Ensuring Meaningful Petition Outreach While Enhancing Rights of States Act of 2018 or the EMPOWERS Act of 2018 This bill amends the Endangered Species Act of 1973 to revise the process for listing, delisting, or reclassifying a species under the Act. Before submitting to the Department of the Interior or the Department of Commerce, as appropriate, a petition to list a species as a threatened or endangered species, the petitioner must notify each county and state in which the species is located of the intent to submit a petition. Upon finding that the petition may be warranted, the appropriate department must solicit advice from each county and state in which the species is located. If a state or county advises that the listing is not warranted, then the appropriate department may not proceed with the listing unless the department demonstrates that the information submitted in support of the advice is incorrect and that the listing is warranted. The bill expands requirements regarding providing notice of a proposed regulation that determines whether a species is endangered or threatened, including by requiring the appropriate department to provide notice to each person who requests a notice. The appropriate department must justify a final regulation that conflicts with the advice of a state or county.

Localizing Authority of Management Plans Act of 2018 or the LAMP Act of 2018 This bill amends the Endangered Species Act of 1973 (ESA) to revise requirements governing cooperative management agreements to manage areas established for the conservation of endangered or threatened species. Under current law, the agreements are between states and the Department of the Interior or the Department of Commerce, as appropriate. This bill allows the appropriate department to enter into: (1) agreements with local governments, Indian tribes, or nonfederal persons; and (2) agreements to manage areas established for the conservation of species that are candidates for listing. The bill exempts the actions of preparing, approving, and entering into an agreement from environmental review requirements under the National Environmental Policy Act of 1969. The departments may: (1) delegate authority under the ESA to states that establish and maintain an adequate program for the conservation of endangered or threatened species that reside in the state, and (2) provide financial assistance to a state that has entered into an agreement with the department or to a state with delegated authority.

Permit Reassurances Enabling Direct Improvements for Conservation, Tenants, and Species Act of 2018 or the PREDICTS Act of 2018 This bill amends the Endangered Species Act of 1973 to provide statutory authority for requirements regarding habitat conservation plans, candidate conservation agreements, and safe harbor agreements. Those plans and agreements give nonfederal property owners incentives, such as assurances regarding resource use restrictions, if the owner contributes towards the recovery or conservation of an endangered species, a threatened species, or a species that is a candidate for listing as an endangered or threatened species. Under current regulations, a habitat conservation plan is required for entities to hold an incidental take permit for a project that may result in the incidental taking of an endangered or threatened species. Under candidate conservation agreements and safe harbor agreements, property owners enter into agreements with the Department of the Interior or the Department of Commerce, as appropriate, to address the needs of endangered, threatened, or candidate species in exchange for assurances regarding resource use restrictions that might be imposed if circumstances change. Each incidental take permit, candidate conservation agreement, and safe harbor agreement must contain certain assurances governing permit revocation, changed circumstances, and unforeseen circumstances as prescribed by the bill. The departments may provide grants to individual private landowners to assist the landowners in carrying out candidate conservation agreements or safe harbor agreements.

Stop Takings On Reserves Antithetical to Germane Encapsulation Act of 2018 or the STORAGE Act of 2018 This bill amends the Endangered Species Act of 1973 to prohibit the Department of the Interior and the Department of Commerce from designating as critical habitat an area in a water storage, diversion, or delivery facility where habitat is periodically created and destroyed as a result of changes in water levels caused by the operation of the facility.

Land Ownership Collaboration Accelerates Life Act of 2018 or the LOCAL Act of 2018 This bill amends the Endangered Species Act of 1973 to provide statutory authority for programs that provide incentives for property owners of natural resources to agree to contribute towards the recovery or conservation of endangered or threatened species. Specifically, the bill authorizes the Department of the Interior or the Department of Commerce, as appropriate, to enter into: (1) species recovery agreements with property owners who agree to contribute towards the recovery of an endangered or threatened species; and (2) species conservation contract agreements with property owners who agree to contribute towards the conservation of an endangered species, a threatened species, a candidate species, or a species with a comparable designation under state law. The departments must establish a program under which the departments may enter into habitat reserve agreements with property owners to protect or manage habitat for endangered or threatened species. The departments: (1) may provide conservation grants to promote the voluntary conservation of endangered species and threatened species by property owners, (2) must provide financial aid to alleviate the costs of complying with the Act, and (3) may provide technical assistance when requested to enhance the conservation effects of the grants or aid. The bill establishes a Habitat Conservation Planning Loan Program under which the departments may make no-interest loans to assist states and local governments in the development of habitat conservation plans.

9/11 Memorial Act This bill directs the Department of the Interior to award competitive grants for the continued operation, security, and maintenance of the on-site memorials to the events and victims of the September 11, 2001, terrorist attacks on the World Trade Center, the Pentagon, and United Airlines Flight 93.

Efficient Drug Disposal Act of 2018 This bill amends the Clean Air Act to exempt certain solid waste incinerators from performance standards, including emission requirements. Specifically, incinerators used by federal, state, and local law enforcement agencies to destroy contraband or household pharmaceuticals are exempt from these requirements.

Family Reunification Act This bill directs the Department of Homeland Security (DHS) to ensure that each unaccompanied alien child removed by a federal official or employee from the custody of a parent or legal guardian at or near a port of entry or within 100 miles of the border be reunited with the parent or legal guardian at the earliest possible date unless: a state court terminates the rights of a parent or legal guardian, determines that it is in the child's best interests to be removed from the parent or legal guardian, or makes any similar determination that is authorized under state law; a state or county child welfare official determines that it is in the child's best interests to be removed from his or her parent or legal guardian because the child is in danger of abuse or neglect from the parent or legal guardian; or DHS requires continued separation because the child is a trafficking victim or is at significant risk of becoming a trafficking victim, there is a strong likelihood that the adult is not the child's parent or legal guardian, or the child is in danger of abuse or neglect from the parent or legal guardian.

This bill amends the Consumer Financial Protection Act of 2010 to modify the uses of civil penalties assessed under federal consumer financial laws. Specifically, amounts shall be paid to individuals who first notified the Consumer Financial Protection Bureau of violations, and excess funds must be returned to the Treasury (under current law, amounts are available as payments to victims of violations).

Generating American Income and Infrastructure Now Act This bill requires the Department of Agriculture (USDA) to sell certain distressed notes and other obligations held by USDA. The sale must be conducted under terms and procedures established by the Department of the Treasury and specified in the bill. Of the proceeds from the sale: (1) 50% must be deposited into an account for carrying out infrastructure projects in low-income communities, and (2) 50% must be retained in the Treasury for deficit reduction.

Putting Our First-Responders First Act of 2018 This bill amends the Internal Revenue Code to allow first responders to exclude from gross income certain service-connected disability payments received as part of a pension or annuity after reaching the age of retirement. The bill applies to law enforcement officers, employees in fire protection activities, and individuals who provide out-of-hospital emergency medical care.

Good Samaritan Charitable Physicians' Services Act of 2018 This bill amends the Internal Revenue Code to allow a tax deduction for direct primary care physicians who provide charity care. The care must be provided without expectation of reimbursement and to an individual enrolled in Medicaid or the Children's Health Insurance Program (CHIP). A "direct primary care physician" is a physician who provides primary care: (1) to individuals who have paid a periodic subscription fee, and (2) in exchange for a fee that is published on a publicly available website of the physician. The bill also amends the Public Health Service Act to specify that a physician is not liable under federal or state law for harm caused by an act or omission of the physician, or attending medical personnel supporting the physician, if the act or omission: (1) occurs in the course of furnishing charity care, and (2) was not grossly negligent. The bill preempts laws of a state or a political subdivision of the state that are inconsistent with this provision, unless the laws provide greater protection from liability for a defendant.

Transitional Housing for Recovery in Viable Environments Demonstration Program Act or the THRIVE Act This bill amends the United States Housing Act of 1937 to require the Department of Housing and Urban Development to establish a five-year demonstration program for nonprofit organizations to provide low-income rental-assistance vouchers to individuals recovering from an opioid or other substance-use disorder. Specifically, an organization shall provide these vouchers through a supportive and transitional housing program that provides treatment for such disorders and job skills training for a period of 12 to 24 months.

Comprehensive Addiction Recovery through Effective Employment and Reentry Act or the CAREER Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to establish a pilot program to award grants to states in order to assist individuals with the transition from substance use disorder treatment programs to independent living and the workforce. Eligible grant activities include outpatient treatment programs, care coordination services, and vocational training. HHS may award five-year grants to up to five states (based in part on specified unemployment and overdose data) and one-year grants to states and Indian tribes (based on criteria determined by HHS). Additionally, the bill amends the Housing and Community Development Act of 1974 to include temporary housing services for individuals transitioning from substance use disorder treatment programs as qualifying activities for which states may use federal funds. The bill also amends the Workforce Innovation and Opportunity Act and the Rehabilitation Act of 1973 to allow states to use federal funds for career and training services for such individuals, including career counseling, employee assistance programs, and educational resources for employers.

Protecting the Dignity of Unborn Children Act of 2018 This bill amends the federal criminal code to make it a crime to recklessly dispose of or abandon fetal remains in a landfill or in any navigable waters of the United States. The term "fetal remains" means any part (except a cremated part) of a deceased human fetus following an abortion. A violator is subject to a fine, up to three years in prison, or both.

Global Trade Accountability Act of 2018 This bill amends the Trade Act of 1974 to require congressional approval of unilateral trade actions. Such actions may take effect without congressional approval for one 90-day period if the President: determines that it is necessary because of a national emergency, because of an imminent threat to health or safety, for the enforcement of criminal laws, or for national security; and submits written notice of the determination to Congress.

Retirement Enhancement and Savings Act of 2018 This bill amends the Internal Revenue Code and the Employee Retirement Income Security Act of 1974 (ERISA) to modify requirements for tax-favored retirement savings accounts, employer-provided retirement plans, and retirement benefits for federal judges. With respect to employer-provided plans, the bill modifies requirements regarding: multiple employer plans, automatic enrollment and nonelective contributions, loans, terminating or transferring plans, reporting and disclosure rules, nondiscrimination rules, selecting lifetime income providers, and Pension Benefit Guaranty Corporation premiums. The bill also increases the tax credit for small employer pension plan startup costs and allows a tax credit for small employers that establish retirement plans that include automatic enrollment. With respect to Individual Retirement Accounts (IRAs), the bill: treats taxable non-tuition fellowship and stipend payments as compensation, repeals the maximum age for traditional IRA contributions, and permits any IRA to be a shareholder of any S corporation that is a bank. The bill makes several modifications to retirement benefits for magistrate judges of the U.S. Tax Court and other federal judges. The bill also modifies various tax provisions to: reinstate and increase the tax exclusion for benefits provided to volunteer firefighters and emergency medical responders, revise the required distribution rules for pension plans, increase penalties for failing to file tax or retirement plan returns, and require the Internal Revenue Service to share returns and return information with U.S. Customs Border Protection to administer the heavy vehicle use tax.

Electricity Reliability and Fuel Security Act This bill amends the Internal Revenue Code to allow a tax credit through 2022 for a portion of the expenses for the operation or maintenance of a coal-powered electric generation unit, excluding expenses for coal. The credit applies to taxpayers who own or lease an electric generation unit that uses coal to produce at least 75% of the electricity produced by the unit. Qualified public entities may transfer the credit to an eligible project partner. A "qualified public entity" is: (1) a federal, state, or local government entity or any political subdivision, agency, or instrumentality thereof; (2) a mutual or cooperative electric company; or (3) a not-for-profit electric utility which had or has received a loan or loan guarantee under the Rural Electrification Act of 1936. An "eligible project partner" is a person who: is responsible for operating, maintaining, or repairing the unit; participates in the provision, including transportation, of coal to the unit; provides financing for the construction or operation of the unit; or leases the unit.

Education Savings Accounts for Military Families Act of 2018 This bill amends the Elementary and Secondary Education Act of 1965 to direct the Department of Education to establish a program to provide children with parents on active duty in the uniformed services with funds for specified educational purposes. Children of active duty service members who reside in a local education agency that receives payments under the Impact Aid Program or who reside within the boundaries of a federal military installation are eligible to receive funds.

United States-Israel Security Assistance Authorization Act of 2018 This bill extends Military Financing Program grants for Israel through FY2023. The Department of Defense shall conduct a joint assessment with Israel regarding: (1) precision guided munitions needed by Israel in a sustained armed confrontation with Hezbollah and other armed groups and terrorist organizations, and (2) related U.S. assistance and resupply planning. The President may utilize the Special Defense Acquisition Fund to transfer precision guided munitions and related defense articles and services to reserve stocks for Israel. Authorities for loan guarantees and the war reserves stockpile for Israel are extended through FY2023. The Department of Homeland Security shall establish a seven-year grant program with Israel to support: (1) cybersecurity research and development, and (2) commercialization of cybersecurity technology. The U.S. Agency for International Development may enter into memoranda of understanding with Israel to advance common goals on energy, agriculture and food security, democracy, economic growth, education, and health. The National Aeronautics and Space Administration (NASA) shall continue to work with the Israel Space Agency to pursue peaceful space exploration and science initiatives. The President may enter into a cooperative project agreement with Israel to carry out research and joint production of defense articles and services to detect and destroy unmanned aerial vehicles (i.e., drones) that threaten the United States or Israel. The bill states that it is U.S. policy to ensure that Israel maintains its qualitative military edge.

Iranian Revolutionary Guard Corps Economic Exclusion Act This bill expands sanctions against Iran's Islamic Revolutionary Guard Corps (IRGC). The President shall report to Congress regarding: foreign and domestic supply chains that significantly aid the IRGC; Iranian state-owned entities that provide support to terrorist entities, including Mahan Air; and foreign persons owned or controlled by the IRGC, including companies listed on the Tehran Stock Exchange or companies with a value in excess of $100 million. The bill states that it is U.S. policy to prevent Iran's membership in the World Trade Organization and similar international bodies as long as Iran remains a state sponsor of terrorism.

USA Workforce Tax Credit Act This bill amends the Internal Revenue Code to allow tax credits for charitable contributions to certain nonprofit organizations with the exclusive purpose of providing: (1) workforce development and apprenticeship training, or (2) scholarships for elementary and secondary education expenses of students from households with income that does not exceed 200% of the median gross income. The bill limits the credits to specified amounts for individuals and corporations. It also: (1) imposes a tax on workforce development, apprenticeship training, and scholarship granting organizations that fail to distribute a specified portion of their receipts; and (2) establishes a $2 billion annual volume cap for the tax credits allowed under this bill.

Searchable Legislation Act of 2018 This bill requires Congress to ensure that all congressional documents and all votes cast in Congress and congressional committees are created, transmitted, and published in searchable electronic formats, consistent with data standards recommended by such advisory bodies as Congress may establish. The Clerk of the House of Representatives and the Secretary of the Senate, acting jointly, shall establish the Congressional Data Task Force (an advisory body) to recommend data standards for the creation, transmission, and publication of information and congressional documents, including bills, resolutions, amendments, reports, laws, and records, in such formats for purposes of this bill.

Readable Legislation Act of 2018 This bill requires every bill or joint resolution that amends an existing section of any Act to do so by setting forth the entire section and showing the omissions and insertions proposed by appropriate typographical devices. A measure may not revise or amend any section of an Act by a mere reference to it.

Second Amendment For Every Registrable Voter Act or the SAFER Voter Act This bill amends the federal criminal code to modify age restrictions on the sale or delivery of a firearm by a federally licensed gun dealer, manufacturer, importer, or collector. Currently, it is unlawful for a licensee to sell or deliver: (1) any firearm to an individual less than 18 years of age, or (2) a handgun to an individual less than 21 years of age. This bill eliminates the prohibition on sale or delivery of a handgun to an individual less than 21 years of age.

Practice of Law Technical Clarification Act of 2018 This bill amends the Fair Debt Collection Practices Act to exclude from the definition of "debt collector" any law firm or licensed attorney engaged in litigation to collect a debt on behalf of a client, if such legal action complies with applicable rules of civil procedure.

Creating Real and Useful Middle-Class Benefits and Savings (CRUMBS) Act of 2018 This bill excludes up to $2,500 of bonus income received by an employee in 2018 from being considered taxable earnings for the purpose of determining an employee's federal tax liability. The bill defines a "bonus" as wages paid in addition to the compensation ordinarily given, required, optioned, or obligated under an employment contract.

Child Tax Credit for Pregnant Moms Act of 2018 This bill amends the Internal Revenue Code, with respect to the child tax credit, to allow the credit to be used for an unborn child if the child is born and issued a Social Security number before the due date for the tax return (without regard to extensions) for the taxable year. The bill defines an "unborn child" as a member of the species homo sapiens, at any stage of development, who is carried in the womb. If a child is not taken into account for the credit for the year immediately preceding the year of the child's birth, the bill doubles the amount of the credit allowed for the year of the birth.

IPO Pipeline Act This bill amends the Securities Act of 1933 to exempt from Securities and Exchange Commission registration requirements certain secondary-market transactions that meet specified requirements, including that all parties involved in the transaction be accredited investors, affiliates of the issuer, or employees of the issuer.

Preventing IRS Abuse and Protecting Free Speech Act This bill amends the Internal Revenue Code to prohibit the Internal Revenue Service from requiring a tax-exempt organization to include in annual returns the name, address, or other identifying information of any contributor. The bill includes exceptions for: (1) required disclosures regarding prohibited tax shelter transactions; and (2) contributions by the organization's officers, directors, or five highest compensated employees (including compensation paid by related organizations).

Release the Memo Resolution Expresses the sense of the House of Representatives that the House Permanent Select Committee on Intelligence should immediately hold a recorded vote on making public a memo alleging improper conduct in the use of the Foreign Intelligence Surveillance Act by the Federal Bureau of Investigation and the Department of Justice that was prepared by members of the committee, as well as ancillary information. Urges the quick release of the memo and information to the public if the committee votes to make such documents available.

Ultrasound Informed Consent Act This bill amends the Public Health Service Act to require abortion providers, before a woman gives informed consent to any part of an abortion: (1) perform an obstetric ultrasound on the pregnant woman; (2) provide a simultaneous explanation of what the ultrasound is depicting; (3) display the ultrasound images so the woman may view them; and (4) provide a complete medical description of the images, including the dimensions of the embryo or fetus, cardiac activity if present and visible, and the presence of external members and internal organs if present and viewable. The bill establishes civil penalties for violations. It prohibits construing this bill to require a woman to view the images or penalizing the provider or the woman if the woman declines to look at the images.

Federal Reserve Disclosure Act This bill amends the Federal Reserve Act to apply personal financial interest restrictions and disclosures currently applicable to employees of the Securities and Exchange Commission to members and employees of the Federal Reserve Board (FRB). The bill also provides for office staff for FRB members.

Transparency for Taxpayers Act This bill requires the Department of the Treasury to make publicly available by April 1, 2018, an online tool that allows taxpayers (other than corporations) to calculate the approximate change in taxpayer income tax liability by reason of P.L. 115-97 (commonly known as the Tax Cuts and Jobs Act).

Securing America's Future Act of 2018 This bill amends the Immigration and Nationality Act to revise immigrant visa allocation provisions, including family-related visas. A nonimmigrant classification for parents of adult U.S. citizens is created. The diversity visa program is eliminated. Annual immigration levels are revised. The limit on the worldwide level of employment-based immigrants is increased. The H-2C visa temporary agricultural worker program is revised. A trust fund is established to provide incentives for such workers to return to their country of origin. DNA testing to establish family relationships is authorized. Employment eligibility verification provisions are revised. The Department of Homeland Security (DHS) shall establish an employment verification system. No federal, state, or local government entity or individual may prohibit or restrict a federal, state, or local government entity or official from complying with the immigration laws or assisting related federal law enforcement activities. The bill revises provisions regarding: (1) detention of aliens in removal proceedings; (2) illegal entry and reentry; (3) inadmissibility and deportability of criminal aliens, gang members, drunk drivers, and sex offenders; (4) repatriation; (5) asylum and asylum fraud; (6) unaccompanied alien children; (7) foreign students; and (8) visa fraud. The bill: (1) transfers authority for strengthening the southern border from the Department of Justice to DHS; (2) revises border security provisions; (3) provides for additional border security personnel; (4) authorizes new ports of entry along the northern border and southern borders; (5) authorizes National Guard border security activities; (6) provides contingent nonimmigrant status for certain aliens who entered the United States as minors; (7) authorizes appropriations for specified border barriers and infrastructure; and (8) establishes Operation Stonegarden to make border security grants to law enforcement agencies. DHS shall: (1) submit a southern border threat analysis, (2) establish the Integrated Border Enforcement Team program, (3) implement the Border Security Deployment Program, (4) review social media activities of visa applicants, and (5) establish a biometric exit data system.

Defending U.S. Government Communications Act This bill prohibits federal agencies from procuring or obtaining, renewing or extending a contract to obtain or procure, or entering into a contract with an entity that uses any equipment, system, or service with telecommunications equipment or services as a substantial or essential component of any system that is from Huawei Technologies Company, ZTE Corporation, or an entity reasonably believed to be owned or controlled by China.

Born-Alive Abortion Survivors Protection Act This bill amends the federal criminal code to require any health care practitioner who is present when a child is born alive following an abortion or attempted abortion to: (1) exercise the same degree of care as reasonably provided to any other child born alive at the same gestational age, and (2) ensure that such child is immediately admitted to a hospital. The term "born alive" means the complete expulsion or extraction from his or her mother, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut. Also, a health care practitioner or other employee who has knowledge of a failure to comply with these requirements must immediately report such failure to an appropriate law enforcement agency. An individual who violates the provisions of this bill is subject to a criminal fine, up to five years in prison, or both. An individual who commits an overt act that kills a child born alive is subject to criminal prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.
