Fair and Open Competition Act or FOCA Act This bill prohibits a federal executive agency that awards any construction contract after the enactment of this bill from requiring or prohibiting a contract bidder from entering into agreements with labor organizations (i.e., Project Labor Agreements [PLAs]) or otherwise discriminating against a bidder or contractor who signs, or refuses to sign, a PLA. Agencies that award grants, provide financial assistance, or enter into cooperative agreements for construction projects after the enactment of this bill must ensure that the bid specifications, project agreements, or other controlling documents for such projects do not contain any requirements or prohibitions relating to PLAs. An agency may exempt a particular project or grant from the prohibition of this bill if it determines that special circumstances exist requiring an exemption to avert an imminent threat to public health or safety or to serve the national security.

Fair Treatment for Families of Veterans Act This bill changes the effective date for reductions or discontinuances of Department of Veterans Affairs dependency and indemnity compensation by reason of the death of a payee from the last day of the month before death to the last day of the month of death. A veteran's surviving spouse who receives both dependency/indemnity compensation and service- or non-service-connected disability/death payments for the month of the veteran's death shall be entitled to the greater of the two payments.

Recognizing America's Children Act This bill authorizes the Department of Homeland Security (DHS) to cancel the removal of, and adjust to conditional nonimmigrant for an initial five-year period the status of, an alien who: was younger than 16 years old when he or she initially entered the United States and has been physically present in the United States since January 1, 2012; is a person of good moral character; is not inadmissible or deportable on specified grounds under the Immigration and Nationality Act; has not participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; has not been convicted of certain offenses under federal or state law; is 18 years or older and has earned a high school diploma, general education development certificate, or high school equivalency diploma in the United States, has been admitted to an institution of higher education, or has a valid work authorization; and has never been under a final order of exclusion, deportation, or removal unless the alien has remained in the United States under color of law after such order's issuance or received the order before attaining the age of 18. An alien applying for relief under this bill shall: (1) register under the Military Selective Service Act if so required, (2) undergo a medical examination, (3) submit biometric and biographic data, and (4) complete security and law enforcement background checks. DHS shall under specified circumstances terminate or extend the conditional nonimmigrant status of an alien who is at least 18 years old. A conditional nonimmigrant may file an application to adjust his or her status to that of an alien lawfully admitted for permanent residence during a specified period. An alien who adjusts to permanent resident status may apply for naturalization upon compliance with all immigration law requirements.

Naismith Memorial Basketball Hall of Fame Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 coins, 400,000 $1 coins, and 750,000 half-dollar coins in recognition and celebration of the Naismith Memorial Basketball Hall of Fame. The coins shall be in the shape of a dome, and the design on the common reverse of the coins shall depict a basketball. Treasury shall hold a competition to determine the design of the common obverse of the coins, which shall be emblematic of the game of basketball. The bill requires all sales of such coins to include specified surcharges, which shall be paid by Treasury to the Hall to fund an endowment for increased operations and educational programming.

Taking Account of Institutions with Low Operation Risk Act of 2017 or the TAILOR Act of 2017 This bill requires federal financial regulatory agencies to: (1) tailor any regulatory actions so as to limit burdens on the institutions involved, with consideration of the risk profiles and business models of those institutions; and (2) report to Congress on specific actions taken to do so, as well as on other related issues. The bill's tailoring requirement applies not only to future regulatory actions but also to regulations adopted within the last seven years.

Commission on the Social Status of Black Men and Boys Act This bill establishes the Commission on the Social Status of Black Men and Boys within the U.S. Commission on Civil Rights Office of the Staff Director to make a systematic study of the conditions affecting black men and boys.

Enhancing Opportunities for Medical Doctors Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to redistribute unused residency positions for which graduate medical education costs are paid under Medicare. Specifically, the Centers for Medicare & Medicaid Services must: (1) reduce a hospital's resident limit by a specified amount if the hospital has unused residency positions and is not a rural hospital with fewer than 250 acute care inpatient beds, and (2) increase the resident limit for each qualifying hospital that applies for an increase. In aggregate, the number of increased positions shall equal the number of reduced positions. The bill establishes specified priorities, limitations, and capacity considerations with respect to redistribution.

Patient Access to Higher Quality Health Care Act of 2017 This bill amends the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 to repeal specified limitations, for purposes of Medicare participation, on self-referrals by newly constructed or expanded physician-owned hospitals.

Military Hunger Prevention Act This bill excludes the value of a housing allowance for a member of a uniformed service from any income, assets, or resources calculation for determining eligibility for any federal program issuing benefits for nutrition assistance (including the family subsistence supplemental allowance program).

Technologies for Energy Security Act of 2017 This bill amends the Internal Revenue Code to extend and modify the tax credits for residential energy efficient property and investments in energy property. The bill modifies the tax credit for residential energy efficient property to extend through 2021 the credits for expenditures for fuel cell property, small wind energy property, and geothermal heat pump property. For each extended credit, the bill phases out the current credit rate of 30% of expenditures by reducing it to 26% or 22%, depending on the date that the property is placed in service. The bill extends the tax credit for investments in energy property for the following property with construction that begins before January 1, 2022: fiber-optic solar energy property, fuel cell property, microturbine property, combined heat and power system property, small wind energy property, and thermal energy property. The bill phases out the current credit rate of 30% for investments in fuel cell property, small wind energy property, and fiber-optic solar energy property by reducing it to 26% or 22%, depending on the date that the property is placed in service.

Synthetics Trafficking and Overdose Prevention Act of 2017 or the STOP Act of 2017 This bill amends the Tariff Act of 1930 to make the Postmaster General the consignee (i.e., the entity financially responsible for the receipt of a shipment) for merchandise, excluding documents, imported through the mail into the United States. The Postmaster General must designate licensed customs brokers to file required documents or information for such shipments. The bill amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to impose a customs user fee on postal shipments or any other item valued at $2,000 or less arriving at an international mail facility. The bill amends the Trade Act of 2002 to direct the Department of the Treasury to require the Postmaster General to provide for the advanced electronic transmission to the U.S. Customs and Border Protection of certain information for all postal shipments made by the U.S. Postal Service (USPS), including postal shipments it receives from foreign postal operators. The Postmaster General: shall be liable for civil penalties for postal shipment violations committed by a foreign postal operator or the USPS; may be directly or indirectly responsible for discrepancies resulting from omissions made or false information provided by a foreign postal operator or the USPS; and shall ensure that all costs and penalties associated with complying with this bill are recouped from foreign shippers, foreign postal operators, or U.S. ultimate consignees.

This bill directs the Department of Veterans Affairs (VA) to enter into an agreement or a contract with each state home to pay for adult day health care for a veteran eligible for, but not receiving, nursing home care. The veteran must need such care specifically for a service-connected disability or the veteran must have a service-connected disability rated 70% or more. Payment under each agreement or contract between the VA and a state home must equal 65% of the payment that the VA would otherwise pay to the state home if the veteran were receiving nursing home care.

Firefighter Cancer Registry Act of 2017 This bill requires the Centers for Disease Control and Prevention (CDC) to develop and maintain a voluntary registry of firefighters to collect history and occupational information that can be linked to existing data in state cancer registries. The registry must be used to improve monitoring of cancer among firefighters and to collect and publish epidemiological information regarding cancer among firefighters. The CDC should seek to include specified information in the registry, including the number and type of fire incidents attended by an individual. To collect information for the registry, the CDC may incorporate questions into existing public health surveys, questionnaires, and other databases. The CDC must: (1) develop a strategy to maximize participation in the registry; (2) develop guidance for states and firefighting agencies regarding the registry; (3) encourage inclusion in the registry of data on minority, female, and volunteer firefighters; and (4) seek feedback on the registry from nonfederal experts. The CDC must develop a process for making registry data available for research without a fee if findings or publications from the research are made public or available to stakeholders.

Maintaining dignity and Eliminating unnecessary Restrictive Confinement of Youths Act of 2017 or the MERCY Act This bill amends the federal criminal code to prohibit juvenile solitary confinement, except as a temporary response to behavior that poses a serious and immediate risk of harm.

Condemns North Korea's development of multiple intercontinental ballistic missiles. Urges the prompt deployment of the Terminal High Altitude Area Defense system in South Korea to counter North Korea's nuclear missile threat. Reaffirms: (1) U.S. support of a layered, interoperable, multi-tier missile defense system to protect Americans and allies on the Korean Peninsula; and (2) the U.S. commitment to its alliances and trilateral missile defense cooperation agreements with South Korea and Japan. Expresses support for: (1) continued U.S.-South Korea bilateral security cooperation and the consideration of additional measures to strengthen the alliance, including expanded foreign military sales, technology development, and joint exercises; and (2) the intelligence sharing agreement between Japan and South Korea signed on November 23, 2016, concerning the direct exchange of intelligence on North Korea threats. Calls upon: (1) China to pressure North Korean leaders to cease their provocative behavior, abandon and dismantle their nuclear and missile programs through the curtailing of vital economic support and trade that support the North Korean government, and comply with all relevant United Nations Security Council Resolutions; and (2) the United States to apply all available economic sanctions, and cooperate with allies and other countries to impose additional sanctions, on North Korea.

Protecting Seniors' Access to Medicare Act of 2017 This bill amends the Patient Protection and Affordable Care Act (PPACA) to terminate the Independent Payment Advisory Board (IPAB). Under PPACA, the IPAB is tasked with developing proposals to reduce the per capita rate of growth in Medicare spending.

Stop Debt Collection Abuse Act of 2017 This bill amends the Fair Debt Collection Practices Act to apply that Act's restrictions to collectors of debt owed to a federal agency. A federal agency that is a creditor may not sell or transfer a debt to a debt collector until 90 days after the obligation becomes delinquent or defaults. Specified notice to the consumer of such a sale or transfer is required. A collector of debt owed to a federal agency may not collect any interest, fee, charge, or expense that is: (1) unreasonable in relation to actual costs, (2) not authorized by a contract between the debt collector and the federal agency, or (3) greater than 10% of the amount collected. The Government Accountability Office shall study and report to Congress on the use of debt collectors by federal, state, and local government agencies.

Agency Accountability Act of 2017 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The funds may not be used unless the funding is provided in advance in an appropriations bill. Any amounts deposited during the fiscal year in which this bill is enacted may not be obligated during the fiscal year and must be used for deficit reduction. The bill includes an exception for funds to be paid to an individual entitled to receive the funds as a whistle-blower, including funds received as a percentage of amounts received by the government pursuant to a judgment or settlement agreement. The bill amends the Congressional Budget Act of 1974 to require offsetting receipts and collections to be treated as revenue. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.) The requirements of the bill do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (USPTO). The Under Secretary of Commerce for Intellectual Property and the Director of the USPTO must submit annually to Congress a report describing any fee, fine, penalty, or proceeds from a settlement collected by the USPTO during the previous year.

Military Surviving Spouses Equity Act This bill: (1) repeals certain provisions that require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or who would be entitled to retired pay except for being under 60 years of age, (2) prohibits requiring repayment of certain amounts previously paid to SBP recipients in the form of a retired pay refund, and (3) requires (current law authorizes) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. The Secretary concerned shall restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to the surviving child or children of a member.

Farm Regulatory Certainty Act This bill amends the Resources Conservation and Recovery Act of 1976 to specify that animal waste, manure, and fertilizer are excluded from the Act's requirements if the waste, manure, or fertilizer originates from or is utilized by an agricultural operation. Citizen suits may not be brought under the Act against an agricultural operation if federal or state legal and enforcement actions are already underway.

Public Land Renewable Energy Development Act of 2017 This bill amends the Energy Policy Act of 2005 to extend through FY2022 the authorization for deposit and use of lease revenues under the Geothermal Steam Act of 1970. Such funds shall be available to the Department of the Interior for FY2017 and afterwards to implement both the Energy Policy Act of 2005 and the Geothermal Steam Act of 1970. Interior shall establish priority areas on covered land (i.e., public land administered by Interior and not excluded under law from the development of geothermal, solar, or wind energy) for geothermal, solar, and wind energy projects. Variance areas shall also be considered for the development of renewable energy projects under this bill, consistent with the principles of multiple use (as defined under the Federal Land Policy and Management Act of 1976). The bill defines "variance area" as covered land that is neither an exclusion area (not suitable for development of renewable energy projects) nor a priority area. Interior shall establish a program to improve federal permit coordination with respect to renewable energy projects carried out on covered land. The bill establishes the Renewable Energy Resource Conservation Fund to make funds available to federal, state, and tribal agencies for distribution in regions in which renewable energy projects are located on federal land for: (1) restoring and protecting fish and wildlife habitat and corridors for affected species and water resources in areas affected by wind, geothermal, or solar energy development; and (2) preserving and improving recreational access to federal land and water in an affected region.

Medicare Access to Rehabilitation Services Act of 2017 This bill repeals existing caps on Medicare payment for certain outpatient physical-therapy services and speech-language pathology services. Under current law, annual payment for such services is capped at $1,980 in 2017, with specified percentage increases to that limit in subsequent years.

Target Practice and Marksmanship Training Support Act This bill amends the Pittman-Robertson Wildlife Restoration Act to facilitate the construction and expansion of public target ranges by: (1) authorizing a state to pay up to 90% of the costs of acquiring land for, expanding, or constructing a public target range; (2) authorizing a state to elect to allocate 10% of a specified amount apportioned to it from the federal aid to wildlife restoration fund for those costs; (3) limiting the federal share of those costs under such Act to 90%; and (4) requiring amounts provided for those costs under such Act to remain available for expenditure and obligation for five fiscal years. The United States shall be shielded from any civil action or claim for money damages for injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is funded by the federal government pursuant to such Act or located on federal land, except to the extent provided under the Federal Tort Claims Act with respect to the exercise or performance of a discretionary function. The bill urges the Forest Service and the Bureau of Land Management to cooperate with state and local authorities and other entities to carry out waste removal and other activities on any federal land used as a public target range to encourage its continued use for target practice or marksmanship training.

Shift Back to Society Act of 2017 This bill directs the Department of Justice to establish a pilot program that awards matching grants to historically black colleges and universities to provide educational programs for eligible offenders to facilitate re-entry into the community. An eligible offender is a convicted criminal offender who has been released from incarceration for less than one year or who is scheduled to be released from incarceration within one year. The Government Accountability Office must report to Congress on the results of the pilot program.

National Right-to-Work Act This bill amends the National Labor Relations Act and the Railway Labor Act to repeal those provisions that permit employers or labor organizations, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).

Common Sense Nutrition Disclosure Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to revise the nutritional information that restaurants and retail food establishments must disclose. The nutrient content disclosure statement on the menu or menu board must include: (1) the number of calories contained in the whole menu item; (2) the number of servings and number of calories per serving; or (3) the number of calories per common unit of the item, such as for a multi-serving item that is typically divided before presentation to the consumer. Nutritional information may be provided solely by a remote-access menu (e.g., an Internet menu) for food establishments where the majority of orders are placed by customers who are off-premises. Establishments with self-serve food may comply with the requirements for restaurants or place signs with nutritional information adjacent to each food item. An establishment's nutrient content disclosures may vary from actual nutrient content if the disclosures comply with current standards for reasonable basis. Establishments with standard menu items that come in different flavors, varieties, or combinations, that are listed as a single menu item may determine and disclose nutritional information using specified methods or methods allowed by the Food and Drug Administration (FDA). Regulations pursuant to this bill or the clause amended by this bill may not take effect earlier than two years after final regulations are promulgated. The FDA may not exempt states from nutrition labeling requirements.

Holocaust Insurance Accountability Act of 2017 This bill allows a beneficiary of a Holocaust-era life, dowry, education, annuity, property, or other insurance policy to bring a civil action in a U.S. district court against the insurer for the covered policy to recover proceeds due or, otherwise, to enforce any rights under the policy. The bill covers any policy that was: (1) in effect at any time from January 31, 1933, to December 31, 1945; and (2) issued to a policy holder domiciled in any area that was occupied or controlled by Nazi Germany, an ally or friendly government, or the territorial jurisdiction of Switzerland. The bill requires the award: (1) to a prevailing beneficiary of the amount of the proceeds due under the policy, plus prejudgment interest at 6% per year, compounded annually, calculated from the date the amount was originally due; and (2) of treble damages against any insurer that acted in bad faith. A civil action under this bill must be filed within 10 years after enactment of this bill. A prior judgment or release entered for any claim arising under a covered policy in any civil action in a federal or state court shall not impair a claim brought under this bill. Any executive agreement between the United States and a foreign government or any executive foreign policy of the U.S. government shall not supercede or preempt any state law or compromise, settle, extinguish, waive, preclude, bar, or foreclose any claim brought under this bill. A claim brought under state law within 10 years after enactment of this bill shall not be deemed untimely on the basis of any state or federal statute of limitations or on the basis of any other legal or equitable rule or doctrine governing timeliness.

Energy Savings Through Public-Private Partnerships Act of 2017 This bill amends the National Energy Conservation Policy Act to revise requirements for energy savings performance contracts and utility energy service contracts (performance contracts). These contracts allow federal agencies to work with private contractors on energy efficiency upgrades to federal facilities, unless the facilities are dams, reservoirs, or hydropower facilities owned or operated by federal agencies. Current law requires federal facility energy managers to evaluate and identify energy and water efficiency measures for federal facilities, but agencies are not required to implement the measures. The bill requires agencies to implement the measures if they are cost-effective. The Department of Energy must report to the President and Congress on each agency's performance contracts, including their investment value and their energy savings. The energy conservation measures that may be contained in performance contracts are expanded by including those involving energy consuming devices and required support structures. Agencies may not limit recognition of operation and maintenance savings associated with energy systems that were modernized or replaced with energy conservation measures and water conservation measures (e.g., lower energy and water bills due to energy efficiency and conservation measures). Agencies may sell or transfer energy savings and apply the proceeds to fund a performance contract. The energy savings that may be contained in performance contracts are expanded to include: (1) the use, sale, or transfer of energy incentives, rebates, or credits (including renewable energy credits) from governments or utilities; and (2) any revenue generated from a reduction in energy or water use, more efficient waste recycling, or additional energy generated from more efficient equipment.

This joint resolution nullifies the “Implementation of the NICS Improvement Amendments Act of 2007 ” rule finalized by the Social Security Administration on December 19, 2016. The rule implements a plan to provide to the National Instant Criminal History Background Check System the name of an individual who meets certain criteria, including that benefit payments are made through a representative payee because the individual is determined to be mentally incapable of managing them. (Current law prohibits firearm sale or transfer to and purchase or possession by a person who has been adjudicated as a mental defective.)

Academic Partnerships Lead Us to Success Act or the A PLUS Act This bill allows each state to receive federal elementary and secondary education funds on a consolidated basis and manage the funds to advance the educational policy of the state. A declaration of intent must be formulated by a combination of specified state officials or by referendum and must list the programs for which consolidated funding is requested. States may use such funds for any educational purpose permitted by state law, but must make certain assurances that they will use fiscal control and fund accounting procedures, abide by federal civil rights laws, advance educational opportunities for the disadvantaged, and use federal funds to supplement rather than supplant state funding. Each declaration state shall: (1) inform the public about its student achievement assessment system, (2) report annually on student progress toward the state's proficiency standards by specified student groups, and (3) provide for the equitable participation of private school children and teachers in the same manner as provided for under current law.

Child Interstate Abortion Notification Act This bill amends the federal criminal code to make it a crime to knowingly transport a minor across a state line to obtain an abortion without satisfying a parental involvement law in the minor's resident state. A parental involvement law requires parental consent or notification, or judicial authorization, for a minor to obtain an abortion. A violator is subject to criminal penalties—a fine, up to one year in prison, or both. The bill provides an exception for an abortion that is necessary to save the life of a minor whose life is endangered by a physical disorder, illness, or condition. This bill prohibits an individual who has committed incest with a minor from knowingly transporting the minor across a state line to receive an abortion. Additionally, this bill makes it a crime for a physician to knowingly perform or induce an abortion on an out-of-state minor without first complying with parental notification requirements, subject to specified exceptions. A physician violator is subject to criminal penalties—a fine, up to one year in prison, or both.

Life at Conception Act This bill declares that the right to life guaranteed by the Constitution is vested in each human being at all stages of life, including the moment of fertilization, cloning, or other moment at which an individual comes into being. Nothing in this bill shall be construed to authorize the prosecution of any woman for the death of her unborn child.

Local Enforcement for Local Lands Act This bill declares that, by September 30, 2017, the Department of Agriculture (USDA) shall terminate the Forest Service Law Enforcement and Investigations unit and cease using Forest Service employees to perform law enforcement functions on federal lands. Also by such date, the Department of the Interior shall terminate the Bureau of Land Management Office of Law Enforcement and cease using Interior employees to perform law enforcement functions on federal lands. Interior shall make a grant to each state to permit the state to maintain law and order on federal land, protect individuals and property on federal lands, and enforce federal law. Any state or local government receiving the grant or subgrant shall enter into an agreement with Interior or USDA, as appropriate, to address the maintenance of law and order and the protection of individuals and property on federal land. In any such agreement, Interior or USDA must waive all civil claims against the state or local government and indemnify that government and save it harmless from all claims by third parties for property damage or personal injury that may arise out of law enforcement functions performed under the agreement. A state or local law enforcement officer performing law enforcement functions pursuant to such an agreement shall not generally be deemed a federal employee with respect to hours of work, compensation rates, leave, unemployment compensation, and federal benefits, among other things.

Mark Takai Atomic Veterans Healthcare Parity Act This bill includes veterans who participated in the cleanup of Enewetak Atoll in the Marshall Islands between January 1, 1977, and December 31, 1980, as radiation exposed veterans for purposes of the Department of Veterans Affairs presumption of service-connection for specified cancers.

Stopping EPA Overreach Act of 2017 This bill amends the Clean Air Act to exclude carbon dioxide, water vapor, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride pollution from the scope of that Act. The bill declares that current law does not authorize or require the regulation of climate change or global warming and nullifies certain final rules relating to: (1) greenhouse gas and volatile organic compounds emissions, including methane emissions, from the oil and natural gas sector; and (2) carbon pollution emissions from the utility power sector. Before proposing or finalizing regulations or policies, the Environmental Protection Agency must analyze the net and gross impact of those regulations and policies on employment. Regulations and policies may not take effect if they have a negative impact on employment, unless they are approved by Congress and signed by the President.

Conscience Protection Act of 2017 This bill amends the Public Health Service Act to codify the prohibition against the federal government and state and local governments that receive federal financial assistance for health-related activities penalizing or discriminating against a health care provider based on the provider's refusal to be involved in, or provide coverage for, abortion. Health care providers include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers. The Office for Civil Rights of the Department of Health and Human Services, in coordination with the Department of Justice (DOJ), must investigate complaints alleging discrimination based on an individual's religious belief, moral conviction, or refusal to be involved in an abortion. DOJ or any entity adversely affected by such discrimination may obtain equitable or legal relief in a civil action. Administrative remedies do not need to be sought or exhausted prior to commencing an action or granting relief. Such an action may be brought against a governmental entity.

Water and Agriculture Tax Reform Act of 201 7 This bill amends the Internal Revenue Code to permit tax-exempt mutual ditch or irrigation companies to earn income from dispositions of certain real property and stock interests without affecting their tax-exempt status, but requires that such income be used to pay the costs of operations, maintenance, and capital improvements of such a company. The bill also establishes a rule regarding the organizational governance of mutual ditch or irrigation companies. Where state law provides that such a company may be organized in a manner that permits voting on a basis that is pro rata to share ownership on corporate governance matters, the tax-exempt status of the mutual ditch or irrigation company must be determined without taking into account whether its member shareholders have one vote on corporate governance matters per share held in the corporation.

National Strategic and Critical Minerals Production Act This bill addresses the mine permitting process. Under the bill, projects that provide minerals vital to job creation, energy infrastructure, American economic competitiveness, and national security must be considered to be "infrastructure projects" as described in Executive Order 13604, entitled "Improving Performance of Federal Permitting and Review of Infrastructure Projects" dated March 22, 2012. This order directed federal agencies to significantly reduce the time required to make permitting and review decisions on infrastructure projects. The bill sets forth general requirements for an existing mineral exploration or mine permit application. The Bureau of Land Management (BLM) or the Forest Service shall appoint a project lead for the mine permitting process to coordinate with other agencies to ensure that the agencies: minimize delays, set and adhere to timelines for completion of the permitting process, set clear permitting goals, and track progress against goals. The requirements of the National Environmental Policy Act of 1969 are satisfied if the BLM or the Forest Service determines that the agency issuing the permit will address specified factors, such as environmental impact, alternatives to issuance of the permit, or any irreversible and irretrievable commitment of resources that would be involved in the proposed action. The time period for completion of the mine permitting review process shall not exceed 30 months, except by mutual agreement. Projects on National Forest System land shall be exempt from regulations that prohibit timber tree cutting and road construction in areas without roads. The bill does not apply to oil, gas, and potash leasing and development within the designated potash areas of Eddy and Lea Counties, New Mexico.

Corporate Rate Equality and Trade Empowerment Jobs Act of 2017 or the Create Jobs Act This bill amends the Internal Revenue Code to lower the rate of tax on the taxable income of corporations to the greater of: (1) 10%, or (2) the rate that is 5% below the average corporate income tax rate for Organization for Economic Co-operation and Development countries other than the United States. The bill also sets forth a procedure for a congressional joint resolution approving an increase in the corporate tax rate.
