Independent Programmers Tax Incentive Act This bill allows a new tax credit for carriage of qualified independent programmers by eligible distributors and multichannel video programming distributors based on license fees and the average number of subscribers. The bill defines eligible distributor as any person that is either engaged in the trade or business of being a multichannel video programming distributor, or a virtual multichannel video programming distributor. The term multichannel video programming distributor is defined in federal regulations as any entity engaged in the business of making available for purchase, by subscribers or customers, multiple channels of video programming. Such entities include, but are not limited to, a cable operator, a BRS/EBS provider, a direct broadcast satellite service, a television receive-only satellite program distributor, and a satellite master antenna television system operator, as well as buying groups or agents of all such entities. The bill defines qualified independent programmer as a U.S.-based person engaged in the production, creation, or wholesale distribution of linear video programming (including, but not limited to, women-, minority-, or socially disadvantaged-, owned programmers) if such person is not a publicly-traded company, multichannel video programming distributor, virtual multichannel video programming distributor, network, or television station company.

This bill terminates the presidential waiver of certain sanctions on Iran and the licenses issued by the Department of the Treasury that allowed for the transfer of previously blocked Iranian funds (namely, the approximately $6 billion of Iranian funds that the Biden Administration permitted to be transferred from restricted accounts in South Korea to restricted accounts in Qatar to facilitate the release of five U.S. citizens detained in Iran). Furthermore, the President may not exercise waiver authority related to certain accounts belonging to Iran.

DETERRENT Act

Defending Education Transparency and Ending Rogue Regimes Engaging in Nefarious Transactions Act or the DETERRENT Act This bill expands oversight and disclosure requirements related to foreign sources and institutions of higher education (IHEs). Specifically, the bill requires an IHE to annually disclose to the Department of Education (ED) any year in which the IHE receives a gift from a foreign country of concern (e.g., China or Russia) or foreign entity of concern of any dollar amount; receives a gift or contract from a foreign source (other than a foreign country of concern or foreign entity of concern) that is valued at $50,000 or more, considered alone or in combination with all other gifts or contracts within a calendar year (current disclosure threshold is $250,000 or more), or which has an undetermined monetary value; enters into a contract with a foreign country of concern or foreign entity of concern after receiving a waiver for such contract; or is substantially controlled by a foreign source. Additionally, the bill prohibits IHEs from entering into contracts with a foreign country of concern or with a foreign entity of concern without obtaining a waiver, requires certain IHEs to disclose gifts or contracts between faculty members and foreign sources, and requires private IHEs with specified assets or investments to file annual investment disclosure reports. The bill authorizes ED to investigate possible violations of this bill and outlines the various penalties for each violation.

Strengthening Tools to Counter the Use of Human Shields Act This bill extends the authority of the President to impose sanctions on foreign persons using human shields through 2030 and requires the President to impose such sanctions on each foreign person determined to be a member of Palestine Islamic Jihad and orders, controls, or otherwise directs the use of human shields. Currently, such sanctions are (1) required for users of human shields who are members of Hamas or Hezbollah or supporters of those groups, and (2) authorized for other users of human shields. The President must also determine if a person named in certain congressional requests meets the criteria for such sanctions and report on whether the President intends to impose sanctions on that person. Additionally, the Department of Defense must report to Congress on the implications of the use of human shields by Hamas, Hezbollah, and Palestine Islamic Jihad.

Operation Swords of Iron Iron Dome Supplemental Appropriations Act

'Operation Swords of Iron' Iron Dome Supplemental Appropriations Act This bill provides $2 billion in appropriations for the Department of Defense to provide to the government of Israel for the procurement of the Iron Dome defense system to counter short-range rocket threats. Federal Disaster Tax Relief Act of 2023 This bill extends rules for the treatment of certain disaster-related personal casualty losses and provides tax relief for losses due to wildfires and a certain incident involving a train derailment. Specifically, the bill excludes from taxpayer gross income, for income tax purposes, any amount received by an individual taxpayer as compensation for expenses or losses incurred due to a qualified wildfire disaster (a disaster declared after 2014 as a result of a forest or range fire). It also excludes relief payments for losses resulting from the East Palestine, Ohio, train derailment on February 3, 2023.

Health Care Practitioner Disaster Protection Act

Health Care Practitioner Disaster Protection Act This bill extends certain liability protections available for health care practitioners who provide voluntary health care services in declared emergencies through a community health center other than the one that initially sponsored them. Current law makes the liability protections available to volunteer practitioners that are sponsored by a particular community health center. This bill maintains the liability protections for a volunteer practitioner who provides services through a different community health center if the center (1) seeks the assistance of the volunteer practitioner to respond to a declared emergency, and (2) promptly notifies the Department of Health and Human Services that the volunteer practitioner will be providing services.

Technology for Energy Security Act of 2023 This bill extends the energy investment tax credit for qualified fuel cell property for eight years.  Under current law, an energy investment tax credit of up to 30% of the cost of qualified fuel cell property is available provided construction of the qualified fuel cell property begins on or before December 31, 2024. This bill extends the energy investment tax credit to include qualified fuel cell property where construction begins on or before December 31, 2032.

Increasing American Ferrosilicon Production Act This bill requires certain actions related to trade with Russia and Belarus, including by requiring an increase in the rate of duty for certain types of ferrosilicon. (Ferrosilicon is an alloy of iron and silicon.) Specifically, the bill directs the President to proclaim an increase in the rate of duty applicable to ferrosilicon that is (1) classified under subheading 7202.21.50 of the Harmonized Tariff Schedule of the United States, and (2) produced in Russia or Belarus. This rate of duty shall be 35% ad valorem. Additionally, the bill extends through January 1, 2025, the authority of the President to proclaim increased rates of duty for all products of Russia or Belarus. (Currently, this authority terminates on January 1, 2024.) The bill requires the Office of the U.S. Trade Representative (USTR) to carry out a public comment period regarding which products of Russia or Belarus are also produced in the United States and, for each product, the ability of U.S. producers to increase production in order to meet U.S. demand. If the USTR determines that U.S. producers have the ability to increase production to meet U.S. demand for a product, then the USTR must notify Congress and indicate whether the President will proclaim an increase in the rate of duty applicable to products of Russia or Belarus. If the President will not proclaim such an increase, then the USTR must explain the reasoning for the decision.

Opportunity Zones Transparency, Extension, and Improvement Act This bill revises rules and reinstates reporting requirements relating to qualified opportunity zones (economically distressed communities where new investments, under specified conditions, may be eligible for preferential tax treatment). Specifically, the bill terminates the designation of zones that are disqualified due to median family income exceeding 130% of national median family income and permits states to identify and expand terminations of such zones. The bill also reinstates reporting requirements for qualified opportunity zones and imposes penalties for noncompliance with such requirements, extends the opportunity zones temporary deferral period for qualifying capital gain through 2028, and establishes a State and Community Dynamism Fund to support public and private investment in qualified opportunity zones.

Seniors’ Access to Critical Medications Act of 2023 This bill allows physicians to dispense outpatient prescription drugs and related supplies to patients outside of their office buildings without violating certain prohibitions under the Stark law (i.e., the Physician Self-Referral Law) for Medicare and Medicaid. Current law requires physicians to dispense outpatient prescription drugs and related supplies to patients in their office buildings in order to qualify for an exception (the in-office ancillary services exception) under the Stark law. The bill specifies that, beginning on May 11, 2023, physicians may dispense outpatient prescription drugs and related supplies in locations other than their office buildings. The bill also requires the Centers for Medicare & Medicaid Services to withdraw specified guidance that contradicts the bill’s changes.

Equal Treatment of Public Servants Act of 2023 This bill phases in a new funding formula for determining benefit amounts under the windfall elimination provision (WEP). The WEP reduces Social Security retirement and disability benefits for those who receive pensions for certain non-covered employment. The new formula adjusts an individual's total lifetime earnings based on the proportion of those earnings subject to Social Security payroll taxes. It applies to individuals who (1) become eligible for Social Security benefits after 2067, and (2) have earnings from non-covered service performed in a year after 1977. Beneficiaries who become eligible for benefits between 2025 and 2067 receive the higher of their benefit calculated under the existing WEP or the new formula. In addition, certain beneficiaries currently impacted by the WEP receive an additional payment. The Social Security Administration must include non-covered earnings in Social Security account statements and must study the feasibility of partnering with certain pension systems to address data sharing issues related to non-covered pensions.

To amend the Internal Revenue Code of 1986 to restore the taxable REIT subsidiary asset test.

The bill specifies that this prohibition shall not apply to training students in archery, hunting, or other shooting sports.

For each post where the average waiting time is longer than 300 days, the State Department must temporarily reassign personnel at that post to shorten the waiting time.

Erie Canal Bicentennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in recognition of the bicentennial of the Erie Canal. The designs of the coins must be emblematic of the Erie Canal and its impact on the development of the United States and New York. All sales of coins issued under this bill must include a surcharge to be paid to the Erie Canalway Heritage Fund, Inc., to support the historic preservation and community development of the Erie Canalway National Heritage Corridor in New York and for educational and commemorative programs.  

Kidney PATIENT Act of 2023

Kidney Patient Access to Technologically Innovative and Essential Nephrology Treatments Act of 2023 or the Kidney PATIENT Act of 2023 This bill delays a change to the payment methodology under Medicare for oral drugs that are used to treat end-stage renal disease (ESRD). Under current regulations, beginning January 1, 2025, the Centers for Medicare & Medicaid Services will incorporate payments for oral-only ESRD drugs into the ESRD prospective payment system rather than issuing separate payments to ESRD facilities. The bill delays implementation of this policy until January 1, 2033, or until an approved intravenous drug is available, whichever is earlier.
