Family First Transition and Support Act of 2019 This bill eliminates income-based limitations on a child's eligibility for federal foster care support and makes other changes to funding for, and administration of, grants and programs for child welfare in states and tribes. The bill increases funding for activities including (1) training of child welfare workers, foster parents, and those working in the court system; (2) research on evidence-based practices to prevent child abuse and neglect; and (3) regional partnerships between child welfare agencies and others to address a parent's, or other caregiver's, substance use disorder. The bill's changes to the administration of child welfare programs include, for example, delaying until FY2027 a requirement for states to expend a minimum percentage of funding for child abuse prevention services on only those services that meet certain criteria for effectiveness. In addition, the bill expands the scope of certain grants to include kinship placement services and allows the use of federal funds to address issues that may put a child at risk of entering foster care, such as by providing assistance with housing and utility payments.

The protocol applies to aliens seeking asylum but who have been assessed not to be more likely than not to face persecution or torture in Mexico.)

Changes to benefits include (1) increasing the primary insurance amount for certain beneficiaries, (2) calculating cost-of-living adjustments by using a price index that tracks the spending patterns of older consumers, and (3) establishing an alternative benefit for widows or widowers in two-income households. Changes to taxes include phasing out the cap on earnings subject to the Social Security payroll tax. Under current law, the maximum amount subject to this tax is $132,900.

Safe Schools Improvement Act of 2019 This bill requires states to direct their local educational agencies (LEAs) to establish policies that prevent and prohibit conduct, including bullying and harassment, that is sufficiently severe, persistent, or pervasive to (1) limit students' ability to participate in, or benefit from, school programs; or (2) create a hostile or abusive educational environment that adversely affects students' education. LEAs shall also provide (1) students, parents, and educational professionals with annual notice of the conduct prohibited in their disciplinary policies; (2) students and parents with grievance procedures that target such conduct; and (3) the public with annual data on the incidence and frequency of that conduct at the school and LEA level. The Department of Education must conduct, and report on, an independent biennial evaluation of programs and policies to combat bullying and harassment in elementary and secondary schools. The National Center for Education Statistics shall collect state data to determine the incidence and frequency of the conduct prohibited by LEA disciplinary policies.

Among other things, the bill prohibits the issuance of a patent for certain mining or millsite claims; establishes a permitting and leasing system for hardrock mining; establishes a 12.5% royalty on new mining operations and an 8% royalty on existing operations, with an exemption for small miners; protects special places, such as wilderness study areas, roadless areas, and wild and scenic rivers, from hardrock mining activity; requires consultation prior to undertaking any mineral activities that may have a substantial direct impact on the lands or interests of Indian tribes; establishes an environmental standard for mining activities to ensure that mining activities prevent undue degradation of public lands and resources; prescribes requirements for the exploration permit process and for operations permits, including financial assurances; and authorizes the use of amounts in the Hardrock Minerals Reclamation Fund for the reclamation and restoration of land and water resources adversely affected by past hardrock mineral activities and related activities.

Tribal Heritage and Grizzly Bear Protection Act This bill provides for the management of grizzly bears ( Ursus arctos horribilis ) except for grizzly bears that (1) belong to a population that is listed as a threatened or an endangered species; (2) are taken, possessed, or transported in Alaska; or (3) are taken in self-defense or to save the life of another person in immediate danger. The Department of the Interior may issue a permit for taking (e.g., killing, harming, or capturing), possessing, or transporting grizzly bears, or their parts if such taking, possession, or transportation is for purposes of science, exhibition, tribal religion, agricultural protection, or public safety. Such permits must be compatible with the protection of the grizzly bear species or a population of grizzly bears occupying a geographically distinct area. In addition, Interior must establish (1) a Grizzly Bear Scientific Committee, and (2) a grant program for assisting livestock producers with issues of livestock predation. Finally, the bill provides for the reintroduction of grizzly bears on tribal land.

Richard G. Lugar and Ellen O. Tauscher Act to Maintain Limits on Russian Nuclear Forces This bill imposes reporting requirements relating to the possible expiration of the Measures for the Further Reduction and Limitation of Strategic Offensive Arms (New START treaty) between the United States and Russia, which is set to expire in in February 2021 but may be extended to February 2026. The Office of the Director of National Intelligence shall report to Congress on the intelligence implications of the treaty's expiration without a new U.S.-Russia arms control agreement. The report shall contain specified elements including assessments of (1) the size and posture of Russia's nuclear forces with and without a treaty extension, (2) the impact of the treaty's expiration on U.S. allies, and (3) the impact of the treaty's expiration on U.S. intelligence capabilities. The Department of State shall report to Congress on the likely reactions of U.S. allies, including the North Atlantic Treaty Organization (NATO) member countries, to a U.S. decision to not extend the treaty or enter into a similar agreement with Russia. The State Department shall periodically report to Congress until the treaty's extension or expiration on discussions with Russia on extending the treaty or entering into a similar agreement. If the treaty expires without a new arms control agreement, the President shall provide Congress a justification for allowing the treaty to expire and certify that extending the treaty was not in U.S. national security interests.

United States Postal Service Shipping Equity Act This bill authorizes the mailing of alcoholic beverages by a covered entity in accordance with the delivery requirements otherwise applicable to a privately carried shipment. Covered entity is defined as an entity (including a winery, brewery, or beverage distilled spirits plant, or other wholesale, distributer, or retailer of alcoholic beverages) that has registered with, obtained a permit from, or obtained approval of an application from the Department of the Treasury pursuant to the Federal Alcohol Administration Act or the Internal Revenue Code provisions regarding alcohol, tobacco, and certain other excise taxes. The bill directs the U.S. Postal Service (USPS) to prescribe regulations: (1) requiring such mailing to be through a means that ensures direct delivery to a duly authorized agent at a postal facility or to the addressee, who must be at least 21 years of age and present a valid, government-issued photo identification at the time of delivery; (2) prohibiting such alcoholic beverages from being for resale or any other commercial purpose; and (3) requiring such covered entity to certify that the mailing is not in violation of applicable laws or regulations and to provide other information as directed by the USPS, including with respect to the prepayment of state alcohol beverage taxes.

The bill makes certain amounts in the trust fund available, without appropriation, to pay 100% of the eligible operations and maintenance costs of specified portions of the Saint Lawrence Seaway (a system of locks, canals, and channels in Canada and the United States that permits oceangoing vessels to travel from the Atlantic Ocean to the Great Lakes); and up to 100% of the eligible operations and maintenance costs assigned to commercial navigation of all U.S. harbors and inland harbors. The discretionary spending adjustment in a given fiscal year may not exceed the amount within the Harbor Maintenance Trust Fund on the last day of the fiscal year that is two years prior to such fiscal year.

Copyright Alternative in Small-Claims Enforcement Act of 2019 or the CASE Act of 2019 This bill creates the Copyright Claims Board, a body within the U.S. Copyright Office, to decide copyright disputes. Damages awarded by the board are capped at $30,000. Participation in board proceedings is voluntary with an opt-out procedure for defendants, and parties may choose instead to have a dispute heard in court. If the parties agree to have their dispute heard by the board, they shall forego the right to be heard before a court and the right to a jury trial. Board proceedings shall have no effect on class actions. The board shall be authorized to hear copyright infringement claims, actions for a declaration of noninfringement, claims that a party knowingly sent false takedown notices, and related counterclaims. The bill provides for various procedures, including with respect to requests for information from the other party and requests for the board to reconsider a decision. The board may issue monetary awards based on actual or statutory damages. The parties shall bear their own attorneys' fees and costs except where there is bad faith misconduct. A board's final determination precludes relitigating the claims in court or at the board. Parties may challenge a board decision in federal district court only if (1) the decision was a result of fraud, corruption, or other misconduct; (2) the board exceeded its authority or failed to render a final determination; or (3) in a default ruling or failure to prosecute, the default or failure was excusable.

Protecting Immigrants From Legal Exploitation Act of 2019 This bill establishes that certain acts of immigration-related fraud shall be punished by fines, imprisonment, or both. The bill provides for such punishment for a person who knowingly or recklessly executes a scheme or artifice in a matter arising under immigration law to (1) defraud any person; or (2) obtain anything of value from any person through false pretenses, representations, or promises. A person who knowingly and falsely represents that such person is an attorney or accredited representative in any matter arising under immigration law shall be subject to such punishment. The Department of Justice (DOJ) may seek civil injunctions to stop an immigration service provider from further engaging in fraudulent conduct or willfully misrepresenting the provider's authority to provide representation in immigration matters. An alien who left the United States based on erroneous advice from a person engaged in immigration practitioner fraud or the unauthorized practice of law shall not be barred from reentering the country. An alien may withdraw an application for immigration benefits that was prepared or submitted by an individual engaging in immigration practitioner fraud or the unauthorized practice of law, if the alien had no prior knowledge of the individual's fraudulent or unauthorized status. The Department of Homeland Security (DHS), the Department of State, and DOJ shall develop procedures for allowing such an alien to submit corrected filings. DHS and DOJ shall establish a program to provide grants to eligible nonprofit organizations to provide direct legal services to aliens.

Specifically, the standards must require dog dealers to provide to dogs adequate housing, exercise, and veterinary care; appropriate and nutritious food; continuous access to potable water; and meaningful socialization with humans and compatible dogs for at least 30 minutes each day. The standards must also include requirements for breeders to use safe breeding practices and make all reasonable efforts to find humane placement for retired breeding dogs.

National Museum of the American Latino Act This bill establishes the National Museum of the American Latino in the Smithsonian Institution. The purposes of the museum are to (1) illuminate Latino contributions to the story of the United States; (2) provide for the collection, study, research, publication, and establishment of exhibitions and programs related to Latino life, art, history, and culture; and (3) provide for collaboration with Smithsonian Institution museums and research centers and other museums and educational institutions in the United States and abroad to promote the study and appreciation of Latino life, art, history, culture, and its impact on society in the United States. The bill establishes a Board of Trustees for the museum to advise and assist the Board of Regents of the Smithsonian on all matters related to the administration and preservation of the museum. The Director of the museum shall manage the museum and may carry out educational and liaison programs in support of its goals. The Director of the Institute of Museum and Library Services shall establish and carry out specified grant programs and a scholarship program, including a grant program to promote the understanding of the Latin American diaspora in the United States. The Board of Regents shall designate a site for the museum and is authorized to design and construct it.

Duty to Report Act This bill requires political committees, candidates for federal office, and other individuals to report to the Federal Election Commission (FEC) and the Federal Bureau of Investigation (FBI) any offers of prohibited contributions, including offers of nonpublic information regarding other candidates, by foreign nationals. Specifically, political committees and candidates must report to the FEC within 24 hours any (1) offers of prohibited contributions from foreign nationals, and (2) meetings with foreign governments or their agents. In addition, the bill requires political committees, candidates, immediate family members of candidates, and individuals affiliated with a campaign (e.g., employees and independent contractors) to report to the FBI within 24 hours any offers of prohibited contributions from foreign nationals. Further, the bill establishes a new criminal offense for knowingly and willfully failing to comply with this reporting requirement. A violator is subject to criminal penalties—a fine, a prison term of up to two years, or both. Such reported information may not be used to enforce certain immigration provisions related to the removal of undocumented aliens.

Dignity for Detained Immigrants Act of 2019

Dignity for Detained Immigrants Act of 2019 This bill directs the Department of Homeland Security (DHS) to establish standards for facilities holding aliens in its custody, phases out using non-DHS facilities for such purposes, and contains other related provisions. The standards shall comply with the American Bar Association's Civil Immigration Detention Standards. The DHS Office of Inspector General (OIG) shall conduct periodic unannounced inspections of each facility and shall take various actions against noncompliant facilities, including imposing fines, cancelling contracts, and closing facilities. DHS shall report to Congress any death of an alien in its custody within 24 hours and conduct an investigation within 30 days that identifies policy changes that could reduce the likelihood of such a death. DHS is prohibited from entering into contracts for third parties to operate detention facilities and shall terminate existing contracts within three years of the bill's enactment. The bill establishes that OIG facility inspection reports and contracts for an outside entity to operate a detention facility are records available to the public under the Freedom of Information Act. DHS shall maintain certain information relating to detained aliens, including the alien's location and whether the alien was separated from family. The bill provides for various requirements and procedures related to detaining aliens, including (1) prohibiting DHS from detaining children, (2) imposing a presumption that an alien should be released, and (3) establishing that aliens in custody shall be subject to the least restrictive conditions. The bill also abolishes mandatory detention for asylum seekers.

Tobacco to 21 Act This bill prohibits the sale of tobacco products to (1) anyone under the age of 21, or (2) anyone under the age of 30 without photo identification of the purchaser's age. The Food and Drug Administration must enforce this prohibition by, for example, conducting undercover compliance checks, performing retailer inspections, and initiating enforcement actions for noncompliance. The bill establishes penalties for violations.

Military Housing Oversight and Service Member Protection Act This bill addresses Department of Defense (DOD) oversight and service member-protections in DOD-sponsored private military housing. Among other things, the bill covers contracts, unit inspection, remedying substandard conditions, handling housing-related injuries, and prohibiting improper financial interests by public officials. Specifically, DOD must establish requirements for entering into and renewing contracts with private landlords and must make the financial details of such agreements public. DOD must employ certified independent housing inspectors to ensure that private military housing units are safe, clean, and adequate and meet federal, state, and local laws and standards of habitability. DOD must allow state and local housing inspectors to conduct no-notice inspections, including on military installations. DOD must require each landlord to provide access to the landlord's maintenance work order system. Service members may file a claim with DOD to withhold the basic allowance for housing if a landlord has not met maintenance guidelines or the unit is uninhabitable according to state and local law. Military treatment facilities must screen service members and family members for medical conditions resulting from unsafe private housing and landlords must pay medical bills associated with housing-related injuries. The Department of Veterans Affairs must provide similar care for veterans and their families. The bill prohibits members of defense-related congressional committees and certain military officers and high-level DOD employees from having a financial interest in private military housing. Violations are subject to civil penalties.

Among other requirements, the bill requires the Food and Drug Administration (FDA) to implement regulations that require color graphics depicting the negative health consequences of smoking on the labeling of cigarette packages; requires the FDA to apply regulations on tobacco products to all tobacco products, including e-cigarettes; raises the minimum age for purchasing tobacco products to age 21, and makes it unlawful to market, advertise, or promote any electronic nicotine delivery system to individuals under such age; prohibits the retail online sale of tobacco products, including electronic nicotine delivery systems; prohibits the use of flavored products in an electronic nicotine delivery system, except in specified circumstances; increases the user fees that the FDA collects from manufacturers and importers; and directs the FDA to regulate products containing synthetic nicotine (not made or derived from tobacco).
