Recognizes the shootings that occurred at Fort Hood, Texas, on November 5, 2009, as a tragic event in the history of the Army and the United States. Extends the deepest sympathies of Congress to the families and friends of the shooting victims. Honors the civilian law enforcement personnel of the Department of Defense (DOD) for implementing their training to eliminate the threat promptly, thereby limiting additional loss of life or injury. Commends the Fort Hood command team for its timely response and situational control. Expresses gratitude to the Fort Hood communities, military personnel stationed at Fort Hood, military service organizations, and the American people for promptly extending comfort and assistance to the victims of the shootings and their families.

Recognizes that National POW/MIA Recognition Day is one of the six days specified by law as a day on which the POW/MIA flag is to be flown over specified federal facilities and national cemeteries, military installations, and post offices. Extends the gratitude of the House of Representatives and the nation to those who have served the United States in captivity to hostile forces as prisoners of war. Recognizes and honors the more than 84,000 members of the Armed Forces who remain unaccounted for and their families. Recognizes the untiring efforts of national POW/MIA organizations in ensuring that America never forgets the contribution of the nation's prisoners of war and unaccounted for military personnel. Applauds the personnel of the Defense POW/Missing Personnel Office, the Joint POW/MIA Accounting Command, the Armed Forces Identification Laboratory, the Life Sciences Equipment Laboratory, and the military departments for continuing their mission of achieving the fullest possible accounting of all Americans unaccounted for as a result of the previous conflicts of the United States.

Amends the National Defense Authorization Act for Fiscal Year 2010 relating to the authority of the Secretary of the Navy to enter into multiyear contracts for the procurement of F/A-18E, F/A-18F, and EA-18G aircraft to: (1) extend from March 1, 2010, to September 1, 2010, the required date of a certification by the Secretary of Defense that certain contract conditions have been met; and (2) provide that such contract authority shall be deemed to meet the requirement that a multiyear contract equal to or greater than $500 million may not be entered into unless the contract is specifically authorized by law and provided for in an appropriations Act.

Expresses the sense of the House of Representatives that the U.S. government should: (1) work with Sudanese parties and regional and international partners to build consensus on the steps needed to implement the Comprehensive Peace Agreement (CPA), including the upcoming referenda, and promote stability throughout Sudan; (2) work with international and Sudanese partners to ensure the right of return of Sudanese refugees and displaced persons, including Darfuris and southerners; (3) work with international partners to ensure a stable north-south border and a permanent peace in Sudan; and (4) assist the government of Southern Sudan to develop its economic, rule of law, and social service and educational infrastructures, improve democratic accountability and human rights, and strengthen reconciliation efforts.

No Taxpayer Funding for Abortion Act - Prohibits: (1) the expenditure of funds authorized or appropriated by federal law or funds in any trust fund to which funds are authorized or appropriated by federal law for any abortion or for health benefits coverage that includes coverage of abortion; (2) any tax benefits for amounts paid or incurred for an abortion or for a health benefits plan (including premium assistance) that includes coverage of abortion; and (3) the inclusion of abortion in any health care service furnished by a federal health care facility or by any physician or other individual employed by the federal government. Exempts from such prohibitions an abortion if the pregnancy is the result of rape or incest with a minor, or if the woman suffers from a physical disorder, injury, or illness that would, as certified by a physician, place the women in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself. Makes such prohibitions applicable to federal funding within the budget of the District of Columbia. Prohibits federal agencies or programs and states and local governments that receive federal financial assistance from discriminating against any individual or institutional health care entity on the basis that such entity does not provide, pay for, provide coverage of, or refer for abortions. Designates the Office for Civil Rights of the Department of Health and Human Services (HHS) to receive, and coordinate the investigation of, discrimination complaints.

Iran Transparency and Accountability Act of 2010 or ITA Act of 2010 - Amends the Securities Exchange Act of 1934 to require an issuer to state, in its mandatory periodic report, whether it (or any subsidiary or affiliate) has: (1) engaged in an activity of a type and involving an amount that could subject it to sanctions under the Iran Sanctions Act of 1996; (2) knowingly engaged in an activity or violated regulations described under the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010; or (3) had any ties to a company designated by either the Secretary of the Treasury or the Secretary of State as contributing or supporting the proliferation activities of Iran. Prescribes specified disclosures. Requires the Securities and Exchange Commission (SEC) to make such disclosures public. Directs the President, upon receipt of such report, to investigate and determine if the issuer should be subject to sanctions under the Iran Sanctions Act of 1996.

Commercial Real Estate Stabilization Act of 2010 - Establishes an Oversight Board to: (1) advise the Secretary of the Treasury on the Commercial Real Estate Credit Guarantee Program (established by this Act); and (2) report quarterly to Congress on the Program and on the current state of the credit system in the United States with respect to commercial lending, small business, and commercial real estate lending. Directs the Secretary to establish the Commercial Real Estate Credit Guarantee Program, under which the Secretary shall guarantee payments of interest and principal on an approved credit instrument. Requires 50% of the Program to be used for small- and mid-sized institutions. Permits loans for either owner-occupied or nonowner-occupied commercial real estate. States that guarantees issued under this Act constitute general obligations of the United States, for which the full faith and credit of the United States is pledged. Expresses the intent of Congress that the Program be utilized when such utilization proves beneficial, and not be unduly inhibited by concerns related to potential unfavorable regulatory accounting treatment.

Home Health Care Access Protection Act of 2010 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Patient Protection and Affordable Care Act, with respect to the prospective payment system (PPS) for home health services and adjustments to it for case mix changes. Requires for years beginning with 2011 that any evaluation of case mix changes and any such adjustment be made using standards developed consistent with specified processes, taking certain criteria into account. Directs the Secretary to convene a Technical Advisory Group to advise on the development of such standards.

Supports efforts to retain the ban on the ability of the National Highway Traffic Safety Administration (NHTSA) to lobby state legislators using federal tax dollars. Recognizes the importance of motorcycle crash prevention as the primary source of motorcycle safety. Encourages NHTSA to: (1) focus on crash prevention and rider education as the most significant priorities in motorcycle safety; and (2) provide appropriate congressional committees a statement why it believes it is less important to focus on crash prevention, rider education and training, proper licensing, and reducing impaired riding than on mandating universal helmet use. Expresses the sense of the House of Representatives that any law that supersedes state laws regarding the use of helmets as it applies to denial of health coverage and benefits resulting from an injury sustained while riding a motorcycle should not be implemented.

Permanent Prevention of Asian Carp Act of 2010 - Directs the Secretary of the Army, acting through the Chief of Engineers, to study the watersheds of the Illinois, Chicago, and Calumet Rivers, including their tributaries, that drain directly into Lake Michigan to determine the feasibility and best means of implementing the hydrologic separation of the Great Lakes and the Mississippi River Basins to prevent the introduction or establishment of populations of aquatic nuisance species between the Great Lakes and Mississippi River Basins through the Chicago Area Water System (CAWS) and other aquatic pathways. Requires the study to: (1) include options to address flooding, Chicago wastewater and stormwater infrastructure, waterway safety operations, and barge and recreational vessel traffic alternatives; and (2) contain a detailed analysis of the environmental benefits and costs of each option. Directs: (1) the Secretary to carry out this Act at federal expense; and (2) the President, or the Council on Environmental Quality as a designee of the President, to oversee the study to ensure its thoroughness and timely completion.

Directs the Secretary of Health and Human Services (HHS) to establish a demonstration project under title XVIII (Medicare) of the Social Security Act (SSA) to evaluate the benefits of providing payment for items and services needed for the administration, within the homes of Medicare beneficiaries, of intravenous immune globin (IVIG) for the treatment of primary immune deficiency diseases. Amends SSA title XVIII to treat as durable medical equipment (DME) any disposable drug delivery systems, including elastomeric infusion pumps, for the treatment of colorectal cancer.

Stop Waste by Eliminating Excessive Programs Act of 2010 or the SWEEP Act - Declares that it shall not be in order in the House of Representatives or the Senate to consider any legislation that authorizes a program unless it provides budget authority for the program for 10 or fewer fiscal years. Requires a federal agency to make the program performance report for each program under its control available to Congress upon request. Establishes the Federal Program Sunset Commission, which shall: (1) submit to Congress a report analyzing the interaction between authorizing legislation and appropriations legislation and the effects of such interaction; (2) establish a schedule to review each activity or project (program) listed in the program and financing schedules of the annual federal budget every 10 years; (3) conduct a review of the efficiency of operation and public need for each such program according to that schedule; and (4) annually report to Congress on the programs reviewed, including recommendations regarding whether each program should be abolished or reorganized and whether the functions of any programs should be consolidated, transferred, or reorganized in an agency or among agencies and proposals for appropriate administrative or legislative action. Terminates the Commission 11 years after this Act's enactment unless reauthorized. Requires the Comptroller General: (1) in cooperation with the Director of the Congressional Research Service (CRS), to submit to Congress and update annually an inventory of all federal programs, with budgetary information to be provided by the Director of the Congressional Budget Office (CBO); and (2) organize the inventory by program areas that are reflective of national needs and agency missions and that are appropriate for the exercise of the review requirements of this Act. Requires the Comptroller General, the Director of CRS, and the Director of CBO to permit the mutual exchange of information that would aid in inventory compilation. Sets forth requirements for, and procedures for congressional consideration of, proposed legislation to abolish programs.

Transaction Account Guarantee Program Act of 2010 - Amends the Federal Deposit Insurance Act to establish the Transaction Account Guarantee (TAG) Program to provide a full guarantee for funds held in noninterest-bearing transaction accounts of insured depository institutions participating in the TAG Program. Requires an insured depository institution that wishes to participate in the TAG Program to submit an application to the Federal Deposit Insurance Corporation (FDIC). Allows an insured depository institution to opt-out of the TAG Program. Directs the FDIC to levy assessments on those insured depository institutions participating in the TAG Program.

Nurses for Impoverished Schools Act - Amends the Public Health Service Act to allow the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC), to make demonstration grants to eligible local educational agencies to reduce the student-to-nurse ratio in public elementary and secondary schools. Defines an "eligible local education agency" as one for which: (1) not less than 20% of the students served are from families with incomes below the poverty line; and (2) the student-to-school nurse ratio in public elementary and secondary schools is 750 or more students to every school nurse.

NATO First Act - States that it is U.S. policy on force structure in Europe to permit the United States to: (1) satisfy its commitments under article 5 of the North Atlantic Treaty of 1949; (2) address the current security environment in Europe, including U.S. participation in theater cooperation activities; and (3) contribute to peace and stability in Europe. Requires a report from the Secretary of Defense (DOD) to the congressional defense committees evaluating potential changes in the composition and capabilities of such force structure. Directs the Secretary to notify Congress at least 30 days before the permanent relocation of a military unit stationed outside the United States. Provides exceptions, including relocation due to deployment to a combat zone. Repeals a superseded reporting requirement under the National Defense Authorization Act (NDAA) for Fiscal Year 2010. Amends the NDAA for Fiscal Year 2006 to increase funding limits for, and extend through FY2013, a program to build the capacity of foreign military forces to support the European Command and other geographic combatant commands. Requires a program implementation plan by the Secretary. Sets forth U.S. policy on its extended deterrence commitment to Europe. Provides specific limitations on reductions in U.S. nuclear forces based in Europe, including that such reduction is requested by the government of the host nation and that the President makes certain certifications concerning the effects of such reduction. Requires the President to notify the defense committees of any such reduction, including a justification therefor, and prohibits the reduction until 180 days after such notification. Authorizes appropriations for: (1) developing the F-35 Lightning II aircraft into a dual-capable aircraft; and (2) supporting the life extension program for the B61 gravity bomb. Sets forth U.S. policy with respect to long-range missile defenses in Europe, including defending all North American Treaty Organization (NATO) allies from intercontinental and intermediate-range ballistic missiles, and continuing development and testing of the two-stage ground-based interceptor. Reserves FY2012-FY2013 funding for such purposes. Expresses the sense of Congress concerning the effects on U.S. missile defense of the New STAR treaty between the United States and Russia. Directs the Secretary of the Air Force to establish and maintain a scholarship program to allow personnel of air forces of foreign signatories of the Partnership for Peace Framework Document to receive undergraduate pilot and related training through the Euro-NATO Joint Jet Pilot Training program.

Demands that Hamas: (1) immediately and unconditionally release Israeli soldier Gilad Shalit; (2) allow access to the Israeli captives by competent medical personnel and representatives of the International Committee of the Red Cross; and (3) provide Gilad Shalit the humane treatment all captives are entitled to as a fundamental human right, including communication with his family. Expresses: (1) commitment to the survival of Israel as a Jewish and democratic state within recognized and secure borders; (2) support in resolving the Israeli-Palestinian conflict through the creation of a democratic, viable, and independent Palestinian state living in peace alongside Israel; (3) sympathy for Gilad Shalit's family; and (4) commitment to seek the release of Gilad Shalit and other missing Israeli soldiers. Recalls Israeli soldiers Ehud Goldwasser, Eldad Regev, Zecharya Baumel, Zvi Feldman, Yehuda Katz, Ron Arad, Guy Hever, and Majdy Halabi. Condemns: (1) Hamas for the cross border attack and kidnapping of Gilad Shalit; and (2) Iran and Syria for their support for international terrorism.

Global Resources and Opportunities for Women to Thrive Act of 2010 or GROWTH Act of 2010 - Targets assistance for women in developing countries with respect to: (1) microenterprises; (2) small and medium enterprises; (3) private property rights and land tenure security; (4) employment access; (5) trade benefits; (6) exchanges with U.S. entrepreneurs; (7) Millennium Challenge Account assistance; and (8) indigenous women's organizations. Directs the Secretary of State to establish the Global Resources and Opportunities for Women to Thrive (GROWTH) Fund to enhance economic opportunities for very poor, poor, and low-income women in developing countries with a focus on: (1) increasing women-owned enterprise development; (2) increasing property rights for women; (3) increasing women's access to financial services; (4) increasing women in leadership in implementing organizations, such as indigenous nongovernmental organizations, community-based organizations, and regulated financial intermediaries; (5) improving women's employment benefits and conditions; and (6) increasing women's ability to benefit from global trade.

Secure the Border Act of 2010 - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to require the Secretary of Homeland Security (DHS) to: (1) construct two layers of reinforced fencing along the entire international land border between the United States and Mexico; (2) provide for the installation of additional physical barriers, roads, lighting, cameras, and sensors along the entire length of the international border between the United States and Mexico and the United States and Canada; and (3) complete such work within two years. Increases the FY2011 budget of the Tunnel Task Force (a joint Immigration and Customs Enforcement [ICE], Customs and Border Patrol [CBP], and Drug Enforcement Administration [DEA] force tasked to pinpoint smuggling tunnels) by 100% above the FY2007 budget. Directs the Secretary to implement a program to fully integrate and utilize aerial surveillance technologies, including unmanned aerial vehicles, to enhance the security of the international borders between the United States and Mexico and the United States and Canada.

Second Amendment Enforcement Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, transporting for legitimate purposes, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Declares that nothing in such prohibitions shall be construed to prohibit the District from regulating the carrying of firearms by a person, either concealed or openly, other than at the person's dwelling place, place of business, or on other land possessed by the person. Amends the Firearms Control Regulations Act of 1975 (FCRA) to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" as any firearm which shoots, is designed to shoot, or can be readily restored to shoot automatically, more than one shot without manual reloading by a single function of the trigger. Includes also the frame or receiver of any such firearm, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a firearm into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; and (2) requirement that licensed firearms dealers keep records of ammunition received into inventory and ammunition sold or transferred. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Permits a licensed firearms dealer to sell or transfer ammunition, excluding restricted pistol bullets, to persons not otherwise prohibited from possessing or receiving ammunition. Declares that, in the case of a sale or transfer of a handgun to a District resident, a federally licensed importer, manufacturer, or dealer of firearms in Maryland or Virginia shall be treated as a dealer licensed under this Act if: (1) the transferee meets in person with the transferor to accomplish the transfer; and (2) the sale, delivery, and receipt fully comply with the legal conditions of sale in both the District and the jurisdiction in which the transfer occurs. Amends FCRA to allow an individual to possess ammunition in the District if the individual owns (currently, holds the valid registration certificate for) a firearm of the same gauge or caliber as such ammunition. (In effect, repeals the handgun ammunition ban.) Repeals the requirement that firearms in the possession of individuals (other than law enforcement personnel) must be kept unloaded, disassembled, or with the trigger locked, unless the firearm is kept at an individual's place of business, or while being used for lawful recreational purposes within the District . Continues current criminal penalties for allowing access of a minor (under age 16) to loaded firearms, except in specified circumstances. Repeals increased penalties for violations of the prohibition against allowing access of a minor to loaded firearms if injury or death results to the minor or another person. Requires the U.S. attorney, however, to consider both the extent of the minor's injuries and the effect of the minor's injury or death on both of the minor's parents when deciding whether to file charges. Prohibits any prosecution in such circumstances unless the person who committed the violation behaved in a grossly negligent manner, or unless similarly egregious circumstances exist. Eliminates criminal penalties for possessing an unregistered firearm. Amends the District of Columbia Code to: (1) allow private persons or entities owning property in the District to prohibit or restrict the possession of firearms on their property (other than authorized law enforcement personnel or lessees occupying residential or business premises); (2) prohibit unauthorized carrying of rifles or shotguns in the District; (3) authorize certain individuals to carry firearms in certain places and for certain purposes; (4) prescribe requirements for lawful transportation of firearms; and (5) prohibit the use of toy and antique pistols to commit a violent or dangerous crime. Authorizes the District of Columbia to prohibit or restrict the possession of firearms (except to lessees occupying residential or business premises) within any building or structure under its control, or in any area of it, which has implemented security measures to identify and exclude unauthorized or hazardous persons or articles. Amends the Office of Administrative Hearings Establishment Act of 2001 to grant jurisdiction to the Office of Administrative Hearings to hear cases pertaining to denial or revocation of firearm dealer licenses. Repeals the Firearms Registration Amendment Act of 2008 and the Inoperable Pistol Amendment Act of 2008. Restores and revives any provision of law amended or repealed by such Acts as if such Acts had not been enacted into law.

Kennesaw Mountain National Battlefield Park Boundary Adjustment Act of 2010 - Modifies the boundary of the Kennesaw Mountain National Battlefield Park in Georgia to include approximately eight acres identified as the Wallis House and Harriston Hill on the map entitled "Kennesaw Mountain National Battlefield Park, Proposed Boundary Adjustment," and dated February 2010. Authorizes the Secretary of the Interior to acquire land or interests, by donation or exchange, from willing sellers only. Requires acquired lands and interests to be administered as part of the Kennesaw Mountain National Battlefield Park.

Girls Protection Act of 2010 - Amends the federal criminal code to impose a fine or five-year prison term, or both, on any U.S. citizen or alien admitted for permanent residence who knowingly transports in foreign commerce a girl under the age of 18 for the purposes of female genital mutilation.

America COMPETES Reauthorization Act of 2010 - Establishes, revises, and extends specified science, technology, education, and mathematics (STEM) programs, as well as engineering, research, and training programs. Authorizes appropriations for FY2011-FY2015 for: (1) the National Science Foundation (NSF); (2) the National Institute of Standards and Technology (NIST); and (3) the Department of Energy (DOE) for activities of the Office of Science.

Amends the Patient Protection and Affordable Care Act to prohibit federal funds from being to used to cover any part of the costs of any health plan that includes coverage of abortion services. (Currently, federal funds cannot be used for abortion services and plans receiving federal funds must keep federal funds segregated from any funds for abortion services.) Requires any qualified health benefit plan offered through an Exchange that includes coverage for abortions to also offer a qualified health benefit plan through the Exchange that is identical in every respect except that it does not cover abortions.

Amends the federal criminal code to impose a fine and/or maximum prison term of five years for anyone who knowingly sells or offers to sell an animal crush video in interstate or foreign commerce for commercial gain. States that this prohibition shall not be construed to prohibit the selling or offering to sell videos that depict hunting. Defines "animal crush video" as any visual depiction of animals being intentionally crushed, burned, drowned, or impaled that: (1) depicts actual conduct in which a living animal is tortured, maimed, or mutilated that violates any criminal prohibition on intentional cruelty under federal law or the law of the state in which the depiction is sold; and (2) taken as a whole, does not have religious, political, scientific, educational, journalistic, historical, or artistic value.

Nutrition Education and Wellness in Schools Act or NEW Schools Act - Amends the Richard B. Russell National School Lunch Act to replace the nutrition promotion program with a program that requires local educational agencies (LEAs) to ensure that their local wellness policies: (1) include goals for nutrition and physical education, physical activity, on-campus food marketing and advertising, and other school-based activities that promote nutrition and wellness throughout the extended school day; (2) include plans for implementing, and measuring the implementation of, such policies; (3) require reimbursable school meals to meet certain nutritional guidelines; and (4) require the nutritional guidelines for nonreimbursable foods and beverages sold in schools to be in compliance with standards established by the Secretary of Agriculture. Requires each LEA, within two years of this Act's enactment and every three years thereafter, to complete and disseminate an assessment of their local wellness policy. Directs each LEA to designate a standing Local Wellness Policy Committee made up of education, health, and nutrition stakeholders to foster the integration of a local wellness policy that meets this Act's requirements with other health-related activities in the LEA's schools and community. Requires the Secretary to: (1) provide technical assistance and outreach to key state and local stakeholders to promote effective local wellness policies; and (2) prepare a report, in conjunction with the Director of the Centers for Disease Control and Prevention (CDC), on the implementation, strength, and effectiveness of local wellness policies. Amends the Child Nutrition Act of 1966 to replace the Team Nutrition Network program with The Wellness and Nutrition Network (TWNN) program providing grants to states to: (1) establish a comprehensive, integrated, and coordinated State Wellness and Nutrition Network; and (2) allocate grants to LEAs to promote and support healthy eating and physical activity programs, policies, or initiatives for children that participate in the child nutrition programs. Directs the Secretary to develop and implement a comprehensive and integrated national nutrition promotion and education strategy as part of TWNN.

Health Information Technology Extension for Behavioral Health Services Act of 2010 - Amends the Public Health Service Act to expand the definition of "health care provider" for purposes of health information technology provisions to include a behavioral or mental health professional, a substance abuse professional, a psychiatric hospital, a behavioral and mental health clinic, and a substance abuse treatment facility. Requires the Secretary of Health and Human Services (HHS), acting through the National Coordinator for Health Information Technology, to award grants to eligible entities to: (1) facilitate the purchase of health information technology; (2) enhance the use of such technology, including covering costs associated with upgrading such technology in order to meet the criteria required to become a certified electronic health record (EHR) technology; (3) train personnel in the use of such technology; (4) improve the secure electronic exchange of health information among behavioral and mental health professionals, substance abuse professionals, and other health care providers; (5) improve such technology for adaptation to community-based behavioral health settings; (6) assist with the implementation of telemedicine, including facilitation of distance clinical consultations in rural and underserved areas; and (7) collaborate and integrate with health information technology regional extension centers. Amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act to include qualified clinical psychologists, clinical social workers, psychiatric hospitals, mental health treatment facilities, and substance abuse treatment facilities within the health professionals, hospitals, and Medicaid providers eligible for incentive payments for the meaningful use of certified EHR technology.
