Military Honor and Decency Act - Directs the Secretary of Defense to review, at least annually, material that is not deemed to be sexually explicit to determine if the material should be deemed sexually explicit and thus prohibited under provisions prohibiting the sale or rental of sexually explicit material: (1) on property under the jurisdiction of the Department of Defense (DOD); or (2) by a member of the Armed Forces or a civilian DOD officer or employee acting in an official capacity. Revises the definition of "sexually explicit material" to (among other things) prohibit print periodicals that regularly feature or give prominence to nudity or sexual or excretory activities.

Expresses solidarity with Israel and its democratic government. Disapproves of former President Jimmy Carter's freelance diplomatic efforts in the Middle East which contradict the foreign policy position of the current Administration. Calls on President Carter to cease all diplomatic efforts with recognized terrorist groups. Condemns Hamas for its support of terrorism and the slaughter of Israeli civilians and states that it should follow the path of diplomacy to bring peace to the Israeli-Palestinian conflict.

Cell Tax Fairness Act of 2008 - Prohibits states or local governments from imposing any new discriminatory tax on mobile services, mobile service providers, or mobile service property for five years after the enactment of this Act. Defines "new discriminatory tax" as a tax imposed on mobile services, providers, or property that is not generally imposed on other types of services or property, or that is generally imposed at a lower rate.

Zeroing In American Energy Act of 2008 - Requires the Secretary of the Interior to conduct a program for the leasing of federal lands for the advancement, development, assessment, installation, and operation of commercial photovoltaic and concentrating solar power energy systems. Requires the Secretary, acting through the Director of the Bureau of Land Management (BLM) and in consultation with the Secretary of Energy, to: (1) identify lease sites comprising 6.4 million acres of federal lands under BLM jurisdiction in Arizona, California, New Mexico, Nevada, and Utah that are suitable and feasible for the installation and operation of such energy systems; and (2) incorporate solar energy development into the relevant agency land use and resource management plans or equivalent plans for such identified sites. Sets forth provisions concerning: (1) the size of such sites; (2) annual milestones for the number of acres of sites to be leased by each of the years 2010-2019; and (3) the collection and payment of royalties from projects under such program. Prohibits the following federal lands from being included within such program: (1) Components of the National Landscape Conservation System; (2) Wilderness and Wilderness Study Areas; (3) Wild and Scenic Rivers; (4) National Scenic and Historic Trails; (5) Monuments; and (6) Resource Natural Areas. Requires the Secretary to complete: (1) a programmatic environmental impact statement for such program prior to implementing it; and (2) a study of federal lands available for a compressed air energy storage system, barriers to access to federal lands for transmission of energy produced under the program, and the need for energy transmission corridors on public lands.

Secure Access to Firearms Enhancement (SAFE) Act of 2008 - Amends the federal criminal code to provide for reciprocity for the carrying of certain concealed firearms in different states by persons who are not prohibited by federal law from possessing, transporting, shipping, or receiving a firearm and who are: (1) carrying a valid state license or permit for carrying a concealed firearm; or (2) otherwise entitled to carry a concealed firearm in their state of residence.

Expresses support for: (1) designation of a National Autism Awareness Month; and (2) devoting new resources to researching the root causes of autism, identifying the best methods of early intervention and treatment, expanding programs for individuals with autism, and promoting understanding of their special needs. Commends parents and relatives for providing for the special needs of children with autism. Stresses the need to begin early intervention services. Recognizes: (1) the shortage of appropriately trained teachers to teach, assist, and respond to special needs students; and (2) the importance of worker training programs tailored to the needs of developmentally disabled persons.

Homeowner Empowerment Act of 2008 - Amends the Internal Revenue Code to: (1) exclude from gross income distributions from individual retirement plans and other qualified retirement plans for payments on the mortgage of a taxpayer's principal residence; (2) require repayments of amounts distributed from such retirement plans over a 12-year period; and (3) waive the 10% penalty on premature distributions from retirement plans for distributions used to pay a mortgage.

English as the Official Language Act of 2008 - Requires: (1) English to be the national language of the federal government; and (2) the federal government to preserve and enhance the role of English as the national language. Provides that no person has a right, entitlement, or claim to have the federal government act, communicate, perform or provide services, or provide materials in any language other than English, unless specifically provided by statute. Makes the English language version of a government form issued in a language other than English the sole authority for legal purposes. Declares that this Act does not prohibit the use of a language other than English.

Labor Management Reporting and Disclosure Enforcement Act of 2008 - Amends the Labor-Management Reporting and Disclosure Act of 1959 (Landrum-Griffin Act) to make a labor organization liable to any of its members for a civil money penalty of up to $250 for each day that it fails to provide such member information regarding the organization's constitution, bylaws, organization report, and annual financial report, including any books, records, and accounts necessary to verify such reports. Authorizes the Secretary of Labor to bring an action in U.S. district court for injunctive relief and enforcement of administrative penalties against any person who has violated or is about to violate any reporting requirements of such Act, including those applying to a labor organization which has or assumes trusteeship over any subordinate labor organization. Requires a district court, upon a complaint by the Secretary that demonstrates failure to file timely and complete reports, to enjoin continued violation of the related reporting requirements. Authorizes the Secretary, upon finding a violation of specified reporting and disclosure requirements, to impose an administrative money penalty of up to $250 a day, or $10,000 in aggregate, adjusted for inflation, against the person, labor organization, or employer responsible for such violation.

Post-9/11 Veterans Educational Assistance Act of 2008 - Amends federal veterans' benefits provisions to entitle to educational assistance under the Montgomery GI Bill individuals in certain length-of-service categories who, commencing on or after September 11, 2001, serve on active duty in the Armed Forces. Establishes the duration of such assistance (in most cases 36 months) and assistance amounts. Requires programs of education pursued with such assistance to be approved by the Secretary of Veterans Affairs. Allows for the pursuit of an approved program of education while on active duty. Allows, under such assistance, for the pursuit of: (1) programs on less than a half-time basis; (2) apprenticeship or other on-job training; (3) correspondence courses; (4) flight training; (5) tutorial assistance; and (6) licensure and certification tests. Makes individuals entitled to assistance under this Act also eligible for supplemental educational assistance for additional active duty service. Requires the Secretary to carry out a program, to be known as the "Yellow Ribbon G.I. Education Enhancement Program," under which colleges and universities may enter into an agreement with the Secretary to cover, for certain individuals, a portion of established charges not otherwise covered and match contributions toward such costs. Requires educational assistance under this Act to be used within 15 years of the individual's discharge or release from active duty (with exceptions). Allows individuals currently under the Montgomery GI Bill educational assistance program to elect to participate in the post-9/11 educational assistance program with respect to any unused entitlement.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Secure the Capitol Act - Prohibits an office of the legislative branch from entering into a contract for goods or services within the Capitol Complex with any contractor employing individuals unless the contractor: (1) elects to participate in the basic pilot program for employment eligibility confirmation under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 with respect to all of its employees and those providing goods or services under the contract; (2) is in compliance with the terms and conditions of such election; and (3) certifies that each of its subcontractors providing goods or services has elected to participate in such program, and is also in such compliance, with respect to all of its employees as well as those providing goods or services under the subcontract.

Blogger Protection Act of 2008 - Amends the Federal Election Campaign Act of 1971 to: (1) exempt uncompensated individual Internet activity from treatment as a contribution to or expenditure of a campaign for federal office; and (2) cover blogs and other Internet and electronic publications under the general media exemption pertaining to expenditures.

Supporting Emergency Responders Volunteer Efforts Act of 2008 or the SERVE Act of 2008 - Amends the Internal Revenue Code to allow a $1,000 refundable tax credit for individuals who are bona fide volunteer members of a qualified volunteer emergency response organization who provide firefighting, ambulance, or emergency medical services.

Commends the Court of Appeal for the Second Appellate District in Los Angeles, California, for allowing a rehearing of the decision in the In re Rachel L. case, requiring parents to hold a teaching license in order to legally homeschool their children. Calls upon the court to uphold the U.S. Supreme Court's opinion that parents have a fundamental and constitutional right to direct the upbringing and education of their children.

Amends the Tariff Act of 1930 to make it unlawful for a person to import plastinated human remains into the United States. Imposes civil penalties, including forfeiture of the remains, for violation of such prohibition. Requires enforcement by the Secretary of Homeland Security.

Amends the Energy Independence and Security Act of 2007 to repeal provisions prohibiting any federal agency from entering into a contract for procurement of an alternative or synthetic fuel for any mobility-related use, other than for research or testing, unless the contract specifies that the lifecycle greenhouse gas emissions associated with the production and combustion of the fuel must be less than or equal to such emissions from the equivalent conventional fuel.

Protecting the Second Amendment and Hunting Rights on Federal Lands Act of 2008 - Prohibits any federal regulation from restricting any individual from possessing or carrying a firearm or ammunition, if such restriction is based, in whole or in part, upon the fact that the individual is in a unit of the National Park System or the Wildlife Refuge System. Sets forth provisions with regard to allowing hunting activities on federal lands. Requires an agency with jurisdiction over any federal land, when developing or considering approval of a management plan, to ensure that hunting activities are allowed as a use of such land to the extent that such use is not clearly incompatible with the purposes for which the federal land is managed.

Medicare Part D Home and Community Services Copayment Equity Act of 2008 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to eliminate part D cost-sharing for certain non-institutionalized full-benefit dual eligible individuals with income below 135% of the poverty line who: (1) reside in an assisted living facility, a resident care program facility, a board and care facility, or any other appropriate licensed facility, including a community mental health center, a psychiatric health facility, a mental health rehabilitation center, and a mental retardation developmental disability facility; or (2) receive home and community-based services in a home setting under a home and community-based waiver.

Reconnecting Homeless Youth Act of 2008 - Amends the Runaway and Homeless Youth Act to revise requirements for services provided under grants from the Secretary of Health and Human Services for centers for runaway and homeless youth and their families. Limits the length of stay in such a center, unless it is located in a state or locality with a child or youth-serving-facility licensure law or regulation that permits a longer length of stay. Increases grant allotments for states and specified U.S. territories. Requires the plan proposed by grant applicants for a runaway and homeless youth center to include an adequate emergency preparedness and management plan. Redefines age limits of homeless youth served under such Act. Revises requirements for transitional living programs to provide a longer length of stay if the program is located in a state or locality that permits one. Requires the Secretary to report periodically to the Speaker of the House of Representatives and the President pro tempore of the Senate estimates of the incidence and prevalence of runaway and homeless individuals between 13 to 25 years of age. Requires the Secretary to: (1) conduct a national homeless youth awareness campaign; and (2) establish priorities for making grants for research, evaluation, demonstration, and service projects. Requires the Secretary to: (1) give priority to public and, as under current law, nonprofit private agencies for sexual abuse programs; (2) establish performance standards for grant recipients; and (3) establish appeals procedures regarding amounts or denials of such grants. Defines "runaway youth" as an individual under age 18 who absents himself or herself from home or place of legal residence without the permission of parents or legal guardians.

New Employee Verification Act of 2008 - Amends the Immigration and Nationality Act (INA) to require employers to verify employee identification and employment eligibility under the Electronic Employment Verification System (EEVS) or the Secure Employment Eligibility Verification System (SEEVS) (as established by this Act). Permits employers subject to employee verification requirements to do so under EEVS or SEEVS. Sets forth provisions respecting: (1) voluntary and expedited participation; (2) employer penalties for failure to participate in EEVS or SEEVS; (3) employer and employee information and document requirements; (4) employer liability protection; (5) attestation; and (6) consequences of EEVS determinations. States that nothing in this Act shall be construed to require a national identification card. Repeals the employment eligibility pilot programs under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996. Amends title II (Old Age, Survivor's and Disability Insurance) of the Social Security Act (SSA) to direct the Commissioner of Social Security to establish EEVS utilizing information in the National Directory of New Hires. States that EEVS shall have the capacity to determine whether: (1) employer-submitted information is consistent with information maintained by the Commissioner with respect to U.S. citizens and nationals and by the Secretary of Homeland Security with respect to aliens; and (2) the individual is a citizen or national or is not an unauthorized alien. Sets forth provisions respecting: (1) submission for confirmation of an individual's identification and employment eligibility and related EEVs determinations; (2) administrative and judicial review of employment disapproval; (3) EEVS implementation; and (4) data use by EEVS. Directs the Commissioner to establish SEEVS to provide, through government certified private entities, for verification of identity and employment eligibility respecting new employees Permits an employer to opt out of SEEVS after one year's participation. Sets forth provisions respecting: (1) certification of entities; (2) database management, including limitations on accessibility and the use and storage of biometric data; (3) employer responsibilities; (4) employee protections; and (5) information security and confidentiality, including penalties for violations. Directs the Commissioner to establish the Employment Verification Advisory Council, which shall terminate five years after enactment of this Act. Amends INA to: (1) apply certain antidiscrimination provisions to EEVS and SEEVS; (2) increase civil money penalties for unfair employment practice violations; (3) increase civil money penalties for certain hiring, recruiting, and referral violations (reduces certain penalties for small employers, exempts certain good faith, first-time violations, and provides a safe harbor for certain contractors); and (4) increase criminal penalties for pattern or practice violations. Amends SSA to: (1) provide for disclosure to the Secretary of Homeland Security of certain National Directory of New Hires information about employees with the greatest number or percentage of mismatched social security information; (2) deny credit toward earnings benefits from unauthorized work; (3) revise totalization agreement provisions; and (4) prohibit survivor's lump sum death payments to individuals who have been removed from the United States under INA.

Leadville Mine Drainage Tunnel Remediation Act of 2008 - Amends the Reclamation Projects Authorization and Adjustment Act of 1992 to repeal a provision requiring construction of a water treatment plant to treat effluent discharged from the Leadville Mine Drainage Tunnel, Colorado. Directs the Secretary of the Interior to participate in the implementation of the operable unit 6 remedy for the California Gulch Superfund Site, as defined in the Environmental Protection Agency's (EPA) 2003 Record of Decision for such unit, by: (1) treating water behind any blockage or bulkhead in the Tunnel; and (2) managing and maintaining the mine pool behind such blockage or bulkhead at a level that precludes surface runoff and releases and minimizes the potential for Tunnel failure due to excessive water pressure. Requires the Secretary to take necessary steps to repair or maintain the Tunnel's structural integrity to prevent Tunnel failure and to preclude uncontrolled release of water from the Tunnel.

Section 8 Reform, Responsibility, and Accountability Act of 2007 - Amends the United States Housing Act of 1937 to prohibit section 8 rental assistance (including tenant- and project-based assistance) from being provided to any family that includes a convicted felon or illegal alien. Places a five-year limitation on section 8 rental assistance, disregarding any month during which such individual was a member of a disabled or elderly family so assisted. Prohibits such assistance on behalf of any family, unless each member of the family who is 18 years of age or older performs at least 20 hours of work activities per week. Requires the Secretary of Housing and Urban Development (HUD) to exempt from such prohibition any individual family member who meets certain requirements. Requires a public housing agency (PHA), in providing such housing assistance, to give preference to families that include a member who is a veteran that will reside in the dwelling unit. Expresses the sense of Congress that the HUD Moving to Work demonstration program under the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 should be expanded to include significantly more PHAs. Authorizes the use of unspent section 8 housing assistance payments for section 8 compliance measures. Requires approved PHA plans, including modifications and amendments, to be made public at the PHA's office and in electronic form on the World Wide Web.

Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007, with respect to Medicare payments for physicians' services through 2009. Revises the update to the single conversion factor in the formula for determination of such payments to make it: (1) 1% for the period between July 1, 2008, and December 31, 2008; and (2) 1.8% for all of 2009.

Protecting Americans from Violent Crime Act of 2008 - Bars, except as provided under current federal criminal law regarding the possession or the causing to be present of firearms and other dangerous weapons in federal facilities (other than federal court facilities), the promulgation or enforcement of any regulation that prohibits an individual from possessing, transporting, or carrying a firearm, including an assembled or functional firearm, in any unit of the National Park System or the National Wildlife Refuge System if: (1) the individual is not otherwise prohibited by law from possessing, transporting, or carrying the firearm; and (2) the possession, transportation, or carrying of the firearm is in compliance with the law governing possession, transportation, or carrying of firearms in parks of the state in which the unit is located.

Restoring the West's Fair Share Act of 2008 - Amends the Consolidated Appropriations Act, 2008, to repeal the requirement for a deduction of 2% from the amount payable to a state in FY2008 under the Federal Oil and Gas Royalty Management Act of 1982, and under the provisions of the Mineral Leasing Act and the Geothermal Steam Act of 1970, before disbursing a payment to that state and for the deposit of the amount deducted to miscellaneous receipts.

Renewable Biomass Facilitation Act of 2008 - Amends the Clean Air Act to redefine the term "renewable biomass" as: (1) materials, precommercial thinnings, or exotic species that are removed as byproducts of preventive treatments to reduce hazardous fuels, to reduce or contain disease or insect infestation, or to restore ecosystem health, that would not otherwise be used for higher-value products, and that are harvested from National Forest System land or public lands in accordance with federal and state law, land management plans, and requirements for old-growth maintenance, restoration, management direction, and large-tree retention under the Healthy Forests Restoration Act of 2003; or (2) any organic matter that is available on a renewable or recurring basis from non-federal land or Indian land held in trust by the United States or subject to a restriction against alienation imposed by the United States, including renewable plant material (including feed grains, other agricultural commodities, other plants and trees, and algae) and waste material (including crop residue, other vegetative waste material, animal waste and byproducts, and construction, food, and yard waste).

Ronald Reagan Centennial Commission Act - Establishes the Ronald Reagan Centennial Commission to: (1) plan and carry out activities to honor Ronald Reagan on the occasion of the 100th anniversary of his birth; (2) provide assistance to federal, state, and local governmental agencies and civic groups to carry out such activities; and (3) study other federal activities to honor Ronald Reagan, including the issuance of a postal stamp, the issuance of a $1 coin for one year, and the convening of a joint session of Congress.

Semper Fi Act - Rescinds all amounts appropriated by the Consolidated Appropriations Act, 2008 for the city of Berkeley, California, or entities in such city. Transfers the rescinded amounts to the Operation and Maintenance, Marine Corps account of the Department of Defense (DOD) for FY2008, to be used for recruiting.

Condemns the City Council of Berkeley, California, for impugning the integrity and professionalism of the Marine Corps. Recommends that any special federal projects funding provided under the Consolidated Appropriations Act, 2008, for Berkeley be rescinded. Recognizes: (1) the service and sacrifices of members of the Armed Forces and their families; and (2) the efforts of the United States Marine Corps Recruiting Command. Commends the unique and significant role the Marine Corps has played in upholding U.S. freedom and security. Reaffirms a commitment to ensuring that policy disagreements do not compromise the honor and sacrifice of serving military personnel.

Condemns the ongoing Iranian-enabled rocket attacks on Israeli civilians and places responsibility for launching the attacks on Hamas and other terrorist organizations in Gaza. Supports the government of Israel's right to defend its territory. Recognizes the difficult balance Israel faces with the competing pressures of being the primary supplier of numerous necessities for Palestinian civilians, even while rockets are being fired at Israel from Palestinian areas. Supports Palestinian civilians who reject Hamas and all forms of terrorism. Reaffirms the friendship between the governments and the people of Israel and the United States.

Lance Corporal Jeremy Burris Act - Amends the federal criminal code to modify the prohibition against destruction of veterans' memorials to include destruction of the grave, headstone, or marker of any person in the Armed Forces and to extend such prohibition to memorials, graves, headstones, or markers on private as well as public property.

Economic Growth Act of 2008 - Amends the Internal Revenue Code to: (1) repeal the dollar and other limitations on the expensing allowance of depreciable business assets; (2) reduce to 25% the maximum corporate income tax rate; (3) provide for an inflation adjustment to the basis of certain capital assets for purposes of determining gain or loss; and (4) reduce from 35 to 15% the alternative capital gains tax rate for corporations.

Condemns the glorification of terrorism and the continuing anti-Israel and anti-Semitic rhetoric at the United Nations. Calls on the Secretary General of the United Nations and the Secretary of State to take actions against such activities and hold responsible officials and member states for such statements. Calls on the President to use U.S. influence to prevent the use of the U.N. budget to support the planned 2009 Durban Review Conference and to withhold a proportional amount of U.S. contributions to the United Nations should the Durban Review Conference proceed as planned.

Stealth Tax Relief Extension Act of 2008 - Amends the Internal Revenue Code to: (1) increase the exemption from the alternative minimum tax for individual taxpayers in 2008; and (2) extend through 2008 the allowance of certain nonrefundable tax credits against alternative minimum tax liability.

Ultrasound Informed Consent Act - Amends the Public Health Service Act to require abortion providers, before a woman gives informed consent to any part of an abortion, to perform an obstetric ultrasound on the pregnant woman, explain the results, display the ultrasound images so the woman may view them, and provide a medical description of the ultrasound images, including the dimensions of the embryo or fetus and the presence of external members and internal organs, if present and viewable. Provides for: (1) civil penalties for willful failure to comply; and (2) a medical emergency exception. Prohibits construing this Act to require a woman to view the images or penalizing the physician or the woman if she refuses to look at the images.
