Agency Accountability Act of 2017

Agency Accountability Act of 2017 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The funds may not be used unless the funding is provided in advance in an appropriations bill. Any amounts deposited during the fiscal year in which this bill is enacted may not be obligated during the fiscal year and must be used for deficit reduction. The bill includes an exception for funds to be paid to an individual entitled to receive the funds as a whistle-blower, including funds received as a percentage of amounts received by the government pursuant to a judgment or settlement agreement. The bill amends the Congressional Budget Act of 1974 to require offsetting receipts and collections to be treated as revenue. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.) The requirements of the bill do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (USPTO). The Under Secretary of Commerce for Intellectual Property and the Director of the USPTO must submit annually to Congress a report describing any fee, fine, penalty, or proceeds from a settlement collected by the USPTO during the previous year.

Childhood Cancer STAR Act

Childhood Cancer Survivorship, Treatment, Access, and Research Act of 2017 or the Childhood Cancer STAR Act This bill amends the Public Health Service Act to authorize the National Institutes of Health (NIH) to provide support to collect the medical specimens and information of children, adolescents, and young adults with selected cancers that have the least effective treatments in order to achieve a better understanding of these cancers and the effects of treatment. The national childhood cancer registry is reauthorized through FY2022 and revised to authorize the Centers for Disease Control and Prevention to award grants to state cancer registries to improve tracking of childhood cancers. The Department of Health and Human Services (HHS) may: (1) support pilot programs to develop or study models for monitoring and caring for childhood cancer survivors throughout their lives, (2) establish a task force to develop and test standards for high-quality childhood cancer survivorship care, and (3) carry out a demonstration project to improve care coordination as childhood cancer survivors transition to adult care. HHS must convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer Survivors. The NIH may support research on: (1) outcomes for, and barriers faced by, pediatric cancer survivors within minority or medically underserved populations; and (2) follow-up care for pediatric cancer survivors, including research on the late effects of cancer treatment and long-term complications. The Government Accountability Office must make recommendations to address barriers to childhood cancer survivors obtaining and paying for adequate medical care.

American Innovation $1 Coin Act This bill directs the Department of the Treasury to mint and issue "American Innovation" $1 coins commemorating an innovation, an individual innovator or pioneer, or a group of innovators or pioneers from each state, each U.S. territory, and the District of Columbia. Treasury shall issue four coins per year, in alphabetical order by jurisdiction, until a coin has been issued for each jurisdiction.

Common Sense Nutrition Disclosure Act of 2017

Common Sense Nutrition Disclosure Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to revise the nutritional information that restaurants and retail food establishments must disclose. The nutrient content disclosure statement on the menu or menu board must include: (1) the number of calories contained in the whole menu item; (2) the number of servings and number of calories per serving; or (3) the number of calories per common unit of the item, such as for a multi-serving item that is typically divided before presentation to the consumer. Nutritional information may be provided solely by a remote-access menu (e.g., an Internet menu) for food establishments where the majority of orders are placed by customers who are off-premises. Establishments with self-serve food may comply with the requirements for restaurants or place signs with nutritional information adjacent to each food item. An establishment's nutrient content disclosures may vary from actual nutrient content if the disclosures comply with current standards for reasonable basis. Establishments with standard menu items that come in different flavors, varieties, or combinations, that are listed as a single menu item may determine and disclose nutritional information using specified methods or methods allowed by the Food and Drug Administration (FDA). Regulations pursuant to this bill or the clause amended by this bill may not take effect earlier than two years after final regulations are promulgated. The FDA may not exempt states from nutrition labeling requirements.

REAL ID Privacy Protection Act This bill amends the REAL ID Act of 2005 to repeal the requirements that each state, in the issuance of drivers' licenses and identification cards: (1) retain paper copies of source documents for 7 years or images of source documents for 10 years, and (2) provide to all other states electronic access to information contained in the state's motor vehicle database. The Department of Homeland Security shall extend through October 10, 2017, the deadline for compliance with the minimum document requirements and issuance standards for federal recognition of state drivers' licenses or identification cards for a state not in compliance that has received a limited extension of the deadline for compliance or that is under review for compliance as of the enactment of this bill. The Department of of Homeland Security shall report on each state's compliance with the requirements of the material compliance checklist for such Act.

Craft Beverage Modernization and Tax Reform Act of 2017 This bill amends the Internal Revenue Code, with respect to the tax treatment of certain alcoholic beverages, to: exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; modify the small wine producer tax credit to increase the amount of the credit, expand the producers that are covered, and specify an adjustment for hard cider; modify the alcohol content limitations that apply to certain wines for tax purposes; specify definitions for "mead" and "low alcohol by volume wine;" modify requirements for records, statements, and returns for certain breweries; and permit the transfer of beer between bonded facilities without payment of tax. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages.

Compassionate Access Act This bill directs the Department of Health and Human Services to submit to the Drug Enforcement Administration (DEA) a recommendation to transfer marijuana from schedule I to another controlled substances schedule. The DEA must consider the recommendation and issue a final rule to reclassify marijuana. It permits, for reclassification purposes, consideration of scientifically sound research conducted in a state that allows medical marijuana and in accordance with state law, even if such research uses non-federally approved marijuana. The legislation amends the Controlled Substances Act (CSA) to: exclude "cannabidiol" (CBD) from the definition of "marijuana" and remove it from coverage under the CSA; limit the concentration of delta-9-tetrahydrocannabinol (THC) in CBD to 0.3% on a dry weight basis; and deem marijuana grown or processed to make CBD, in accordance with state law, to comply with the THC concentration limit unless the DEA determines state law to be unreasonable. No provision of the CSA or Federal Food, Drug, and Cosmetic Act prohibits or restricts a physician from prescribing; a patient, caregiver, or guardian from obtaining, possessing, or transporting; an entity from producing, processing, manufacturing, or distributing; a pharmacy from dispensing; or a laboratory from testing medical marijuana or CBD in compliance with a state's medical marijuana law. The bill requires the Attorney General to delegate responsibility for registering marijuana researchers to an executive branch agency that supports research on substances' medical value. Such agency must ensure adequate marijuana supply for medical research.

ADA Education and Reform Act of 2017 This bill requires the Disability Rights Section of the Department of Justice to develop a program to educate state and local governments and property owners on strategies for promoting access to public accommodations for persons with a disability. The program may include training for professionals to provide a guidance of remediation for potential violations of the Americans with Disabilities Act of 1990 (ADA). The bill prohibits civil actions based on the failure to remove an architectural barrier to access into an existing public accommodation unless: (1) the aggrieved person has provided to the owners or operators a written notice specific enough to identify the barrier, and (2) the owners or operators fail to provide the person with a written description outlining improvements that will be made to improve the barrier or they fail to remove the barrier or make substantial progress after providing such a description. The aggrieved person's notice must specify: (1) the address of the property, (2) the specific ADA sections alleged to have been violated, (3) whether a request for assistance in removing an architectural barrier was made, and (4) whether the barrier was permanent or temporary. The Judicial Conference of the United States must develop a model program to promote alternative dispute resolution mechanisms to resolve such claims. The model program should include an expedited method for determining relevant facts related to such barriers and steps to resolve accessibility issues before litigation.

A Member may designate up to two such covered congressional employees. A covered congressional employee may not be recognized as an agent or attorney with respect to veterans' benefit claims. Funds under this bill may not be used to design or administer any training for covered congressional employees. The bill makes funds available for FY2018 through FY2021 for such congressional employee access program.

Reforming Executive Guidance Act of 2017 or the REG Act of 2017 This bill requires guidance documents of federal agencies to be considered rules that are subject to the congressional review process. A "guidance document" is a statement of general applicability and future effect, other than a regulatory action, issued by a federal agency that sets forth: (1) a policy on a statutory, regulatory, or technical issue; or (2) an interpretation of a statutory or regulatory issue. The bill modifies the definition of rule to include significant guidance for purposes of rulemaking. A "significant guidance document" is guidance that may reasonably be anticipated to: (1) lead to an annual effect of at least $100 million on, or adversely affect in a material way, the economy, productivity, competition, employment, the environment, public health or safety, or governmental entities or communities; (2) create a serious inconsistency, or otherwise interfere, with an action taken or planned by another federal agency; (3) materially alter the budgetary impact of any entitlement, grant, user fees, or loan programs or the rights or obligations of recipients; or (4) raise novel legal or policy issues arising out of legal mandates.

Interim Consolidated Storage Act of 2017 This bill amends the Nuclear Waste Policy Act of 1982 to authorize the Department of Energy (DOE) to enter into new contracts (or modify existing contracts) with the licensee of an interim consolidated storage facility in order to take title to and store in it either high-level radioactive waste or spent nuclear fuel of domestic origin. The bill defines: "interim consolidated storage facility" as a facility licensed by the Nuclear Regulatory Commission for the storage of high-level radioactive waste or spent nuclear fuel received from DOE or from two or more persons that generate or hold title to such fuel generated at a civilian nuclear power reactor, and "high-level radioactive waste" as including Greater than Class C waste. The bill assigns priority to storage of such waste and spent fuel located on sites without an operating nuclear reactor. The bill makes appropriations targeted for the Nuclear Waste Fund available to pay for costs in connection with storage in an interim consolidated storage facility. Beginning in FY2018 DOE shall not expend, on fees for dry modes of storage of high-level radioactive waste or spent nuclear fuel, any amounts exceeding the cumulative amount of interest generated by the Fund each fiscal year.

Cuba Trade Act of 2017

Cuba Trade Act of 2017 This bill repeals or amends current laws restricting trade with Cuba. The prohibition on assistance to Cuba, and the President's authority for the embargo on Cuba, under the Foreign Assistance Act of 1961 are eliminated. The Cuban Democracy Act of 1992 is amended to eliminate: presidential authority to impose sanctions against Cuban trading partners, restrictions on transactions between U.S.-owned or controlled firms and Cuba, limitations on direct shipping between Cuban and U.S. ports, and restrictions on remittances. The Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 is amended to eliminate: the enforcement of an economic embargo of Cuban provisions, and the prohibition on indirect financing of Cuba. The Trade Sanctions Reform and Export Enhancement Act of 2000 is amended to: remove Cuba from the list of state sponsors of terrorism subject to agricultural and medical export restrictions; eliminate the prohibition on U.S. assistance, including foreign assistance, export assistance, and any credit or guarantees being made available for exports to Cuba; eliminate the prohibition against a U.S. person's providing payment or financing terms for sales of agricultural commodities or products to Cuba; prohibit the United States from providing any foreign assistance to Cuba or any financial assistance, loans, loan guarantees, extension of credit, or other financing for exports to Cuba; and eliminate the prohibition on the U.S. entry of merchandise that is of Cuban origin, is or has been located in or transported from or through Cuba, or is made or derived in whole or in part of any article which is the growth, produce, or manufacture of Cuba. The federal government may not obligate or expend any funds to promote trade with or develop markets in Cuba, except through certain commodity promotion programs.

Fairness for High-Skilled Immigrants Act of 2017 This bill amends the Immigration and Nationality Act to: (1) eliminate the per-country numerical limitation for employment-based immigrants, and (2) increase the per-country numerical limitation for family-based immigrants from 7% to 15% of the total number of family-sponsored visas. The Chinese Student Protection Act of 1992 is amended to eliminate the provision requiring the reduction of annual Chinese immigrant visas to offset status adjustments under such Act. The bill establishes a transition period during which a percentage of employment-based second and third preference (EB-2 and EB-3) immigrant visas are reserved as follows: for FY2017, 15% of such visas are allotted to natives of countries other than the two countries with the largest aggregate numbers of natives obtaining such visas in FY2011; for FY2018, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2012; and for FY2019, 10% of such visas are allotted in each category to natives of countries other than the two with the largest aggregate numbers of natives obtaining such visas in FY2015. During the transition period, not more than 25% of the total number of the reserved EB-2 and EB-3 visas shall be allotted to natives of a single country. For FY2015-FY2017, not more than 85% of the unreserved EB-2 and EB-3 visas shall be allotted to natives of a single country. Amendments made by this bill shall apply beginning in FY2017.

Email Privacy Act This bill amends the federal criminal code to revise provisions that limit an electronic communication service (ECS) or remote communication service (RCS) provider from disclosing the contents of a wire or electronic communication that is in electronic storage. Additionally, it revises the standards for the government to compel an ECS or RCS provider to disclose contents of a wire or electronic communication or noncontent records or information pertaining to a subscriber or customer. An ECS or RCS provider may notify a subscriber or customer of the receipt of a warrant, court order, subpoena, or request, unless the government obtains an order for delayed notification. The bill revises the process for obtaining a delayed notification order and lengthens the maximum duration of a delayed notification order.

Concealed Carry Reciprocity Act of 2017 This bill amends the federal criminal code to allow a qualified individual to carry a concealed handgun into or possess a concealed handgun in another state that allows individuals to carry concealed firearms. A qualified individual must: (1) be eligible to possess, transport, or receive a firearm under federal law; (2) carry a valid photo identification document; and (3) carry a valid concealed carry permit issued by any state or be eligible to carry a concealed firearm in his or her state of residence. Additionally, the bill specifies that a qualified individual who lawfully carries or possesses a concealed handgun in another state: (1) is not subject to the federal prohibition on possessing a firearm in a school zone, and (2) may carry or possess the concealed handgun in federally owned lands that are open to the public.

ENLIST Act

Encourage New Legalized Immigrants to Start Training Act or the ENLIST Act This bill authorizes the enlistment in the Armed Forces of aliens unlawfully present in the United States on December 31, 2012, who: (1) have been continuously present in the United States since such date; (2) were younger than 15 years of age when they initially entered the United States; and (3) are otherwise eligible for original enlistment in a regular component of the Army, Navy, Air Force, Marine Corps, or Coast Guard. The Department of Homeland Security shall adjust the status of an alien enlisted under such authority to the status of an alien lawfully admitted for permanent residence under provisions of the Immigration and Nationality Act applicable to aliens who entered the United States prior to January 1, 1972. The bill rescinds such lawful permanent resident status if the alien is separated from the Armed Forces under other than honorable conditions before serving the term of enlistment.
