Medicare DMEPOS Market Pricing Program Act of 2012 - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services (HHS) to establish a market pricing program for durable medical equipment (DME), prosthetics, orthotics, and supplies (DMEPOS) as a replacement for the competitive acquisition program for DMEPOS, which is hereby terminated. Directs the Secretary to: (1) conduct annual market-priced auctions from among entities supplying market priced items and services in an eligible market area selected in the auction design, (2) establish a lead product for each of specified product categories, and (3) award a contract to any entity in an eligible market area in which an auction is conducted whose bid is below a clearing price equal to the highest cost bid that will meet capacity targets in the market area. Requires the Secretary to contract with an auction expert to assist in, and a market monitor to monitor, the design, development, and functioning of the auction. Adjusts the covered DME item update for 2012 through 2014 and each subsequent year.

Non-Federal Employee Whistleblower Protection Act of 2012 - Repeals and replaces provisions prohibiting reprisals against employees of civilian and defense contractors for disclosing to a federal official information relating to a substantial violation of law related to a public contract. Prohibits an employee of any non-federal employer receiving covered funds (i.e., a contract, grant, or other payment any portion of which is provided by the federal government) from being discharged, demoted, or discriminated against as a reprisal for initiating or participating in any proceeding related to the misuse of federal funds, reasonably opposing the misuse of federal funds, or disclosing to specified federal agencies or officials information that the employee reasonably believes is evidence of: (1) gross mismanagement of an agency contract or grant relating to covered funds; (2) a gross waste of covered funds; (3) a substantial and specific danger to public health or safety, or an abuse of authority, related to the implementation or use of covered funds; or (4) a violation of a law, rule, or regulation related to an agency contract, subcontract, or grant relating to covered funds. Sets forth provisions on: (1) time limitations for determinations by inspector generals on whether to conduct or continue an investigation of a reprisal complaint, (2) access by a complainant to the inspector general's investigative file, (3) the standard of proof for showing the occurrence of a reprisal, (4) agency actions to deny relief or remedy a reprisal, (5) the exhaustion of administrative remedies authorizing civil action by a complainant, and (6) nonenforceability of waivers and arbitration of disputes.

Veterans Health Access Act - Directs the Secretary of Veterans Affairs, when it is determined that Department of Veterans Affairs (VA) facilities are not capable of furnishing economic hospital care or medical services because of geographical inaccessibility or the care or services required, to determine whether or not to furnish such care or services to a veteran in a non-VA facility. Requires such determination to be made within 30 days following the request for such care or services. Amends the Wounded Warrior Act to authorize the Secretary of Defense (DOD) to allow any former member of the Armed Forces with a severe injury or illness to receive necessary medical and dental care in a non-VA facility when such care is determined by the member's physician to be in their best interest. Extends such authority through 2016.

Federal Executive Board Efficiency Act

Federal Executive Board Efficiency Act - Requires the Director of the Office of Personnel Management (OPM) to establish Federal Executive Boards, which are defined as interagency entities established in a geographic area with a high concentration of federal employees outside the Washington, D.C. metropolitan area to strengthen the management and administration of agency activities and coordination among local federal officers to implement national initiatives in that area. Requires each Board for a geographic area to consist of a senior officer for each agency in that area. Requires the Director to: (1) consider specified factors in determining the location for establishment of such Boards, such as whether a geographic area has a strong, viable, and active Federal Executive Association and whether such Association petitions to become a Board; and (2) provide for the administration and oversight of such Boards, including by establishing staffing and communications policies and performance standards for Board staff. Requires each Board to: (1) serve as an instrument of outreach for the national headquarters of agencies relating to agency activities in the geographic area; (2) provide a forum for the exchange of information relating to programs and management methods and problems between the national headquarters of agencies and the field; (3) develop local coordinated approaches to the development and operation of programs that have common characteristics; (4) communicate management initiatives and other concerns from federal officers and employees in the Washington, D.C. area to federal officers and employees in the geographic area to achieve better mutual understanding and support; (5) develop relationships with state and local governments and nongovernmental organizations to help fulfill the roles and responsibilities of that Board; and (6) facilitate communication, collaboration, and training to prepare the federal workforce for emergencies and continuity of operations. Requires the Director to: (1) establish a fund within OPM for financing essential Board functions, into which contributions from the headquarters of each participating agency shall be deposited; (2) submit annual reports to Congress and agencies on Board program outcomes and budget matters; and (3) report to specified congressional committees on essential Board functions, staffing requirements, and staffing and operating expenses.

Chesapeake Bay Watershed Fairness Act of 2012 - Amends the Food Security Act of 1985 to authorize the Secretary of Agriculture (USDA) to provide technical assistance to a Chesapeake Bay state (Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia, and the District of Columbia) to assist in developing water quality goals that reduce losses of nitrogen, phosphorus, and sediment from agricultural or nonindustrial private forest land in the Chesapeake Bay watershed. Authorizes the Secretary to provide financial and technical assistance to such a state to assist agricultural producers or owners to promote state water quality goals. Authorizes the Secretary to provide technical assistance to producers and owners in such watershed, either directly or through a technical service provider, an agricultural or silvicultural producer association, a state or local government, an Indian tribe, a farmer cooperative, an institution of higher education, or an organization with an established history of working with producers on agricultural land, to address: (1) local conservation priorities related to agricultural production, wildlife habitat development, and nonindustrial private forest land management; or (2) critical watershed-scale soil erosion, water quality, sediment reduction, or other natural resource concerns. Authorizes such technical assistance to be provided for: (1) conservation services to reduce losses of nitrogen, phosphorus, and sediment from agricultural and nonindustrial private forest land in such watershed; or (2) identifying best management practices and assessing practices required to achieve compliance with state and federal water quality laws. Authorizes funding for each of FY2013-FY2018 for such activities in such watershed.

Requires the study to examine the impact on: (1) national security, including how much implementing this policy will cost the Department of Homeland Security (DHS) in terms of manpower and other costs; (2) fraud, including how impacted federal agencies will address an increase in fraudulent documents; (3) U.S. workers, including the effectiveness of programs under the Social Security Act (such as Medicare), the national unemployment rate and unemployment compensation, and the implementation of the Patient Protection and Affordable Care Act; and (4) the U.S. economy, including federal Pell grants, the supplemental nutrition assistance program, college admissions and scholarships, and federal work-study programs. Directs the Secretary to refrain from implementing such policy until after the Comptroller General has reported to Congress on the results of such study.

Behavioral Health Information Technology Act of 2012

Behavioral Health Information Technology Act of 2012 - Amends the Public Health Service Act to include as a health care provider behavioral and mental health professionals, substance abuse professionals, psychiatric hospitals, certain community mental health centers, and residential or outpatient mental health or substance abuse treatment facilities. Amends title XVIII (Medicare) of the Social Security Act (SSA), with respect to incentives for meaningful use of certified electronic health records (EHR) technology under the pay schedule for physician's services, to include as eligible professionals clinical psychologists providing qualified psychologist services. Makes inpatient psychiatric hospitals eligible for payment for inpatient hospital services. Amends SSA title XIX (Medicaid) to treat as Medicaid providers: (1) public and certain private hospitals that are principally psychiatric hospitals, (2) certain community mental health centers, and (3) certain residential or outpatient mental health or substance abuse treatment facilities. Makes eligible professionals under the Medicaid program certain clinical psychologists providing qualified psychologist services. Authorizes a covered entity to submit to a Patient Safety Organization information on electronic health record (EHR)-related adverse events with respect to certified EHR technology the entity has used or provided. Specifies covered entities as certain EHR users, health information exchange entities, and health care professionals who use EHR technology. Defines an EHR-related adverse event as a defect, malfunction, or error in the certified health information technology or electronic health record used by a provider, or in the input or output of data maintained through such technology or record, that results or could reasonably result in harm to a patient. Limits electronic discovery (e-discovery) in any health care lawsuit against a covered entity relating to an Reallotted adverse event involving certified EHR technology to information: (1) related to that event, and (2) from the period in which the event occurred. Prohibits a claimant from commencing a lawsuit more than three years after the manifestation of injury or one year after the claimant discovers, or should have discovered, the injury, whichever occurs first. Requires tolling of this limitation, however, to the extent that the claimant is able to prove: (1) fraud; (2) intentional concealment; or (3) the presence of a foreign body, with no therapeutic or diagnostic purpose or effect, in the injured person. Subjects each party to such a lawsuit which is not a covered entity to proportionate liability only. Allows punitive damages against a covered entity only upon proof by clear and convincing evidence that the entity acted with reckless disregard for the claimant's health or safety. Shields covered entities, employees, agents, and representatives from civil liability for libel or slander arising from information or entries made in certified EHR technology, or transferred to another eligible provider, if the information, entries, or transfer were made in good faith and without malice.

Hydropower Regulatory Efficiency Act of 2012

Hydropower Regulatory Efficiency Act of 2012 - Amends the Public Utility Regulatory Policies Act of 1978 (PURPA) to increase from 5,000 to 10,000 kilowatts the size of small hydroelectric power projects which the Federal Energy Regulatory Commission (FERC) may exempt from its license requirements. Amends the Federal Power Act to revise the limitation on the maximum installation capacity of qualifying conduit hydropower facilities that are eligible for an exemption from licensing requirements. Requires any person, state, or municipality proposing to construct a qualifying conduit hydropower facility to file with FERC a notice of intent to do so. Requires FERC, within 15 days after receiving such a notice of intent, to make an initial determination as to whether the facility meets the qualifying criteria. Waives license requirements for any conduit hydroelectric facility that: (1) uses for electric power generation only the hydroelectric potential of a non-federally owned conduit, (2) has a maximum installed capacity of 5 megawatts, and (3) is not currently licensed or exempted from license requirements. Redefines "conduit" to specify any tunnel, canal, pipeline, aqueduct, flume, ditch, or similar manmade water conveyance operated for the distribution of water for agricultural, municipal, or industrial consumption and not primarily for the generation of electricity. Authorizes FERC to: (1) exempt from license requirements any electric power generation facility that utilizes for such generation only the hydroelectric potential of a conduit, and has an installed capacity or 40 megawatts or fewer; and (2) extend the preliminary permit period for up to 2 additional years beyond the 3 years otherwise allowed if it finds that the permittee has implemented activities under the permit in good faith and with reasonable diligence. Directs FERC to: (1) investigate the feasibility of issuing a license for hydropower development at nonpowered dams and closed loop pumped storage projects during a two-year period, and (2) hold workshops and develop hydropower pilot projects. Directs the Secretary of Energy (DOE) to study: (1) the technical flexibility that existing pumped storage facilities can provide to support intermittent renewable electric energy generation, including the potential for such facilities to be upgraded or retrofitted with advanced commercially available technology; and (2) the technical potential of existing pumped storage facilities and new advanced pumped storage facilities to provide grid reliability benefits.

Defines "forest product" as a product made from materials derived from the practice of forestry or the management of growing timber, including: (1) pulp, paper, paperboard, pellets, and wood products; and (2) any recycled products derived from forest materials.
