Restoring Artistic Protection Act of 2022 This bill limits the admissibility of evidence of a defendant's creative or artistic expression against the defendant in a federal criminal case. The term creative or artistic expression means the expression or application of creativity or imagination in the production or arrangement of forms, sounds, words, movements, or symbols, including music, dance, performance art, visual art, poetry, literature, film, and other such objects or media.

Shirley Chisholm Congressional Gold Medal Act This bill provides for the posthumous presentation of a Congressional Gold Medal in commemoration of Shirley Chisholm, in recognition of her activism, independence, and groundbreaking achievements in politics, election as the first African American woman in Congress, and campaign to be the first African American to gain the nomination of a major political party for President of the United States. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be available for display and research.

Strengthening Welfare in Marine Settings Act of 2022 or the SWIMS Act of 2022 This bill establishes prohibitions on capturing, importing, exporting, or breeding of orcas, beluga whales, false killer whales, or pilot whales for the purpose of public display. Specifically, the bill prohibits the National Oceanic and Atmospheric Administration from issuing any permit under the Marine Mammal Protection Act of 1972 that authorizes the taking (e.g., capturing) or importation of such orcas or whales for the purpose of public display. The bill further revises the act to make it unlawful to export such orcas or whales, unless they are being transported to marine mammal sanctuaries or for release into the wild. Further, the bill makes it unlawful under the Animal Welfare Act for any person to breed or artificially inseminate such marine mammals for purposes of using their progeny for public display.

Renewing Immigration Provisions of the Immigration Act of 1929 This bill expands eligibility for a program that authorizes the Department of Homeland Security to, at its discretion, provide lawful permanent resident status to certain long-term residents of the United States, including individuals who are unlawfully present. Currently, this program, sometimes referred to as the Registry program, is only available to eligible non-U.S. nationals ( aliens under federal law) who entered the United States before January 1, 1972. The bill removes this entry cutoff date and opens up the program to eligible individuals who have resided in the United States for at least seven years. Existing requirements (e.g., the individual must not be inadmissible or deportable due to certain grounds related to crime or terrorism) continue to apply.

Reproductive Health Travel Fund Act of 2022 This bill authorizes the Department of Health and Human Services to award grants to pay for travel, childcare, and other expenses of an individual seeking access to abortion services. Eligible grant recipients must be nonprofit or community-based organizations that assist individuals seeking abortion services through programs that are unbiased and medically and factually accurate. The grants may not be used to pay for abortion procedures.

No Tax Breaks for Union Busting (NTBUB) Act This bill denies employers a tax deduction for any expenditures incurred for attempting to influence their employees with respect to labor organizations or labor organization activities, such as elections, labor disputes, and collective actions. The bill requires employers to report on their attempts to influence their employees with respect to labor organizations and their activities.

Respect for Marriage Act This bill provides statutory authority for same-sex and interracial marriages. Specifically, the bill replaces provisions that define, for purposes of federal law, marriage as between a man and a woman and spouse as a person of the opposite sex with provisions that recognize any marriage that is valid under state law. (The Supreme Court held that the current provisions were unconstitutional in United States v. Windsor in 2013.) The bill also replaces provisions that do not require states to recognize same-sex marriages from other states with provisions that prohibit the denial of full faith and credit or any right or claim relating to out-of-state marriages on the basis of sex, race, ethnicity, or national origin. (The Supreme Court held that state laws barring same-sex marriages were unconstitutional in Obergefell v. Hodges in 2015; the Court held that state laws barring interracial marriages were unconstitutional in Loving v. Virginia in 1967.) The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations.

Puerto Rico Status Act This bill provides for a plebiscite to be held on November 5, 2023, to resolve Puerto Rico's political status. Specifically, such plebiscite shall offer eligible voters a choice of independence, sovereignty in free association with the United States, or statehood. The Puerto Rico State Elections Commission shall carry out a nonpartisan voter education campaign through traditional paid media and make available at all voting locations voter education materials related to the plebiscites. All voter educational materials and ballots used to carry out this bill shall be made available in English and Spanish. The bill sets forth transition and implementation provisions for each choice offered in the plebiscite.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances access to contraception and cannot be achieved through less restrictive means. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Clean Shipping Act of 2022 This bill directs the Environmental Protection Agency (EPA) to require vessels on certain commercial voyages to comply with standards for the carbon intensity of the vessel's fuel on a specified schedule, with vessels on such voyages utilizing 100% less than the carbon intensity baseline by 2040 and beyond. Additionally, the EPA must promulgate and continually revise standards to eliminate emissions of specified greenhouse gases and air pollutants associated with vessels at anchorage or at berth in the contiguous zone of the United States.

Ensuring Access to Abortion Act of 2022 This bill prohibits anyone acting under state law from interfering with a person's ability to access out-of-state abortion services. ( Abortion services includes the use of any drugs that are approved to terminate pregnancies and any health care services related to an abortion, whether or not provided at the same time or on the same day.) Specifically, the bill prohibits any person acting under state law from preventing, restricting, impeding, or retaliating against health care providers who provide legal abortion services to out-of-state residents, any person or entity who helps health care providers to provide such services, any person who travels to another state to obtain such services, any person or entity who helps another person travel to another state to obtain such services, or the movement in interstate commerce of drugs that are approved to terminate pregnancies. The Department of Justice may enforce this bill through civil actions; the bill also establishes a private right of action for violations.

Jackson Women's Health Organization (that there is no constitutional right to abortion) and expresses a commitment to instituting judicial reform and supporting access to abortion and the communities affected by the Court's ruling. It also urges the executive branch to advance reproductive justice.

Faster Payments to Veterans' Survivors Act of 2022 This bill modifies policies and procedures related to the payment of benefits under certain life insurance programs administered by the Department of Veterans Affairs (VA). If a primary beneficiary has not made a claim for payment within one year (currently two years) after the death of the insured under the National Service Life Insurance (NSLI) program or the United States Government Life Insurance (USGLI) program, the VA is authorized to make payment to another designated beneficiary as if the primary beneficiary had predeceased the insured. If no designated beneficiary makes a claim within two years (currently four years) after the death of the insured, the VA is authorized to make a payment to a person the VA deems to be equitably entitled to such benefit. The bill also modifies the beneficiary designation process under NSLI and USGLI. Specifically, if a person does not designate a beneficiary for insurance, or if the designated beneficiary predeceases the insured person, the VA must determine the beneficiary in a specified order of succession. Additionally, the bill requires the VA to improve its processes and procedures with respect to identifying, locating, and paying hard-to-find beneficiaries of life insurance policies, including by improving its website search tools.

Aaron Salter, Jr., Responsible Body Armor Possession Act This bill establishes a federal statutory framework to restrict the purchase, ownership, or possession of enhanced body armor by civilians. The term enhanced body armor means body armor, including a helmet or shield, with a ballistic resistance that meets or exceeds the ballistic performance standard of Type III armor, as determined using the National Institute of Justice standard in effect at the time the person purchases, owns, or possesses the armor.

My Body, My Data Act of 2022 This bill establishes protections, subject to certain limits, for personal reproductive or sexual health information. This includes information relating to past, present, or future surgeries or procedures, such as the termination of a pregnancy. Specifically, commercial entities, including individuals, nonprofits, and common carriers, may not collect, retain, use, or disclose personal reproductive or sexual health information except (1) with the express written consent of the individual to whom such information relates, or (2) as is strictly necessary to provide a requested product or service. Commercial entities also must provide individuals with access to, and a reasonable mechanism to delete, any of their reproductive or sexual health information upon request. Further, commercial entities must maintain and publish a privacy policy describing their practices with respect to such information. The bill's provisions do not apply to entities that are subject to certain existing health-related privacy regulations, such as the privacy regulations issued under the Health Insurance Portability and Accountability Act of 1996. Additionally, the provisions do not apply to the disclosure of personal reproductive or sexual health information for the publication of newsworthy information of legitimate public concern. The bill provides for enforcement by the Federal Trade Commission and by private civil actions.

Good Jobs for Good Airports Act This bill addresses pay, benefits, and labor standards for certain airport service workers. Airport service workers include security officers, food service workers, cleaning staff, ticketing agents, and retail service workers. Specifically, the bill establishes a minimum wage and benefit standard for such airport service workers at large, medium, and small hub airports. It also prohibits small, medium, and large hub airports from accessing federal funds for airport development projects unless the airports certify that such airport service workers are paid no less than the higher of $15 per hour, the applicable state or local minimum wage and fringe benefits, or the prevailing wage and fringe benefits required under the Service Contract Act as established by the Department of Labor.

Prioritizing Clean Energy and Climate Cooperation with India Act of 2022 This bill establishes the U.S.-India Climate and Clean Energy Agenda 2030 Partnership and addresses related issues. The partnership shall serve as the primary forum and funding mechanism for U.S.-India cooperation on clean energy technology matters. The Department of State must report to Congress a comprehensive multiyear strategy for implementing the partnership. The bill requires programs to promote U.S.-India partnerships in (1) research and innovation for clean energy technologies, (2) initiatives for providing technical assistance for grid improvement and energy efficiency in India, and (3) initiatives to develop new renewable energy generation capacity in India. The U.S. Agency for International Development must work cooperatively with India's government on integrating scientifically supported climate change risk reduction and building resilience capacities in India. The State Department must report to Congress on the prospects for cooperation between U.S. states and states in India on clean energy issues.

Social Security Expansion Act This bill increases benefits and certain taxes related to the Social Security program. Changes to benefits include (1) increasing the primary insurance amount for certain beneficiaries; (2) revising the method of calculating cost-of-living adjustments; (3) establishing a new minimum benefit for certain low earners; and (4) allowing certain children of retired, deceased, or disabled workers to receive benefits until age 22 if they are a full-time student. Changes to taxes include (1) increasing the net investment income tax and making active trade or business income subject to this tax; and (2) extending payroll taxes on wages, salaries, and self-employment earnings to income above $250,000 (the maximum amount subject to the Social Security payroll tax is currently $147,000 for 2022). The bill also combines the existing Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund into a single Social Security Trust Fund.

Sustaining Our Democracy Act This bill establishes and provides funds through FY2032 for the State Election Assistance and Innovation Trust Fund for purposes of promoting election activities. Specifically, the bill establishes the Democracy Advancement and Innovation Program, through which the Office of Democracy Advancement and Innovation (also established by this bill) shall make allocations to states for carrying out democracy promotion activities. These activities include improving the administration of federal elections, recruiting and training nonpartisan election officials and poll workers, and increasing voting access. The bill requires each state, in order to receive allocated funds, to (1) submit a plan for approval that describes how the state will distribute resources and carry out democracy promotion activities, and (2) establish uniform and nondiscriminatory state-based administrative complaint procedures. The bill prohibits states from using funds for certain activities, including any activity that diminishes the ability of any eligible voter to participate in the electoral process.

This bill establishes reporting and other requirements related to disaster preparedness and response and hazard mitigation. The Governmental Accountability Office (GAO) must conduct a study and report on disaster spending and strategies for reducing the need for such spending. Specifically, the GAO must identify for the 5-year period ending on the date of this bill's enactment, the total amount of federal, state, and tribal funds spent in response to major disasters and emergencies; 10 proposed federal actions, including reinsurance, that, if implemented, would most effectively reduce the need for spending related to such major disasters or emergencies; the effect that using blockchain may have on delivering disaster assistance to state and Indian tribal governments; and whether insurance protection against wildfires will remain available and affordable to homeowners. The President must coordinate with each state to update state plans to incorporate strategies that decrease the time required to prepare for disasters, including the time to evacuate individuals. An entity that receives grants for hazard mitigation revolving loan funds must ensure that at least 10% of the total dollar amount of the loans it makes each fiscal year assist projects or activities that reduce risks for residential structures related to specified natural hazards.

Protecting Our Kids Act This bill makes various changes to federal firearms laws, including to establish new criminal offenses and to expand the types of weapons and devices that are subject to regulation. Among the changes, the bill generally prohibits the sale or transfer of certain semiautomatic firearms to individuals who are under 21 years of age; establishes new federal criminal offenses for gun trafficking and related conduct; establishes a federal statutory framework to regulate ghost guns (i.e., guns without serial numbers); establishes a framework to regulate the storage of firearms on residential premises at the federal, state, and tribal levels; subjects bump stocks to regulation under federal firearms laws; and generally prohibits the import, sale, manufacture, transfer, and possession of large capacity ammunition feeding devices.

This joint resolution directs the President to remove U.S. Armed Forces from hostilities against the Houthis in Yemen within 30 days of the enactment of this joint resolution unless Congress authorizes a later withdrawal date, issues a declaration of war, or specifically authorizes the use of the Armed Forces. Prohibited activities include sharing intelligence or providing logistical support to enable offensive strikes by the coalition led by Saudi Arabia. This joint resolution shall not affect any military operations directed at Al Qaeda or associated forces.

Affordability is Access Act This bill establishes several requirements relating to health insurance coverage of, and access to, over-the-counter contraceptives. Specifically, the bill requires the Department of Health and Human Services, the Department of Labor, and the Department of the Treasury to specify that private health insurance plans must cover over-the-counter contraceptives that are approved by the Food and Drug Administration (FDA), even without a prescription. Under current law, private health insurance plans (with some exceptions) must cover FDA-approved prescription contraceptives, without cost-sharing requirements. The bill also prohibits retailers from interfering with an individual's access to oral contraceptives that are meant for routine, daily use and are FDA-approved for use without a prescription.

Freight Rail Assistance and Investment to Launch Coronavirus-Era Activity and Recovery Act of 2022 or the Freight RAILCAR Act of 2022 This bill provides a new tax credit through 2024 for 10% of freight railcar fleet modernization expenses (i.e., railcar replacement and modernization expenses for meeting fuel efficiency and performance standards). The bill provides that no more than 2,000 freight railcars per taxpayer may be taken into account for purposes of determining the credit in a taxable year. The Department of the Treasury must report to Congress on the credit to provide information on the number of times the credit was claimed and the number of railcars scrapped or built as a result of the credit.

This resolution expresses that the House of Representatives is deeply concerned for the latest years-long drought in the Horn of Africa and the ensuing food security crisis and severe socioeconomic disturbances it caused; acknowledges the role that climate change plays in increasing the frequency of extreme weather events like droughts, and pledges to take coordinated, international action to adapt to and avert further global warming; reaffirms the effectiveness and instrumentality of U.S. international food assistance for meeting humanitarian obligations, cultivating enduring self-reliance in developing nations, ensuring the stability of global financial markets, and mitigating the likelihood of conflict in accordance with our national security interests; and emphasizes the importance of funding urgently needed humanitarian assistance for hunger-stricken regions of the world, supporting the development of sustainable agricultural sectors in developing nations, and assisting with the international resettlement of refugees escaping droughts and extreme hunger.

Helicopter Safety and Noise Management Act This bill establishes a commission comprised of the Federal Aviation Administration, members of local and state government, and helicopter noise and safety advocates to develop a helicopter usage management plan to substantially reduce the number of nonessential civil rotorcraft (i.e., a helicopter) that can operate in certain airspace at any given time. The plan shall not apply any limitation or requirement to the operation of a civil rotorcraft for purposes of public health and safety, including (1) law enforcement, (2) emergency response, (3) disaster response, (4) medical services, (5) scientific research, and (6) official purposes by a news organization.

Displaced Afghan Women and Girls Education Act of 2022 This bill provides certain educational resources to certain displaced Afghan women and girls domiciled in the United States. For example, the bill (1) requires such displaced Afghan women and girls to receive in-state tuition rates at public institutions of higher education, and (2) provides funding for and establishes the Displaced Afghan Women and Girls Scholarship Grant.

Federal Emergency Management Advancement of Equity Act or the FEMA Equity Act This bill addresses equity in federal disaster assistance policies and programs. The Federal Emergency Management Agency (FEMA) must develop and implement a process to ensure equity in the provision of federal assistance and throughout all FEMA programs and policies. Additionally, FEMA must establish metrics to measure the efficacy of the process and seek input from relevant representatives of state, regional, local, and tribal governments; community-based organizations; subject matter experts; and individuals from underserved communities impacted by disasters. FEMA must designate a senior official as an equity advisor. The bill establishes in FEMA an Equity Enterprise Steering Group. The chief executive officer of an affected county may submit a request for a presidential declaration that a major disaster exists if (1) the governor of the state or territory in which the county is located does not request such a declaration, (2) the affected county is not included in a request for assistance made by such governor, or (3) the affected county communicates with that governor about the disaster or potential request for a major disaster declaration before the relevant period has lapsed. The Government Accountability Office shall issue a report describing the factors that FEMA considers when evaluating a request from a governor to declare that a major disaster or emergency exists and to authorize specified assistance.

Pride in Mental Health Act This bill expands programs that prevent and treat child abuse and neglect to address issues facing youth who are lesbian, gay, bisexual, transgender, queer or questioning, nonbinary, or gender-variant members of indigenous communities (e.g., Two Spirit). Specifically, these programs include (1) research and reporting requirements, (2) providing technical assistance, (3) grants to states and local agencies to train child-welfare personnel, and (4) community-based prevention-service grants. The bill also establishes a grant program to provide mental and behavioral health resources for such youth, including trauma-informed care.

Health Equity and Accountability Act of 2022 This bill directs the Department of Health and Human Services (HHS) and others to undertake efforts to reduce health disparities. For example, the bill (1) requires more detailed reporting of demographic and health disparities data, including related to public health emergencies; (2) directs certain components of HHS to support health workforce diversity; and (3) increases access to culturally and linguistically appropriate health care. The bill also modifies eligibility and other requirements for Medicare, Medicaid, private health insurance, nutrition assistance, and other programs to reduce health disparities among vulnerable populations. The bill includes specific provisions with respect to noncitizens; maternal, infant, and child health; mental and behavioral health; specified conditions that disproportionately affect racial and ethnic minority groups, such as certain cancers, HIV/AIDS, kidney disease, and diabetes; investments in communities facing health and other inequities; and nondiscrimination in the provision of services in federally supported health programs. Additionally, the bill (1) revises health information technology programs to address health disparities, and (2) supports health impact assessments and other efforts pertaining to environmental justice and social determinants of health (i.e., nonmedical factors that influence health outcomes, such as income and educational attainment). The bill also requires various studies and reports on issues related to health care and health disparities, including a report by the Government Accountability Office on health workforce diversity.

Get the Lead Out of Assisted Housing Act of 2022 This bill addresses the removal of lead from drinking water in federally assisted housing. Specifically, the bill requires the Department of Housing and Urban Development (HUD) to require specified testing and remediation with respect to water service lines containing lead; authorizes HUD to inspect all sources of lead contamination in federally assisted housing and to mitigate sources of lead exposure; establishes a grant program for states and local governments to create inventories of water service lines containing lead and to test for lead in the drinking water at child care facilities, schools, and public water fountains; and allows recipients of certain HUD assistance to use such assistance to replace water fixtures and service lines containing lead.
