Vanessa Guillén Military Justice Improvement and Increasing Prevention Act This bill modifies the process and policy related to the disposition of charges and convening of courts-martial for certain sexual assault cases and other specified offenses under the Uniform Code of Military Justice (UCMJ). Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.

Chronic Kidney Disease Improvement in Research and Treatment Act of 2021 This bill modifies provisions relating to Medicare coverage of treatments for chronic kidney disease. Specifically, the bill expands the Medicare annual wellness visit to include chronic kidney disease screening and allows certain Medicare beneficiaries who have End Stage Renal Disease (ESRD) to enroll in Medicare supplemental policies. It also (1) provides for alternative payment methodologies for certain new drugs, biologics, and devices that are renal dialysis services; (2) revises quality measures; (3) establishes an incentive payment methodology; and (4) increases access to kidney disease education services. The bill also extends the coordination period (from 30 months to 42 months) during which private health insurers may serve as the primary payers for Medicare beneficiaries with ESRD.

Mental Health in International Development and Humanitarian Settings Act or the MINDS Act This bill directs the U.S. Agency for International Development (USAID) and the Department of State to integrate mental health and psychosocial support activities across all U.S. foreign assistance programs, with a particular focus on children and other vulnerable populations. To facilitate this integration, the bill makes organizational changes at the USAID. It authorizes the USAID to appoint a coordinator to oversee and direct mental health and psychosocial support activities. The coordinator must ensure that these activities focus on children, adult caretakers and families, displaced populations, and other vulnerable groups. In addition, the bill establishes a working group comprised of representatives from every USAID bureau and the Department of State to coordinate interagency efforts related to, promote best practices for, and ensure sustainability and continuity of mental health and psychosocial support activities. The USAID and the State Department must brief Congress about the amount of foreign assistance spending on mental health and psychosocial support activities and related matters.

Pell Grant Preservation and Expansion Act of 2021 This bill makes various changes to the Federal Pell Grant program, including by expanding student eligibility for Pell Grants. The bill also revises student eligibility for federal student-aid programs. Specifically, the bill provides funding to increase the maximum Pell Grant award for each eligible student. Further, the bill requires the award amount to be adjusted for inflation. Next, the bill allows students who receive means-tested federal benefits (e.g., Medicaid) to automatically qualify for the maximum Pell Grant award plus an additional award amount. In addition, the bill moves the Iraq and Afghanistan Service Grant program into the Pell Grant program. Next, the bill raises from 12 to 18 the total number of semesters during which a student may receive a Pell Grant. The bill makes Dreamer students (i.e., students who have been granted Deferred Action for Childhood Arrivals status) who entered the United States before the age of 18 and who meet certain educational criteria eligible for federal financial aid. The bill also revises satisfactory academic progress requirements for federal student-aid programs, including by allowing a student who has not been enrolled in an institution of higher education for two years to regain eligibility for federal student aid.

American Innovation and Choice Online Act

American Choice and Innovation Online Act This bill prohibits certain large online platforms from engaging in specified acts, including giving preference to their own products on the platform, excluding or disadvantaging competing products from another business on the platform, or discriminating among similarly situated users. Further, a platform may not materially restrict or impede the capacity of a competing business user to access or interoperate with the same platform, operating system, or hardware or software features. The bill also restricts the platform's use of nonpublic data obtained from or generated on the platform and prohibits the platform from restricting access to platform data generated by the activity of a competing business user. The bill also provides additional restrictions related to installing or uninstalling software, search or ranking functionality, and retaliation for contact with law enforcement regarding actual or potential violations of law. The bill establishes affirmative defenses for the prohibited conduct. The Federal Trade Commission or the Department of Justice must designate whether an entity is a platform covered by the bill, and both must carry out enforcement activities. The bill also provides for civil penalties, injunctions, conflicts of interest, a private right of action, and the forfeit of profits for repeat offenders.

GLOBE Act of 2021

Greater Leadership Overseas for the Benefit of Equality Act of 2021 or the GLOBE Act of 2021 This bill contains provisions related to (1) the protection of LGBTQI individuals globally; and (2) immigration protections for vulnerable individuals. The bill establishes (1) an interagency group to respond to urgent threats to LGBTQI people in foreign countries, and (2) a permanent Special Envoy for the Human Rights of LGBTQI Peoples in the Department of State. The President shall impose visa-blocking sanctions on foreign persons responsible for violating the human rights of individuals based on sexual orientation, gender identity, or sex characteristics. The State Department shall establish the Global Equality Fund to provide assistance to nongovernmental organizations working to advance and protect human rights. The U.S. Agency for International Development shall establish the LGBTQI Global Development Partnership to work with the private sector and nongovernmental organizations to support LGBTQI rights. The bill removes prohibitions against providing foreign assistance to nongovernmental organizations that offer certain medical services (e.g., abortion-related services) using non-U.S. government funds. The bill contains several immigration-related provisions, such as those  establishing that persecution based on sexual orientation or gender identity may form the basis of an asylum request, allowing certain applicants to file asylum claims more than a year after their arrival in the United States, including a permanent partnership between two partners as a marriage for immigration law purposes, providing for free counsel in certain immigration proceedings, and granting U.S. citizenship to a child born abroad through assistive reproductive technology from a U.S. citizen who is the child's nonbiological parent.

Women’s Health Protection Act of 2021

Women's Health Protection Act of 2021 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Specifically, governments may not limit a provider's ability to prescribe certain drugs, offer abortion services via telemedicine, or immediately provide abortion services when the provider determines a delay risks the patient's health. Furthermore, governments may not require a provider to perform unnecessary medical procedures, provide medically inaccurate information, comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions, or carry out all services connected to an abortion. In addition, governments may not (1) require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining such services, or (2) prohibit abortion services before fetal viability or after fetal viability when a provider determines the pregnancy risks the patient's life or health. The bill also prohibits other governmental measures that are similar to the bill's specified restrictions or that otherwise single out and impede access to abortion services, unless a government demonstrates that the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. The bill applies to restrictions imposed both prior and subsequent to the bill's enactment.

Equity in Transit Service Planning Act

Equity in Transit Service Planning Act This bill requires the Department of Transportation (DOT) to issue best practices to assist providers of public transportation with defining major service changes for purposes of complying with federal civil rights laws. The bill also requires that, within three years of DOT issuing the best practices, the Transit Cooperative Research Program of the National Academy of Sciences must review how providers define major service changes. Under current law, public transportation providers must evaluate the impact of major service changes on minority and low-income populations. Typically, a major service change is presented as a numerical standard (e.g., a change that affects more than a given number of route miles or hours) with the standards set by the providers.

As part of the program, the bill requires, within 30 days, the development of a comprehensive strategy to end the COVID-19 pandemic. The strategy must outline efforts to increase COVID-19 vaccinations worldwide, including through the immediate release of the COVID-19 vaccine doses that the United States committed to sending abroad. The bill also requires a long-term strategy for the program to prevent future pandemics.

Among other provisions, the bill extends FY2021 enacted levels through FY2022 for federal-aid highway, transit, and safety programs; reauthorizes for FY2023-FY2026 several surface transportation programs, including the federal-aid highway program, transit programs, highway safety, motor carrier safety, and rail programs; addresses climate change, including strategies to reduce the climate change impacts of the surface transportation system and a vulnerability assessment to identify opportunities to enhance the resilience of the surface transportation system and ensure the efficient use of federal resources; revises Buy America procurement requirements for highways, mass transit, and rail; establishes a rebuild rural bridges program to improve the safety and state of good repair of bridges in rural communities; implements new safety requirements across all transportation modes; and directs DOT to establish a pilot program to demonstrate a national motor vehicle per-mile user fee to restore and maintain the long-term solvency of the Highway Trust Fund and achieve and maintain a state of good repair in the surface transportation system.

Eviction Prevention Act of 2021 This bill authorizes the Department of Justice to provide grants to state and local governments to make legal counsel available to eligible tenants undergoing eviction proceedings. An eligible tenant is an individual whose income is less than 125% of the federal poverty level. The bill also requires the Department of Housing and Urban Development to establish a national database of evictions. The Government Accountability Office must report on the national status of legal representation of tenants in eviction proceedings, including the effects of access to representation on case outcomes.

United States-Cuba Relations Normalization Act This bill repeals the trade embargo on Cuba and other provisions restricting trade and travel to Cuba. The bill also (1) removes restrictions on certain transactions related to trademarks used in connection with a confiscated business or asset, (2) extends nondiscriminatory trade treatment to Cuban products, and (3) prohibits and rescinds limits on remittances to Cuba. The President may, in relation to Cuba, impose new export controls and exercise powers related to declared national emergencies. The bill authorizes common carriers to provide telecommunications services between the United States and Cuba. Travel by U.S. citizens and residents to Cuba may not be regulated or prohibited if such travel would be lawful in the United States. The President shall take all necessary steps to engage with Cuba to (1) negotiate settlements relating to claims that Cuba had taken the property of U.S. nationals, and (2) secure the protection of internationally recognized human rights.

Menstrual Equity For All Act of 2021

Menstrual Equity For All Act of 2021 This bill expands access to free sanitary napkins and tampons (i.e., menstrual products) in certain locations and for particular groups. It also requires Medicaid to cover menstrual products, as well as liners, cups, and similar items used by individuals with respect to menstruation. Specifically, the bill imposes requirements to make free menstrual products available in federal and state correctional facilities (including facilities that house aliens detained by the Department of Homeland Security) and restrooms in federal buildings that are open to the public. It also establishes a demonstration grant program to support the provision of free menstrual products on campuses of institutions of higher education and permits elementary and secondary schools to use certain grants to provide menstrual products to students. Furthermore, the bill requires employers with at least 100 employees to provide free menstrual products for employees. It also permits the use of certain grants for emergency food and shelter to provide menstrual products to homeless individuals.

Marijuana Opportunity Reinvestment and Expungement Act of 2021 or the MORE Act of 2021 This bill decriminalizes marijuana. Specifically, it removes marijuana from the list of scheduled substances under the Controlled Substances Act and eliminates criminal penalties for an individual who manufactures, distributes, or possesses marijuana. The bill also makes other changes, including the following: replaces statutory references to marijuana and marihuana with cannabis , requires the Bureau of Labor Statistics to regularly publish demographic data on cannabis business owners and employees, establishes a trust fund to support various programs and services for individuals and businesses in communities impacted by the war on drugs, imposes an excise tax on cannabis products produced in or imported into the United States and an occupational tax on cannabis production facilities and export warehouses, makes Small Business Administration loans and services available to entities that are cannabis-related legitimate businesses or service providers, prohibits the denial of federal public benefits to a person on the basis of certain cannabis-related conduct or convictions, prohibits the denial of benefits and protections under immigration laws on the basis of a cannabis-related event (e.g., conduct or a conviction), establishes a process to expunge convictions and conduct sentencing review hearings related to federal cannabis offenses, and directs the Government Accountability Office to study the societal impact of cannabis legalization.

Reproductive Rights are Human Rights Act of 2021 This bill directs the Department of State to include in its annual reports on human rights in countries receiving U.S. development and security assistance a discussion of the status of reproductive rights in each country. This must include whether a country has adopted and enforced policies to (1) promote access to contraception and accurate, nondiscriminatory family planning and sexual health information; (2) provide services to ensure safe and healthy pregnancy and childbirth; (3) expand or restrict access to safe abortion services; and (4) prevent and treat sexually transmitted diseases. For each country, the reports shall also contain (1) data concerning pregnancy-related injuries and deaths; and (2) a description of the nature and extent of discrimination and violence against women, girls, and LGBTQI+ individuals in health care settings and the relevant government's response to such actions.

Keeping Our Promise Act This bill authorizes issuing visas to certain individuals who were previously refused a diversity immigrant visa or admission into the United States because of certain executive orders or the COVID-19 public health emergency. (Diversity immigrant visas are available to eligible immigrants from countries with relatively low rates of immigration to the United States.) Specifically, this bill applies to individuals who were refused such a visa solely due to certain executive orders from 2017 to 2020, including orders which suspended the entry of individuals from certain countries. The bill also applies to diversity visa applicants who, because of the COVID-19 emergency, were (1) unable to receive a visa interview despite requesting one, or (2) unable to be admitted into the United States despite being approved for a visa. The Department of State must notify each individual covered under this bill of the individual's visa eligibility. To retain eligibility, an individual must respond to the State Department's notice within one year of the notice. An individual may also lose eligibility if the State Department determines that the applicant fails to meet certain requirements. The bill also relaxes certain annual numerical limits for individuals obtaining a visa under this bill. An individual who was a child when initially selected for a visa shall be treated as a child for the purposes of a visa application under this bill.

Conrad State 30 and Physician Access Reauthorization Act

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program for three years from this bill's enactment. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.

The center must perform the following duties support the development of aviation and aerospace education curricula; support the professional development of educators using such curricula; promote aviation and aerospace employment opportunities; support Armed Forces personnel seeking to transition to a career in civil aviation or an aerospace-related field through outreach, training, apprenticeships, or other means; serve as a central repository for publicly available economic data, safety data, and research efforts related to the aviation and aerospace sectors; and serve as a forum, through symposiums, conferences, and other means as appropriate, for cross-disciplinary collaboration among aviation and aerospace stakeholders. Additionally, the center may issue grants to organizations that have experience in, and knowledge of, creating, developing, and delivering or updating (1) high school aviation curricula; or (2) aviation curricula used at institutions of higher education, secondary educations institutions, or by technical training and vocational schools.

The commission must (1) report recommendations for a plan of action for the establishment and maintenance of a National Museum of Asian Pacific American History and Culture in the District of Columbia; (2) develop a fundraising plan to support the establishment, operation, and maintenance of the museum through public contributions; (3) obtain an independent review of this fundraising plan, including an analysis of the resources necessary to fund the construction of the museum and its operations and maintenance in perpetuity without reliance on federal funds; and (4) submit a legislative plan of action to establish and construct the museum. Accelerating Access to Critical Therapies for ALS Act

Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to facilitate patients' access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration (FDA) shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Public-Private Partnership for Neurodegenerative Diseases between the National Institutes of Health, the FDA, and at least one eligible entity (generally, an institution of higher education or a nonprofit organization). The partnership shall support the development and regulatory review of drugs that address ALS and other rare neurodegenerative diseases. The FDA shall publish on its website a five-year action plan for fostering the development of drugs that improve or extend the lives of people living with rare neurodegenerative diseases.

John Lewis Every Child Deserves a Family Act This bill prohibits discrimination on the basis of sexual orientation, gender identity, marital status, or religion in the provision of child welfare programs and services by entities receiving federal funding. The Department of Health and Human Services (HHS) must provide technical assistance to help states follow this requirement, including (1) guidance for bringing state laws into compliance, (2) developing training to increase cultural competency related to social identity, and (3) training for judges and attorneys involved in child welfare cases, among other supports. Additionally, HHS must establish the National Resource Center on Safety, Well-Being, Placement Stability, and Permanency for LGBTQ Children and Youth Involved with Child Welfare Services to provide training, technical assistance, and guidance to applicable state and local agencies and service providers. Further, the Religious Freedom Restoration Act may not be the basis for challenging the application or enforcement of this bill. The Government Accountability Office must study and report on states' compliance with the requirements of the bill no later than three years after enactment.

Keeping All Students Safe Act

Keeping All Students Safe Act This bill prohibits the use of seclusion and limits the use of physical restraint in schools and Head Start programs that receive federal funding. Specifically, the bill prohibits the use of seclusion, which is the involuntary confinement of a student alone in a room or area from which the student is physically prevented from leaving. The term does not include a time out, which may involve separating the student from others in a non-locked setting. The bill prohibits the use of mechanical or chemical restraints or physical restraints that restrict breathing or are life threatening. The bill outlines the requirements for the use of physical restraint, including that the student's behavior must pose an imminent danger of serious physical injury to the student or other individual. Each state must ensure that a sufficient number of program personnel are trained and certified by a state-approved crisis intervention training program. Additionally, each program must establish procedures to follow after an incident involving physical restraint. Further, the bill establishes enforcement provisions, including a private right of action for a student who has been subjected to unlawful seclusion or restraint. The Department of Education and the Department of Health and Human Services must withhold payments from a program for unlawful seclusion or restraint. Finally, the bill requires each state educational agency (SEA) to establish, implement, and enforce policies and procedures required by the bill. It also creates a grant program to assist SEAs with these activities.

Dentist and Optometric Care Access Act of 2021 or the DOC Access Act of 20 21 This bill prohibits private health insurance plans from setting rates for items and services, except for dental cleanings, provided by a doctor of optometry, of dental surgery, or of dental medicine for which the plan does not pay a substantial amount. Additionally, an agreement between a plan and such a doctor for limited scope dental or vision benefits may last longer than two years only with the prior acceptance of the doctor for each term extension. Plans also may not restrict such a doctor's choice of laboratories or suppliers. Such doctors may elect to waive the application of the payment amount and choice of laboratories provisions of this bill. The bill establishes a private right of action for a person adversely affected by a violation of this bill. The bill does not supersede state laws regarding health insurers and dental or vision benefit plans.

Sustainable Skies Act

Sustainable Skies Act This bill allows a business-related tax credit through 2031 for each gallon of sustainable aviation fuel used by a taxpayer in the production of a qualified mixture (i.e., a mixture of sustainable aviation fuel and kerosene that is sold for use in certain U.S. aircraft). The bill generally defines sustainable aviation fuel as liquid fuel that consists of synthesized hydrocarbons, meets certain recognized international standards, is derived from biomass, waste streams, renewable energy sources, or gaseous carbon oxides, is not derived from palm fatty acid distillates, and achieves at least a 50% life cycle greenhouse gas emissions reduction in comparison with petroleum-based jet fuel. To be eligible for such credit, a taxpayer must meet certification requirements showing that the sustainable aviation fuel conforms with one of the life cycle greenhouse gas emissions reduction tests set forth in this bill.

Global Pandemic Prevention and Biosecurity Act This bill establishes a task force and requires the Department of State and the U.S. Agency for International Development (USAID) to take specified measures to respond to and prevent zoonotic (animal-to-human) disease outbreaks. Specifically, the bill establishes the Global Zoonotic Disease Task Force to ensure an integrated approach to preventing, detecting, preparing for, and responding to zoonotic spillover and zoonotic disease outbreaks that may pose a threat to global health security. The bill directs the State Department and the USAID to work with international stakeholders on measures that include (1) preventing zoonotic spillover events, (2) preventing degradation and fragmentation of forests and other ecosystems to minimize interactions between wildlife and human populations, and (3) strengthening global capacity for detection of zoonotic diseases with pandemic potential. Further, the USAID must develop and publish a strategy for food security, global health, and biodiversity protection, including information about zoonotic disease surveillance. To help implement and finance the strategy, the USAID must establish a Conservation Corps to provide Americans eligible for service abroad to deliver technical and strategic assistance. The bill also authorizes a program within the USAID to prevent spillover events, epidemics, and pandemics through specified activities.

MOM­MA’s Act

Mothers and Offspring Mortality and Morbidity Awareness Act or the MOMMA's Act This bill establishes various programs and requirements to reduce maternal mortality. It also increases federal tobacco taxes and equalizes the tax treatment of different tobacco products. Specifically, the Centers for Disease Control and Prevention (CDC) must provide technical assistance and best practices for collecting data, standardizing reporting, and preventing maternal mortality. The CDC must consult with the Health Resources and Services Administration (HRSA) on this assistance. The bill also provides statutory authority for CDC grants for state-based collaboratives to improve care immediately before and after birth and to improve maternal and infant health outcomes, and a HRSA program to improve the quality and safety of maternity care. Furthermore, the Department of Health and Human Services (HHS) must establish regional centers through health professional schools and training programs to educate health care providers about implicit bias and culturally competent care. In addition, the bill expands eligibility for Medicaid, the Children's Health Insurance Program (CHIP), and other benefits for pregnant and postpartum individuals. Specifically, it extends postpartum eligibility for Medicaid and CHIP for one year; provides coverage for oral health services for pregnant and postpartum individuals under Medicaid and CHIP; and extends postpartum eligibility for the Special Supplemental Nutrition Program for Women, Infants, and Children for two years. HHS must also take steps to publicize the benefits available to pregnant and postpartum individuals under Medicaid and CHIP, and the Centers for Medicare & Medicaid Services must provide guidance on Medicaid coverage for doula services.
