Indian School Construction Act of 2001

Indian School Construction Act of 2001 - Directs the Secretary of the Interior to establish a pilot program under which eligible Indian tribes have the authority to issue tribal school modernization bonds to provide funding for the construction, rehabilitation, or repair of tribal schools, including advance planning and design. Permits a tribe to use amounts received through the issuance of a bond to enter into and make payments under contracts: (1) for the design and engineering of the school; and (2) with financial advisors, underwriters, attorneys, trustees, and other professionals who would be able to provide assistance to the tribe in issuing bonds. Makes any tribal school modernization bond issued by a tribe subject to a trust agreement. Authorizes the Secretary to deposit not more than $30 million each fiscal year into a tribal school modernization escrow account beginning in FY 2002 from amounts made available for school replacement under the construction account of the Bureau of Indian Affairs. Requires the Secretary to use any amounts deposited to make payments to trustees or for advance planning and design. Declares that no bond shall be an obligation of, nor shall payment of the principal be guaranteed by the United States. Provides that any amounts earned through the investment of funds under the control of a trustee shall not be subject to Federal income tax. Amends the Internal Revenue Code to allow a tax credit to individuals who hold such bonds. Permits a separation (including at issuance) of the ownership of such a bond and the entitlement to the credit with respect to such bond.

Bridges to the Cuban People Act of 2001

Bridges to the Cuban People Act of 2001 - Exempts from the embargo on trade with Cuba (including prohibitions under the Cuban Democracy Act of 1992 against the unloading at a U.S. port of vessels that previously entered a Cuban port to engage in trade) the export of any agricultural commodity, farm machinery or equipment, medicine, or medical device, or any travel incident to the delivery of such items. Prohibits the President from prohibiting or regulating travel to or from or within Cuba by U.S. nationals or lawful resident aliens, including specified transactions ordinarily incident to such travel, financial or otherwise. Authorizes the President to provide scholarships for Cuban nationals who seek to undertake graduate study in public health, public policy, economics, law, or other field of social science. Authorizes the President to waive certain sanctions against, and restrictions on assistance to, Cuba, including the exclusion from the United States of certain aliens who have confiscated property in Cuba of U.S. nationals or who traffic in such property, if he determines that it will promote the peaceful transition to democracy in Cuba or will further U.S. national economic interests. Prohibits the Secretary of the Treasury from limiting the amount of remittances to Cuba that any U.S. person may make. Authorizes the import into the United States of a Cuban originated medical article if the Secretary of Health and Human Services makes a determination that there is a medical need in the United States for such article that is not being met by any medicine or medical device in commercial distribution in the United States. Prohibits the use of funds to enforce unilateral sanctions on the export of goods and services intended for the exclusive use of children in Cuba.

Child Care Quality Incentive Act of 2001

Child Care Quality Incentive Act of 2001 - Amends the Child Care and Development Block Grant Act of 1990 to establish a program of incentive grants to States to improve the quality of, and access to, child care by increasing child care payment rates. Sets the maximum Federal share of activity costs at 75 percent. Authorizes the Secretary of Health and Human Services to make an annual payment to an eligible State only if: (1) the Secretary determines that the State has made progress, through the assisted activities, in maintaining increased payment rates; and (2) the State updates an initial child care services market rate survey at least once every two years. Requires an eligible State that receives such a grant to make priority use of its funds to increase significantly (up to the 100th percentile of the market rate survey) the rate of reimbursement to providers for subsidized child care.

Global Access to HIV/AIDS Prevention, Awareness, Education, and Treatment Act of 2001 - Amends the Foreign Assistance Act of 1961 to urge the United States and other developed countries, with respect to activities supported in connection with health programs, to provide assistance to sub-Saharan and other developing countries to control the human immunodeficiency virus and acquired immune deficiency syndrome (HIV/AIDS) pandemic through HIV/AIDS prevention, treatment, monitoring, and related activities. Authorizes the Administrator of the U.S. Agency for International Development (AID) to provide assistance through nongovernmental organizations to carry out such activities there. Directs the Administrator for AID to provide assistance to sub-Saharan African and other developing countries for the procurement of HIV/AIDS pharmaceuticals, anti-viral therapies, and other appropriate medicines and their distribution to qualified national, regional, or local organizations for the treatment of individuals with HIV/AIDS in accordance with appropriate HIV/AIDS testing and monitoring requirements and for the prevention of transmission of HIV/AIDS from mother to child. Provides for U.S. contributions to multilateral efforts to prevent, treat, and monitor HIV/AIDS in sub-Saharan African and other developing countries.

Makes it unlawful for any person receiving Federal funds to knowingly acquire, receive, or otherwise transfer any human embryos for valuable consideration if such action affects interstate commerce. Directs the Secretary, in conjunction with the Director of the National Institutes of Health (NIH), to issue guidelines expanding on the rules governing human embryonic stem cell research to include rules that govern the derivation of stem cells from donated embryos under this Act.

Exempts from such prohibition certain franchises or sales contracts entered into before October 17, 2000. Establishes civil and criminal penalties for violations of this Act. Instructs the Federal Trade Commission to: (1) issue regulations requiring full disclosure by refiners and distributors of their wholesale motor fuel pricing policies, with a separate listing of each component contributing to prices, including the cost of crude oil, refining, marketing, transportation, equipment, overhead, and profit, along with a description of any rebates, incentives, and market enhancement allowances; and (2) ensure that all information acquired pursuant to such regulations is disseminated to the public.

Directs: (1) the Secretary and the State of California to develop a Governance Board for managing CALFED program operations; and (2) such Federal agencies to develop a program to achieve increased yield and environmental benefits, as well as improved water system reliability, water quality, water use efficiency, watershed management, water transfers, and levee protection. Requires the Governance Board to undertake a competitive grant program to: (1) investigate and identify opportunities for the design and construction of demonstration and permanent facilities to increase yield and improve water quality; (2) carry out design and construction of identified facilities; and (3) conduct research. Requires specific congressional authorization of new CALFED projects. Small Reclamation Water Resources Project Act of 2001 - Amends the Small Reclamation Projects Act of 1956 to: (1) provide that eligible projects shall include, but not be limited to, irrigation projects; and (2) modify loan and grant programs to establish within the Bureau of Reclamation a program for grants and loan guarantees to organizations to carry out reclamation projects, a Small Reclamation Water Resources Management Partnership Program, and a loan guarantee demonstration program.

Kids Deserve Freedom from Tobacco Act of 2001 or the KIDS Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for additional restrictions on the marketing, advertising, and access to tobacco products. Comprehensive Insurance Coverage of Childhood Immunization Act of 2001 - Amends ERISA, PHSA, and the Internal Revenue Code (IRC) to outline standards relating to coverage of childhood immunization. Children's Environmental Protection Act - Amends the Toxic Substances Control Act to provide for environmental protection for children and other vulnerable subpopulations. School Environment Protection Act - Amends the Federal Insecticide, Fungicide, and Rodenticide Act to provide for integrated pest management systems for public schools. Directs the Secretary of Health and Human Services (HHS Secretary) to make grants to eligible States to support parenting support and education programs. Family and Medical Leave Fairness Act of 2001 - Amends the Family and Medical Leave Act of 1993 to extend its coverage to private employers with 25 or more (currently, 50 or more) employees. Family Income to Respond to Significant Transitions Insurance Act - Directs the Secretary of Labor to make grants to pay for the Federal share of projects to provide wage replacement for eligible individuals responding to family caregiving needs, including those resulting from the birth or adoption of a child. Children's Environmental Protection and Right to Know Act - Amends: (1) the Emergency Planning and Community Right-To-Know Act of 1986 with respect to reporting toxic chemicals; and (2) the Federal Hazardous Substances Act to require publication of a list of substances or mixtures determined toxic to children. Amends SSA title IV part D (Child Support and Establishment of Paternity) to provide block grants to States for media campaigns promoting responsible fatherhood. Focus On Committed and Underpaid Staff for Children's Sake Act or the FOCUS Act - Establishes the Child Care Provider Development and Retention Grant Program and the Child Care Provider Scholarship Program. Federal Employees Child Care Act - Provides for child care centers in Federal facilities as well as for child care services for Federal employees. Early Learning Linkages Act of 2001 - Repeals the Early Learning Opportunities Act to replace it with a program of grants by the HHS Secretary to State and Local Councils to provide funds to early childhood learning providers to: (1) increase the number of full-day full-year Head Start programs, and the number of children served by Early Head Start and State prekindergarten education programs; and (2) develop linkages among such programs within a community and between them and health care services for young children in ways that facilitate greater access to such programs. Child Care Facilities Financing Act - Authorizes the Secretary to award grants for the Federal share of the cost of the acquisition, construction, or improvement of child care facilities or equipment. Book Stamp Act - Directs the Secretary to make grants to State agencies to promote child literacy and improve children's access to books at home and in early learning and other child care programs. America's Better Classroom Act of 2001 - Amends the IRC to establish an income tax credit for qualified public school modernization, school construction, and zone academy bonds. Child Opportunity Zone Family Center Act of 2001 - Amends the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to partnerships for child opportunity zone family centers. Tax Relief for Working Families Act of 2001 - Amends the IRC to increase the earned income tax credit for married couples and for two or more qualifying children. Extends the dependent care tax credit to respite care services. Establishes the Gateways Grant Program to improve the administration of State and county low-income families with children programs. Child Support Distribution Act of 2001 - Amends SSA title IV parts A (Temporary Assistance for Needy Families) (TANF) and B (Child Support and Establishment of Paternity) to provide for increased child support payments to families and enforcement of child support obligations. Child Support Assurance Act of 2001 - Directs the HHS Secretary to make grants to States for child support assurance demonstration projects. Fair Minimum Wage Act of 2001 - Amends the Fair Labor Standards Act of 1938 to provide for a graduated increase in the minimum wage (and apply it to the Commonwealth of the Northern Mariana Islands). Federal Living Wage Responsibility Act - Specifies minimum hourly wages and other employment terms for employees under Federal contracts. Amends the Richard B. Russell National School Lunch Act concerning the child and adult care food program, and the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 concerning the food stamp program. Directs the Secretary of Housing and Urban Development (HUD) to establish a rental assistance voucher program. Establishes the Voucher Success Fund and the National Affordable Housing Trust Fund. Housing Preservation Matching Grant Act of 2001 - Directs the HUD Secretary to make grants to States for low-income housing preservation. Amends SSA title IV part E (Foster Care and Adoption Assistance) to direct the HHS Secretary to reimburse States for preventive, protective, crisis, permanency, independent living, and post-permanency services. Amends SSA title IV part B (Child and Family Services) for expansion of the promoting safe and stable families program. Social Services Block Grant Restoration Act of 2001 - Amends SSA title IV part A (TANF) and SSA title XX (Block Grants to States for Social Services) to provide for restoration of funds for the social services block grant. Child Protection/Alcohol and Drug Partnership Act of 2001 - Amends SSA title IV part B to provide for child protection and alcohol and drug partnerships for children. Amends SSA title IV part E to provide for a permanency grants program. Amends the Family Violence Prevention and Services Act to direct the HHS Secretary to award grants for programs to encourage domestic violence models using multisystem partnerships to address the needs of children exposed to domestic violence. Younger Americans Act - Establishes a national youth policy, an Office of National Youth Policy in the Executive Office of the President, and a Council on National Youth Policy. Establishes grants for State and community programs to encourage and assist State agencies, community boards, and area agencies on youth to assure that all youth have access to the full array of core resources. Mental Health Juvenile Justice Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 (JJDPA) to establish grants for a State and local juvenile justice agency training program regarding access to mental health and substance abuse treatment for juveniles in contact with the State juvenile justice system. Establishes a Federal Coordinating Council on Criminalization of Juveniles With Mental Disorders. Juvenile Justice and Accountability Act - Amends the JJDPA to establish grants to States for juvenile accountability block grants. Amends the Federal criminal code to: (1) provide for the regulation of firearms transfers at gun shows; and (2) require child handgun safety locks on firearms. Amends the Consumer Product Safety Act to require child handgun safety locks. Prohibits weapons transfers to juveniles and imports of large capacity ammunition feeding devices. Amends the Violent Crime Control and Law Enforcement Act of 1994 to establish grants for: (1) State and local domestic violence offender recordkeeping improvements; (2) State and local gun prosecutors; and (3) local and antigun violence media campaigns. Provides for regulation of Internet firearms transfers. Prohibits multiple handgun sales or purchases. Directs the HHS Secretary to establish the Advisory Committee on Private Sector Support for Children and Families.

Providing Reliable Officers, Technology, Education, Community Prosecutors, and Training In Our Neighborhoods Act of 2001 or PROTECTION Act - Modifies provisions of the Omnibus Crime Control and Safe Streets Act of 1968 regarding public safety and community policing ("cops on the beat" program, COPS) to authorize the Attorney General to use funding under COPS grants to: (1) increase prosecutor presence and to enhance law enforcement access to new technologies; (2) pay overtime to existing career law enforcement officers to the extent that such overtime is devoted to community policing efforts; and (3) promote higher education among in-service State and local law enforcement officers by reimbursing them for the costs associated with seeking a college or graduate school education. Includes among permitted additional grant projects: (1) specialized integrity and ethics training; and (2) innovative proactive crime control and prevention programs involving school officials and religiously-affiliated organizations. Authorizes the Attorney General to use up to five percent of appropriated funds for technical assistance and training to States, local governments, Indian tribal governments, and other public and private entities. Repeals provisions of the Act regarding termination of grants for hiring officers. Allows grants to be used to assist: (1) police departments in employing specified professional, scientific, and technological advancements; and (2) State, local, or tribal prosecutors' offices in implementation of community-based prosecution programs that build on local community policing efforts. Reserves specified funds for units of local government with a population of less than 50,000. Authorizes the Attorney General to use no more than 50 percent of grant renewal funds to award grants targeted specifically for retention of police officers.

Grants consent of Congress to the States to enter into a cooperative agreement with the Secretary, as well as an interstate compact, to establish a multistate infrastructure bank. Prescribes infrastructure bank requirements. Emphasizes that: (1) any infrastructure bank loan shall be used to supplement, not supplant other Federal, State, and local funds; and (2) the contribution of Federal funds into such infrastructure banks shall not be construed as a Federal commitment, guarantee, or obligation to any third party. Mandates review by the Secretary of the financial condition of each infrastructure bank.

Energy Independence Act of 2001 - Directs the Secretary of Energy to: (1) develop and transmit to Congress a strategic plan to ensure that the United States is energy self-sufficient by the year 2011; and (2) develop a program for the acquisition of certain commercially available fuel cell power plants and power generated therefrom for use at federally owned or operated facilities. Directs the President, in coordination with designated Secretaries, to establish: (1) a demonstration program for fuel cell proton exchange membrane technology for commercial, residential, and transportation applications (including buses) within the Secretaries' respective areas of responsibility; and (2) a comprehensive proton exchange membrane fuel cell bus demonstration program to address hydrogen production, storage, and use in transit bus applications. Requires each Federal agency that maintains a motor vehicle fleet to develop a plan for fleet transition to vehicles powered by fuel cell technology. Directs the Secretary of Energy to establish a fuel cell technology grant program for State or local government to meet their energy requirements, including such technology as a motor vehicle power source.

Requires that such service which is performed by an incumbent law enforcement officer be treated: (1) on or after the enactment date of this Act, for all purposes, as service performed as a law enforcement officer, irrespective of how such service is treated under the following; and (2) before, on, or after such date, for purposes of CSRS and FERS, as service performed as such an officer, but only if an appropriate written election is submitted to the Office of Personnel Management five years after such date or before separation from Government service, whichever is earlier. Provides that nothing under current law respecting mandatory separation from Government service under CSRS or FERS shall cause the involuntary separation of an officer before the end of the three-year period beginning on such date.

Directs the Comptroller General to make available General Accounting Office (GAO) personnel, equipment, and facilities to assist the Commission in performing its activities in examining such land claims. Permits the Commission to review reports prepared by GAO regarding community land grants and to request an interview with the authors of such reports.

Establishes within the Department of State a United States Special Coordinator for Tibetan Issues who shall promote substantive dialogue between the Government of China and the Dalai Lama or his representatives. Directs the U.S. executive director of each international financial institution, including the Export-Import Bank of the United States, the Overseas Private Investment Corporation, and the Trade and Development Agency, to support projects in Tibet consistent with specified principles. Sets forth provisions with respect to: (1) the release of, and access by humanitarian organizations to, Tibetan prisoners detained in China because of their political or religious beliefs; (2) the establishment of a U.S. branch office in Lhasa, Tibet; (3) Tibetan language training to U.S. foreign service officers assigned to the consulate in China; (4) U.S. promotion of economic development, cultural preservation, health care, and education and environmental sustainability for Tibetans inside Tibet; (5) Tibet considerations at the United Nations; and (6) the end of religious persecution in Tibet.

Authorizes additional appropriations for the National Science, Mathematics, Engineering, and Technology Education Digital Library for precollege education collections and support services for science teachers. Authorizes the agencies in the Next Generation Internet program to provide broadband Internet connections to elementary and secondary schools for science, mathematics, and technology education. Requires the NSF Director to make mathematics and science proficiency partnerships demonstration grants to LEAs. Getting Our Girls Ready for the 21st Century Act (Go Girl Act) - Authorizes the NSF Director to make grants to, and contracts and cooperative agreements with, LEAs to provide subgrants to elementary and secondary schools for services that prepare girls to pursue undergraduate and graduate degrees and careers in science, mathematics, and technology. Requires the NSF Director to: (1) to give priority for outreach grants under the Scientific and Advanced-Technology Act of 1992 to proposals involving secondary schools with a majority of students from groups underrepresented in the science, mathematics and engineering workforce; (2) arrange for an independent review by the National Research Council of Federal programs supporting elementary and secondary science and mathematics education; and (3) convene the first annual conference for kindergarten through the 12th grade science, mathematics, engineering, and technology education stakeholders. Requires the Director of the Office of Science and Technology Policy to: (1) establish an interagency committee to coordinate Federal programs supporting elementary and secondary science and mathematics education; and (2) prepare a plan for such programs.

Requires such plan or issuer, in the case of non-emergency maintenance or post-stabilization care services, to provide for reimbursement for services provided by nonparticipating providers in a manner consistent with specified guidelines under the Social Security Act or as the Secretary of Health and Human Services shall establish. Requires plans and issuers to make information regarding emergency services coverage available annually. Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code to deem requirements of this Act to be incorporated into such Acts and the Internal Revenue Code.

Establishes the National Bi-Partisan Indian Health Care Entitlement Commission to: (1) establish a Study Committee to study the extent of Indian health services needs; (2) review and analyze the Study Committee's report; and (3) make recommendations to Congress for providing health services for Indians as an entitlement.

Provides a five-year recovery period for the depreciation of qualified seismic retrofit expenses. Authorizes the issuance of qualified seismic retrofitting bonds, 95 percent of the proceeds of which must be used for seismic retrofitting expenditures. Provides an exemption from passive activity loss restrictions for any seismic retrofitting activity engaged in during a taxable year. Amends the Earthquake Hazards Reduction Act of 1977 to authorize the Director of the Federal Emergency Management Agency to establish a grant program to provide financial assistance to certain local governments, public or nonprofit private hospitals, or public institutions of higher education to pay the Federal share of the cost of carrying out earthquake disaster mitigation and recovery planning measures with respect to critical facilities and infrastructures (disaster response facilities, hospital and medical facilities) under the jurisdiction of such recipients. Allows grant funds to be used to retrofit such facilities and infrastructures, implement earthquake disaster mitigation measures, or develop earthquake disaster recovery plans. Establishes the Loss Reduction Trust Fund for grant payments.
