Methamphetamine Abuse Prevention Act of 2004

Methamphetamine Abuse Prevention Act of 2004 - Amends the Controlled Substances Act to: (1) reduce the retail sales threshold for the sale of products containing pseudoephedrine or phenylpropanolamine products from nine grams to six grams; and (2) eliminate the "regulated transaction" exemption for any over-the-counter sale of such products (including blister packs) by retail distributors. Prohibits any State, political subdivision, or State authorized entity from establishing any requirement for retail sales of any pseudoephedrine drug product that is different from the requirements that apply to such products under this Act. Makes this provision inapplicable to any requirement enacted prior to January 1, 2005, other than a requirement allowing any individual to purchase more than six grams of pseudoephedrine base in any single retail transaction. Allows the State to adopt penalties that are different from penalties that apply under this Act. Authorizes exemptions from this prohibition upon a determination by the Attorney General that pseudoephedrine drug products obtained in the State are being used as a significant source of precursor chemicals for illegal manufacture of a controlled substance for distribution or sale, that the requirement is likely to substantially decrease such use, and that the requirement will not unduly burden interstate commerce. Sets forth provisions governing judicial review.

Authorizes the Director of the Office of National Drug Control Policy to provide grants to States for the implementation and evaluation of Meth Watch programs, which shall have as their purpose to: (1) improve communication and cooperation between law enforcement agencies and manufacturers, distributors, and retailers of products that are frequently used in the production of methamphetamine; and (2) increase public awareness of the ways in which the illegal manufacturers of methamphetamine obtain precursor chemicals and equipment and of how the public may assist law enforcement agencies in stopping such activity. Authorizes the use of grant funds by a State to: (1) hire and retain personnel to implement and manage a Meth Watch program; (2) pay for training expenses and technical assistance to law enforcement personnel and employees of manufacturers, distributors, or retailers of products that are frequently used in methamphetamine production; (3) obtain informational materials, such as posters or videos, designed to implement the the program; (4) establish and maintain an informational hotline for the reporting by manufacturers, distributors, or retailers to law enforcement agencies of suspicious transactions in methamphetamine precursor chemicals or equipment; or (5) make grants to subdivisions of the State to implement the program.

To create an additional judgeship for the eastern district of California, and for other purposes.

Combat Meth Act - Directs the Attorney General to carry out a program to provide grants to qualified States (i.e., those which had more than 200 methamphetamine lab seizures in 2003 and that provide a specified mandatory minimum sentence for possession and/or distribution of five grams or more of methamphetamine or 50 grams or more of a substance containing methamphetamine) to combat methamphetamine abuse, focusing on the prosecution of repeat offenders. Authorizes funds to provide training to: (1) State and local prosecutors and law enforcement agents for investigation and prosecution of methamphetamine offenses; and (2) State law enforcement personnel at the Drug Enforcement Administration's Clandestine Laboratory Training Facility in Quantico, Virginia. Amends: (1) the Omnibus Crime Control and Safe Streets Act of 1968 to expand the public safety and community policing grant program to authorize the use of grant funds to hire personnel and purchase equipment to assist in enforcing and prosecuting methamphetamine offenses and in cleaning up methamphetamine-affected areas; and (2) the Public Health Service Act to authorize grants to local governments and nonprofit private entities to provide treatment for methamphetamine abuse. Directs the Attorney General to allocate funds for the hiring and training of special assistant U.S. attorneys. Authorizes the Attorney General, acting through the Bureau of Justice Assistance, to award grants to States to establish methamphetamine precursor monitoring programs.

Major Regulation Cost Review Act of 2004 - Amends Federal civil service law to require each Federal agency to publish in the Federal Register a plan, which may be amended at any time by publishing a revision, for the periodic review of all the major rules issued by the agency. Requires that the plan provide for review within five years after publication as a final rule, with a five year extension permitted. Directs the agency, in reviewing major rules, to consider: (1) the continued need for the rule; (2) the nature of complaints or comments received from the public concerning the rule; (3) the complexity of the rule; (4) the extent to which the rule overlaps, duplicates, or conflicts with other Federal rules, and with State and local governmental rules; and (5) the length of time since the rule has been evaluated or the degree to which technology, economic conditions, or other factors have changed in the area affected by the rule. Requires that: (1) the review include a cost-benefit analysis of the rule, including an identification and consideration of a range of less costly regulatory alternatives; and (2) each year each agency publish a list of the major rules which are to be reviewed and which are to be included in the accounting statement and associated report submitted to Congress by the Director of the Office of Management and Budget. Makes conforming changes to the Treasury and General Government Appropriations Act, 2001.

NASA and JPL 50th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury, in commemoration of the 50th anniversary of the establishment of the National Aeronautics and Space Administration (NASA) and the Jet Propulsion Laboratory (JPL) to mint and issue: (1) ten dollar gold coins; (2) five dollar gold coins; (3) one dollar silver coins; and (4) half-dollar silver coins emblematic of the 50 years of exemplary and unparalleled achievements of NASA and JPL. Directs each Federal agency and U.S. instrumentality that has in its possession any craft or any part of a craft that flew in space to: (1) retrieve any gold, silver, copper, and other precious metal that may be used in the production of any coins under this Act from such craft or part; and (2) deposit such metals with the Director of the United States Mint. Requires that all sales of coins minted under this Act include a surcharge of : (1) $75 per coin for the ten dollar coin; (2) $35 per coin for the five dollar coin; (3) $10 per coin for the one dollar coin; and (4) $3 for the half-dollar coin, which shall be paid by the Secretary to the NASA Family Assistance Fund for the purposes of providing financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties.

Federal Wetlands Jurisdiction Act of 2004 - Amends the Federal Water Pollution Control Act (FWPCA) to clarify that waters of the United States, including the territorial seas, are subject to the jurisdiction of the permitting program for the discharge of dredged or fill material if such waters are: (1) navigable; (2) hydrologically connected to navigable waters through a continuous, naturally occurring surface connection; or (3) wetlands adjacent to such navigable or hydrologically connected waters. States that waters are considered hydrologically connected to navigable waters for purposes of this Act if connected by perennial or intermittent streams that contribute flow to navigable waters. Excludes from the definition those waters connected by: (1) sheet flow; (2) ephemeral waters, ground water, manmade ditches, or pipelines; or (3) a municipal separate storm sewer system or any other regulated point source. Excludes fastlands (areas located behind legally constituted manmade structures) from the jurisdiction of the permitting program for the discharge of dredged or fill material. Sets forth procedures whereby property owners, or those with written authorization from such owners, may: (1) request that the Secretary of the Army determine jurisdiction under this Act and thereafter seek judicial review or injunctive relief; or (2) proceed under the administrative appeals process. Transfers to the Secretary of the Army, acting through the Chief of Engineers, the Environmental Protection Agency (EPA) Administrator's authority over permits for the discharge of dredged or fill material into navigable waters under the FWPCA. Allows the Administrator to retain authority to comment on such permits.

Stem Cell Research Enhancement Act of 2004 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to conduct and support research that utilizes human embryonic stem cells if: (1) the stem cells were derived from human embryos donated from in vitro fertilization clinics for the purpose of fertility treatment and were in excess of the needs of the individuals seeking such treatment; (2) the embryos will never be implanted in a woman and would otherwise be discarded; and (3) such individuals donate the embryos with written informed consent and receive no financial or other inducements.

To amend the Internal Revenue Code of 1986 to establish tax credits for climate neutral combustion technologies.

Terrorism Insurance Backstop Extension Act of 2004 - Amends the Terrorism Risk Insurance Act of 2002 to define: (1) the term "Program Year 4" as the period from January 1, 2006, through December 31, 2006; and (2) the term "Program Year 5" as the period from January 1, 2007, through December 31, 2007 (thereby extending the terrorism risk insurance program from 2005 through 2007). Sets a deadline for the Secretary of the Treasury to make a final determination regarding: (1) the availability of group life insurance to both insurers and consumers; and (2) whether certain provisions of the Act shall be applied to providers of group life insurance. Sunsets the Terrorism Risk Insurance Program after December 31, 2007.

Child Credit Preservation and Expansion Act of 2004 - Amends the Internal Revenue Code to repeal the scheduled reductions in the amount of the child tax credit for taxable years beginning in 2005 through 2009 (from $1,000 to $700 in 2005 through 2008 and $800 in 2009). Makes the $1,000 credit amount permanent. Increases the income threshold amount for calculating reductions in the credit amount to $125,000 ($250,000 for married taxpayers filing a joint return). Eliminates the reduction in the percentage of earned income for calculating the refundable portion of the credit (15 to 10 percent) for taxable years beginning before 2005. Includes in earned income for purposes of calculating the refundable portion of the credit otherwise tax excludable combat zone compensation of members of the armed forces. Exempts from the general termination date in the Economic Growth and Tax Relief Reconciliation Act of 2001 (December 31, 2010) provisions of that Act disregarding as income any refunds from the child tax credit for purposes of determining eligibility for federally funded assistance programs.

San Francisco Old Mint Commemorative Coin Act

Requires that sales of the coins include a surcharge of $35 per coin for the $5 coin, $10 for the $1 coin, and $3 for the half dollar coin, which shall be promptly paid by the Secretary to the American Eagle Foundation of Tennessee to: (1) establish an interest-bearing endowment called the American Eagle Fund as a permanent source of support for the care, monitoring, maintenance, and recovery of the bald eagle and its habitat in the United States; (2) make annual grants to Federal, State, and private eagle restoration, protection, and enhancement projects; (3) administer the Fund in an annual amount not to exceed the lesser of ten percent of the annual income of the Fund or $250,000; and (4) provide financial support for capital projects and for continuation and expansion of the Foundation's efforts to educate the American people about the bald eagle.

Directs the Attorney General to establish a registry of child custody and visitation orders and proceedings. Authorizes State and local law enforcement officers to hold any child listed as missing for a proper custody disposition. Amends the International Child Abduction Remedies Act to require the U.S. Central Authority under the Hague Convention on the Civil Aspects of International Child Abduction to establish a funding program for the provision of legal services to persons seeking remedies in interstate or international parental kidnapping cases. Authorizes the Legal Services Corporation to provide Convention-related legal assistance to qualified aliens. Requires the Central Authority to encourage the designation of courts to hear Convention-related cases. Amends the Federal judicial code to require the Federal Judicial Center to include in its continuing education programs information on the Convention and related laws. Requires various reports relating to international child abduction. Requires the Attorney General to support, through specified activities, the adoption and implementation in the States of the Uniform Child Custody Jurisdiction and Enforcement Act. Amends the Violence Against Women Act of 2000 to expand the Safe Havens for Children Pilot Program to include children at risk of parental kidnapping. Amends the Internal Revenue Code of 1986 to authorize the disclosure of taxpayer identity information to the National Center for Missing and Exploited Children.

Military Survivor Benefits Improvement Act of 2004

Military Survivor Benefits Improvement Act of 2004 - Adjusts the basic Survivor Benefit Plan (SBP) annuity amount for surviving spouses, age 62 and older, of former military personnel to: (1) 35 percent of the retired pay of the decedent (current law), for months before October 2005; (2) 40 percent for months after September 2005 and before October 2008; (3) 45 percent for months after September 2008 and before October 2014; and (4) 55 percent for months after September 2014 . Adjusts similarly percentage amounts with respect to survivors of reserve personnel and survivors of persons who die while on active duty. Provides a corresponding phased elimination of the SBP supplemental annuity authorized to be provided to such surviving spouses. Requires periodic recomputation of: (1) annuity amounts beginning in October 2005; and (2) retired pay reductions for supplemental survivor annuities. Provides a one-year open enrollment period for SBP participation, commencing October 1, 2005, for those currently not participating, those electing to increase current coverage, and those wishing to participate in the supplemental SBP. Authorizes the Secretary of Defense to require appropriate premiums for SBP participation.

Stock Option Accounting Reform Act - Amends the Securities Exchange Act of 1934 to require an issuer of registered securities to show as an expense in its mandatory annual report the fair value of all stock purchase options granted to certain of its senior executive officers after December 31, 2004. Exempts small business issuers from such requirement. Amends the Securities Act of 1933 to require reporting of: (1) stock option expenses as a reduction of the total expense in the fiscal year in which they expire or are forfeited; and (2) as income any excess by which such reduction exceeds total option expenses for any fiscal year. Requires any accounting principle recognized as "generally accepted" by the Securities and Exchange Commission (SEC) regarding the expensing of stock purchase options to comply with this Act. Denies recognition to any such accounting principle until the Secretaries of Commerce and of Labor complete a joint study on the economic impact of mandatory expensing of all employee stock options.

Firefighters Medical Monitoring Act of 2003 - Directs the Secretary of Health and Human Services, acting through the Director of the National Institute for Occupational Safety and Health, to monitor the long-term medical health of firefighters who have fought fires in any area for which the President has declared a major disaster under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.

Recognizing and honoring the firefighters and other public servants who responded to the October, 2003, historically devastating, outbreak of wildfires in Southern California.

Amends the Clean Air Act to authorize the production of methyl bromide in the same amount requested by the United States under the critical use exemption process of the Montreal Protocol, even if the parties to the protocol do not approve the entire amount. (Methyl bromide is a fumigant used to control insects, nematodes, weeds, and pathogens that has been defined under the Montreal Protocol of 1991 as a chemical that contributes to depletion of the ozone layer. The Montreal Protocol requires a phase out in production in the United States on a more accelerated schedule than that required of developing countries with which U.S. agriculture competes.)

To amend the reclamation laws to clarify that certain man-made facilities that receive water from a Bureau of Reclamation Project are not navigable waters.

Amends Federal reclamation law to clarify that man-made facilities that receive water from a Bureau of Reclamation Project and store or convey water for irrigation or drainage purposes, except for reservoirs in navigable streams or rivers, shall not be considered navigable waters of the United States.
