Ready to Work Act of 2016 This bill amends title III (Unemployment Insurance) of the Social Security Act to allow states, rather than the Department of Labor, to determine whether an individual claiming unemployment compensation is an individual for whom suitable work is only available in an occupation that regularly conducts drug testing. The final rule issued by Labor on August 1, 2016, entitled "Federal-State Unemployment Compensation Program; Middle Class Tax Relief and Job Creation Act of 2012 Provision on Establishing Appropriate Occupations for Drug Testing of Unemployment Compensation Applicants" (81 Fed. Reg. 50298), shall have no force or effect.

This bill amends the Internal Revenue Code, with respect to the tax credit for the production of electricity from advanced nuclear power facilities, to: (1) establish requirements for the allocation of unutilized portions of the national megawatt capacity limitation, and (2) allow public entities to transfer the credit to project partners. If a portion of the 6,000 national megawatt capacity limitation for the credit is unutilized after December 31, 2020, the Internal Revenue Service must allocate the unutilized capacity: (1) first to facilities that were placed in service on or before December 31, 2020, and did not receive an allocation equal to their full nameplate capacity, and (2) then to facilities placed in service after December 31, 2020, in the order in which the facilities are placed in service. The placed-in-service sunset date of January 1, 2021, does not apply to the allocations of unutilized national megawatt capacity. Qualified public entities may transfer the credit to an eligible project partner. A "qualified public entity" is: (1) a federal, state, or local government or any political subdivision, agency, or instrumentality thereof; (2) a mutual or cooperative electric company; or (3) a not-for-profit electric utility which has or had received a loan or loan guarantee under the Rural Electrification Act of 1936. An "eligible project partner" includes any person who: (1) is responsible for, or is participating in, the design or construction of the facility; (2) participates in the provision of nuclear steam or nuclear fuel to the facility, or (3) has an ownership interest in the facility.

Preventing Iranian Destabilization of Iraq Act of 2016

Preventing Iranian Destabilization of Iraq Act of 2016 This bill declares it shall be the policy of the United States to impose sanctions with respect to terrorist organizations and foreign countries, including the government of Iran, that threaten the peace or stability of Iraq. The bill directs the President to impose sanctions to block transactions in property and interests in property in the United States of, and the Department of State or the Department of Homeland Security (DHS) to deny admissions into the United States or revoke the visa of, any foreign person that State or DHS determines: has knowingly committed, or poses a significant risk of committing, violence that threatens the peace or stability of Iraq or that undermines economic reconstruction, political reform, or humanitarian efforts in Iraq; has knowingly materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services in support of, any such act; or is owned or controlled by, or has acted on behalf of, a foreign person that has carried out any such act or activity. Such admissions-related sanctions shall not apply if a person's admission is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations or other applicable international obligations. The President may waive the application of sanctions under this bill for up to 90 days if the President provides prior certification that the waiver is vital to U.S. national security interests. The sanction provisions of this bill shall cease to be effective on January 1, 2022. It is the sense of Congress that the government of Iran has committed acts of violence, and poses a significant risk of committing further acts of violence, that threaten the peace or stability of Iraq. The bill directs the President to determine whether specified Iranian officials are responsible for engaging in acts or activities described in this bill and, if so, to impose admissions-related sanctions on such officials. The President must report, every 180 days for 5 years, on Iranian activities in Iraq, including Iran's support for Iraqi militias or political parties.

Local Coverage Determination Clarification Act of 2016

Local Coverage Determination Clarification Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to revise the process by which Medicare administrative contractors (MACs) issue and reconsider local coverage determinations (LCDs) that: (1) are new, (2) restrict or substantively revise existing LCDs, or (3) are otherwise specified in regulation. (MACs are private insurers that process Medicare claims within specified geographic areas.) Before such an LCD may take effect, the MAC issuing the determination must, with respect to each geographic area to which the determination applies: publish online a proposed version of the determination and other specified, related information; convene one or more public meetings to review the draft determination, receive comments, and secure the advice of an expert panel; post online a record of the minutes from each such meeting; provide a period for submission of written public comments; and post online specified information related to the rationale for the final determination. Upon the filing of an applicable request by an interested party with regard to the reconsideration of a specified LCD, the MAC that issued the determination shall: provide specified information related to whether the determination failed to correctly apply qualifying relevant evidence, exceeds the scope of its intended purpose, fails to apply as intended, or is otherwise erroneous; preserve the determination, modify the determination, or rescind the determination in part; and make publicly available a written description of such action. An interested party may appeal a reconsideration decision to the Centers for Medicare & Medicaid Services (CMS). CMS shall appoint a Medicare Reviews and Appeals Ombudsman to carry out specified duties with regard to LCDs.

Stop Dangerous Sanctuary Cities Act This bill prohibits a sanctuary jurisdiction from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program. A sanctuary jurisdiction is a state or political subdivision that has a statute, policy, or practice in effect that prohibits or restricts: (1) information sharing about an individual's immigration status, or (2) compliance with a lawfully issued detainer request or notification of release request. A state or political subdivision that complies with a detainer is deemed to be an agent of the Department of Homeland Security and is authorized to take actions to comply with the detainer. The bill limits the liability of a state or political subdivision, or an officer or employee of such state or political subdivision, for actions in compliance with the detainer.

Small Business Health Care Relief Act of 2016

Small Business Health Care Relief Act This bill amends the Internal Revenue Code, the Patient Protection and Affordable Care Act (PPACA), and other laws to exempt qualified small employer health reimbursement arrangements (HRA) from certain requirements that apply to group health plans. A qualified small employer HRA is offered by employers that have fewer than 50 full-time employees and do not offer group health plans to any of their employees. A qualified small employer HRA must: be provided on the same terms to all eligible employees of the employer; be funded solely by the employer without salary reduction contributions; provide, after an employee provides proof of coverage, for the payment or reimbursement of medical expenses of the employee and family members; and limit annual payments and reimbursements to specified dollar amounts. HRAs that meet these requirements are not considered group health plans and are exempt from various requirements that apply to group health plans, including coverage and cost-sharing requirements. (Under current law, employers that sponsor group health plans that do not meet specified requirements are subject to an excise tax.) Coverage and payments under a qualified HRA are excluded from gross income, unless the employee does not have minimum essential coverage for the month in which the medical care was provided. Employers offering a qualified HRA must notify employees in advance regarding permitted benefits and report benefit information on W-2 forms and to health exchanges. The bill sets forth requirements for determining whether an employee covered under an HRA is also eligible for premium subsidies under PPACA.

Protecting Internet Freedom Act This bill prohibits the Assistant Secretary of Commerce for Communications and Information from allowing the National Telecommunications and Information Administration's responsibility for Internet domain name system functions, including the authoritative root zone file and the performance of the Internet Assigned Numbers Authority functions, to cease unless a federal statute enacted after enactment of this bill expressly grants the Assistant Secretary such authority. The Assistant Secretary must certify to Congress that the U.S. government has: (1) secured sole ownership of the .gov and .mil top-level domains, and (2) entered into a contract with the Internet Corporation for Assigned Names and Numbers that provides the U.S. government with exclusive control and use of those domains in perpetuity.

PADME Act

Patient Access to Durable Medical Equipment Act of 2016 or the PADME Act This bill amends title XVIII (Medicare) of the Social Security Act to establish a bid ceiling for durable medical equipment (such as wheelchairs) under Medicare's competitive acquisition program, through which rates are set according to a bidding process rather than by an established fee schedule. Specifically, the bid ceiling for such an item shall not be less than the fee schedule amount that would otherwise be determined. Under current law, the Centers for Medicare & Medicaid Services (CMS) must use payment information from competitive acquisition programs to make payment adjustments for areas outside of such programs. The bill requires CMS, in making these adjustments, to account for stakeholder input. In addition, CMS must account for a comparison of competitive acquisition areas and other areas with respect to the following factors: average travel distance and cost associated with furnishing items and services, barriers to access, average delivery time, average volume of items and services furnished by suppliers, and number of suppliers. In addition, CMS shall delay by 15 months the full implementation of new Medicare payment rates for durable medical equipment. On a monthly basis, CMS must publish on its website the results of the monitoring of health outcomes and Medicare beneficiaries' access to durable medical equipment.

WINGMAN Act

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide an accredited, permanent congressional employee with read-only remote access to the electronic Veterans Benefits Administration (VBA) claims records system of a represented veteran, regardless of whether the employee is acting under a power of attorney executed by the veteran. The VA shall ensure that access does not allow the employee to modify system data. An employee must complete the VA certification process required of agents or attorneys in order to have system access. Each Member of Congress who elects to have an employee participate in the system shall bear the certification cost, which shall be paid from the Member's representational allowance. Information access by an employee shall be deemed: (1) a covered disclosure requiring prior consent, with specified exceptions; and (2) a permitted disclosure relating to the privacy of individually identifiable health information. The VA may not recognize an employee for purposes of preparation, presentation, and prosecution of VA claims by reason of such system access. "Accredited, permanent congressional employee" means an employee of a Member of Congress who assists constituents with issues regarding federal departments or agencies. "Electronic VBA claims records system" means the VA system that provides claim status information, including information about medical records, compensation and pension exams records, rating decisions, a statement of the case and a supplementary statement of the case, a notice of disagreement, and Form-9.

The bill includes exceptions for: (1) required disclosures regarding prohibited tax shelter transactions; and (2) contributions by the organization's officers, directors, or five highest compensated employees (including compensation paid by related organizations).
