Securing Transportation Energy Efficiency for Tomorrow Act of 2005 - Amends the Federal Property and Administrative Services Act of 1949 to authorize the Administrator of General Services to establish a program for the procurement and installation of photovoltaic solar electric systems for electric production in public buildings. Directs the Architect of the Capitol to evaluate the energy infrastructure of the Capitol Complex to determine how it could be augmented to become more energy efficient, using photovoltaic solar energy systems, district-heating, and other unconventional and renewable energy resources. Amends Federal transportation law to: (1) direct the Secretary of Transportation (Secretary) to establish a program of grants to State and local governments for fuel conservation projects; (2) authorize the Secretary to make grants for fuel cell bus technology projects; and (3) require environmental impact statements for Federal-aid highway and transit projects to consider energy impacts as an environmental project consequence. Directs the Secretary to establish: (1) a Conserve By Bicycling pilot program for projects to encourage the use of bicycles in place of motor vehicles; and (2) a specified public-private research partnership dedicated to advancement of railroad technology, efficiency, and safety owned by the Federal Railroad Administration and operated in the private sector. Directs: (1) the Secretary to establish a pilot clean airport bus replacement and fleet expansion grant program; and (2) the Administrator of the Federal Aviation Administration to establish a public-private research partnership to develop a clean ground demonstrator engine utilizing specified National Aeronautics and Space Administration-developed technologies. Directs the Secretary to establish a public-private research partnership to develop and demonstrate technologies that increase fuel economy, reduce emissions, and lower costs of marine transportation, as well as the efficiency of intermodal transfers. Directs the Secretary of the Army to study and report to Congress on the potential for reduced fossil fuel consumption through an increase in U.S. hydropower capabilities. Encourages specified adjacent States to continue to prohibit off-shore drilling in the Great Lakes for oil and gas, and other adjacent States to prohibit such drilling. Amends the Internal Revenue Code to exclude from gross income as a qualifying transportation fringe benefit a commuting allowance of $75 per month for individuals who bicycle, carpool, or car-share to work.

Erroneous Tax Refund Fairness Act - Amends the Internal Revenue Code to require the Secretary of the Treasury to abate interest on erroneous refund checks without regard to the amount of the refund check (current law provides for no abatement for refund checks exceeding $50,000 or for erroneous refunds caused by the taxpayer or a related third party). Authorizes the Secretary to deny abatement if the taxpayer received notice of the erroneous refund before the Internal Revenue Service (IRS) made demand for repayment and did not attempt to resolve the issue within 30 days.

Transportation Equity Act: A Legacy for Users - Reauthorizes the Federal-aid surface transportation program through FY 2009. Reauthorizes appropriations from the Highway Trust Fund (HTF) for: (1) specified highway (including highway safety) programs; (2) research and technology; (3) motor carrier transportation and safety; and (4) transportation research and education. Directs the Secretary of Transportation to establish a National Commission on Future Revenue Sources to Support the HTF. Establishes a National Commission on the Future of the Dwight D. Eisenhower National System of Interstate Defense Highways. Requires States with an urbanized area population of over 200,000 to obligate specified funds for congestion relief. Authorizes the Secretary to make grants to States that have enacted laws that prohibit the use of racial profiling in the enforcement of State laws regulating the use of Federal-aid highways. Federal Public Transportation Act of 2005 - Revises requirements for public transportation funding and the Secretary's authority to make specified grants, including grants for capital projects, planning, and transit and for commercial driver's license program improvements. Directs the Secretary to establish programs involving: (1) long-term bridge performance; (2) innovative highway safety technologies; (3) freight planning capacity building; (4) freight transportation research; (5) future strategic highway research; (6) surface transportation congestion solutions research; and (7) commercial remote sensing products and spatial information technologies. Intelligent Transportation Systems Act of 2005 - Directs the Secretary to conduct an ongoing intelligent system transportation research and development program. Requires: (1) metropolitan planning organizations to develop long-range transportation plans and transportation improvement programs for metropolitan planning areas; and (2) States to develop statewide transportation plans and statewide transportation improvement programs. Revises hazardous materials transportation requirements to provide uniformity in Federal standards regulating the transportation of hazardous materials in intrastate, interstate, and foreign commerce. States that this Act continues the Transportation Equity Act for the 21st Century provisions which guarantee that specified levels of authorized funding will be available for obligation each year by continuing the highway category and the mass transit category budgetary firewalls.

Second Chance for Ex-Offenders Act of 2005 - Amends the Federal criminal code to allow an individual to file a petition for expungement of a record of conviction for a nonviolent criminal offense if such individual has: (1) never been convicted of a violent offense and has never been convicted of a nonviolent offense other than the one for which expungement is sought; (2) fulfilled all requirements of the sentence of the court in which conviction was obtained; (3) remained free from dependency on or abuse of alcohol or a controlled substance for a minimum of one year and has been rehabilitated, to the court's satisfaction, if so required by the terms of supervised release; (4) obtained a high school diploma or completed a high school equivalency program; and (5) completed at least one year of community service. Authorizes an individual convicted of a felony or a misdemeanor to file an expungement petition. Directs the court, in ruling on such petition, after determining petitioner eligibility, to weigh the petitioner's interests against the best interests of justice and public safety. Authorizes the Department of Justice to maintain a nonpublic manual or computerized index of expunged records, to be made available only to Federal and State law enforcement personnel who have custody of such records for limited disclosure purposes. Requires the restoration of expunged records of individuals subsequently convicted of any Federal or State offense.

Amends the Federal Water Pollution Control Act to require projects receiving sewer overflow control grant assistance to be carried out subject to the requirements applicable to projects receiving assistance from State water pollution control revolving funds, except to the extent that the Governor of the State in which the project is located determines that a revolving fund requirement is inconsistent with the purposes of the sewer overflow control grant program. Reauthorizes appropriations for sewer overflow control grants through FY 2011. Modifies grant funding allocation provisions to reflect new dates of authorization and reauthorized amounts. Eliminates the set-aside for the Administrator of the Environmental Protection Agency (EPA) to make direct grants to municipalities and municipal entities during the second year of authorization. Establishes a December 31, 2008, deadline for the Administrator's report to Congress on recommended funding levels for sewer overflow control grants.

Department of Veterans Affairs Claims Backlog Reduction Act of 2005 - Directs the Secretary of Veterans Affairs to: (1) identify the current backlog of veterans' claims for benefits through the Department of Veterans Affairs and to categorize those claims; and (2) identify claims that need further development and refer them to a geographically appropriate County Veterans Service Office. Allows veterans' claims to be submitted to County Veterans Service Officers (in lieu of the Department) and authorizes the Officers to fully develop such claims. Requires appropriate information sharing between the Department's Benefits Delivery Network and the Offices. Requires funding provided by this Act to be allocated to States based on their respective populations of veterans and allocates such funds to the appropriate Office. Prohibits Federal funding from exceeding 50 percent of the costs of Office operations. Allows funding to be used to establish Officer programs in States that do not have one.

Directs the Consumer Product Safety Commission to prescribe regulations classifying any children's product containing lead as a banned hazardous substance under the Hazardous Substances Act. Defines "children's product containing lead" as any consumer product marketed for use by children under age six (or whose substantial use by such children is foreseeable) that contains more than trace amounts of lead as determined by the Commission and prescribed by regulations. Requires the Commission, if it determines that it is not feasible for certain electronic devices to immediately comply with prescribed regulations, to: (1) issue standards to reduce exposure and accessibility to lead in such devices; and (2) establish a schedule for full compliance.

Amends Federal provisions concerning the National Guard Youth Challenge Program (a civilian youth opportunities program conducted by the Secretary of Defense) to provide a maximum Federal matching funds level of 60 percent of the costs of operating the State program during FY 2005, 65 percent during FY 2006, 70 percent during FY 2007, and 75 percent during FY 2008 and beyond.

Free Flow of Information Act of 2005 - Prohibits Federal entities from compelling covered persons (specified media outlets or their employees) to testify or produce any document unless a court determines by clear and convincing evidence that: (1) the entity has unsuccessfully attempted to obtain such testimony or document from all non-covered persons; and (2) in a criminal matter, based on information from a non-covered person, there are reasonable grounds to believe a crime has occurred and the testimony or document is essential to the investigation, prosecution, or defense; or (3) in a non-criminal matter, based on information from a non-covered person, the testimony or document is essential to a dispositive issue of substantial importance. Requires the content of compelled testimony or documents to be: (1) limited to the purpose of verifying published information; and (2) narrowly tailored in subject matter and time period covered. Excludes certain commercial or financial information from coverage under this Act. Prohibits compelled disclosure, notwithstanding this Act's conditions for such disclosure, of: (1) the identity of a confidential source; or (2) information reasonably expected to lead to the discovery of such identity. Makes this Act applicable to testimony or documents sought from third parties that are related to business transactions with covered persons. Authorizes compelled disclosure in such cases only where the covered person has received notice and an opportunity to be heard. States that publication or dissemination of testimony or documents does not waive the requirements for compelled disclosure set forth in this Act.

Student Privacy Protection Act of 2005 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to revise provisions for military recruiter access to secondary school student information. Requires ESEA-assisted local educational agencies (LEAs) to notify each secondary school student's parent of the option to consent to a release of the student's name, address, and telephone listing to military recruiters, and to give the parent the opportunity to provide such consent in writing. Requires such LEAs to provide military recruiters, upon their request, with access to such information on a student only if the student's parent has given such written consent.

Keep Our Promise to America's Military Retirees Act - Directs the Secretary of Defense to enter into an agreement with the Office of Personnel Management to provide Federal Employees Health Benefits (FEHB) coverage to the following eligible beneficiaries: (1) a member or former member of the Armed Forces entitled to military retired or retainer pay; (2) an unremarried former spouse who was married to a member for at least 20 years, during which such member performed at least 20 years of retirement-creditable military service; (3) a dependent of a deceased qualifying member or former member; (4) a dependent of a living member or former member; and (5) a family member. Directs the Secretary to reimburse such eligible persons for pharmacy benefits received from a pharmacy that is not a TRICARE (Department of Defense managed health care plan) network pharmacy in the same manner as the Secretary would reimburse such person for such benefits received from a TRICARE network pharmacy. Requires such persons, in order to receive such reimbursement, to submit a certification from their physician stating that the person does not have access to a TRICARE network pharmacy due to physical or medical constraints. Amends title XVIII (Medicare) of the Social Security Act to waive the monthly part B premium (Supplementary Medical Insurance Benefits for the Aged and Disabled) with respect to: (1) an individual who is entitled to military retired or retainer pay based upon service that began before December 7, 1956; and (2) the spouse, widow, or widower of such individuals.

Caribbean National Forest Act of 2005 - Designates the El Toro Wilderness in the Caribbean National Forest/Luquillo Experimental Forest in the Commonwealth of Puerto Rico as a component of the National Wilderness Preservation System. Prohibits anything in this Act from precluding the installation and maintenance of hydrologic, meteorological, climatological, or atmospheric data collection and remote transmission facilities that are essential to the scientific research purposes of the Luquillo Experimental Forest.

Graduation for All Act - Authorizes the Secretary of Education to establish a program that will provide grants to State educational agencies (SEAs) and, through them, subgrants to local educational agencies (LEAs) to establish reading and writing programs to improve overall reading and writing performance among middle and high school students. Limits eligibility for subgrants to LEAs in a State that are among those that have the lowest graduation rates for public secondary school students. Includes among required uses of LEA subgrant funds: (1) hiring and inservice training of literacy coaches; (2) counseling for at-risk students; and (3) professional development for educators that addresses literacy needs of certain student groups. Amends the Elementary and Secondary Education Act of 1965 to include public secondary school graduation rates for all students under requirements for: (1) accountability for adequate yearly progress; and (2) annual State report cards. Amends the Adult Education and Family Literacy Act to require annual reports on the number participants who are 16, 17, or 18 years of age in certain programs and services, disaggregated by certain attributes.

Amends the Elementary and Secondary Education Act of 1965 to establish a program to assist States and local educational agencies (LEAs) to recruit, train, and hire additional school-based mental health and student service providers, including additional school counselors, psychologists, and social workers (in order to reduce the student-to-counselor ratios nationally, in elementary and secondary schools, to an average of one school counselor for every 250 students, one psychologist for every 1,000 students, and one social worker for every 800 students, as recommended in a report by the Institute of Medicine of the National Academy of Sciences relating to schools and health). Directs the Secretary of Education, after reserving certain funds for schools in outlying areas and schools run by the Bureau of Indian Affairs, to make program allotments to States according to a specified formula. Requires States to allocate funds from Federal and State shares of program costs to LEAs according to specified formulas.

Cord Blood Stem Cell Act of 2005 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration (HRSA), to enter into contracts with qualified cord blood stem cell banks to assist in establishing and maintaining a National Network of Cord Blood Stem Cell Banks to: (1) acquire, tissue type, test, cryopreserve, and store donated units of human cord blood acquired with the informed consent of the donor; (2) make cord blood units available to transplant centers for stem cell transplantations; and (3) allocate up to 10 percent of the cord blood inventory each year for peer-reviewed research. Requires the Secretary to provide for the establishment of a Board of Directors to administer the Network. Directs the Secretary, acting through the Administrator, to establish as part of the Network a National Cord Blood Stem Cell Registry to: (1) operate a system for identifying, acquiring, and distributing donated units of cord blood; (2) provide health care professionals with the ability to search the registry for suitable matches for patients; and (3) maintain a database to document the collection, storage, distribution, and transplantation of cord blood units and the clinical outcomes of Network transplantations. Requires the Administrator to report to the Secretary regarding the safety, efficacy, and cost-effectiveness of the clinical, research, and education activities of the Network. Requires the Board to ensure that: (1) the Network donor banks meet confidentiality and privacy requirements; and (2) the Network and their birthing hospital collection sites are geographically distributed throughout the United States.

Arthritis Prevention, Control, and Cure Act of 2005 - Amends the Public Health Service Act to require the Secretary of Health and Human Services: (1) to develop and implement a National Arthritis Action Plan; and (2) acting through the Director of the Centers for Disease Control and Prevention (CDC), to conduct, support, and promote the coordination of arthritis and other rheumatic diseases research. Requires the Secretary to award grants to: (1) support arthritis-specific research projects at the Centers for Prevention Research by the CDC; (2) support State comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities; and (3) assist in the implementation of a national strategy for arthritis control and prevention. Requires the Secretary to coordinate a national education and outreach program on arthritis and other rheumatic diseases. Requires the Secretary to establish an Arthritis and Rheumatic Diseases Interagency Coordinating Committee to: (1) improve coordination of Federal research activities related to arthritis and rheumatic diseases; and (2) convene a summit to provide a detailed overview of such current Federal research. Requires the Director of the National Institutes of Health (NIH) to expand and intensify juvenile arthritis research. Allows the Secretary, acting through the Director of the CDC, to award grants to support juvenile arthritis data collection. Requires the Secretary, acting through the Director of the CDC, to support the development of a National Juvenile Arthritis Patient Registry. Requires the Secretary to promote and support pediatric rheumatology training, including by allowing the Secretary to establish a loan repayment program. Requires the Comptroller General to conduct a study on the economic impact of arthritis in the workplace.

Amends the Horse Protection Act to prohibit the shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of horses and other equines to be slaughtered for human consumption. Authorizes the Secretary of Agriculture to detain for examination, testing, or the taking of evidence: (1) any horse at any horse show, horse exhibition, or horse sale or auction which is sore or which the Secretary has probable cause to believe is sore; and (2) any horse or other equine which the Secretary has probable cause to believe is being shipped, transported, moved, delivered, received, possessed, purchased, sold, or donated in violation of such prohibition.

Recognizes the unique obstacles that women face in ensuring retirement security and survivor and disability stability, and the essential role that Social Security plays in guaranteeing inflation-protected financial stability for women throughout their entire old age. Expresses the sense of the House of Representatives that the Congress and the President should take these factors into account when considering proposals to reform the Social Security system.

Government Reservation Accelerated Development for Education Act - Amends the Elementary and Secondary Education Act of 1965 to entitle certain local educational agencies (LEAs) to specified payment amounts under Impact Aid programs: (1) relating to Federal acquisition of real property; and (2) for basic support for eligible federally-connected children. (Current law makes such LEAs eligible for such payments up to specified maximum amounts.) Revises the formula for calculating additional Impact Aid payments to LEAs for federally-connected children with disabilities who are eligible for services under the Individuals with Disabilities Education Act. Extends the authorization of appropriations for: (1) construction and school modernization payments for certain LEAs, including ones with high percentages of children living on Indian lands or children of military parents; and (2) facilities maintenance payments for certain schools located on military bases and serving military dependent children.

No Taxation Without Representation Act of 2005 - Provides for full voting representation in Congress for the residents of the District of Columbia, including two Senators and as many Representatives as a similarly populous State would be entitled to under the law. Treats the District of Columbia as a State. Prescribes a procedure for the first elections under this Act. Entitles the District to one Representative until the taking effect of the next reapportionment.

National Computer Recycling Act - Directs the Administrator of the Environmental Protection Agency (EPA), after submitting to Congress the results of a study of waste materials in used computers that may be hazardous to human health or the environment along with related management recommendations, to require assessment of a fee on the sale to an end-user of any computer, monitor, or other designated electronic devices. Exempts nonprofit organizations from the fee requirement. Authorizes the Administrator to create additional fee exemptions for sales that will likely result in maximum reuse of significant components and the disposal of remaining components in an environmentally sound and lawful manner. Requires fees collected to be used for administration of this Act and for making grants to eligible individuals or organizations for: (1) collecting or processing used computers, monitors, or other devices for recycling; (2) reusing or reselling such devices; and (3) extracting and using, or selling for reuse, raw materials from such devices. Requires reports to Congress on the status of computer recycling, which shall include descriptions of fee collection and use.

Medicare's Equitable Drugs for Seniors Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to repeal provisions prohibiting the Secretary of Health and Human Services from: (1) interfering with the negotiations between drug manufacturers and pharmacies and prescription drug plan sponsors; and (2) requiring a particular formulary to institute a price structure for the reimbursement of covered Medicare part D (Voluntary Prescription Drug Benefit Program) drugs. Grants the Secretary instead, in order to ensure that beneficiaries enrolled under prescription drug plans and Medicare Advantage prescription drug plans pay the lowest possible price, authority similar to that of the Secretary of Veterans Affairs, Secretary of Defense, and the heads of other Federal agencies and departments that purchase prescription drugs in bulk to negotiate contracts with manufacturers of covered Medicare part D drugs, consistent with the requirements and in furtherance of the goals of providing quality care and containing costs under such part.

Little Rock Central High School Desegregation 50th Anniversary Commemorative Coin Act - Requires the Secretary of the Treasury to mint and issue coins commemorating the 50th anniversary of the desegregation of Little Rock Central High School in Little Rock, Arkansas. Requires the design of such coins to be emblematic of the desegregation of Little Rock Central High School and its contribution to civil rights in America. Specifies the sale price of such coins and applicable surcharges. Requires surcharges collected from sales to be used equally for: (1) the Jefferson National Parks Association for support of the activities and mission of Little Rock Central High National Historic Site; and (2) site improvements.

Alice Paul Congressional Gold Medal Act - Requires the Speaker of the House of Representatives and the President pro tempore of the Senate to make arrangements for the posthumous presentation of a congressional gold medal in commemoration of Alice Paul, to recognize her role in the women's suffrage movement and in advancing equal rights for women. Authorizes the Secretary of the Treasury to strike and sell duplicates in bronze of such medal. Requires proceeds from the sale of such medals to be deposited into the U.S. Mint Public Enterprise Fund.

Requires the Secretary of Homeland Security (Secretary) to grant lawful permanent resident status to certain nationals of Montserrat previously granted temporary protected status in the United States (and specified family members). Authorizes aliens previously ordered excluded, deported, or removed, or ordered to depart voluntarily, to apply for adjustment of status under this Act. Requires the Secretary to provide work authorization and related documentation to principal aliens seeking the benefits of this Act. Directs the Secretary to provide specified administrative review procedures for such aliens and their qualifying family members. States that the granting of adjustment of status for principal aliens under this Act shall not reduce the number of available immigrant visas.

Breast Cancer Research Stamp Reauthorization Act - Amends Federal postal law to extend through December 31, 2007, the U.S. Postal Service's authority to issue special postage stamps to help fund breast cancer research.

Retired Pay Restoration Act of 2005 - Expresses the sense of Congress that military retired pay should not be reduced because a military retiree is also eligible for veterans' disability compensation awarded for a service-connected disability. Allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability (currently, only a disability rated at 50 percent or more). Repeals provisions phasing in the full concurrent receipt of such pay through December 31, 2013. Makes eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay those individuals who were retired or separated from military service due to a service-connected disability.

Filipino Veterans Equity Act of 2005 - Deems certain service performed before July 1, 1946, in the organized military forces of the Philippines and the Philippine Scouts as active military service for purposes of eligibility for veterans' benefits through the Department of Veterans Affairs. Repeals certain provisions discounting such service as qualifying service.
