Veterans Justice Outreach Improvement Act This bill updates the Department of Veterans Affairs (VA) Veterans Justice Outreach Program, which is a program through which the VA identifies justice-involved veterans and provides them with access to VA services. Justice-involved veterans are those with active, ongoing, or recent contact with some component of a local criminal justice system. Specifically, the bill requires the VA to conduct program outreach to justice-involved veterans, military and veterans service organizations, and relevant stakeholders in the criminal justice community (e.g., local law enforcement). The VA must increase the number of program specialists responsible for supporting justice-involved veterans in rural, remote, or underserved areas. Additionally, the VA must establish performance goals, measures, and implementation time lines for the program, specialists, and providing support for research regarding justice-involved veterans. Program specialists must receive training, at least annually, on (1) veteran eligibility for the program, and (2) best practices for identifying and conducting outreach to justice-involved veterans and relevant stakeholders in the criminal justice community.

Accountability in Foreign Animal Research Act This bill prohibits the National Institutes of Health from conducting or supporting research that involves testing on vertebrate animals in China, Cuba, Iran, North Korea, Russia, or other countries determined to be a foreign adversary.

Stabilizing Medicare Access to Rehabilitation and Therapy Act or the SMART Act This bill modifies the application of a certain Medicare payment methodology for outpatient physical therapy services and outpatient occupational therapy services that are furnished by a therapy assistant. Under current law, effective January 1, 2022, payment for such services is 85% of the otherwise applicable rate. The bill delays this effective date by one year and excludes services that are furnished in rural or medically underserved areas from this payment methodology. The bill also specifies that supervision requirements for outpatient physical therapy services that are furnished through private practice may not be more stringent for purposes of Medicare coverage than under state law.

This resolution requests the President and directs the Department of State to transmit to the House of Representatives, not later than 14 days after the adoption of this resolution, copies of both classified and unclassified documents that refer or relate to certain information on the withdrawal of the United States from Afghanistan, including reactions, concerns, or objections expressed by certain allies and partners; any agreement reached with the Taliban related to the evacuation of specified individuals; and numbers of specified individuals in contact with the State Department to request evacuation assistance from Afghanistan, from July 30, 2021, to the present.

Prevent All Soring Tactics Act of 2021 or the PAST Act of 2021 This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

Protecting Financial Privacy Act of 2021 This bill prohibits a federal agency from creating, implementing, or administering a program that requires financial institutions or individuals to report on the balances of, transactions involving, or transfers into and out of financial accounts. This prohibition does not apply to laws or regulations in effect on September 1, 2021, or to the Bank Secrecy Act (laws that require financial institutions and other entities to report on certain financial transactions to prevent money laundering, the financing of terrorism, and other criminal activity). This prohibition does apply, however, to regulations issued under the Bank Secrecy Act after September 1, 2021.

Medically Tailored Home-Delivered Meals Demonstration Pilot Act of 2021 This bill requires the Centers for Medicare & Medicaid Services to establish a demonstration program to allow hospitals to provide medically tailored, home-delivered meals to Medicare beneficiaries who have a diet-impacted disease (e.g., kidney disease) and have daily living limitations. Participating hospitals must (1) retain a physician, registered dietitian or nutrition professional, or clinical social worker to screen, monitor, and coordinate services for individuals who receive meals through the program; and (2) contract with experienced organizations for meal delivery. Hospitals may choose to also provide meals to an individual's primary caregiver or to a dependent under the age of 18 who resides in the same household.

Animal Freedom from Testing, Experiments, and Research Act of 2021 or the AFTER Act of 2021 This bill requires federal research facilities to facilitate the adoption or nonlaboratory placement of certain warm-blooded animals (e.g., dogs, cats, monkeys, guinea pigs, hamsters, and rabbits) with animal rescue organizations, animal sanctuaries, animal shelters, or individuals. In order to be adopted or placed, the animals must (1) no longer be needed for research; (2) be suitable for release; (3) not be birds, rats, or mice.

9/11 Memorial and Museum Act This bill directs the Department of Homeland Security (DHS) to award to the official organization that operates the National September 11 Memorial & Museum a one-time grant to be used solely for the purposes of the operation, security, and maintenance of the memorial and museum. As a condition on receipt of the grant, the organization must provide for free admission to all facilities and museums associated with the memorial and museum for active and retired members of the Armed Forces, individuals who were registered first responders to the terrorist attacks of September 11, 2001, and family members of victims of such attacks; provide for dedicated free admission hours for the general public at least once a week; and allow for annual federal audits of its financial statements.

Preventing Overdoses and Saving Lives Act of 2021 This bill establishes a grant program for states, Indian tribes, and territories to respond to the opioid crisis. In awarding the grants, the Department of Health and Human Services (HHS) must give priority to recipients with the highest opioid dispensing rates. Recipients must use at least 20% of grant funds to implement a program that requires a prescription for an opioid overdose reversal drug along with an opioid prescription if (1) a patient is prescribed benzodiazepines, medication-assisted treatment, or high-dose opioids; or (2) the prescriber has reason to know of the patient's history with substance use disorders. As part of this program, recipients must also require continuing education on opioid-prescribing practices for prescribers and on recognizing opioid overdose fatalities for coroners. Recipients must use the remaining funds to develop a strategic plan for the jurisdiction's response to the opioid crisis.

Working Dog Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the service that working dogs provide to society. The designs of the coins minted under this bill shall be emblematic of the contributions of working dogs to society, including in detection, military service, therapy and assistance. Treasury may issue coins only during the one-year period beginning on January 1, 2023. All sales of coins shall include a surcharge, which shall be paid to America's VetDogs for general expenses associated with the fulfillment of its mission.

Care for Her Act This bill allows an eligible taxpayer to claim the Child Tax Credit for the tax year preceding the year the child is born. It also sets out other activities to support parents and pregnant women. Specifically, the bill establishes the Pregnancy Support Collaborative, which consists of representatives from the Department of Health and Human Services (HHS) and states that elect to participate. The collaborative must maintain a clearinghouse of information on providers of pregnancy and parenting supports and services. States must identify providers in their jurisdictions who meet applicable criteria for inclusion. In addition, the collaborative must share information about education and training opportunities for parents and pregnant women and identify successful programs (including workplace policies) to support them. Furthermore, the collaborative must award grants to states for local programs to improve maternal and infant health outcomes. If a community demonstrates that its program reduces Medicaid costs, it retains a portion of those savings. If approved by the collaborative, HHS must award grants to providers in the clearinghouse for mentoring and training pregnant women and new mothers and addressing gaps in the availability of maternity housing. Additionally, HHS may award grants for pregnancy and parenting supports and services. The Centers for Disease Control and Prevention and the Centers for Medicare & Medicaid Services must jointly maintain a database of de-identified epidemiological and Medicaid claims data to evaluate the effect of maternity homes on maternal and infant health outcomes.

American Freedom and Internet Access Act of 2021 This bill requires the Department of the Air Force to develop and implement Operation Starfall to deploy stratospheric balloons, aerostats, or satellite technology capable of rapidly delivering wireless internet anywhere on the planet from the stratosphere or higher.

Championing Uncensored Bandwidth Access Act of 2021 or the CUBA Act of 2021 This bill requires the Department of State to develop a strategy for expanding open access to the internet and other telecommunications services in Cuba and for countering efforts by the Communist Party of Cuba to disrupt such access. The State Department must also report to Congress on its actions taken to implement the strategy and additional resources needed to increase access to telecommunications services in Cuba.

Ocean Shipping Reform Act of 2021 This bill revises provisions related to ocean shipping policies and is designed to support the growth and development of U.S. exports and promote reciprocal trade in the foreign commerce of the United States. Among other provisions, the bill sets forth requirements for operating a shipping exchange involving ocean transportation in the foreign commerce of the United States; prohibits ocean common carriers and marine terminal operators from retaliating or discriminating against shippers because such shippers have patronized another carrier, or filed a complaint; requires the Federal Maritime Commission (FMC) to publish and annually update all its findings of false certifications by ocean common carriers or marine terminal operators and all penalties assessed against such carriers or operators; requires ocean common carriers to adhere to minimum service standards that meet the public interest; directs the FMC to establish rules prohibiting ocean common carriers and marine terminal operators from adopting and applying unjust and unreasonable demurrage and detention fees; requires ocean common carriers to report to the FMC each calendar quarter on total import and export tonnage and the total loaded and empty 20-foot equivalent units per vessel that makes port in the United States; authorizes the FMC to initiate investigations of an ocean common carrier's fees or charges and apply enforcement measures, as appropriate; and revises annual reporting requirements for the FMC on foreign laws and practices to include practices by ocean common carriers.

9/11 Responder and Survivor Health Funding Correction Act This bill increases funding for and otherwise modifies a federal program that provides medical monitoring and treatment to responders and survivors who suffer from health conditions related to the September 11, 2001, attacks on the World Trade Center. Among the changes, the bill allows certain health care providers other than physicians to determine whether an individual's health condition is related to the attacks, and it establishes a research program to study the impacts of the attacks on health and educational outcomes of individuals who were 21 years of age or younger when the attacks occurred.

September 11 Transparency Act of 2021 This bill requires declassification reviews of certain documents related to investigations into the terrorist attacks on September 11, 2001. The Office of the Director of National Intelligence, the Department of Justice, and the Central Intelligence Agency must complete reviews of certain documents by deadlines specified in the bill.

Havana Syndrome Attacks Response Act This bill requires the President to sanction foreign persons and governments for carrying out clandestine attacks on U.S. personnel that have caused brain injury. Specifically, the President must impose visa- and asset-blocking sanctions on any foreign person that has directed or carried out such an attack. If the President determines a foreign government carried out such an attack, the President must notify Congress and sanction that country by terminating any foreign assistance (except for humanitarian aid or food or agricultural commodities or products) and arms transactions, restricting commercial exports, and denying access to U.S. credit or other financial assistance. The President must remove these sanctions after 12 months, provided that (1) the country's government gives reliable assurances that it will not conduct future attacks, and (2) the executive branch does not have persuasive information indicating an attack occurred in the preceding six months. The bill also requires a congressional briefing and report about suspected clandestine attacks on U.S. personnel that have caused brain injury, including hypotheses concerning the identity of the perpetrators and the technical methods used to carry out the attacks.

Promoting Access to Diabetic Shoes Act This bill allows a nurse practitioner or physician assistant to fulfill documentation requirements for coverage, under Medicare, of special shoes for diabetic individuals. Under current law, such requirements may be satisfied only by a physician.

Uyghur Policy Act of 2021 This bill addresses human rights issues concerning the Uyghurs and other minority groups in the Xinjiang Uyghur Autonomous Region in China. The bill authorizes the establishment of a Special Coordinator for Uyghur Issues position within the Department of State. The State Department's Bureau of Educational and Cultural Affairs may, subject to appropriations, make certain funds available to human rights advocates working on behalf of Uyghurs and members of other minority groups. The funds, if made available, shall be used to facilitate the presence of such human rights advocates at public diplomacy forums to speak on issues related to the human rights and religious freedoms of minority groups in Xinjiang. The State Department must ensure that Uyghur language training is available to Foreign Service officers. It must also ensure that a Uyghur-speaking member of the Foreign Service is assigned to U.S. diplomatic and consular missions in China.

This concurrent resolution expresses the sense of Congress that the individuals responsible for the July 1999 murders of U.S. citizens Ylli, Agron, and Mehmet Bytyqi in Serbia should be brought to justice and that the United States should devote sufficient resources to fully assist and monitor Serbia's efforts to investigate and prosecute such individuals.

Border Security for America Act of 2021 This bill addresses border security and related issues. For example, the bill requires the Department of Homeland Security (DHS) to resume all activities to construct a border barrier system along the U.S.-Mexico border that were underway or planned prior to January 20, 2021; requires DHS to deploy, in addition to physical barriers, tactical infrastructure and technology to achieve situational awareness and operational control of the southwest border; authorizes U.S. Customs and Border Protection (CBP) to carry out a program to acquire innovative commercial items through a competitive selection of proposals; imposes certain requirements for DHS border security technology acquisition programs that have a total expenditure of at least $300 million; requires CBP to implement certain technologies, including a program to establish a biometric exit data system at ports of entry; requires CBP to increase or maintain certain staffing levels for agents, officers, processing coordinators, and other positions; requires CBP to implement a workload staffing model for the U.S. Border Patrol and for CBP's Air and Marine Operations; and provides statutory authority through FY2026 for Operation Stonegarden, a Federal Emergency Management Agency program that provides grants to states and territories involved in certain active CBP border security operations.

COVID-19 American History Project Act This bill directs the American Folklife Center at the Library of Congress to establish a history project to be known as the COVID-19 American History Project to collect and make publicly available individual stories and records of experiences during the COVID-19 pandemic in the United States. The bill includes a requirement to collect video and audio recordings of personal histories and testimonials of those who were affected by the pandemic.

United Nations Transparency and Accountability Act of 2021 This bill requires various actions related to malign influence operations by other countries in the United Nations (UN), with such operations defined as coordinated actions by a UN member state to foster UN actions or attitudes that further that member state's interests in a manner inconsistent with the UN Charter. The President shall direct the U.S. Permanent Representative to the UN to vote for and promote policies to (1) oppose malign influence operations and UN employees involved in such operations, and (2) support Taiwan's membership or meaningful participation in UN entities. (Taiwan was expelled from the UN in 1971.) The Department of State shall designate a senior level official to assist in implementing such policies and fulfill other related responsibilities. The State Department shall also establish an Office of Multilateral Strategy and Personnel within the Bureau of International Organization Affairs to promote the candidacy of U.S. citizens for roles in international organizations, including the UN, and to coordinate support for non-U.S. candidates when appropriate. The State Department shall increase by at least 50% the number of U.S.-sponsored Junior Professional Officer positions in the UN. The President shall periodically review evidence and determine if any countries have engaged in malign influence operations that have threatened U.S. interests. The President must designate any such country as a malign global actor and provide an explanation to Congress for why the designation was made.

Performing Artist Tax Parity Act of 2021 This bill modifies the tax deduction for the expenses of performing artists (including commissions paid to managers or agents) to provide for a phaseout of such deduction for taxpayers whose adjusted gross income exceeds $100,000 ($200,000 for joint return filers). The $100,000 phaseout threshold is adjusted for inflation annually for taxable years beginning after 2021.

Global Malnutrition Prevention and Treatment Act of 2021 This bill sets out programs and otherwise directs the U.S. Agency for International Development (USAID) to carry out activities to prevent and treat malnutrition globally. Specifically, the USAID must leverage resources to address malnutrition through the Global Nutrition Coordination Plan (an interagency effort to strengthen the impact of U.S. investments in nutrition) and its role on the board of directors of the International Development Finance Corporation. The USAID must also select countries based on specified malnutrition-related indicators for purposes of targeting malnutrition prevention and treatment programs and update the selection within five years. Additionally, the USAID may establish the Nutrition Leadership Council to coordinate activities to prevent and treat malnutrition across the agency; target resources and nutrition interventions to the populations most susceptible to severe malnutrition and otherwise support efforts to prevent and treat malnutrition globally; and coordinate activities among partner countries, United Nations agencies, civil society, private sector actors, and others to, for example, build capacity in partner countries to sustain nutrition interventions. The bill also requires the USAID to provide to Congress an implementation plan and annual reports concerning its programs for treating and preventing malnutrition. The bill's provisions terminate seven years after its enactment.

New York-New Jersey Watershed Protection Act This bill requires the U.S. Fish and Wildlife Service to establish the New York-New Jersey Watershed Restoration Program, a nonregulatory program, to coordinate restoration and protection activities among government entities and conservation partners throughout the watershed. The bill also establishes the New York-New Jersey Watershed Restoration Grant Program, a voluntary grant and technical assistance program, to provide competitive matching grants to certain entities to implement restoration and protection activities for the watershed.

Guaranteeing Healthcare Access to Personnel Who Served Act This bill addresses the administration and provision of health care to veterans through the Department of Veterans Affairs (VA) and non-VA providers. First, the bill provides statutory authority for the eligibility thresholds for when a veteran must receive non-VA care under the Veterans Community Care Program (VCCP) for primary care, mental health care, noninstitutional extended care services, specialty care, or specialty services. Additionally, the bill establishes access to care standards for non-VA care under the VCCP, meaning a veteran's appointment must be within specified distances and time frames. Among other requirements, the VA must also implement an 18-month pilot program to allow certain veterans to use a website or mobile application to request, schedule, and confirm medical appointments with VCCP providers; ensure that VCCP third party administrators and credentials verification organizations comply with specified requirements to help ensure that certain health care providers are excluded from providing non-VA health care services; develop a strategic plan to ensure the effectiveness of the telehealth technologies and modalities delivered by the VA; and establish an online health care education portal for veterans. The bill requires the Government Accountability Office to report on (1) the VA program under which third parties provide transportation for veterans who are seeking VA services or benefits, (2) VA telehealth services, and (3) the VA's Foreign Medical Program. Finally, the Paperwork Reduction Act does not apply to the voluntary collection of information during research conducted by the Veterans Health Administration.

Resilient Federal Forests Act This bill modifies and sets forth provisions regarding forest management activities on National Forest System, public, and tribal lands. The bill provides for, among other things the Departments of Agriculture (USDA) and Interior to conduct fireshed management projects in fireshed management areas, certain categorical exclusions for various purposes, the balancing of the short- and long-term effects of forest management activities while considering injunctive relief, USDA and Interior to establish their own discretionary arbitration pilot programs as an alternative dispute resolution process for forest management activities, increasing the maximum term for a stewardship end result contract to 20 years, demonstration projects to support the development and commercialization of biochar on Indian forest lands or rangelands and in nearby communities by providing reliable supplies of feedstock from federal lands, the decommissioning of certain Forest Service Roads within designated high fire-prone areas, repealing of the Eastside Screens requirements on National Forest System lands, making the Northwest Forest Plan Survey and Manage Mitigation Measure Standards and Guidelines inapplicable to any National Forest System lands or public lands, development of a protection plan for giant sequoia trees on National Forest System lands and public lands, and permanent rights of access to the Oregon and California Railroad grant lands and the Coos Bay Wagon Road grant lands for private landowners issued reciprocal road rights-of-way.

Entrepreneurs Need Timely Replenishment (for) Eating Establishments Act or the ENTRÉE Act This bill provides FY2021 supplemental appropriations for the Restaurant Revitalization Fund and modifies requirements related to administration of the fund. The fund was established in response to COVID-19 to make grants to eligible food and beverage purveyors for covering specified costs such as payroll, operational expenses, and paid sick leave. The bill correspondingly rescinds unobligated amounts previously made available for the Economic Injury Disaster Loan Program and coronavirus state and local fiscal recovery funds. Further, the bill requires the Small Business Administration (SBA) to (1) review and process grant applications in the order in which they are received; (2) impose requirements on applicants that reduce waste, fraud, and abuse; and (3) submit and report monthly on an oversight and audit plan outlining the SBA's policies, procedures, and activities with respect to these grants.

Turkey Human Rights Promotion Act of 2021 This bill directs the Department of State to provide assistance to civil society organizations in Turkey that (1) work to secure the release of prisoners of conscience and political prisoners in Turkey, or (2) provide support and post-incarceration assistance for such prisoners.

Local Law Enforcement Protection Act of 2021 This bill requires state and local governments to certify that they provide a certain level of qualified immunity to law enforcement officers in order to be eligible for (1) funds under the Community Development Block Grant program, and (2) loans under the Department of Agriculture's Community Facilities Direct Loan and Grant Program. Qualified immunity is a judicially created legal doctrine that shields government officials from civil liability in cases involving the deprivation of statutory or constitutional rights.

Preserving Rules Ordered for The Entities Covered Through 340B Act of 2021 or the PROTECT 340B Act of 2021 This bill prohibits pharmacy benefit managers (PBMs) and health insurance plans from discriminating against health providers participating in the 340B drug pricing program, including pharmacies contracted with such providers to dispense 340B drugs. The 340B program allows certain providers to receive covered outpatient drugs at reduced prices from manufacturers. Specifically, PBMs and insurance plans may not reimburse 340B participants at a lower rate than other entities not participating in the program; impose differing terms (such as fees, charge-backs, or audits) on 340B participants; interfere with an individual's choice to receive drugs from a 340B participant; require 340B participants to identify which drugs fall within the program; or refuse to contract with a 340B participant on the basis that they utilize the program. Violations of this bill are subject to a civil penalty of not more than $5,000 per violation per day. These prohibitions also apply to prescription drug (Part D) sponsors under Medicare. The bill also provides for a process to prevent duplicate 340B drug discounts to states under Medicaid.

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

Rebuilding Communities After Disasters Act This bill requires the Small Business Administration (SBA) to increase the loan limits for the disaster loan program and to communicate certain information about the program following disasters. Specifically, the bill raises from $40,000 to $75,000 the loan amount for repair or replacement of household and personal effects and from $200,000 to $400,000 the loan amount for repair or replacement of a primary residence. Further, the bill requires the SBA to communicate through radio, television, print, and web-based outlets all relevant information needed by disaster loan applicants if a disaster is declared or the SBA declares eligibility for additional disaster assistance. (Currently, the SBA is only required to endeavor to communicate such information.) The SBA must submit a report on the disaster loan program that includes information such as the number and dollar value of program loans and the average estimated dollar value of damage sustained by borrowers.

Community and Senior Center Support Act This bill permits the Department of Agriculture (USDA) to provide financial assistance for multipurpose senior centers and essential community facilities that provide health, community, social, recreation, or cultural services, without regard to whether the center or facility is in a rural area, In providing this assistance in nonrural areas, USDA must consult with the Department of Housing and Urban Development. Currently, USDA may provide such assistance to rural areas.
