Special Inspector General for the Troubled Asset Relief Program Act of 2009

Special Inspector General for the Troubled Asset Relief Program Act of 2009 - Amends the Emergency Economic Stabilization Act of 2008 to grant the Special Inspector General (SIG) authority to conduct, supervise, and coordinate an audit or investigation of any action taken with regard to the Troubled Asset Relief Program (TARP) that the SIG deems appropriate. Prohibits any audit or investigation, however, of any action related to: (1) graduated authorization to purchase troubled assets; (2) oversight and audits by the Comptroller General; (3) the Comptroller General's study and report on margin authority; and (4) the Congressional Oversight Panel. Authorizes the SIG to exercise specified employment authorities for additional personnel, but not after six months following enactment of this Act. Prohibits any period of appointment from exceeding the date on which the Office of the SIG terminates. States that if an annuitant receiving an annuity from the Civil Service Retirement and Disability Fund becomes employed within the Office of the SIG for the Troubled Asset Relief Program, such annuity shall continue. Limits such allowance to: (1) not more than 25 employees at any time as designated by the SIG; and (2) only pay periods beginning after the enactment of this Act. Requires the Secretary of the Treasury either to: (1) take action to address deficiencies identified by a report or investigation of the SIG or other auditor engaged by the TARP; or (2) certify to congressional committees that no action is necessary or appropriate. Instructs the SIG to work with Inspectors General of designated federal agencies to: (1) avoid duplication of effort; and (2) ensure comprehensive oversight of TARP. Requires the SIG to: (1) report to Congress by September 1, 2009, on the use of any funds received by a financial institution under TARP; and (2) make such report available to the public, including on the home page of the SIG's website within 24 hours after its submission to Congress. Requires funding for the office of the SIG to be made available not later than seven days after the the date of enactment of this Act. Makes the Special Inspector General for Iraq Reconstruction and the Special Inspector General for Afghanistan Reconstruction members of the Council of the Inspectors General on Integrity and Efficiency until the termination of their respective Offices.

Fairness in Housing Recovery Act of 2009

Fairness in Housing Recovery Act of 2009 - Shields a servicer from liability for entering into a loan modification or loss mitigation plan for certain mortgages pursuant to guidelines issued by the Secretary of the Treasury under the Emergency Economic Stabilization Act of 2008 (EESA), if such servicer acts consistent with the fiduciary duty of servicers of pooled residential mortgages required by the Truth in Lending Act. Amends the National Housing Act to replace the Hope for Homeowners Program with a program for insurance of home ownership retention mortgages. Amends the Department of Housing and Urban Development Act to establish the Office of Housing Counseling Requires the Secretary of Housing and Urban Development (HUD) to provide financial assistance to governmental entities and nonprofit organizations providing home ownership or rental counseling. Requires the Secretary to study and report to Congress on the root causes of default and foreclosure of home loans. Amends the Real Estate Settlement Procedures Act of 1974 to direct the Secretary periodically to prepare a consumer education booklet on real estate settlement practices for federally related mortgage loan applicants. Amends the National Housing Act to prescribe limitations upon participation in origination and mortgagee approval. Establishes Commission on the Foreclosure and Mortgage Lending Crisis to study and report to Congress on the current legal and regulatory framework governing the housing mortgage lending markets and how it contributed to the increased foreclosure rate. Authorizes appropriations to the Attorney General to combat mortgage fraud. Amends the Federal Deposit Insurance Act (FDIA) and the Federal Credit Union Act (FCUA) to increase the maximum deposit insurance and borrowing authorities of the Federal Deposit Insurance Corporation (FDIC) and the National Credit Union Administration (NCUA). Amends the FDIA with respect to systemic risk special assessments. Amends the FCUA to direct the NCUA Board to establish a National Credit Union Share Insurance Fund restoration plan in specified circumstances. Amends the EESA to prohibit the Secretary of the Treasury from making any purchase for which the Secretary receives control-diluting stock. Declares that for a taxpayer who holds an interest in a subsidized residence: (1) the exclusion of gain from sale of principal residence under the Internal Revenue Code shall not apply to any gain from the sale or exchange of such interest, and (2) a specified rate of tax on specified gain shall be twice the rate which would otherwise apply. Amends the Internal Revenue Code to allow a refundable general home buyer credit for residences purchased during 2009 or 2010. Prescribes general conditions for mortgage relief.

Dedicates any repeal or cancellation only to deficit reduction or increase of a surplus. Provides for adjustment of: (1) committee allocations resulting from such rescission; and (2) applicable limits, as appropriate, under the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act). Sets forth procedures for expedited congressional consideration of a proposed rescission. Expresses the sense of Congress that no President or any executive branch official should condition the inclusion or exclusion, or threaten to condition the inclusion or exclusion, of any proposed repeal or cancellation in any special message under this Act upon any vote cast or to be cast by any Member of either chamber.

Achieving a Better Life Experience Act of 2009 or the ABLE Act of 2009 - Amends the Internal Revenue Code to establish tax-exempt ABLE accounts for individuals with a disability to pay certain expenses of such individuals, including expenses for education, housing, transportation, employment support, medical care, and certain life necessities. Defines "individual with a disability" as an individual who is eligible to receive certain supplemental security income benefits under the Social Security Act. Allows individual taxpayers a tax deduction, up to $2,000 per year, for contributions to an ABLE account. Requires the Secretary of the Treasury to study and report to Congress on the use of ABLE accounts and the effect of the tax deduction for contributions to such accounts. Requires ABLE accounts to be disregarded in determining eligibility for Medicaid benefits and for purposes of determining eligibility for other means-tested federal programs.

Iran Threat Reduction Act of 2009 - Amends the Iran Freedom Support Act to maintain specified U.S. sanctions with respect to Iran until the President certifies to the appropriate congressional committees that Iran has verifiably dismantled its weapons of mass destruction programs and ceased its support for international terrorism. Amends the Iran Sanctions Act of 1996 to: (1) include transshipment among sanctionable activities; and (2) exclude from the United States an alien who is a senior government official of a foreign government or a corporate principal or significant shareholder of a foreign person involved in proliferation activities relating to Iran. Expands: (1) the scope of sanctionable "persons" to include any business organization and any foreign subsidiary or affiliate; and (2) the definition of "petroleum resources" to include petroleum byproducts, oil or liquefied natural gas or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or compressed or liquefied natural gas. Prohibits, with a discretionary waiver, U.S. importation of Iranian products other than information materials. Subjects an entity to penalties for violations of certain sanctions committed by a subsidiary established by such entity outside of the United States that would be subject to prohibitions if committed inside the United States or by a U.S. person. Authorizes the President to impose sanctions on principal executive officers of sanctioned persons. Amends the Iran, North Korea, and Syria Nonproliferation Act to include within the scope of such Act persons involved in the transshipment of certain goods, services, or technology. Prohibits service module payments to the Russian Aviation and Space Agency. Sets forth provisions regarding divestment from Iran's energy sector. Amends the Internal Revenue Code to: (1) deny a foreign tax credit to a taxpayer engaged in business activity with Iran that is prohibited by U.S. law; and (2) set forth income tax provisions respecting a foreign corporation engaged in business activity with Iran that is prohibited by U.S. law. Establishes the Compensation for Former United States Hostages in Iran Fund. Identifies claims to be paid. Establishes restrictions on nuclear cooperation with a country that is assisting the nuclear program of, or transferring advanced conventional weapons or missiles to, Iran.

Makes such benefit: (1) an amount not to exceed $200 for each day, in the case of a former member; and (2) either one day of administrative absence or an amount not to exceed $200, in the case of a current member. Excludes from such benefit any members discharged or released under other than honorable conditions. Sets at 40 the maximum number of days for which such benefit may be provided.

Requires the Comptroller General to review the process by which the Civil Air Patrol may provide assistance to the Secretary of Homeland Security, other federal agencies, and states to support homeland security missions, including by providing: (1) aerial reconnaissance or communications capabilities for border security; (2) capabilities for collective response to an act of terrorism, natural disaster, or other man-made event by assisting in damage assessment and situational awareness, conducting search and rescue operations, assisting in evacuations, or transporting time-sensitive medical or other materials; or (3) assistance in the exercise and training of departmental resources responsible for the intercept of aviation threats to designated restricted areas. Directs the Comptroller General's report to include assessments of: (1) the feasibility and cost-effectiveness of using Civil Air Patrol assets; and (2) whether current mechanisms for requesting support from the Civil Air Patrol are sufficient. Requires the Secretary to analyze the study and report to the committees any recommendations for action that could affect DHS's organization and administration.

Organized Retail Crime Act of 2009 - Amends the federal criminal code to define "organized retail crime" as: (1) the stealing, embezzlement, obtaining by fraud, false pretenses, or other illegal means of retail merchandise in quantities that would not normally be purchased for personal use or consumption for the purpose of reselling or otherwise reentering such retail merchandise in commerce; or (2) the recruitment of persons to participate in such criminal activities. Modifies the crime of transporting and selling or receiving stolen goods to include activities involving organized retail crime and the facilitation of such crime through the operation of an online marketplace. Expands the crime of fraud involving access devices to include the use of gift cards, a Universal Product Code label, or a radio frequency identification transponder to obtain goods or services illegally. Imposes reporting and other requirements on operators of online marketplaces and high volume (at least $12,000 annually) sellers relating to the sale of goods and services suspected of being acquired through organized retail crime. Requires the U.S. Sentencing Commission to review and, if appropriate, amend its guidelines for persons convicted of offenses involving organized retail crime. Provides for civil forfeiture of any property used to commit or facilitate organized retail crime. Allows a business whose goods or services were sold or used in the facilitation of organized retail crime through the operation of an online marketplace to obtain injunctive relief and compensatory damages.

Colorectal Cancer Prevention, Early Detection, and Treatment Act of 2009 - Amends the Public Health Service Act to allow the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to make grants to states and Indian tribes for colorectal cancer programs that include: (1) providing colorectal cancer screening to individuals who are over 50 years of age or at high risk for such cancer; (2) providing case management and referrals for medical treatment; (3) ensuring the full continuum of follow up and cancer care for individuals screened; (4) carrying out activities to improve the education, training, and skills of health professionals in the detection and control of colorectal cancer; and (5) developing and disseminating public information and education programs for the detection and control of colorectal cancer and promoting the benefits of receiving screenings through this program. Gives priority to low-income individuals who lack adequate coverage under health insurance and health plans with respect to screenings for colorectal cancer. Allows the Secretary to provide training and technical assistance with respect to the planning, development, and operation of programs funded by a grant under this Act. Amends title XIX (Medicaid) of the Social Security Act to allow states to provide medical assistance to individuals who have been screened for colorectal cancer under this Act and who need treatment for complications due to screening or colorectal cancer. Applies provisions related to breast and cervical cancer programs to programs under this Act.

Access to Emergency Medical Services Act of 2009 - Establishes the United States Bipartisan Commission on Access to Emergency Medical Services to: (1) identify and examine factors in the health care delivery, financing, and legal systems that affect the effective delivery of screening and stabilization services furnished in hospitals that have emergency departments pursuant to the Emergency Medical Treatment and Labor Act (EMTALA); and (2) make specific recommendations to Congress with respect to federal programs, policies, and financing needed to assure the availability of such screening and stabilization services and the coordination of state, local, and federal programs for responding to disasters and emergencies. Amends title XVIII (Medicare) of the Social Security Act to provide for additional payments for certain physicians' emergency services furnished pursuant to EMTALA. Directs the Secretary of Health and Human Services, acting through the Administrator of the Centers for Medicare & Medicaid Services, to convene a working group that includes experts in emergency care, inpatient critical care, hospital operations management, nursing, and other relevant disciplines to develop boarding and diversion standards for hospitals and guidelines, measures, and incentives for implementation, monitoring, and enforcement of such standards. Requires the CMS working group to: (1) identify barriers contributing to delays in timely processing of patients requiring admission as inpatients who initially sought care through the hospital's emergency department; (2) identify best practices to improve patient flow within hospitals; and (3) report to Congress and the Secretary a detailed description of the standards, guidelines, measures, and incentives developed, as well as identified barriers and best practices. Directs the Secretary to establish a mechanism to make public information regarding any hospital that fails to report information requested by the CMS working group.

Military Spouses Residency Relief Act - Amends the Servicemembers Civil Relief Act to prohibit, for purposes of voting for a federal, state, or local office, deeming a person to have lost a residence or domicile in a state, acquired a residence or domicile in any other state, or become a resident in or of any other state solely because the person is absent from a state because the person is accompanying the person's spouse who is absent from the state in compliance with military or naval orders. Prohibits a servicemember's spouse from either losing or acquiring a residence or domicile for purposes of taxation because of being absent or present in any U.S. tax jurisdiction solely to be with the servicemember in compliance with the servicemember's military orders if the residence or domicile is the same for the servicemember and the spouse. Prohibits a spouse's income from being considered income earned in a tax jurisdiction if the spouse is not a resident or domiciliary of such jurisdiction when the spouse is in that jurisdiction solely to be with a servicemember serving under military orders. Suspends land rights residency requirements for spouses accompanying servicemembers serving under military orders.

Pulmonary Fibrosis Research Enhancement Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) develop a system to collect data on pulmonary fibrosis and other interstitial lung diseases; (2) establish the National PF Registry; and (3) establish the National Pulmonary Fibrosis Advisory Board. Allows the Secretary, acting through the Director of the CDC, to provide for the collection, analysis, and reporting of data on pulmonary fibrosis and other interstitial lung diseases that can be confused with, misdiagnosed as, and progress to pulmonary fibrosis. Requires the Secretary, in developing the Registry, to: (1) expand and coordinate existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure; and (2) provide for research access to pulmonary fibrosis data. Directs the Secretary to ensure that epidemiological and other types of information are made available to the National Institutes of Health (NIH) and the Department of Veterans Affairs (VA). Requires the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate Institute pulmonary fibrosis research activities. Requires the Director of CDC to prepare the National Pulmonary Fibrosis Action Plan. Requires the Secretary to: (1) convene a summit of individuals with expertise in research and care of pulmonary fibrosis to provide a detailed overview of NIH research activities and discuss potential collaborations between NIH and other federal health agencies; and (2) make information about NIH activities relating to pulmonary fibrosis publicly available.

Directs the Secretary to: (1) require that a new drug application include any clinical data possessed by the applicant that relates to the safety and effectiveness of the drug involved by gender, age, and racial subgroup; and (2) develop guidance for the staff of the Food and Drug Administration (FDA) to ensure that new drug applications are adequately reviewed to determine whether they include the required clinical data. Authorizes the Secretary to place a clinical hold on an investigation under an investigational new drug application if the sponsor of the investigation fails to meet the requirements of an annual report on the status of each study in progress. Applies provisions relating to clinical data submission for new drug applications to applications for an investigational new drug, a biologics license for a biological product, premarket approval for a class III device, and investigational use of a device. Amends the Public Health Service Act to require the Secretary to provide that all nonidentifiable patient safety work product reported to and among the network of patient safety databases be identified by sex. Directs that analyses of statistics of information reported to the network of patient safety databases take into account data that specifically relates to women and any disparities between treatment and the quality of care between males and females. Requires the Director of the Agency for Healthcare Research and Quality to support research and demonstrations to identify and evaluate clinical and organizational strategies to improve the quality of and access to care for women with heart disease, stroke, and other cardiovascular diseases. Requires the Secretary to: (1) distribute to females age 65 or older and appropriate health care professionals educational materials relating to the prevention, diagnosis, and treatment of heart disease, stroke, and cardiovascular diseases in women; and (2) conduct an education and awareness campaign for health care professionals relating to such diagnosis and treatment. Expands the grant program authorizing the Secretary to award grants for preventive health services to all states.

Secondary Metal Theft Prevention Act of 2009 - Expresses the sense of Congress that government agencies should work with representatives of the secondary metal recycling industry to combat the theft and sale of stolen secondary metal. Defines "secondary metal" as: (1) wire or cable commonly used by communications and electrical utilities; and (2) copper, aluminum, or other metal (including when combined with other materials) that is valuable for recycling or reuse as raw metal. Makes it unlawful to sell certain secondary metal unless the seller documents ownership and maintains written or electronic records of each secondary metal purchase. Includes within the prohibition: (1) secondary metal that is marked with the name, logo, or initials of a railroad, a utility company, or a state or local government; (2) highway or street poles, fixtures, rails, or signs; (3) unused or undamaged building construction or utility material; (4) historical markers or grave markers; and (5) large bulk containers for beer. Prohibits cash purchases of secondary metal in excess of $75 or small multiple cash purchases within a 48-hour period. Requires purchasers of secondary metal in excess of $75 to pay by check. Empowers the Federal Trade Commission (FTC) and state attorneys general to enforce this Act. Imposes a civil penalty for violations. Declares that this Act does not preempt any state or local law regulating the sale or purchase of secondary metal.
