American Promise Act of 2017 This bill amends the Immigration and Nationality Act to permit an alien who is in temporary protected status (TPS) or deferred enforced departure (DED) status to apply for legal permanent resident status if such alien: is eligible for permanent resident status, applies for adjustment within three years, was granted or was eligible for TPS or DED status on or before October 1, 2017, and has been continuously physically present in the U.S. for at least three years. (TPS designations permit eligible nationals of designated counties affected by armed conflict or natural disasters to temporarily reside and work in the United States. DED designations permit eligible nationals of presidentially-designated counties to be temporarily not subject to removal from the United States.) The bill: waives certain grounds of inadmissibility; authorizes the waiver of the continuous physical presence requirement if an alien's removal would cause extreme hardship to the alien or to the alien's spouse, children, parents, or domestic partner; authorizes an alien who has applied for status adjustment to work; and authorizes an alien who has been ordered removed or granted voluntary departure to apply for status adjustment. An alien's spouse, parent, or unmarried child shall have his or her status adjusted to legal permanent resident if such person is eligible for status adjustment and applies within three years. Aliens from countries that no longer have valid TPS designation and aliens who no longer have valid DED status are not included in this bill unless such TSP or DED status expires on or after January 1, 2017.

Give Assistance and Help to Americans impacted by Natural Disasters Act or the Give A HAND Act This bill amends the Internal Revenue Code to allow various tax credits, deductions, and modifications to existing rules in areas impacted by disasters. With respect to areas in which a federally declared disaster occurred, the bill allows: expensing of disaster expenses, increased charitable contribution limits and mileage rates, modifications to rules regarding deductions for losses, waivers of certain mortgage revenue bond requirements, increased expensing and bonus depreciation, an increased new markets tax credit allocation, penalty-free distributions from retirement plans, an additional exemption for providing housing to displaced individuals, an exclusion for cancellations of indebtedness, the use of the previous year's income for calculating the earned income tax credit and the child tax credit, an increased rehabilitation credit for buildings, additional advance refundings of certain tax-exempt bonds, disaster area recovery bonds, additional low-income housing credit allocations, an exclusion for disaster mitigation payments received from state and local governments, a deduction for payments to a tax-exempt natural disaster fund, a credit for a portion of the wages paid to employees, an exclusion for employer-provided housing, an enhanced deduction for medical expenses, and extensions for tax and Medicare filing deadlines. The bill also modifies several deductions, credits, and other tax provisions that affect Puerto Rico and the U.S. Virgin Islands.

Dialysis Patient Access to Integrated-care, Empowerment, Nephrologists, Treatment, and Services Demonstration Act of 2017 or the Dialysis PATIENTS Demonstration Act of 2017 This bill establishes a demonstration program for the provision of integrated care to Medicare beneficiaries with end-stage renal disease (ESRD). Under the voluntary program, eligible participating providers may form organizations to offer ESRD integrated care models and serve as medical homes for program-eligible beneficiaries. Such a model: (1) shall cover medical and hospital services, other than hospice care, under Medicare; (2) must include benefits for transition into transplantation, palliative care, or hospice; and (3) may cover prescription drug benefits. An organization must offer at least one open network model but may also offer one or more preferred network models. An organization shall return savings achieved under the models to program-eligible beneficiaries. A beneficiary shall have the opportunity to: (1) opt out of the program, (2) make an assignment change into an open network model offered by a different organization, or (3) elect a preferred network model. The bill establishes requirements regarding: (1) benefits for program-eligible beneficiaries who are also eligible for Medicaid benefits, (2) program quality and reporting, (2) ESRD integrated care strategy, (3) program operation and scope, (4) beneficiary notification, and (5) payment. The Medicare Payment Advisory Commission must, before 2025, submit to Congress an interim report on the program.

Community-Based Independence for Seniors Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to establish a Community-Based Institutional Special Needs Plan demonstration program through which up to five eligible Medicare Advantage (MA) organizations shall provide home and community-based care to eligible Medicare beneficiaries. For purposes of the demonstration program, an eligible Medicare beneficiary is ineligible for Medicaid and unable to perform two or more activities of daily living. The Centers for Medicare & Medicaid Services (CMS) shall establish payment rates for eligible MA plans under the demonstration program. Such payment rates are capped but shall be in addition to payments otherwise made to MA organizations with respect to such plans. The CMS shall also: (1) help to educate eligible Medicare beneficiaries on the availability of the program, and (2) provide for program evaluation by an independent third party.

AFG and SAFER Program Reauthorization Act of 2017 This bill amends the the Federal Fire Prevention and Control Act of 1974 to: (1) repeal the expiration dates of, and to reauthorize through FY2023, the Assistance to Firefighters Grants (AFG) Program, the Fire Prevention and Safety Grants (FPSG) Program, and the Staffing for Adequate Fire and Emergency Response Grant (SAFER) Program; and (2) authorize the use of AFG Program grants, instead of SAFER Program grants, to provide specialized training to first responders on how to recognize and properly intervene with individuals with mental illness. The SAFER Program is revised to permit the use of grants to change the status of part-time or paid-on-call firefighters to full-time firefighters. The United States Fire Administration (USFA) may develop and make widely available an electronic, online training course for members of the fire and emergency response community on matters related to the administration of AFG, FPSG, and SAFER grants. The Federal Emergency Management Agency (FEMA) shall ensure that any such training is: (1) tailored to the financial and time constraints of members of the fire and emergency response community; and (2) accessible to all individuals in the career, combination, paid-on-call, and volunteer fire and emergency response community. The USFA shall develop and implement a grant monitoring and oversight framework to mitigate and minimize risks of fraud, waste, abuse, and mismanagement relating to such grants programs.

The plan must: identify situations that the covered person might experience that would trigger the need to implement the measures identified in the plan; outline tasks to be carried out in response to emergencies or disasters; establish a chain of command and identify the individuals responsible for fulfilling the tasks; and address how response and recovery will be handled in terms of materials, resources, and training needed. Real Education for Healthy Youth Act of 2017 This bill requires the Department of Health and Human Services (HHS), in coordination with the Department of Education, to award grants for: (1) comprehensive sex education for adolescents, (2) comprehensive sex education provided by institutions of higher education, and (3) training faculty and staff to teach comprehensive sex education to adolescents. HHS must enter a contract with a nonprofit organization to evaluate and report on these grants. The bill makes appropriations to carry out the the bill. Grants may not be used for health education programs that: withhold health-promoting or lifesaving information about sexuality-related topics, including HIV; are medically inaccurate or have been scientifically shown to be ineffective; promote gender or racial stereotypes; are insensitive and unresponsive to the needs of certain youth, including survivors of sexual abuse or assault, sexually active youth, pregnant or parenting youth, or individuals with varying gender identities or sexual orientations; or are inconsistent with the ethical imperatives of medicine and public health. The bill amends the Public Health Service Act to revise requirements and eliminate prohibitions regarding the content of educational programs funded through the AIDS prevention program. The bill amends the Elementary and Secondary Education Act of 1965 to allow funding to be used for: (1) materials or programs that promote or encourage sexual activity, and (2) contraceptive distribution in schools. The bill amends title V (Maternal and Child Health Services) of the Social Security Act to repeal the program for abstinence education. Unobligated funds for abstinence education are transferred and made available to carry out this bill.

The bill defines a "veteran" for purposes of this bill as an individual who, during active military, naval, or air service, served in or near the Korean demilitarized zone during the period beginning on September 1, 1967, and ending on August 31, 1971. The bill specifies such a disease as: (1) a listed disease that becomes manifest, or (2) any additional disease that the Department of Veterans Affairs determines warrants a presumption of service-connection by reason of a positive association with herbicide exposure and that manifests itself within a prescribed period.

Customer Non-Discrimination Act This bill amends the Civil Rights Act of 1964 to include sex, sexual orientation, and gender identity among the prohibited categories of discrimination or segregation in places of public accommodation. It defines: "sex" to include a sex stereotype, sexual orientation or gender identity, and pregnancy, childbirth, or a related medical condition; "sexual orientation" as homosexuality, heterosexuality, or bisexuality; and "gender identity" as gender-related identity, appearance, mannerisms, or characteristics, regardless of the individual's designated sex at birth. The bill expands the categories of public accommodations to include places or establishments that provide: exhibitions, recreation, exercise, amusement, gatherings, or displays; goods, services, or programs, including a store, a shopping center, an online retailer or service provider, a salon, a bank, a gas station, a food bank, a service or care center, a shelter, a travel agency, a funeral parlor, or a health care, accounting, or legal service; or transportation services. "Establishment" shall not be construed to be limited to a physical facility or place. Protections against discrimination based on race, color, religion, sex, sexual orientation, gender identity, or national origin must include protections against discrimination based on: (1) an association with another person who is a member of such a protected class; or (2) a perception or belief, even if inaccurate, that an individual is a member of such a protected class. The bill prohibits the Religious Freedom Restoration Act of 1993 from providing a claim, defense, or basis for challenging such protections. The bill prohibits denial of an individual's access to a shared facility (including a restroom, a locker room, and a dressing room) that is in accordance with the individual's gender identity.

Furthering Access to Coordinated Treatment for Seniors Act of 2017 or the FACTS Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to allow Medicare prescription drug plan (PDP) sponsors to access certain Medicare claims data. Specifically, the Centers for Medicare & Medicaid Services (CMS) must establish a process for PDP sponsors to request, beginning in plan year 2020, standardized extracts of claims data for Medicare hospital and medical services. PDP sponsors may use such data: (1) to optimize therapeutic outcomes through improved medication use, (2) to improve care coordination so as to prevent adverse health outcomes, or (3) for any other purpose determined appropriate by the CMS. PDP sponsors may not, however, use such data: (1) to inform coverage determinations; (2) to conduct retroactive reviews of medically accepted indications determinations; (3) to direct enrollment changes; (4) to inform marketing of benefits; or (5) for certain other purposes affecting the security of personal health information, as determined by the CMS.

Wage Theft Prevention and Wage Recovery Act

Wage Theft Prevention and Wage Recovery Act This bill amends the Fair Labor Standards Act of 1938 (FLSA) to require employers to make initial disclosures to employees of the terms of their employment, provide such employees with regular paystubs, and make final payment to a terminating employee for uncompensated hours within 14 days of the employee's termination. An employer shall compensate an employee at the rate specified in an employment contract or other employment agreement, including a collective bargaining agreement, that specifies a rate of pay higher than the minimum wage rate. The bill establishes new and increased civil and criminal penalties for violations of FLSA overtime or minimum wage requirements, including referral to the Department of Justice for criminal prosecution of employers who engage in wage theft, falsification of wage records, or retaliation against employees. The bill: (1) increases damages for employees who are victims of wage theft from two to three times the wages owed or who are fired for filing a complaint concerning wage theft or for cooperating in an investigation by the Department of Labor, (2) revises requirements for wage recordkeeping by employers and establishes penalties for violations of those requirements, (3) grants employees the right to inspect employer wage records, and (4) increases the statute of limitation for bringing a claim for owed wages from two to four years (three to five years for willful violations). Labor must award grants to assist certain entities in the enforcement of FLSA wage and hour requirements.

Dream Act of 2017

Dream Act of 2017 This bill directs the Department of Homeland Security (DHS) to cancel removal and grant lawful permanent resident status on a conditional basis to an alien who is inadmissible or deportable or is in temporary protected status who: (1) has been continuously physically present in the United States for four years preceding this bill's enactment; (2) was younger than 18 years of age on the initial date of U.S. entry; (3) is not inadmissible on criminal, security, terrorism, or other grounds; (4) has not participated in persecution; (5) has not been convicted of specified federal or state offenses; and (6) has fulfilled specified educational requirements. DHS shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an alien who was granted Deferred Action for Childhood Arrivals (DACA) status unless the alien has engaged in conduct that would make the alien ineligible for DACA. DHS may not: (1) grant conditional permanent resident status without the submission of biometric and background data, and completion of background and medical checks; and (2) disclose or use information provided in applications filed under this bill or in DACA requests for immigration enforcement purposes. The bill prescribes the conditions under which DHS: (1) may terminate a person's conditional permanent resident status, and (2) shall adjust a person's conditional status to permanent resident status. The bill: (1) sets forth documentation requirements for establishing DACA eligibility, and (2) repeals the denial of an unlawful alien's eligibility for higher education benefits based on state residence.

Hizballah International Financing Prevention Amendments Act of 2017 This bill amends the Hizballah International Financing Prevention Act of 2015 to impose specified sanctions on: (1) foreign persons that knowingly assist in or provide support for fund raising or recruitment activities for Hizballah; (2) agencies of foreign governments that provide Hizballah with financial support, arms, or other assistance (export license requirements are included in addition to sanctions if such government is a state sponsor of terrorism); and (3) Hizballah, including by reason of Hizballah's significant transnational criminal activities. The bill expresses the sense of Congress that sanctions should be placed on financial institutions that serve Lebanese government officials affiliated with Hizballah. The Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 is amended to sanction foreign financial institutions that facilitate efforts by Iran or the Islamic Revolutionary Guard Corps to aid Hizballah. The bill prescribes reporting requirements or reporting modifications with respect to: (1) foreign persons that knowingly assist or provide significant financial, material, or technological support for foreign persons assisting Hizballah; (2) financial institutions that are owned or organized under the laws of state sponsors of terrorism; (3) Hizballah's racketeering activities; (4) combating illicit tobacco trafficking networks used by Hizballah and other foreign terrorist organizations to finance their operations; (5) the estimated net worth of senior Hizballah officials and how these funds were acquired and used; and (6) countries that support Hizballah or in which Hizballah maintains important logistics networks or financial networks and steps such countries are taking to disrupt such networks.

Mechanical Insulation Installation Incentive Act of 201 7 This bill amends the Internal Revenue Code to allow an additional tax deduction for the cost of installing mechanical insulation property. The bill: (1) limits the amount of such deduction to the lesser of 30% of the cost or the reduction in energy loss from the installed mechanical insulation property compared to property that meets the minimum requirements of American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) standard 90.1-2007; and (2) allows the cost of mechanical insulation property that is placed in service to replace insulation property to be treated as a deductible business expense in the current taxable year. The bill defines "mechanical insulation property" as insulation materials, facings, and accessory products: (1) placed in service in connection with a mechanical system which is located in the United States and of a character subject to an allowance for depreciation; and (2) utilized for thermal requirements for mechanical piping and equipment, hot and cold applications, and heating, venting and air conditioning applications which can be used in a variety of facilities. The bill also allows a tax deduction for capital expenditures related to mechanical insulation property.
