Directs the Chief to: (1) identify gaps between federal and state capabilities to prepare for and respond to emergencies; and (2) make recommendations to the Secretary of Defense on Guard programs and activities to address such gaps. Requires annual Department of Defense (DOD) budget justification documents to include separate amounts for Guard training and equipment for military assistance to civil authorities and other domestic operations. Expresses the sense of Congress calling for consideration of eligible reserve officers for promotion to the grades of lieutenant general or vice admiral on the active duty list. Treats service as a Bureau adjutant general as joint duty experience. Requires the position of Deputy Commander of the U.S. Northern Command to be filled by a qualified Guard officer eligible for promotion to the grade of lieutenant general. Requires an annual plan for the use of the Armed Forces and National Guard for responding to disasters and acts of terrorism.

State and Local Law Enforcement Discipline, Accountability, and Due Process Act of 2007 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to set forth the due process rights, including procedures, that shall be afforded a law enforcement officer (officer) who is the subject of an investigation or disciplinary hearing. Declares that an officer shall not be: (1) prohibited from engaging in political activity or be denied the right to refrain from engaging in such activity, except when on duty or acting in an official capacity; and (2) prohibited from being a candidate for an elective office or from serving in such elective office solely because of the officer's status as an officer, with exceptions. Requires that: (1) each agency adopt and thereafter comply with a written complaint procedure that meets specified requirements; and (2) an investigation based on a complaint from outside the agency commence not later than 15 days after receipt of the complaint by the agency employing the officer against whom the complaint has been made, or any other agency charged with investigating such complaint. Directs that any officer who is the subject of an investigation be notified of the investigation 24 hours before the commencement of questioning. Establishes rights of officers before and during questioning, including the right to counsel. Requires questioning to be conducted at reasonable hours. Prohibits an officer from being compelled to submit to the use of a lie detector.

Authorizes the Secretary to establish a CAFE credit trading program to allow a manufacturer that exceeds fuel economy standards to sell credits to another manufacturer.

Dedicates any cancellation only to deficit reduction or increase of a surplus. Provides for adjustment of: (1) committee allocations resulting from such rescission; and (2) applicable limits, as appropriate, under the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act). Sets forth procedures for expedited congressional consideration of a proposed rescission. Expresses the sense of Congress that no President or any executive branch official should condition the inclusion or exclusion, or threaten to condition the inclusion or exclusion, of any proposed cancellation in any special message under this Act upon any vote cast or to be cast by any Member of either chamber.

Keeping Families Together Act of 2007 - Amends the Public Health Service Act to allow the Secretary of Health and Human Services, acting through the Administrator of the Substance Abuse and Mental Health Services Administration, to award competitive matching grants to states to establish systems of care to provide mental health treatment and services to all children who are in the custody of the state or at-risk of entering into the custody of the state for the purpose of receiving mental health services. Requires states to use grant funds for certain activities, including to: (1) expand public health insurance programs to cover community-based mental health and family support services for such children and their families that will be sustainable after the grant has expired; (2) provide outreach and public education concerning available programs and activities; and (3) provide training and professional development for personnel who work with such children. Requires the Administrator to establish a task force to examine: (1) problems of mental health in the child welfare and juvenile justice systems; (2) issues with respect to access by children and youth to mental health services; and (3) the role of federal agencies in promoting access by children and youth to mental health services.

Downed Animal and Food Safety Protection Act - States that it is U.S. policy that all nonambulatory livestock in interstate and foreign commerce be immediately and humanely euthanized when such livestock become nonambulatory. Amends the Humane Methods of Slaughter Act of 1958 to direct the Secretary of Agriculture to promulgate regulations providing for the humane treatment, handling, and disposition of nonambulatory livestock by a covered entity, including a requirement that nonambulatory livestock be humanely euthanized. Requires an entity to: (1) humanely euthanize nonambulatory livestock (while not limiting the Secretary's ability to test nonambulatory livestock for disease, such as bovine spongiform encephalopathy); and (2) not move nonambulatory livestock while such livestock is conscious, and ensure that such livestock remains unconscious until death. Prohibits an inspector at an establishment covered by the Federal Meat Inspection Act to pass nonambulatory livestock, carcass, or carcass parts through inspection. Requires an inspector or other employee at such establishment to label such material as "inspected and condemned." Defines "covered entity," "nonambulatory livestock," and "humanely euthanize."

DRIVE Act

Dependence Reduction through Innovation in Vehicles and Energy Act or DRIVE Act - Directs the Director of the Office of Management and Budget to publish in the Federal Register an oil savings target and action plan for specified calendar years. Directs the Secretary of Energy to conduct a national media campaign to decrease oil consumption in the United States over the next decade. Directs the Secretary of Transportation to develop: (1) a fuel efficiency program for passenger car and light truck tires; (2) a program to designate Transit-Oriented Development Corridors; and (3) pilot projects to save oil by reducing vehicle miles traveled. Directs the Administrator of the Environmental Protection Agency to: (1) develop a testing and assessment program to determine the fuel economy of heavy duty vehicles; (2) establish a near-term electric transportation deployment program; and (3) implement a fuel and technology neutral program to reduce tailpipe emissions. Directs the Secretary of Transportation to prescribe average heavy duty vehicle fuel economy standards. Amends the Energy Policy Act of 2005 to direct the Secretary of Energy to make loan guarantees for eligible projects to improve hybrid technologies or to encourage production of efficient hybrid and advanced diesel vehicles. Requires a specified graduated percentage of passenger cars manufactured by light-duty motor vehicles manufacturers to be fuel choice enabling motor vehicles or alternative fuel automobiles. Amends the Internal Revenue Code to: (1) allow an advanced technology motor vehicles manufacturing tax credit; (2) allow a flexible fuel vehicle tax credit; (3) extend the alternative vehicle tax credit for new qualified hybrid motor vehicles; (4) allow a fuel-efficient tax credit for private fleets; (5) subject heavy vehicles to the depreciation limitation for certain luxury automobiles; (6) increase the alternative fuel vehicle refueling property tax credit; (7) provide a graduated tax credit for plug-in hybrid electric passenger and light truck vehicles; and (8) allow an idling reduction tax credit for heavy-duty diesel-powered on-highway vehicles. Establishes the Alternative Fueling Infrastructure Trust Fund. Authorizes the Secretary of Energy to obligate sums from the Fund for the Clean Cities grant program to increase the availability to consumers of ethanol, biodiesel, and other alternative fuels. Amends the Clean Air Act to prescribe minimum annual quantities of renewable fuel from cellulosic biomass. Directs the Secretary of Energy to: (1) require at least a 20% reduction in the federal fleets' petroleum consumption (including that at least 30% of federal vehicles required to be alternative fuel vehicles be flexible fuel hybrid or flexible fuel plug-in hybrid vehicles); (2) submit to Congress an action plan calling for a specified graduated percentage of the nation's ground fuel demand to be supplied by fuels derived from sources other than oil; and (3) carry out a plug-in hybrid electric vehicle prize program.

Condemns the ongoing abductions and murders of women and girls in Guatemala. Urges the government of Guatemala to recognize domestic violence and sexual harassment as criminal acts and encourages the government of Guatemala to investigate the killings of women, prosecute those responsible, and eliminate the tolerance of violence against women. Supports efforts to identify perpetrators and unknown victims through forensic analysis, including DNA testing. Encourages the Secretary of State to urge the government of Guatemala to: (1) honor the victims of the brutal murders and to continue to include in the Department of State's annual Country Reports on Human Rights Practices all instances of improper investigatory methods, threats against human rights activists, and the use of torture with respect to cases involving the murder and abduction of women and girls in Guatemala; (2) hold accountable those law enforcement and judicial officials who fail to investigate and prosecute the murders adequately; and (3) take measures to ensure that the special Guatemalan police and prosecutorial units are adequately staffed and have sufficient resources. Recommends that the Secretary develop a comprehensive plan to combat the growing problem of violence against women in Latin America.

No Child Left Behind Improvements Act of 2007 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to alter requirements for adequate yearly progress (AYP) assessments of student groups by: (1) allowing states to vary the number of students sufficient for such an assessment from local educational agency (LEA) to LEA and from school to school; (2) lowering the percentage of students in a failing group who must show improvement from the preceding year for a school to avoid corrective action; (3) changing the method of counting students in more than one group; (4) allowing states to use alternative methods of defining AYP; (5) exempting a higher percentage of students from such assessments; (6) giving states greater flexibility in the use of alternative assessments for disabled students and those not proficient in English; and (7) allowing multiple assessments of the same student prior to the following school year and measurement of the achievement of students as if they were in their prior grade. Provides that a state's intermediate academic achievement goals need not increase in equal increments for all groups. Requires that states be given maximum flexibility in devising academic improvement plans. Limits the implementation of sanctions to schools and LEAs that fail AYP standards in the same subject for the same group for two consecutive school years, and the provision of school transfers and supplemental services to students in the group who failed AYP standards. Provides further exceptions to and conditions on the application of corrective actions. Involves LEAs in the choice and critique of supplemental service providers as well as the provision of such services. Authorizes states, LEAs, and schools to defer implementation of certain corrective actions in any fiscal year when the amount appropriated under ESEA and the Individuals with Disabilities Act does not equal or exceed a specified authorized amount. Applies AYP assessments to private schools receiving benefits under ESEA. Allows states to deny such benefits to private schools that fail state AYP standards for three consecutive years and underperform local public schools.

Preserve Historic America Act of 2007 - Amends the Internal Revenue Code to modify the tax credit for rehabilitation of older and historic buildings by: (1) increasing from 20 to 25% the tax credit rate for certified historic structure rehabilitation expenditures; (2) permitting a building at least 50 years old to qualify for the rehabilitation tax credit (currently, a building must have been placed in service before 1936); (3) permitting qualified rehabilitated buildings to be used for lodging purposes; (4) limiting to 50% the basis reduction for buildings qualifying for the low-income housing and rehabilitation tax credits; (5) allowing an increased rehabilitation tax credit for certain buildings in difficult development areas or which qualify as small rehabilitation projects; (6) exempting tax credits for rehabilitation of certified historic structures from the calculation of the passive activity credit; and (7) permitting the assignment of rehabilitation tax credits. Allows a new tax credit for 20% of the cost of rehabilitating a qualified historic home. Defines "qualified historic home" as a certified historic structure which has been substantially rehabilitated and which is owned by the taxpayer and is or will be used as the taxpayer's principal residence.

Sets forth reporting and recordkeeping requirements for: (1) certain contract participants that enter into or execute "included energy transactions;" and (2) electronic trading facilities for energy commodities. Extends prohibitions against fraudulent transactions to: (1) filling an order by offset against the other person's order; and (2) knowingly and willfully becoming the buyer in respect to another person's selling order, or the seller in respect to another person's buying order, without the other person's prior consent. Empowers the Commodity Futures Trading Commission to impose civil and criminal penalties for price manipulation and other violations of such Act.

Prohibits an increase after: (1) April 1, 2006, in a premium, deductible, copayment, or other charge prescribed by the Secretary of Defense for medical and dental health care coverage for military personnel; and (2) September 30, 2007, in the dollar amount of a cost-sharing requirement under the DOD pharmacy benefits program. Prohibits: (1) charges for DOD inpatient care from exceeding $535 per day; and (2) beginning on April 1, 2006, an increase in premiums under TRICARE (a DOD managed health care program) for certain members of the Selected Reserve.

Minimum Wage for All Americans Act

Minimum Wage for All Americans Act - Amends the Fair Labor Standards Act of 1938 to apply federal minimum wage requirements to American Samoa. Increases the minimum wage in American Samoa: (1) to $3.55 an hour, beginning on the 60th day after enactment of this Act; and (2) by $0.50 an hour (or such lesser amount necessary to equal the federal minimum wage), beginning six months after enactment of this Act and every six months thereafter until such minimum wage equals the federal minimum wage. Provides that, if an employee is employed in an industry in American Samoa that, on enactment of this Act, is required under regulations concerning industries in American Samoa to pay a minimum wage rate that is higher than the minimum wage rate required by this Act, the minimum wage applicable to such employee shall be: (1) the minimum wage rate for the industry under the regulations on such enactment; and (2) increased by $0.50 an hour (or such lesser amount necessary to equal the federal minimum wage), beginning six months after enactment of this Act and every six months thereafter until such minimum wage equals the federal minimum wage.

Authorizes the Secretary of Agriculture to detain for examination, testing, or the taking of evidence: (1) any horse at any horse show, horse exhibition, or horse sale or auction which is sore or which the Secretary has probable cause to believe is sore; and (2) any horse or other equine which the Secretary has probable cause to believe is being shipped, transported, moved, delivered, received, possessed, purchased, sold, or donated in violation of such prohibition.

Declares that any new federal tax system should be a simple and fair system that: (1) applies a low rate to all Americans; (2) provides tax relief for working Americans; (3) protects the rights of taxpayers and reduces tax collection abuses; (4) eliminates the bias against savings and investment; (5) promotes economic growth and job creation; and (6) does not penalize marriage or families. Requires that the new federal tax system be approved by Congress in its final form by July 4, 2010.

Genetic Information Nondiscrimination Act of 2008

Genetic Information Nondiscrimination Act of 2007 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to expand the prohibition against discrimination by group health plans and health insurance issuers in the group and individual markets on the basis of genetic information or services to prohibit: (1) enrollment and premium discrimination based on information about a request for or receipt of genetic services; and (2) requiring genetic testing. Sets forth penalties for violations. Amends title XVIII (Medicare) of the Social Security Act to prohibit issuers of Medicare supplemental policies from discriminating on the basis of genetic information. Extends medical privacy and confidentiality rules to the disclosure of genetic information. Makes it an unlawful employment practice for an employer, employment agency, labor organization, or training program to discriminate against an individual or deprive such individual of employment opportunities because of genetic information. Prohibits the collection and disclosure of genetic information, with certain exceptions. Establishes a Genetic Nondiscrimination Study Commission to review the developing science of genetics and advise Congress on the advisability of providing for a disparate impact cause of action under this Act.

Stroke Treatment and Ongoing Prevention Act - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to carry out a national education campaign to promote stroke prevention and increase the number of stroke patients who seek immediate treatment. Requires the Secretary, acting through the Centers for Disease Control (CDC), to maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse by collecting specific data points and benchmarks for stroke care analysis and by compiling and disseminating information on state, local, and private care system achievements and problems. Defines "stroke" as an attack in which blood flow to the brain is interrupted or in which a blood vessel or aneurysm in the brain breaks or ruptures. Includes stroke and traumatic injury prevention, diagnosis, and treatment within the grant program for emergency medicine residency training. Authorizes the Secretary, through the Administrator of the Health Resources and Services Administration (HRSA), to make grants to qualified entities for education programs for health care professionals in the use of diagnostic approaches, technologies, and therapies for stroke and traumatic injury prevention, diagnosis, treatment, and rehabilitation. Gives preference to qualified entities that will train professionals that serve areas with a significant incidence of stroke or traumatic injuries. Authorizes the Secretary, through the Director of the Office for the Advancement of Telehealth, to make up to seven grants to states and to consortia of public and private entities in any non-grantee state to conduct a five-year pilot project to improve stroke patient outcomes by coordinating health care through telehealth networks.

Securing America's Future Economy Commission Act, or SAFE Commission Act - Establishes the Securing America's Future Economy (SAFE) Commission to develop legislation designed to address: (1) the unsustainable imbalance between long-term federal spending commitments and projected revenues; (2) increases in net national savings to provide for domestic investment and economic growth; (3) the implications of foreign ownership of federally issued debt instruments; and (4) revision of the budget process to place greater emphasis on long-term fiscal issues. Requires the Commission to: (1) develop one or two methods for estimating the cost of legislation as an alternative to the current Congressional Budget Office (CBO) method; and (2) hold at least one town-hall style public hearing within each federal reserve district. Requires the Commission to submit a legislative proposal to Congress and the President. Authorizes the President to submit to Congress an alternative proposal. Authorizes the Committee on the Budget of either chamber to publish its own alternative proposal in the Congressional Record. Sets forth procedures for consideration of such legislation. Requires CBO to prepare a long-term cost estimate and have it published in the Congressional Record as expeditiously as possible whenever requested to do so by the Commission, the President, or the chairman or ranking minority member of the Committee on the Budget of either chamber.

Sets forth a schedule of additional benefit increases for such beneficiaries (and related beneficiaries), with percentages declining from 55% to 5% keyed to the year an individual became eligible for (early retirement) benefits between 1978 and 1989. Provides for an election to receive such payments in a lump sum.

Sets forth criteria for the Attorney General to consider in identifying a National Threat Drug Gang, including (1) ties to international terrorist organizations or state-sponsored terrorism; (2) the volume of controlled substances imported or distributed by such gangs; and (3) the threat to children and schools in the United States.
