National Biological Diversity Conservation and Environmental Research Act

National Biological Diversity Conservation and Environmental Research Act - States that the conservation of biological diversity is a national priority. Requires Federal actions to be consistent with such goal. Amends the National Environmental Policy Act of 1969 to require that environmental impact statements on proposed Federal actions include any impacts on biological diversity. Requires Federal agencies to conduct annual reviews of their programs for consistency with the conservation of biological diversity pursuant to this Act and to report the results of such reviews to the President, the Council on Environmental Quality, and the Congress. Sets forth requirements for programs found to be inconsistent with this Act. Directs the President's Council on Environmental Quality to: (1) establish guidelines for consideration of biological diversity in the preparation of environmental impact statements; and (2) identify those biotic communities, species, and populations that appear to be in decline, in imminent danger of loss of viability, or otherwise of special concern. Directs the Administrator of the Environmental Protection Agency to review and comment on the adequacy of each environmental impact statement prepared under the National Environmental Policy Act of 1969 in assessing biological diversity impacts. Establishes a National Center for Biological Diversity and Conservation Research (Center) responsible for: (1) coordinating the collection of data pertaining to the national biota and supplementing and disseminating such information; (2) arranging and conducting surveys and supplementary research of the national biota; and (3) enhancing the application of biological data to the conservation of biological diversity. Establishes an Interagency Working Committee on Biological Diversity responsible for preparing a coordinated Federal strategy (Strategy) for conservation of biological diversity. Dissolves the Committee two years after this Act's enactment. Sets forth the required contents of such strategy and reporting requirements. Authorizes each agency represented on the Interagency Committee to provide grants to public agencies, private individuals, and organizations for projects to maintain or restore biological diversity. Requires that such grants be matched on at least an equal basis by the grantee, except when the grantee is a State or where the grant is provided for research. Directs each agency represented on the Interagency Committee to: (1) give high priority to research and personnel training directed towards implementation of the Strategy; and (2) assess the adequacy of its environmental research and training programs. Establishes, on a permanent basis, a National Scientific Advisory Committee on Biological Diversity which shall: (1) oversee the implementation of the Strategy; (2) advise the Interagency Committee and Federal agencies in the preparation and implementation of the Strategy; (3) assist in the coordination of interaction between Interagency Committee agencies and the Center; (4) assist in the evaluation of the impacts of proposed Federal activities on biological diversity; (5) assist in the review of Federal programs for consistency with the conservation of biological diversity and the adequacy of such programs in environmental research and training; and (6) serve as a general reference and advisory resource for the Nation in matters relating to conservation of biological diversity. Authorizes appropriations for the activities of the Center and the grant program for FY 1990 through 1992.

Rural Enterprise Zone Act of 1989

Rural Enterprise Zone Act of 1989 - Title I: Designation of Enterprise Zones - Amends the Internal Revenue Code to authorize the Secretary of Housing and Urban Development (Secretary) to designate rural enterprise zones for purposes of providing tax and regulatory relief and improving local services. Limits choices to areas nominated by States and local governments. Limits to 100 the total number of areas that may be designated, and the time period of the designation. Authorizes the Secretary to designate a zone only if the area meets certain locational, demographic, unemployment, and poverty criteria. Requires nominating local governments, as a condition of the Secretary's designation, to agree in writing to follow a course of action that may include reducing tax rates, improving local services, simplifying or streamlining regulation of business, and providing job training to area residents. Describes areas to which the Secretary must give preference in selecting areas for designation. Requires the Secretary to report to the Congress every four years on the effects of such enterprise zones' designation in accomplishing the purposes of this Act. Title II: Federal Income Tax Incentives - Subtitle A: Credits for Employers and Employees - Allows employers located in enterprise zones a nonrefundable income tax credit for qualified increased employment expenditures and employment of the disadvantaged. Sets the credit amount at ten percent of the increase in payroll plus a specified percentage of wages paid to certain disadvantaged workers through the first 20 years of the enterprise zone designation. Allows a nonrefundable income tax credit to enterprise zone employees for five percent of wages earned. Phases out both credits in the last four years of the enterprise zone designation. Subtitle B: Credits for Investment in Tangible Property in Enterprise Zones - Allows businesses an additional investment tax credit for investments made in certain enterprise zone construction property. Limits the credit to ten percent for new property, including rental property. Requires the recapture of credit amounts upon the early disposition of the property. Subtitle C: Nonrecognition of Qualified Enterprise Zone Capital Gain Where Acquisition of Enterprise Zone Business Property - Provides for the nonrecognition of capital gain on the sale of enterprise zone property if, within one year after the sale, the taxpayer acquires qualified replacement property (generally defined as property related to an enterprise zone or to a business within a zone). Subtitle D: Deduction for Purchase of Enterprise Stock - Allows a taxpayer to deduct up to $100,000 of the aggregate amount paid for the purchase of enterprise stock on its original issue by a qualified issuer. Requires any gain from the disposition of the stock to be treated as ordinary income. Subtitle E: Rules Relating to Industrial Development Bonds - Declares that: (1) limitations on the cost recovery deductions for property financed with tax-exempt bonds shall not apply to enterprise zone property; and (2) the termination of the small issue exemption shall not apply to bonds whose proceeds are used to finance facilities in enterprise zones. Requires that five percent of the private activity bond volume cap for a State that has one or more enterprise zones be set aside exclusively for use in such zones. Subtitle F: Ordinary Loss Deduction for Securities of Enterprise Zone Business Which Become Worthless - Permits an ordinary loss deduction for securities of enterprise zone business that become worthless during the taxable year. Subtitle G: Increase in Research Credit for Research Conducted in Enterprise Zones - Increases from 20 percent to 30 percent the tax credit for increasing research conducted in enterprise zones. Applies this subtitle retroactively to taxable years 1987 and thereafter. Subtitle H: Sense of the Congress with Respect to Tax Simplification - Expresses the sense of the Congress that the Secretary of the Treasury should simplify the administration and enforcement of any provision of the Internal Revenue Code affected by this Act. Subtitle I: Regulations - Directs the Secretary of the Treasury to issue regulations to carry out the provisions of this Act not later than six months after enactment. Title III: Regulatory Flexibility - Amends Federal law to revise the definition of "small entity" for purposes of the analysis of regulatory functions to include qualified business, government, and nonprofit enterprises operating within enterprise zones. Authorizes Federal agencies, upon request by a designating government, to waive or modify rules and regulations pertaining to the implementation of projects or activities within an enterprise zone. Requires agencies to approve the request if the resulting benefits of job creation, community development, or economic revitalization outweigh the public interest in retaining the rule unchanged. Disallows waiver or modification of a rule that would directly violate a statutory requirement or present a danger to the public health and safety. Amends the Department of Housing and Urban Development Act to direct the Secretary of Housing and Urban Development to promote the coordination of all enterprise zone programs and to consolidate all periodic reports required under such programs into one summary report. Title IV: Establishment of Foreign-Trade Zones in Enterprise Zones - Requires the Foreign-Trade Zone Board to consider on a priority basis and to expedite the processing of applications for the establishment of foreign-trade zones within enterprise zones. Requires the Secretary of the Treasury to give priority to, and expedite applications for, the establishment of ports of entry necessary to establish such zones. Title V: Enterprise Zone Business Incubator Program - Directs the Secretary of Housing and Urban Development to establish a business incubator program to provide loans and grants to State and local governments to give start-up assistance to small businesses in distressed rural areas.

Administrative Law Judge Corps Act

Administrative Law Judge Corps Act - Establishes, in Washington, D.C., an Administrative Law Judge Corps (the Corps) comprised of all current administrative law judges. States that the chief administrative law judge shall be the chief administrative officer of the Corps as well as its presiding judge. Specifies the qualifications for chief judge. States that such judge shall be appointed by the President, with the advice and consent of the Senate. Directs the chief judge to submit annual reports to the President and the Congress. Establishes divisions (to number between four and ten) within the Corps, with each division headed by a division chief judge appointed by the chief administrative law judge, with the approval of the Council of the Administrative Law Judge Corps (the first division chief judge of each division shall be appointed by the President, with the advice and consent of the Senate). Sets forth qualifications for division chief judges. Identifies initial divisions and their respective areas of jurisdiction. States that the Corps' policymaking body shall be the Council of the Corps (the Council), comprised of the chief judge and the division chief judges. Authorizes the Council to determine matters of general Corps policy, including: (1) issuance of regulations for Corps proceedings; (2) creation or abolition of divisions or regional offices; (3) contractual transactions; and (4) delegation of functions to division chief judges. Establishes a Judicial Nomination Commission to submit a list of qualified nominees for positions of chief judge and division chief judges. Prescribes a procedure for recommending appointments to the President. Directs the Corps to appoint new judges from a register maintained by the Office of Personnel Management. Confers jurisdiction upon members of the Corps to adjudicate cases under specified sections of the Administrative Procedure Act. Requires cases arising under such sections to be referred to the Corps. Directs the Council to issue regulations for assigning such cases. Provides guidelines for the removal and discipline of administrative law judges. Establishes a Complaints Resolution Board within the Corps to recommend action upon complaints against the official conduct of judges. Details the membership of such Board and the procedures to be followed. Declares Board proceedings and the contents of complaints to be privileged and confidential. Exempts documents and reports considered by the Board from the disclosure and publication requirements of the Freedom of Information Act. Exempts the Board from compliance with the public meeting requirements of specified Federal law. Authorizes appropriations.

Mount Rushmore Commemorative Coin Act

1991 Mount Rushmore Commemorative Coin Act - Requires the Secretary of the Treasury to issue a specified number of five-dollar gold coins, one-dollar silver coins, and half-dollar clad coins in commemoration of the Mount Rushmore National Memorial. Provides that such coins shall be considered legal tender. Requires the Secretary to begin issuing such coins on January 1, 1991. Directs the Secretary to obtain silver for the minting of such coins from stockpiles established under the Strategic and Critical Materials Stock Piling Act and to obtain gold pursuant to authority under existing law. Provides that the design of such coins shall be selected by the Secretary after consultation with the Mount Rushmore National Memorial Society of Black Hills. Specifies the sales price of such coins as the face value plus costs. Requires that all sales of such coins include a surcharge of $35 per coin for five-dollar coins, $7 per coin for one-dollar coins, and $1 for half-dollar coins. Requires that of the total surcharges received by the Secretary from the sale of such coins: (1) 50 percent shall be returned to the Treasury for purposes of reducing the national debt; and (2) 50 percent shall be paid to the Society to assist efforts to improve the Mount Rushmore National Memorial. Authorizes the Comptroller General to audit such payments. Requires the Secretary to ensure that the minting and issuance of such coins shall not result in any net costs to the Government.

Tongass Timber Reform Act - Title I: Alaska National Interest Lands Conservation Act Amendments - Repeals specified provisions of the Alaska National Interest Lands Conservation Act (the Act) relating to: (1) the authorization of appropriations for the maintenance of the timber supply from the Tongass National Forest in Alaska to dependent industry; (2) the identification of Forest lands unsuitable for timber production; and (3) a specified report to certain congressional committees by the Secretary of Agriculture on the timber supply and demand in southeastern Alaska. Amends the Act to include in a specified report to the Congress the impact of timber management on subsistence resources, wildlife, and fisheries habitats in the Forest. Requires the Secretary to terminate, not later than 90 days after enactment of this Act, specified timber sale contracts between the United States and the Alaska Pulp Corporation and the Ketchikan Pulp Company, respectively. Title II: Wilderness - Amends the Act to designate the following lands within the Tongass National Forest as components of the National Wilderness Preservation System: (1) Anan Creek Wilderness; (2) Berners Bay Wilderness; (3) Calder-Holbrook Wilderness; (4) Chichagof Wilderness; (5) Chuck River Wilderness; (6) Kadashan Wilderness; (7) Karta River Wilderness; (8) Kegan Lake Wilderness; (9) Naha River Wilderness; (10) Nutkwa Wilderness; (11) Outside Islands Wilderness; (12) Pleasant Island-Lemesurier Islands Wilderness; (13) Pt. Adolphus-Mud Bay Wilderness; (14) Pt. Medicare Adult Day Care Amendments of 1989 - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act to provide for the establishment of adult day care programs providing certain health services to chronically-impaired adults in a group setting outside their homes for up to 125 days on a less than 24-hour basis. Requires providers of such services to have a multidisciplinary group of health care personnel conduct a written assessment of the status of each chronically-impaired adult before the adult's admission to the program and thereafter periodically develop and coordinate an individualized treatment plan for, and with the cooperation of, the adult. Defines a "chronically-impaired adult" as an individual 18 years of age or older who has a physical, emotional, or mental impairment which, but for the provision of adult day care, would require the provision of care in a hospital, skilled nursing, or intermediate care facility. Makes deductibles inapplicable to adult day care, requiring only the payment of a specified coinsurance amount. Directs the Secretary of Health and Human Services to issue regulations regarding adult day care programs.

Amends title IV (National Research Institutes) of the Public Health Service Act to require the Director of the National Center for Nursing Research to acquire, construct, improve, or repair laboratories and other research facilities to increase the capacity of institutions of higher education to conduct nursing research. Authorizes the Secretary of Health and Human Services to make grants and enter into contracts for such purposes. Requires the Director, from amounts appropriated under this Act, to reserve 15 percent to carry out such purposes through grants to, and contracts with, institutions that received less than an aggregate of a specified amount in Federal financial assistance for research and development in the preceding two fiscal years. Requires matching funds, in cash or in kind, from non-Federal sources. Directs the Secretary to require technical and scientific peer review of applications for grants and contracts. Authorizes appropriations for FY 1990 through 1992.
