Positive Aging Act of 2005 - Amends the Older Americans Act of 1965 to direct the Assistant Secretary for Aging to establish the Office of Older Adult Mental Health Services within the Administration on Aging to develop and implement initiatives to address the mental health needs of older individuals. Directs the Assistant Secretary to make grants to: (1) states for systems to deliver mental health screening and treatment services to older individuals lacking access to such services and for programs to increase public awareness of the benefits of preventing and treating mental disorders; and (2) public and nonprofit private entities for demonstration projects providing mental health screening and treatment services to older individuals residing in rural areas or in naturally occurring retirement communities in urban areas. Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Director of the Center for Mental Health Services, to make grants to public and nonprofit private entities for: (1) demonstration projects integrating mental health services for older patients into primary care settings; and (2) multidisciplinary geriatric mental health outreach teams in community settings where older adults reside or receive social services. Requires the Director to designate a Deputy Director for Older Adult Mental Health Services. Requires membership of the advisory council for the Center for Mental Health Services to include representatives of older Americans, their families, and geriatric mental health specialists. Includes among projects of national significance the targeting of substance abuse by older individuals. Includes services for older individuals under community mental health services block grant state plan criteria.

Amends the Communications Act of 1934 to make federal provisions which prohibit the obligation or expenditure of funds either in excess of appropriated amounts or in violation of sequestration orders under the Balanced Budget and Emergency Deficit Control Act of 1986 inapplicable to: (1) any amount collected or received as federal universal service contributions; or (2) the expenditure or obligation of amounts attributable to such contributions.

Amends the Internal Revenue Code to extend through December 31, 2010, the income tax credit for biodiesel used as fuel and the excise credits for biodiesel mixtures and biodiesel used to produce biodiesel mixtures.

Combating Autism Act of 2005 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to establish: (1) a program to provide information and education on autism and its risk factors to health professionals and the general public; and (2) the Autism Coordinating Committee to coordinate autism related activities within the Department of Health and Human Services (HHS). Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration (HRSA), to award grants or cooperative agreements to develop statewide autism screening, diagnosis, and intervention programs and systems. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to award grants or cooperative agreements to provide technical assistance to state agencies to conduct applied autism research.

Fair Minimum Wage Act of 2005 - Amends the Fair Labor Standards Act of 1938 to increase the federal minimum wage to: (1) $5.85 an hour, beginning on the 60th day after enactment of this Act; (2) $6.55 an hour, beginning 12 months after that 60th day; and (3) $7.25 an hour, beginning 24 months after that 60th day. Makes federal minimum wage requirements applicable to the Commonwealth of the Northern Mariana Islands. Sets forth a transition period during which a specified minimum wage there shall be gradually increased to equal the federal minimum wage.

Pledge Protection Act of 2005 - Amends the Federal judicial code to deny jurisdiction to any Federal court, and appellate jurisdiction to the Supreme Court, to hear or decide any question pertaining to the interpretation of the Pledge of Allegiance or its validity under the Constitution. Makes this limitation inapplicable to: (1) any court established by Congress under its power to make needful rules and regulations respecting the territory of the United States; or (2) the Superior Court of the District of Columbia or the District of Columbia Court of Appeals.

Children's Access to Vision Act of 2005 - Authorizes the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to make grants to states for providing: (1) comprehensive eye examinations for children, with priority given to children under nine years old; (2) subsequent vision treatment or services to correct vision problems; and (3) educational materials to parents, teachers, and health care practitioners on recognizing signs of visual impairment in children. Directs the Secretary to: (1) develop criteria to collect data related to vision assessment and the utilization of follow-up services; and (2) coordinate the grant program with appropriate federal and state child services programs. Requires states to annually submit to the Secretary a program evaluation.

Preserving Patient Access to Physicians Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act with respect to payment for physicians' services to: (1) eliminate the sustainable growth rate payment update system; and (2) establish in its place an update to the single conversion factor for 2006 of at least 2.7 percent, and a formula for an update to the single conversion factor for years beginning with 2007. Requires the Secretary of Health and Human Services, in calculating the formula for the single conversion factor, to establish an input price index and estimate annually a productivity adjustment factor.

Clinical Research Act of 2005 - Requires the Director of the National Institutes of Health (NIH) to award clinical investigator advancement grants to eligible academic health centers to: (1) establish career development programs for new and mid-level clinician-investigators who are fully committed to academic clinical research careers; (2) support the translation of basic science to patient care by implementing and conducting all aspects of their clinical research mission; and (3) support activities leading to innovative ways to achieve such purposes in an efficient and cost-effective manner. Requires that health centers receive a proportionate share of the total grant money awarded based on the amount invested by the grantee in clinical research compared to the total clinical research investment of all grantees. Requires the Director to award clinical research infrastructure grants to eligible academic health centers to: (1) foster the use of information technology to facilitate the transformation of basic research findings on disease mechanisms into the development of new methodologies for diagnosis, therapy, and prevention; (2) address the obstacles impeding the expeditious application of new science, including a lack of up-to-date information technology systems and an underrepresentation of some populations in clinical research; and (3) share clinical research infrastructure across academic health centers to enable and facilitate cross-center clinical research collaborations. Allows the Secretary of Health and Human Services to make up to five grants to eligible academic health centers to form partnerships with health care providers for carrying out clinical human subject research to demonstrate how academic research centers may collaborate with the practicing health care community.

Breast Cancer and Environmental Research Act of 2005 - Amends the Public Health Service Act to require the Director of the National Institute of Environmental Health Sciences to make grants to public or nonprofit private entities for the development and operation of not more than eight centers to conduct multidisciplinary and multi-institutional research on environmental factors that may be related to the etiology of breast cancer. Requires each such center to: (1) be known as a Breast Cancer and Environmental Research Center of Excellence; (2) establish ongoing collaborations with community organizations; (3) be formed from a consortium of cooperating institutions; (4) be supported under this Act for a period of not more than five years with additional periods allowed after review and recommendation; and (5) use innovative approaches to study unexplored areas of the environment and breast cancer. Requires the Secretary of Health and Human Services to establish a Breast Cancer and Environmental Research Panel to make recommendations for and to review grants awarded under this Act.

Declares that the existence of racially restrictive covenants in housing documents is inconsistent with the principles and values embodied in Supreme Court precedent and the Fair Housing Act of 1968, and causes harm to not only property owners but to all members of American society. Commends California and the Missouri State Senate for taking roles in such covenants' removal. Urges States to enact laws that: (1) will more readily permit property owners to remove racially restrictive covenants from their property titles, deeds, or other documents; and (2) require homeowner associations to strike racially restrictive covenants from all declarations or other governing documents.

District of Columbia Fairness in Representation Act - Considers the District of Columbia as a congressional district for purposes of representation in the House of Representatives. Provides, until the taking effect of the first reapportionment occurring after the regular decennial census conducted for 2010, that: (1) the membership of the House shall be increased by two Members; and (2) each such Representative shall be in addition to such current membership; and (3) the State identified by the Clerk of the House in a specified report by the President to Congress shall be entitled to one additional Representative. Prohibits the temporary increase from: (1) increasing or decreasing the permanent membership of the House; (2) affecting the basis of reappointment established by Federal law; or (3) being taken into account in determining the number of electors with respect to the 2008 Presidential election. Amends the District of Columbia Delegate Act to eliminate the office of District of Columbia Delegate. Amends the District of Columbia Statehood Constitutional Convention Initiative of 1979 to eliminate the office of Statehood Representative.

Railroad Competition Improvement and Reauthorization Act of 2005 - Amends federal transportation law to specify the primary objectives of U.S. rail transportation policy. Requires a rail carrier, upon shipper request, to establish a rate for transportation and provide requested service between any two points on the carrier's system where traffic originates, terminates, or may reasonably be interchanged. Prohibits the Surface Transportation Board (STB) from issuing a certificate authorizing construction and operation of railroad lines, or exempting a person, class of persons, or a transaction or service from the certificate requirement, if such an activity involves a transfer of interest in a line of railroad from a Class I rail carrier to a Class II or III rail carrier, and the activity directly or indirectly would restrict: (1) the ability of the Class II or Class III rail carrier to interchange traffic with other carriers; or (2) competition of rail carriers in the region affected by the activity in a manner that would violate federal antitrust laws. Prescribes a procedure for shipper petition and STB review of any activity alleged to have resulted in a restriction of competition for at least ten years. Changes from discretionary to mandatory the STB's authority to require: (1) a rail carrier's terminal facilities to be used by another rail carrier subject to certain conditions; and (2) rail carriers to enter into reciprocal switching agreements. Prohibits the STB, in either instance, from requiring evidence of anticompetitive conduct by a rail carrier from which such access is sought. Requires the STB to designate any state or substantial part of a state as an area of inadequate rail competition after finding that: (1) it encompasses rail shipping origins and destinations served exclusively by one Class I railroad; and (2) persons that ship by rail or receive rail shipments in it pay rates exceeding a certain mark, or have experienced competitive disadvantage in the marketplace or other economic adversity because of high cost or poor rail service quality. Specifies actions the STB may take to resolve such anti-competitive conditions. Requires submission to arbitration of rail rate disputes. Requires the STB to adopt new methods for determining the reasonableness of rail rates. Establishes within the Department of Transportation (DOT) the Office of Rail Customer Advocacy. Requires the STB, in a proceeding involving the merger or control of at least two Class I railroads, to consider among other things the safety and environmental effect of the proposed transaction on local communities and rail passenger transportation.

American Veterans Disabled for Life Commemorative Coin - Directs the Secretary of the Treasury to mint and issue $1 silver coins emblematic of the design selected by the Disabled Veterans' LIFE Memorial Foundation for the American Veterans Disabled for Life Memorial, in commemoration of disabled American veterans. Expresses the sense of Congress that, to the greatest extent possible, the coins should be struck at the United States Mint at West Point, New York, Limits the period for coin issuance to the calendar year beginning on January 1, 2010. Imposes a $10 surcharge per coin, to be distributed to the Disabled Veterans' LIFE Memorial Foundation for the purpose of establishing an endowment to support the construction of American Veterans' Disabled for Life Memorial in Washington, D.C.

Water for the Poor Act of 2005 - Expresses the sense of Congress with respect to U.S. water and sanitation assistance programs. Amends the Foreign Assistance Act of 1961 to authorize the President to furnish assistance for programs in developing countries to provide affordable and equitable access to safe water and sanitation. Directs the Administrator of the United States Agency for International Development (USAID) to develop a strategy to further the U.S. foreign assistance objective of providing affordable and equitable access to safe water and sanitation in developing countries.

End Demand for Sex Trafficking Act of 2005 - Authorizes the Attorney General to award grants to states and political subdivisions to: (1) establish model law enforcement programs that promote the effective prosecution of persons who solicit an unlawful commercial sex act, persons who purvey others to engage in such an act, and sex traffickers; and (2) assist victims of such an act. Amends the federal criminal code to modify prohibitions against transportation for illegal sexual activity and related crimes (generally) and for coercion and enticement to engage in prostitution or criminal sexual activity to explicitly cover purchasers of commercial sexual activities and acts. Directs federal agencies involved in combating sex trafficking and providing services to victims of commercial sex acts inside the United States to coordinate their activities with the Senior Policy Operating Group established by the Victims of Trafficking and Violence Protection Act of 2000. Directs the Attorney General to: (1) report annually to the Senate and House Judiciary Committees regarding grants and evaluating success in enhancing the prosecution and conviction of purchasers, sex traffickers, and exploiters and in reducing demand for commercial sexual activity; (2) disseminate best methods and practices for training state and local law enforcement personnel involved in enforcing laws prohibiting commercial sexual acts at each annual conference conducted by the Department of Justice; and (3) carry out a biennial comprehensive statistical review and analysis of commercial sexual acts in the United States.

Medicare Mental Health Modernization Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to provide for: (1) elimination of the lifetime limit on inpatient mental health services; (2) parity in treatment for outpatient mental health services; (3) coverage of intensive residential services under Medicare part A (Hospital Insurance) and of intensive outpatient services under Medicare part B (Supplementary Medical Insurance); (4) exclusion of clinical social worker services from coverage under the Medicare skilled nursing facility prospective payment system; and (5) coverage of marriage and family therapist services and mental health counselor services under Medicare. Directs the Secretary of Health and Human Services to study and report to Congress on whether the criteria for coverage of any therapy service or any oupatient mental health care service under Medicare unduly restricts the access to such a service of any Medicare beneficiary with Alzheimer's disease or a related mental illness because the coverage criteria requires the Medicare beneficiary to display continuing clinicial improvement to continue to receive the service.

Export Freedom to Cuba Act of 2005 - Prohibits the President from regulating or prohibiting, directly or indirectly, travel to or from Cuba by U.S. citizens or legal residents, or any of specified transactions incident to such travel. Declares that: (1) this prohibition does not authorize the importation into the United States of any goods for personal consumption acquired in Cuba; and (2) the restrictions on authority contained in this Act do not apply in a case in which the United States is at war with Cuba, armed hostilities between the two countries are in progress, or there is imminent danger to the public health or the physical safety of U.S. travelers.

America's Red Rock Wilderness Act of 2005 - Designates specified lands in the following areas of Utah as components of the National Wilderness Preservation System: (1) Great Basin; (2) Zion and Mojave Desert; (3) the Grand Staircase and the Escalante Canyons; (4) Moab-LaSal Canyons; (5) Henry Mountains; (6) Glen Canyon; (7) San Juan-Anasazi; (8) Canyonlands Basin; (9) San Rafael Swell; and (10) Book Cliffs and Uinta Basin. Sets forth administrative provisions regarding: (1) filing by the Secretary of the Interior of a map and a legal description of each designated wilderness area with appropriate congressional committees; (2) the exchange of State-owned lands within such areas; (3) Federal reservation of water rights; (4) measurement of setbacks for roads with wilderness; (5) authorized livestock grazing; and (6) withdrawal of such lands from disposition under certain public land laws.

Great Cats and Rare Canids Act of 2005 - Directs the Secretary of the Interior to provide assistance for projects for the conservation of rare felids and rare canids. Authorizes the Secretary to convene an advisory group of individuals representing public and private organizations actively involved in the conservation of felids and canids. Restricts the use of grants for captive breeding or display purposes. Establishes in the Multinatonal Species Conservation Fund as a separate account the Great Cats and Rare Canids Conservation Fund. Defines "rare canid" to: (1) mean any canid species, subspecies, or population that is not native to the United States and Canada, and is included in the threatened or endangered lists of the World Conservation Union, the Convention on International Trade in Endangered Species of Wild Fauna and Flora, or the Endangered Species Act of 1973; and (2) include such a subspecies or population of dhole, gray wolf, ethiopian wolf, african wild dog, or maned wolf. Defines "rare felid" to: (1) mean any felid species, subspecies, or population that is not native to the United States and Canada, and is included in the threatened or endangered lists of the World Conservation Union, the Convention on International Trade in Endangered Species of Wild Fauna and Flora, or the Endangered Species Act of 1973; and (2) include such a subspecies or population of lion, leopard, jaguar, snow leopard, clouded leopard, cheetah, or iberian lynx. Does not include any tiger.

Obligation of Funds Transparency Act of 2005 - Prohibits a Federal agency from obligating funds made available in an appropriation Act to implement an earmark that is included in a congressional report accompanying such Act, unless the earmark is also included in that Act. Amends the Rules of the House of Representatives to prohibit waiver of the germaneness requirement for conference reports by a report by the Committee on Rules, unless approved by a vote of three-fifths of the Members voting, with a quorum being present. Limits debate on such a question to 20 minutes equally divided by a proponent and an opponent. States that the above also applies in the case of a special rule that waives all (or specified) points of order. Prohibits the Committee on Rules from reporting a rule or order waiving the above amendment to the rules.

Nonproliferation Treaty Enhancement Resolution of 2005 - Reaffirms congressional support for the objectives of the Treaty on the Nonproliferation of Nuclear Weapons (NPT) and expresses support for appropriate measures to strengthen the NPT. Calls on all parties participating in the Seventh Review Conference on the Treaty on the Nonproliferation of Nuclear Weapons to make good faith efforts to: (1) establish more effective controls on critical technologies that can be used to produce nuclear weapons material; (2) ensure universal adoption of the Additional Protocol to the NPT and support the International Atomic Energy Agency's (IAEA) authority to monitor nonproliferation compliance; (3) use diplomacy and economic leverage to halt uranium enrichment and other nuclear fuel cycle activities in Iran, and verifiably dismantle North Korea's nuclear weapons capacity; (4) accelerate programs to eliminate nuclear weapons and to safeguard nuclear weapons-grade fissile materials; (5) establish procedures to ensure that a state cannot retain access to controlled nuclear materials, equipment, technology, and components acquired for peaceful purposes or avoid United Nations (UN) sanctions for violations of the NPT by withdrawing from the NPT; and (6) implement the NPT-related disarmament obligations. Affirms congressional support for the Proliferation Security Initiative, and urges additional nations to join the Initiative.

Comprehensive Assistance for Veterans Exposed to Traumatic Stressors Act of 2005 - Extends eligibility for readjustment counseling services for Vietnam-era veterans. Requires implementation of a Department of Veterans Affairs (VA)-Department of Defense (DOD) Health Care Sharing Incentive Fund. Requires: (1) the DOD to assist the VA with post-traumatic stress disorder (PTSD) and other mental health-related data collection; (2) substance use disorder questions in pre- and post-deployment screens and related treatment protocols; and (3) routine preventative maintenance intervention for returning members of the Armed Forces. Requires a study of factors that decrease the likelihood of developing combat-related chronic PTSD. Extends the enhanced eligibility period for VA health services for certain veterans. Provides for a joint demonstration project that stations VA psychologists and psychiatrists at major demobilization sites and military treatment facilities. Directs the Secretary of Veterans Affairs to develop model programs to address mental health disorders prevalent among veterans of Operations Enduring Freedom and Iraqi Freedom. Requires: (1) performance measures that ensure appropriate deployment of resources to implement the Iraq war clinical practice guidelines; (2) establishment of the DOD/VA Council on Post-Deployment Mental Health; (3) a plan for expanded access to specialized PTSD care; and (4) additional mental health services personnel for certain VA programs and locations. Requires counseling for immediate family members of disabled veterans and Armed Forces personnel killed in action. Establishes a National Steering Committee on PTSD Education. Addresses deficiencies in compensation and pension examinations with regard to PTSD. Requires development of criteria for determining which medical conditions are likely associated with PTSD and when secondary service-connection should be granted for those conditions. Provides for an outreach program to enhance PTSD awareness.

National Aquatic Invasive Species Act of 2005 - Amends the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 to establish aquatic invasive species prevention requirements for all vessels operating in U.S. waters. Requires the Secretary of Homeland Security to promulgate regulations for ballast water management standards and certification procedures. Directs the Aquatic Invasive Species Task Force to establish a priority pathway management program that identifies those pathways that pose the highest risk for the introduction of aquatic invasive species unless further managed. Prohibits the importation of live aquatic organisms of a species not in trade without specified screening and approval. Requires the Director of the United States Fish and Wildlife Service, the Administrator of the National Oceanic and Atmospheric Administration (NOAA), and the Administrator of the Environmental Protection Agency to implement a national system of ecological surveys for rapid early detection and monitoring of invasive species. Requires the Task Force to review and approve State rapid response contingency strategies. Requires the Invasive Species Council to establish a Federal rapid response team for each of the ten Federal regions. Requires the Assistant Secretary of the Army (Civil Works) to complete construction of and operate the Chicago River Ship and Sanitary Canal dispersal barrier project to prevent the spread of aquatic invasive species. Requires the Invasive Species Council to coordinate with the Task Force to combat aquatic invasive species. Requires the Task Force to recommend to appropriate Federal agencies additions to the list of aquatic invasive species. Requires the Task Force, the Council, and the Secretary of State to coordinate activities to ensure that international efforts to prevent and manage aquatic invasive species are coordinated with U.S. policies.

Fuels Security Act of 2005 - Amends the Clean Air Act to require that motor vehicle fuel contain a specified volume of renewable fuel. Establishes a system of: (1) tradeable credits for motor vehicle fuel containing more renewable fuel than required; and (2) waivers for States and small refineries. Amends the Energy Policy Act of 1992 to require Federal agency heads to ensure that ethanol-blended gasoline and biodiesel-blended diesel fuel is purchased for agency vehicles in areas where such fuel is available at competitive prices. Amends the Clean Air Act to eliminate the oxygen content requirement for reformulated gasoline. Requires the Administrator to: (1) establish standards for toxic air pollutants from the use of reformulated gasoline; and (2) within 30 days of enactment of this Act, determine the adequacy of any petition from a State Governor to exempt gasoline sold in the State from certain requirements for reformulated gasoline. Permits States additional opt-in areas under the reformulated gasoline program. Requires Federal enforcement of State fuels requirements. Sets forth various data collection and reporting requirements.

Salmon Planning Act - Requires the Secretary of Commerce (Secretary) to enter into an arrangement with the National Academy of Sciences for scientific analysis of Federal salmon and steelhead recovery efforts. Requires the Comptroller General to study the potential effects of partially removing the four lower Snake River dams, including those on: (1) the economy of surrounding communities; (2) water transportation; (3) irrigation; (4) energy production; and (5) the extinction of salmon and steelhead populations in Snake River. Authorizes the Secretary of the Army, acting through the Corps of Engineers, to partially remove the dams if found necessary by: (1) the Secretary to restore Snake River salmon and steelhead populations to meet obligations under the Endangered Species Act of 1973; (2) the Secretary of the Interior to meet treaty obligations to Indian tribes or other sovereign nations; or (3) the Administrator of the Environmental Protection Agency to meet requirements of the Federal Water Pollution Control Act.

Aquatic Invasive Species Research Act - Requires the National Oceanic and Atmospheric Administration (NOAA), the Smithsonian Institution, and the U.S. Geological Survey (administering agencies) to: (1) enter into a memorandum of understanding regarding the implementation and coordination of this Act; and (2) develop a marine and fresh-water research program to support efforts to assess introduction rates and patterns of invasive nonnative species into the aquatic ecosystem, and efforts to detect, prevent, and eradicate them. Requires the administering agencies to: (1) develop standardized protocols for conducting ecological and pathway surveys of such species; (2) conduct research to identify the relationship between the introduction and establishment of such species; and (3) analyze the data collected and develop a profile that determines whether a species planned for importation is likely to invade an aquatic ecosystem. . Requires the U.S. Geological Survey to develop a central, national pathway and ecological surveys database of information. Makes the Invasive Species Council responsible for disseminating such information and develop a national strategy for how it will be shared with Federal, State, and local entities. Requires the Environmental Protection Agency (EPA) to develop a grant program to fund research, development, demonstration and verification of environmentally sound, cost-effective technologies and methods to control and eradicate such species. Reauthorizes the ship pathway technology demonstration program. Requires the Coast Guard and the EPA to develop a research program to support implementation of ship pathway standards to prevent the introduction and spread of invasive species by ships. Requires the National Science Foundation to establish a grant program for researchers at institutions of higher education and museums to carry our research programs in systematics and taxonomy.

Childhood Adoption Act of 2005 - Amends the Internal Revenue Code to: (1) increase the tax credit for adoption expenses from $10,000 to $15,000; (2) make such tax credit refundable; and (3) increase the exclusion from gross income for employer-paid adoption expenses from $10,000 to $15,000. Amends title IV, part E (Federal Payments for Foster Care and Adoption Assistance) of the Social Security Act to increase: (1) levels of adoption incentive payments payable to States under the adoption assistance program; and (2) funding for adoption incentive payments for FY 2006 through 2008.

Amends the Internal Revenue Code to: (1) reduce the top marginal tax rate for estates and gifts to 30 percent; (2) increase the estate tax exclusion amount to $10 million, with an annual adjustment for inflation; and (3) increase the annual gift tax exclusion from $10,000 to $50,000.

Collegiate Housing and Infrastructure Act of 2005 - Amends the Internal Revenue Code to allow tax-exempt charitable or educational organizations to make collegiate housing and infrastructure improvement grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) so long as all of the active members of such clubs are full-time students at the college or university with which such clubs are associated. Defines "collegiate housing and infrastructure grants" to include grants to provide, improve, operate, or maintain collegiate housing.

Renewing the Dream Tax Credit Act - Amends the Internal Revenue Code to allow homebuilders and investors a general business tax credit for building or substantially rehabilitating residences for low and moderate-income individuals in certain areas, including a rural area, an Indian reservation, or an area of chronic economic distress. Sets forth rules for the calculation of such credit and its administration and allocation by the States.

Coastal Ocean Observation System Integration and Implementation Act of 2005 - Directs the Secretary of Commerce to establish within the National Oceanic and Atmospheric Administration (NOAA) a Coastal Ocean Observation System (System) to support coastal and fishery management activities and an integrated national ocean observation system. Authorizes the Secretary to: (1) designate as a unit of the System any Federal agency or non-Federal entity that operates marine sensors that collect observation data in U.S. ocean and coastal waters; and (2) coordinate such units' activities. Requires the Secretary to develop: (1) viable end-use products of the System to support coastal and fishery management activities; (2) a data management and communication system by which all System collected data regarding U.S. coastal waters are integrated and available; and (3) forecast models using collected data to support and improve coastal and fishery management, safe and efficient marine navigation, weather and climate prediction, and other appropriate activities. Requires the Secretary to carry out pilot projects to determine the effectiveness of collecting and integrating coastal ocean observation data to support the System.

Social Security Benefits Tax Relief Act of 2005 - Amends the Internal Revenue Code to repeal the 85 percent maximum tax rate on Social Security and Railroad Retirement benefits enacted by the Omnibus Budget Reconciliation Act of 1993. Appropriates, from the general fund, to the Hospital Insurance Trust Fund amounts equal to the reduction in revenues resulting from this repeal.

Fisheries Science and Management Enhancement Act of 2005 - Amends the Magnuson-Stevens Fishery Conservation and Management Act to revise requirements for the appointment and training of the voting members of the eight Regional Fishery Management Councils. Requires each science and statistical committee established by a Council to include a fishery and marine science subcommittee. Sets forth subcommittee functions, primarily to determine for the Council biological catch limits that will prevent overfishing in a fishery and any protections required for threatened or endangered species. Revises requirements regarding the disclosure of financial interests by and recusal of members with respect to voting on Council decisions. Revises provisions required to be in a fishery management plan to require such a plan to allocate any quotas or other conservation and management measures fairly and equitably among the commercial, recreational, and charter fishing sectors in the fishery, and allow fishery sectors to develop allocation plans subject to Council approval. Provides for peer review of fishery and marine science subcommittee determinations to the Council. Directs the Secretary of Commerce to carry out a cooperative research, data collection, and gear modification program to conduct conservation projects to minimize the mortality of unavoidable bycatch or fishery impacts on essential fish habitat through modifications of fishing gear and practices. Amends the Saltonstall-Kennedy Act to make certain funds available to implement the cooperative research, data collection, and gear modification program.

Darfur Genocide Accountability Act of 2005 - Expresses the sense of Congress that the atrocities unfolding in Darfur, Sudan, are genocide. Directs the President to: (1) block the property and assets of civil and military officials of the Government of Sudan and their family members implicated in the Darfur atrocities, and property and assets controlled by the National Congress Party; and (2) prohibit an entity engaged in any commercial activity in Sudan from raising capital in the United States, or from trading its securities in any capital market in the United States. Directs the Secretary of State to: (1) prohibit visas for civil and military officials of the Government of Sudan, and militia members and others implicated in the Darfur atrocities; (2) reduce the Sudanese diplomatic mission in Washington, D.C., and restrict or control the remaining staff's movement within the United States; and (3) instruct the U.S. Permanent Representative to the United Nations (UN) to oppose any UN or other international conference from being held in Sudan. Authorizes the President to: (1) use force to stop the Darfur genocide, including establishment of a no-fly zone and use of unmanned armed planes; and (2) deny U.S. port entry to ships doing business in the Sudan oil sector and /or with the Sudan armed forces.

Paul Wellstone Mental Health Equitable Treatment Act of 2005 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to prohibit a group health plan or group health coverage that provides both medical and surgical benefits and mental health benefits from imposing treatment limitations or financial requirements on the mental health benefits unless comparable limitations or requirements are imposed on medical and surgical benefits. Excludes such requirements for plans and coverage for small employers. Allows a plan or coverage that provides in-network mental health benefits to provide out-of-network mental health benefits using treatment limitations or financial requirements that are not comparable to those applied to medical-surgical benefits if the in-network mental health benefits are provided at parity with medical-surgical benefits and with reasonable access. Requires the Government Accountability Office (GAO) to: (1) study the effects of this Act on health insurance costs and access and quality of health care; and (2) provide a cost estimation of extending such requirements to the treatment of substance abuse and chemical dependency.

Assistance for Orphans and Other Vulnerable Children in Developing Countries Act of 2005 - Amends the Foreign Assistance Act of 1961 to authorize the President to provide assistance, including through nongovernmental or international organizations, for basic care for orphans and other vulnerable children in developing countries, including assistance for: (1) community-based care; (2) school food programs; (3) education and employment training; (4) psychosocial support; (5) protection of inheritance rights; and (6) HIV/AIDS care. Directs the Secretary of State to appoint a Special Advisor for Assistance to Vulnerable Populations. Directs the President to: (1) establish a system to evaluate such assistance's effectiveness; and (2) develop and submit to the appropriate congressional committees a coordinating strategy for such assistance.

Student Athlete Protection Act - Amends the Federal judicial code to include as unlawful sports gambling a lottery, sweepstakes, or other betting, gambling, or wagering scheme based, directly or indirectly, on one or more: (1) competitive games in which high school or college athletes participate; (2) performances of high school or college athletes in competitive games; or (3) competitive games at the Summer or Winter Olympics.

Higher Education Affordability and Equity Act of 2005 - Amends the Internal Revenue Code to: (1) repeal the dollar limitation on the tax deduction for interest on education loans and expand eligibility for such deduction by revising the modified adjusted gross income phaseout for such deduction; (2) make the tax deduction for qualified tuition and related expenses permanent; (3) increase from $2,000 to $5,000 the maximum allowable contribution to a Coverdell savings account; (4) exclude from gross income amounts received for qualified higher education expenses (e.g., books, supplies, room, board, and special needs services); and (5) allow certain additional expenses (e.g., fees, books, supplies, and equipment) for purposes of the Hope Scholarship Tax Credit and provide that such tax credit shall not be reduced by Federal Pell Grants and Supplemental Educational Opportunity (SEOG) Grants. Repeals the sunset provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) applicable to title IV, subtitles A, B, and D (Affordable Education Provisions) of such Act. Amends the Higher Education Act of 1965 (HEA) to provide that a qualified education benefit shall not be considered an asset of a student for purposes of a student financial need analysis. Defines "qualified education benefit" as a tax-exempt tuition credits program, a State education prepayment plan, and a Coverdell education savings account.

Medicare Diabetic Footwear Quality Restoration Act of 2005 - Amends the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 to terminate the reduction in Medicare payment for orthopedic shoes and inserts furnished to individuals with diabetes after December 31, 2005.

Family Smoking Prevention and Tobacco Control Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for the regulation of tobacco products by the Secretary of Health and Human Services through the Food and Drug Administration, including through disclosure, annual registration, inspection, recordkeeping, and user fee requirements. Sets forth criteria by which tobacco products are deemed adulterated or misbranded. Allows the Secretary to require prior approval of all label statements. Allows the Secretary to restrict the sale or distribution of tobacco products, including advertising and promotion, if the Secretary determines that such regulation would be appropriate for the protection of the public health. Prohibits such regulations from: (1) limiting product sales or distribution to authorization of a practitioner licensed to prescribe medical products; (2) prohibiting product sales in face-to-face transactions by a specific category of retail outlets; or (3) establishing a minimum age greater than 18 years of age for product purchases. Prohibits cigarettes from containing any artificial or natural flavor (other than tobacco or menthol) or an herb or spice, including strawberry, cinnamon, or coffee. Requires the Secretary to establish tobacco product standards to protect the public health, but reserves to Congress the power to ban any tobacco products or reduce the nicotine level to zero. Allows the Secretary to take specified actions, including public notification and recall, against unreasonably harmful products. Requires premarket approval of all new tobacco products. Sets forth standards for the sale of modified risk tobacco products. Sets forth provisions regarding: (1) judicial review; (2) coordination with the Federal Trade Commission (FTC); (3) congressional review of regulations; and (4) state and local authority. Requires the Secretary to establish a Tobacco Products Scientific Advisory Committee. Amends the Federal Cigarette Labeling and Advertising Act to change cigarette warning label and advertising requirements. Amends the Comprehensive Smokeless Tobacco Health Education Act of 1986 to change smokeless tobacco warning label and advertising requirements.

Resource Efficient Appliance Incentives Act of 2005 - Amends the Internal Revenue Code to allow a business tax credit for the production of certain household appliances (clothes washers, dishwashers, and refrigerators) with a specified energy efficiency rating. Imposes an aggregate limitation of $75 million on such credit for all taxable years ($35 million for certain other appliances), and an annual limitation based on taxpayer gross receipts (two percent of taxpayer average annual gross receipts for the three previous taxable years).
