects on federal lands. For FY2021-FY2025, there shall be deposited into the fund an amount equal to 50% of all federal revenues from the development of oil, gas, coal, or alternative or renewable energy on federal lands and waters. Deposited amounts must not exceed $1.9 billion for any fiscal year. The fund must be used for priority deferred maintenance projects in specified systems that are administered by the National Park Service, the Forest Service, the U.S. Fish and Wildlife Service, the Bureau of Land Management, and the Bureau of Indian Education. The Government Accountability Office must report on the effect of the fund in reducing the backlog of priority deferred maintenance projects for the specified agencies. Additionally, the bill makes funding for the Land and Water Conservation Fund (LWCF) permanent. The President shall annually report to Congress specified details regarding the allocation of funds to the LWCF. Congress may provide for alternate allocations using specified procedures.

Accelerating Access to Critical Therapies for ALS Act This bill establishes a grant program, as well as a new center within the Food and Drug Administration (FDA), to facilitate access to investigational therapies for neurodegenerative diseases such as amyotrophic lateral sclerosis (i.e., ALS, also known as Lou Gehrig's disease, a progressive and fatal disease). Specifically, the Department of Health and Human Services (HHS) must award grants for the provision of investigational drugs for ALS and other rapidly progressing neurodegenerative diseases through an expanded access (i.e., compassionate use) program. HHS may award these grants to (1) a small business that is the sponsor of an investigational new drug application, or (2) a participating clinical trial site for such a sponsor. Additionally, HHS must establish within the FDA a Center of Excellence for Neurodegenerative Diseases. The center shall have duties and authorities similar to those of the FDA's Oncology Center of Excellence, which helps expedite the development of medical products and assists providers in requesting access to investigational drugs.

Terms for such loans shall include (1) a 15-year term, (2) no requirement to provide collateral or a guaranty, and (3) a maximum loan amount of $25 million. An applicant for such a loan must make a good faith certification that, among other things, (1) the loan request is necessary to support the recipient's ongoing operations; and (2) the recipient will use the loan for purposes directly connected to contracted services, including performances and sporting events.

Paycheck Protection Program Flexibility Act of 2020

Paycheck Protection Program Flexibility Act of 2020 This bill modifies provisions related to the forgiveness of loans made to small businesses under the Paycheck Protection Program implemented in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill establishes a minimum maturity of five years for a paycheck protection loan that has a remaining balance after the application of forgiveness. The bill also extends the covered period during which the recipient of a paycheck protection loan may use such funds for certain expenses while remaining eligible for forgiveness of the loan. Further, the bill prohibits the Small Business Administration from limiting the non-payroll portion of a forgivable covered loan amount. Currently, only 25% of a paycheck protection loan may be allocated to non-payroll expenses such as rent and utilities. The bill extends the period of time in which an employer may rehire or eliminate a reduction in employment, salary, or wages that would otherwise reduce the forgivable amount of a paycheck protection loan. State Municipal Assistance for Response and Transition Act or the SMART Act This bill provides $500 billion for a Coronavirus Local Community Stabilization Fund to address the economic effects of the COVID-19 (i.e., coronavirus disease 2019) pandemic on state, local, and tribal budgets. The bill also expands the uses of payments from the Coronavirus Relief Fund. The bill allows a jurisdiction to use funding from the Coronavirus Local Community Stabilization Fund or Coronavirus Relief Fund for (1) necessary expenditures related to COVID-19 that were not accounted for in the jurisdiction's budget, including the nonfederal share contribution requirement for disaster or emergency assistance; or (2) expenditures the jurisdiction would otherwise be unable to make because of decreased or delayed revenues. Funding from the Coronavirus Local Community Stabilization Fund may be used for expenditures through 2022. The bill (1) reserves specified funds for payments to tribal governments; (2) apportions funds to states based on population, infected population, and revenue lost; (3) provides for payments to counties and municipalities based on lost revenue. The bill conditions funding on each state agreeing to fair and equitable budgeting based on need. The Office of Inspector General of the Department of the Treasury may use amounts appropriated to carry out oversight and recoupment activities under this bill.

Paycheck Protection Program Flexibility Act of 2020 This bill modifies provisions related to the forgiveness of loans made to small businesses under the Paycheck Protection Program implemented in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill establishes a minimum maturity of five years for a paycheck protection loan that has a remaining balance after the application of forgiveness. The bill also extends the covered period during which the recipient of a paycheck protection loan may use such funds for certain expenses while remaining eligible for forgiveness of the loan. Further, the bill prohibits the Small Business Administration from limiting the non-payroll portion of a forgivable covered loan amount. Currently, only 25% of a paycheck protection loan may be allocated to non-payroll expenses such as rent and utilities. The bill extends the period of time in which an employer may rehire or eliminate a reduction in employment, salary, or wages that would otherwise reduce the forgivable amount of a paycheck protection loan. However, the forgivable amount must be determined without regard to a reduction in the number of employees if the recipient is unable to rehire an employee and is able to demonstrate an inability to hire a similarly qualified employee. Lastly, the bill eliminates a provision that makes a paycheck protection loan recipient who has such indebtedness forgiven ineligible to defer payroll tax payments.
