Terrorist Detention and Prosecution Act of 2010 - Replaces the term "unprivileged enemy combatant" in federal military law with the term "unlawful enemy combatant." Includes in the definition, and therefore makes subject to trial by military commissions, an individual who: (1) is closely associated with or has provided material support to al Qaeda or any other organization dedicated to committing acts of terrorism against the United States; (2) has taken up or conspired to take up arms on behalf of al Qaeda; and (3) has committed or conspired to commit acts of terrorism against the United States or American citizens or targets, regardless of the location of the individual's capture. Allows the President to authorize the detention of any unlawful enemy combatant until determining that the individual is no longer a threat to the United States or its allies.

Amends the Americans with Disabilities Act to require that the same access to transportation and public accommodations be afforded to certified trainers of service animals as is afforded to individuals with disabilities who use such animals. Defines "service animal" as a guide dog, signal dog, or other animal trained or being trained to assist an individual with a disability regardless of whether such animal has been licensed or certified by a state or local government.

Nonprofit Mortgage Licensing Clarification Act of 2009 - Amends the S.A.F.E. Mortgage Licensing Act of 2008 to permit a state to exempt from certain registration or licensing requirements any charitable organization exempt from federal tax (including their employees and agents acting as loan originators), if the organization: (1) executes loan originations in order to promote or facilitate homeownership for certain low-income, disabled, or other disadvantaged persons or families; (2) offers loans at interest rates lower than the bank prime loan rate, or that are no-interest loans or loans with interest rates significantly below those for loans to purchase generally available single-family housing; and (3) does not otherwise engage in the business of a loan originator or mortgage broker.

Condemns the gross abuses of the rights of Iranian citizens by the government of Islamic Republic of Iran and calls on the government to immediately honor its obligations under its own constitution and International Human Rights Laws. Supports the rights of Iranian citizens to peacefully protest. Urges the government of Iran to release all those peaceful protectors and opposition supporters it has detained, stop the harassment and violent acts against these Iranian citizens committed by security forces and the Basij militias, and bring to justice the government authorities responsible for such unlawful acts of violence.

Expresses the sense of Congress that the President and the Secretaries of State and Defense (DOD) should urge France and the other North Atlantic Treaty Organization (NATO) and European Union (EU) members not to sell major weapons systems or offensive military equipment to the Russian Federation until that country has: (1) withdrawn its troops from Georgia and revoked its recognition as sovereign states of the separatist regions within Georgia; (2) fulfilled its commitments to withdraw its military forces from the Transnistrian region of the Republic of Moldova; (3) ceased actions that violate or threaten the sovereignty and territorial integrity of neighboring states; (4) halted weapons and related technology sales to state sponsors of terrorism; and (5) taken steps to enforce the rule of law and human rights within the Russian Federation.

Expresses the sense of the House of Representatives that: (1) the guidelines of the United States Preventive Services Task Force would not prohibit an insurer from providing coverage for mammography services in addition to those recommended by the Task Force and should not be used by insurers to deny coverage for services that are not recommended on a routine basis; and (2) the National Cancer Institute should continue to invest and provide leadership regarding research to develop more effective breast cancer screening tools and strategies.

Amends the National Security Act of 1947 to direct the President to provide to the congressional intelligence committees all information necessary to assess the lawfulness, effectiveness, cost, benefit, intelligence gain, budgetary authority, and risk of an intelligence activity. Requires information or material concerning covert actions and actions other than covert actions to be made available to each member of such committees, unless the President requests in writing that access be limited to meet extraordinary circumstances affecting vital U.S. interests. Allows the chair and ranking member of each committee to jointly determine whether and how to limit such access. Requires information or material so limited to be made fully available to each committee member at the earliest possible time, and to include the reasons for not providing prior access.

Stop the Automatic Pay Raise for Members of Congress in Fiscal Year 2011 Act - Declares that no automatic pay adjustment shall be considered to have taken effect in FY2011 in the rates of basic pay for Members of Congress under the General Schedule (thus eliminating the pay adjustment for Members for such fiscal year).

National Commission on American Recovery and Reinvestment Act of 2009 - Establishes in the legislative branch the National Commission on American Recovery and Reinvestment. Requires the Commission to: (1) investigate and make findings on the number of jobs saved or created as a result of the American Recovery and Reinvestment Act of 2009; and (2) make recommendations on changes that could be made to such Act to save or create more jobs as well as steps that could be taken to prevent the improper payment of funds allocated under it.

Calls on the President to: (1) not enter into or extend any arms control agreement with the Russian Federation that may jeopardize the ability of the United States to ensure a credible strategic deterrent with regard to the People's Republic of China (PRC) or other countries that are deemed capable of deploying a strategic nuclear arsenal; (2) report to Congress on any plans or steps taken to enter into any bilateral arms control agreement with the Russian Federation; (3) report to Congress on the PRC's capabilities and intentions regarding the future deployment of a major strategic nuclear arsenal; and (4) refuse to enter into any strategic nuclear arms agreement with the Russian Federation or any other country that would require the United States to limit or suspend its efforts to create missile defense systems for itself and its allies. Urges the President to refrain from negotiating any follow-on agreement to START I until the Nuclear Posture Review is completed and the President, Congress, and all relevant U.S. government departments and agencies have had an opportunity to evaluate the Nuclear Posture Review.

Medicare SGR Improvement and Reform Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to provide an increased annual update for the Sustainable Growth Mechanism (SGR) formula for determining rates in the fee schedule for Medicare physician payments. Sets a three-year time limit for the commencement of a health care lawsuit. Prescribes requirements for: (1) unlimited damages for a claimant's actual economic losses in health care lawsuits; (2) court supervision of arrangements for payment of such damages, including limitation of contingent attorney fees; (3) restrictions on punitive damages; and (4) payment of future damages to claimants in health care suits. Terminates funding of the Medicare Improvement Fund as of January 1, 2010. Amends the Public Health Service Act to prescribe requirements for the licensure of biological products as biosimilar or interchangeable. Includes under the Federal Food, Drug, and Cosmetic Act fees relating to the licensure of a biological product. Amends patent law with respect to biosimilar products. Directs the Secretary of Health and Human Services (HHS) to adopt a single set of consensus-based operating rules for each health information transaction.

Reaffirms congressional opposition to trade boycotts of Israel and calls on the President to take stronger steps to end all trade boycotts of Israel. Amends the Trade Act of 1974 to direct the United States Trade Representative to include in: (1) the annual trade barrier report a list of each country (and specified boycott-related information about such country) that participates in any trade boycott of Israel; and (2) the National Trade Estimate a report on U.S. steps taken at the World Trade Organization (WTO) or other international fora to end the trade boycott of Israel.

Real Stimulus Act of 2009 - Prohibits the Federal Communications Commission (FCC) from proposing, promulgating, or issuing any regulations with regard to the Internet or IP-enabled services. Makes such prohibition non-applicable to regulations that are determined necessary to: (1) prevent damage to U.S. national security; (2) ensure public safety; or (3) assist or facilitate any actions taken by federal and state law enforcement agencies.

Accountability for Business Choices in Iran Act - Expresses the sense of Congress that: (1) Iran's illicit nuclear activities as well as development of unconventional weapons and ballistic missiles and support for international terrorism represent a serious threat to the security of the United States and its allies; (2) the United States should continue supporting diplomatic efforts in the International Atomic Energy Agency (IAEA) and the United Nations Security Council (UNSC) to end Iran's illicit nuclear activities; (3) the UNSC should take further measures beyond specified existing UNSC resolutions to tighten sanctions on Iran, including preventing new investment in Iran's energy sector as long as it fails to comply with international demands to halt its nuclear enrichment; and (4) the United States should discourage foreign banks and entities from investing in Iran's energy sector as well as seek to prohibit entities doing business with the United States from doing business with Iran. Requires the head of each federal agency to ensure that each contract with a company for the procurement of goods and services contains a requirement for the company to certify that it is not conducting business operations in Iran. Defines "business operations" as operations that: (1) provide Iran with refined petroleum resources or technology that could enhance its ability to import or expand its domestic production of such resources; (2) invest $20 million or more in aIran's ability to develop petroleum resources; and (3) provide sensitive technology to Iran. Authorizes a state or local government to adopt measures to prohibit them from entering into or renewing a contract for the procurement of goods or services with persons included on the List of Parties Excluded from Federal Procurement and Nonprocurement Programs. Terminates this Act 30 days after: (1) the President certifies to Congress that Iran has ceased support for acts of international terrorism and is no longer considered a state-sponsor of terrorism; and (2) Iran has permanently ceased the pursuit, acquisition, and development of nuclear, biological, and chemical weapons and missiles.

Suspend ACORN Certification Act of 2009 - Requires the Inspector General of the Department of Housing and Urban Development (HUD), with respect to the Association of Community Organizations for Reform Now (ACORN) or any of its specified related affiliates (covered organizations), to: (1) audit all assistance within HUD jurisdiction provided to ACORN at any time; (2) determine whether each such covered organization has used the assistance in accordance with all laws, regulations, and other terms and conditions; and (3) publish such determination in the Federal Register. Bars covered organizations from being approved, certified, or authorized under the Housing and Urban Development Act of 1968 or otherwise to provide housing counseling in connection with any HUD program or to receive HUD assistance for housing counseling activities unless and until the Inspector General has made a determination, pursuant to such audit, that all such recipients of the assistance have used all of it in accordance with its terms and conditions. Prohibits the HUD Secretary from providing any assistance within HUD jurisdiction for housing counseling activities to a covered organization unless and until the Inspector General has made such determination.

Peace Through Strength Act of 2009 - Sets forth congressional findings regarding: (1) Iranian support for terrorism, (2) Iran's ballistic missile fleet; (3) Iran's nuclear program; (4) the threat to the United States of an electromagnetic pulse (EMP) attack; (5) Iran's dependence on petroleum imports; and (6) Iranian human rights violations. Sets forth U.S. policy regarding normalization of relations with Iran. Amends the Iran Sanctions Act of 1996 to state that it shall be U.S. policy to encourage foreign governments to: (1) direct state-owned entities to cease all investment in Iran's energy sector and all exports of refined petroleum resources to Iran; and (2) persuade, and where possible, require private entities to cease all investment in Iran's energy sector and all exports of refined petroleum resources to Iran. Directs the President, with respect to sanctions against Iran, to (1) reduce the dollar threshold for imposition of sanctions against persons making investments that contribute to Iran's petroleum resource development; (2) enlarge the scope of activities that trigger sanctions against persons providing Iran with petroleum resources which contribute to Iran's ability to develop chemical, biological, or nuclear weapons; (3) impose sanctions against persons importing Iranian goods or services other than news publications into the United States or exporting to Iran goods or technology for other than humanitarian purposes; and (4) include among listed sanctions foreign exchange, banking, and property transaction prohibitions. States that the United States is capable, willing, and ready to use military force to prevent Iran from obtaining or developing a nuclear weapons capability. Directs the Secretary of Defense to: (1) develop military options to prevent Iran's development or deployment of a nuclear weapons capability; and (2) submit a related annual report to the appropriate congressional committees.

Establishes a Joint Select Committee on Earmark Reform to study and report to both chambers on the practices of the legislative and executive branch regarding earmarks in authorizing, appropriation, tax, and tariff measures. Makes it out of order to consider a bill, joint resolution, or conference report containing a congressional earmark, limited tax benefit, or limited tariff benefit until the filing of such report.

Teacher Tax Relief Act of 2009 - Amends Internal Revenue Code provisions relating to the tax deduction for the expenses of elementary and secondary school teachers to: (1) increase the maximum dollar amount of such deduction to $500; (2) allow the deduction of professional development expenses; and (3) make such deduction permanent.

American Health Care Solutions Act of 2009 - Declares that nothing in this Act may be construed to authorize the federal government to ration health care for the American people. Requires each state to mitigate the cost of high risk individuals in the state through: (1) a state reinsurance program; or (2) a state high risk pool. Amends the Public Health Service Act to provide for the establishment and governance of individual membership associations (IMAs), which are organizations that offer health benefits coverage to members through health insurance issuer contracts. Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for establishment and governance of association health plans (AHPs), which are group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations and which meet certain ERISA certification requirements. Directs that the laws of the state designated by a health insurance issuer (primary state) shall apply to individual health insurance coverage offered by that issuer in the primary state and in any other state (secondary state), but only if the coverage and issuer comply with conditions of this Act. Amends the Internal Revenue Code to allow: (1) a small employer a health benefits plan implementation credit; (2) a tax deduction for long-term care insurance premiums; and (3) caregivers a tax credit for family members with long-term care needs. Prohibits the Secretary of Health and Human Services (HHS) from using data from comparative effectiveness research to deny coverage of an item or service under a federal health care program. Prohibits employers from being prevented from establishing premium discounts or rebates, or modifying copayments or deductibles, for employees who adhere to or participate in a health promotion or disease prevention (wellness) program that meets certain requirements. Amends title XXI (Children's Health Insurance Program) (CHIP, formerly known as SCHIP) of the Social Security Act to require a CHIP plan to describe how it will provide for child health assistance with respect to targeted low-income children who have access to coverage under a group health plan. Requires alternative coverage options under CHIP. Applies such provisions to Medicaid. Requires verification of U.S. citizenship or nationality for Medicaid. Revises provisions related to health savings accounts (HSAs), including to permit the use of HSAs to purchase health insurance. Sets conditions for lawsuits arising from health care liability claims regarding health care goods or services or any medical product affecting interstate commerce. Establishes a statute of limitations and limits noneconomic and punitive damages. Sets forth provisions related to Medicare and Medicaid fraud and abuse. Rescinds unobligated balances of certain discretionary appropriations made available under the American Recovery and Reinvestment Act of 2009. Repeals provisions of such Act providing fiscal assistance to states and setting limits on executive compensation.

FHA Taxpayer Protection Act of 2009 - Amends the National Housing Act to increase the downpayment requirement for a Federal Housing Administration (FHA) mortgage loan from 3.5% to 5%. Repeals the current inclusion in the principal amount of an FHA mortgage loan of any initial service charges, appraisal, inspection, and other fees that the Secretary of Housing and Urban Development (HUD) approves. Prohibits the inclusion of such charges and fees in the principal amount of an FHA mortgage loan. Directs the Comptroller General to study and report to Congress on the Mutual Mortgage Insurance Fund and the mortgage insurance programs under which the insurance obligations are obligations of such Fund.

Consistency, Accuracy, Responsibility, and Excellence in Medical Imaging and Radiation Therapy Act of 2009 - Amends the Public Health Service Act to require personnel who perform or plan the technical component of either medical imaging examinations or radiation therapy procedures for medical purposes to possess, effective January 1, 2013: (1) certification in each medical imaging or radiation therapy modality and service provided from a certification organization designated by the Secretary of Health and Human Services (HHS); or (2) state licensure or certification where such services and modalities are within the scope of practice as defined by the state for such profession and where the requirements for licensure, certification, or registration meet or exceed the standards established by the Secretary. Exempts physicians, nurse practitioners, and physician assistants. Directs the Secretary to: (1) establish minimum standards for personnel who perform, plan, evaluate, or verify patient dose for medical imaging examinations or radiation therapy procedures; (2) establish a program for designating certification organizations after consideration of specified criteria; (3) provide a method for the recognition of individuals whose training or experience are determined to be equal to, or in excess of, those of a graduate of an accredited educational program in that specialty; and (4) approve and publish a list of accrediting bodies for such certification organizations. Authorizes the Secretary to develop alternative standards for rural or health professional shortage areas as appropriate to assure access to quality medical imaging. Amends the Social Security Act to allow Medicare payment for medical imaging and radiation therapy services furnished on or after January 1, 2013, only if the examination or procedure is planned or performed by an individual who meets this Act's requirements.

Limiting the Intrusive Miles of International Terrorist Sponsors Act of 2009 or LIMITS Act of 2009 - Directs the President to restrict to a specified designated area the travel of officials and representatives of countries that are designated as state sponsors of terrorism who are visiting the U.N. headquarters complex in connection with official business. Authorizes presidential waiver of such restriction upon submission of a report to Congress explaining why it is in the national interest to do so. Excludes from such restriction: (1) direct travel to and from John F. Kennedy International Airport or LaGuardia Airport to the designated area in connection with official business at the U.N. headquarters complex; (2) land travel to and from any lodgings or other hotel accommodations in which an official or representative is staying if such lodging or other hotel accommodation is within the designated area; and (3) travel to and from New York University medical center or Bellevue Hospital Center for emergency medical care.

Surface Transportation and Taxation Equity Act or the STATE Act - Amends the Internal Revenue Code to reduce the federal excise tax on gasoline and special fuels (but not below two cents per gallon) by corresponding increases in fuel taxes imposed by states after March 17, 2009.

New IDEA (Illegal Deduction Elimination Act) - Amends the Internal Revenue Code to deny a tax deduction for wages and benefits paid to or on behalf of an unauthorized alien. Directs the Commissioner of Social Security and the Secretaries of Homeland Security and the Treasury to jointly establish a program to share information that may lead to the identification of unauthorized aliens. Requires the Secretary of the Treasury to provide taxpayer identity information to the Commissioner of Social Security and the Secretary of Homeland Security on employers who paid nondeductible wages to unauthorized aliens and on the aliens to whom such wages were paid. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to: (1) make permanent the pilot program for verifying the employment eligibility of alien workers (E-Verify Program); (2) apply such program to current employees in addition to new hires; (3) establish a rebuttable presumption that employers who participate in the pilot program have not violated the prohibition against continued employment of unauthorized aliens; and (4) allow employers to offer a prospective employee a conditional offer of employment pending final verification of identity and employment eligibility under the E-Verify Program.
