Federal Firearms Licensee Protection Act This bill amends the federal criminal code to modify provisions related to theft of firearms. Under current law, it is unlawful to steal a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. This bill broadens the scope of unlawful conduct to also prohibit stealing a firearm from a gun range that rents firearms or a shooting club. Additionally, the bill modifies criminal penalties for an offense: to increase from 10 to 20 years the maximum prison term, and to create a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. Finally, an attempt to commit an offense is subject to the same penalties as a substantive offense.

Prison Reform and Redemption Act

Prison Reform and Redemption Act This bill directs the Department of Justice to develop the Post-Sentencing Risk and Needs Assessment System for use by the Bureau of Prisons (BOP) to assess prisoner recidivism risk; guide housing, grouping, and program assignments; and incentivize and reward participation in and completion of recidivism reduction programs and productive activities. It amends the federal criminal code to: require the BOP to implement the Post-Sentencing Risk and Needs Assessment System; establish prerelease custody procedures for prisoners who, among other things, earn time credits for successfully completing recidivism reduction programs or productive activities; prohibit, subject to specified exceptions, the use of restraints on federal prisoners who are pregnant or in postpartum recovery; and broaden the duties of probation and pretrial services officers to include court-directed supervision of sex offenders conditionally released from civil commitment. The BOP must: incorporate de-escalation techniques into its training programs; report on its ability to treat heroin and opioid abuse through medication-assisted treatment; establish pilot programs on youth mentorship and service to abandoned, rescued, or vulnerable animals; and designate a release preparation coordinator at each facility that houses prisoners. The bill prohibits monitoring the contents of an electronic communication between a prisoner at a BOP facility and the prisoner's attorney. It amends the Second Chance Act of 2007 to reauthorize through FY2022 and modify eligibility criteria for an elderly offender early release pilot program. Lieutenant Osvaldo Albarati Correctional Officer Self-Protection Act of 2017 The bill amends the federal criminal code to require the BOP to allow federal correctional officers to securely store and carry concealed firearms on BOP premises outside the security perimeter of a prison.

Report and Educate About Campus Hazing Act or the REACH Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify campus security reporting requirements for an institution of higher education (IHE) that participates in federal student aid programs. Specifically, an IHE must disclose hazing incidents that were reported to campus security authorities or local police agencies in its annual security report. In addition, each IHE must provide students with an educational program on hazing, which includes information on hazing awareness, hazing prevention, and the IHE's policies on hazing. Hazing means any intentional, knowing, or reckless act committed by a student, or a former student, of an IHE against another student, that: (1) was committed in connection with an initiation into, an affiliation with, or the maintenance of membership in, any organization that is affiliated with the IHE; and (2) contributes to a substantial risk of physical injury, mental harm, or degradation or causes physical injury, mental harm or personal degradation.

Second Chance Reauthorization Act of 2017 This bill amends the Omnibus Crime Control and Safe Streets Act of 1968 to: revise and reauthorize grant programs for offender reentry demonstration projects; family-based substance abuse treatment; and evaluating and improving educational methods at prisons, jails, and juvenile facilities; and repeal grant programs for offender reentry courts and drug treatment alternatives to incarceration. Additionally, the legislation amends the Second Chance Act of 2007 to: rename, revise, and reauthorize grant programs for technology career training demonstration projects and reentry mentoring services, reauthorize offender reentry research and the grant program for offender reentry substance abuse and criminal justice collaboration, reauthorize and modify eligibility for an elderly offender early release pilot program, and repeal grant programs for the responsible reintegration of offenders and the study of Depot Naltrexone to treat heroin addiction. It amends the federal criminal code to establish partnerships between prisons and faith- or community-based nonprofit organizations to conduct activities to reduce recidivism. The Department of Justice (DOJ) Office of Inspector General must conduct annual audits of selected grant recipients to prevent waste, fraud, and abuse of funds. The bill prohibits grants to nonprofit organizations that hold money in an offshore account to avoid tax liability. It also prohibits a grantee from using grant funds to lobby DOJ or a state, local, or tribal government regarding the award of grant funding. DOJ, in collaboration with interested persons, providers, and organizations, and state, local, and tribal governments, must coordinate and report to Congress on federal reentry programs, policies, and practices. The bill limits the use of grants for conferences that use more than $20,000 in DOJ funds.

SITSA Act

Stop the Importation and Trafficking of Synthetic Analogues Act of 2017 or the SITSA Act This bill amends the Controlled Substances Act to establish a new, sixth schedule of controlled substances—schedule A. A drug or substance in schedule A has a chemical structure that is similar to, and an effect on the body that is similar to or greater than, a controlled substance in schedule I, II, III, IV, or V. The bill adds 13 synthetic fentanyl-related substances to schedule A. It also authorizes, and establishes procedures for, the Drug Enforcement Administration (DEA) to temporarily and permanently place a drug or substance in schedule A. The bill establishes criminal penalties for an individual who imports, exports, manufactures, distributes, or possesses with intent to distribute a schedule A substance. However, it explicitly prohibits criminal and civil penalties solely for possession of a schedule A controlled substance. The bill makes it unlawful to import, export, manufacture, distribute, dispense, or possess with intent to manufacture, distribute, or dispense, a schedule A substance that is not clearly labeled. Finally, it establishes new, separate DEA registration requirements for manufacturers, distributors, and importers and exporters of schedule A substances.

Volunteer Organization Protection Act of 2017 This bill amends the Volunteer Protection Act of 1997 to expand liability protections to volunteer nonprofit organizations for harm caused by an act or omission of a volunteer on behalf of the organization. The bill prohibits such liability protections from applying if the organization: (1) would be liable under laws governing the direct or vicarious liability of organizations, and (2) expressly authorized the specific conduct constituting the act or omission. The bill bars such an organization from liability for harm caused by the organization, or a volunteer acting on its behalf, if the act or omission was at the request of, or pursuant to an authorization by, a state, the United States, or another governmental subdivision, provided that: (1) the requesting or authorizing governmental entity would have been immune either from suit or from liability in damages if it had engaged in the acts or omissions itself or through employees or independent contractors; or (2) the governmental employee, agent, or contractor would have been immune either from suit or from liability in damages by virtue of immunity extended to individual governmental actors. The bill prohibits punitive damages from being awarded against a volunteer nonprofit organization for the actions of a volunteer within the scope of the volunteer's responsibilities to the organization unless the claimant establishes by clear and convincing evidence that the organization itself expressly authorized the volunteer's action with a conscious, flagrant indifference to the rights or safety of the individual harmed.

Puppies Assisting Wounded Servicemembers Act of 2017 or the PAWS Act of 2017 This bill directs the Department of Veterans Affairs (VA) to carry out a five-year pilot program under which it provides grants to eligible nonprofit organizations to provide service dogs to veterans who suffer from post-traumatic stress disorder after completing other evidence-based treatment. An organization that receives a grant shall provide for each participating service dog and veteran: coverage by a commercially available veterinary health insurance policy, hardware clinically determined to be required by the dog to perform the tasks necessary to assist the veteran, payments for travel expenses to obtain the dog, and travel expenses required to obtain a replacement service dog. To be eligible for a grant, an organization must: (1) agree to cover all costs in excess of the grant amount to guarantee such benefits, (2) be certified by Assistance Dogs International, (3) provide one-on-one training for each service dog and recipient for 30 hours or more over 90 days or more, and (4) provide an in-house residential facility or other accommodations nearby in which service dog recipients stay for a minimum of 10 days while receiving at least 30 hours of training. The VA shall develop metrics to measure the improvement in psychosocial function and therapeutic compliance and changes independence on prescription narcotics and psychotropic medication of veterans participating in the program. The Government Accountability Office must report to Congress on the methodology used for the pilot program.

Bankruptcy Judgeship Act of 2017 This bill amends the federal judicial code to: convert certain temporary bankruptcy judges to permanent bankruptcy judges and authorize the appointment of additional bankruptcy judges in Delaware and Michigan; convert temporary bankruptcy judges to permanent bankruptcy judges in specified judicial districts in Florida, Maryland, Nevada, North Carolina, Puerto Rico, and Virginia; and authorize the appointment of an additional bankruptcy judge in the middle district of Florida. The bill increases the quarterly fee payable to the U.S. trustee by chapter 11 (reorganization) debtors whose disbursements equal or exceed $1 million in a fiscal year unless the balance in the United States Trustee System Fund exceeds $200 million.

Promotion and Expansion of Private Employee Ownership Act of 201 7 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an "ESOP business concern" and allows such a concern to continue to qualify as a small business for the purposes of programs under the Small Business Act. An "ESOP business concern" is a business concern that was a small business concern eligible for a loan, preference, or other program under the Small Business Act before more than 49% of the business concern was acquired by an ESOP.

Fostering Stable Housing Opportunities Act of 2017 This bill amends the United States Housing Act of 1937 to include within the definition of "families" a child who is in foster care and has attained an age such that the provision of foster care for such child will end by reason of the age of the child within six months. Preference is given, subject to certain terms and conditions, for public housing occupancy and section 8 housing assistance under such Act to certain otherwise eligible children who are aging out of foster care and are at-risk for homelessness. The bill amends the Housing Act of 1949 to give preference for rural rental assistance to certain otherwise eligible children who are aging out of foster care and are at-risk of homelessness.

VA Billing Accountability Act This bill authorizes the Department of Veterans Affairs (VA) to waive the requirement that a veteran make copayments for medications, hospital care, nursing home care, and medical services if: an error committed by the VA or a VA employee was the cause of delaying copayment notification to the veteran, and the veteran received such notification later than 120 days (18 months in the case of a non-VA facility) after the date on which the veteran received the care or services. In requiring a veteran to make a copayment for care or services provided at a VA or a non-VA medical facility, the VA shall notify the veteran not later than 120 days (18 months in the case of a non-VA facility) after the date on which the veteran received the care or services. If the VA does not provide notification by such date, it may not collect the payment, including through a third-party entity, unless the veteran is provided with: information about applying for a waiver and establishing a payment plan with the VA, and an opportunity to make a waiver or establish a payment plan. The VA shall review and improve its copayment billing internal controls and notification procedures.

End Discriminatory State Taxes for Automobile Renters Act of 201 7 This bill prohibits state or local taxes that discriminate against the rental of motor vehicles, the business of renting motor vehicles, or motor vehicle rental property, except where such tax is imposed as of the enactment date of this bill, the tax does not lapse, the tax rate does not increase, and the tax base for such tax does not change. A tax that is imposed on the rental of motor vehicles or a motor vehicle rental business is discriminatory if: (1) it is not generally applicable to more than 51% of other rentals of tangible personal property or businesses within a state or locality, or (2) the rate exceeds the generally applicable tax rate on at least 51% of the other rentals of tangible personal property or businesses within the jurisdiction. A tax discriminates against motor vehicle rental property if a state or locality: (1) assesses the property at a value that has a higher ratio to the true market value of the property than the ratio applicable to commercial and industrial property, or (2) levies or collects either a tax on an assessment prohibited by this bill or an ad valorem property tax on motor vehicle rental property at a generally applicable rate that exceeds the rate for commercial and industrial property in the jurisdiction. A person who is aggrieved by a discriminatory tax may bring a civil action in a U.S. district court for damages, injunctive relief, other legal or equitable relief, or declaratory relief.
