Military Death Benefit Improvement Act of 2005 - Increases from $12,000 to $100,000 the death gratuity payable to the survivors of members of the Armed Forces who die: (1) while on active duty or inactive duty training; or (2) within 120 days after discharge or release from such duty or training, if the death resulted from an injury or disease incurred or aggravated during such duty or training.

Bullying and Gang Prevention for School Safety and Crime Reduction Act of 2005 - Amends: (1) the Safe and Drug-Free Schools and Communities Act to cover bullying and gang (as well as drug and violence) prevention; and (2) the Omnibus Crime Control and Safe Streets Act of 1968 to authorize (with respect to juvenile accountability block grants) accountability-based programs designed to enhance school safety, which may include research-based bullying and gang prevention programs.

Family and Medical Leave Protection Act of 2005 - Amends the Family and Medical Leave Act of 1993 (FMLA) to: (1) include nurse practitioners as health care providers, and domestic partners as spouses, for FMLA coverage purposes; and (2) extend from 12 to 24 workweeks the period of family or medical leave for spouses employed by the same employer.

Expresses the sense of Congress that the National Academy of Sciences, through the Board on Children, Youth, and Families, should convene an expert panel to: (1) recommend the best practices and measures to use in data collection relating to foster care; and (2) research and develop methods for streamlining the application and approval process for moving a child from foster care to a permanent residence.

Geothermal Energy Initiative Act of 2005 - Directs the Secretary of Energy to: (1) review and publish annually the available assessments of geothermal energy resources available within the United States; and (2) undertake new assessments as necessary, taking into account changes in market conditions, available technologies, and other relevant factors. Directs the Secretary of the Interior and the Secretary of Agriculture to expedite development of geothermal energy in making revisions to certain land use plans for public lands and National Forest System lands, respectively. Directs the Secretary of the Interior to report to Congress any recommendations for statutory or regulatory changes that would assist geothermal energy development on Federal land, including: (1) a five-year plan for encouraging such development; and (2) a list, developed in consultation with the Secretaries of Energy and of Defense, of lands under their jurisdictions, that would be suitable for development for geothermal energy, as well as recommended statutory and regulatory mechanisms for such development. Instructs the Secretary of the Interior and the Secretary of Agriculture to enter into and submit to Congress a memorandum of understanding regarding leasing (including a five-year leasing plan) and permitting for geothermal development of public lands under their respective jurisdictions. Amends the Geothermal Steam Act of 1970 to authorize the Secretary of the Interior to reimburse certain persons through royalty credits for reasonable amounts paid for preparation by the Secretary (or a Secretary-selected contractor or other person) of project-level analysis, documentation, or related study required under the National Environmental Policy Act of 1969 with respect to the lease.

International Pediatric HIV/AIDS Network Act of 2005 - Amends the Foreign Assistance Act of 1961 to provide for the establishment and operation of a network of pediatric centers in countries in sub-Saharan Africa, the Republic of India, the People's Republic of China, the Co-operative Republic of Guyana, and other countries and areas with high rates of HIV/AIDS to provide: (1) treatment and care for children with HIV/AIDS; and (2) training of pediatric health care professionals.

Directs the Secretary of Education to study and report to Congress on the rate at which Native Americans (including Alaska Natives and Native Hawaiians) and students who reside in American Samoa, the Northern Mariana Islands, and Guam drop out of secondary schools in the United States. Requires recommendations for increasing the numbers of such students who graduate from secondary school. Directs the Secretary of Labor to report to Congress three years after enactment of this Act on the Federal programs funded during such period which were designed to decrease or otherwise address the rate at which students cease attending secondary schools in the United States before they have graduated.

Shirley Chisholm Congressional Gold Medal Act - Authorizes the posthumous award of a congressional gold medal in commemoration of Shirley Chisholm, in recognition of her activism, independence, and ground-breaking achievements in politics, her election as the first African-American woman in Congress, and her campaign to be the first African-American to gain the nomination of a major political party for President of the United States.

Child Safety Lock Act of 2005 - Amends the Brady Handgun Violence Prevention Act to define a firearm "locking device." Makes it unlawful for a licensed manufacturer, importer, or dealer to sell, deliver, or transfer a handgun without a locking device and specified warnings to any person other than a licensed manufacturer, importer, or dealer, with exceptions for law enforcement officers and governmental entities. Sets forth civil penalties, including suspension or loss of license, for related violations. Directs the Attorney General to: (1) prescribe such regulations governing the design, manufacture, and performance of trigger lock devices as are necessary to reduce or prevent the unintentional discharge of handguns, including setting a minimum safety standard to prevent children who have not attained age 18 from operating a handgun; and (2) in developing the standard, to consider such devices that are not detachable. Authorizes the Attorney General to issue an order prohibiting the manufacture, sale, transfer, or delivery of a trigger lock device which the Attorney General finds has been designed, manufactured, transferred, or distributed in violation of this Act. Grants the Attorney General specified authority regarding: (1) recall, repair, replacement, or refund with respect to such devices; and (2) inspections. Authorizes the Attorney General to: (1) assess a civil penalty of up to $10,000 per violation; and (2) revoke a Federal firearms license for a violation of this Act. Imposes criminal penalties for knowingly violating this Act. Directs that a portion of firearms tax revenue be used for public education programs on the safe storage and use of firearms.

Anti-Terrorism and Port Security Act of 2005 - Amends the Federal criminal code to make it unlawful to: (1) destroy or interfere with vessels or maritime facilities; (2) put destructive devices in U.S. waters; (3) use a dangerous weapon or explosive to try to kill someone on board a passenger vessel; (4) fail to heave to a vessel at the direction of an authorized Federal law enforcement official; (5) destroy an aid to maritime navigation maintained by the Saint Lawrence Seaway Development Corporation or the Coast Guard if this would endanger safe navigation; or (6) knowingly discharge or release a hazardous substance into U.S. navigable waters or the adjoining shoreline with intent to endanger human life, health, or welfare. Revises piracy and privateering laws, increasing penalties. Requires the Attorney General to coordinate port-related crime data collection. Designates the Captain-of-the-Port as the primary authority for seaport security at each port. Amends the Tariff Act of 1930 to establish criminal penalties for violations of prohibitions against falsity or lack of a cargo manifest, and increases civil penalties. Directs the Secretary of Homeland Security to: (1) develop a shipment profiling plan to track containers and shipments of merchandise to be imported; (2) submit to Congress a plan for inspecting merchandise and their transportation containers at foreign facilities before importation; (3) issue final regulations prescribing seaport security requirements; and (4) approve minimum standards for high security container seals and award grants to seal developers. Requires Captains-of-the-Port to secure and protect all sensitive information.

Commission to Study Reparation Proposals for African-Americans Act - Establishes the Commission to Study Reparation Proposals for African-Americans to examine: (1) the institution of slavery which existed within the United States and the colonies that became the United States from 1619 through 1865; (2) the extent to which the Federal and State governments supported the institution of slavery in constitutional and statutory provisions; (3) Federal and State laws that discriminated against freed African slaves and their descendants; and (4) the lingering negative effects of the institution of slavery on living African-Americans and on society in the United States. Instructs the Commission to address the following issues when making its recommendations to Congress: (1) whether the Federal government should offer a formal apology for the perpetration of gross human rights violations on African slaves and their descendants; (2) whether African-Americans still suffer from the lingering effects of slavery; and (3) whether any form of compensation to the descendants of African slaves is warranted.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956, and the Revised Statutes of the United States, to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from determining that real estate brokerage activity or real estate management activity is financial in nature, is incidental to any financial activity, or is complementary to a financial activity. (In effect, prohibits financial holding companies and national banks from engaging, directly or indirectly, in real estate brokerage or real estate management activities.) Exempts from such prohibition: (1) activities of a bank holding company (or any affiliate) that directly relate to managing any real property owned by national banks or their affiliates; and (2) the right, power, or ability of any financial holding company to engage in any activity, or acquire or retain the shares of any company engaged in an activity authorized for financial holding companies on December 6, 2001 ("grandfather clause").

Secure Domestic Container Partnership Act of 2005 - Amends Federal shipping law to direct the Secretary of Homeland Security to carry out an empty shipping container sealing pilot program to encourage shipping container handlers to seal empty shipping containers after they have unpacked them. Allows the Secretary to authorize a shipper, cargo carrier, freight forwarder, terminal operator, port authority, or labor organization that is a qualified container handler to secure, under a seal approved by the Secretary, a shipping container that is emptied by the person. Requires the Secretary to issue requirements for treating a person as a qualified container handler under this Act.

College Fire Prevention Act - Directs the Secretary of Education to make competitive demonstration grants to private or public colleges or universities, fraternities, or sororities for up to half the cost of installing fire sprinkler systems, or other fire suppression or prevention technologies, in student housing and dormitories owned or controlled by such entities. Requires grant priority to be given eligible entities that demonstrate the greatest financial need. Reserves the following portions of grant funds made available for each fiscal year: (1) at least ten percent for eligible entities that are historically Black colleges and universities, Hispanic-serving institutions, and tribally controlled colleges and universities; and (2) at least ten percent for eligible entities that are social fraternities and sororities. Provides that any application for assistance under this Act, any negative determination on the part of the Secretary with respect to such application, or any statement of reasons for the determination, shall not be admissible as evidence in any proceeding of any court, agency, board, or other entity (except a proceeding to enforce an agreement entered into between the Secretary and an eligible entity under this Act).

National Security Language Act - Amends the Higher Education Act of 1965 (HEA) to establish programs to encourage early foreign language instruction, including grants to: (1) partnerships of institutions of higher education (IHEs) and local educational agencies (LEAs) for activities relating to foreign language instruction at elementary or secondary schools, with priorities for high-need LEAs and less-commonly taught foreign languages; and (2) IHEs that develop innovative programs for the teaching of foreign languages, with priorities for combining foreign languages with science and technology and for less-commonly taught foreign languages. Provides undergraduate student loan forgiveness of up to $10,000 for students who major in a critical foreign language and are employed as teachers of such language in elementary or secondary schools or as using such language regularly in a Federal agency. Directs the Secretary of Education to: (1) establish a foreign language education marketing campaign to encourage students at secondary schools and IHEs to study foreign languages, particularly ones less commonly taught and critical to national security; and (2) conduct a study to identify foreign language heritage communities and recruit speakers of such critical languages. Amends the David L. Boren National Security Education Act of 1991 to establish an International Flagship Language Initiative with grants to IHEs.

Healthy People, Healthy Choices Act of 2005 - Requires the Director of the Centers for Disease Control and Prevention (CDC) to conduct public outreach campaigns to increase the awareness of African Americans and other minority populations about: (1) nutrition and fitness; (2) access to, and the affordability of, healthy foods and dietary supplements; (3) the need for health promotion; (4) how to prepare inexpensive, healthy meals; and (5) how to incorporate dietary supplements and physical activity into daily life. Allows the Director to make grants to: (1) not-for-profit organizations servicing medically underserved populations to promote healthy eating and regular exercise habits among minority communities; (2) State and local educational agencies and community organizations to conduct training events and demonstration projects for children and their parents in communities with significant minority populations; and (3) community organizations to encourage manufacturers to make their healthy food products available at a discount in communities with significant minority populations.

Keep America Healthy Act of 2005 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to make a new optional Medicaid eligibility group for individuals between ages 21 and 65 whose family income does not exceed a State-specified percentage up to 200 percent of the applicable poverty line. Authorizes the State also to require the individual's resources not to exceed whatever level the State may establish, so long as it is not more restrictive than the requirements of SSA title XVI (Supplemental Security Income). Provides for the application to such new group of the enhanced Federal medical assistance percentage dtermined under SSA title XXI (State Children's Health Insurance Program) (SCHIP). Amends SSA title XI to provide for an increase in the Medicaid payment limit for territories to accommodate expanded coverage for residents of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands.

Family Caregiver Security Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to provide for the use of qualified family caregivers in the provision of home health aide services under Medicare. Declares that nothing in such title shall be construed as authorizing the exclusion of coverage of skilled nursing services for an individual 75 years of age or older as part of home health services solely on the basis of the individual's refusal of physical therapy services during rehabilitation, regardless of whether such physical therapy services are part of the individual's plan of care.

Asthma Awareness, Education and Treatment Act of 2005 - Authorizes the Secretary of Health and Human Services to make grants to public and nonprofit private entities for projects for specified asthma-related activities in low-income communities, including screening and referrals, information and education, and workshops for parents and other individuals who supervise children. Authorizes the Secretary to award contracts to provide for a national media campaign to inform the public and health care providers about asthma, allergies, and related respiratory problems, especially in children. Amends the Internal Revenue Code to give taxpayers licensed and engaged in the trade or business of providing pest control services or heating, ventilation, and air conditioning services an income tax credit for the aggregate cost of providing such services without charge to: (1) public housing; or (2) any multifamily residential rental property at least 75 percent of whose occupants are reasonably expected to have incomes below 200 percent of the official poverty line. Directs the Secretary to provide for research regarding a causal relationship between air pollutants and the occurrence of asthma, allergies, and related respiratory problems. Requires the Director of the National Heart, Lung, and Blood Institute, through the National Asthma Education Prevention Program Coordinating Committee, to: (1) identify Federal programs that carry out asthma-related activities; and (2) develop and submit to Congress a Federal plan for responding to asthma. Requires the Director of the Centers for Disease Control and Prevention to collect and publish asthma-related data.

Stem Cell Replenishment Act of 2005 - Allows Federal funds to be used for research on human embryonic stem cells irrespective of the date on which the derivation process for such stem cells was initiated or completed. (Current law requires the derivation process to have begun by August 9, 2001.) Requires the Director of the National Institutes of Health (NIH) to revise human embryonic stem cell research guidelines to the extent necessary to ensure the availability of not less than 60 stem cell lines that are scientifically fit for distribution for research purposes.

Minority Populations Diabetes Prevention and Control Act of 2005 - Directs the Secretary of Health and Human Services, acting through the Centers for Disease Control and Prevention (CDC), to increase the extent of activities regarding diabetes in minorities, including: (1) grants for State-based initiatives; (2) prevention research; (3) cooperation with States to determine the national incidence and prevalence in various minority populations and the reasons therefor; (4) National Diabetes Education Program activities; and (5) projects to provide treatment. Authorizes appropriations to carry out the plan to implement recommendations of the Diabetes Research Working Group of the National Institutes on Diabetes and Digestive and Kidney Diseases.

Fairness to All Vietnam Veterans Act - Directs the Secretary of Defense to study and report to Congress: (1) to identify veterans who died after October 31, 1955, as a result of military operations in southeast Asia whose names are not eligible for inscription on the Vietnam Veterans Memorial; and (2) on the feasibility and equitability of revising the eligibility requirements to be more inclusive of such veterans or of creating an alternative means for recognizing them, including alternatives involving an education center at the Memorial.

Social Security Fairness Act of 2005 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to repeal: (1) pension offset provisions applicable to husband's and wife's insurance benefits, widow's and widower's insurance benefits, and mother's and father's insurance benefits with respect to OASDI payments; and (2) windfall elimination provisions with respect to computation of the primary insurance amount of an individual.

Goods Movement Act of 2005 - Directs the Secretary of Transportation to establish a goods movement program to improve the productivity, security, and safety of freight transportation gateways, while mitigating congestion and community impacts in the area of such gateways. Declares that the purposes of the program shall be to: (1) facilitate and support multimodal freight transportation initiatives at the State, regional, and local levels to improve freight transportation gateways and mitigate congestion in the area of such gateways; (2) provide capital funding to address infrastructure and freight operational needs at freight transportation corridors and gateways; (3) encourage adoption of new financing strategies to leverage State, local, and private investment in freight transportation gateways; and (4) support military mobilization and readiness. Qualifies for funding under this Act intermodal freight transportation projects that provide community and highway benefits by addressing economic, congestion, security, safety, and environmental issues associated with freight transportation corridors and gateways, subject to specified limitations. Sets forth project selection and grant approval criteria. Requires a recipient of Federal financial assistance for a project with an estimated total cost of $100 million or more to submit to the Secretary an annual financial plan for the project. Repeals National Corridor Planning and Development Program provisions of the Transportation Equity Act for the 21st Century.

Filipino Veterans Fairness Act - Makes former members of the Philippine Commonwealth Army or new Philippine Scouts who served with U.S. Armed Forces during World War II and became U.S. citizens or lawfully resided in the United States eligible for: (1) payment of compensation ($100 per month) for service-connected disability; (2) vocational rehabilitation as well as job counseling, training, and placement; and (3) veterans' housing loans made or guaranteed by the Department of Veterans Affairs. Directs the Secretary of Veterans Affairs to furnish outpatient health care at the Manila Outpatient Clinic in the Republic of the Philippines for such veterans residing in the Philippines. Makes spouses of such veterans eligible for veterans' educational assistance. Makes the rate of assistance for such spouses and children residing in the United States equal to the rate for the dependents of U.S. veterans. Makes such spouses and dependents eligible for job counseling, training, and placement benefits. Requires the Secretary to ensure that at least one member of the Advisory Committee on Minority Veterans is a Commonwealth Army veteran or new Philippine Scout.

Mother-to-Child Transmission Plus Appropriations Act for Fiscal Year 2005 - Makes additional appropriations for FY 2005 to Columbia University's Mailman School of Public Health for its MTCT (mother-to-child transmission)-Plus Initiative, which has committed funds from the cooperation of private foundations and the United Nations (UN) for the first major multi-country, family-centered AIDS treatment program for developing countries in Africa and Asia.

Amends the Internal Revenue Code to allow certain businesses located in areas designated as nonattainment areas under the Clean Air Act a general business tax credit for the cost of certain clean-fuel vehicle property and clean-burning fuel. Allows the credit to be taken against regular and alternative minimum tax liabilities. Allows a tax deduction for any unused clean fuel credit amounts.

Child Care Lending Pilot Act of 2005 - Allows proceeds of loans made through the Small Business Administration (SBA) to local certified development companies for plant acquisition, construction, or expansion to be used to provide loans to small, nonprofit child care businesses, provided that: (1) the loan will be used for a sound business purpose approved by the SBA Administrator; (2) each business receiving the assistance meets eligibility requirements applicable to for-profit businesses; (3) one or more individuals have personally guaranteed the loan; and (4) the child care business has both clear and singular title to the collateral for the loan and sufficient cash flow to meet loan obligations and reasonable operating expenses. Prohibits more than seven percent of the total number of loans guaranteed in any fiscal year for local development companies from being awarded under this program. Terminates such authority at the end of FY 2007.

Belated Thank You to the Merchant Mariners of World War II Act of 2005 - Directs the Secretary of Veterans Affairs to pay a monthly benefit of $1,000 to certain honorably-discharged veterans of the U.S. Merchant Marine who served between December 7, 1941, and December 31, 1946 (or to their survivors). Includes service in the Army Transport Service and the Naval Transport Service. Exempts benefits paid under this Act from taxation. Provides for benefits for World War II Merchant Mariners under title II (Old Age, Survivors, and Disability Insurance) (OASDI) of the Social Security Act.

Postal Accountability and Enhancement Act - Amends Federal postal service law to direct the Postal Regulatory Commission (PRC) (established by this Act) to establish a modern system for regulating rates and classes for market-dominant products (all first-class mail, special services, periodicals, standard mail, media mail, library mail, and bound printed matter). Directs the Board of Governors of the U.S. Postal Service to establish rates and classes for products in the competitive category of mail (priority mail, expedited mail, mailgrams, international mail, and parcel post). Authorizes the Postal Service to conduct market tests of experimental products. Directs the PRC to establish rules to ensure that workshare discounts (presorting, barcoding, etc.) do not exceed the cost that the Postal Service avoids as the result of private sector workshare activity. Establishes in the Treasury a revolving Postal Service Competitive Products Fund which shall be available to the Postal Service without fiscal year limitation for the payment of: (1) costs attributable to competitive products; and (2) all other costs incurred by the Postal Service, to the extent allocable to competitive products. Requires the Postal Service to: (1) compute its assumed Federal income tax (which would be the taxable income of a corporation) on competitive products income for such year; and (2) transfer from the Competitive Products Fund to the Postal Service Fund the amount of that assumed tax. Prohibits the Postal Service from: (1) establishing anti-competitive rules or regulations; (2) compelling the disclosure, transfer, or licensing of intellectual property to any third party; or (3) obtaining information from a person that provides any product, and then offering any product or service that uses or is based in whole or in part on such information, without the person's consent. Makes the Secretary of State responsible for foreign policy related to international postal services and other international delivery services. Replaces the Postal Rate Commission with the Postal Regulatory Commission. Directs the Postal Service to report to the President, Congress, and: (1) PRC on universal postal service in the United States; and (2) Postal Service Board of Governors on the postal processing and distribution network. Repeals the authority of the Postal Service to impose fines on air carriers transporting mail beyond U.S. borders for unreasonable or unnecessary delays and other delinquencies. Directs the Postal Service to prescribe regulations for the safe transportation of hazardous materials in the mail. Provides civil penalties, plus cleanup costs, for violations. Revises postal pension funding requirements under the Civil Service Retirement System. Establishes the Postal Service Retiree Health Benefits Fund.

Health Improvement and Professionals Act of 2005 - Requires the number of employment-based visas available in a fiscal year, beginning with FY 2005, to be increased by the number of unused visas in the four prior fiscal years. Makes such recaptured visas available to certain classes of skilled immigrants.

Democracy Day Act of 2005 - Requires the Tuesday next after the first Monday in November in 2008 and in each even-number year thereafter (Election Day) to be treated in the same manner as November 11 (Veterans Day) for purposes of any laws relating to Federal employment. Urges private employers to give their employees that day off to enable them to vote. Directs the Comptroller General to conduct a study of the impact of such requirement on voter participation.
