Ensuring Ballott Access for Hurricanes Katrina and Rita Victims Act of 2005 - Directs the Election Assistance Commission to make grants to states to restore and replace election administratiion supplies, materials, and equipment which were damaged as a result of Hurricane Katrina and Hurricane Rita.

Community Cancer Care Preservation Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to subject to quarterly reconciliation any payments to physicians for drugs or biologicals made according to average sales price payment methodology in order to assure that they do not exceed or fall short of the actual average sales price during any preceding period. Requires the Secretary of Health and Human Services to review all such payments in the preceding quarter and compare them to the verified average sales price reported by the manufacturer for such quarter. Removes prompt pay discounts from the calculation of the manufacturer's average sales price. Extends through December 31, 2006, the current demonstration project to identify and assess oncology services that positively affect cancer outcomes. Requires the Secretary to make an additional 2% for drug administration services payment to physicians for overhead and related costs. Directs the Secretary to develop indicators for the evaluation of the quality of oncology services provided in the physician office setting. Requires the Director of the National Cancer Institute to develop a strategic plan to increase the number of cancer patients who enroll in clinical trials.

American Parity Act of 2005 - Directs the Secretary of the Treasury to make grants to states and local governments for assistance in making priority expenditures. Defines priority expenditures as ordinary and necessary maintenance and operating expenses for: (1) primary, secondary, or higher education; (2) public safety; (3) public health; (4) social services for the disadvantaged or aged; (5) roads, transportation, and water infrastructure; and (6) housing, as well as ordinary and necessary capital expenditures authorized by state law. Requires at least one third of grant amounts to be made available to local governments.

Advocates Dedicated to Older Child Parental Tax Credit (ADOPT) Act of 2005 - Amends the Internal Revenue Code to allow a $2,000 tax credit for costs associated with the adoption of a child who has reached nine years of age before the adoption decree becomes final. Allows the credit each year until such child attains the age of 19.

Requests the President and directs the Secretary of State to provide to the House of Representatives: (1) all documents from 2003 pertaining to the taskforce organized by Andrew Card, consisting of Karl Rove, Karen Hughes, Mary Matalin, Nicholas E. Calio, James R. Wilkinson, Condoleezza Rice, Stephen Hadley and I. Lewis Libby, known as the White House Iraq Group; (2) all drafts of all white papers concerning Iraq's nuclear threat assembled in 2003 by the Group; and (3) all documents, including notes from meetings, memos, telephone and electronic mail records, logs and calendars, and records of internal discussions in the possession of the President or the Secretary relating to the Group.

Pakistani Temporary Protected Status Act of 2005 - Expresses the sense of Congress that the extraordinary and temporary conditions caused by the earthquake in Pakistan qualifies Pakistan for designation under the Immigration and Nationality Act pursuant to which its nationals would be eligible for temporary protected status (TPS) in the United States (for an initial 12-month period). Sets forth related TPS eligibility requirements, including continuous U.S. presence since October 8, 2005. Requires the Secretary to give prior consent to such aliens for temporary trips abroad in emergency and extenuating circumstances.

Recognizes the 60th anniversary of the disappearance of the five naval Avenger torpedo bombers of Flight 19 and the naval Mariner rescue aircraft sent to search for Flight 19. Honors the memory of the 27 Navy airmen lost in these disappearances. Commends the Naval Historical Center for preserving the history of Flight 19.

Pandemic Preparedness and Response Act - Amends the Public Health Service Act to require the President to appoint a National Director of Pandemic Preparedness and Response to strengthen, expand, and coordinate domestic pandemic influenza preparedness activities. Establishes the Pandemic Influenza Preparedness Policy Coordinating Committee to develop an Interagency Preparedness Plan. Requires states to have an approved state preparedness plan as a condition of receiving certain funds related to bioterrorism. Provides for the integration and coordination of public and private influenza surveillance activities. Directs the Secretary of Health and Human Services to: (1) procure antivirals, developed vaccines, and essential medications for the Strategic National Stockpile; (2) develop a national system for tracking and distributing antiviral medications and vaccines; and (3) assist other counties in preparation for, and response to, pandemic influenza. Provides for the expansion and intensification of influenza research. Directs the Secretary to contract with the Institute of Medicine to study topics related to the pandemic influenza. Establishes the National Pandemic Influenza Economics Advisory Committee. Requires the Secretary of Agriculture to expand and intensify efforts to prevent pandemic influenza. Requires the Secretary of Health and Human Services to: (1) enter into contracts with manufacturers to produce additional necessary doses of the influenza vaccine; and (2) develop a national plan for responding to potential influenza vaccine shortages. Sets forth prohibitions against charging excessive prices during a public health emergency for, reporting false pricing information to the Secretary about, or employing a manipulative or deceptive device or contrivance in connection with the purchase or sale of, drugs, devices, or biologics for the prevention or treatment of influenza at wholesale.

Food Allergy and Anaphylaxis Management Act of 2005 - Requires the Secretary of Health and Human Services to develop and make available to local educational agencies a voluntary policy to manage the risk of food allergy and anaphylaxis in schools. Directs that such policy address: (1) a parental obligation to provide the school with information regarding a student's food allergy and anaphylaxis; (2) communication strategies between schools and emergency medical services; (3) strategies to reduce the risk of exposure in classrooms and common areas; (4) food allergy management training of school personnel; (5) authorization of school personnel to administer epinephrine when the school nurse is not immediately available; and (6) creation of an individual health care plan tailored to each child's risk for anaphylaxis.

Honors the life and achievements of Dr. John Garang de Mabior. Reaffirms the House of Representatives' commitment to a lasting peace in the Republic of the Sudan, and calls for full implementation of the Comprehensive Peace Agreement. Directs the Clerk of the House of Representatives to transmit an enrolled copy of this resolution to the Secretary of State with a request that the Secretary transmit it to Dr. Garang's widow, Rebecca Garang, and to the government of Southern Sudan, through the Office of the Sudan People's Liberation Movement (SPLM) in the District of Columbia.

Gulf Coast Hurricanes Student and School Relief Act - Directs the Secretary of Education to make grants to: (1) impacted local educational agencies (LEAs) serving major disaster areas because of Hurricane Katrina or Hurricane Rita (Gulf hurricanes) for immediate aid to restart public school operations; (2) receiving LEAs serving students who have relocated as a result of one of the Gulf hurricanes, for education and pupil services for such students; (3) receiving LEAs for assistance to public schools to provide special education and related services to such relocated children with disabilities; (4) eligible entities under the 21st Century Community Learning Centers program in areas served by impacted or receiving LEAs, for activities at such centers; and (5) impacted and receiving LEAs for school facilities construction, modernization, or repair.

Pension Benefits Protection Act of 2005 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code with respect to pension benefits of employees in defined benefit plans. Directs the Secretary of the Treasury to apply Code provisions regarding continued accrual of benefits beyond normal retirement age under a defined benefit plan, which prohibit certain discrimination based on age, without regard to the portion of the preamble to a specified Treasury Decision which relates to allocation of interest adjustments through normal retirement age under a cash balance plan. Prohibits forced conversions of certain defined benefit plan participants to cash balance plans, and other such plans that are hybrids of defined benefit and defined contribution plans, by plan amendments which: (1) change the way the accrued benefits to participants or beneficiaries are expressed; and (2) reduce the rate of future benefit accrual of one or more participants. Requires employers, at the time such amendment takes effect, to provide employees who have attained 40 years of age or 10 years of service with certain notices and an election upon retirement to receive benefits as determined either under the plan in effect at time of retirement or under the plan in effect immediately before the plan amendment. Sets forth a formula to determine when a plan amendment adopted by a large (100 or more participants) defined benefit plan shall be treated as wearing away accrued benefits.

Children's Gasoline Burn Prevention Act - Directs the Consumer Product Safety Commission to promulgate final child-resistance product safety standards for closures on portable gasoline containers intended for use by consumers. Prescribes criteria for such standards.

Gulf Coast College Revitalization Act - Expresses the sense of Congress that the assistance provided under this Act to revitalize institutions of higher education (IHE) affected by Hurricane Katrina or Hurricane Rita is a first step toward revitalizing and restoring the economic, social, and cultural prosperity of the entire Gulf Coast region. Directs the Secretary (of Education) to award grants to IHEs adversely affected by a Gulf hurricane disaster to assist the affected institutions in recruiting and retaining students and retaining faculty. Directs the Secretary to assume or cancel repayment obligations for qualified loan amounts under specified student loan programs under the Higher Education Act of 1965 for certain borrowers who return to or enroll in such affected IHEs in academic years 2005–2006, 2006–2007, or 2007–2008, and obtain associate’s or bachelor’s degrees from such IHEs. Designates such provisions for institutional grants and student loan forgiveness under this Act as emergency requirements pursuant to specified budget provisions of H. Con. Res. 95 of the 109th Congress.

ALS Registry Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) develop a system to collect data on amyotrophic lateral sclerosis (ALS); and (2) establish a national registry for the collection and storage of ALS data. Requires the Secretary, acting through the Director, to establish the Advisory Committee on the National ALS Registry to study and make recommendations to the Secretary concerning: (1) the development and maintenance of the registry; (2) the type of information to be included; (3) the manner in which data is to be collected; (4) the use and availability of such data; and (5) the collection of information about diseases and disorders that primarily affect motor neurons that are considered essential to furthering the study and cure of ALS. Allows the Secretary, acting through the Director, to award grants to, and enter into contracts and cooperative agreements with, public or private nonprofit entities for the collection, analysis, and reporting of data on ALS. Requires the Secretary, acting through the Director, to: (1) identify, build upon, expand, and coordinate among existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure wherever possible; and (2) provide for public access to an electronic national database that accepts data from state registries, health care professionals, and others as recommended by the Advisory Committee in a manner that protects personal privacy. Requires the Secretary to ensure that epidemiological and other types of information is made available to the National Institutes of Health (NIH) and the Department of Veterans Affairs.

Mercury in Dental Fillings Disclosure and Prohibition Act - Amends the Federal Food, Drug, and Cosmetic Act to deem adulterated (hence prohibited), effective January 1, 2009, any amalgam containing mercury intended for use in a dental filling. Provides for a transition period, during which such a device may be manufactured and sold if it bears a specified warning label, until this Act becomes effective.

Interrogation Procedures Act of 2005 - Prohibits any individual in the custody or control of the U.S. government, regardless of nationality or physical location, from being subject to cruel, inhuman, or degrading treatment or punishment. Prohibits any person in the custody or control of the Department of Defense (DOD), or under detention in a DOD facility, from being subject to any treatment or technique of interrogation not authorized by and listed in the U.S. Army Field Manual on Intelligence Interrogation.

Makes a member of the Armed Forces who is performing duty in response to a disaster or emergency declaration after August 28, 2005, in an area affected by Hurricane Katrina or Rita eligible for hospital care, medical services, and nursing home care for any disability, notwithstanding insufficient medical evidence to conclude that the disability is attributable to such duty. Prohibits such care or services with respect to a disability found to have resulted from a cause other than such duty. Terminates eligibility two years after the member's discharge or release from such duty. Directs the Secretaries of Defense and Veterans Affairs to enter into an agreement with the National Academy of Sciences to review and make recommendations for the health surveillance of members who may be exposed to environmental hazards as the result of duty in areas affected by Hurricanes Katrina and Rita in 2005. Requires the Secretary of Veterans Affairs to maintain a database of members provided health care by the Department of Veterans Affairs pursuant to such duty.

Amends the Public Health Service Act to deem certain physicians or other licensed or certified health care practitioners to be employees of the Public Health Service for purposes of any civil action that may arise due to services provided in an emergency area by a contractor or an employee of a qualified health center. Provides that such services must be provided under an arrangement with a qualified health center or with a federal agency with responsibility for providing health services in the emergency area.

Expresses the sense of the House of Representatives that: (1) Hurricane Katrina and other such disasters should not be used to weaken, waive, or roll back federal public health, environmental, and environmental justice laws and regulations; (2) state, local, and regional authorities must retain their authority for compliance and permitting of industrial and other facilities and their role in monitoring and cleanup; (3) testing, monitoring, cleanup, and recovery in areas of national emergency should be completed in a manner designed to protect public health and the environment, ensure habitability, and mitigate against the effects of future storms and in compliance with Executive Order 12898 (requires federal actions to address environmental justice in minority and low-income populations); and (4) the federal rebuilding of the Gulf Region communities and economy should be a model of an integrated, diverse, and sustainable society.

Downed Animal Protection Act - States that it is U.S. policy that all nonambulatory livestock in interstate and foreign commerce be immediately and humanely euthanized when such livestock become nonambulatory. Amends the Humane Methods of Slaughter Act of 1958 to direct the Secretary of Agriculture to promulgate regulations providing for the humane treatment, handling, and disposition of nonambulatory livestock by a covered entity, including a requirement that nonambulatory livestock be humanely euthanized. Requires an entity to: (1) humanely euthanize nonambulatory livestock (while not limiting the Secretary's ability to test nonambulatory livestock for disease, such as bovine spongiform encephalopathy); and (2) not move nonambulatory livestock while such livestock is conscious, and ensure that such livestock remains unconscious until death. Prohibits an inspector at an establishment covered by the Federal Meat Inspection Act to pass nonambulatory livestock, carcass, or carcass parts through inspection. Requires an inspector or other employee at such establishment to label such material as "inspected and condemned." Defines "covered entity," "nonambulatory livestock," and "humanely euthanize."

Federal Response to Energy Emergencies Act of 2005 - Declares unlawful: (1) unconscionable pricing of gasoline, oil, natural gas, and petroleum distillates during emergencies; (2) intentional reporting of false price information concerning wholesale prices of such products; and (3) market manipulation regarding the purchase or sale at wholesale of such products. Authorizes the President to declare a federal energy emergency upon finding that the national health, safety, welfare, or economic well-being is at risk because of an actual or imminent shortage of such products due to a disruption of the national distribution system, or significant pricing anomalies in national or regional energy markets for the products. Empowers the Federal Trade Commission (FTC) and State Attorneys General to enforce this Act. Sets forth civil and criminal penalties for violations of this Act. Requires fines and penalties collected under this Act to be deposited in a separate fund in the treasury to be known as the Consumer Relief Trust Fund to provide assistance under the Low Income Home Energy Assistance Program. Directs the FTC to facilitate price transparency in wholesale markets for the sale of crude oil and essential petroleum products. Instructs the FTC to transmit a confidential report to Congress on the potential impact on domestic prices of crude oil, residual fuel oil, and refined petroleum products that would result from the disruption for periods of one week, one year, and five years, respectively. Directs the Secretary of Energy and the Energy Information Administration to review and report to Congress on expenditures and activities undertaken by certain size companies to protect the energy supply system from terrorist attacks, international supply disruptions, and natural disasters, and ensure a stable and reasonably priced supply of such products to consumers in the United States. Requires such report to assess the companies' preparations for the forecasted period of more frequent and more intense hurricane activity in the Gulf of Mexico and other vulnerable coastal areas.

Millennium Challenge Environmental Accountability Act - Amends the Millennium Challenge Act of 2003 (the Act) to apply the environmental procedures applicable to programs, projects, and activities of the United States Agency for International Development (USAID) to the provision of economic growth and poverty reduction assistance authorized under the Act. Requires each Millennium Challenge Compact (a compact required to be entered into by each participating country) to include a plan to promote environmental sustainability, including prevention, minimization, mitigation, or compensation for the potential adverse impact on natural resources in the implementation of programs and activities funded under the Compact. Provides for the input of non-governmental organizations concerning Compact creation. Requires the inclusion, in an annual report under the Act, of information on progress made toward implementing the country's plan for environmental sustainability. Directs that each report be published in the Federal Register and made available on the Internet.

Expresses the sense of the House of Representatives that the U.S. government and the governments of other industrial countries should: (1) examine ways to accelerate the elimination or phase-out of agricultural subsidies; (2) work with their African counterparts to remove non-tariff barriers to African agricultural imports; and (3) work with the governments of least developed African countries to minimize the economic impact of an opening of African markets to foreign goods.

Requests the President to transmit to the House of Representatives information in his possession regarding federal contracts for services or construction related to Hurricane Katrina recovery or rebuilding and compliance with standards for wages and benefits to be paid to workers pursuant to the Davis-Bacon Act, the Service Contract Act of 1965, or the Fair Labor Standards Act of 1938. Includes in such request: (1) copies of relevant portions of such contracts awarded or requested by the Federal Emergency Management Agency (FEMA) or by the Departments of Labor, of Education, of Homeland Security, of Health and Human Services, or of Defense, or the Army Corps of Engineers; and (2) communications made or received by such agencies related to compliance with such Acts in the geographic areas specified in the President's Proclamation 7924 of September 8, 2005.

Pets Evacuation and Transportation Standards Act of 2005 - Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to require the Director of the Federal Emergency Management Agency (FEMA) to ensure that state and local emergency preparedness operational plans address the needs of individuals with household pets and service animals following a major disaster or emergency.

Amends the Congressional Award Act to extend through calendar 2009 the requirement that the Comptroller General determine, and report to Congress on, whether the Director of the Congressional Award Board is complying with requirements for financial operations of the Congressional Award Program. Extends the authorization of the Board from October 1, 2004, to October 1, 2009. Provides for, during the period of October 1, 2004, through this Act's enactment date, all actions and functions of the Board under the Congressional Award Act to have same effect as though no lapse or termination of the Board ever occurred.

States' Right To Innovate in Health Care Act of 2005 - Amends the Social Security Act to add a new title XXII (State Comprehensive Health Care and Cost Containment Demonstration Projects) to allow up to ten states to receive from the Secretary of Health and Human Services planning and demonstration grants to develop a cost-effective delivery system of universal, comprehensive health care with simplified administration.

Medicare Informed Choice Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to: (1) provide for an extended period of open enrollment during all of 2006 without late enrollment penalty; (2) give Medicare beneficiaries the opportunity to make a one-time change in prescription drug plan enrollment at any point in 2006; and (3) provide protection from loss of employment-based retiree health coverage upon enrollment for Medicare prescription drug benefit, including a Medicare Advantage-Prescription Drug benefit, during 2006.

Access to Emergency Medical Services Act of 2005 - Amends the Public Health Service Act to deem hospitals, emergency rooms, physicians, and physicians groups that provide emergency care to uninsured individuals to be employees of the Public Health Service for purposes of any civil action that may arise due to items and services furnished. Requires the Attorney General to make separate estimates as to the cost of claims expected to arise under this Act and to establish separate funds for such claims. Requires the Secretary of Health and Human Services to limit the total amount of payments under this Act to the amounts appropriated in advance for such purposes. Amends title XVIII (Medicare) of the Social Security Act to provide additional payments from the Federal Supplementary Insurance Trust Fund for physicians' services in the emergency department of a hospital or critical access hospital to a Medicare recipient. Provides for incentive payments to hospitals that certify to the Secretary that they meet established standards for prompt admission by a hospital of individuals presenting to the emergency department that need inpatient hospital services. Requires the Comptroller General to submit to the relevant congressional committees a report that evaluates whether such standards will achieve the stated objectives and recommends any changes. Sets forth civil monetary penalties for filing a false certification and engaging in a pattern or practice of failing to meet established standards.

Calls upon the President, the Secretary of State, the Administrator of the United States Agency for International Development (USAID), and the heads of other U.S. agencies to support the government of El Salvador and private sector, nongovernmental, and religious organizations in their efforts to reduce poverty and to promote educational opportunity, health care, and social equity for the people of El Salvador.

Credit Card Minimum Payment Warning Act of 2005 - Amends the Truth in Lending Act to include among the mandatory disclosures at each billing cycle of open end consumer credit plans: (1) the words "Minimum Payment Warning: Making only the minimum payment will increase the amount of interest that you pay and the time it will take to repay your outstanding balance;" (2) the number of years and months it would take the consumer to pay the entire amount of the balance if the consumer pays only the required minimum monthly payments; (3) the total cost to the consumer, as well as a breakdown in principal and interest payments, of paying that balance in full if the consumer pays only the required minimum monthly payments, and if no further advances are made; (4) the monthly payment amount that would be required to eliminate the outstanding balance in 36 months if no further advances are made; and (5) a toll-free telephone number for information about accessing credit counseling and debt management services. Directs the Board of Governors of the Federal Reserve System and the Federal Trade Commission to issue jointly guidelines for creditors to establish and maintain a toll-free telephone number for such disclosures.

Microbicide Development Act - Amends the Public Health Service Act to require the Director of the Office of AIDS Research to: (1) expedite the implementation of the Federal strategic plan for the conduct and support of microbicide research; and (2) expand, intensify, and coordinate all activities with respect to research and development of microbicides to prevent the transmission of HIV and other sexually transmitted diseases. Requires the Director of the National Institute of Allergy and Infectious Diseases to: (1) establish within the Division of AIDS an organizational unit to carry out microbicide research and development; and (2) assign priority to ensuring adequate funding and support for the integration of basic science and clinical research. Requires the Director of the Centers for Disease Control and Prevention (CDC) to fully implement the CDC's topical microbicide agenda to support microbicide research and development. Directs the head of the Office of HIV/AIDS of the U.S. Agency for International Development (USAID) to develop and implement a program to support the development of microbicides products and facilitate wide-scale availability of such products.

Expresses support for the August 2005 memorandum of understanding signed by the government of the Republic of Indonesia and the Free Aceh Movement to end the conflict in Aceh, and congratulates both parties for their willingness to compromise. Encourages the Secretary of State and the Administrator of the United States Agency for International Development (USAID) to commit resources in guaranteeing the peace and building a strong civil society in Aceh.

Honors the life and work of Simon Wiesenthal to memorialize the victims of the Holocaust and bring the perpetrators of crimes against humanity to justice. Reaffirms Congress's commitment to fighting anti-Semitism and intolerance. Urges the international community to facilitate the investigation and prosecution of surviving Nazi war criminals and to continue documenting and collecting information on Nazi war crimes.

Expresses the sense of the Congress that: (1) a requirement that U.S. citizens obtain photo identification cards before being able to vote has not been shown to ensure ballot integrity and places an undue burden on the legitimate voting rights of citizens; (2) the Department of Justice should vigorously enforce the Voting Rights Act of 1965 and challenge any state law that limits a citizen's ability to vote based on discriminatory photo identification requirements; and (3) any effort to impose national photo identification requirements for voting should be rejected.

Hurricane Katrina Surviving Spouse Student Loan Relief Act - Directs the Secretary of Education to discharge or cancel the federal student loan indebtedness of spouses and parents of victims of Hurricane Katrina, with respect to any principal and accrued unpaid interest outstanding on student loans on behalf of such victims on the date of the injury causing their death or permanent and total disability.
