Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to support research on and facilitate access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Collaborative for Neurodegenerative Diseases, which shall support the development and regulatory approval of drugs that address ALS and other rare neurodegenerative diseases.

However, for a private fund to qualify as a venture capital fund, the investments predominately must be acquired directly. Under current law, non-qualifying investments—which include secondary transactions—may comprise up to 20% of a venture capital fund.

Among other things, the bill does the following: establishes the National Commission on Online Child Sexual Exploitation Prevention; directs the commission to develop best practices for interactive online service providers (e.g., Facebook and Twitter) to prevent the online sexual exploitation of children; requires interactive online service providers to certify compliance with the best practices (or implement other reasonable practices to prevent the online sexual exploitation of children), or else lose liability protections from claims alleging violations of child sexual exploitation laws; and replaces statutory references to child pornography with child sexual abuse material .

Preventing Future Pandemics Act of 2020

Preventing Future Pandemics Act of 2020 This bill establishes measures to address global public health risks posed by wildlife markets, which are commercial markets that sell or slaughter wildlife for human consumption as food or medicine in communities where alternative nutritional or protein sources are available. Specifically, the bill prohibits importing, exporting, purchasing, or selling live wild animals in the United States for human consumption as food or medicine. The Department of the Interior must hire, train, and deploy at least 50 new U.S. Fish and Wildlife Service law enforcement attachés around the world, and the U.S. Agency for International Development must increase specified activities to address the threats and causes of zoonotic (animal-to-human transmission) disease outbreaks. Additionally, the United States must work with other United Nations member states to urge a global ban on commercial wildlife markets and enforcement of laws to end wildlife trafficking. Further, the President may impose sanctions against a foreign country or foreign nationals that the Department of State has determined are taking certain actions that enable or facilitate commercial wildlife markets. Among other reports required by the bill, the State Department must conduct a study and submit a report that includes an evaluation of (1) the impact that consumption of terrestrial wildlife as food or medicine has on the transmission of novel viral and other pathogens, (2) the role of consuming terrestrial wildlife as food or medicine in the transmission of microbes from animals to humans, and (3) the conditions at live wildlife markets that lead to this transmission.

Foster Accountability, Integrity, Trust, and Honor in Congress Act or the FAITH in Congress Act This bill establishes prohibitions related to the compensation of Members of Congress, lobbying activities, and consideration of legislation. Specifically, the bill prohibits Members of Congress from being paid if both chambers of Congress have not (1) agreed to a budget resolution for the next fiscal year by April 15, or (2) passed each of the regular appropriations bills for the next fiscal year by September 30. In addition, the bill eliminates automatic pay adjustments for Members of Congress, and it prohibits generally the use of funds provided for official travel expenses of Members of Congress and legislative branch employees from being used for airline accommodations that are not coach class. Further, the bill prohibits former Members of Congress and elected officers of Congress from lobbying Congress, and it prohibits the House of Representatives from considering legislation that does not have demonstrable bipartisan support.

Paycheck Protection Small Business Forgiveness Act This bill modifies loan forgiveness under the Paycheck Protection Program established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill provides for automatic forgiveness of a paycheck protection loan that is not more than $150,000 if the recipient submits a one-page form. Such form must allow a recipient to submit specified demographc and expenditure information, and certain individuals (e.g., the President, the Vice President, or the head of an executive department) are not eligible for such forgiveness. Further, the bill prohibits any enforcement or other action against a lender relating to loan origination, forgiveness, or guarantee based on the lender's reliance on certifications or documentation submitted by a loan applicant or recipient.

Motor Carrier Safety Selection Standard Act This bill establishes a standard of care for the selection of brokers and other entities that contract with motor carriers for the shipment of goods or household goods. (A broker is a person, other than a motor carrier or an employee or agent of a motor carrier, that as a principal or agent sells, offers for sale, negotiates for, or holds itself out by solicitation, advertisement, or otherwise as selling, providing, or arranging for, transportation by motor carrier for compensation.) Specifically, the bill requires such entities to verify that a transporting motor carrier (1) is properly registered with the Department of Transportation (DOT); (2) has obtained the minimum required insurance coverage; and (3) is not determined unfit to safely operate commercial motor vehicles, or otherwise ordered to discontinue operations by the Federal Motor Carrier Safety Administration or a state. DOT must prescribe by regulation a process for revoking the registration of an owner or operator determined unfit to safely operate a commercial motor vehicle.

Hong Kong Safe Harbor Act

Hong Kong Safe Harbor Act This bill designates certain Hong Kong residents with priority status for refugee consideration and contains other related provisions. An individual and certain family members shall have such priority status if the individual (1) is a Hong Kong resident who suffered persecution or has a well-founded fear of persecution as a result of peaceful political activity; or (2) has been formally charged, detained, or convicted for certain peaceful actions. An individual receiving refugee status under this bill shall not be counted against various numerical limitations. When determining whether an individual shall be admitted as a refugee under this bill, an individual whose citizenship, nationality, or residency was revoked for submitting a nonfrivolous application for a U.S. immigration benefit shall be considered to have suffered persecution on account of political opinion. The general presumption that an alien is seeking immigrant status shall not apply to certain Hong Kong residents seeking asylum into the United States. (Typically, an alien seeking admission as a nonimmigrant must establish that the alien does not intend to immigrate to the United States.) This exception to the presumption shall apply to certain individuals involved in the 2019 and 2020 protests against China's encroachment into Hong Kong's autonomy (Hong Kong is a part of China but has a separate legal and economic system). An individual from Hong Kong may not be denied admission into the United States if the primary reason for the denial is a politically motivated government action against the individual's involvement in protests.

Great American Outdoors Act

Great American Outdoors Act This bill establishes the National Parks and Public Land Legacy Restoration Fund to support deferred maintenance projects on federal lands. For FY2021-FY2025, there shall be deposited into the fund an amount equal to 50% of all federal revenues from the development of oil, gas, coal, or alternative or renewable energy on federal lands and waters. Deposited amounts must not exceed $1.9 billion for any fiscal year. The fund must be used for priority deferred maintenance projects in specified systems that are administered by the National Park Service, the Forest Service, the U.S. Fish and Wildlife Service, the Bureau of Land Management, and the Bureau of Indian Education. The Government Accountability Office must report on the effect of the fund in reducing the backlog of priority deferred maintenance projects for the specified agencies. Additionally, the bill makes funding for the Land and Water Conservation Fund (LWCF) permanent. The President shall annually report to Congress specified details regarding the allocation of funds to the LWCF. Congress may provide for alternate allocations using specified procedures.

The bill also extends the covered period during which the recipient of a paycheck protection loan may use such funds for certain expenses while remaining eligible for forgiveness of the loan. Further, the bill prohibits the Small Business Administration from limiting the non-payroll portion of a forgivable covered loan amount. Currently, only 25% of a paycheck protection loan may be allocated to non-payroll expenses such as rent and utilities. The bill extends the period of time in which an employer may rehire or eliminate a reduction in employment, salary, or wages that would otherwise reduce the forgivable amount of a paycheck protection loan. However, the forgivable amount must be determined without regard to a reduction in the number of employees if the recipient is (1) unable to rehire an employee, (2) able to demonstrate an inability to hire a similarly qualified employee, or (3) able to demonstrate an inability to return to the same level of business activity. Lastly, the bill eliminates a provision that makes a paycheck protection loan recipient who has such indebtedness forgiven ineligible to defer payroll tax payments.

Jumpstarting Our Businesses' Success Credit Act of 2020 or the JOBS Credit Act of 2020 This bill increases the employer tax credit for the retention of employees and coordinates such credit with the Payroll Protection Program. Specifically, it increases the rate of the employee retention credit to 80% of up to $15,000 in employee wages per calendar quarter with an increased annual wage cap of $45,000 for all calendar quarters. The bill increases the maximum credit amount to $36,000. The bill expands the definition of large employer, for credit eligibility purposes, to include employers with more than 1,500 employees and more than $41.5 million in gross receipts in 2019, and requires employers to show a significant decline in gross receipts. It also extends eligibility for the credit to state governmental agencies and Indian tribal governments. The bill also coordinates the credit with the Paycheck Protection Program to allow employers to claim both programs subject to certain restrictions.

Open Technology Fund Authorization Act This bill authorizes the existing Open Technology Fund (OTF) as an independent grantee within the U.S. Agency for Global Media (USAGM). The OTF is an independent nonprofit organization within the purview of the USAGM that supports the development of internet freedom technologies that create ways to counter censorship efforts. As an independent grantee authorized by this bill, the OTF shall seek to advance freedom of the press and unrestricted internet access in repressive environments through functions such as researching, developing, implementing, and maintaining secure communications tools and technologies that circumvent censorship techniques used to limit or block access to the internet; advancing internet freedom by supporting private and public sector efforts to provide secure and uncensored access to the internet; and developing, acquiring, and distributing internet freedom technologies and techniques to fully enable the creation and distribution of digital content between and to all users and audiences. To advance freedom of the press and unrestricted internet access, the OTF shall use methods that include supporting fully open-source tools, code, and components that are as secure, transparent, and accessible as possible; supporting technologies that undergo comprehensive security audits; and establishing safeguards to mitigate the use of supported technologies for illicit purposes. The Department of State must report on the effectiveness of the OTF and the extent to which U.S. interests are being served by its work, and the Government Accountability Office shall have access to all information pertaining to financial transactions as may be necessary to facilitate an audit.

Stop the Spread of Invasive Mussels Act of 20 20 This bill directs the Bureau of Reclamation to provide financial assistance to states with Reclamation projects to prevent the spread of aquatic invasive species into and out of reservoirs operated and maintained by Reclamation, including assistance to purchase, establish, operate, or maintain a watercraft inspection and decontamination station that has the highest likelihood of preventing the spread of aquatic invasive species. In providing financial assistance, Reclamation must prioritize projects that (1) prevent the spread of an aquatic invasive species to waters under its jurisdiction, including irrigation, reclamation, or other water projects; and (2) align with the priorities of the state and with the document titled Quagga-Zebra Mussel Action Plan for Western U.S. Waters , published in February 2010. The bill provides authority for each federal agency on the Aquatic Nuisance Species Task Force to (1) conduct mandatory inspections and decontamination of watercraft; and (2) if necessary, impound, quarantine, or otherwise prevent entry of a watercraft. The membership of the task force is expanded to include the National Park Service, Bureau of Land Management, and Reclamation.

K2 Veterans Toxic Exposure Accountability Act of 2020 This bill addresses toxic exposure of members of the Armed Forces deployed to Karshi-Khanabad (K-2) Air Base in Uzbekistan between October 1, 2001, and December 31, 2005. Specifically, the bill requires the Department of Defense (DOD) to conduct a study and report on such exposure. Based on the results of the study, the Department of Veterans Affairs (VA) must determine (1) whether a positive association exists between such exposure and the occurrence of a diagnosed illness in humans, and (2) whether a presumption of service-connection is warranted. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. If the VA determines a presumption of service-connection is not warranted, notice must be published and include an explanation of the basis for the determination. The bill also requires the VA to remove previous presumptions if evidence indicates such presumption is not warranted. The bill requires the VA to establish and maintain a registry for individuals who were deployed to K-2 during the specified time frame. Finally, DOD must provide access to information upon request by the National Academies of Sciences, Engineering, and Medicine for purposes of a study regarding the effects of exposure to toxic substances at K-2.

TRAIN Act

Transit Revitalization And Infrastructure Needs Act or the TRAIN Act This bill expands the authority of the Department of Transportation (DOT) to provide fixed guideway capital investment grants. DOT may provide grants to state and local governments to assist in (1) expanding transit station platforms, (2) increasing service frequency, (3) increasing the capacity of an existing station, and (4) replacing temporary measures (including the use of rail equipment) which have been used to expand system capacity. A fixed guideway capital investment grant project may advance to the engineering phase of development if DOT makes certain determinations, including (1) that the project will increase capacity of an existing fixed guideway system, corridor, or station at least 10% or replace temporary measures; and (2) whether existing fixed guideway transit vehicles or stations are at or over capacity, or are projected to be at or over capacity within the next 10 years.

Repeatedly Flooded Communities Preparation Act

Repeatedly Flooded Communities Preparation Act This bill requires a community that participates in the National Flood Insurance Program and has been repeatedly flooded, as specified by the bill, to (1) assess the continuing risks to community areas repeatedly damaged by floods; and (2) develop and implement a publicly available, community-specific plan for mitigating continuing flood risks to such areas. The Federal Emergency Management Agency (FEMA) must, upon request, provide a community with appropriate data to assist in preparation of the required plan. In making decisions with respect to awarding flood risk mitigation grants, FEMA may consider the extent to which a community has complied with these requirements and is working to remedy problems with repeatedly flooded areas. A community that does not comply with these requirements may be subject to appropriate sanctions.

Domestic Terrorism Prevention Act of 2020

Domestic Terrorism Prevention Act of 2020 This bill establishes new requirements to expand the availability of information on domestic terrorism, as well as the relationship between domestic terrorism and hate crimes. It authorizes domestic terrorism components within the Department of Homeland Security (DHS), the Department of Justice (DOJ), and the Federal Bureau of Investigation (FBI) to monitor, analyze, investigate, and prosecute domestic terrorism. The domestic terrorism components of DHS, DOJ, and the FBI must jointly report on domestic terrorism, including white-supremacist-related incidents or attempted incidents. DHS, DOJ, and the FBI must review the anti-terrorism training and resource programs of their agencies that are provided to federal, state, local, and tribal law enforcement agencies. It creates an interagency task force to analyze and combat white supremacist and neo-Nazi infiltration of the uniformed services and federal law enforcement agencies. Finally, it directs the FBI to assign a special agent or hate crimes liaison to each field office to investigate hate crimes incidents with a nexus to domestic terrorism.
